		<official-title display="yes">To grant the Secretary of the Interior
		  permanent authority to authorize States to issue electronic duck stamps, and
		  for other purposes.</official-title>

		<section id="H809F68E88290453FA18A230B3D8D237B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Permanent Electronic Duck Stamp Act of
			 2012</short-title></quote>.</text>
		</section><section id="H73BA53548B2F4ABF8F200C657B32E2A0"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H836634EE2CB546C08D7D047987F2BD2A"><enum>(1)</enum><header>Actual
			 stamp</header><text display-inline="yes-display-inline">The term <term>actual
			 stamp</term> means a Federal migratory-bird hunting and conservation stamp
			 required under the Act of March 16, 1934 (<external-xref legal-doc="usc" parsable-cite="usc/16/718a">16 U.S.C. 718a et seq.</external-xref>) (popularly
			 known as the <quote>Duck Stamp Act</quote>), that is printed on paper and sold
			 through the means established by the authority of the Secretary immediately
			 before the date of enactment of this Act.</text>
			</paragraph><paragraph id="HAE0B76387A0144EEA825B6FB934A0CE2"><enum>(2)</enum><header>Automated
			 licensing system</header>
				<subparagraph id="H16F0EA14189B451EA6CAF667E0DFA015"><enum>(A)</enum><header>In
			 general</header><text>The term <term>automated licensing system</term> means an
			 electronic, computerized licensing system used by a State fish and wildlife
			 agency to issue hunting, fishing, and other associated licenses and
			 products.</text>
				</subparagraph><subparagraph id="HA027CF3E4AD4441AB9B72A39671607AD"><enum>(B)</enum><header>Inclusion</header><text display-inline="yes-display-inline">The term <term>automated licensing
			 system</term> includes a point-of-sale, Internet, telephonic system, or other
			 electronic applications used for a purpose described in subparagraph
			 (A).</text>
				</subparagraph></paragraph><paragraph id="HE74248AB08AB4E77B996636E05C08A0B"><enum>(3)</enum><header>Electronic
			 stamp</header><text>The term <term>electronic stamp</term> means an electronic
			 version of an actual stamp that—</text>
				<subparagraph id="H667D19465C11457DB13B0DCA6E2277B2"><enum>(A)</enum><text>is a unique
			 identifier for the individual to whom it is issued;</text>
				</subparagraph><subparagraph id="H44848C5E282944B197E08B10A0315E9B"><enum>(B)</enum><text display-inline="yes-display-inline">can be printed on paper or produced through
			 an electronic application with the same indicators as the State endorsement
			 provides;</text>
				</subparagraph><subparagraph id="HA0863611B85A447B8F181D945718E3B4"><enum>(C)</enum><text>is issued through
			 a State automated licensing system that is authorized, under State law and by
			 the Secretary under this Act, to issue electronic stamps;</text>
				</subparagraph><subparagraph id="HA21F4E0D4D6F46D2A20E593904469535"><enum>(D)</enum><text>is compatible with
			 the hunting licensing system of the State that issues the electronic stamp;
			 and</text>
				</subparagraph><subparagraph id="H1B704F4EEECE49E7B38588F3CE79BB47"><enum>(E)</enum><text>is described in
			 the State application approved by the Secretary under section 4(b).</text>
				</subparagraph></paragraph><paragraph id="H62D2BCBD1B1442C8A2A858B8954E8F0F"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph></section><section id="H541940914F0041EA9571515A31FC6B56"><enum>3.</enum><header>Authority to
			 issue electronic duck stamps</header>
			<subsection id="H0512F51A927E41E3A39055F02E835E82"><enum>(a)</enum><header>In
			 general</header><text>The Secretary may authorize any State to issue electronic
			 stamps in accordance with this Act.</text>
			</subsection><subsection id="HCE9F8A5B0973466D95CFA6B5B0F93442"><enum>(b)</enum><header>Consultation</header><text>The
			 Secretary shall implement this section in consultation with State management
			 agencies.</text>
			</subsection></section><section id="H8324A479165E4DEF92C4591C8FB550BC"><enum>4.</enum><header>State
			 application</header>
			<subsection id="H40305211F56549DBA9A5C700EE23D5E6"><enum>(a)</enum><header>Approval of
			 Application required</header><text display-inline="yes-display-inline">The
			 Secretary may not authorize a State to issue electronic stamps under this Act
			 unless the Secretary has received and approved an application submitted by the
			 State in accordance with this section. The Secretary may determine the number
			 of new States per year to participate in the electronic stamp program.</text>
