		<section id="HCF8EB3D8DA6A42E3AEC52C0176F5EE24" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Medicare Access to Radiology Care Act
			 of 2011</short-title></quote>.</text>
		</section><section id="HE751B4165D984E79B0D25C78D2E99D5D"><enum>2.</enum><header>Medicare payment
			 for qualified radiologist assistant services</header>
			<subsection id="H125A186729B14E29A92FB6894A463199"><enum>(a)</enum><header>Coverage</header><text>Section
			 1861 of the Social Security Act (42 U.S.C. 1395x) is amended—</text>
				<paragraph id="HBF3D0692659240D1A1C70790857969BB"><enum>(1)</enum><text>in subsection
			 (s)(2)(K)—</text>
					<subparagraph id="HB99F7C0F60F641989783FA6C2A945598"><enum>(A)</enum><text>by striking the
			 semicolon at the end of clause (ii) and inserting a comma; and</text>
					</subparagraph><subparagraph id="HDDA8B03D343F4E00815D3440E4085AD7"><enum>(B)</enum><text>by adding at the
			 end the following new clause:</text>
						<quoted-block display-inline="no-display-inline" id="HC262BD3AF1DD4EB2B7F3FB9710202331" style="OLC">
							<clause id="HC5CEA721CD20467B9165E63A0A2879D1" indent="up2"><enum>(iii)</enum><text display-inline="yes-display-inline">qualified radiologist assistant services
				(as defined in subsection (iii)(1)),</text>
							</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HEC13162DF5A84B48B017D53A19A496AF"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
					<quoted-block id="H5AE720A9F6C54892962DDC37458570EE" other-style="archaic" style="other"><subsection id="HE581E23A64B94F9086E918A355DA5092"><enum>(iii)</enum><header>Qualified Radiologist
		  Assistant Services; Qualified Radiologist Assistant</header><paragraph commented="no" display-inline="yes-display-inline" id="H5C9F265DDD844F4BB67D64F8FBD515FA"><enum>(1)</enum><text>The term <term>qualified
				radiologist assistant services</term> means services—</text>
								<subparagraph id="H6AF5A6E2341844CA84E2B30FC0EEA616" indent="up1"><enum>(A)</enum><text>performed by a qualified radiologist
				assistant (as defined in paragraph (2)) as an employee, leased employee, or
				independent contractor of the supervising radiologist under the supervision (as
				determined by State law) of a radiologist; and</text>
								</subparagraph><subparagraph id="HC6BD023E93034CA8A4781CEF26A942B5" indent="up1"><enum>(B)</enum><text>which the radiologist assistant is
				legally authorized to perform under State law (or the State regulatory
				mechanism provided by State law).</text>
								</subparagraph></paragraph><paragraph id="HCEF7C45E7E7D49938C94604F42DBC3D8" indent="up1"><enum>(2)</enum><text>The term <term>qualified radiologist
				assistant</term> means a radiographer who is certified by the American Registry
				of Radiologic Technologists as a registered radiologist assistant or by the
				Certification Board for Radiology Practitioner Assistants as a radiology
				practitioner assistant to perform radiologic procedures under the supervision
				(as determined by State law) of a
				radiologist.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H369DD58E92104B58960DAE8A6BF2373B"><enum>(b)</enum><header>Payment in
			 relation to physician fee schedule</header>
				<paragraph id="H414600E6876A4E49A92CAFECB566317C"><enum>(1)</enum><header>Payment
			 level</header><text>Section 1833(a)(1)(O) of such Act (42 U.S.C.
			 1395l(a)(1)(O)) is amended by inserting <quote>or qualified radiologist
			 assistant services</quote> after <quote>or clinic nurse
			 specialists</quote>.</text>
				</paragraph><paragraph id="H325382C826AB4A659503460D58773EE1"><enum>(2)</enum><header>Payment to
			 supervising radiologist</header><text>The first sentence of section 1842(b)(6)
			 of such Act (42 U.S.C. 1395u(b)(6)) is amended—</text>
					<subparagraph id="HA977D55F256D4041A6BF4423DD4DDA9B"><enum>(A)</enum><text>by striking
			 <quote>and</quote> before <quote>(H)</quote>; and</text>
					</subparagraph><subparagraph id="HDE8F354D349048D8B40D7D2D2F2941C6"><enum>(B)</enum><text>by inserting
			 before the period at the end the following: <quote>, and (I) in the case of
			 qualified radiologist assistant services, the payment shall be made to the
			 supervising radiologist</quote>.</text>
					</subparagraph></paragraph><paragraph id="HD57856C6ED954D21B837CAC105F84FDB"><enum>(3)</enum><header>Rules of
			 construction</header><text>Nothing in this section, or the amendments made by
			 this section, shall be construed as affecting—</text>
					<subparagraph id="H872F02ECDE4B41A8B5D15A7F41E21F05"><enum>(A)</enum><text>coverage of and
			 payment for the technical component (including the technical component of a
			 global fee) with respect to imaging services under title XVIII of the Social
			 Security Act (42 U.S.C. 1395 et seq.) as in effect before the date of the
			 enactment of this Act; or</text>
					</subparagraph><subparagraph id="HF09A8A745CA54588AE6F3B715AB698F4"><enum>(B)</enum><text>the amount of
			 payment made for physicians’ services under such title when furnished solely by
			 a radiologist.</text>
					</subparagraph></paragraph></subsection><subsection id="H05A33F882DF44DB9BA537F16933C66E8"><enum>(c)</enum><header>Review and
			 report</header><text>The Secretary of Health and Human Services shall conduct a
			 review of the effect of the amendments made by this section on patient
			 satisfaction and on the clinical and operational effectiveness of the use of
			 radiologist assistants pursuant to such amendments, and shall submit to
			 Congress not later than January 1, 2016, a report to Congress on such review.</text>
			</subsection><subsection id="HA169AD9E45FA43AFBED680814F974836"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to services
			 furnished on or after January 1, 2012.</text>
