		<legis-type>A BILL</legis-type>
		<official-title>To amend the National Labor Relations Act to modify the
		  authority of the National Labor Relations Board with respect to rulemaking,
		  issuance of complaints, and authority over unfair labor
		  practices.</official-title>

		<section id="HB06E5C121EB44D9AA6AED31E813E7B05" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Protecting American Jobs
			 Act</short-title></quote>.</text>
		</section><section id="H5D400D9C7629431BA7F0F8BF013249AF"><enum>2.</enum><header>Amendments to the
			 National Labor Relations Act</header>
			<subsection id="H9987F67390EB4751BF41BFA9F88A5286"><enum>(a)</enum><header>Duties of the
			 General Counsel and Administrative Law Judges</header><text display-inline="yes-display-inline">The National Labor Relations Act (29 U.S.C.
			 151 et seq.) is amended—</text>
				<paragraph id="H5E21233D485E46B3A10EDA81B63AFF67"><enum>(1)</enum><text>in section 3(d),
			 by striking <quote>and issuance of complaints under section 10, and in respect
			 of the prosecution of such complaints before the Board</quote>; and</text>
				</paragraph><paragraph id="H95114E6735B34A0B9A31B077ED73AAC1"><enum>(2)</enum><text>in section 4(a),
			 by striking the fourth sentence.</text>
				</paragraph></subsection><subsection id="HACC78DE0E8BC4232A990430DBD4666C4"><enum>(b)</enum><header>Clarification of
			 the Board’s rulemaking authority</header><text display-inline="yes-display-inline">Section 6 of such Act (29 U.S.C. 156) is
			 amended by adding at the end the following: <quote>Such rulemaking authority
			 shall be limited to rules concerning the internal functions of the Board and
			 the Board is prohibited from promulgating rules that affect the substantive
			 rights of any person, employer, employee, or labor
			 organization.</quote>.</text>
			</subsection><subsection id="HAE8DD1A1844B4DB8838F141C8083A6EE"><enum>(c)</enum><header>Investigatory
			 power and Adjudicatory Authority Over Unfair Labor Practice
			 Allegations</header><text display-inline="yes-display-inline">Section 10 of
			 such Act (29 U.S.C. 60) is amended—</text>
				<paragraph id="H33E8E3EC6DB74E618E3939A2338DE030"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>
					<subparagraph id="H890A0D1C36F4404E9E124859E6CC9FFA"><enum>(A)</enum><text>by striking
			 <quote>prevent any person from engaging in</quote> and inserting
			 <quote>investigate</quote>; and</text>
					</subparagraph><subparagraph id="HC9FF01A1E4FF46ECAA1C3E748E861DBF"><enum>(B)</enum><text>by striking
			 <quote>This power shall</quote> and all that follows through the end of the
			 subsection;</text>
					</subparagraph></paragraph><paragraph id="HFAA8A0ABCC574AF08AE2774A8C0ED32F"><enum>(2)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="H6525F32C98C946299A10720C8A684E43"><enum>(A)</enum><text>by striking
			 <quote>Whenever it is charged</quote> and inserting <quote>Whenever it
			 appears</quote>;</text>
					</subparagraph><subparagraph id="H65F5531F28A3453FA5CF39E20B013D21"><enum>(B)</enum><text>by striking
			 <quote>or is engaging in</quote> and inserting <quote>, is engaging in, or is
			 about to engage in</quote>;</text>
					</subparagraph><subparagraph id="H4DA3E8EDF1F046A9847B718090318DDC"><enum>(C)</enum><text>by striking
			 <quote>the Board, or any agent</quote> and all that follows through
			 <quote><italic>Provided, </italic>That no complaint shall be issued</quote> and
			 inserting <quote>the aggrieved party may bring a civil action for such relief
			 (including injunctions) as may be appropriate. Any such action may be brought
			 in the district court of the United States where the violation occurred, or at
			 the option of the parties, in the United States District Court for the District
			 of Columbia. No civil action may be brought</quote>;</text>
					</subparagraph><subparagraph id="HE7F5788E0F164B45B4B4F11714078E8C"><enum>(D)</enum><text>by striking
			 <quote>charge with the Board and the service of a copy thereof upon the person
			 against whom such charge is made</quote> and insert <quote>civil
			 action</quote>; and</text>
					</subparagraph><subparagraph id="H106E2441E8F543D9BAAF154B784EF712"><enum>(E)</enum><text display-inline="yes-display-inline">by striking <quote>Any such complaint may
			 be amendment</quote> and all that follows through <quote>Any such proceeding
			 shall, so far as practicable,</quote> and insert <quote>Any such proceeding
			 shall</quote>;</text>
					</subparagraph></paragraph><paragraph id="HB3550479B7854C4F91D154044E03C91C"><enum>(3)</enum><text>by striking
			 subsections (c) through (k) and redesignating subsection (l) as subsection (c);
			 and</text>
				</paragraph><paragraph id="H80C303BF954042BCA13D9A9BA1F69569"><enum>(4)</enum><text>in subsection (c)
			 (as so redesignated)—</text>
					<subparagraph id="HEE7B6A7052A54CF0822269382DF2D48D"><enum>(A)</enum><text>by striking
			 <quote>Whenever it is charged</quote> and inserting <quote>Whenever it is
			 alleged</quote>;</text>
					</subparagraph><subparagraph id="H56305E4F16C4487E9D6A7017F46D1AFE"><enum>(B)</enum><text>in the first
			 sentence, by striking <quote>charge</quote> both places it appears and
			 inserting <quote>allegation</quote>; and</text>
					</subparagraph><subparagraph id="H0B5890A1CD0F414A81BA9C4769EA6560"><enum>(C)</enum><text>by striking
			 <quote>and that a complaint should issue, he shall</quote> and all that follows
			 through the end of the subsection and inserting <quote>, the officer or
			 regional attorney shall, on behalf of the Board, submit a written summary of
			 the findings to all parties involved in the alleged unfair labor
			 practice.</quote>.</text>
					</subparagraph></paragraph></subsection></section><section id="H037D97491B914D1C9009DDD617750EB3"><enum>3.</enum><header>Regulations</header><text display-inline="no-display-inline">Not later than 6 months after the date of
			 the enactment of this Act, the National Labor Relations Board shall review and
			 revise all regulations promulgated before such date to implement the amendments
			 made by this Act.</text>
