		<section id="HA167F4A75D9E419593115AEEFDFC445D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal Employees Leave Transfer Act of
			 2011</short-title></quote>.</text>
		</section><section id="HFF6A4A2B84F74B7B99D55657F4970637"><enum>2.</enum><header>Authority to
			 transfer sick leave</header>
			<subsection id="H9920A7AAD784422FBD3AF64E8A8F9655"><enum>(a)</enum><header>Direct transfers
			 of leave</header>
				<paragraph id="HC82BD4B83C3C4113B45F073ADC39EEE3"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter III of
			 chapter 63 of title 5, United States Code, is amended by inserting after
			 section 6338 the following:</text>
					<quoted-block display-inline="no-display-inline" id="H3C31D736992E414494D393BB7DD43AB8" style="USC">
						<section id="H0C17C94E759049F0AC49C0A511E473F2"><enum>6338a.</enum><header>Sick
				leave</header>
							<subsection id="H63CC2F8AB586406B82E97FE84EFEA78A"><enum>(a)</enum><text display-inline="yes-display-inline">The Office of Personnel Management shall by
				regulation modify the program established under the preceding provisions of
				this subchapter so as to permit, in addition to annual leave, the transfer and
				use of sick leave.</text>
							</subsection><subsection id="H840596B2CEFF430B8D80D9817A344E7F"><enum>(b)</enum><text display-inline="yes-display-inline">To the extent feasible, the terms and
				conditions governing the transfer and use of sick leave under the regulations
				shall be the same as those governing the transfer and use of annual leave under
				the preceding provisions of this subchapter, subject to the following:</text>
								<paragraph id="H3A7F7833C62B46269D2111F9F281E5CE"><enum>(1)</enum><text display-inline="yes-display-inline">Sick leave may not be transferred or used
				in connection with any purpose for which accrued sick leave could not be used
				by the leave recipient under subchapter I.</text>
								</paragraph><paragraph id="HD4EB792091F048A18F9C16FFC944A1F3"><enum>(2)</enum><text display-inline="yes-display-inline">Sick leave received under this
				subchapter—</text>
									<subparagraph id="H90790956BBD442C9B142AFBFB11AF16A"><enum>(A)</enum><text display-inline="yes-display-inline">may not be used before the exhaustion
				requirement under section 6333(b) has been met; and</text>
									</subparagraph><subparagraph id="H1E08A842EBEB44D7AF7A64538B1F18FA"><enum>(B)</enum><text display-inline="yes-display-inline">shall not (for restoration purposes, if
				applicable) be considered to have been used before all transferred annual leave
				has been exhausted.</text>
									</subparagraph></paragraph><paragraph id="H8297DC82420B469B99D6F6773E1F7D22"><enum>(3)</enum><text display-inline="yes-display-inline">Nothing in this section shall affect the
				maximum amount of sick leave or annual leave which may be accrued by a leave
				recipient while using any leave received under this subchapter in connection
				with a particular medical emergency.</text>
								</paragraph><paragraph commented="no" id="H8071354557F44C3689EF02B4815B9D30"><enum>(4)</enum><text display-inline="yes-display-inline">An employee who donates sick leave pursuant
				to this section shall not be conferred any benefit (including an appointment,
				promotion, or compensation) in connection with such donation.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H963D7379FE2D46CC9307B8203856C2A6"><enum>(2)</enum><header>Technical and
			 conforming amendments</header>
					<subparagraph id="H7C3CD775F80A4477AAAF73E55390E22D"><enum>(A)</enum><header>Prohibition of
			 coercion</header><text display-inline="yes-display-inline">Section 6338(a) of
			 title 5, United States Code, is amended by striking <quote>annual leave</quote>
			 and inserting <quote>annual or sick leave</quote>.</text>
					</subparagraph><subparagraph id="HFD2792B5CA8F4D6DB4BC3BB626992585"><enum>(B)</enum><header>Excepted
			 agencies</header><text display-inline="yes-display-inline">Section 6339(b)(1)
			 of such title is amended—</text>
						<clause id="H30EFC8F0F249438084940F54235A885D"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>annual leave
			 accrued</quote> and inserting <quote>annual or sick leave accrued</quote>;
			 and</text>
						</clause><clause id="HFFBCAE349DF84303812630FC4FD31815"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>annual leave
			 account</quote> and inserting <quote>annual or sick leave account (as
			 applicable)</quote>.</text>
						</clause></subparagraph><subparagraph id="H49BF706767594E96A6FBA5E337B610A3"><enum>(C)</enum><header>Table of
			 contents</header><text display-inline="yes-display-inline">The table of
			 sections for chapter 63 of title 5, United States Code, is amended by inserting
			 after the item relating to section 6338 the following:</text>

