		  per-country limitation on family-sponsored immigrant visas, and for other

		<section id="H18452F1BBC854591B6D1752A52AF6176" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Protecting American Families and
			 Businesses Act of 2011</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="HBCB9A236E3A948C68148C0A30C974F56" section-type="subsequent-section"><enum>2.</enum><header>Equal treatment among
			 foreign states</header>
			<subsection id="H63ABF59D689A4727BF5E18FD7B457F92"><enum>(a)</enum><header>Numerical
			 limitation to any single foreign state</header><text display-inline="yes-display-inline">Section 202(a)(2) of the Immigration and
			 Nationality Act (8 U.S.C. 1152(a)(2)) is amended—</text>
				<paragraph id="H9B864F6F8E974804B93E863677FF97FA"><enum>(1)</enum><text>in the paragraph
			 heading, by striking <quote><header-in-text level="paragraph" style="OLC">and
			 employment-based</header-in-text></quote>;</text>
				</paragraph><paragraph id="H8CB1B6C70FE34933B0E25B8FB353132D"><enum>(2)</enum><text>by striking
			 <quote>(3), (4), and (5),</quote> and inserting <quote>(3) and
			 (4),</quote>;</text>
				</paragraph><paragraph id="H48181F53740549BA9E32405B89B4D595"><enum>(3)</enum><text>by striking
			 <quote>subsections (a) and (b) of section 203</quote> and inserting
			 <quote>section 203(a)</quote>;</text>
				</paragraph><paragraph id="HA0E7D0CE4C054B58B11474D90B418E42"><enum>(4)</enum><text>by striking
			 <quote>7</quote> and inserting <quote>15</quote>; and</text>
				</paragraph><paragraph id="H34E78A2590C4440EB46F7A43B7824EE6"><enum>(5)</enum><text>by striking
			 <quote>such subsections</quote> and inserting <quote>such
			 section</quote>.</text>
				</paragraph></subsection><subsection id="HAD4989751F4E4103A07DB65AC7C0F139"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Section 202 of the Immigration and Nationality Act (8
			 U.S.C. 1152) is amended—</text>
				<paragraph id="HD3126D1D36424804B5356231FFBFE243"><enum>(1)</enum><text>in subsection
			 (a)(3), by striking <quote>both subsections (a) and (b) of section 203</quote>
			 and inserting <quote>section 203(a)</quote>;</text>
				</paragraph><paragraph id="H1C226A531F0546CFBA01029FD48A93BD"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (a)(5); and</text>
				</paragraph><paragraph id="H4FA9369F80914F42803D31C828D05AEC"><enum>(3)</enum><text>by amending
			 subsection (e) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H4157F687B1044602AF76A07D43E97A58" style="OLC">
						<subsection id="HCE2E8CD60E434F01B5DB5CC8ECD3E4C1"><enum>(e)</enum><header>Special rules
				for countries at ceiling</header><text display-inline="yes-display-inline">If
				it is determined that the total number of immigrant visas made available under
				section 203(a) to natives of any single foreign state or dependent area will
				exceed the numerical limitation specified in subsection (a)(2) in any fiscal
				year, in determining the allotment of immigrant visa numbers to natives under
				section 203(a), visa numbers with respect to natives of that state or area
				shall be allocated (to the extent practicable and otherwise consistent with
				this section and section 203) in a manner so that, except as provided in
				subsection (a)(4), the proportion of the visa numbers made available under each
				of paragraphs (1) through (4) of section 203(a) is equal to the ratio of the
				total number of visas made available under the respective paragraph to the
				total number of visas made available under section
				203(a).</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H736E6F12234C4CF1A2F1A998F4F80CE0"><enum>(c)</enum><header>Country-Specific
			 offset</header><text display-inline="yes-display-inline">Section 2 of the
			 Chinese Student Protection Act of 1992 (8 U.S.C. 1255 note) is amended—</text>
				<paragraph id="H72AD620BF00040CE90BD4B692640EB3A"><enum>(1)</enum><text>in subsection (a),
			 by striking <quote>subsection (e))</quote> and inserting <quote>subsection
			 (d))</quote>; and</text>
				</paragraph><paragraph id="H2BA52C8DBD5A43DDB5CA20171A99C80A"><enum>(2)</enum><text>by striking
			 subsection (d) and redesignating subsection (e) as subsection (d).</text>
				</paragraph></subsection><subsection id="H3BF26D03EE304FC9BBCEFBB85DFC21E9"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to fiscal
			 years beginning with fiscal year 2013.</text>
			</subsection><subsection id="HE98E01B6D6044726A94F392470416632"><enum>(e)</enum><header>Transition rules
			 for employment-Based immigrants</header>
				<paragraph id="HB712BAA0FFA34D2BB6ABC84ACE4F8127"><enum>(1)</enum><header>In
			 general</header><text>Subject to the succeeding paragraphs of this subsection
			 and notwithstanding title II of the Immigration and Nationality Act (8 U.S.C.
