			 Quality Financing</header>
			<subtitle id="H1C461919650A46889C6E887493D0A999"><enum>A</enum><header>Technical and
			 Management Assistance</header>
				<section id="HF0A142AEDC02488F958F97CC9CC16D68"><enum>1101.</enum><header>Technical
			 assistance</header>
					<subsection id="H8DC33626BB244B3DB2553978470A7E08"><enum>(a)</enum><header>Technical
			 Assistance for Rural and Small Treatment Works</header><text>Section 104(b) (33
			 U.S.C. 1254(b)) is amended—</text>
						<paragraph id="HB6C0848C59554A7A9840979315C624B1"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (6);</text>
						</paragraph><paragraph id="H1667BB2D51CA4C10A0ADFBEB86CABD7E"><enum>(2)</enum><text>by striking the
			 period at the end of paragraph (7) and inserting <quote>; and</quote>;
			 and</text>

				and small municipalities and tribal governments for the purpose of assisting,
				in consultation with the State in which the assistance is provided, such
				municipalities and tribal governments in the planning, developing, and
				acquisition of financing for eligible projects described in section
				603(c);</text>
									</subparagraph><subparagraph id="H08F01AAAD6AA4750B3EE755DBF7E8E0D"><enum>(B)</enum><text>to provide
				technical assistance and training for rural, small, and tribal publicly owned
				treatment works and decentralized wastewater treatment systems to enable such
				treatment works and systems to protect water quality and achieve and maintain
				compliance with the requirements of this Act; and</text>
									</subparagraph><subparagraph id="HC3B6C44E2E4B4DF2A8073BA8920E13D2"><enum>(C)</enum><text>to disseminate
				information to rural, small, and tribal municipalities and municipalities that
				meet the affordability criteria established under section 603(i)(2) by the
				State in which the municipality is located with respect to planning, design,
				construction, and operation of publicly owned treatment works and decentralized
				wastewater treatment
				systems.</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="H79E9D06718794212AADFDA1FCB2F9AB3"><enum>(b)</enum><header>Authorization of
			 Appropriations</header><text>Section 104(u) (33 U.S.C. 1254(u)) is
			 amended—</text>
						<paragraph id="HBB710074A3264F279C78AD88E590A67B"><enum>(1)</enum><text>by striking
			 <quote>and (6)</quote> and inserting <quote>(6)</quote>; and</text>

			 clearinghouse</header><text>Section 104(q)(4) (33 U.S.C. 1254(q)(4)) is

				resource plan</header><text display-inline="yes-display-inline">The development
				of an integrated water resource plan for the coordinated management and
				protection of surface water, ground water, and stormwater resources on a
				watershed or subwatershed basis to meet the objectives, goals, and policies of
				this Act.</text>
									</paragraph><paragraph id="HFBD00B81A902483788669748595C0B3C"><enum>(5)</enum><header>Municipality-wide
				storm water management planning</header><text display-inline="yes-display-inline">The development of a municipality-wide plan
				that identifies the most effective placement of storm water technologies and
				management approaches, including green infrastructure, to reduce water quality
				impairments from storm water on a municipality-wide
				basis.</text>
									</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H4BD5220E224743ECA82BFBD6DBB2CC8D"><enum>(b)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">The first
			 sentence of section 122(c)(1) is amended—</text>

				under this title if the project otherwise meets the requirements of subsection
				(a)(1) and meets the requirement of paragraph (3).</text>
								</paragraph><paragraph id="H051C3873F5AF47E9BEE678365C20B4E9"><enum>(2)</enum><header>New
				systems</header><text>Notwithstanding the requirement of subsection (a)(2)
				concerning the existence of a community as a condition of eligibility, a
				project for a new collection system to serve a community existing on January 1,
				2007, shall be eligible for a grant under this title if the project otherwise
				meets the requirements of subsection (a)(2) and meets the requirement of
				paragraph (3).</text>
								</paragraph><paragraph id="H1928EEF3D869403DADBCD400A0572995"><enum>(3)</enum><header>Requirement</header><text>A
				project meets the requirement of this paragraph if the purpose of the project
				is to accomplish the objectives, goals, and policies of this Act by addressing
				an adverse environmental condition existing on the date of enactment of this
				paragraph.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section id="HAB6DCE6B75A84CCB84287DB9D19DD379"><enum>1202.</enum><header>Treatment
			 works defined</header><text display-inline="no-display-inline">Section
			 212(2)(A) (33 U.S.C. 1292(2)(A)) is amended—</text>
					<paragraph id="H793189F1201047F1B46AFE1220A67DA4"><enum>(1)</enum><text>by striking
			 <quote>any works, including site</quote>;</text>
					</paragraph><paragraph id="HA1D99AABA1164F25BDF6919A90827197"><enum>(2)</enum><text>by striking
			 <quote>is used for ultimate</quote> and inserting <quote>will be used for
			 ultimate</quote>; and</text>

			 Pollution Control Revolving Funds</header>

			 authority for capitalization grants</header><text display-inline="no-display-inline">Section 601(a) (33 U.S.C. 1381(a)) is
			 amended by striking <quote>for providing assistance</quote> and all that
			 follows through the period at the end and inserting the following: <quote>to
			 accomplish the objectives, goals, and policies of this Act by providing
			 assistance for projects and activities identified in section
			 603(c).</quote>.</text>

			 grant agreements</header>
					<subsection id="H4332CB5144784EC890CA84F3AF718EF9"><enum>(a)</enum><header>Reporting
			 Infrastructure Assets</header><text>Section 602(b)(9) (33 U.S.C. 1382(b)(9)) is
			 amended by striking <quote>standards</quote> and inserting <quote>standards,
			 including standards relating to the reporting of infrastructure
			 assets</quote>.</text>
					</subsection><subsection id="HE169615F8BDA49F48B72DF0D07528EBC"><enum>(b)</enum><header>Additional

