		<official-title>To amend the Federal Water Pollution Control Act to
		  establish a San Francisco Bay restoration grant program.</official-title>

		<section id="H3A441D98731C41FEB6AC0ED73A3A7B6D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>San Francisco Bay Restoration Act of
			 2011</short-title></quote>.</text>
		</section><section id="HC2E4DFF39A464EA5B5341167BBE26212"><enum>2.</enum><header>San Francisco Bay
			 restoration grant program</header><text display-inline="no-display-inline">Title I of the Federal Water Pollution
			 Control Act (33 U.S.C. 1251 et seq.) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H1DE8F5A384944DBAB480C545D531D933" style="OLC">
				<section id="H9D54DF77644D4CBFA948AF131484B6A7"><enum>123.</enum><header>San Francisco
				Bay restoration grant program</header>
					<subsection id="HE5D351F4737147BC95EAA1DEFBA2F594"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
						<paragraph id="H1CEC48D4445E4459A42E127100C29C97"><enum>(1)</enum><header>Annual priority
				list</header><text>The term <term>annual priority list</term> means the annual
				priority list compiled under subsection (b).</text>
						</paragraph><paragraph id="H34CCE62EF5714CD5B90566F19C1404EE"><enum>(2)</enum><header>Comprehensive
				plan</header><text>The term <term>comprehensive plan</term> means—</text>
							<subparagraph id="H85B44A3073CB4D618CE7A3011D9BA316"><enum>(A)</enum><text>the comprehensive
				conservation and management plan approved under section 320 for the San
				Francisco Bay estuary; and</text>
							</subparagraph><subparagraph id="H1C7DE9E1DDCA482A988BB3E890F23E92"><enum>(B)</enum><text>any amendments to
				that plan.</text>
							</subparagraph></paragraph><paragraph id="H26F7D08881C44E20903428E132440802"><enum>(3)</enum><header>Estuary
				partnership</header><text>The term <term>Estuary Partnership</term> means the
				San Francisco Estuary Partnership, the entity that is designated as the
				management conference under section 320.</text>
						</paragraph></subsection><subsection id="H7CB9FE461E134E629693DE5F7B11BE50"><enum>(b)</enum><header>Annual priority
				list</header>
						<paragraph id="HA2CA8163AC574CF49FA825281C6DDB8B"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">After providing
				public notice, the Administrator shall annually compile a priority list
				identifying and prioritizing the activities, projects, and studies intended to
				be funded with the amounts made available under subsection (c).</text>
						</paragraph><paragraph id="HA93C4C900D5C41BE9C10A392EA0F6C90"><enum>(2)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The annual priority list compiled under
				paragraph (1) shall include—</text>
							<subparagraph id="H2C105C8095A3421189AB6CE6E150BCD3"><enum>(A)</enum><text display-inline="yes-display-inline">activities, projects, or studies that
				advance the goals and objectives of the approved comprehensive plan;</text>
							</subparagraph><subparagraph id="H1A90A3ACD9D440CDAEC6B1516416767F"><enum>(B)</enum><text display-inline="yes-display-inline">information on the activities, projects, or
				studies specified under subparagraph (A), including a description of—</text>
								<clause id="HDE33759E4AC44806A3B9F4813901670C"><enum>(i)</enum><text display-inline="yes-display-inline">the identities of the financial assistant
				recipients; and</text>
								</clause><clause id="H7101B2F2A9554531937AC7F9C2FE4E21"><enum>(ii)</enum><text display-inline="yes-display-inline">the communities to be served; and</text>
								</clause></subparagraph><subparagraph id="H087A917669654D7BB34B8FDEDB8CA56A"><enum>(C)</enum><text display-inline="yes-display-inline">the criteria and methods established by the
				Administrator for selection of activities, projects, and studies.</text>
							</subparagraph></paragraph><paragraph id="H9863E40CC0C449F1BBC6A8A936BAFAA6"><enum>(3)</enum><header>Consultation</header><text display-inline="yes-display-inline">In developing the priority list under
