		<official-title display="yes">To amend the Immigration and Nationality
		  Act to require accreditation of certain educational institutions for purposes
		  of a nonimmigrant student visa, and for other purposes.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" id="H69A1451547D841118A73E47FC2E58B94" style="OLC">
		<section id="HA17AA83F9FEE4D0789E5D43E228ADEA5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Student Visa Reform
			 Act</short-title></quote>.</text>
		</section><section id="H115EB78607974FBD8EF60CF80E65401E"><enum>2.</enum><header>Accreditation
			 requirement for colleges and universities</header><text display-inline="no-display-inline">Section 101(a) of the Immigration and
			 Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8
			 U.S.C. 1101(a)</external-xref>) is amended—</text>
			<paragraph id="H3B94E5806F8C4B6EB37D578AEBE41E93"><enum>(1)</enum><text>in paragraph
			 (15)(F)(i)—</text>
				<subparagraph id="H6C2CF101D0CE4A198535FFC2D6127D01"><enum>(A)</enum><text>by striking
			 <quote>section 214(l) at an established college, university, seminary,
			 conservatory, academic high school, elementary school, or other academic
			 institution or in an accredited language training program in the United
			 States</quote> and inserting <quote>section 214(m) at an accredited college,
			 university, or language training program, or at an established seminary,
			 conservatory, academic high school, elementary school, or other academic
			 institution in the United States</quote>; and</text>
				</subparagraph><subparagraph id="H3387AC0AA76743B580DCCEE13E29ADB5"><enum>(B)</enum><text>by striking
			 <quote>Attorney General</quote> each place such term appears and inserting
			 <quote>Secretary of Homeland Security</quote>; and</text>
				</subparagraph></paragraph><paragraph id="H76C9EBF359E14FF6B3D43EECFFDF3931"><enum>(2)</enum><text>by amending
			 paragraph (52) to read as follows:</text>
				<quoted-block id="HB9432C064D8040118A55BEFACA21B1DB" style="traditional">
					<paragraph id="H86370325018743B491357C5D29F63212" indent="up1"><enum>(52)</enum><text>Except as provided in section
				214(m)(4), the term <quote>accredited college, university, or language training
				program</quote> means a college, university, or language training program that
				is accredited by an accrediting agency recognized by the Secretary of
				Education.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HCC0D61FED90A4C29A78B3AD1D19E1476"><enum>3.</enum><header>Other
			 requirements for academic institutions</header><text display-inline="no-display-inline">Section 214(m) of the Immigration and
			 Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8
			 U.S.C. 1184(m)</external-xref>) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H6645E2B0624144429A2C0F3C69D6308E" style="traditional">
				<paragraph id="H917300D1DB3145A59FE647E1C41F76F9" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security, in the
				Secretary’s discretion, may require accreditation of an academic institution
				(except for seminaries or other religious institutions) for purposes of section
				101(a)(15)(F) if—</text>
					<subparagraph id="H26F049D7298D48FEAB899D498C68AAD5"><enum>(A)</enum><text display-inline="yes-display-inline">that institution is not already required to
				be accredited under section 101(a)(15)(F)(i);</text>
					</subparagraph><subparagraph id="H4EB158A1A4D74176B0A21F363D2126C9"><enum>(B)</enum><text display-inline="yes-display-inline">an
				appropriate accrediting agency recognized by the Secretary of Education is able
				to provide such accreditation; and</text>
					</subparagraph><subparagraph id="H6B6816A9584A4355B05372C5F03369D2"><enum>(C)</enum><text display-inline="yes-display-inline">the institution has or will have 25 or more
				alien students accorded status as nonimmigrants under clause (i) or (iii) of
				section 101(a)(15)(F) pursuing a course of study at that institution.</text>
					</subparagraph></paragraph><paragraph id="HA2406CC56F374009B3715DA103707BE5" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security, in the
				Secretary’s discretion, may waive the accreditation requirement in section
				101(a)(15)(F)(i) with respect to an established college, university, or
				language training program if the academic institution—</text>
					<subparagraph id="H4AA8FFB8B6614F1C9E2BFFB7C0556A30"><enum>(A)</enum><text>is otherwise in compliance with the
				requirements of such section; and</text>
					</subparagraph><subparagraph id="HA62C8272D48C41D9ACB25530B4FAADD6"><enum>(B)</enum><text>is making a good faith effort to
				satisfy the accreditation requirement.</text>
					</subparagraph></paragraph><paragraph id="H693B54D169E24518AE77E1F8295A7AF9" indent="up1"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HF4F9A52E26FE440FAA7E009A537361B3"><enum>(A)</enum><text display-inline="yes-display-inline">No person convicted of an offense referred
				to in subparagraph (B) shall be permitted by any academic institution having
				authorization for attendance by nonimmigrant students under section