				by the State to recipients of assistance that are considered program income
				will be used for the purpose of financing the cost of administering the fund or
				financing projects or activities eligible for assistance from the fund;</text>
								</paragraph><paragraph id="H3DB723953F784D0BA41FBB243A1D9EA3"><enum>(13)</enum><text>beginning in
				fiscal year 2013, the State will include as a condition of providing assistance
				to a municipality or intermunicipal, interstate, or State agency that the
				recipient of such assistance certify, in a manner determined by the Governor of
				the State, that the recipient—</text>
									<subparagraph commented="no" id="H42C0FD35AC644F749F5A2DC5E47ACE24"><enum>(A)</enum><text>has studied and
				evaluated the cost and effectiveness of the processes, materials, techniques,
				and technologies for carrying out the proposed project or activity for which
				assistance is sought under this title, and has selected, to the extent
				practicable, a project or activity that maximizes the potential for efficient
				water use, reuse, and conservation, and energy conservation, taking into
				account the cost of constructing the project or activity, the cost of operating
				and maintaining the project or activity over its life, and the cost of
				replacing the project or activity; and</text>
									</subparagraph><subparagraph commented="no" id="H5ECC9FE33881417FBC92287CCE171218"><enum>(B)</enum><text display-inline="yes-display-inline">has considered, to the maximum extent
				practicable and as determined appropriate by the recipient, the costs and
				effectiveness of other design, management, and financing approaches for
				carrying out a project or activity for which assistance is sought under this
				title, taking into account the cost of constructing the project or activity,
				the cost of operating and maintaining the project or activity over its life,
				and the cost of replacing the project or activity;</text>
									</subparagraph></paragraph><paragraph id="H53F1329C7DAD4B3E841AA954CA0747B5"><enum>(14)</enum><text>the State will
				use at least 15 percent of the amount of each capitalization grant received by
				the State under this title after September 30, 2010, to provide assistance to
				municipalities of fewer than 10,000 individuals that meet the affordability
				criteria established by the State under section 603(i)(2) for projects or
				activities included on the State’s priority list established under section
				603(g), to the extent that there are sufficient applications for such
				assistance;</text>
								</paragraph><paragraph commented="no" id="HC34DDEE08BB4462E83415D8F4EA42042"><enum>(15)</enum><text>a contract to be
				carried out using funds directly made available by a capitalization grant under
				this title for program management, construction management, feasibility
				studies, preliminary engineering, design, engineering, surveying, mapping, or
				architectural related services shall be negotiated in the same manner as a
				contract for architectural and engineering services is negotiated under chapter
				11 of title 40, United States Code, or an equivalent State qualifications-based
				requirement (as determined by the Governor of the State); and</text>
								</paragraph><paragraph id="HBEA84A66164A429EB435987001F6BF69"><enum>(16)</enum><text display-inline="yes-display-inline">the requirements of section 513 will apply
				to the construction of treatment works carried out in whole or in part with
				assistance made available by a State water pollution control revolving fund as
				authorized under this title, or with assistance made available under section
				205(m), or both, in the same manner as treatment works for which grants are
				made under this
				Act.</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection></section><section id="H00A79F10A9784B1D8F4D8316FDFA7130"><enum>1303.</enum><header>Water
			 pollution control revolving loan funds</header>
					<subsection id="HFD6F64EA0F2D464D82CA4A196F992331"><enum>(a)</enum><header>Projects and
			 Activities Eligible for Assistance</header><text>Section 603(c) (33 U.S.C.
			 1383(c)) is amended to read as follows:</text>
						<quoted-block id="H1BA5D383EF774B3C8460718D380BBE8A" style="OLC">
							<subsection id="HD5524B69E9C24AA1A89E3CB30E6B5B8D"><enum>(c)</enum><header>Projects and
				Activities Eligible for Assistance</header><text>The amounts of funds available
				to each State water pollution control revolving fund shall be used only for
				providing financial assistance—</text>
								<paragraph id="H83E7E6A8FC9D4551B5BBEDECD94501BB"><enum>(1)</enum><text>to any
				municipality or intermunicipal, interstate, or State agency for construction of
				publicly owned treatment works;</text>
								</paragraph><paragraph id="H1D0C3BEE355A4336B8E982E0EB1FCA6A"><enum>(2)</enum><text>for the
				implementation of a management program established under section 319;</text>
								</paragraph><paragraph id="HD63E7F0DC54C4C469DCDB83F82429682"><enum>(3)</enum><text>for development
				and implementation of a conservation and management plan under section
				320;</text>
								</paragraph><paragraph id="HF4657587EEDA40DCBE29383183C5F9D7"><enum>(4)</enum><text>for repair or
				replacement of decentralized wastewater treatment systems that treat domestic
				sewage;</text>
								</paragraph><paragraph id="H098FBDDAEF134014AD4837AF104F3991"><enum>(5)</enum><text display-inline="yes-display-inline">for measures to manage, reduce, treat, or
				reuse municipal stormwater;</text>
								</paragraph><paragraph id="H75AB6C08109B432484CE7B9D77AABA70"><enum>(6)</enum><text>to any
				municipality or intermunicipal, interstate, or State agency for measures to
				reduce the demand for publicly owned treatment works capacity through water
				conservation, efficiency, or reuse;</text>
								</paragraph><paragraph id="H0723070A7E74412BA2655C69658B7BE7"><enum>(7)</enum><text>for the
				development and implementation of watershed projects meeting the criteria set
				forth in section 122; and</text>
								</paragraph><paragraph id="HCA6A31E08B8F4F3AA67A915342C8E42B"><enum>(8)</enum><text display-inline="yes-display-inline">to any municipality or intermunicipal,
				interstate, or State agency for measures to reduce the energy consumption needs
				for publicly owned treatment works, including the implementation of
				energy-efficient or renewable-energy generation
				technologies.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="HA0688CC6941D48F685C6F807FBE0BCB2"><enum>(b)</enum><header>Extended
			 Repayment Period</header><text>Section 603(d)(1) (33 U.S.C. 1383(d)(1)) is
			 amended—</text>
						<paragraph id="H999975218B7C4157831DE1AC027B2AA1"><enum>(1)</enum><text>in subparagraph
			 (A) by striking <quote>20 years</quote> and inserting <quote>the lesser of 30
			 years or the design life of the project to be financed with the proceeds of the
			 loan</quote>; and</text>
						</paragraph><paragraph id="H43A6D300CDA34DD08DB4387F5CCFD898"><enum>(2)</enum><text>in subparagraph
			 (B) by striking <quote>not later than 20 years after project completion</quote>
			 and inserting <quote>upon the expiration of the term of the
			 loan</quote>.</text>
						</paragraph></subsection><subsection id="HFF32110F0E9F4E8DA700A17C9CD0CF98"><enum>(c)</enum><header>Fiscal
			 Sustainability Plan</header><text>Section 603(d)(1) (33 U.S.C. 1383(d)(1)) is
			 further amended—</text>
						<paragraph id="HCFB86D7CFEE34CC39A0CE8C5B287186F"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (C);</text>
						</paragraph><paragraph id="H2D6A22358C8B475A9D454F31EE87B403"><enum>(2)</enum><text>by inserting
			 <quote>and</quote> at the end of subparagraph (D); and</text>
						</paragraph><paragraph id="H49C261E0FC1243CAB2FE56D6683F33FE"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
							<quoted-block id="HD57CED2AC4BB451D9935F4FCAB6B4EBD" style="OLC">
								<subparagraph id="HB42BC662EF0C42768E61805DF29DF27B"><enum>(E)</enum><text>for any portion of
				a treatment works proposed for repair, replacement, or expansion, and eligible
				for assistance under section 603(c)(1), the recipient of a loan will develop
				and implement a fiscal sustainability plan that includes—</text>
									<clause id="H1C56AF9656A8453096CFA8DD5A3F3245"><enum>(i)</enum><text>an
				inventory of critical assets that are a part of that portion of the treatment
				works;</text>
									</clause><clause id="HFFDC789DA0A34E459F022EFA451BF527"><enum>(ii)</enum><text>an evaluation of
				the condition and performance of inventoried assets or asset groupings;</text>
									</clause><clause id="H8A1AA0AB32914937824ADA1CC79C0976"><enum>(iii)</enum><text>a certification
				that the recipient has evaluated and will be implementing water and energy
				conservation efforts as part of the plan; and</text>
									</clause><clause id="H83693C876D1D4616B027E413C9438FB5"><enum>(iv)</enum><text>a
				plan for maintaining, repairing, and, as necessary, replacing that portion of
				the treatment works and a plan for funding such
				activities;</text>
									</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="H6C73E8BEBE3C49ADA3B2C4C9A7720B7C"><enum>(d)</enum><header>Administrative
			 Expenses</header><text>Section 603(d)(7) (33 U.S.C. 1383(d)(7)) is amended by
			 inserting before the period at the end the following: <quote>, $400,000 per
			 year, or <fraction>1/5</fraction> percent per year of the current valuation of
			 the fund, whichever amount is greatest, plus the amount of any fees collected
			 by the State for such purpose regardless of the source</quote>.</text>
					</subsection><subsection id="H9D313EAE1FFD45C9BD8702D0D248CB6F"><enum>(e)</enum><header>Technical and
			 Planning Assistance for Small Systems</header><text>Section 603(d) (33 U.S.C.
			 1383(d)) is amended—</text>
						<paragraph id="H15206B14F5944EF58719E31BF44869F7"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (6);</text>
						</paragraph><paragraph id="HE23A7E4D849A4040B5A7857B8FB62074"><enum>(2)</enum><text>by striking the
			 period at the end of paragraph (7) and inserting a semicolon; and</text>
						</paragraph><paragraph id="H5EC294C1926B495FB7F5FB9494E05991"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
							<quoted-block id="H1D968B72FC8549D1A9E62021F41EB9E8" style="OLC">
								<paragraph commented="no" id="H31543529D6E044B5A3327CFC3E0DC2F7"><enum>(8)</enum><text>to provide grants
				to owners and operators of treatment works that serve a population of 10,000 or
				fewer for obtaining technical and planning assistance and assistance in
				financial management, user fee analysis, budgeting, capital improvement
				planning, facility operation and maintenance, equipment replacement, repair
				schedules, and other activities to improve wastewater treatment plant
				management and operations, except that the total amount provided by the State
				in grants under this paragraph for a fiscal year may not exceed one percent of
				the total amount of assistance provided by the State from the fund in the
				preceding fiscal year, or 2 percent of the total amount received by the State
				in capitalization grants under this title in the preceding fiscal year,
				whichever amount is greatest; and</text>
								</paragraph><paragraph commented="no" id="HEF7D35A4DC2449BD8192D8891A24D49C"><enum>(9)</enum><text>to provide grants
				to owners and operators of treatment works for conducting an assessment of the
				energy and water consumption of the treatment works, and evaluating potential
				opportunities for energy and water conservation through facility operation and
				maintenance, equipment replacement, and projects or activities that promote the
				efficient use of energy and water by the treatment works, except that the total
				amount provided by the State in grants under this paragraph for a fiscal year
				may not exceed one percent of the total amount of assistance provided by the
				State from the fund in the preceding fiscal year, or 2 percent of the total
				amount received by the State in capitalization grants under this title in the
				preceding fiscal year, whichever amount is
				greatest.</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="H057C642BB16C4BFBB0ABE4F414E8803E"><enum>(f)</enum><header>Additional
			 Subsidization</header><text>Section 603 (33 U.S.C. 1383) is amended by adding
			 at the end the following:</text>
						<quoted-block id="HAD118B8E24304DE39368834CCE42E9F9" style="OLC">
							<subsection id="H1AF612EEDA084BD1B987523C77E3A853"><enum>(i)</enum><header>Additional
				Subsidization</header>
								<paragraph id="H2310A07B0F064070BDBE0887B0C90B42"><enum>(1)</enum><header>In
				general</header><text>In any case in which a State provides assistance to a
				municipality or intermunicipal, interstate, or State agency under subsection
				(d), the State may provide additional subsidization, including forgiveness of
				principal and negative interest loans—</text>
									<subparagraph id="HF22ABE1830864BC2911C16163038F659"><enum>(A)</enum><text>to benefit a
				municipality that—</text>
										<clause id="H4BAE78232C1A4DD19F70D35779161E33"><enum>(i)</enum><text>meets the State’s
				affordability criteria established under paragraph (2); or</text>
										</clause><clause id="HF52CE9869CBF4880A0C4BE0491B83F74"><enum>(ii)</enum><text>does not meet the
				State’s affordability criteria if the recipient—</text>
											<subclause id="H250FC561614649D5BE4AF9539C921DE3"><enum>(I)</enum><text>seeks additional
				subsidization to benefit individual ratepayers in the residential user rate
				class;</text>
											</subclause><subclause id="HCC243288F3CB4DFA87B261B227A953FA"><enum>(II)</enum><text>demonstrates to
				the State that such ratepayers will experience a significant hardship from the
				increase in rates necessary to finance the project or activity for which
				assistance is sought; and</text>
											</subclause><subclause id="HF43AA9591E9249B5BC1229E954D88FC4"><enum>(III)</enum><text>ensures, as part
				of an assistance agreement between the State and the recipient, that the
				additional subsidization provided under this paragraph is directed through a
				user charge rate system (or other appropriate method) to such ratepayers;
				or</text>
											</subclause></clause></subparagraph><subparagraph commented="no" id="H245260785E3E4A1D85EB32A081587BFF"><enum>(B)</enum><text display-inline="yes-display-inline">to implement a process, material,
				technique, or technology to address water-efficiency goals, address
				energy-efficiency goals, mitigate stormwater runoff, or encourage
				environmentally sensitive project planning, design, and construction.</text>
									</subparagraph></paragraph><paragraph id="H71E4A421173F4E69BEB14FFB7B9CEE61"><enum>(2)</enum><header>Affordability
				criteria</header>
									<subparagraph id="H9E06B92EBFCA4463B963DBCBD073ED2F"><enum>(A)</enum><header>Establishment</header><text display-inline="yes-display-inline">On or before September 30, 2012, and after
				providing notice and an opportunity for public comment, a State shall establish
				affordability criteria to assist in identifying municipalities that would
				experience a significant hardship raising the revenue necessary to finance a
				project or activity eligible for assistance under section 603(c)(1) if
				additional subsidization is not provided. Such criteria shall be based on
				income data, population trends, and other data determined relevant by the
				State, including whether the project or activity is to be carried out in an
				economically distressed area, as described in section 301 of the Public Works
				and Economic Development Act of 1965 (42 U.S.C. 3161).</text>
									</subparagraph><subparagraph id="HB7F3DBD0D9D74D82914B388BA0868C82"><enum>(B)</enum><header>Existing
				criteria</header><text>If a State has previously established, after providing
				notice and an opportunity for public comment, affordability criteria that meet
				the requirements of subparagraph (A), the State may use the criteria for the
				purposes of this subsection. For purposes of this Act, any such criteria shall
				be treated as affordability criteria established under this paragraph.</text>
									</subparagraph><subparagraph id="H2A4367ECEED841BCB4B7F1C2C0983B4C"><enum>(C)</enum><header>Information to
				assist states</header><text>The Administrator may publish information to assist
				States in establishing affordability criteria under subparagraph (A).</text>
									</subparagraph></paragraph><paragraph id="H937B82A0463E44778C1358ED9E2BB2A3"><enum>(3)</enum><header>Priority</header><text>A
				State may give priority to a recipient for a project or activity eligible for
				funding under section 603(c)(1) if the recipient meets the State’s
				affordability criteria.</text>
								</paragraph><paragraph id="H8B17EE63F7AB4812B2C9D1EF88C5F457"><enum>(4)</enum><header>Set-aside</header>
									<subparagraph commented="no" id="H1BF6356666804F0BA86874B00343DF7B"><enum>(A)</enum><header>In
				general</header><text>In any fiscal year in which the Administrator has
				available for obligation more than $1,000,000,000 for the purposes of this
				title, a State shall provide additional subsidization under this subsection in
				the amount specified in subparagraph (B) to eligible entities described in
				paragraph (1) for projects and activities identified in the State’s intended
				use plan prepared under section 606(c) to the extent that there are sufficient
				applications for such assistance.</text>
									</subparagraph><subparagraph id="H64752C3C19B14C3484D39D7CE382F04C"><enum>(B)</enum><header>Amount</header><text>In
				a fiscal year described in subparagraph (A), a State shall set aside for
				purposes of subparagraph (A) an amount not less than 25 percent of the
				difference between—</text>
										<clause id="H3AC8B5F3EE244290BA21369E00CE51B1"><enum>(i)</enum><text>the total amount
				that would have been allotted to the State under section 604 for such fiscal
				year if the amount available to the Administrator for obligation under this
				title for such fiscal year had been equal to $1,000,000,000; and</text>
										</clause><clause id="H55FB57A62B634BAFA6FFC1177080B828"><enum>(ii)</enum><text>the total amount
				allotted to the State under section 604 for such fiscal year.</text>
										</clause></subparagraph></paragraph><paragraph id="H863FEEC887DA463293A7152F10EEC535"><enum>(5)</enum><header>Limitation</header><text>The
				total amount of additional subsidization provided under this subsection by a
				State may not exceed 30 percent of the total amount of capitalization grants
				received by the State under this title in fiscal years beginning after
				September 30,
				2011.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection></section><section id="H305BFC947A264E299707272B9377C95C"><enum>1304.</enum><header>Allotment of
			 funds</header>
					<subsection id="H5E67F0D04E8A49639CD237D2D5BFB1F1"><enum>(a)</enum><header>In
			 General</header><text>Section 604(a) (33 U.S.C. 1384(a)) is amended to read as
			 follows:</text>
						<quoted-block id="H7ADCEC7B2A724E158D8D2671E8E8D8E5" style="OLC">
							<subsection id="HC5C4D5B8140F4A3BBD2EBE002CDB6919"><enum>(a)</enum><header>Allotments</header>
								<paragraph id="H813B975C4B3D4BA293C4CCB059293446"><enum>(1)</enum><header>Fiscal years
				2012 and 2013</header><text>Sums appropriated to carry out this title for each
				of fiscal years 2012 and 2013 shall be allotted by the Administrator in
				accordance with the formula used to allot sums appropriated to carry out this
				title for fiscal year 2011.</text>
								</paragraph><paragraph id="HE06E7D7B1C8A4D719D03258DDCEFA0EC"><enum>(2)</enum><header>Fiscal year 2014
				and thereafter</header><text>Sums appropriated to carry out this title for
				fiscal year 2014 and each fiscal year thereafter shall be allotted by the
				Administrator as follows:</text>
									<subparagraph id="H0DA51952EBF54EAAA73AF6098AEE5799"><enum>(A)</enum><text>Amounts that do
				not exceed $1,350,000,000 shall be allotted in accordance with the formula
				described in paragraph (1).</text>
									</subparagraph><subparagraph id="H42AA38D37A5B4C538AEF9B7EE9D47312"><enum>(B)</enum><text>Amounts that
				exceed $1,350,000,000 shall be allotted in accordance with the formula
				developed by the Administrator under subsection
				(d).</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H68119F42B81C4537BF91E0AD0541A8FE"><enum>(b)</enum><header>Planning
			 Assistance</header><text>Section 604(b) (33 U.S.C. 1384(b)) is amended by
			 striking <quote>1 percent</quote> and inserting <quote>2
			 percent</quote>.</text>
					</subsection><subsection id="HF050C8AAED5A46519DD5A36641A8365C"><enum>(c)</enum><header>Formula</header><text>Section
			 604 (33 U.S.C. 1384) is amended by adding at the end the following:</text>