			</subsection><subsection id="H7CCAD37753994A84B67753C4CE119485"><enum>(b)</enum><header>Contents of
			 Application</header><text>The Secretary may not approve a State application
			 unless the application contains—</text>
				<paragraph id="HADBBB0DC3E39454D88F72315790693E6"><enum>(1)</enum><text>a
			 description of the format of the electronic stamp that the State will issue
			 under this Act, including identifying features of the licensee that will be
			 specified on the stamp;</text>
				</paragraph><paragraph id="H20622C2C2D1F4D7284AEBA2A26D6468E"><enum>(2)</enum><text>a
			 description of any fee the State will charge for issuance of an electronic
			 stamp;</text>
				</paragraph><paragraph id="H24974226D4A24324BE89752AAA160E29"><enum>(3)</enum><text>a
			 description of the process the State will use to account for and transfer to
			 the Secretary the amounts collected by the State that are required to be
			 transferred to the Secretary under the program;</text>
				</paragraph><paragraph id="HE1ECC213A29848BF95C63A50F35B4205"><enum>(4)</enum><text>the manner by
			 which the State will transmit electronic stamp customer data to the
			 Secretary;</text>
				</paragraph><paragraph id="HAB91AEDB9DCD460AB4D230A319A5FA59"><enum>(5)</enum><text>the manner by
			 which actual stamps will be delivered;</text>
				</paragraph><paragraph id="H9B8317A52F874250B4D6E7465FC50D37"><enum>(6)</enum><text>the policies and
			 procedures under which the State will issue duplicate electronic stamps;
			 and</text>
				</paragraph><paragraph id="H895AFC334A264E9D96989C2E28BB647D"><enum>(7)</enum><text>such other
			 policies, procedures, and information as may be reasonably required by the
			 Secretary.</text>
				</paragraph></subsection><subsection id="HBC8DA6F7ACCD40F3A1C140333983B0E4"><enum>(c)</enum><header>Publication of
			 Deadlines, Eligibility Requirements, and Selection Criteria</header><text>Not
			 later than 30 days before the date on which the Secretary begins accepting
			 applications under this section, the Secretary shall publish—</text>
				<paragraph id="H4FE4F55EB3F54934B66FF210F28E2ACB"><enum>(1)</enum><text>deadlines for
			 submission of applications;</text>
				</paragraph><paragraph id="HAC133632BA2E4F93BCEF061FF52689A3"><enum>(2)</enum><text>eligibility
			 requirements for submitting applications; and</text>
				</paragraph><paragraph id="HD50BEBDC4B214522AAE5382EF7CBE205"><enum>(3)</enum><text>criteria for
			 approving applications.</text>
				</paragraph></subsection></section><section id="H2571A8786E3C47B9B739A7BD8BEDFFEC"><enum>5.</enum><header>State obligations
			 and authorities</header>
			<subsection id="H6DDA03CA8953434DBE3AD494A64E9C67"><enum>(a)</enum><header>Delivery of
			 Actual Stamp</header><text>The Secretary shall require that each individual to
			 whom a State sells an electronic stamp under this Act shall receive an actual
			 stamp—</text>
				<paragraph id="H49D62DB2CBFF48ADB3ACB1E8793EAB5A"><enum>(1)</enum><text>by not later than
			 the date on which the electronic stamp expires under section 6(c); and</text>
				</paragraph><paragraph id="H96B51C2A57FA4612BD5A90A4042FF430"><enum>(2)</enum><text>in a manner agreed
			 upon by the State and Secretary.</text>
				</paragraph></subsection><subsection id="H83E93EA6C9F9427A82208B8F4730004F"><enum>(b)</enum><header>Collection and
			 transfer of electronic stamp revenue and customer information</header>
				<paragraph id="H7D744C23B6434C7884D589ED133FC934"><enum>(1)</enum><header>Requirement to
			 transmit</header><text>The Secretary shall require each State authorized to
			 issue electronic stamps to collect and submit to the Secretary in accordance
			 with this section—</text>
					<subparagraph id="H39CB1F32879145DB914D09F0BCACDD6E"><enum>(A)</enum><text>the first name,
			 last name, and complete mailing address of each individual that purchases an
			 electronic stamp from the State;</text>
					</subparagraph><subparagraph id="H064CF236807D448FBA26578E133D9516"><enum>(B)</enum><text>the face value
			 amount of each electronic stamp sold by the State; and</text>
					</subparagraph><subparagraph id="H93FD5FA63A1249A99BD6BBD847C2CC61"><enum>(C)</enum><text>the amount of the
			 Federal portion of any fee required by the agreement for each stamp
			 sold.</text>
					</subparagraph></paragraph><paragraph id="HBB0C72DFD2154D0CB767283F1B24B990"><enum>(2)</enum><header>Time of
			 transmittal</header><text display-inline="yes-display-inline">The Secretary
			 shall require the submission under paragraph (1) to be made with respect to
