		<section id="H04D9E16384C34DE19EFA7CA74C9E9912" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>State Transportation Emergency Flexibility Act of
			 2011</short-title></quote>.</text>
		</section><section id="HE2E1C88B3C2F467097BFE30EE8CA32C5"><enum>2.</enum><header>Funding
			 flexibility for transportation emergencies</header>
			<subsection id="HBF554A0FD87D4F54AB83C3381559E9B1"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 3 of title
			 23, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H7961B7E0A1EE4237B067F8BCCFF0602C" style="USC">
					<section id="HEA3894C3C23C431698F61B6A3607D1B6"><enum>330.</enum><header>Funding
				flexibility for transportation emergencies</header>
						<subsection id="H2D491E12645146F09ACA8E8AE0BC1CB4"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of law, the chief executive of a State, after declaring an
				emergency with respect to a transportation facility under subsection (b), may
				use any covered funds of the State to repair or replace the transportation
				facility.</text>
						</subsection><subsection id="H93C40B49B03A4CA38EB50CACE91102A9"><enum>(b)</enum><header>Declaration of
				emergency</header><text display-inline="yes-display-inline">To declare an
				emergency with respect to a transportation facility for purposes of subsection
				(a), the chief executive of a State shall provide to the Secretary written
				notice of the declaration, which shall specify—</text>
							<paragraph id="H19835C1224954C6896AF90A03C517077"><enum>(1)</enum><text>the
				emergency;</text>
							</paragraph><paragraph id="HC21A2EA11694496393CAAABD64268CF8"><enum>(2)</enum><text>the affected
				transportation facility; and</text>
							</paragraph><paragraph id="H67999B88A91843198717E27ABEF4C604"><enum>(3)</enum><text>the repair or
				replacement activities to be carried out.</text>
							</paragraph></subsection><subsection id="H3E488A72D44B479A934D5DFA7A5517F2"><enum>(c)</enum><header>Definitions</header><text>In
				this section, the following definitions apply:</text>
							<paragraph id="H1F61AF15331641A5AB13954182A16E44"><enum>(1)</enum><header>Covered
				funds</header><text display-inline="yes-display-inline">The term <term>covered
				funds</term> means any amounts apportioned to a State under this title or
				section 1303 or 1404 of SAFETEA–LU (23 U.S.C. 101 note; 402 note), including
				any such amounts required to be set aside for a purpose other than the repair
				or replacement of a transportation facility under this section.</text>
							</paragraph><paragraph id="HDB40192938B849D3B022BC30E5A057AC"><enum>(2)</enum><header>Emergency</header><text display-inline="yes-display-inline">The term <term>emergency</term> means any
				event or condition that—</text>
								<subparagraph id="H8C8F3781963243869A4A4A2DB4524915"><enum>(A)</enum><text>affects a
				transportation facility; and</text>
								</subparagraph><subparagraph id="H62ABFC9B34154458B27A8DC6401E98BD"><enum>(B)</enum><text>is determined to
				be an emergency by the chief executive of a State.</text>
								</subparagraph></paragraph><paragraph id="H77FD73AFC1FD405F89B1A92B3AC8A986"><enum>(3)</enum><header>Transportation
				facility</header><text>The term <term>transportation facility</term> means any
				component of the National Highway
				System.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HFF78F7F16263473D9161B76BEAB6ADC9"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The analysis for such chapter is amended by adding at
			 the end the following:</text>
