		<section commented="no" display-inline="no-display-inline" id="H70D12341D8E3431C986DAD11E8E1F008" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal Hiring Process Improvement Act
			 of 2011</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="HCCCB6D24E9BA471EA88471D4FAE35F1C" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="no-display-inline">In this Act, the term
			 <term>agency</term>—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H1AF0993BDF9844FE823921CF6C7EA94E"><enum>(1)</enum><text display-inline="yes-display-inline">means an Executive agency as defined under
			 section 105 of title 5, United States Code; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD4B812A10ED041DD909D8088FF9891B1"><enum>(2)</enum><text display-inline="yes-display-inline">shall not include the Government
			 Accountability Office.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="HFF9798BEC099444FBA6BAFA61219C565" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Strategic Workforce Plan</header>
			<subsection commented="no" display-inline="no-display-inline" id="H104E913DC23B48CCBCDB6D9A4EB4D17E"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H2D13A08D91B04E5381074F13EE1BBCC5"><enum>(1)</enum><header display-inline="yes-display-inline">Development of plan</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 enactment of this Act and in every subsequent year, the head of each agency, in
			 consultation with the Office of Personnel Management and the Office of
			 Management and Budget, shall develop a strategic workforce plan as part of the
			 agency performance plan required under section 1115 of title 31, United States
			 Code, to include—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H4F7DD5D1C5A54B569C936B8D788EA9A7"><enum>(A)</enum><text display-inline="yes-display-inline">hiring projections, including occupation
			 and grade level;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H253C39A579F94269A0D54CF7F37F9595"><enum>(B)</enum><text display-inline="yes-display-inline">long-term and short-term strategic human
			 capital planning to address critical skills deficiencies;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD89104FF7E7948528DEA20683BF0EC96"><enum>(C)</enum><text display-inline="yes-display-inline">recruitment strategies to attract highly
			 qualified candidates from diverse backgrounds;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H887B51F4C94B43AA8FA70066F97513A4"><enum>(D)</enum><text display-inline="yes-display-inline">streamlining the hiring process to conform
			 with the provisions in this Act; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H05716864ED81468CAE395A74BEF30380"><enum>(E)</enum><text display-inline="yes-display-inline">a specific analysis of the contractor
			 workforce, whether the balance between work being performed by the Federal
			 workforce and the contractor workforce should be adjusted, and the capacity of
			 the agency to manage employees who are not Federal employees and are doing the
			 work of the Government.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD0F5F73ABD2E468BA3F7D2A384F657F3"><enum>(2)</enum><header display-inline="yes-display-inline">Inclusion in performance plan</header><text display-inline="yes-display-inline">Section 1115(a) of title 31, United States
			 Code, is amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HEABF21B15C6D4A4497647059CAA98837"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (5), by striking
			 <quote>and</quote> after the semicolon;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H817ACFBB52C749499C505D58CCBCC4B6"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (6), by striking the period
			 and inserting <quote>; and</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9EECC4E13B0749CAACF5E8FD88773D04"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H0838EBCC3D924319B8A1A7F51D68040A" style="OLC">
							<paragraph commented="no" display-inline="no-display-inline" id="H5B3EDCE06EE441FF9E2E8C6D6E5FCB2C"><enum>(7)</enum><text display-inline="yes-display-inline">include the strategic workforce plan
				developed under section 3 of the Federal Hiring Process Improvement Act of
				2011.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H0723CF1081DE44C9A766D561346C4438"><enum>(b)</enum><header display-inline="yes-display-inline">Hiring projections</header><text display-inline="yes-display-inline">Agencies shall make hiring projections made
			 under strategic workforce plans available to the public, including on agency
			 Web sites.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H19BE0530C189451AB33702D150B3E67A"><enum>(c)</enum><header display-inline="yes-display-inline">Submission to the Office of Personnel
			 Management</header><text display-inline="yes-display-inline">Each agency
			 strategic workforce plan shall be submitted to the Office of Personnel
			 Management.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HE682A65B18194B63AC5B9E1905809FC5"><enum>(d)</enum><header display-inline="yes-display-inline">Governmentwide strategic workforce