			 1151 et seq.), the following rules shall apply:</text>
					<subparagraph id="H13EB3A622A974FF3B5A3296506287B79"><enum>(A)</enum><text display-inline="yes-display-inline">For fiscal year 2013, 15 percent of the
			 total number of immigrant visas made available under section 203(b) of such Act
			 (8 U.S.C. 1153(b)) shall be allotted to immigrants who are natives of a foreign
			 state or dependent area that was not one of the two states with the largest
			 numbers of natives obtaining lawful permanent resident status during fiscal
			 year 2011 under such section 203(b).</text>
					</subparagraph><subparagraph id="H860451C7876045D6835F5F9AF2FB236F"><enum>(B)</enum><text display-inline="yes-display-inline">For fiscal year 2014, 10 percent of the
			 total number of immigrant visas made available under such section 203(b) shall
			 be allotted to immigrants who are natives of a foreign state or dependent area
			 that was not one of the two states with the largest numbers of natives
			 obtaining lawful permanent resident status during fiscal year 2012 under such
			 section 203(b).</text>
					</subparagraph><subparagraph id="H800199B0D76E43E7B404C4FD480F9B87"><enum>(C)</enum><text display-inline="yes-display-inline">For fiscal year 2015, 10 percent of the
			 total number of immigrant visas made available under such section 203(b) shall
			 be allotted to immigrants who are natives of a foreign state or dependent area
			 that was not one of the two states with the largest numbers of natives
			 obtaining lawful permanent resident status during fiscal year 2013 under such
			 section 203(b).</text>
					</subparagraph></paragraph><paragraph id="H960FAEF5C5AE4F4FA5F949492382204A"><enum>(2)</enum><header>Per-country
			 levels</header>
					<subparagraph id="H6DE605E889BB42D29F67E07552981359"><enum>(A)</enum><header>Reserved
			 visas</header><text>With respect to the visas reserved under each of
			 subparagraphs (A) through (C) of paragraph (1), the number of such visas made
			 available to natives of any single foreign state or dependent area in the
			 appropriate fiscal year may not exceed 25 percent (in the case of a single
			 foreign state) or 2 percent (in the case of a dependent area) of the total
			 number of such visas.</text>
					</subparagraph><subparagraph id="H69CCA43A6FAA4E489F865B337142D092"><enum>(B)</enum><header>Unreserved
			 visas</header>
						<clause id="HCB484EB3A3854D758CCA59537E68EE0B"><enum>(i)</enum><header>In
			 general</header><text>With respect to the immigrant visas made available under
			 such section 203(b) and not reserved under paragraph (1), for each of fiscal
			 years 2013, 2014, and 2015, not more than the number of such visas calculated
			 under clause (ii) shall be allotted to immigrants who are natives of any single
			 foreign state.</text>
						</clause><clause id="HC16594BB46F5492FAB284298E3E3A065"><enum>(ii)</enum><header>Calculation of
			 number</header><text display-inline="yes-display-inline">The numbers of visas
			 calculated under this clause for a fiscal year is the number that is equal to
			 70 percent of the total number of immigrant visas made available under such
			 section 203(b) for such fiscal year.</text>
						</clause></subparagraph></paragraph><paragraph id="H2FA54088205043B4A6E9FBF31658F6F2"><enum>(3)</enum><header>Rules for
			 chargeability</header><text display-inline="yes-display-inline">Section 202(b)
			 of such Act (8 U.S.C. 1152(b)) shall apply in determining the foreign state to
			 which an alien is chargeable for purposes of this subsection.</text>
