		<official-title>To amend title XXVII of the Public Health Service Act to
		  exempt licensed independent insurance producer remuneration from the medical
		  loss ratio.</official-title>

		<section id="H3B79C89FB92246C39D27F653BD3758BC" section-type="section-one"><enum>1.</enum><header>Exempting licensed
			 independent insurance producer remuneration from the medical loss
			 ratio</header>
			<subsection id="H6887BBB905CA4B20B2E7C578400ECEA6"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 2718 of the
			 Public Health Service Act (42 U.S.C. 300gg et seq.), as inserted by section
			 1001 and amended by section 10101(f) of the Patient Protection and Affordable
			 Care Act (Public Law 111–148), is amended—</text>
				<paragraph id="H868C9C3C26EB489B90D89A1F8AB34589"><enum>(1)</enum><text>in subsection
			 (a)(3), by inserting <quote>, remuneration paid for licensed independent
			 insurance producers,</quote> after <quote>State taxes</quote>;</text>
				</paragraph><paragraph id="HE998931D23054BD1BAA33B1B4A90F3D2"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)(1)(A), in the matter
			 preceding clause (i), by inserting <quote>, remuneration paid for licensed
			 independent insurance producers,</quote> after <quote>State
			 taxes</quote>;</text>
				</paragraph><paragraph id="H7660025B168044FF92C2FD0BA1C83AFA"><enum>(3)</enum><text>in subsection
			 (b)(1)(B), by inserting <quote>, remuneration paid for licensed independent
			 insurance producers,</quote> after <quote>State taxes</quote>; and</text>
				</paragraph><paragraph id="H2EC773AE2C0B4A0197355B0DA843B35B"><enum>(4)</enum><text>by adding at the
			 end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HB1005EBC29C34CCB8139495B30EDF8BD" style="OLC">
						<subsection id="H8A760DA3992E40EEA028A6573CCF0243"><enum>(f)</enum><header>Independent
				insurance producer, remuneration defined</header><text display-inline="yes-display-inline">For purposes of this section:</text>
							<paragraph id="HBE9501D86E6D44C9B6606FDF315AD8F8"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>independent insurance
				producer</term> means an insurance agent or broker, insurance consultant,
				benefit specialist, limited insurance representative, and any other person
				required to be licensed under the laws of the particular State to sell,
				solicit, negotiate, service, effect, procure, renew or bind policies of
				insurance coverage or offer advice, counsel, opinions, or services related to
				insurance.</text>
							</paragraph><paragraph id="HABA794B413C64F44A5CEC0275ABC9123"><enum>(2)</enum><text>The term
				<term>remuneration</term> means compensation paid by or accrued from an
				insurance issuer or health plan for services rendered under contractual
				agreement which may include fees, commissions, or
				rebates.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HBBE2BF8CC7844F008BB3B05531844BBE"><enum>(b)</enum><header>Regulations</header><text>Not
			 later than 60 days after the date of the enactment of this Act, the Secretary
			 of Health and Human Services shall amend any applicable regulations so as to
			 take the amendments made by subsection (a) into account.</text>
