		<official-title>To amend the Federal Power Act to prohibit the Federal
		  Energy Regulatory Commission from requiring the removal or modification of
		  existing structures or encroachments in licenses of the
		  Commission.</official-title>

		<section commented="no" display-inline="no-display-inline" id="HC195A3B1DBC84947B73DDEB09ED5B452" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Landowner Protection Act of
			 2011</short-title></quote>.</text>
		</section><section id="HBBF12413E1FD4364B6E10841D5BA5920" section-type="subsequent-section"><enum>2.</enum><header>Shoreline Management
			 Plans</header>
			<subsection id="HF05556D0206E48BCA18CAF3C845DE932"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">Section 4(e) of the
			 Federal Power Act (16 U.S.C. 797(e)) is amended—</text>
				<paragraph id="H0407ED0CDCA24E85ABE34DFA15C13251"><enum>(1)</enum><text>by designating the
			 first, second, and third sentences as paragraphs (1), (2), and (3),
			 respectively; and</text>
				</paragraph><paragraph id="H4396369B5217455B902126B4EF8F5A7F"><enum>(2)</enum><text>by adding at the
			 end the following:</text>

						<paragraph id="H6503B54637C449F5923782243915F174"><enum>(4)</enum><header>Removal or
				Modification of Existing Nonconforming Structures or Encroachments</header>
							<subparagraph id="H4CFEAB8F96D8430783733C44B74C4266"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), in issuing,
				denying, approving, or modifying a shoreline management plan required under any
				license issued under this part for any project, the Commission shall not
				require the removal or modification of any existing nonconforming structure or
				encroachment within the project boundary.</text>
							</subparagraph><subparagraph id="HA651F5667DF04D1E95065A7592DF2AB4"><enum>(B)</enum><header>Exception</header><text>Subparagraph
				(A) shall not apply to any existing nonconforming structure or encroachment
				built within the project boundary in bad
				faith.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HF3DE22F0B289472BAF626D670910F23F"><enum>(b)</enum><header>Effective
			 Date</header><text>The amendments made by subsection (a) shall take effect on
			 January 1, 2011.</text>
