		  transfer the funding dedicated to such program to carry out the most critical
		  emergency transportation projects identified by the Secretary of
		  Transportation, after consultation with State and local transportation

		<section id="HA2866BBB82614960BE8EC231B268B833" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Emergency Transportation Safety Fund
			 Act</short-title></quote>.</text>
		</section><title id="H5F8284EF945341B9B77E36895F9CEB55"><enum>I</enum><header>Emergency
			 Transportation Safety Fund</header>
			<section id="H2F6239DD69AF49CCBA1FDFA523ADCF79"><enum>101.</enum><header>Elimination of
			 Transportation Enhancement Program</header>
				<subsection id="H2E271A282477424E99E0BD066052C9E3"><enum>(a)</enum><header>Definition</header><text>Section
			 101(a)(35) of title 23, United States Code, is repealed.</text>
				</subsection><subsection id="H912AF30293774F34839F2FC34038CA01"><enum>(b)</enum><header>Transportation
			 enhancement set aside</header><text display-inline="yes-display-inline">Section
			 133 of title 23, United States Code, is amended—</text>
					<paragraph id="HE29ABE2F9EAF4AF3956795643A4E6572"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b), by striking paragraph
			 (8);</text>
					</paragraph><paragraph id="H6CCD746962E6406A9EBD1B54D0B1555B"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d), by striking paragraphs
			 (2) and (5); and</text>
					</paragraph><paragraph id="H5D2C2AAAEE1241BBAF6F5C17206750DF"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (e)—</text>
						<subparagraph id="HD008C6D24F0E43BE89C9B9A1B416EEF0"><enum>(A)</enum><text display-inline="yes-display-inline">by amending paragraph (3) to read as
			 follows:</text>
							<quoted-block display-inline="no-display-inline" id="H28EC584AB3264AF9A2F7DFDC4F375CAC" style="OLC">
								<paragraph id="H8889F089AE204DD6BA79F88DF79E25D4"><enum>(3)</enum><header>Payments</header><text>The
				Secretary shall make payments to a State of costs incurred by the State for the
				surface transportation program in accordance with procedures to be established
				by the Secretary.</text>
								</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph><subparagraph id="H70EB086B8A9C444290C992B270981008"><enum>(B)</enum><text>by striking
			 paragraph (5).</text>
						</subparagraph></paragraph></subsection><subsection id="H63F349B52D9A43B390C3F3AA1A505479"><enum>(c)</enum><header>State assumption
			 of responsibilities</header><text>Section 325(a)(2) of title 23, United States
			 Code, is amended by striking <quote>the following projects:</quote> and all
			 that follows and inserting <quote>projects funded under section
			 104(h).</quote>.</text>
				</subsection><subsection id="H987BCAFE70C34743B1AD1DEBC34F3695"><enum>(d)</enum><header>Statewide
			 transportation planning priorities</header><text>Section 5304(g)(4)(H) of title
			 49, United States Code, is amended by striking <quote>, including
			 transportation enhancement activities,</quote>.</text>
				</subsection><subsection id="H6C21AB4CAD544EBE9DDB01C709CBEAB7"><enum>(e)</enum><header>STP set-Aside
			 program rescissions</header><text>Section 10212(f) of SAFETEA–LU (Public Law
			 109–59) is amended by striking <quote>, transportation enhancement
			 activities,</quote>.</text>
				</subsection></section><section id="H5F7845D77E1446828B1EA54DA72998A4"><enum>102.</enum><header>Establishment
			 of Emergency Transportation Safety Fund</header>
				<subsection id="HDF169310D10D40F7B6B5E66A46767BA5"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">There is established
			 in the Treasury of the United States a trust fund to be known as the
			 <term>Emergency Transportation Safety Fund</term>.</text>
				</subsection><subsection id="H0C3C764CB49F402FB53003AC09182509"><enum>(b)</enum><header>Emergency relief
			 expenditures</header><text>Section 125(c) of title 23, United States Code, is
			 amended—</text>
					<paragraph id="H3B070CBEFA824B5793BAC1E7F81F0168"><enum>(1)</enum><text>by redesignating
			 paragraphs (1) and (2) as paragraphs (2) and (3), respectively; and</text>
					</paragraph><paragraph id="HAD4CDF299536431583A77AF80613B21D"><enum>(2)</enum><text>by inserting
			 before paragraph (2), as redesignated, the following:</text>
						<quoted-block display-inline="no-display-inline" id="H6B5D79FE6ED34F96B347BE09AD50F29F" style="OLC">
							<paragraph id="HF7E80BE5E51E443F90881D6DB564469F"><enum>(1)</enum><text>Amounts deposited
				into the Emergency Transportation Safety Fund are authorized to be obligated to
				carry out, in priority order, the projects on the current list compiled by the
				Secretary under section 201(b)(1) of the <short-title>Emergency Transportation Safety Fund Act</short-title>
				that meet the eligibility requirements set forth in subsection
				(a).</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H7D88A78E664F4593B77BB27544ED788A"><enum>(c)</enum><header>Funding</header><text>Section
			 133(d) of title 23, United States Code, is amended by inserting before
			 paragraph (3) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H2173E294D3B64926AC5124D8B5355E31" style="OLC">
						<paragraph id="H6C90732ACC6945BDA4B054A84B5368A5"><enum>(1)</enum><header>Emergency
				transportation safety fund</header><text>In each fiscal year, there shall be
				deposited into the Emergency Transportation Safety Fund, established under
				section 102(a) of the <short-title>Emergency
				Transportation Safety Fund Act</short-title>, an amount equal to 10 percent of
				the funds apportioned to a State under section 104(b)(3) for such fiscal year.