				</paragraph></subsection></section><section id="H0B1D0FA178A14232B97D2057AB5497B0" section-type="subsequent-section"><enum>3.</enum><header>Special provisions in
			 cases of lengthy adjudications</header>
			<subsection id="H44F6DA444C2B4D459F12A678C5A107D8"><enum>(a)</enum><header>Employment-Based
			 immigrants</header>
				<paragraph id="H9153B83FE70D4E0AA54E6BE4C20C30D1"><enum>(1)</enum><header>In
			 general</header><text>Section 214 of the Immigration and Nationality Act (8
			 U.S.C. 1154) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H645833CB3B2944C4857A754FD4819072" style="OLC">
						<subsection id="H7B73D2574B3741B1BA3492E082B89430"><enum>(s)</enum><header>Special
				provisions in cases of lengthy adjudications</header>
							<paragraph id="H399EAD80A20F45E094B98FF12C0F1A4A"><enum>(1)</enum><header>Exemption from
				limitations</header><text display-inline="yes-display-inline">Notwithstanding
				subsections (c)(2)(D), (g)(4) and (m), the authorized stay of an alien
				described in paragraph (2) may be extended pursuant to paragraph (3) if 365
				days or more have elapsed since the filing of any of the following:</text>
								<subparagraph id="HD93E7C91D6E04E0394359BC9B6B68697"><enum>(A)</enum><text>An application for
				labor certification under section 212(a)(5)(A), in a case in which
				certification is required or used by an alien to obtain status under section
				203(b).</text>
								</subparagraph><subparagraph id="H256120538075458F94BD86B930861650"><enum>(B)</enum><text>A petition
				described in section 204(b) to accord the alien a status under section
				203(b).</text>
								</subparagraph></paragraph><paragraph id="H79F7FBC0D4F44C028706DCCBF4C08968"><enum>(2)</enum><header>Aliens
				described</header><text>An alien is described in this paragraph if the alien
				was previously issued a visa or otherwise provided nonimmigrant status
				under—</text>
								<subparagraph id="HF4CE431B1F58411DAB0FBA2D129E41A8"><enum>(A)</enum><text display-inline="yes-display-inline">section 101(a)(15)(F);</text>
								</subparagraph><subparagraph id="HF05FC77B5DC8482DB09BE279FF30B9FC"><enum>(B)</enum><text>section
				101(a)(15)(H)(i)(b); or</text>
								</subparagraph><subparagraph id="H85A55823816A4CC39314CA48713A270B"><enum>(C)</enum><text>section
				101(a)(15)(L).</text>
								</subparagraph></paragraph><paragraph id="HC5B22F9697064E14A6DFAE2EBEC2D08C"><enum>(3)</enum><header>Extension of
				status</header><text>The Secretary of Homeland Security shall extend the stay
				of an alien who qualifies for an extension under paragraph (1) in one-year
				increments until such time as a final decision is made—</text>
								<subparagraph id="H05CA7BED181C4BE7B105B463B6BEA6B0"><enum>(A)</enum><text>to deny the
				application described in paragraph (1)(A), or, in a case in which such
				application is granted, to deny a petition described in paragraph (1)(B) filed
				on behalf of the alien pursuant to such grant;</text>
								</subparagraph><subparagraph id="H3CB487235FE64399A553E4F405D03A11"><enum>(B)</enum><text>to deny the
				petition described in paragraph (1)(B); or</text>
								</subparagraph><subparagraph id="H6A8C3732381E43C88C093DEA93BEA572"><enum>(C)</enum><text>to grant or deny
				the alien’s application for an immigrant visa or adjustment of status to that
				of an alien lawfully admitted for permanent
				residence.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H85C371DA3B4647DD8CD08B51177ECBC8"><enum>(2)</enum><header>Providing dual
			 intent for students</header><text display-inline="yes-display-inline">Section
			 101(a)(15)(F)(i) of the Immigration and Nationality Act (8 U.S.C.