				101(a)(15)(F)(i) to be involved with the institution as its principal, owner,
				officer, board member, general partner, or other similar position of
				substantive authority for the operations or management of the institution,
				including serving as an individual designated by the institution to maintain
				records required by the Student and Exchange Visitor Information System
				established under section 641 of the Illegal Immigration Reform and Immigrant
				Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1372">8 U.S.C. 1372</external-xref>).</text>
					</subparagraph><subparagraph id="H90C4FBACEA0F493D92CC14A0066502F9" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">An offense referred to in this subparagraph
				includes a violation, punishable by a term of imprisonment of more than 1 year,
				of any of the following:</text>
						<clause id="HE6173DE0CC1841D7BB8C77EBDB991EAA"><enum>(i)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/77">Chapter 77</external-xref> of title 18,
				United States Code (relating to peonage, slavery and trafficking in
				persons).</text>
						</clause><clause id="HF03A4F7D6A4C43538DEAFF45F55DFF8F"><enum>(ii)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/117">Chapter
				117</external-xref> of title 18, United States Code (relating to transportation
				for illegal sexual activity and related crimes).</text>
						</clause><clause id="H47D19A9BAAC54E4DA99B8712A42F9BD5"><enum>(iii)</enum><text>Section 274 of the Immigration and
				Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324">8
				U.S.C. 1324</external-xref>) (relating to unlawful bringing of aliens into the
				United States).</text>
						</clause><clause id="H95C142943C1E46669E5A907727BE5B0E"><enum>(iv)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/18/1546">Section 1546</external-xref> of title 18, United
				States Code (relating to fraud and misuse of visas, permits, and other
				documents) relating to an academic institution’s participation in the Student
				and Exchange Visitor
				Program.</text>
						</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" id="HC14BD3F0A4794C2FA0E5CE1153317490"><enum>4.</enum><header>Conforming
			 amendment</header><text display-inline="no-display-inline">Section 212(a)(6)(G)
			 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(6)(G)</external-xref>) is amended
			 by striking <quote>section 214(l)</quote> and inserting <quote>section
			 214(m)</quote>.</text>
		</section><section id="H106CCE87CD4E4003A15C150349AC1450"><enum>5.</enum><header>Effective
			 date</header>
			<subsection id="H29755004939349978859E192B3A5459B"><enum>(a)</enum><header>In
			 general</header><text>Except as provided in subsection (b), the amendments made
			 by sections 2 and 3—</text>
				<paragraph id="HC4BA15A309F8496C90D4119011D0D5AC"><enum>(1)</enum><text>shall take effect
			 on the date that is 180 days after the date of the enactment of this Act;
			 and</text>
				</paragraph><paragraph id="HE13722209610437CA5DC0CB7025CA589"><enum>(2)</enum><text>shall apply with
			 respect to applications for a nonimmigrant visa under section 101(a)(15)(F)(i)
			 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(F)(i)</external-xref>) that are
			 filed on or after the effective date described in paragraph (1).</text>
				</paragraph></subsection><subsection id="HE245669C186C4FD0AAAD0D3E9160F716"><enum>(b)</enum><header>Temporary
			 exception</header>
				<paragraph id="H5074A71752034D55BA375F4695E97D16"><enum>(1)</enum><header>In
			 general</header><text>During the 3-year period beginning on the date of
			 enactment of this Act, an alien seeking to enter the United States to pursue a
			 course of study at a college or university that has been certified by the
			 Secretary of Homeland Security may be granted a nonimmigrant visa under clause
			 (i) or clause (iii) of section 101(a)(15)(F) of the Immigration and Nationality
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C.
			 1101(a)(15)(F)</external-xref>) without regard to whether or not that college
			 or university has been accredited or been denied accreditation by an entity
			 described in section 101(a)(52) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(52)</external-xref>), as amended by
			 section 2(2) of this Act.</text>
				</paragraph><paragraph id="HDEA871E7589F411889011F79981DC145"><enum>(2)</enum><header>Additional
			 requirement</header><text>An alien may not be granted a nonimmigrant visa under
			 paragraph (1) if the college or university to which the alien seeks to enroll
			 does not—</text>
					<subparagraph id="H10C6B9CA68844D239A6CC639E3FD0B79"><enum>(A)</enum><text>submit an
			 application for the accreditation of such institution to a regional or national
			 accrediting agency recognized by the Secretary of Education on or before the
			 date that is 1 year after the effective date described in subsection (a)(1);
			 and</text>
					</subparagraph><subparagraph id="H316A4DEA86B5467B87AF248E252B9A11"><enum>(B)</enum><text>comply with the
			 applicable accrediting requirements of such agency.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