			 plan</header><text display-inline="yes-display-inline">Based on the agency
			 plans submitted under subsection (a), the Office of Personnel Management
			 shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H936174BEEB2B47C187E6C064FFE6CA98"><enum>(1)</enum><text display-inline="yes-display-inline">develop a governmentwide strategic
			 workforce plan updated at least annually to include the contents described
			 under subsection (a)(1) on a governmentwide basis; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8CF72AE8403F4F6A8F6281598A9B509D"><enum>(2)</enum><text display-inline="yes-display-inline">make such plan available to the President,
			 Congress, and the public.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HE3909B7F857B4BD0AB63D32D01362075" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Federal announcements of vacant
			 positions</header>
			<subsection commented="no" display-inline="no-display-inline" id="H7AA1E1D4F91243B294F5D51ED6A56DE5"><enum>(a)</enum><header display-inline="yes-display-inline">Targeted Announcements</header><text display-inline="yes-display-inline">In consultation with the Chief Human
			 Capital Officers Council, the head of each agency shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HF8AE5E962EEC451CBCDDE5E041841E34"><enum>(1)</enum><text display-inline="yes-display-inline">take steps necessary to identify highly
			 qualified applicant pools with diverse backgrounds before posting announcements
			 of vacant positions;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9DF336529A954894B0D191281D9E8251"><enum>(2)</enum><text display-inline="yes-display-inline">seek to develop relationships with targeted
			 and diverse applicant pools to encourage applications for high-quality
			 applicants; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBB63DC575A8D4923865FB1635AB63D47"><enum>(3)</enum><text display-inline="yes-display-inline">post announcements of vacant positions for
			 a reasonable period of time.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H2A9DF0304C3D4A8189DCABBC1AA6BCDD"><enum>(b)</enum><header display-inline="yes-display-inline">Public notice requirements</header><text display-inline="yes-display-inline">The requirements of subsection (a) shall
			 not supersede public notice requirements.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HF7E3423AF9CA489BB682E34BA11F657D"><enum>(c)</enum><header display-inline="yes-display-inline">Plain writing requirement</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H74F1B9676C6448CEAB494EED935E4EF6"><enum>(1)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this subsection, the term <term>plain
			 writing</term> has the meaning given under section 3 of the Plain Writing Act
			 of 2010 (5 U.S.C. 301 note).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3475F95EB2B74825992B4C17CA8FC8D2"><enum>(2)</enum><header display-inline="yes-display-inline">Requirement</header><text display-inline="yes-display-inline">All Federal announcements of vacant
			 positions for competitive positions shall be written in plain writing in
			 accordance with the Plain Writing Act of 2010 (5 U.S.C. 301 note).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H192EAC07DDB5489BBDB1BFAE415A3AD6"><enum>(d)</enum><header display-inline="yes-display-inline">Contact Information</header><text display-inline="yes-display-inline">Announcements of vacant positions shall
			 include contact information for applicants to seek further information.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H62ACD5088D24410091557513962A558C" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Application process and notification
			 requirements</header>
			<subsection commented="no" display-inline="no-display-inline" id="HE6E76462A6A048A8BE7F835046D24A3A"><enum>(a)</enum><header display-inline="yes-display-inline">Application process</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 enactment of this Act and in consultation with the Office of Personnel
			 Management and the Office of Management and Budget, the head of each agency
			 shall ensure that processes are implemented to—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H86667D613603444BBA01EFA2F7459454"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that positions that are on the
			 announcements of vacant positions are open for a reasonable period of time as
			 determined by the head of the agency to allow applicants from diverse
			 backgrounds time to submit an application;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H589ACCAA9F8B4073958CA31335799456"><enum>(2)</enum><text display-inline="yes-display-inline">allow applicants to submit a cover letter,
			 resume, and answers to brief questions, such as questions relating to United
			 States citizenship and veterans status, to complete an initial
			 application;</text>
				</paragraph><paragraph id="H2503B8271E8E4611A8A7238F7F3C4042"><enum>(3)</enum><text>not require
			 lengthy writing requirements such as knowledge, skills, and ability essays as