			 sales of electronic stamps by a State according to the written agreement
			 between the Secretary and the State agency.</text>
				</paragraph><paragraph id="H8BCECBEBD2624B88810DDCBF485D7DBC"><enum>(3)</enum><header>Additional fees
			 not affected</header><text>This section shall not apply to the State portion of
			 any fee collected by a State under subsection (c).</text>
				</paragraph></subsection><subsection id="H36D3D5D41AAD45B8B5D87DA69176DC97"><enum>(c)</enum><header>Electronic Stamp
			 Issuance Fee</header><text>A State authorized to issue electronic stamps may
			 charge a reasonable fee to cover costs incurred by the State and the Department
			 of the Interior in issuing electronic stamps under this Act, including costs of
			 delivery of actual stamps.</text>
			</subsection><subsection id="HDB03087D525348C798C1FCDE7B06149B"><enum>(d)</enum><header>Duplicate
			 Electronic Stamps</header><text>A State authorized to issue electronic stamps
			 may issue a duplicate electronic stamp to replace an electronic stamp issued by
			 the State that is lost or damaged.</text>
			</subsection><subsection id="H79093004843B4692B2096CF58CD2FFE2"><enum>(e)</enum><header>Limitation on
			 Authority To Require Purchase of State License</header><text>A State may not
			 require that an individual purchase a State hunting license as a condition of
			 issuing an electronic stamp under this Act.</text>
			</subsection></section><section id="H06D973AD03AF4BB2B9B70A9ADE16BE0D"><enum>6.</enum><header>Electronic stamp
			 requirements; recognition of electronic stamp</header>
			<subsection id="H8A6912A8BD854F8AB2EC082D11D9ADF6"><enum>(a)</enum><header>Stamp
			 Requirements</header><text>The Secretary shall require an electronic stamp
			 issued by a State under this Act—</text>
				<paragraph id="H3FD0B7826A664FF5A281345CA53D0CE5"><enum>(1)</enum><text>to have the same
			 format as any other license, validation, or privilege the State issues under
			 the automated licensing system of the State; and</text>
				</paragraph><paragraph id="H92D1E1DACDF1457E8993C73F5D05F522"><enum>(2)</enum><text>to specify
			 identifying features of the licensee that are adequate to enable Federal,
			 State, and other law enforcement officers to identify the holder.</text>
				</paragraph></subsection><subsection id="H6E6CF9F9EC6D4133A8B0CBA03D5E3781"><enum>(b)</enum><header>Recognition of
			 Electronic Stamp</header><text>Any electronic stamp issued by a State under
			 this Act shall, during the effective period of the electronic stamp—</text>
				<paragraph id="H8F75BE2171F042BAB67827CF313786FB"><enum>(1)</enum><text>bestow upon the
			 licensee the same privileges as are bestowed by an actual stamp;</text>
				</paragraph><paragraph id="H833024307E2E47E691FB817F9BD4305F"><enum>(2)</enum><text>be recognized
			 nationally as a valid Federal migratory bird hunting and conservation stamp;
			 and</text>
				</paragraph><paragraph id="H3F18759F0793453CAE6CF615A687B645"><enum>(3)</enum><text>authorize the
			 licensee to hunt migratory waterfowl in any other State, in accordance with the
			 laws of the other State governing that hunting.</text>
				</paragraph></subsection><subsection id="H07E0D2945B6A4787854CAE5AA017FC4F"><enum>(c)</enum><header>Duration</header><text>An
			 electronic stamp issued by a State shall be valid for a period agreed to by the
			 State and the Secretary, which shall not exceed 45 days.</text>
			</subsection></section><section id="HE87A30F0EF93428BB6AD6DC57CF529E7"><enum>7.</enum><header>Termination of
			 State participation</header><text display-inline="no-display-inline">The
			 authority of a State to issue electronic stamps under this Act may be
			 terminated—</text>
			<paragraph id="H381AA29B322B48EC9827BF1497649A14"><enum>(1)</enum><text>by the Secretary,
			 if the Secretary—</text>
				<subparagraph id="HBC0C6BE3432648DAA535B24ECFFA0ABB"><enum>(A)</enum><text>finds that the
			 State has violated any of the terms of the application of the State approved by
			 the Secretary under section 4; and</text>
				</subparagraph><subparagraph id="HA2D20D3AC58A49DE995342B2CBA87AB8"><enum>(B)</enum><text>provides to the
			 State written notice of the termination by not later than the date that is 30
			 days before the date of termination; or</text>
				</subparagraph></paragraph><paragraph id="HA53C447130EF46BBAFB5F6ADBBE35908"><enum>(2)</enum><text>by the State, by
			 providing written notice to the Secretary by not later than the date that is 30
			 days before the termination date.</text>
			</paragraph></section></legis-body>
