		<section id="H8EC5ADB22B0A4043854314E2797AA163" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Freeze and Investigate Affordable Care
			 Act of 2011</short-title></quote>.</text>
		</section><section id="H3EF781CA30DC4F5193F72C6370230520"><enum>2.</enum><header>Freeze on
			 implementation of health reform law</header>
			<subsection id="H85DDDA288BA04DCB89B68DFB52F13CE2"><enum>(a)</enum><header>In
			 general</header><text>Notwithstanding any other provision of law, the
			 provisions of the health reform law that are not in effect on the date of the
			 enactment of this Act shall not take effect.</text>
			</subsection><subsection id="H88FC5E69061342E2BD43B5D36920A993"><enum>(b)</enum><header>Regulations
			 under health reform law</header><text>Notwithstanding any other provision of
			 law, the Federal Government shall not promulgate or enforce regulations under
			 the provisions of the health reform law that are not in effect on the date of
			 enactment of this Act, or otherwise prepare to implement such
			 provisions.</text>
			</subsection></section><section id="H0F5C4B86995047D1B5B9BC645297236B"><enum>3.</enum><header>Establishment of
			 Commission</header><text display-inline="no-display-inline">There is
			 established in the legislative branch a commission to be known as the
			 Affordable Care Evaluation Commission (in this Act referred to as the
			 <term>Commission</term>).</text>
		</section><section id="H84D7F0D1AE79467BB4A11F2B8F97581D"><enum>4.</enum><header>Duties of the
			 Commission; investigative report</header><text display-inline="no-display-inline">The duties of the Commission shall
			 be—</text>
			<paragraph commented="no" id="H3676719570D84069AFD32D3F0E6402B9"><enum>(1)</enum><text>to prepare and,
			 not later than 270 days after the date of the enactment of this Act, to submit
			 to the President and Congress a report that contains—</text>
				<subparagraph commented="no" id="H6F0AC1AED69141E5A8E254579D357E78"><enum>(A)</enum><text display-inline="yes-display-inline">a projection of the impact that the
			 implementation of the provisions of the health reform law that are not in
			 effect on the date of the enactment of this Act would have on—</text>
					<clause commented="no" id="HC5610A0EF7AD4AD1976861ECDC466F25"><enum>(i)</enum><text>the quality of
			 health care delivered to individuals who are Medicare recipients on the date of
			 the enactment of this Act;</text>
					</clause><clause commented="no" id="HB19FA4A14BF048939E492A154BB8E16F"><enum>(ii)</enum><text>health insurance
			 coverage of individuals who are insured on such date;</text>
					</clause><clause commented="no" id="HC28C046742874205915DE384945AF311"><enum>(iii)</enum><text>participation in
			 State exchanges and the effect on the Federal deficit; and</text>
					</clause><clause commented="no" id="HA2D734019699444591D64D11497AE11C"><enum>(iv)</enum><text>job creation and
			 the size of the tax base;</text>
					</clause></subparagraph><subparagraph commented="no" id="H9FA2E931A14E491CB3F2251F4B22CAF3"><enum>(B)</enum><text>an evaluation of
			 the findings, conclusions, and recommendations developed by all other relevant
			 governmental agencies regarding the facts and circumstances surrounding such
			 implementation; and</text>
				</subparagraph><subparagraph commented="no" id="H44B6733009B14A70AEC78AE3D3171CE6"><enum>(C)</enum><text>a recommendation
			 of corrective measures to mitigate any negative impact of such implementation;
			 and</text>
				</subparagraph></paragraph><paragraph id="H23B428C5DB2D4E3A8CE3F405CB2BEB47"><enum>(2)</enum><text>to make available
			 to the public the report submitted under paragraph (1).</text>
			</paragraph></section><section id="H05C5D62DFC8B45F08D88E7DA6EBF9691"><enum>5.</enum><header>Members of
			 Commission</header>
			<subsection id="H0E17D6DA53D24BA4925D8BB6EE3BE9DE"><enum>(a)</enum><header>Composition</header><text>The
			 Commission shall be composed of 10 members, of whom—</text>
				<paragraph id="H782B99146FB548D1966F9A498D118363"><enum>(1)</enum><text>1
			 member shall be appointed by the President, who shall serve as chair of the
			 Commission;</text>
				</paragraph><paragraph id="H19AB48136C6A446EB774691B32A2EB06"><enum>(2)</enum><text>1