			 part of an initial application;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H60866D26E4DF4B6ABB728A30C7EF97B0"><enum>(4)</enum><text display-inline="yes-display-inline">allow applicants to submit application
			 materials in a variety of formats, including word processing documents and
			 portable document format;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4C63767634BF4AC7ACC2A6ACE61773CF"><enum>(5)</enum><text display-inline="yes-display-inline">not require any applicant to provide a
			 Social Security number or any other personal identifying information
			 unnecessary for the initial review of an applicant for a position;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDDE1BF31A10C4C14B4AFC321916939C6"><enum>(6)</enum><text display-inline="yes-display-inline">not require the submission of additional
			 material in support of an application, such as educational transcript, proof of
			 veterans status, and professional certifications, unless necessary to complete
			 the hiring process;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H14CB39FB9390434A94BE4C1257A6E1D4"><enum>(7)</enum><text display-inline="yes-display-inline">provide for a valid, position-related
			 assessment process to help identify the best candidates for the position to be
			 filled and which does not place an unreasonable burden upon applicants;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD009FBD0977B40AC83D291C5AC17A088"><enum>(8)</enum><text display-inline="yes-display-inline">ensure that applicants are given a
			 reasonable amount of time after the closing date of the announcement of a
			 vacant position to provide additional necessary information; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1ABCD4C626244B7CA1488E8333CD7156"><enum>(9)</enum><text display-inline="yes-display-inline">include the hiring manager in all parts of
			 the hiring process, including—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H6E39A1F45A2E4C25977C6BD1052E8A4D"><enum>(A)</enum><text display-inline="yes-display-inline">targeted recruitment;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9D72B561017541B19852AF21B2A706DC"><enum>(B)</enum><text display-inline="yes-display-inline">drafting the announcement of the vacant
			 position;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA6283CA56BFB4961A4D28F5FEA2EB79A"><enum>(C)</enum><text display-inline="yes-display-inline">review of the initial applications;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC878CE9C2B1D4E068227BC613087EA5F"><enum>(D)</enum><text display-inline="yes-display-inline">interviewing the applicants; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDF557D73CFCA49CD9EAF3912029261B0"><enum>(E)</enum><text display-inline="yes-display-inline">the final decision making process.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H40B249E8279940309A85A3AC3696C6C5"><enum>(b)</enum><header display-inline="yes-display-inline">Notification requirements</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HBCCC55B90373460E89535D041F62F395"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In consultation with the Chief Human
			 Capital Officers Council, the head of each agency shall ensure there are
			 mechanisms under which each applicant for a vacant position shall receive
			 timely notification of the status of each application or provide the applicant
			 the ability to check on the status of each application.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDA436BB44F024F96BFF368DB560D2B4A"><enum>(2)</enum><header display-inline="yes-display-inline">Notification</header><text display-inline="yes-display-inline">A timely notification to an applicant under
			 this subsection shall be made upon—</text>
					<subparagraph id="H15DD836DA4EE4CD186C9653FCFD6B361"><enum>(A)</enum><text>receipt of an
			 application by the employing agency;</text>
					</subparagraph><subparagraph id="H149F37B3AB5C42C68CD84152690C2F98"><enum>(B)</enum><text>determination of
			 the qualification of the applicant for the position;</text>
					</subparagraph><subparagraph id="H4C7386BDA80F4B10A989D1B9DCD7745C"><enum>(C)</enum><text>referral to the
			 selecting official, or when a decision is made not to refer the applicant;
			 and</text>
					</subparagraph><subparagraph id="H37A674E8316E443AA0BB485DF8CD0949"><enum>(D)</enum><text>selection of an
			 applicant.</text>
					</subparagraph></paragraph><paragraph id="HB4C6B308296D4BFD98736CDCC0944767"><enum>(3)</enum><header>Applicants not
			 selected</header><text>The agency shall notify any applicant who is not offered
			 employment that the applicable position is not open, not later than 10 business
			 days after the date on which—</text>
					<subparagraph id="H527BDCE735234D1B9CC9EC46BF545DBA"><enum>(A)</enum><text>the selected
			 candidate has accepted an offer of employment; or</text>
					</subparagraph><subparagraph id="HAF08E8C6C2194DD6800111CF169F47F4"><enum>(B)</enum><text>the announcement
			 of the vacant position has been cancelled.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H986699FAF2BA4BCCBD4F4F9BDC013267" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Agency hiring procedures</header>
