		<section id="id7eca2c13241d4677a74290639c930109" section-type="resolved"><text>That the bill from the House of Representatives
		(H.R. 3321) entitled <quote>An Act to facilitate the hosting in the United
		States of the 34th America’s Cup by authorizing certain eligible vessels to
		participate in activities related to the competition, and for other
		purposes.</quote>, do pass with the following</text>
		</section><amendment><amendment-instruction blank-lines-after="0"><text>Strike all after
	 the enacting clause and insert the
	 following:</text></amendment-instruction><amendment-block blank-lines-after="1" changed="added" reported-display-style="italic">
				<section id="H4977B35DCAC34E3EB5DE3415B433C334" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
		<quote><short-title>America’s Cup Act of
		2011</short-title></quote>.</text>
				</section><section id="H0EF3F1E9C1ED45558C9AD19F18579991"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
					<paragraph id="H32EFC2BCFD754779A3D4286B97D4DDB5"><enum>(1)</enum><header>34th america’s
		cup</header><text>The term <term>34th America’s Cup</term>—</text>
						<subparagraph id="H48B1984644894E0792D51946226F4706"><enum>(A)</enum><text>means the sailing
		competitions, commencing in 2011, to be held in the United States in response
		to the challenge to the defending team from the United States, in accordance
		with the terms of the America’s Cup governing Deed of Gift, dated October 24,
		1887; and</text>
						</subparagraph><subparagraph id="H01EF01FB6891400AA5509C7E6CF9CED6"><enum>(B)</enum><text>if
		a United States yacht club successfully defends the America’s Cup, includes
		additional sailing competitions conducted by America’s Cup Race Management
		during the 1-year period beginning on the last date of such defense.</text>
						</subparagraph></paragraph><paragraph id="H09439F50E220451C90A3037F72836E84"><enum>(2)</enum><header>America’s cup
		race management</header><text>The term <term>America’s Cup Race
		Management</term> means the entity established to provide for independent,
		professional, and neutral race management of the America’s Cup sailing
		competitions.</text>
					</paragraph><paragraph id="H87FBE71582E74206B4CD4DF611ED7AFD"><enum>(3)</enum><header>Eligibility
		certification</header><text>The term <term>Eligibility Certification</term>
		means a certification issued under section 4.</text>
					</paragraph><paragraph id="HA9416440F33F4929990DA15225CCF6FD"><enum>(4)</enum><header>Eligible
		vessel</header><text>The term <term>eligible vessel</term> means a competing
		vessel or supporting vessel of any registry that—</text>
						<subparagraph id="H75DDAEEF0A9343958E99729989975862"><enum>(A)</enum><text>is
		recognized by America’s Cup Race Management as an official competing vessel, or
		supporting vessel of, the 34th America’s Cup, as evidenced in writing to the
		Administrator of the Maritime Administration of the Department of
		Transportation;</text>
						</subparagraph><subparagraph id="H82C1CF0FB80E4E698CDD46539CA780F2"><enum>(B)</enum><text>transports not
		more than 25 individuals, in addition to the crew;</text>
						</subparagraph><subparagraph id="H1A4A8DC646E74554A4468B61B3CDC6BC"><enum>(C)</enum><text>is
		not a ferry (as defined under
		<external-xref legal-doc="usc" parsable-cite="usc/46/2101">section
		2101(10b)</external-xref> of title 46, United States Code);</text>
						</subparagraph><subparagraph id="H8EE590DD433143A1BEC11838BA82825F"><enum>(D)</enum><text>does not transport
		individuals in point-to-point service for hire; and</text>
						</subparagraph><subparagraph id="HA8660D4C53A640ABA1C46BADAEA48E00"><enum>(E)</enum><text>does not transport
		merchandise between ports in the United States.</text>
						</subparagraph></paragraph><paragraph id="H357BD6B734B7435CAA647E924B809361"><enum>(5)</enum><header>Supporting
		vessel</header><text>The term <term>supporting vessel</term> means a vessel
		that is operating in support of the 34th America’s Cup by—</text>
						<subparagraph id="H794512C9A257421B808BDF4E639C324E"><enum>(A)</enum><text>positioning a
		competing vessel on the race course;</text>
						</subparagraph><subparagraph id="H76C467AA91784BDBB375A63463B1ABDD"><enum>(B)</enum><text>transporting
		equipment and supplies utilized for the staging, operations, or broadcast of
		the competition; or</text>
						</subparagraph><subparagraph id="H82D3BCF7E71E4A20A3632A45BF0FD70B"><enum>(C)</enum><text>transporting
		individuals who—</text>
							<clause id="HD1A266D45D7C4409A190BDEDFE28A6B8"><enum>(i)</enum><text>have not
		purchased tickets or directly paid for their passage; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H5C44B237068E4CB18AD9A7C111D84BDE"><enum>(ii)</enum><text>who are engaged
		in the staging, operations, or broadcast of the competition, race team
		personnel, members of the media, or event sponsors.</text>
							</clause></subparagraph></paragraph></section><section id="H718ABAA9DD344FC6945A1624540A7145"><enum>3.</enum><header>Authorization of
		eligible vessels</header><text display-inline="no-display-inline">Notwithstanding sections 55102, 55103, and
		55111 of title 46, United States Code, an eligible vessel, operating only in
		preparation for, or in connection with, the 34th America’s Cup competition, may
		position competing vessels and may transport individuals and equipment and
		supplies utilized for the staging, operations, or broadcast of the competition
		from and around the ports in the United States.</text>
