		<official-title>To authorize the Secretary of Agriculture to make grants
		  to community-based organizations and local redevelopment agencies operating in
		  low-income communities to promote increased access to and consumption of fresh
		  fruits, fresh vegetables, and other healthy foods among residents of such
		  communities, and for other purposes.</official-title>

		<section display-inline="no-display-inline" id="H606B169AD22C4CA6BA3468B9ED12EB48" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Healthy Foods for Healthy Living
			 Act</short-title></quote>.</text>
		</section><section id="H89CDBBCBAD7D417986188B8DE06CD247"><enum>2.</enum><header>Department of
			 Agriculture grants to promote greater consumption of fresh fruits, fresh
			 vegetables, and other healthy foods in low-income communities</header>
			<subsection id="HA375401ACD0A47638DDC23C17BBB567D"><enum>(a)</enum><header>Grants
			 authorized</header><text display-inline="yes-display-inline">The Secretary of
			 Agriculture may make grants for the purposes specified in subsection (b) to any
			 of the following:</text>
				<paragraph id="H008CA90A48EC4E8C9CC9638564B0771A"><enum>(1)</enum><text display-inline="yes-display-inline">A community-based organization that
			 operates in a low-income community and carries out one or both of the
			 activities described in subsection (b), as determined by the Secretary.</text>
				</paragraph><paragraph id="H052CCF92698148D6A9A00B0CAA559A34"><enum>(2)</enum><text>A
			 local redevelopment agency that is chartered, established, or otherwise
			 sanctioned by a State or local government.</text>
				</paragraph></subsection><subsection id="H27CFDEAF8B7E4E559991B379DF000A06"><enum>(b)</enum><header>Use of grant
			 amounts</header><text>The recipient of a grant under this section shall use the
			 grant amounts for one or both of the following activities:</text>
				<paragraph id="H2C618C63AD4A4AA68AE9A50F46056929"><enum>(1)</enum><text display-inline="yes-display-inline">To assist in purchasing appropriate
			 equipment or in hiring and training personnel to expand the inventory of fresh
			 fruits and vegetables or other healthy food alternatives, as defined by the
			 Department of Agriculture, such as healthier dairy and non-dairy alternatives
			 to whole milk, 100 percent pure fruit juices, and products with 0 grams of
			 transfat, available for residents of a low-income community.</text>
				</paragraph><paragraph id="H3A5C927805824BE1AAF0CFCD885FADB5"><enum>(2)</enum><text display-inline="yes-display-inline">To carry out consumer education and
			 outreach activities to encourage the purchase of products described in
			 paragraph (1), such as by informing residents of a low-income community about
			 the health risks associated with high-calorie, low-exercise lifestyles and the
			 benefits of healthy living.</text>
				</paragraph></subsection><subsection id="HFF40837AEFB5421388C83E13B4F6D65A"><enum>(c)</enum><header>Maximum
			 grant</header><text>A grant under this section may not exceed $100,000.</text>
			</subsection><subsection id="H8766F885DA544AC9B0CDEB0B787674D8"><enum>(d)</enum><header>Community-Based
			 organization defined</header><text display-inline="yes-display-inline">In this
			 section, the term <term>community-based organization</term> includes schools,
			 day-care centers, senior centers, community health centers, food banks, or
			 emergency feeding organizations.</text>
			</subsection><subsection id="H53338EE602004387BCC73240E1E392E5"><enum>(e)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to the
			 Secretary to carry out this section $5,000,000 for fiscal year 2012.</text>
			</subsection></section><section display-inline="no-display-inline" id="H72702AD3CC9B41988124C012A7F81A52" section-type="subsequent-section"><enum>3.</enum><header>Coverage of additional
			 primary care and preventive services under the Medicare and Medicaid
			 programs</header>
			<subsection id="HF7A52219B70446229DEEBBC4025AA0BF"><enum>(a)</enum><header>Medicare
			 program</header>
				<paragraph id="H25E9729EF85B403F8C0993F61891C4FA"><enum>(1)</enum><header>In
			 general</header><text>Section 1861(ddd) of the Social Security Act (42 U.S.C.