				paragraph (1), the Administrator shall consult with and consider the
				recommendations of—</text>
							<subparagraph id="H33BEC3EB5EA84F20811156035CEEE413"><enum>(A)</enum><text display-inline="yes-display-inline">the Estuary Partnership;</text>
							</subparagraph><subparagraph id="H294E1C918BEA45118B572FE00C89696A"><enum>(B)</enum><text display-inline="yes-display-inline">the State of California and affected local
				governments in the San Francisco Bay estuary watershed; and</text>
							</subparagraph><subparagraph id="HE2E57C16BFA8425281C1A21707F307B4"><enum>(C)</enum><text display-inline="yes-display-inline">any other relevant stakeholder involved
				with the protection and restoration of the San Francisco Bay estuary that the
				Administrator determines to be appropriate.</text>
							</subparagraph></paragraph></subsection><subsection id="H1916482A221C40CE98038D3495B89D74"><enum>(c)</enum><header>Grant
				program</header>
						<paragraph id="H2787E6B051EB4BD4A6E890C9271B2925"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Pursuant to section
				320, the Administrator may provide funding through cooperative agreements,
				grants, or other means to State and local agencies, special districts, and
				public or nonprofit agencies, institutions, and organizations, including the
				Estuary Partnership, for activities, studies, or projects identified on the
				annual priority list.</text>
						</paragraph><paragraph id="H40A2CAC58AC545A187502A0D24B7AE0C"><enum>(2)</enum><header>Maximum amount
				of grants; non-Federal share</header>
							<subparagraph id="HCC8C51F9950D49F6B4A697D67E9BD488"><enum>(A)</enum><header>Maximum amount
				of grants</header><text display-inline="yes-display-inline">Funding provided to
				any individual or entity under this section for a fiscal year shall not exceed
				an amount equal to 75 percent of the total cost of eligible activities that are
				to be carried out using such funds.</text>
							</subparagraph><subparagraph id="HF60F9456B1D04597ABE9EAFA04B09BDD"><enum>(B)</enum><header>Non-Federal
				share</header><text display-inline="yes-display-inline">The non-Federal share
				of the total cost of any eligible activities that are carried out using funds
				provided under this section shall be—</text>
								<clause id="H25F86B88916D493EB988EE9F0E40367D"><enum>(i)</enum><text display-inline="yes-display-inline">not less than 25 percent; and</text>
								</clause><clause id="H19256F5E928742F08DAF7CF03B898FDC"><enum>(ii)</enum><text display-inline="yes-display-inline">provided from non-Federal sources.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="H49FFC0E711E249D2A20B8916E76F06D6"><enum>(d)</enum><header>Funding</header>
						<paragraph id="H30BAE55620ED4E70ACB32B4A7FFCA68C"><enum>(1)</enum><header>Authorization of
				appropriations</header><text display-inline="yes-display-inline">There is
				authorized to be appropriated to the Administrator to carry out this section
				$20,000,000 for each of fiscal years 2012 through 2016.</text>
						</paragraph><paragraph id="H17C0DC0394C9441293757C087C9D7773"><enum>(2)</enum><header>Administrative
				expenses</header><text display-inline="yes-display-inline">Of the amount made
				available to carry out this section for a fiscal year, the Administrator shall
				use not more than 5 percent to pay administrative expenses incurred in carrying
				out this section.</text>
						</paragraph><paragraph id="HDBF9536BE8204E9AB1A181EBC43A9AC9"><enum>(3)</enum><header>Relationship to
				other funding</header><text display-inline="yes-display-inline">Nothing in this
				section shall limit the eligibility of the Estuary Partnership to receive
				funding under section 320(g).</text>
						</paragraph><paragraph id="H60C80881529A42039CD66E83B40AEF7A"><enum>(4)</enum><header>Prohibition</header><text>No
				funding made available under subsection (c) may be used for the administration
				of a management conference under section
				320.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