					</subsection></section><section id="H62DDCA520ECD4A9485ECAD7A8372ABA8"><enum>1305.</enum><header>Intended use
			 plan</header>
					<subsection id="HF3DD3E5FD53F45D5B2F41FC4F34A9FBC"><enum>(a)</enum><header>Integrated
			 Priority List</header><text>Section 603(g) (33 U.S.C. 1383(g)) is amended to
			 read as follows:</text>

				assistance is sought from the State’s water pollution control revolving fund.
				Such projects and activities shall be listed in priority order based on the
				methodology established under paragraph (2). The State may provide financial
				assistance from the State’s water pollution control revolving fund only with
				respect to a project or activity included on such list. In the case of projects
				and activities eligible for assistance under section 603(c)(2), the State may
				include a category or subcategory of nonpoint sources of pollution on such list
				in lieu of a specific project or activity.</text>
								</paragraph><paragraph id="H9484E14B0F4E440FADFFE2C5A24F5C0A"><enum>(2)</enum><header>Methodology</header>
									<subparagraph id="H7BC60E2672634D3CA805D176F4AE3235"><enum>(A)</enum><header>In
				general</header><text>Not later than 1 year after the date of enactment of this
				paragraph, and after providing notice and opportunity for public comment, each
				State (acting through the State’s water quality management agency and other
				appropriate agencies of the State) shall establish a methodology for developing
				a priority list under paragraph (1).</text>
									</subparagraph><subparagraph id="HA7C1DA4998EA4611BCDC9E3AC04B566D"><enum>(B)</enum><header>Priority for
				projects and activities that achieve greatest water quality
				improvement</header><text display-inline="yes-display-inline">In developing the
				methodology, the State shall seek to achieve the greatest degree of water
				quality improvement, taking into consideration the requirements of section
				602(b)(5) and section 603(i)(3), whether such water quality improvements would
				be realized without assistance under this title, and whether the proposed
				projects and activities would address water quality impairments associated with
				existing treatment works.</text>
									</subparagraph><subparagraph id="H7AD02E44F9104F61B3AC9BF7DFA56906"><enum>(C)</enum><header>Considerations
				in selecting projects and activities</header><text>In determining which
				projects and activities will achieve the greatest degree of water quality
				improvement, the State shall consider—</text>
										<clause id="HFD15EE56E54148188785C4787829CB5C"><enum>(i)</enum><text>information
				developed by the State under sections 303(d) and 305(b);</text>
										</clause><clause id="H1DA33EAE43AE4985980502A949F1A48D"><enum>(ii)</enum><text>the State’s
				continuing planning process developed under section 303(e);</text>
										</clause><clause id="H59D9C772C7814221BB12C691BD55191D"><enum>(iii)</enum><text>the State’s
				management program developed under section 319; and</text>
										</clause><clause id="H5138FE9ACC0E4361B327166E9CA01924"><enum>(iv)</enum><text>conservation and
				management plans developed under section 320.</text>
										</clause></subparagraph><subparagraph id="H11D7539E8E19482A98654E12D003B054"><enum>(D)</enum><header>Nonpoint
				sources</header><text>For categories or subcategories of nonpoint sources of
				pollution that a State may include on its priority list under paragraph (1),
				the State shall consider the cumulative water quality improvements associated
				with projects or activities in such categories or subcategories.</text>
									</subparagraph><subparagraph id="H5F6AAF3BBAC447B88B3EEBADFF232AB8"><enum>(E)</enum><header>Existing
				methodologies</header><text>If a State has previously developed, after
				providing notice and an opportunity for public comment, a methodology that
				meets the requirements of this paragraph, the State may use the methodology for
				the purposes of this
				subsection.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H03E1F93AA0CD4F16B5F880F04CD762C8"><enum>(b)</enum><header>Intended Use
			 Plan</header><text>Section 606(c) (33 U.S.C. 1386(c)) is amended—</text>
						<paragraph id="H8D6594646838490A8FBF71CC5DDC4176"><enum>(1)</enum><text>in the matter
			 preceding paragraph (1) by striking <quote>each State shall annually
			 prepare</quote> and inserting <quote>each State (acting through the State’s