			 member shall be appointed by the Speaker of the House, who shall serve as vice
			 chair of the Commission;</text>
				</paragraph><paragraph id="HE401E867C13146058F61F9598115F4D0"><enum>(3)</enum><text>2
			 members shall be appointed by the majority leader of the Senate;</text>
				</paragraph><paragraph id="HAB32F7D448BF41E8B45223AB389A2F2B"><enum>(4)</enum><text>2
			 members shall be appointed by the minority leader of the Senate;</text>
				</paragraph><paragraph id="HB21F97617822463895C97C669CFAF1D3"><enum>(5)</enum><text>2
			 members shall be appointed by the majority leader of the House of
			 Representatives; and</text>
				</paragraph><paragraph id="HE9EB765347C8464687F0C8C86406AC4D"><enum>(6)</enum><text>2
			 members shall be appointed by the minority leader of the House of
			 Representatives.</text>
				</paragraph></subsection><subsection commented="no" id="H07E0BDD232944132BC304A92898FACA5"><enum>(b)</enum><header>Deadline for
			 appointment</header><text>All members of the Commission shall be appointed
			 before the end of the 30-day period beginning on the date of the enactment of
			 this Act.</text>
			</subsection><subsection id="H5401CFEE41A6413EBCFB7918946B2CC6"><enum>(c)</enum><header>Qualifications</header>
				<paragraph id="H8854C7F186D3438081B8D35E661654DB"><enum>(1)</enum><header>Political party
			 affiliation</header><text>Not more than 5 members of the Commission shall be
			 from the same political party.</text>
				</paragraph><paragraph id="HA2AD9AC4CD504BB5A9D5EB9989CB6FF6"><enum>(2)</enum><header>Nongovernmental
			 appointees</header><text>An individual appointed to the Commission may not be
			 an officer or employee of the Federal Government or any State or local
			 government.</text>
				</paragraph><paragraph commented="no" id="H3ABB86ECB28A455D944DF531333D7326"><enum>(3)</enum><header>Other
			 qualifications</header><text>Individuals appointed to the Commission shall be
			 prominent citizens, with national recognition and significant depth of
			 experience in such professions as government service, financial services,
			 economics, law, public administration, commerce, and the United States
			 healthcare system.</text>
				</paragraph></subsection></section><section id="H64A9DFCEC1C148F69133188311746CCE"><enum>6.</enum><header>Operation of
			 Commission</header>
			<subsection id="H944745322A4A4AC7878A6D77399C8F1B"><enum>(a)</enum><header>Initial
			 meeting</header><text>The Commission shall meet and begin the operations of the
			 Commission as soon as practicable.</text>
			</subsection><subsection id="H22E8B7489C194A74AD88EA62B1D8FC1E"><enum>(b)</enum><header>Public
			 meetings</header><text>Meetings of the Commission shall be held in public to
			 the extent practicable.</text>
			</subsection><subsection id="H6324A3865A364B17AE5054CC6E24B6B3"><enum>(c)</enum><header>Quorum;
			 vacancies</header><text>After its initial meeting, the Commission shall meet
			 upon the call of the chair, the vice chair, or a majority of its members. Six
			 members of the Commission shall constitute a quorum. Any vacancy in the
			 Commission shall not affect its powers, but shall be filled in the same manner
			 in which the original appointment was made.</text>
			</subsection></section><section id="H6339E951C8484410B468BE5AA632C0F4"><enum>7.</enum><header>Compensation of
			 members</header>
			<subsection id="HDF93BD0B88004AA9A0867C8A036BBB75"><enum>(a)</enum><header>Compensation</header><text>Each
			 member of the Commission shall be paid at a rate not to exceed the daily
			 equivalent of the annual rate of basic pay for level IV of the Executive
			 Schedule under section 5315 of title 5, United States Code, for each day during
			 which that member is engaged in the actual performance of duties vested in the
			 Commission.</text>
			</subsection><subsection commented="no" id="H7B1D5C5C57534F20A7A013C3119BE772"><enum>(b)</enum><header>Travel
			 expenses</header><text>Each member shall receive travel expenses, including per
			 diem in lieu of subsistence, in accordance with applicable provisions under
			 subchapter I of chapter 57 of title 5, United States Code.</text>
			</subsection><subsection id="H654725FA29F14B038044DEE4CFECFBEE"><enum>(c)</enum><header>Members not