			 1101(a)(15)(F)(i)) is amended by striking <quote>having a residence in a
			 foreign country which he has no intention of abandoning,</quote>.</text>
				</paragraph><paragraph id="H23545047D3F44D64B2B9FC742281B3C2"><enum>(3)</enum><header>Conforming
			 amendments</header>
					<subparagraph id="H42253481F1F34D739E0F573739256FFD"><enum>(A)</enum><text display-inline="yes-display-inline">Section 106 of the American Competitiveness
			 in the 21st Century Act is amended by striking subsections (a) and (b).</text>
					</subparagraph><subparagraph id="H69AEEC8EF0CD417383DE6E56E3A6AC6C"><enum>(B)</enum><text>Section 214(b) of
			 the Immigration and Nationality Act (8 U.S.C. 1184(b)) is amended by striking
			 <quote>(L) or (V)</quote> and inserting <quote>(F), (L) or (V)</quote>.</text>
					</subparagraph><subparagraph id="H2C91508CAE2746379BE837108C4A7454"><enum>(C)</enum><text display-inline="yes-display-inline">Section 214(h) of the Immigration and
			 Nationality Act (8 U.S.C. 1184(h)) is amended by striking
			 <quote>(H)(i)(b)</quote> and inserting <quote>(F), (H)(i)(b)</quote> .</text>
					</subparagraph></paragraph></subsection><subsection id="H53B2D3E536754BE1A69BDCC0906D5664"><enum>(b)</enum><header>Family-Based
			 immigrants</header><text>Section 101(a)(15) of the Immigration and Nationality
			 Act (8 U.S.C. 1101(a)(15)) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H3F1B722767944E0C93811E4FC1F1A816" style="OLC">
					<subparagraph id="HF51067B1165647F2B3F2A79B8A374492"><enum>(W)</enum><text display-inline="yes-display-inline">an alien who is the beneficiary (including
				a child of the principle alien, if eligible to receive a visa under section
				203(d)) of an approved petition to accord a status under section 203(a)(2)(A)
				if 180 days or more have elapsed since the filing of such petition and—</text>
						<clause id="H4B3230140F5C49669A366B8C155266E9"><enum>(i)</enum><text>an
				immigrant visa is not immediately available to the alien because of a waiting
				list of applicants for visas under section 203(a)(2)(A); or</text>
						</clause><clause id="HD2D581963CC643968881DB377923274A"><enum>(ii)</enum><text>the alien’s
				application for an immigrant visa, or the alien’s application for adjustment of
				status under section 245, pursuant to the approval of such petition, remains
				pending.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HEFA87F1D49B04235AD062848A7181985"><enum>4.</enum><header>Recapturing
			 immigrant visas lost to bureaucratic delay</header>
			<subsection id="HDB0696C322474066BA33D452F5E467F2"><enum>(a)</enum><header>Employment-Based
			 immigrants</header><text>Section 201(d) of the Immigration and Nationality Act
			 (8 U.S.C. 1151(d)) is amended to read as follows:</text>
				<quoted-block id="H2D98682EA8ED496FBB26E01FD350821E" style="OLC">
					<subsection id="H3914DC8067BC461481F07D9D5BC410B0"><enum>(d)</enum><header>Worldwide Level
				of Employment-Based Immigrants</header>
						<paragraph id="HD0D8874C15B7448E8729C768607D9153"><enum>(1)</enum><header>In
				general</header><text>The worldwide level of employment-based immigrants under
				this subsection for a fiscal year is equal to the sum of—</text>
							<subparagraph id="H6583D99A03CA4B58873AD2683AB14052"><enum>(A)</enum><text display-inline="yes-display-inline">140,000;</text>
							</subparagraph><subparagraph id="HD063450D968F48C2BAC2CED339D7BF25"><enum>(B)</enum><text>the number
				computed under paragraph (2); and</text>
							</subparagraph><subparagraph id="HF90F81EABB5D434EA0D64ECD68884840"><enum>(C)</enum><text>the number
				computed under paragraph (3).</text>
							</subparagraph></paragraph><paragraph id="H36E0E88CDA7B444B8F5AC1CCF4A9D72C"><enum>(2)</enum><header>Previous fiscal
				year</header><text>The number computed under this paragraph for a fiscal year
				is the difference, if any, between the maximum number of visas which may be
				issued under section 203(a) (relating to family-sponsored immigrants) during
				the previous fiscal year and the number of visas issued under that section
				during that year.</text>
						</paragraph><paragraph id="HC905A4A671BE49E687B4E4932E134CC1"><enum>(3)</enum><header>Unused
				visas</header><text>The number computed under this paragraph is the difference,
