		<official-title>To amend the Federal Food, Drug, and Cosmetic Act with
		  respect to appointments to advisory committees and conflicts of

		<section id="HC08BE883C763416CB6759990B2569432" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Cultivating Scientific Expertise to Foster Innovation for
			 Patients Act of 2011</short-title></quote>.</text>
		</section><section id="H8C185E874DB34DB6B399E1B56601B0DD"><enum>2.</enum><header>Conflicts of
			 interest</header>
			<subsection id="H351B0095B8B3496189A94CEEC9544951"><enum>(a)</enum><header>Evaluation of
			 individual appointments to advisory committees</header><text display-inline="yes-display-inline">Paragraph (2) of section 712(b) of the
			 Federal Food, Drug, and Cosmetic Act (21 U.S.C. 379d–1(b)) is amended to read
			 as follows:</text>

					<paragraph id="HB419FAD523734190BD95540311087201"><enum>(2)</enum><header>Evaluation and
				criteria</header>
						<subparagraph commented="no" id="HBED0B29BD03B4442A667976F7DAFAE89"><enum>(A)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of this paragraph are—</text>
							<clause commented="no" id="H2331DB6DEB3A4E358925AD759D67A121"><enum>(i)</enum><text>to ensure that the
				Secretary has access to the most current expert advice; and</text>
							</clause><clause id="H903A2E66CEBF470B966513F634A6D3F8"><enum>(ii)</enum><text>to promote
				scientific exchange and the use of sound science to guide Food and Drug
				Administration evaluations and decisionmaking.</text>
							</clause></subparagraph><subparagraph id="HE399FB68F7CB420CB10EC271E1ED1AE0"><enum>(B)</enum><header>In
				general</header><text>The Secretary shall ensure that individual appointments
				to advisory committees are made to promote scientific and technical expertise
				while at the same time minimizing any potential conflicts of interest.</text>
						</subparagraph><subparagraph id="H7A4A7A3473D34589B69A6586297DDD5A"><enum>(C)</enum><header>Considerations</header><text>In
				making each such appointment, the Secretary shall consider, with respect to any
				financial interest constituting a potential conflict of interest—</text>
							<clause id="H433B9A7253704463AAA96723C7A6348D"><enum>(i)</enum><text>the type of the
				financial interest;</text>
							</clause><clause id="HD0D4E82ADB3A4D1A949B04FBF8A84DEC"><enum>(ii)</enum><text>the nature of the
				financial interest; and</text>
							</clause><clause id="H9EBB4FBE1A044E49B018261EEF881E77"><enum>(iii)</enum><text>the magnitude,
				expressed as a range, of the financial interest.</text>
							</clause></subparagraph><subparagraph id="H97ADC657CAB34F449C8CED22CA959191"><enum>(D)</enum><header>No one factor
				dispositive</header><text>No one factor specified in clause (i), (ii), or (iii)
				of subparagraph (C) shall be dispositive in the Secretary’s evaluation of a
				particular financial
				interest.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H739CC5F5E62D4D8AB6FAC1C5B21278C6"><enum>(b)</enum><header>Elimination of
			 limitation on certain waivers and exceptions</header><text>Section 712(c)(2) of
			 the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 379d–1(c)(2)) is amended by
			 striking subparagraph (C).</text>