			 program</header>
				<paragraph id="HA23BD596EA564576A89F17C1D9BF6890"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter IV of
			 chapter 63 of title 5, United States Code, is amended by inserting after
			 section 6371 the following:</text>

						<section id="HFCA19AFF82584FE4BBEC78DD4A352CB5"><enum>6371a.</enum><header>Sick
				leave</header>
							<subsection id="HDE85F967B0A3489DBA5612F021F084E9"><enum>(a)</enum><text display-inline="yes-display-inline">The Office of Personnel Management shall by
				regulation modify the program established under the preceding provisions of
				this subchapter so as to permit, in addition to annual leave, the contribution
				and use of sick leave.</text>
							</subsection><subsection id="HDD3273063B6D49E5BE92B4D77F0091F0"><enum>(b)</enum><text display-inline="yes-display-inline">To the extent feasible, the terms and
				conditions governing the contribution and use of sick leave under the
				regulations shall be the same as those governing the contribution and use of
				annual leave under the preceding provisions of this subchapter, subject to the
				following:</text>
								<paragraph id="H0FECD9B9A42F4D74915A60BD4D0D66D4"><enum>(1)</enum><text display-inline="yes-display-inline">Sick leave may not be used in connection
				with any purpose for which accrued sick leave could not be used by the leave
				recipient under subchapter I.</text>
								</paragraph><paragraph id="H78F3AF6DE80544C3AB6462556905D37A"><enum>(2)</enum><text display-inline="yes-display-inline">Sick leave may be contributed instead of
				annual leave in order to satisfy, in whole or in part, the requirements of
				section 6366(a)(2)(A).</text>
								</paragraph><paragraph id="H2F0202DCD4D14F0AAB1B8E0DA66A3CF4"><enum>(3)</enum><text display-inline="yes-display-inline">Sick leave received under this subchapter
				may not be used before the exhaustion requirement under section 6367(c) has
				been met.</text>
								</paragraph><paragraph id="H599A7305EFF6443A9879B6B468F3F547"><enum>(4)</enum><text display-inline="yes-display-inline">Nothing in this section shall affect the
				maximum amount of sick leave or annual leave which may be accrued by a leave
				recipient while using leave received under this subchapter in connection with a

			 title 5, United States Code, is amended by striking <quote>annual leave</quote>
			 and inserting <quote>annual or sick leave</quote>.</text>
					</subparagraph><subparagraph id="HE45FE95A452F4D0D87C27600321D9C04"><enum>(B)</enum><header>Excepted
			 agencies</header><text display-inline="yes-display-inline">Section 6372(c)(1)
			 of such title is amended by striking <quote>annual leave accrued</quote> and
			 inserting <quote>annual or sick leave accrued</quote>.</text>
					</subparagraph><subparagraph id="HC08D012EEAEF4D00BAF5AA35F359AE19"><enum>(C)</enum><header>Table of
			 contents</header><text display-inline="yes-display-inline">The table of
			 sections for chapter 63 of title 5, United States Code, is amended by inserting
			 after the item relating to section 6371 the following:</text>

			 date</header><text display-inline="yes-display-inline">Regulations required to
			 be prescribed by the Office of Personnel Management under the amendments made
			 by this section shall become effective not later than 90 days after the date of
			 enactment of such section.</text>
