		<official-title>To amend the Federal Deposit Insurance Act to prohibit
		  insured depository institutions from charging consumers fees for the use of
		  debit cards.</official-title>

		<section id="HC9A774680C634B98ACE684B68BFEE24D" section-type="section-one"><enum>1.</enum><header>Prohibition on fees on debit
			 cards</header><text display-inline="no-display-inline">The Federal Deposit
			 Insurance Act is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H43A421170E7E4D37AF53EC7ED0078BDE" style="OLC">
				<section id="H27984FF491CB4EAF96A4492A6AF5DD67"><enum>51.</enum><header>Prohibition on
				fees on debit cards</header>
					<subsection id="HD66115F61A164F38B9D0AD2309797ED0"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">An insured depository
				institution may not charge a fee to any consumer for receiving or using a debit
				card.</text>
					</subsection><subsection id="H073C3DEB9BEC423FA7198D49271E11EB"><enum>(b)</enum><header>Civil
				liability</header><text>Any entity that violates subsection (a) with respect to
				a consumer is liable to that consumer in an amount equal to the sum of—</text>
						<paragraph id="H663CCD9982C74392851B608FF3DFE463"><enum>(1)</enum><text>any actual damages
				sustained by the consumer as a result of the violation or damages of not less
				than $100 and not more than $1,000;</text>
						</paragraph><paragraph id="H2E708F1935B04C6CA59607522C8AEFA9"><enum>(2)</enum><text>such amount of
				punitive damages as the court may allow; and</text>
						</paragraph><paragraph id="H0C3DA1607D1944D8AC51A3305C6998E7"><enum>(3)</enum><text>in the case of any
				successful action to enforce any liability under this section, the costs of the
				action together with reasonable attorney's fees as determined by the
				court.</text>
						</paragraph></subsection><subsection id="H0EFF9395E607455D8F5353D9C4ABC9D2"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section, the terms
				<quote>consumer</quote> and <quote>debit card</quote> have the meaning given
				such terms, respectively, under section 603 of the Fair Credit Reporting Act
				(15 U.S.C.
				1681a).</text>