			 treated as Federal employees</header><text>The Members of the Commission shall
			 not be considered employees under section 2105 of title 5, United States
			 Code.</text>
			</subsection></section><section id="HE128540D7ED548D6863AFA1C2420B845"><enum>8.</enum><header>Director and
			 staff of Commission</header>
			<subsection display-inline="no-display-inline" id="HE3DDC5FB145E481FA1CC63FC2416859A"><enum>(a)</enum><header>Appointment and
			 compensation</header><text>The chair of the Commission, in consultation with
			 the vice chair of the Commission, in accordance with rules agreed upon by the
			 Commission, may appoint and fix the pay of a director and such other personnel
			 as may be necessary to enable the Commission to carry out its functions,
			 without regard to the provisions of title 5, United States Code, governing
			 appointments in the competitive service, and without regard to the provisions
			 of chapter 51 and subchapter III of chapter 53 of such title relating to
			 classification and General Schedule pay rates, except that no rate of pay fixed
			 under this subsection may exceed the annual rate of basic pay for level V of
			 the Executive Schedule under section 5316 of title 5, United States
			 Code.</text>
			</subsection><subsection id="HF5AD8387511E4C599FE00B0298F75BBD"><enum>(b)</enum><header>Detailees</header><text>Upon
			 request of the Commission, the head of a Federal department or agency may
			 detail, without reimbursement from the Commission, any of the personnel of that
			 department or agency to the Commission to assist it in carrying out its duties
			 under this Act.</text>
			</subsection><subsection id="H0A83863AADAA4AB7AC8D0C528150E82C"><enum>(c)</enum><header>Consultant
			 services</header><text>The Commission may procure the services of experts and
			 consultants in accordance with section 3109(b) of title 5, United States Code,
			 but at rates for individuals not to exceed the daily equivalent of the annual
			 rate of basic pay for level IV of the Executive Schedule under section 5315 of
			 title 5, United States Code.</text>
			</subsection></section><section id="H775D42CE15754274A463961689728211"><enum>9.</enum><header>Powers of
			 commission</header>
			<subsection display-inline="no-display-inline" id="H93D2DC092D0B461BB7A9769ACDF91C60"><enum>(a)</enum><header>Hearings and
			 evidence</header><text>The Commission may, for the purpose of carrying out this
			 Act, hold hearings, sit and act at times and places, take testimony, and
			 receive evidence as the Commission considers appropriate. The Commission may
			 administer oaths or affirmations to witnesses appearing before it.</text>
			</subsection><subsection id="H8CE02069EDEF4D368F5C23147F9A8B39"><enum>(b)</enum><header>Information from
			 Federal agencies</header><text display-inline="yes-display-inline">The
			 Commission may secure directly from any Federal department or agency
			 information necessary to enable it to carry out this Act. Upon the request of
			 the chair or a majority of the Commission, the head of that department or
			 agency shall furnish such information to the Commission.</text>
			</subsection><subsection id="H4E957CEB693B4813996888B4A54B087D"><enum>(c)</enum><header>Subpoenas</header>
				<paragraph id="H5AD3B4A758944BE8A0F47F82095A9DBA"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Commission may
			 issue subpoenas requiring the attendance and testimony of witnesses and the
			 production of any evidence relating to any matter under investigation by the
			 Commission only—</text>
					<subparagraph id="H54AC580FB5654D2BB49BF56A600C54B2"><enum>(A)</enum><text>by the agreement
			 of the chair and the vice chair; or</text>
					</subparagraph><subparagraph id="H6F20188B5467487A91225C002470BA5A"><enum>(B)</enum><text>by the affirmative
			 vote of 6 members of the Commission.</text>
					</subparagraph></paragraph><paragraph commented="no" id="H118DFBB2F34F42E290BF8CE9DF8FE480"><enum>(2)</enum><header>Service of
			 subpoenas</header><text>Subpoenas of the Commission may be served by any person
			 designated by the chair or by a majority of the Commission.</text>
				</paragraph><paragraph id="H362C840DF5784723AC4A1ABD82B5E20F"><enum>(3)</enum><header>Enforcement</header>