			 (as amended by this section), a State shall continue to comply with the
			 requirements of sections 603(g) and 606(c) of such Act, as in effect on the day
			 before the date of enactment of this Act.</text>

								</subparagraph><subparagraph id="HAD5B3B1510864747AEDF11FDD6ED49DD"><enum>(C)</enum><text display-inline="yes-display-inline">an estimate of the number of jobs created
				through carrying out such projects and activities;</text>
								</subparagraph><subparagraph id="H3DB6D3541F704FE58F1BAC22F28DCC96"><enum>(D)</enum><text>an assessment of
				the progress made toward meeting the goals and purposes of this Act through
				such projects and activities; and</text>
								</subparagraph><subparagraph id="HADFC55A3F53A4162BF35378AAD62BBF2"><enum>(E)</enum><text>any additional
				information that the Administrator considers
				appropriate.</text>

				assistance</header>
								<subsection id="H5C8C234E0E7D4FE5BB4B76573EEB6FB2"><enum>(a)</enum><header>Simplified
				Procedures</header><text>Not later than 1 year after the date of enactment of
				this section, the Administrator shall assist the States in establishing
				simplified procedures for treatment works to obtain assistance under this
				title.</text>
								</subsection><subsection id="H0DE8B706B0634EE39F48A70896C9B307"><enum>(b)</enum><header>Publication of
				Manual</header><text>Not later than 2 years after the date of the enactment of
				this section, and after providing notice and opportunity for public comment,
				the Administrator shall publish a manual to assist treatment works in obtaining
				assistance under this title and publish in the Federal Register notice of the
				availability of the manual.</text>
								</subsection><subsection id="H8CD3E58083134EE086A60B4FD0ADD4D1"><enum>(c)</enum><header>Compliance
				criteria</header><text>At the request of any State, the Administrator, after
				providing notice and an opportunity for public comment, shall assist in the
				development of criteria for a State to determine compliance with the conditions
				of funding assistance established under sections 602(b)(13) and
				603(d)(1)(E).</text>
								</subsection></section><section id="H62CFFA446E9447ADA48FB358AE6A739F"><enum>608.</enum><header>Buy
				America</header>
								<subsection id="H10E588D8D71D4834983F69600CFE09F4"><enum>(a)</enum><header>In
				general</header><text>Notwithstanding any other provision of law, funds made
				available from a State water pollution control revolving fund established under
				this title may not be used for a project for the construction of a publicly
				owned treatment works unless the steel, iron, and manufactured goods used for
				the project are produced in the United States.</text>
								</subsection><subsection id="HEB392CD3C0694021905AA7E63BC676F7"><enum>(b)</enum><header>Exceptions</header><text>Subsection
				(a) shall not apply to a project for the construction of a treatment works if
				the Administrator (in consultation with the Governor of the State in which the
				treatment works will be constructed) makes a finding that—</text>
									<paragraph id="HE2EFE2FA5C484CD29DA4250ED320693F"><enum>(1)</enum><text>the steel, iron,
				or manufactured goods required for the project are a de minimis component of
				the project, as determined in accordance with regulations to be issued by the
				Administrator;</text>
									</paragraph><paragraph id="HF534DEE6262548128B55A6A4E9320379"><enum>(2)</enum><text>the steel, iron,
				or manufactured goods required for the project are not produced in the United
				States—</text>
										<subparagraph id="HFBF30DB8DAEC4396B0211723E1F1553C"><enum>(A)</enum><text>in sufficient and
				reasonably available quantities; or</text>
										</subparagraph><subparagraph id="H79C7AE5085F14DBB886DE5ED81618E48"><enum>(B)</enum><text>to a satisfactory
				quality; or</text>
										</subparagraph></paragraph><paragraph id="HE4A0218CCE4E4049A8F08CF8DFBB7C21"><enum>(3)</enum><text>the use of steel,
				iron, and manufactured goods produced in the United States for the project will
				increase the total cost of the project by more than 25 percent.</text>
									</paragraph></subsection><subsection id="HD04023915C1D460281AF4685B358CAA4"><enum>(c)</enum><header>Waiver
				requirements</header>
									<paragraph id="H56301F114C984FB1982B571083BAACD6"><enum>(1)</enum><header>Public
				notification and opportunity for comment</header>
										<subparagraph id="H47FF1EF60C1541DC95101695D700A039"><enum>(A)</enum><header>In
				general</header><text>At least 30 days before making a finding under subsection
				(b), the Administrator shall provide notice of and an opportunity for public
				comment on the finding.</text>
										</subparagraph><subparagraph id="HC5857309E16243D1A85A27EEC0C68570"><enum>(B)</enum><header>Notice
				requirements</header><text>Any notice provided under this subparagraph
				shall—</text>
											<clause id="HE6C071A1152C48CBB21C13BC1129BE5D"><enum>(i)</enum><text>include a
				justification for the proposed finding; and</text>
											</clause><clause id="HB186676418894046B386DC0593D53802"><enum>(ii)</enum><text>be provided by
				electronic means, including on the Internet.</text>
											</clause></subparagraph></paragraph><paragraph id="H416E8668D2454764B13510A4429A8770"><enum>(2)</enum><header>Detailed
				justification in Federal Register</header><text display-inline="yes-display-inline">If the Administrator makes a finding under
				subsection (b), the Administrator shall—</text>
										<subparagraph id="H531BDB16DBA74EEC915E92B617D6C8D8"><enum>(A)</enum><text>publish in the
				Federal Register a detailed justification for the finding; and</text>
										</subparagraph><subparagraph id="H7025BFD755524BD4863123D7A89D3561"><enum>(B)</enum><text>provide notice of
				and an opportunity for public comment on the detailed justification at least 30
				days before the finding takes effect.</text>
										</subparagraph></paragraph><paragraph id="HC49312492BC34F8CA448B292D70575E9"><enum>(3)</enum><header>Annual
				report</header><text>Not later than February 1 of each year beginning after the
				date of enactment of this section, the Administrator shall submit to the
				Committee on Transportation and Infrastructure of the House of Representatives
				and the Committee on Environment and Public Works of the Senate a report
				that—</text>
										<subparagraph id="HA31B76ED8CE948EAA95AB434222CDEF2"><enum>(A)</enum><text>specifies each
				project with respect to which the Administrator made a finding under subsection
				(b) during the preceding calendar year; and</text>
										</subparagraph><subparagraph id="HEA70039982504622ACBD4D8493106DB1"><enum>(B)</enum><text>describes the
				justification for each such finding.</text>
										</subparagraph></paragraph></subsection><subsection id="H9CECB87382ED4194BAADAA8278674430"><enum>(d)</enum><header>State
				requirements</header><text>The Administrator may not impose a limitation or
				condition on assistance provided under this title that restricts—</text>
									<paragraph id="HFE9BDC63C12443AAAB33D8E837909139"><enum>(1)</enum><text>a State from
				imposing requirements that are more stringent than those imposed under this
				section with respect to limiting the use of articles, materials, or supplies
				mined, produced, or manufactured in foreign countries for projects carried out
				with such assistance; or</text>
									</paragraph><paragraph id="H5A339DD9B56F40169DCB2C38D9C0B762"><enum>(2)</enum><text>any recipient of
				assistance from a State water pollution control revolving fund established
				under this title from complying with such State requirements.</text>
									</paragraph></subsection><subsection id="HA1BF14B72619455CB48E7D00FB7369CD"><enum>(e)</enum><header>Intentional
				violations</header><text>Pursuant to procedures established under subpart 9.4
				of chapter 1 of title 48, Code of Federal Regulations, a person shall be
				ineligible to receive a contract or subcontract funded with amounts made
				available from a State water pollution control revolving fund established under
				this title if the Administrator or a court determines that such person
				intentionally—</text>
									<paragraph id="HB30D6C3D7C3B41FB9321BB23D27B42FF"><enum>(1)</enum><text>affixed a label
				bearing a <quote>Made in America</quote> inscription, or any inscription with
				the same meaning, to any steel, iron, or manufactured goods that—</text>
										<subparagraph id="H0160C644BAF54FEB86A5FAD6079BD490"><enum>(A)</enum><text>were used in a
				project to which this section applies; and</text>
										</subparagraph><subparagraph id="HE1B322D9399748EC9C6712DAF93C619D"><enum>(B)</enum><text>were not produced
				in the United States; or</text>
										</subparagraph></paragraph><paragraph id="H77DA933E4B334ED5ACC9CBCD87B78B35"><enum>(2)</enum><text>represented that
				any steel, iron, or manufactured goods were produced in the United States
				that—</text>
										<subparagraph id="HBBCA204BA0D1487EB99D4ECB4DC554AF"><enum>(A)</enum><text>were used in
				projects to which this section applies; and</text>
										</subparagraph><subparagraph id="HCEA533CBB6664BC191573C25835FE31F"><enum>(B)</enum><text>were not produced
				in the United States.</text>
										</subparagraph></paragraph></subsection><subsection id="HAC412E8F89B74CBA97E02F61E1BE5E69"><enum>(f)</enum><header>Consistency with
				international agreements</header>
									<paragraph id="H2F243C6869E946939A6A023F8891E572"><enum>(1)</enum><header>In
				general</header><text>This section shall be applied in a manner that is
				consistent with United States obligations under international
				agreements.</text>
									</paragraph><paragraph id="HC7A890DD4757487DB92ECCD03D9AC5FB"><enum>(2)</enum><header>Treatment of
				foreign countries in violation of international agreements</header><text display-inline="yes-display-inline">The Administrator shall prohibit the use of
				steel, iron, and manufactured goods produced in a foreign country in a project
				funded with amounts made available from a State water pollution control
				revolving fund established under this title, including any project for which
				the Administrator has made a finding under subsection (b), if the
				Administrator, in consultation with the United States Trade Representative,
				determines that the foreign country is in violation of the terms of an
				agreement with the United States by discriminating against steel, iron, or
				manufactured goods that are produced in the United States and covered by the
				agreement.</text>
									</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section id="HB548267CE6E645B5A973AF66B18019F5"><enum>1308.</enum><header>Economic
			 hardship waiver</header><text display-inline="no-display-inline">Notwithstanding the requirements of section
			 602(b)(2) of the Federal Water Pollution Control Act (33 U.S.C. 1382(b)(2)),
			 for fiscal years 2012 and 2013, the Administrator of the Environmental
			 Protection Agency may waive the requirement that a State deposit an amount
			 equal to 20 percent of the State’s annual capitalization grant into the State’s
			 water pollution control revolving fund established under title VI of that Act
			 if the Administrator determines that the State is currently experiencing a
			 local, statewide, or regional economic hardship and that providing such a
			 deposit would adversely impact the State’s ability to restore and maintain the
			 chemical, physical, and biological integrity of waters located within the
			 State.</text>