				if any, between—</text>
							<subparagraph id="H81EF2661E69E447AAD68F3BC55BE7419"><enum>(A)</enum><text>the difference, if
				any, between—</text>
								<clause id="HB8E5682739434975A03976B31B62BA8F"><enum>(i)</enum><text>the sum of the
				worldwide levels established under paragraph (1) for fiscal years 1992 through
				2011; and</text>
								</clause><clause id="H0E2F0557D3DA4B14B7FF1445C1134791"><enum>(ii)</enum><text>the number of
				visas actually issued under section 203(b), subject to this subsection, during
				such fiscal years; and</text>
								</clause></subparagraph><subparagraph id="H97ED47A8A5614E5D884411BC88074142"><enum>(B)</enum><text>the number of
				visas actually issued after fiscal year 2011 pursuant to an immigrant visa
				number issued under section 203(b), subject to this subsection, during fiscal
				years 1992 through
				2011.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HAC5937A31B244EF98D5CF38EFB9CD9F7"><enum>(b)</enum><header>Family-Sponsored
			 immigrants</header><text>Section 201(c) of the Immigration and Nationality Act
			 (8 U.S.C. 1151(c)) is amended to read as follows:</text>
				<quoted-block id="H451F63C5B823409785720AD60CF97275" style="OLC">
					<subsection id="H7E56730B3DDE4BA4A8AB8C787BDD62C7"><enum>(c)</enum><header>Worldwide Level
				of Family-Sponsored Immigrants</header>
						<paragraph id="H1551017C62684D3CA9822250604E9847"><enum>(1)</enum><header>In
				general</header>
							<subparagraph id="HB07548B76E0141B785E1E90579E1B209"><enum>(A)</enum><text>Subject to
				subparagraph (B), the worldwide level of family-sponsored immigrants under this
				subsection for a fiscal year is equal to—</text>
								<clause id="H472A048B83E84282A85D59A655BEB26A"><enum>(i)</enum><text>480,000 minus the
				number computed under paragraph (2); plus</text>
								</clause><clause id="H3F738DB9E8264BD885CA475D7EAFFA17"><enum>(ii)</enum><text>the sum of the
				number computed under paragraph (3) and the number computed under paragraph
				(4).</text>
								</clause></subparagraph><subparagraph id="HC570A64AF7B942B5BBA7D1CA67164DB1"><enum>(B)</enum><text>In no case shall
				the number computed under subparagraph (A)(i) be less than 226,000.</text>
							</subparagraph></paragraph><paragraph id="HA4BAA6B177AD40ECAAD68BE768452A01"><enum>(2)</enum><header>Immediate
				relatives</header><text>The number computed under this paragraph for a fiscal
				year is the number of aliens described in subparagraph (A) or (B) of subsection
				(b)(2) who were issued immigrant visas, or who otherwise acquired the status of
				an alien lawfully admitted to the United States for permanent residence, in the
				previous fiscal year.</text>
						</paragraph><paragraph id="HEA4F664CBFD942A2B8F4AB1B93368EC2"><enum>(3)</enum><header>Previous fiscal
				year</header><text>The number computed under this paragraph for a fiscal year
				is the difference, if any, between the maximum number of visas which may be
				issued under section 203(b) (relating to employment-based immigrants) during
				the previous fiscal year and the number of visas issued under that section
				during that year.</text>
						</paragraph><paragraph id="H84311140499045FDA9BE99855D5DF061"><enum>(4)</enum><header>Unused
				visas</header><text>The number computed under this paragraph is the difference,
				if any, between—</text>
							<subparagraph id="H2D5F67698CA2418A9508AD1DC3CC8C29"><enum>(A)</enum><text>the difference, if
				any, between—</text>
								<clause id="H06B67151C5954EDC95A7ED8FCF8597E7"><enum>(i)</enum><text>the sum of the
				worldwide levels established under paragraph (1) for fiscal years 1992 through
				2011; and</text>
								</clause><clause id="H5430EEB48E3A4C608858ED3C53744E31"><enum>(ii)</enum><text>the number of
				visas actually issued under section 203(a), subject to this subsection, during
				such fiscal years; and</text>
								</clause></subparagraph><subparagraph id="HE5C5F4458CDB44468ED805FB61269D14"><enum>(B)</enum><text>the number of
				visas actually issued after fiscal year 2011 pursuant to an immigrant visa
				number issued under section 203(a), subject to this subsection, during fiscal
				years 1992 through
				2011.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section></legis-body>