			<subsection id="HF421E263D8FC43E69A92645BCA7F29B8"><enum>(a)</enum><header>Elimination of
			 the rule of three; multiple selections from one certificate</header>
				<paragraph id="HC548BAF993F440EF9151C1A56B0AD941"><enum>(1)</enum><header>In
			 general</header><text>Chapter 33 of title 5, United States Code, is amended by
			 striking section 3317 and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="HF6B00A723E04458A9F9EEA96E361006C" style="USC">
						<section id="H6626419AFFB24FA99A89A2D03195A78F"><enum>3317.</enum><header>Competitive
				service; certification and selection using numerical ratings</header>
							<subsection id="H3122D4744C1D4E2D89961B807A8FF835"><enum>(a)</enum><header>Certifications</header><text>The
				Office of Personnel Management, or an agency to which the Office has delegated
				examining authority under section 1104(a)(2), shall certify a sufficient number
				of names from the top of the appropriate register or list of eligibles for an
				appointing authority who has requested a certificate of eligibles to consider
				when filling a position in the competitive service.</text>
							</subsection><subsection id="H07C0BA4889D34115BAECE30542EBC7BF"><enum>(b)</enum><header>Selections</header>
								<paragraph id="HE42DA00D137C474E91108FF383B12AD0"><enum>(1)</enum><header>In
				general</header><text>An appointing authority shall select for appointment from
				the eligibles available for appointment on the certificate provided under
				subsection (a), unless objection to one or more of the individuals certified is
				made to, and sustained by, the Office of Personnel Management or the relevant
				agency for proper and adequate reason.</text>
								</paragraph><paragraph id="H3B424D597E464E6D995A97F71E16CD6F"><enum>(2)</enum><header>Other appointing
				authorities</header><text>Not later than 240 days after the date of issuance of
				a certificate under subsection (a), other appointing authorities may select
				from that certificate for similar positions in the same occupational series and
				at the same grade level without any additional posting under section
				3327.</text>
								</paragraph></subsection><subsection id="HA830AEAEF687427E877A2A4DEA50054A"><enum>(c)</enum><header>Preference
				eligibles</header>
								<paragraph id="HF9EFDE952AD34A908C2539454106716C"><enum>(1)</enum><header>Pass
				overs</header>
									<subparagraph id="HC3FED54EAE0F4629970BF5C3258DA656"><enum>(A)</enum><header>In
				general</header><text>If an appointing authority proposes to pass over a
				preference eligible on a certificate in order to select an individual who is
				not a preference eligible, that appointing authority shall submit a statement
				of reasons to the Office of Personnel Management for passing over the
				preference eligible.</text>
									</subparagraph><subparagraph id="HA10AA773E33D4FC2B78E83473527E023"><enum>(B)</enum><header>Reasons for pass
				overs</header>
										<clause id="H7FC5292CC8DD4BD1A3B3C7E81FD89F7F"><enum>(i)</enum><header>Record</header><text>The
				Office shall make the reasons submitted by the appointing authority part of the
				record of the preference eligible and may require the submission of more
				detailed information from the appointing authority in support of the passing
				over of the preference eligible.</text>
										</clause><clause id="HE208AD0A66CD470D841E75E5863C9B35"><enum>(ii)</enum><header>Review</header><text>The
				Office shall—</text>
											<subclause id="H10266B961EBF4072BF233A8B0E0778CD"><enum>(I)</enum><text>review the reasons
				submitted by the appointing authority; and</text>
											</subclause><subclause id="HB86A2A684192481EB9E88C194DD6FEC2"><enum>(II)</enum><text>determine the
				sufficiency or insufficiency of the reasons, taking into account any response
				received by the Office from the preference eligible based on the reasons made
				available under or paragraph (3).</text>
											</subclause></clause></subparagraph><subparagraph id="HCB56CE71105146A8B52918512231B7FD"><enum>(C)</enum><header>Findings</header><text>After
				the Office has completed the review under subparagraph (B) of the proposed pass
				over, the Office shall send its findings to the appointing authority and to the
				preference eligible. The appointing authority shall comply with the findings of
				the Office.</text>
									</subparagraph></paragraph><paragraph id="H50234E491AAA44A39AB4CEFC550C2C6F"><enum>(2)</enum><header>Preference
				eligibles</header><text>In the case of a preference eligible not described
				under paragraph (3)(A), upon the request of that preference eligible (or the
				representative of that preference eligible) the Office of Personnel Management
				shall provide a copy of—</text>
									<subparagraph id="HB76FAA678A664E1E8D536561C74BA7E6"><enum>(A)</enum><text>the reasons for
				the proposed pass over submitted by the appointing authority under paragraph
				(1)(A); and</text>
									</subparagraph><subparagraph id="H3726C5D261124757B98E8A0B49D660E8"><enum>(B)</enum><text>the findings of