			 funds</header><text>Section 221(g) of such Act (33 U.S.C. 1301(g)) is amended

				providing notice and an opportunity for public comment, that allocates to each
				State a proportional share of such amounts based on the total needs of the

				overflow controls identified in the most recent survey conducted pursuant to
				section 516 and any other information the Administrator considers
				appropriate.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" id="H85C499FE5C8A476EBD87BDB3A055D1D8"><enum>(d)</enum><header>Reports</header><text>The
			 first sentence of section 221(i) (33 U.S.C. 1301(i)) is amended by striking

				</subsection></section></title><title id="H3EE2F153F90E4A5DB92A813339DD4D4D"><enum>IV</enum><header>Clean Water Trust
			 Fund</header>
			<section id="HEB07E0E918A04D8BB0F717108E9F5A14"><enum>4001.</enum><header>Establishment
			 of Clean Water Trust Fund</header><text display-inline="no-display-inline">Subchapter A of chapter 98 of the Internal
			 Revenue Code of 1986 (relating to the establishment of trust funds) is amended
			 by adding at the end the following new section:</text>

					<section id="HF4766E06403D4025B3DDFAB64D20D899"><enum>9512.</enum><header>Clean Water
				Trust Fund</header>
						<subsection id="H1DB8216CD76A4D50B36049B2424D3C0B"><enum>(a)</enum><header>Creation of
				trust fund</header><text>There is established in the Treasury of the United
				States a trust fund to be known as the <quote>Clean Water Trust Fund</quote>,
				consisting of such amounts as may be appropriated or credited to the Fund as
				provided in this section or section 9602(b).</text>
						</subsection><subsection id="H316974370B2E4F76B7FE6BD4259137E7"><enum>(b)</enum><header>Transfers to
				trust fund</header><text>There are hereby appropriated to the Clean Water Trust
				Fund amounts equivalent to—</text>
							<paragraph id="HF6DF2DEDDFCA4E45838AFE8CEFF48822"><enum>(1)</enum><text>fees, taxes, or
				other sources of revenue specifically collected and deposited in the Fund or
				received in the Treasury for the purposes provided in this section; and</text>
							</paragraph><paragraph id="H66602521F3A647C09157E379917F6850"><enum>(2)</enum><text>any penalty paid
				pursuant to section 309 of the Federal Water Pollution Control Act (33 U.S.C.
				1319) (other than those that result of violations of section 311 of such
				Act).</text>
							</paragraph></subsection><subsection id="H74952ED40EA9419F9AC097BDB405314E"><enum>(c)</enum><header>Appropriation of
				additional sums</header><text display-inline="yes-display-inline">There are
				hereby authorized to be appropriated to the Clean Water Trust Fund such
				additional sums as may be required to make the expenditures referred to in
				subsection (d).</text>
						</subsection><subsection id="HA7CF93C144114D89B074AFFD742B081A"><enum>(d)</enum><header>Expenditures</header><text>Amounts
				in the Clean Water Trust Fund shall be available, as provided in appropriations
				Acts, for the following purposes:</text>
							<paragraph id="HDD5B40748A8946BA979D6A473572AB5E"><enum>(1)</enum><text display-inline="yes-display-inline">Capitalization grants under section 601 of
				the Federal Water Pollution Control Act (33 U.S.C. 1381).</text>
							</paragraph><paragraph id="H665CF52880F841F3A05E74C1E03D167F"><enum>(2)</enum><text>Grants to States
				and interstate agencies under section 106(a) of that Act (33 U.S.C.
				1256(a)).</text>
							</paragraph><paragraph id="H564EFA4C1192432D94DE420F5A477684"><enum>(3)</enum><text>Grants under
				sections 104(b) and 104(g) of that Act (33 U.S.C. 1254(b) and 1254(g)).</text>
							</paragraph><paragraph commented="no" id="H7D8D2794AC1B433D99A12780D7FABD34"><enum>(4)</enum><text display-inline="yes-display-inline">To cover the cost of making direct loans or

			</section><section id="H35C5C4B32A4F4423B6435900D2631D5A"><enum>4002.</enum><header>Allocation of
			 funds</header><text display-inline="no-display-inline">Title VI (as amended by
			 section 1307 of this Act) is further amended by inserting after section 608 the
			 following:</text>

				Trust Fund</header>

				funds</header><text display-inline="yes-display-inline">The Administrator shall
				allocate funds made available for a fiscal year out of the Clean Water Trust
				Fund established by section 9512 of the Internal Revenue Code of 1986 among
				eligible programs and activities as follows:</text>
							<paragraph commented="no" id="HED5B5CEB3376471C92D22ACBF198F6E6"><enum>(1)</enum><text>80 percent for
				capitalization grants under section 604.</text>

