		<official-title display="yes">To amend the Lacey Act Amendments of 1981
		  to limit the application of that Act with respect to plants and plant products
		  that were imported before the effective date of amendments to that Act enacted
		  in 2008, and for other purposes.<pagebreak></pagebreak></official-title>

		<section id="H2ED9A57FDD1A4F09A6E598ACFB320C2D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Retailers and Entertainers Lacey
			 Implementation and Enforcement Fairness Act</short-title></quote> or the
			 <quote><short-title>RELIEF Act</short-title></quote>
			 .</text>
		</section><section id="H2A7C8141C7FF417DACAEA828A3302F10"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="HCD0971196CF44912AE3A6BDF971BB565"><enum>(1)</enum><text>Amendments to the Lacey
			 Act Amendments of 1981 were enacted as part of the Food, Conservation, and
			 Energy Act of 2008 (Public Law 110–246).</text>
			</paragraph><paragraph id="HC536D12E71DA47B99DE3EA40A857EEDC"><enum>(2)</enum><text>The 2008 amendments were
			 intended to level the playing field for American businesses engaged in the
			 responsible harvest, shipment, manufacture, and trade of plants and plant
			 products whose prices had been undercut by a black market fueled by
			 irresponsible and illegal taking of protected plants around the globe.</text>
			</paragraph><paragraph id="HD52287DF47754DE68BC005BD7B2BD1B1"><enum>(3)</enum><text>The 2008 amendments were
			 overly broad and their enforcement as enacted could criminalize actions of a
			 good-faith owner, purchaser, or retailer of a plant or plant product,
			 subjecting them to penalties that include forfeiture, fines, and
			 imprisonment.</text>
			</paragraph><paragraph id="H71178EBAF7144555BC70CFFBAC7FC39B"><enum>(4)</enum><text>Sanctions for violating
			 the 2008 amendments should be proportional to the act in violation. An
			 individual who is not in the commercial shipping business should not be held to
			 the same standard of compliance under that Act.</text>
			</paragraph><paragraph id="HFFB8D37E80AE47B492040416FB96EED9"><enum>(5)</enum><text display-inline="yes-display-inline">Individuals fear that they risk incurring
			 those penalties by merely owning or traveling with a vintage musical
			 instrument, antique furniture, or another wood product.</text>
			</paragraph><paragraph id="HE10E86257B91422D82337B1202D9D239"><enum>(6)</enum><text display-inline="yes-display-inline">The Department of the Interior and
			 Department of Justice have stated <quote>people who unknowingly possess a
			 musical instrument or other object containing wood that was illegally taken,
			 possessed, transported or sold in violation of law and who, in the exercise of
			 due care would not have known that it was illegal, do not have criminal
			 exposure.</quote>.</text>
			</paragraph><paragraph id="HD15268080BF34B94BC23037C5E4E8D70"><enum>(7)</enum><text display-inline="yes-display-inline">It is necessary to clarify the 2008
			 amendments so that legally harvested new plant products can enter the market
			 place.</text>
			</paragraph><paragraph id="H0678997C9C5E4BB7B038799A8E96DE33"><enum>(8)</enum><text display-inline="yes-display-inline">Declaration requirements for plant products
			 imported or manufactured prior to May 22, 2008, are unreasonable since the
			 sourcing of plant products was not previously required by law.</text>
			</paragraph><paragraph id="H9F55455668E44C70A1D24857B51F0B84"><enum>(9)</enum><text display-inline="yes-display-inline">Federal law enforcement officials should
			 not engage in overzealous enforcement action under the 2008 amendments.</text>
			</paragraph><paragraph id="HF416AC88E391465F8D653770A542F2AD"><enum>(10)</enum><text display-inline="yes-display-inline">It is important to ensure that the
			 appropriate agencies have the necessary funding to implement the current phases
			 of the declaration requirement before considering any future phases.</text>
			</paragraph><paragraph id="H5873A296137C4CA4B252719943D6A5C9"><enum>(11)</enum><text display-inline="yes-display-inline">The appropriate agencies have the
			 responsibility of providing a publicly accessible database so that everyone can