				At the end of each fiscal year, any unobligated amounts in the Fund in excess
				of $500,000,000 shall be made available for the Highway Bridge Program, in
				accordance with section
				144.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section></title><title id="H7A5534727B6A49CBB6B7176D09A455CA"><enum>II</enum><header>Emergency
			 Transportation Safety Priority List</header>
			<section id="HF503AC4BE10749A7823E5043AE13F503"><enum>201.</enum><header>Emergency
			 transportation priorities</header>
				<subsection id="H9A7C8CA98C604D56B8BAC7411B40B224"><enum>(a)</enum><header>List</header><text>The
			 Secretary of Transportation, in consultation with a representative sample of
			 State and local government transportation officials, shall compile a
			 prioritized list of emergency transportation projects, which will guide the
			 allocation of funding to the States from the Emergency Transportation Safety
			 Fund.</text>
				</subsection><subsection id="H2AC58D588D124121B0357CB896AB7A34"><enum>(b)</enum><header>Criteria</header><text>In
			 compiling the list under subsection (a), the Secretary of Transportation, in
			 addition to other criteria established by the Secretary, shall rank priorities
			 in descending order, beginning with—</text>
					<paragraph id="H38295CD30B2445A39F11372B4DE90F95"><enum>(1)</enum><text>whether the
			 project is part of the interstate highway system;</text>
					</paragraph><paragraph id="H45BB88790E4F4F92A2530ACDCF7D1143"><enum>(2)</enum><text>whether the
			 project is a road or bridge that is closed for safety reasons;</text>
					</paragraph><paragraph id="H89CFB89AE99F4EBC95AE40F64E82CE9E"><enum>(3)</enum><text>the impact of the
			 project on interstate commerce;</text>
					</paragraph><paragraph id="H1F39E944FC694F55839BAD77C9800691"><enum>(4)</enum><text>the volume of
			 traffic affected by the project; and</text>
					</paragraph><paragraph id="HD746512569AA4952A92E2A514804E51A"><enum>(5)</enum><text>the overall value
			 of the project or entity.</text>
					</paragraph></subsection><subsection id="HF78141A949B54CF98162489B0165EF87"><enum>(c)</enum><header>Report</header><text>Not
			 later than 120 days after the date of the enactment of this Act, the Secretary
			 of Transportation shall submit a report to Congress that includes—</text>
					<paragraph id="H0990A4052FF441C18463573D3034A1B5"><enum>(1)</enum><text>a
			 prioritized list of emergency transportation projects to be funded through the
			 Emergency Transportation Safety Fund; and</text>
					</paragraph><paragraph id="H04C77CA5A3D0481AB2F2AA2EEBBCA505"><enum>(2)</enum><text>a
			 description of the criteria used to establish the list referred to in paragraph
			 (1).</text>
					</paragraph></subsection><subsection id="HCD07DE185B314AD7AA33D89654D63244"><enum>(d)</enum><header>Quarterly
			 updates</header><text>Not less frequently than 4 times per year, the Secretary
			 of Transportation shall—</text>
					<paragraph id="H5C95E20EFF0E476394DF48E16503BCDE"><enum>(1)</enum><text>update the report
			 submitted pursuant to subsection (c);</text>
					</paragraph><paragraph id="H585AE0B17D33484D8AD78FFA00D74DAF"><enum>(2)</enum><text>send a copy of the
			 report to Congress; and</text>
					</paragraph><paragraph id="H0C358EE5907644E08364BD601CDF3D4D"><enum>(3)</enum><text>make a copy of the
			 report available to the public through the Department of Transportation's Web
			 site.</text>
					</paragraph></subsection></section></title></legis-body>
