		  Responsibility Act of 1996 to make permanent the E-Verify program, and for

		<section id="HE6C4601EDD284BB6AD40FA57535F7D6C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Improving Methods to Promote Regular
			 Occurrences of the Verification of Employability Status Act of
			 2011</short-title></quote>.</text>
		</section><section id="H402944DA54F540C38AD445027C614FFA"><enum>2.</enum><header>Making the
			 E–Verify program permanent</header>
			<subsection id="H182330323C5940C4A582A72DC00A3529"><enum>(a)</enum><header>Permanence</header><text display-inline="yes-display-inline">Section 401(b) of the Illegal Immigration
			 Reform and Immigrant Responsibility Act of 1996 (division C of Public Law
			 104–208; 8 U.S.C. 1324a note) is amended—</text>
				<paragraph id="H574F9B93A0D74932A28C14703CE27168"><enum>(1)</enum><text>in the subsection
			 heading, by striking <quote><header-in-text level="subsection" style="OLC">;
			 Termination</header-in-text></quote>; and</text>
				</paragraph><paragraph id="H1CCC1A7E9A3148E3ACFE9580FBD4B4DF"><enum>(2)</enum><text>by striking the
			 second sentence and inserting the following: <quote>The programs provided for
			 under this subtitle shall not have a termination date.</quote>.</text>
				</paragraph></subsection><subsection id="H861CC6B89DCC40B486F1FD2BABEEC167"><enum>(b)</enum><header>Pilot Program
			 References</header><text display-inline="yes-display-inline">Section 401(d)(1)
			 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996
			 (division C of Public Law 104–208; 8 U.S.C. 1324a note) is amended—</text>
				<paragraph id="H93646295FBD14EAB8CB12F8C0FA54DA1"><enum>(1)</enum><text>in the paragraph
			 heading by striking <quote><header-in-text level="paragraph" style="OLC">Pilot
			 program</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Program</header-in-text></quote>; and</text>
				</paragraph><paragraph id="H548DF650BB1F43C581590195D5AADFC2"><enum>(2)</enum><text>by striking
			 <quote>3 pilot</quote>.</text>
				</paragraph></subsection></section><section id="H713796842DF44DDBAE829FEAED1BE036"><enum>3.</enum><header>Verification of
			 current and newly hired employees; protection from liability for employers
			 verifying employees; informational posters</header><text display-inline="no-display-inline">Section 403 of the Illegal Immigration
			 Reform and Immigrant Responsibility Act of 1996 (division C of Public Law
			 104–208; 8 U.S.C. 1324a note) is amended—</text>
			<paragraph id="H975A9672C7564E1A8F0A254B1C267534"><enum>(1)</enum><text>in subsection
			 (a)(3)(A), by adding at the end the following: <quote>The person or other
			 entity may wait for confirmation of the individual’s identity and work
			 eligibility before beginning to pay or train the individual.</quote>;</text>
			</paragraph><paragraph id="HB3ADD10F6B3746F89787862E8F48993E"><enum>(2)</enum><text>in subsection
			 (a)(3), by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H6C1E5B11CDE34C4CBFFA2604E1C6B65E" style="OLC">
					<subparagraph id="HB9212A902E404A7C96114A7B6F5E32E9"><enum>(C)</enum><header>Current
				Employees</header><text display-inline="yes-display-inline">Not later than 14
				business days after beginning to participate in the program, a person or other
				entity may use the program to verify the employment authorization of an
				employee hired prior to the participation in the program only if the person or
				other entity verifies the employment authorization of every employee hired
				prior to the participation in the
				program.</text>
					</subparagraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HFCE90D3BABA4452CA3313386AD86A9B8"><enum>(3)</enum><text>in subsection
			 (a)(4)(B)(iii), by inserting after <quote>until a nonconfirmation becomes
			 final</quote> the following: <quote>and the individual exhausts any
			 administrative or judicial review if the individual initiates such
			 review.</quote>;</text>
			</paragraph><paragraph id="H37F44C81F81A4FB3B3A1D7A95CC732C3"><enum>(4)</enum><text>in subsection (d),
			 by striking <quote>through the confirmation system.</quote> and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HA090DACFD8E14DAFB769D7F2459B0C2C" style="OLC">
					<quoted-block-continuation-text quoted-block-continuation-text-level="subsection">through
				the confirmation system if—</quoted-block-continuation-text><paragraph display-inline="no-display-inline" id="H0A36310EAC3C4F4687D68E8699B8FBB3"><enum>(1)</enum><text>such action
				occurred due to an error in the program that was unknown to the employer at the
				time of such action; and</text>
					</paragraph><paragraph id="H6C7430616E164271BBF836A78B7865EB"><enum>(2)</enum><text display-inline="yes-display-inline">the person or other entity terminates the
				employment of the individual upon being informed of the
				error.</text>
					</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H9ED5D08407194329B3BE7D8B769056FA"><enum>(5)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H40233573AD684279A011E8574A8A9DFE" style="OLC">
					<subsection id="H3D0F28AB5ABA45B1A91DBD1417659525"><enum>(e)</enum><header>Use of
				Fraudulent Documentation and Sanctions</header>
						<paragraph id="HB376FD459D3F4CABB8CDE455F72CF6B4"><enum>(1)</enum><header>Fraudulent
				documentation</header><text display-inline="yes-display-inline">Each instance
				of a person or other entity participating in the program who employs an
				unauthorized individual after providing or accepting documentation the person
				or entity knows to be fraudulent shall—</text>
							<subparagraph id="H4F6F3A149B6141179A5CA65120C13718"><enum>(A)</enum><text display-inline="yes-display-inline">be treated as a violation of section
				274A(a)(1)(B) of the Immigration and Nationality Act (8 U.S.C. 1324A(a)(1)(B))
				with respect to each offense; and</text>
							</subparagraph><subparagraph id="H1C104521E36A4DB0B3E1965A69687CE0"><enum>(B)</enum><text display-inline="yes-display-inline">create a rebuttable presumption that the
				employer has violated section 274A(a)(1)(A) of the Immigration and Nationality
				Act (8 U.S.C. 1324A(a)(1)(A)).</text>
							</subparagraph></paragraph><paragraph id="H98706D701E6F4038BFC431D6490030CB"><enum>(2)</enum><header>Sanctions</header><text display-inline="yes-display-inline">Notwithstanding the amounts specified in
				section 274A(e)(5) of the Immigration and Nationality Act (8 U.S.C.
				1324A(e)(5)), the applicable civil monetary penalty for a violation under this
				subsection shall require the person or entity to pay a civil penalty in an
				amount of not less than $200 and not more than $2,000 for each individual with
				respect to whom such violation occurred.</text>
						</paragraph></subsection><subsection id="H4DEDE5171D854A52881AA068D2E323B9"><enum>(f)</enum><header>Informational
				Posters</header><text>In the case where the Secretary of Homeland Security
				requires under this subtitle a person or other entity to display an
				informational poster, such poster shall be written only in English. The
				Secretary shall allow a person or other entity with less than 25 employees to
				meet any informational poster requirement by giving its employees a pamphlet
				meeting the same requirements and containing the same information as the
				poster.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H45AAC29E9AB44C7987E2D66CF75DE321"><enum>4.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall take effect 180 days after the date of the enactment of this
			 Act.</text>