					<subparagraph id="H32E40BD9F10449918927BF6CBB328539"><enum>(A)</enum><header>In
			 general</header><text>If a person refuses to obey a subpoena issued under
			 paragraph (1), the Commission may apply to a United States district court for
			 an order requiring such person to appear before the Commission to give
			 testimony, produce evidence, or both, relating to the matter under
			 investigation. Any failure to obey the order of the court may be punished by
			 the court as civil contempt.</text>
					</subparagraph><subparagraph id="H780C2B7E38164E738CFA55FC2E9D3C90"><enum>(B)</enum><header>Additional
			 enforcement</header><text display-inline="yes-display-inline">If a person
			 refuses to obey a subpoena issued under paragraph (1), the Commission may, by
			 majority vote, certify a statement of fact constituting such failure to the
			 appropriate United States attorney, who may bring the matter before the grand
			 jury for its action, under the same statutory authority and procedures as if
			 the United States attorney had received a certification under sections 102
			 through 104 of the Revised Statutes of the United States (2 U.S.C. 192 through
			 194).</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="H932A9CEC33634DA0B8EBCD56F3A83859"><enum>(d)</enum><header>Contracting</header><text display-inline="yes-display-inline">To the extent or in the amounts provided in
			 advance in appropriation Acts, the Commission may enter into contracts to
			 enable the Commission to carry out its duties under this Act.</text>
			</subsection><subsection id="H4CF0756002A74DBE974C5F3B1EF1A880"><enum>(e)</enum><header>Administrative
			 support services</header><text display-inline="yes-display-inline">Upon the
			 request of the Commission, the Administrator of General Services shall provide
			 to the Commission, on a reimbursable basis, the administrative support services
			 necessary for the Commission to carry out its duties under this Act.</text>
			</subsection><subsection commented="no" id="H58BB2B4029C644F59BF3DDFFE8B2AFA7"><enum>(f)</enum><header>Gifts</header><text>To
			 the extent or in the amounts provided in advance in appropriations Acts, the
			 Commission may accept, use, and dispose of gifts or donations of services or
			 property.</text>
			</subsection><subsection commented="no" id="HC73405F28BD64EF78C5875D91180022A"><enum>(g)</enum><header>Postal
			 services</header><text>The Commission may use the United States mails in the
			 same manner and under the same conditions as other departments and agencies of
			 the United States.</text>
			</subsection></section><section id="H52F3C17601564499A8261B3C7A407EE2"><enum>10.</enum><header>Nonapplicability
			 of Federal Advisory Committee Act</header><text display-inline="no-display-inline">The Federal Advisory Committee Act (5 U.S.C.
			 App.) shall not apply with respect to the Commission.</text>
		</section><section id="H8CCA1155F90640BBBC61D93E6B9A3F53"><enum>11.</enum><header>Termination</header><text display-inline="no-display-inline">The Commission shall terminate not later
			 than 30 days after the report is submitted under section 4.</text>
		</section><section id="H08156E4E063A496689C8B2968E1D8D47"><enum>12.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HA2B6903CD7D94F00A0D8569D91A4110E"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>health reform law</term>
			 means the Patient Protection and Affordable Care Act (Public Law 111–148) and
			 the health care-related provisions of the Health Care and Education
			 Reconciliation Act of 2010 (Public Law 111–152), including the amendments made
			 by such provisions.</text>
			</paragraph><paragraph id="H5246396E25AB4B03AE5D2A4F6C6F4C7B"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>health care-related
			 provisions</term> means, with respect to the Health Care and Education
			 Reconciliation Act of 2010, title I and subtitle B of title II of such
			 Act.</text>
			</paragraph></section><section commented="no" id="H9D273457631740F5BFD86848B1D91446"><enum>13.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as may be necessary to carry out the
			 activities of the Commission under this Act, to remain available until the
			 termination of the Commission.</text>