				the Office under paragraph (1)(C).</text>
									</subparagraph></paragraph><paragraph id="H65BE7A76B7FA469BBE519D9392F1434E"><enum>(3)</enum><header>Preference
				eligibles with certain disabilities</header>
									<subparagraph id="HE3922D4407F44128B9ABD053AF73F381"><enum>(A)</enum><header>Notifications</header><text>In
				the case of a preference eligible described under section 2108(3)(C) who has a
				compensable service-connected disability of 30 percent or more, the appointing
				authority shall provide notification to the preference eligible of—</text>
										<clause id="H1089F8450E2D44098E362C46A9632BE8"><enum>(i)</enum><text>the proposed pass
				over;</text>
										</clause><clause id="H21FF5DB93E9C499AA5791228B583CF70"><enum>(ii)</enum><text>the reasons for
				the proposed pass over; and</text>
										</clause><clause id="H1DF8E41E60AF43DC8DF62C146F18D8CE"><enum>(iii)</enum><text>the right of the
				preference eligible to respond to those reasons to the Office of Personnel
				Management or the relevant agency not later than 15 days after the date of the
				receipt of the notification.</text>
										</clause></subparagraph><subparagraph id="H8C730EEF271C4AAC8E06382F4DCF36E9"><enum>(B)</enum><header>Timing of
				notifications</header><text>The appointing authority shall provide notification
				to the preference eligible under subparagraph (A) at the same time the
				appointing authority provides notification to the Office of Personnel
				Management under paragraph (1).</text>
									</subparagraph><subparagraph id="HCABAF8F335AF4C9DBCC16FF829CD199B"><enum>(C)</enum><header>Demonstration of
				notifications</header><text>Before completing the review under paragraph (1)
				with respect to a preference eligible described under section 2108(3)(C) who
				has a compensable service-connected disability of 30 percent or more, the
				Office shall require a demonstration by the appointing authority that a timely
				notification under subparagraph (A) was sent to the last known address of the
				preference eligible.</text>
									</subparagraph></paragraph><paragraph id="H6F40C90A0C144FC6A6D8205F528E76F8"><enum>(4)</enum><header>Nondelegation of
				functions</header><text>In the case of a preference eligible described under
				paragraph (3), the functions of the Office of Personnel Management under this
				subsection may not be delegated.</text>
								</paragraph></subsection><subsection id="H581C4101BE4B4C95A4CBECDCAEEA6D89"><enum>(d)</enum><header>Reemployment</header><text>If
				the names of preference eligibles are on a reemployment list appropriate for
				the position to be filled, a nominating or appointing authority may appoint
				from a register of eligibles established after examination only an individual
				who qualifies as a preference eligible under section 2108(3)(C) through
				(G).</text>
							</subsection><subsection id="H80CF0DA9A0104AD685B10CEFFB172E61"><enum>(e)</enum><header>Regulations</header><text>The
				Office of Personnel Management shall prescribe regulations to carry out this
				section, including regulations for the establishment of mechanisms, such as
				advanced determination of score, for identifying the eligibles who will be
				considered for

			 enactment of this Act—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H85A33886A1564DF79DD55803A2E8C75E"><enum>(1)</enum><text display-inline="yes-display-inline">in consultation with the Chief Human
			 Capital Officers Council, the Office of Personnel Management shall develop and
			 notify agencies of a training program for human resources professionals to
			 implement the requirements of this Act; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H936C36601EE24B468B1ECBEC5E33F9F5"><enum>(2)</enum><text display-inline="yes-display-inline">each agency shall develop and submit to the
			 Office of Personnel Management a plan to implement the training program.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H963A7835B9F547FAB1D11E480C549233" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Reduction in the length of the hiring
			 process</header>
			<subsection commented="no" display-inline="no-display-inline" id="HE9223F7BC6C44A3C905881795572B273"><enum>(a)</enum><header display-inline="yes-display-inline">Agency plans</header><text display-inline="yes-display-inline">Unless the Office of Personnel Management
			 certifies an agency already has a plan in effect, the head of each agency shall
			 develop a plan to reduce the length of the hiring process, which shall include
			 an analysis of the current hiring process performed in accordance with
			 standards established by the Office of Personnel Management.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H1A7C451F7FFB4E3E87EE510723CCC820"><enum>(b)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">To the extent practical, each agency shall
			 fill identified vacancies not later than an average of 80 calendar days after