				cover the cost of making direct loans or guaranteeing obligations authorized
				under the <short-title>Water Pollution Control Investment
				Act</short-title>.</text>
							</paragraph><paragraph commented="no" id="H959078AD9BD44E949CBD115F6BC17653"><enum>(3)</enum><text>7.5 percent for
				grants to States and interstate agencies under section 106(a).</text>
							</paragraph><paragraph commented="no" id="HDD5FE6C7264B45EE8DF927D3AE9626E1"><enum>(4)</enum><text>2.5 percent for
				grants under sections 104(b) and 104(g).</text>
							</paragraph></subsection><subsection id="H612C75F795C64C3CB379BFAEBFA463A8"><enum>(b)</enum><header>Amounts made
				available for capitalization grants</header><text>To the extent there are
				sufficient applications, not less than 30 percent of the amounts allocated for
				capitalization grants under subsection (a)(1) shall be used for one or more of
				the following purposes:</text>
							<paragraph id="H04C178B244CE4888A8FC493394EA1826"><enum>(1)</enum><text>Projects or
				activities to address green infrastructure.</text>
							</paragraph><paragraph id="HEBC0C91ED48B4858BC892D6864B0D17A"><enum>(2)</enum><text>Water or energy
				efficiency improvements or other environmentally innovative activities.</text>
							</paragraph><paragraph id="H7CA4617DAEC8406FB8EB7E2735FC0EA1"><enum>(3)</enum><text>The implementation
				of best management practices or measures identified in an approved nonpoint
				source management program under section
				319.</text>
							</paragraph></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block>
			</section><section id="H2C68345AC2EF40C38F963A97F0E7D39A"><enum>4003.</enum><header>Revenues for
			 Clean Water Trust Fund</header>
				<subsection id="H35A06F6A0FB44DBEBA3FE7335A8A8B24"><enum>(a)</enum><header>Study on
			 identification of revenues</header><text display-inline="yes-display-inline">Not later than 45 days after the date of
			 enactment of this Act, the Director of the Congressional Budget Office, in
			 consultation with the Administrator of the Environmental Protection Agency and
			 the Secretary of the Treasury, shall undertake a study of potential funding
			 mechanisms and revenue sources for the Clean Water Trust Fund established by
			 section 9512(d) of the Internal Revenue Code of 1986 (as added by this Act)
			 that are sufficient to support annual funding levels of at least
			 $10,000,000,000 for the purposes identified in section 9512(d) of that
			 Act.</text>
				</subsection><subsection id="H2A63914D41DF42D98E764DD2641C8099"><enum>(b)</enum><header>Conduct of
			 study</header><text>In carrying out the study, the Director shall—</text>
					<paragraph id="H533A8F095D524DFEA0FB8EE27F4640A9"><enum>(1)</enum><text>take into
			 consideration whether potential funding mechanisms and revenue sources—</text>
						<subparagraph id="H4309100E13084A26A4B365DCF594C881"><enum>(A)</enum><text>are broad
			 based;</text>
						</subparagraph><subparagraph id="H70182BE177904E0BA6F5508D3C5CC785"><enum>(B)</enum><text>are equitably
			 allocated; and</text>
						</subparagraph><subparagraph id="H50C1F7DA493649E0953C32B272D79BAD"><enum>(C)</enum><text>can be efficiently
			 collected;</text>
						</subparagraph></paragraph><paragraph id="HD3B14866DF254C519616D2AB02F917EE"><enum>(2)</enum><text>review and, to the
			 extent practicable, utilize existing studies and reports on potential sources
			 of revenue for a clean water trust fund, including—</text>
						<subparagraph id="H5F221786139245B89BD3DCA43644E1FF"><enum>(A)</enum><text>the report of the
			 Government Accountability Office entitled <quote>Clean Water Infrastructure: A
			 Variety of Issues Need to Be Considered When Designing a Clean Water Trust
			 Fund</quote> (GAO–09–037, May 2009); and</text>
						</subparagraph><subparagraph id="H58E44A2197644C28BDBAF0390CCC1FB8"><enum>(B)</enum><text>the report of the
			 Environmental Protection Agency entitled <quote>Alternative Funding Study:
			 Water Quality Fees and Debt Financing Issues</quote> (EPA 832–R–96–001, June
			 1996);</text>
						</subparagraph></paragraph><paragraph id="HF314C4B9FB0A489C915840F70043E541"><enum>(3)</enum><text>consult with
			 Federal, State, tribal, and local agencies, representatives of business and
			 industry, representatives of entities operating publicly owned treatment works,
			 representatives of conservation and environmental organizations,
			 representatives of ratepayer organizations, and other interested persons;
			 and</text>
					</paragraph><paragraph id="HCC225A4138FF45C7A3D546CB3A49147D"><enum>(4)</enum><text>provide the
			 opportunity for public hearings.</text>
					</paragraph></subsection><subsection id="H2012E695716E41D1BA28BC3683EEBB4F"><enum>(c)</enum><header>Report to
			 Congress</header><text>Not later than 1 year after the date of enactment of
			 this Act, the Director shall submit a report on the results of the study
			 to—</text>
					<paragraph id="HCBA4180A1B954FD88EA0A710D87A70A5"><enum>(1)</enum><text>the Committee on
			 Transportation and Infrastructure, the Committee on Ways and Means, and the
			 Committee on the Budget of the House of Representatives; and</text>
					</paragraph><paragraph id="HE87756635A2E464FB3664C6D85FD7F26"><enum>(2)</enum><text>the Committee on
			 Environment and Public Works, the Committee on Finance, and the Committee on
			 the Budget of the Senate.</text>
					</paragraph></subsection></section></title><title id="H072BE65F3879435F9DA941F7875C4300"><enum>V</enum><header>Water
			 Pollution Control Investment</header>
			<section id="H3EB30BCDD10B4B45A40DE0198CF5A9B0"><enum>5001.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>Water Pollution Control
			 Investment Act</short-title></quote>.</text>
			</section><section id="H62CC23BD52D642F68A51EC15076B3AED"><enum>5002.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title, the following definitions
			 apply:</text>
				<paragraph id="H1ED1F3C308F14F8995D1ED7556E838AE"><enum>(1)</enum><header>Administrator</header><text>The
			 term <term>Administrator</term> means the Administrator of the Environmental
			 Protection Agency.</text>
				</paragraph><paragraph commented="no" id="H71029E1861CD44CB942BC63FC1B31C3C"><enum>(2)</enum><header>Borrower</header><text display-inline="yes-display-inline">The term <term>borrower</term> means a
			 person who owes payments of interest or principal on an obligation guaranteed
			 under this title.</text>
				</paragraph><paragraph commented="no" id="H97EC2A7E24CF459F99D1D73DDD8A755D"><enum>(3)</enum><header>Cost of a direct
			 loan</header><text display-inline="yes-display-inline">The term <quote>cost of
			 a direct loan</quote> means the <quote>cost of a direct loan</quote> as that
			 term is used in section 502(5) of the Federal Credit Reform Act of 1990 (2
			 U.S.C. 661a(5)).</text>
				</paragraph><paragraph commented="no" id="H46F588220A68448BBFECE03DC9EC62B3"><enum>(4)</enum><header>Cost of a
			 guarantee</header><text display-inline="yes-display-inline">The term <term>cost
			 of a guarantee</term> means the <term>cost of a loan guarantee</term> as that
			 term is used in section 502(5) of the Federal Credit Reform Act of 1990 (2
			 U.S.C. 661a(5)).</text>
				</paragraph><paragraph commented="no" id="HB94D97BBC5FD4FCC8F3AE8F03612AFB1"><enum>(5)</enum><header>Direct
			 loan</header><text display-inline="yes-display-inline">The term <quote>direct
			 loan</quote> has the meaning given that term in section 502 of the Federal
			 Credit Reform Act of 1990 (2 U.S.C. 661a).</text>
				</paragraph><paragraph id="HA3B39B8C7AFC431DB20C8D9162778341"><enum>(6)</enum><header>Guarantee</header>
					<subparagraph id="H4233FAD49A5F4F61993E35155EE43698"><enum>(A)</enum><header>In
			 general</header><text>The term <term>guarantee</term> has the meaning given the
			 term <term>loan guarantee</term> in section 502 of the Federal Credit Reform
			 Act of 1990 (2 U.S.C. 661a).</text>
					</subparagraph><subparagraph commented="no" id="HDE9C94834B5F46579A2DA2615DE13404"><enum>(B)</enum><header>Inclusion</header><text>The
			 term <term>guarantee</term> includes a loan guarantee commitment (as that term
			 is defined in section 502 of the Federal Credit Reform Act of 1990 (2 U.S.C.
			 661a)).</text>
					</subparagraph></paragraph><paragraph id="H512DA51CE03F463BA06726312408ED23"><enum>(7)</enum><header>Large water
			 infrastructure project</header>
					<subparagraph id="HE2C68421A7624752BAE71BD49396F1AF"><enum>(A)</enum><header>In
			 general</header><text>The term <term>large water infrastructure project</term>
			 means a project for construction of a publicly owned treatment works that
			 qualifies for assistance under section 603(c) of the Federal Water Pollution
			 Control Act (33 U.S.C. 1383(c)), but because of its significant scope and cost
			 is not likely to receive assistance under that Act, as determined by the
			 Administrator.</text>
					</subparagraph><subparagraph id="HEBCD00FCBD2344229441E8DB3E2912B0"><enum>(B)</enum><header>Guidelines</header><text>The
			 Administrator shall issue guidelines for determining whether a project
			 qualifies as a large water infrastructure project.</text>
					</subparagraph></paragraph><paragraph commented="no" id="HF4E4764B721F4062AF1A1F0D30E4F44A"><enum>(8)</enum><header>Obligation</header><text>The
			 term <term>obligation</term> means a loan or other debt obligation.</text>
				</paragraph><paragraph id="H93ABD9AF21D04D2F9C3FB080B91BB26A"><enum>(9)</enum><header>State
			 infrastructure financing authority</header><text display-inline="yes-display-inline">The term <quote>State infrastructure
			 financing authority</quote> means the State entity established or designated by
			 the Governor of a State to receive a capitalization grant provided by, or
			 otherwise carry out the requirements of, title VI of the Federal Water
			 Pollution Control Act (33 U.S.C. 1381 et. seq.).</text>
				</paragraph></section><section id="HE75967641C5646398596C2A571230E8A"><enum>5003.</enum><header>Direct
			 loans</header>
				<subsection id="H1098073B5B1E43BDAEEE0861FF513E21"><enum>(a)</enum><header>In
			 general</header>
					<paragraph commented="no" id="HE848E432AB514C099F4B058AF972E7A0"><enum>(1)</enum><header>Use of
			 loans</header><text display-inline="yes-display-inline">The Administrator may
			 make a direct loan to a State infrastructure financing authority for use in the
			 same manner, and subject to the same terms and conditions (unless otherwise
			 specified in this section), as a capitalization grant made under section 601 of
			 the Federal Water Pollution Control Act (33 U.S.C. 1831).</text>
					</paragraph><paragraph id="H83C6381ED3C04F94AE8DFEA702931B05"><enum>(2)</enum><header>Terms and
			 conditions</header><text display-inline="yes-display-inline">The Administrator
			 may make a loan under this section on such terms and conditions (including
			 requirements for audits) as the Administrator determines appropriate.</text>
					</paragraph></subsection><subsection id="H7257DA04988646D2AF256D105CA01651"><enum>(b)</enum><header>Loan