				</section><section id="H6E08E782CFF44AF0BA986DFA01D97CF7"><enum>4.</enum><header>Certification</header>
					<subsection id="H3FEE0A4C9B7E4AD5807E993E4B643A76"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">A vessel may not operate under section 3
		unless the vessel has received an Eligibility Certification.</text>
					</subsection><subsection id="H58E8A0D8B5AD490693A1AAB0423B2759"><enum>(b)</enum><header>Issuance</header><text display-inline="yes-display-inline">The Administrator of the Maritime
		Administration of the Department of Transportation is authorized to issue an
		Eligibility Certification with respect to any vessel that the Administrator
		determines, in his or her sole discretion, meets the requirements set forth in
		section 2(4).</text>
					</subsection></section><section id="H4E9482467C734EE6BBECA66ECAA1C697"><enum>5.</enum><header>Enforcement</header><text display-inline="no-display-inline">Notwithstanding sections 55102, 55103, and
		55111 of title 46, United States Code, an Eligibility Certification shall be
		conclusive evidence to the Secretary of the Department of Homeland Security of
		the qualification of the vessel for which it has been issued to participate in
		the 34th America’s Cup as a competing vessel or a supporting vessel.</text>
				</section><section id="HC4F8AA35AB7C4A5891995EB9578AFF02"><enum>6.</enum><header>Penalty</header><text display-inline="no-display-inline">Any vessel participating in the 34th
		America’s Cup as a competing vessel or supporting vessel that has not received
		an Eligibility Certification or is not in compliance with
		<external-xref legal-doc="usc" parsable-cite="usc/46/12112">section
		12112</external-xref> of title 46, United States Code, shall be subject to the
		applicable penalties provided in chapters 121 and 551 of title 46, United
		States Code.</text>
				</section><section commented="no" id="H027398583F01471A95DD923C13419204"><enum>7.</enum><header>Waivers</header>
					<subsection commented="no" id="H2D0FC9F23FB840519373584FD277B7A0"><enum>(a)</enum><header>In
		general</header><text>Notwithstanding sections 12112 and 12132 and
		<external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/551">chapter 551</external-xref> of title 46,
		United States Code, the Secretary of the department in which the Coast Guard is
		operating may issue a certificate of documentation with a coastwise endorsement
		for each of the following vessels:</text>
						<paragraph commented="no" id="HEBC45DC951AE4DC9B6F225663FBAEB23"><enum>(1)</enum><text>M/V GEYSIR (United
		States official number 622178).</text>
						</paragraph><paragraph commented="no" id="H2C0A76EB38B94FD6BD0DF284B844EAAA"><enum>(2)</enum><text>OCEAN VERITAS (IMO
		number 7366805).</text>
						</paragraph><paragraph commented="no" id="H6D864326BD5441709AF2D9881F564B05"><enum>(3)</enum><text>LUNA (United
		States official number 280133).</text>
						</paragraph></subsection><subsection commented="no" id="H3FC72D3C71554BEB970536FDC640CB13"><enum>(b)</enum><header>Documentation of
		LNG tankers</header>
						<paragraph commented="no" id="H1DF22BA3608F41D2A8906412A1D8E899"><enum>(1)</enum><header>In
		general</header><text>Notwithstanding sections 12112 and 12132 and
		<external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/551">chapter 551</external-xref> of title 46,
		United States Code, the Secretary of the department in which the Coast Guard is
		operating may issue a certificate of documentation with a coastwise endorsement
		for each of the following vessels:</text>
							<subparagraph commented="no" id="H0D8E2ED446494BF8B462B1B8F84CA32A"><enum>(A)</enum><text>LNG GEMINI (United
		States official number 595752).</text>
							</subparagraph><subparagraph commented="no" id="HFDFE0CA8E0D54CB1BE73E5619B3A48C0"><enum>(B)</enum><text>LNG LEO (United
		States official number 595753).</text>
							</subparagraph><subparagraph commented="no" id="HD8FDA607222041C885C23B658F41D93E"><enum>(C)</enum><text>LNG VIRGO (United
		States official number 595755).</text>
							</subparagraph></paragraph><paragraph commented="no" id="H7D6ACE4C0DD34AE4BBE64F2A2F40E7FE"><enum>(2)</enum><header>Limitation on
		operation</header><text>Coastwise trade authorized under paragraph (1) shall be
		limited to carriage of natural gas, as that term is defined in section 3(13) of
		the Deepwater Port Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/33/1502">33 U.S.C. 1502(13)</external-xref>).</text>
						</paragraph><paragraph commented="no" id="H8085D879CBFA48ED831D14972F59C2B5"><enum>(3)</enum><header>Termination of
		effectiveness of endorsements</header><text>The coastwise endorsement issued
		under paragraph (1) for a vessel shall expire on the date of the sale of the
		vessel by the owner of the vessel on the date of enactment of this Act to a
		person who is not related by ownership or control to such owner.</text>
						</paragraph></subsection><subsection commented="no" id="H1426374BC1B94BA9B76966BEE21BFFB9"><enum>(c)</enum><header>Operation of a
		dry dock</header><text>A vessel transported in Dry Dock #2 (State of Alaska
		registration AIDEA FDD–2) is not merchandise for purposes of
		<external-xref legal-doc="usc" parsable-cite="usc/46/55102">section
		55102</external-xref> of title 46, United States Code, if, during such
		transportation, Dry Dock #2 remains connected by a utility or other connecting
		line to pierside moorage.</text>
					</subsection></section></amendment-block></amendment></engrossed-amendment-body>