			 the date of identification of the vacancy.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H2975818B7B024515BC6670E6EECEE259"><enum>(c)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">Each agency shall submit an annual report
			 to Congress on the average period of time required to fill each position, and
			 whether such positions are cancelled or reopened.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H39DAE35DD4D54E109FF74F1B11670986" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Measures of Federal hiring
			 effectiveness</header>
			<subsection commented="no" display-inline="no-display-inline" id="H9412DB491F734C0094C2214DAA08EAC5"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each agency shall measure and collect
			 information on indicators of hiring effectiveness relating to—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HF2C1A1768E2D43BB9F70241391512055"><enum>(1)</enum><text display-inline="yes-display-inline">recruiting and hiring, including
			 the—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H33FC769CE886464484D7098D6F02EB44"><enum>(A)</enum><text display-inline="yes-display-inline">ability to reach and recruit highly
			 qualified talent from diverse talent pools;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCAF1892CBE334F29AE98C2A74AF1FA5B"><enum>(B)</enum><text display-inline="yes-display-inline">use and impact of each hiring authority and
			 flexibility to recruit most qualified applicants, including the use of student
			 internships and scholarship programs as a talent pool for permanent
			 hires;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFB07D8BF0A7B4A90882608BB998D1AC4"><enum>(C)</enum><text display-inline="yes-display-inline">use and impact of special hiring
			 authorities and flexibilities to recruit diverse candidates, including veteran,
			 minority, and disabled candidates;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5831A876492B4EC08C3D0D03FAB736D2"><enum>(D)</enum><text display-inline="yes-display-inline">age, educational level, and source of
			 applicants;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H40B3F6F17C5348839B44B1390B511F6F"><enum>(E)</enum><text display-inline="yes-display-inline">length of time between the time a position
			 is advertised and the time a first offer of employment is made;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5F1E9D72CC384034829C0CD0BC2F3B7C"><enum>(F)</enum><text display-inline="yes-display-inline">length of time between the time a first
			 offer of employment for a position is made and the time a new hire starts in
			 that position;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H23A7EDCEDBE1475ABA5C012B5FF5EDE2"><enum>(G)</enum><text display-inline="yes-display-inline">number of internal and external applicants
			 for Federal positions;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3D195CB43EB542A488EB05008F00C04F"><enum>(H)</enum><text display-inline="yes-display-inline">number of positions filled compared to the
			 specific number in the annual workforce plan of the agency, with specific
			 reference to mission-critical occupations or areas of critical shortage
			 deficiencies; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9E875B6EFCCB44EEA5D70CDB51A2020F"><enum>(I)</enum><text display-inline="yes-display-inline">number of offers accepted compared to the
			 number of offers made for permanent positions;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0A572806B5974F90AF02739F25BD741F"><enum>(2)</enum><text display-inline="yes-display-inline">hiring manager assessment,
			 including—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HC91C10C5F0B44CA08F25832C0D1FD6EB"><enum>(A)</enum><text display-inline="yes-display-inline">manager satisfaction with the quality of
			 the applicants interviewed and new hires;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF33C7056D830418B94FF80C5E9E1E5D4"><enum>(B)</enum><text display-inline="yes-display-inline">manager satisfaction with the match between
			 the skills of newly hired individuals and the needs of the agency;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H583FED1BB69C4056A9AA7B243D01CF23"><enum>(C)</enum><text display-inline="yes-display-inline">manager satisfaction with the hiring
			 process and hiring outcomes;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA73F0D26F7A4475DA551F7F885FC13C8"><enum>(D)</enum><text display-inline="yes-display-inline">mission-critical deficiencies closed by new
			 hires and the connection between mission-critical deficiencies and annual
			 agency performance; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H10BA7123DC5540E3AC2444C4186160FF"><enum>(E)</enum><text display-inline="yes-display-inline">manager satisfaction with the length of
			 time to fill a position;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE3B29761F06041D681BBD2DD8C0E287B"><enum>(3)</enum><text display-inline="yes-display-inline">applicant satisfaction with the hiring
			 process, including—</text>
					<subparagraph id="H1D2FBFDF838E4C05A5C2B4D01B0F077E"><enum>(A)</enum><text>the clarity of the
			 announcement of the vacant position;</text>