			 requirements</header>
					<paragraph id="HA6DC5716F54242B7961E32E60695436C"><enum>(1)</enum><header>Maximum
			 amount</header><text display-inline="yes-display-inline">The amount of a loan
			 made under this section to a State infrastructure financing authority shall not
			 exceed the applicable percentage for the State establishing such authority of
			 the total amount available under this title for disbursement, based on the
			 allotment for the State in accordance with section 604 of the Federal Water
			 Pollution Control Act (33 U.S.C. 1384).</text>
					</paragraph><paragraph id="H3C7AF07877824F87A8B5AC2863A42DB7"><enum>(2)</enum><header>Term of
			 loan</header><text display-inline="yes-display-inline">The final maturity date
			 of a loan made under this section shall not be later than 35 years after the
			 date on which funds are disbursed to a State infrastructure financing
			 authority.</text>
					</paragraph><paragraph id="H91C50CC8732848E397C90E973B17F6C9"><enum>(3)</enum><header>Interest
			 rate</header><text display-inline="yes-display-inline">The Administrator may
			 make a loan under this section only if the Administrator determines that the
			 interest rate on the loan is appropriate, taking into account the prevailing
			 rate of interest in the private sector for similar loans.</text>
					</paragraph><paragraph commented="no" id="H372F4C056D284341B37EBF1639A5AFE9"><enum>(4)</enum><header>Security</header><text display-inline="yes-display-inline">The Administrator shall require a State
			 infrastructure financing authority receiving a loan under this section to use a
			 rate covenant, coverage requirement, or similar security feature adequate to
			 ensure loan repayment.</text>
					</paragraph><paragraph id="H1CEC5AE251874810AC9326C0964542C4"><enum>(5)</enum><header>Repayment</header>
						<subparagraph commented="no" id="H27194090B4CD4C0A9FF6FFEC0FF06234"><enum>(A)</enum><header>Schedule</header><text display-inline="yes-display-inline">The Administrator shall set a repayment
			 schedule for each loan made under this section based on the projected cash flow
			 to the State infrastructure financing authority, including consideration of the
			 effect on such cash flow of the security features described in paragraph
			 (4).</text>
						</subparagraph><subparagraph id="HAC40C6D44339480699B07B312A093833"><enum>(B)</enum><header>Commencement</header><text display-inline="yes-display-inline">Scheduled loan repayments of principal or
			 interest on a loan made under this section shall commence not later than 5
			 years after the date on which the loan is made.</text>
						</subparagraph><subparagraph id="H6E995F4BB11B4B3DAB98120D0C377CD4"><enum>(C)</enum><header>Deferral of
			 payments</header>
							<clause commented="no" id="H88628E0CBF0D4DBB85333585E551E773"><enum>(i)</enum><header>In
			 general</header><text>If the Administrator determines that a State
			 infrastructure financing authority lacks the resources to make scheduled
			 payments on a loan made under this section based on circumstances not
			 foreseeable at the time the loan is made, the Administrator may allow for the
			 deferral of such payments.</text>
							</clause><clause id="HE639CC8FEF4B47E18059D108502BC288"><enum>(ii)</enum><header>Interest</header><text>Any
			 payment deferred under clause (i) shall—</text>
								<subclause id="H849F7CB3176F484A93C28D99A41AD273"><enum>(I)</enum><text>continue to accrue
			 interest until fully repaid; and</text>
								</subclause><subclause id="H84EDF90D439D4B3883CF2C9FADF47AFB"><enum>(II)</enum><text>be amortized over
			 the remaining term of the loan.</text>
								</subclause></clause></subparagraph><subparagraph id="H111F71F676234A02BAAEA58A4549B701"><enum>(D)</enum><header>Prepayment</header><text>Payments
			 on the loan may be made in advance with no penalty.</text>
						</subparagraph></paragraph></subsection><subsection id="H0F8910251BF5495E904F855FB2E4B348"><enum>(c)</enum><header>Sale of
			 loans</header><text display-inline="yes-display-inline">After notifying the
			 State infrastructure financing authority, the Administrator, in consultation
			 with the Secretary of the Treasury, may sell a loan made under this section, if
			 the Administrator determines that the sale can be made on favorable
			 terms.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HD55D9B7D34F44D30B870F921CC808AA7"><enum>(d)</enum><header>Conforming
			 requirements</header><text>The requirements of sections 211, 511(c)(1), and 513
			 of the Federal Water Pollution Control Act (33 U.S.C. 1291, 1371(c)(2), and
			 1372) apply to the construction of a project carried out in whole or in part
			 with assistance made available through a loan under this section in the same
			 manner as treatment works for which grants are made available under the Federal
			 Water Pollution Control Act.</text>
				</subsection><subsection id="H512099BC800E467FA5AE5A922DD26478"><enum>(e)</enum><header>Fees</header><text display-inline="yes-display-inline">The Administrator shall charge and collect
			 fees from State infrastructure financing authorities receiving loans under this
			 section in amounts the Administrator determines are sufficient to cover the
			 administrative expenses associated with carrying out this section and, as
			 provided in advance in appropriations Acts, use such amounts to cover such
			 expenses.</text>
				</subsection><subsection id="H8F2A181B10A14AD6B9B0579C80E04F60"><enum>(f)</enum><header>Records;
			 Audits</header>
					<paragraph id="HEB57BB7E01A84F6996545B43B8AECA95"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">A State
			 infrastructure financing authority receiving a loan under this section shall
			 keep such records and other pertinent documents as the Administrator shall
			 prescribe by regulation, including such records as the Administrator may
			 require to facilitate an effective audit of loans made under this
			 section.</text>
					</paragraph><paragraph id="HD6789F98191B4218A092C92D470ABC56"><enum>(2)</enum><header>Access</header><text>The
			 Administrator and the Comptroller General of the United States, or their duly
			 authorized representatives, shall have access, for the purpose of audits, to
			 records and other pertinent documents kept under paragraph (1).</text>
					</paragraph></subsection></section><section id="HE303B8E8353B4845B80302FAB3311B2F"><enum>5004.</enum><header>Guarantees</header>
				<subsection id="H1E7B61243EC648B59EB1BDC1F54F3F15"><enum>(a)</enum><header>In
			 general</header>
					<paragraph commented="no" id="H2DD9562AC89640B8B32DE0E184201A0F"><enum>(1)</enum><header>Use of
			 guarantees</header><text>The Administrator may make a guarantee under this
			 title for an obligation for construction of a large water infrastructure
			 project in accordance with the requirements of this section.</text>
					</paragraph><paragraph id="H5086C492166244ECAC76E216A256E9CF"><enum>(2)</enum><header>Selection
			 criteria</header>
						<subparagraph display-inline="no-display-inline" id="H0577658CC208484AB24B14B5866524D8"><enum>(A)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Administrator shall establish criteria
			 for selecting among large water infrastructure projects in making guarantees
			 under this title.</text>
						</subparagraph><subparagraph id="H6697CFB0E3984933A47BB2A6FA8562BB"><enum>(B)</enum><header>Criteria</header><text display-inline="yes-display-inline">In establishing selection criteria under
			 this paragraph, the Administrator shall include consideration of the
			 following:</text>
							<clause id="H55606AF383BA41DEA9196AC720A67FC2"><enum>(i)</enum><text display-inline="yes-display-inline">The extent to which the project is
			 nationally or regionally significant.</text>
							</clause><clause id="H82FEDE142C1347E191DC6FDE73690DE5"><enum>(ii)</enum><text>The
			 creditworthiness of the project, including a determination by the Administrator
			 that any financing has appropriate features to ensure repayment.</text>
							</clause><clause id="H4FCE6DEA2E434C7D9E733AB5A0B9F51D"><enum>(iii)</enum><text>The extent to
			 which the project uses new technologies that enhance the environmental benefits
			 of the project.</text>
							</clause><clause id="H88AE044461F746BC90EF797F5CC66389"><enum>(iv)</enum><text display-inline="yes-display-inline">The cost of a guarantee under this
			 title.</text>
							</clause><clause id="H88062E5608C241EE8D8B30F801890F3B"><enum>(v)</enum><text>The
			 extent to which the project helps restore, maintain, or protect the
			 environment.</text>
							</clause></subparagraph></paragraph><paragraph id="HC8ABE55DC0A6431CA8D5312989A6BFCE"><enum>(3)</enum><header>Fiscal year
			 limitation</header><text display-inline="yes-display-inline">The Administrator
			 may not utilize more than 10 percent of the funds made available under this
			 title for a fiscal year to make guarantees under this section during that
			 fiscal year.</text>
					</paragraph><paragraph id="HE7770A80206E4A83B035433B94A2E5F4"><enum>(4)</enum><header>Terms and
			 conditions</header><text display-inline="yes-display-inline">The Administrator
			 may make a guarantee for a large water infrastructure project under this title
			 on such terms and conditions (including requirements for audits) as the
			 Administrator determines appropriate.</text>
					</paragraph><paragraph commented="no" id="H5EBCF8CE56F14657B9602418B18637E5"><enum>(5)</enum><header>Security</header><text display-inline="yes-display-inline">The Administrator shall require a borrower
			 to use a rate covenant, coverage requirement, or similar security feature
			 adequate to ensure repayment of the obligation.</text>
					</paragraph></subsection><subsection id="HDD8904AEEF9A4D71AA66BD0FB27B9D07"><enum>(b)</enum><header>Guarantee
			 requirements</header>
					<paragraph id="H001B6F715CFC423F98FB36776AE96F6D"><enum>(1)</enum><header>Probability of
			 repayment</header><text display-inline="yes-display-inline">The Administrator
			 may make a guarantee under this title only if the Administrator determines that
			 there is a high probability of repayment by the borrower of the principal and
			 interest on the obligation.</text>
					</paragraph><paragraph id="HB3A1CFD008EF447AA416BC393F7B2151"><enum>(2)</enum><header>Amount</header>
						<subparagraph id="HF09DC763733D4DABB78563BB16A5A214"><enum>(A)</enum><header>Percentage of
			 total cost</header><text display-inline="yes-display-inline">The Administrator
			 may make a guarantee under this title only if the amount of the obligation does
			 not exceed 75 percent of the total cost of the large water infrastructure
			 project, as estimated at the time at which the guarantee is issued.</text>
						</subparagraph><subparagraph id="H956A297365B24222B8DC23FB4E6B5DCC"><enum>(B)</enum><header>Sufficiency</header><text>The
			 Administrator may make a guarantee under this title only if the Administrator
			 determines that the amount of the obligation, when combined with amounts