			 be notified of the foreign laws of countries as they apply to the importation
			 of plants.</text>
			</paragraph></section><section id="H148E65C1CE644B17A105B64BE559C6FD"><enum>3.</enum><header>Treatment of plants and
			 plant products under Lacey Act Amendments of 1981</header>
			<subsection id="H33E291599E5848509B958972541D0D42"><enum>(a)</enum><header>Limitation on
			 application of Act to certain plants and plant products</header><text>The Lacey
			 Act Amendments of 1981 (16 U.S.C. 3371 et seq.) is amended by redesignating
			 section 9 as section 10, and by inserting after section 8 the following:</text>
				<quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="HE1285ED198894314847419DAE64D9032" reported-display-style="italic" style="OLC">
					<section id="H530996C5943E4B3A978D9F2A04AA747C"><enum>9.</enum><header>Limitation on
				application to certain plants and plant products</header><text display-inline="no-display-inline">This Act does not apply with respect
				to—</text>
						<paragraph id="H8EB4ACC8C8374A91B392B22A7B44C9F1"><enum>(1)</enum><text>any plant that was
				imported into the United States before May 22, 2008; or</text>
						</paragraph><paragraph id="HECA47CD148E242D18F9ED8483022C8FA"><enum>(2)</enum><text>any finished plant or
				plant product the assembly and processing of which was completed before May 22,
				2008.</text>
						</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5140F7D4797643F1866C9102F1100EE2"><enum>(b)</enum><header>Limitations on
			 application of plant declaration requirement</header><text display-inline="yes-display-inline">Section 3(f) of such Act (16 U.S.C.
			 3372(f)) is amended—</text>
				<paragraph id="H55609701F7D94029A1BCD96032D0B29E"><enum>(1)</enum><text>in paragraph (1), by
			 inserting <quote>that is entered for consumption (as that term is defined in
			 part 141.0a of title 19, Code of Federal Regulations, as in effect on the date
			 of enactment of the <short-title>Retailers and
			 Entertainers Lacey Implementation and Enforcement Fairness
			 Act</short-title>)</quote> after <quote>plant</quote>; and</text>
				</paragraph><paragraph id="H26C8085C369B4ABEA54D234FA20D5F53"><enum>(2)</enum><text>in paragraph (3)—</text>
					<subparagraph id="HFD06BD497C8141BDACECDB590A136714"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>(A)</quote> before
			 <quote>Paragraphs (1)</quote>; and</text>
					</subparagraph><subparagraph id="HE9F3C4B7F19E48BAB4D2CF61DCCAB6CA"><enum>(B)</enum><text>by adding at the end the
			 following:</text>
						<quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="HA637406F8ABD4CB891F1B385F5E2C5EA" reported-display-style="italic" style="OLC">
							<subparagraph id="H598A118293D04514A5D575CFFD6611A8" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H7D5FB2C5D0F948A8A9842D96C60B2552"><enum>(i)</enum><text>In the case of a plant
				product that is derived from a tree, a declaration under paragraph (1) or (2)
				is not required to include information referred to in subparagraph (A), (B), or
				(C) of that paragraph unless the plant product is solid wood.</text>
								</clause><clause changed="added" committee-id="HII00" id="H0944EEF959BB4FC4BDBEA3700C3025B1" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>The Administrator of the
				Animal and Plant Health Inspection Service shall issue regulations that define
				the term <term>solid wood</term> for purposes of this
				subparagraph.</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H841CB8DCC6814530AC0134C1C3A91853"><enum>(c)</enum><header>Application of civil
			 forfeiture laws</header><text>Section 5(d) of such Act (16 U.S.C. 3374(d)) is
			 amended—</text>
				<paragraph id="H369CD3EC35594CF094C049B2D394F3C7"><enum>(1)</enum><text>by inserting
			 <quote>(1)</quote> before <quote>Civil</quote>;</text>
				</paragraph><paragraph id="HEDE85FEB364844A6B16C4075E112337E"><enum>(2)</enum><text>by inserting <quote>,
			 except as provided in paragraphs (2) and (3) of this subsection</quote> before
			 the period at the end; and</text>
				</paragraph><paragraph id="H7BE7B13F9131418F8B3BF1E8F08EA3F3"><enum>(3)</enum><text>by adding at the end the
			 following:</text>
