		<official-title>To amend the Mineral Leasing Act to require that a
		  portion of amounts deposited into the general fund of the Treasury from sales,
		  bonuses, royalties, and rentals from new mineral and geothermal lease authority
		  be paid to States for use for the education of students in kindergarten through
		  grade 12 and at institutions of higher education, and for other
		  purposes.</official-title>

		<section id="H13142D5B40724B58A09B7FC062D00F53" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Education and Energy Act of
			 2011</short-title></quote>.</text>
		</section><section id="HF8A966E95C83433BB31EF0C95EAF43D4"><enum>2.</enum><header>Use of revenues
			 from new mineral and geothermal lease authority for payments to States for use
			 for education</header><text display-inline="no-display-inline">Section 35(a) of
			 the Mineral Leasing Act (30 U.S.C. 191) is amended by inserting
			 <quote>(1)</quote> before the first sentence, and by adding at the end the
			 following new paragraph:</text>
			<quoted-block id="H1A381EC4DE6E46A593B59D002F425042" style="OLC">
				<paragraph id="H104D52F6310843B8A64D32E0B7038343"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H9067BD760B4A418F89238F9857BA5CA8"><enum>(A)</enum><text>Of amounts otherwise
				required under paragraph (1) to be deposited into the general fund of the
				Treasury each fiscal year that are derived from leases for tracts located in a
				State, the Secretary shall pay to the State 33 percent for use for the
				education of students in grades kindergarten through grade 12 and at
				institutions of higher education.</text>
					</subparagraph><subparagraph id="H75500497B40F478CA6C2164DE0ED18DD" indent="up1"><enum>(B)</enum><text>Of the amounts otherwise required
				under paragraph (1) to be deposited into the general fund of the Treasury each
				fiscal year that are not required to be used for payments under subparagraph
				(A) of this paragraph, the Secretary shall pay to States, in equal amounts, 17
				percent for use for the education of students in grades kindergarten through
				grade 12 and at institutions of higher education.</text>
					</subparagraph><subparagraph id="HC4742B73256A44E581AE610A42602526" indent="up1"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H72782BEE60274DDBA054323C4AF6CEE9"><enum>(i)</enum><text>Subparagraphs (A) and
				(B) shall apply only with respect to amounts that—</text>
							<subclause id="H9F80D200DDB24696BF676594B2F70EBE" indent="up1"><enum>(I)</enum><text>are received by the United States
				under leases entered into under authority granted to the Secretary after the
				date of enactment of the Education and Energy Act of 2011; and</text>
							</subclause><subclause id="H3408677BDA75413DBCAD353FE936339F" indent="up1"><enum>(II)</enum><text>exceed the amount of revenues that
				the Secretary of the Treasury previously estimated would be received under such
				leases in the fiscal year.</text>
							</subclause></clause><clause id="H941000AF336747EEAB3CFAE78B1AEE0A" indent="up1"><enum>(ii)</enum><text>In calculating estimates referred to
				in clause (i)(II), the Secretary of the Treasury shall consult with the
				Congressional Budget Office.</text>
						</clause></subparagraph><subparagraph id="H3CB7A62FD85046C6AB30DF74E70C10E1" indent="up1"><enum>(D)</enum><text>Subparagraphs (A) and (B) shall not
				apply with respect to amounts required by paragraph (1) to be paid into,
				reserved, and appropriated, as part of the reclamation
				fund.</text>