			 available from other sources, will be sufficient to carry out the
			 project.</text>
						</subparagraph></paragraph><paragraph id="H4E3F12E4DC884B73966266E57FD073D2"><enum>(3)</enum><header>Nonsubordination</header><text display-inline="yes-display-inline">The Administrator may make a guarantee
			 under this title only if the guarantee is not subordinate to other
			 financing.</text>
					</paragraph><paragraph id="H93B0C10A178D4F33870D54F9AA68B9B4"><enum>(4)</enum><header>Interest
			 rate</header><text display-inline="yes-display-inline">The Administrator may
			 make a guarantee under this title only if the Administrator determines that the
			 interest rate on the obligation is appropriate, taking into account the
			 prevailing rate of interest in the private sector for similar obligations.</text>
					</paragraph><paragraph id="HC8366E07D9354EFC94F1A2C0D8BB8D01"><enum>(5)</enum><header>Term</header><text display-inline="yes-display-inline">The Administrator may make a guarantee
			 under this title only if—</text>
						<subparagraph id="HBBB8E70270304390AE522922ABD22015"><enum>(A)</enum><text>repayment of the
			 obligation is required over a period not to exceed the lesser of—</text>
							<clause id="HD8D3869629A84D5892544C420A16F380"><enum>(i)</enum><text>35
			 years; or</text>
							</clause><clause id="H573CD78CE3B64F3B9F94A8CE2F706113"><enum>(ii)</enum><text display-inline="yes-display-inline">90 percent of the projected useful life of
			 the large water infrastructure project to be financed by the obligation (as
			 determined by the Administrator); and</text>
							</clause></subparagraph><subparagraph commented="no" id="HD9F286C39EF94F05B431740787BA1230"><enum>(B)</enum><text display-inline="yes-display-inline">payments on the obligation are scheduled to
			 commence not later than 5 years after the date of substantial completion of the
			 large water infrastructure project.</text>
						</subparagraph></paragraph></subsection><subsection id="HE3A1A5B960284F44AB239AD913E3ED3E"><enum>(c)</enum><header>Conforming
			 requirements</header>
					<paragraph id="HAA57BC86C9224287B990F0434A9F73C5"><enum>(1)</enum><header>Fiscal
			 sustainability plan</header><text display-inline="yes-display-inline">The
			 Administrator may make a guarantee for a large water infrastructure project
			 under this title only if the owner or operator of such project commits to
			 develop and implement a fiscal sustainability plan that meets the requirements
			 of section 603(d)(1)(E) of the Federal Water Pollution Control Act, as added by
			 this Act.</text>
					</paragraph><paragraph id="H9EC77FC3213C436F9B7BD9E704AB77A6"><enum>(2)</enum><header>Priority
			 list</header><text display-inline="yes-display-inline">The Administrator may
			 make a guarantee for a large water infrastructure project under this title only
			 if such project is on a State priority list under section 603(g) of the Federal
			 Water Pollution Control Act (33 U.S.C. 1383(g)), as amended by this Act.</text>
					</paragraph><paragraph id="H5D802FD6050A42BF9742A153DC2C3001"><enum>(3)</enum><header>Additional
			 requirements</header><text display-inline="yes-display-inline">The requirements
			 of sections 211, 511(c)(1), and 513 of the Federal Water Pollution Control Act
			 (33 U.S.C. 1291, 1371(c)(2), and 1372) apply to the construction of a large
			 water infrastructure project carried out in whole or in part with financing
			 made available through an obligation guaranteed under this title in the same
			 manner as treatment works for which grants are made available under the Federal
			 Water Pollution Control Act.</text>
					</paragraph></subsection><subsection id="H26E6E25D5BCD4BA1BBCB416C29C9B8C4"><enum>(d)</enum><header>Defaults</header>
					<paragraph id="H0D55D2744DED46A69F4428BEF7FDF811"><enum>(1)</enum><header>Payment by
			 Administrator</header>
						<subparagraph id="H7884C5EA1AD9495792E2872B281C86BB"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">If a borrower
			 defaults on an obligation guaranteed under this title (as defined in
			 regulations promulgated by the Administrator and specified in the guarantee
			 contract), the holder of the guarantee shall have the right to demand payment
			 of the unpaid amount from the Administrator.</text>
						</subparagraph><subparagraph id="H04A63539044E48CC8D82D20ADAA9C099"><enum>(B)</enum><header>Payment
			 required</header><text display-inline="yes-display-inline">Within such period
			 as may be specified in the guarantee or related agreements, the Administrator
			 shall pay to the holder of a guarantee the unpaid interest on, and unpaid
			 principal of, the obligation guaranteed under this title as to which the
			 borrower has defaulted, unless the Administrator finds that there was no
			 default by the borrower in the payment of interest or principal or that the
			 default has been remedied.</text>
						</subparagraph><subparagraph id="H9DE6FB17110145E9AD2BF938D6382A46"><enum>(C)</enum><header>Forbearance</header><text display-inline="yes-display-inline">Nothing in this subsection precludes any
			 forbearance by the holder of a guarantee for the benefit of the borrower which
			 may be agreed upon by the parties to the obligation and approved by the
			 Administrator.</text>
						</subparagraph></paragraph><paragraph id="H08441953E5054D9A949F958D7CF8D736"><enum>(2)</enum><header>Subrogation</header>
						<subparagraph id="HA8F332829A1549CC86BCFDD06261E14E"><enum>(A)</enum><header>In
			 general</header><text>If the Administrator makes a payment under paragraph (1),
			 the Administrator shall be subrogated to the rights of the holder of the
			 guarantee as specified in the guarantee or related agreements.</text>
						</subparagraph><subparagraph id="H14B3B0070F48419591B6845C47213243"><enum>(B)</enum><header>Superiority of
			 rights</header><text display-inline="yes-display-inline">The rights of the
			 Administrator, with respect to any property acquired pursuant to a guarantee or
			 related agreements, shall be superior to the rights of any other person with
			 respect to the property.</text>
						</subparagraph></paragraph></subsection><subsection id="H4A6DD79EFFAA410D8851089EC03E2FC0"><enum>(e)</enum><header>Payment of
			 principal and interest by Administrator</header>
					<paragraph id="H95FD103136D0497280B1B621208FE4C5"><enum>(1)</enum><header>In
			 general</header><text>With respect to any obligation guaranteed under this
			 title, the Administrator may enter into a contract to pay, and pay, a holder of
			 the guarantee, for and on behalf of the borrower, from funds appropriated for
			 that purpose, the principal and interest payments which become due and payable
			 on the unpaid balance of the obligation if the Administrator finds that—</text>
						<subparagraph id="HE01D3DC745DA47E7948EE67110411222"><enum>(A)</enum><text>the borrower is
			 unable to meet the payments and is not in default;</text>
						</subparagraph><subparagraph id="HA9DC0E3F7AD7423C9C8B8D386DD458DC"><enum>(B)</enum><text>it is in the
			 public interest to permit the borrower to continue to pursue the purposes of
			 the project;</text>
						</subparagraph><subparagraph id="HDBA38FAADD6442E0AA4BFD8E9CCD4EBC"><enum>(C)</enum><text>the probable net
			 benefit to the Federal Government in paying the principal and interest will be
			 greater than that which would result in the event of a default; and</text>
						</subparagraph><subparagraph id="HEDA81FAF09AF4E01B1BA4541988ABEC1"><enum>(D)</enum><text display-inline="yes-display-inline">the State or region in which the project is
			 located is experiencing a period of local or regional economic hardship that
			 has affected the borrower's ability to meet the payments.</text>
						</subparagraph></paragraph><paragraph id="HF8898DB5E59F401093839169298D0F31"><enum>(2)</enum><header>Amount</header><text>The
			 amount of the payment that the Administrator is authorized to pay under this
			 subsection shall be no greater than the amount of principal and interest that
			 the borrower is obligated to pay under the obligation.</text>
					</paragraph><paragraph id="H9F12E05AC5FF4BB2888F566DF4CE6B86"><enum>(3)</enum><header>Reimbursement</header><text>A
			 payment may be made under this subsection only if the borrower agrees to
			 reimburse the Administrator for the payment (including interest) on terms and
			 conditions that are satisfactory to the Administrator.</text>
					</paragraph></subsection><subsection commented="no" id="HF7365021B2C3487EBF9EDE566A588750"><enum>(f)</enum><header>Fees</header><text>The
			 Administrator shall charge and collect fees from borrowers for guarantees made
			 under this title in amounts the Administrator determines are sufficient to
			 cover the administrative expenses associated with carrying out this title and,
			 as provided in advance in appropriations Acts, use such amounts to cover such
			 expenses.</text>
				</subsection><subsection id="H35B7D33929034DBEA65650BD3AA664AB"><enum>(g)</enum><header>Records;
			 audits</header>
					<paragraph id="H8352C9997FA747AEAE9EF2E97B5E4EE6"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">A borrower shall keep
			 such records and other pertinent documents as the Administrator shall prescribe
			 by regulation, including such records as the Administrator may require to
			 facilitate an effective audit of guarantees made under this title.</text>
					</paragraph><paragraph id="HE72917D24E3C4E5AA6EAE3425E2830CD"><enum>(2)</enum><header>Access</header><text display-inline="yes-display-inline">The Administrator and the Comptroller
			 General of the United States, or their duly authorized representatives, shall
			 have access, for the purpose of audits, to records and other pertinent
			 documents kept under paragraph (1).</text>
					</paragraph></subsection><subsection id="H14DB273401DE42F6872EF6F832B7B8F6"><enum>(h)</enum><header>Full faith and
			 credit</header><text display-inline="yes-display-inline">The full faith and
			 credit of the United States is pledged to the payment of all guarantees made
			 under this title.</text>
				</subsection></section><section id="HFEB581618ECC419FB5CEF20557A0D3F7"><enum>5005.</enum><header>Funding</header>
				<subsection commented="no" id="H70AB401F0E3346FCB2D5F7228DE51B0B"><enum>(a)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated such sums as are necessary to provide direct
			 loans and the costs of guarantees under this title.</text>
				</subsection><subsection commented="no" id="HB6C19F8D0AAC49FC834DEE01D8E34E0C"><enum>(b)</enum><header>Alternate
			 funding mechanism</header><text display-inline="yes-display-inline">With
			 respect to a guarantee for a large water infrastructure project under this
			 title, in lieu of funding such guarantee through a separate appropriation, the
			 borrower of the obligation to be guaranteed may pay a one-time guarantee fee to
			 the Administrator equal to the cost of the guarantee, and the Administrator may
			 use such fee, as provided in advance in appropriations Acts, to make such
			 guarantee.</text>