					<quoted-block changed="added" committee-id="HII00" id="HF9EB9FD450254043A1A77A533929BEBD" reported-display-style="italic" style="OLC">
						<paragraph id="HAB08F7BCBB34473499C476106FEF7171" indent="up1"><enum>(2)</enum><text>Subsection (d)(4) of
				section 983 of such chapter, and the second sentence of subsection (a)(1)(F) of
				such section, shall not apply to plants or plant products.</text>
						</paragraph><paragraph id="H132B1C0373784C54ABCD58FA31EE002F" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">This section is the sole authority for
				civil seizure or forfeiture actions alleging, or predicated upon, a violation
				of section
				3.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H9A86045D612E4DCD98913CA66ADA7502"><enum>4.</enum><header>Limitation on
			 application of foreign laws</header>
			<subsection id="H42E3FB2ED6584CBA829409ECCB5E6ADA"><enum>(a)</enum><header>Prohibited
			 acts</header><text display-inline="yes-display-inline">Section 3(a) of such Act
			 (16 U.S.C. 3372(a)) is amended—</text>
				<paragraph id="HFFD824F90B6C4F8499225EA006BF8DD1"><enum>(1)</enum><text>in paragraph (2)(B), in
			 clause (ii) and in clause (iii), by striking <quote>foreign law</quote> and
			 inserting <quote>foreign law that is directed at the protection, conservation,
			 and management of plants</quote>; and</text>
				</paragraph><paragraph id="HFE3D8408B47B4AB7B714BA10B2C7BCB2"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3)(B), in clause (ii) and in
			 clause (iii), by striking <quote>foreign law</quote> and inserting
			 <quote>foreign law that is directed at the protection, conservation, and
			 management of plants</quote>.</text>
				</paragraph></subsection><subsection id="H859406781A964F908A2CE304E2D10F76"><enum>(b)</enum><header>Civil
			 penalties</header><text display-inline="yes-display-inline">Section 4(a)(1) of
			 such Act (16 U.S.C. 3373(a)(1)) is amended by striking <quote>foreign
			 law</quote> and inserting <quote>foreign law that is directed at the
			 protection, conservation, and management of plants</quote>.</text>
			</subsection></section><section id="HBD9FAF5C4AE1481ABED36C524C1729D3"><enum>5.</enum><header>Review and
			 report</header><text display-inline="no-display-inline">Section 3(f) of such
			 Act (16 U.S.C. 3372(f)) is amended—</text>
			<paragraph id="HDDC48A1E834347E090CDC3F33666B0A4"><enum>(1)</enum><text>in paragraph (4), by
			 striking <quote>Not later than two years after the date of enactment of this
			 subsection,</quote> and inserting <quote>Not later than 180 days after the date
			 of enactment of the <short-title>Retailers and
			 Entertainers Lacey Implementation and Enforcement Fairness
			 Act</short-title>,</quote>; and</text>
			</paragraph><paragraph id="H52080B7E32EF4C6298A585C0E1599AFC"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (5)—</text>
				<subparagraph id="H9C25C55AEBD94A13B54072AF4C39E3CC"><enum>(A)</enum><text>by striking <quote>Not
			 later than 180 days after the date on which the Secretary completes the review
			 under paragraph (4), the Secretary</quote> and inserting <quote>Not later than
			 180 days after the date the Secretary completes the review under paragraph (4),
			 the Director of the United States Fish and Wildlife Service</quote>;</text>
				</subparagraph><subparagraph id="H56326189A1FA49309107C2C21F7559AB"><enum>(B)</enum><text>by striking
			 <quote>and</quote> after the semicolon at the end of subparagraph (B);</text>
				</subparagraph><subparagraph id="H01DA4E72102D4CCBA817ED9D10A0336C"><enum>(C)</enum><text>by striking the period at
			 the end of subparagraph (C) and inserting <quote>; and</quote>; and</text>
				</subparagraph><subparagraph id="H743A3C8B03DB41AD8D8EE3E85FA56D93"><enum>(D)</enum><text>by adding at the end the
			 following:</text>
					<quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="H5BD1005ADA154486A29D7EDC04BFB799" reported-display-style="italic" style="OLC">
						<subparagraph id="HF44EC28A55FD403C95FFA4171B96EF89"><enum>(D)</enum><text display-inline="yes-display-inline">an evaluation of the feasibility of
				creating and maintaining a publicly available database of laws of foreign
				countries from which plants are
				exported.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