			 1395x(ddd)) is amended—</text>
					<subparagraph id="H45290DE884C84439AD3FF6BC0DA9953E"><enum>(A)</enum><text>by adding at the
			 end of paragraph (1) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H6F5BA5D70C2F4E908271EC2C6D2E89F6" style="traditional">
							<quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">Such term
				also includes the primary care and preventive services described in paragraph
				(4).</quoted-block-continuation-text><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H8FF960D25A2F41D7BB91EC5E755D73B1"><enum>(B)</enum><text>by adding at the
			 end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="H8BE2E6A451654CA6B6E868A015C9004F" style="traditional">
							<paragraph id="HF23ADF4A31E545BB9441E07AD9F738FB" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">The primary care and preventive services
				described in this paragraph are the following, insofar as they are not
				otherwise covered under this title, when provided by qualified
				providers:</text>
								<subparagraph id="H65FD002D67E7405BB8F22AD2E0ABED20"><enum>(A)</enum><text>Services for the prevention and
				treatment of obesity and obesity-related disease.</text>
								</subparagraph><subparagraph id="HD50A6A81AC22494182EF1A022176E204"><enum>(B)</enum><text>Supervised exercise sessions.</text>
								</subparagraph><subparagraph id="H4D16A4F2AE754C4EB35C864ED48E2062"><enum>(C)</enum><text>Exercise stress testing for the
				purpose of exercise prescriptions.</text>
								</subparagraph><subparagraph id="H0BAD00F13D4342E380619994B54C480E"><enum>(D)</enum><text>Lifestyle health improvement
				education.</text>
								</subparagraph><subparagraph id="H5DEF1F136D264023A97916C995ACF063"><enum>(E)</enum><text>Culinary arts education for the
				purpose of promoting proper
				nutrition.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HFEAC42F036D34E6C978C063775A20839"><enum>(2)</enum><header>Conforming
			 amendments</header><subparagraph commented="no" display-inline="yes-display-inline" id="H6806D5D2817841B08AA75750987094DF"><enum>(A)</enum><text>Section 1862(a)(1) of
			 such Act (42 U.S.C. 1395y(a)(1)) is amended—</text>
						<clause id="H4828B99B79264DAD80036EB6F43183AA" indent="up1"><enum>(i)</enum><text>by striking <quote>and</quote> at
			 the end of subparagraph (O);</text>
						</clause><clause id="HE79BF839A86948FE8362A31E4E0ABFCA" indent="up1"><enum>(ii)</enum><text>by adding <quote>and</quote> at
			 the end of subparagraph (P); and</text>
						</clause><clause id="H28E118B9DC68408189D7F996F59A7804" indent="up1"><enum>(iii)</enum><text>by adding at the end the
			 following new subparagraph:</text>
							<quoted-block display-inline="no-display-inline" id="HE81B160E5CF640B097746E1AE731C509" style="traditional">
								<subparagraph id="H2FDF015E18424D1082CCCE2BF14D0E4C"><enum>(Q)</enum><text display-inline="yes-display-inline">in the case of additional primary care and
				preventive services described in section 1861(ddd)(4), which are performed more
				frequently than the Secretary may
				specify;</text>
								</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="HE7143BAA1F8745AAB0EEFF66A2DB84A8" indent="up1"><enum>(B)</enum><text>The first sentence of section
			 1833(b)(1) of such Act (42 U.S.C. 1395l(b)(1)) is amended by striking
			 <quote>for preventive services</quote> and all that follows through <quote>for
			 the individual</quote> and inserting <quote>for additional preventive services
			 (as defined in section 1861(ddd))</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H542F888A8CDB45C8BA9547AB1625C64D"><enum>(b)</enum><header>Medicaid
			 program</header><text>Section 1905(a) of the Social Security Act (42 U.S.C.
			 1396d(a)) is amended—</text>
				<paragraph id="H85E16F2ADC7D496483F725D75FD1C9B6"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (28);</text>
				</paragraph><paragraph id="HEDB803E3505B4AEBB8C0C676474788C0"><enum>(2)</enum><text>by redesignating
			 paragraph (29) as paragraph (30); and</text>
				</paragraph><paragraph id="H3FB44419979D4EB9B4126A45F88E19DB"><enum>(3)</enum><text>by inserting after
			 paragraph (28) the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HB750CE004325414391D6B472896DF1C2" style="traditional">
						<paragraph id="H5708975BA9DA47AC949996AE997FC13B"><enum>(29)</enum><text>additional
				preventive services (as defined in section 1861(ddd)(1)) which are not
				otherwise covered under this subsection;
				and</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HAC15642D73BF43FF8B73AA7315618E00"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on the
			 first day of the first calendar quarter beginning after the date of the
			 enactment of this Act, regardless of whether regulations to implement the
			 amendments are in effect as of such date.</text>