					</subparagraph><subparagraph id="H7D085C0555804F45B563DDCB737FAEC6"><enum>(B)</enum><text>the reasons for
			 withdrawal of any application;</text>
					</subparagraph><subparagraph id="H6C03F00691B84B39AFD8832A7AADD0F0"><enum>(C)</enum><text>the
			 user-friendliness of the application process;</text>
					</subparagraph><subparagraph id="H17C1A23A50D94E2C878C04A4A1A52D8F"><enum>(D)</enum><text>the communication
			 regarding status of application; and</text>
					</subparagraph><subparagraph id="H8A3C6816488F4BBA94C09A8595540557"><enum>(E)</enum><text>the timeliness of
			 hiring decision; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6BA064A46163469BB86BFE1EA5C6A6F3"><enum>(4)</enum><text display-inline="yes-display-inline">new hire assessment, including—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HB5DF50139B37448982698B0A59C66F49"><enum>(A)</enum><text display-inline="yes-display-inline">new hire satisfaction with the hiring
			 process, including—</text>
						<clause id="H824C180F9C8745E6BCB41E6E40F775D5"><enum>(i)</enum><text>the
			 clarity of the announcement of the vacant position;</text>

						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEEB61EDFE8AD4B83A7EC25A64E17D42C"><enum>(B)</enum><text display-inline="yes-display-inline">satisfaction with the onboarding
			 experience, including—</text>
						<clause id="HA83BA95E96EB483EAFA90F03636DEE99"><enum>(i)</enum><text>the
			 timeliness of onboarding after the hiring decision;</text>
						</clause><clause id="H8927D02AE7F14F87BC26F2E505C02E82"><enum>(ii)</enum><text>the
			 welcoming and orientation processes; and</text>
						</clause><clause id="H7A79179BCE664E41AD860C0183115E2A"><enum>(iii)</enum><text>being provided
			 with timely and useful new employee information and assistance;</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H48084093E2074C43BC2E9F698495DEF3"><enum>(C)</enum><text display-inline="yes-display-inline">new hire attrition;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9692ED9270BC446B844C8C9A85653607"><enum>(D)</enum><text display-inline="yes-display-inline">investment in training and development for
			 employees during their first year of employment; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H68597ABD4C2D4C2F93DB4BA13EE03749"><enum>(E)</enum><text display-inline="yes-display-inline">other indicators and measures as required
			 by the Office of Personnel Management.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HBED1CFD979324271A2B6B66B29D57CCD"><enum>(b)</enum><header display-inline="yes-display-inline">Reports</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H840F5823E15A45E2BAB16B50865418C0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each agency shall submit on an annual basis
			 and in accordance with regulations prescribed under subsection (c) the
			 information collected under subsection (a) to the Office of Personnel
			 Management.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H29BDFE573E044AB289C9E47C37DD6935"><enum>(2)</enum><header display-inline="yes-display-inline">Availability of recruiting and hiring
			 information</header><text display-inline="yes-display-inline">Each year the
			 Office of Personnel Management shall provide the information submitted under
			 paragraph (1) in a consistent format to allow for a comparison of hiring
			 effectiveness and experience across demographic groups and agencies to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H258926D181F8429F8B22C60E9B694A30"><enum>(A)</enum><text display-inline="yes-display-inline">Congress before that information is made
			 publicly available; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H693C8A646A704BD7B601662BD8034DB3"><enum>(B)</enum><text display-inline="yes-display-inline">the public on the Web site of the Office
			 not later than 90 days after the submission of the information under paragraph
			 (1).</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HEE6C277BACE2421B8A7DBD8576A9A9EC"><enum>(c)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the Director of the Office of Personnel Management shall
			 prescribe regulations directing the methodology, timing, and reporting of the
			 data described in subsection (a).</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H94054B21FF1A4DCD8DCD38D733949621" section-type="subsequent-section"><enum>10.</enum><header display-inline="yes-display-inline">Regulations</header>
			<subsection commented="no" display-inline="no-display-inline" id="H858C39851CC74E79955570F1DB358A4D"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided under section 9(c), not
			 later than 120 days after the date of enactment of this Act, the Director of
			 the Office of Personnel Management shall prescribe regulations as necessary to
			 carry out this Act.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H59410651CB4B46419F46B071096E2C08"><enum>(b)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">The Director of the Office of Personnel
			 Management shall consult the Chief Human Capital Officers Council in the
			 development of regulations under this section.</text>
