		<official-title>To facilitate the hosting in the United States of the
		  34th America’s Cup by authorizing certain eligible vessels to participate in
		  activities related to the competition.</official-title>

		<section id="HDBFC600C45FA4B788AE30230A68CB37F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>America’s Cup Act of
			 2011</short-title></quote>.</text>
		</section><section id="H3836E0BB492F42329A2A69AE21CECB89"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H3513F3CDBF7F4EECB0BF5DA3E452F488"><enum>(1)</enum><header>34th america’s
			 cup</header><text>The term <term>34th America’s Cup</term> means the America’s
			 Cup World Series held in San Diego, California, from November 12–20,
			 2011.</text>
			</paragraph><paragraph id="HABC3B0BDC64E4EC5B02788C365774809"><enum>(2)</enum><header>America’s cup
			 race management</header><text>The term <term>America’s Cup Race
			 Management</term> means the entity established to provide for independent,
			 professional, and neutral race management of the America’s Cup sailing
			 competitions.</text>
			</paragraph><paragraph id="HBAA2D5A632A24C078D68BAE784553874"><enum>(3)</enum><header>Eligibility
			 certification</header><text>The term <term>Eligibility Certification</term>
			 means a certification issued under section 4.</text>
			</paragraph><paragraph id="H5FCED51900D74540A30339F59865710A"><enum>(4)</enum><header>Eligible
			 vessel</header><text>The term <term>eligible vessel</term> means a competing
			 vessel or supporting vessel of any registry that—</text>
				<subparagraph id="H33F2D1EFC0464273908187A1D83AEB8C"><enum>(A)</enum><text>is recognized by
			 America’s Cup Race Management as an official competing vessel, or supporting
			 vessel of, the 34th America’s Cup, as evidenced in writing to the Administrator
			 of the Maritime Administration of the Department of Transportation;</text>
				</subparagraph><subparagraph id="HFA825032B609425CACE66A8506BBC07F"><enum>(B)</enum><text>transports not
			 more than 25 individuals, in addition to the crew;</text>
				</subparagraph><subparagraph id="H03B730B787D3468C84A3BEB3F21D7C8F"><enum>(C)</enum><text>is not a ferry (as
			 defined under section 2101(10b) of title 46, United States Code);</text>
				</subparagraph><subparagraph id="H13F756862FF44C9F8542C858BBC47F90"><enum>(D)</enum><text>does not transport
			 individuals in point-to-point service for hire; and</text>
				</subparagraph><subparagraph id="H54D61AC593154C46A340715D664482A5"><enum>(E)</enum><text>does not transport
			 merchandise between ports in the United States.</text>
				</subparagraph></paragraph><paragraph id="H83ABFF211615484E95003626D532C067"><enum>(5)</enum><header>Supporting
			 vessel</header><text>The term <term>supporting vessel</term> means a vessel
			 that is operating in support of the 34th America’s Cup by—</text>
				<subparagraph id="HF54A133093094B95B5E3E2ABBED213E2"><enum>(A)</enum><text>positioning a
			 competing vessel on the race course;</text>
				</subparagraph><subparagraph id="H51961238F0844AB4A1A38C639D612453"><enum>(B)</enum><text>transporting
			 equipment and supplies utilized for the staging, operations, or broadcast of
			 the competition; or</text>
				</subparagraph><subparagraph id="H3C08714D5DF44A908D398306C9F1F3B6"><enum>(C)</enum><text>transporting
			 individuals who—</text>
					<clause id="H13C3F4D1F29C4C77BD5F441DF5486B28"><enum>(i)</enum><text>have
			 not purchased tickets or directly paid for their passage; and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H827EB58071024FD88CE47C55BF297EAB"><enum>(ii)</enum><text>who are engaged
			 in the staging, operations, or broadcast of the competition, race team
			 personnel, members of the media, or event sponsors.</text>
					</clause></subparagraph></paragraph></section><section id="HE556AA38296F44478F720671F1596DEA"><enum>3.</enum><header>Authorization of
			 eligible vessels</header><text display-inline="no-display-inline">Notwithstanding sections 55102, 55103, and
			 55111 of title 46, United States Code, an eligible vessel, operating only in
			 preparation for, or in connection with, the 34th America’s Cup competition, may
			 position competing vessels and may transport individuals and equipment and
			 supplies utilized for the staging, operations, or broadcast of the competition
			 from and around the ports in the United States.</text>
		</section><section id="H9F36FDE7BF334F6DB69A128B68A4C35B"><enum>4.</enum><header>Certification</header>
			<subsection id="H81A5BD6AEFD142BAA88717D8EBD4869A"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">A vessel may not operate under section 3
			 unless the vessel has received an Eligibility Certification.</text>
			</subsection><subsection id="H9AC936EFA971449CBF619AB0204D80C2"><enum>(b)</enum><header>Issuance</header><text display-inline="yes-display-inline">The Administrator of the Maritime
			 Administration of the Department of Transportation is authorized to issue an
			 Eligibility Certification with respect to any vessel that the Administrator
			 determines, in his or her sole discretion, meets the requirements set forth in
			 section 2(4).</text>
			</subsection></section><section id="H61FDDF7B4200403483DADDD69A17A866"><enum>5.</enum><header>Enforcement</header><text display-inline="no-display-inline">Notwithstanding sections 55102, 55103, and
			 55111 of title 46, United States Code, an Eligibility Certification shall be
			 conclusive evidence to the Secretary of the Department of Homeland Security of
			 the qualification of the vessel for which it has been issued to participate in
			 the 34th America’s Cup as a competing vessel or a supporting vessel.</text>
		</section><section id="HB14744ED41F74255A2949B707E8EB19E"><enum>6.</enum><header>Penalty</header><text display-inline="no-display-inline">Any vessel participating in the 34th
			 America’s Cup as a competing vessel or supporting vessel that has not received
			 an Eligibility Certification or is not in compliance with section 12112 of
			 title 46, United States Code, shall be subject to the applicable penalties
			 provided in chapters 121 and 551 of title 46, United States Code.</text>
