Profitability and Revenue-Generating Enhancements</header>

offer nonpostal services</header>
<subsection id="H9CF7E40CB01C4594A214B8113678829F"><enum>(a)</enum><header>Specific
power</header><text display-inline="yes-display-inline">Section 404(a) is
amended—</text>

by striking <quote>and</quote> at the end;</text>

services</header><text>Section 404(e) is amended to read as follows:</text>
<quoted-block display-inline="no-display-inline" id="H416BDDE1DDCA4AEEA0D64302DF60F55C" style="USC">
<subsection id="H52E5E4F0077A4E87980F14895B0E386B"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H6FDFD397B6DA4A998CEAD874E3309330"><enum>(1)</enum><text>The Postal Service may
provide nonpostal services that use the processing, transportation, delivery,
retail network, technology or other resources of the Postal Service in a manner
consistent with the public interest.</text>
</paragraph><paragraph id="H4531F74A4E274368A36FFCA2BC52AD8E" indent="up1"><enum>(2)</enum><text>At least 90 days before offering new
nonpostal services, the Postal Service shall request an advisory opinion from
the Postal Regulatory Commission that evaluates the extent to which the
provision of such nonpostal services—</text>
<subparagraph id="H1450B8FBF4DD493FA0DE4DD8BCD042D5"><enum>(A)</enum><text>would use the processing,
transportation, delivery, retail network, technology, or other resources of the
Postal Service; and</text>
</subparagraph><subparagraph id="HC389B45540E34D41A500DF649603037B"><enum>(B)</enum><text>would be consistent with the public
interest.</text>
</subparagraph></paragraph><paragraph id="H4951298C9EEA4E8C99EAF41BDC85701B" indent="up1"><enum>(3)</enum><text>Within 45 days after receiving the
request under paragraph (2), the Postal Regulatory Commission—</text>
<subparagraph id="HF7CFA68909C14D3BBB70F8D38F698829"><enum>(A)</enum><text>shall issue its advisory opinion to
the Postal Service; and</text>
</subparagraph><subparagraph id="H9F5304B3B0014DB09532B9181F7F5EC4"><enum>(B)</enum><text>shall transmit a copy of such opinion,
together with the original request, to—</text>
<clause id="HD229CF7778AB4E378907AA78FBB61950"><enum>(i)</enum><text>the Committee on Oversight and
Government Reform of the House of Representatives; and</text>
</clause><clause id="H7E6CF759875A4DCF883C6CB67E49CCCD"><enum>(ii)</enum><text>the Committee on Homeland Security
and Governmental Affairs of the Senate.</text>
</clause></subparagraph></paragraph><paragraph commented="no" id="HF589FDFFDBA64A06B619FDAD825CC161" indent="up1"><enum>(4)</enum><text>For purposes of this title, the term
<term>nonpostal services</term> means services and products other than postal
services as defined in section 102(5), including—</text>
<subparagraph commented="no" id="HBB95530BE8474F69A6ED3A3D969DFAC0"><enum>(A)</enum><text display-inline="yes-display-inline">check-cashing services;</text>
</subparagraph><subparagraph commented="no" id="HC66E0DCC219E4CDE942D42F6E5BBCDFB"><enum>(B)</enum><text>new technology and media
services;</text>
</subparagraph><subparagraph commented="no" id="HE76E4FC9E82440A0AA90154489D4E232"><enum>(C)</enum><text>warehousing and logistics;</text>
</subparagraph><subparagraph commented="no" id="HF287D52A47404462BC6CCD00E94E9452"><enum>(D)</enum><text>facility leasing; and</text>
</subparagraph><subparagraph commented="no" id="H53A9EC121C78415A86A54C69985F6621"><enum>(E)</enum><text>public internet access
services.</text>

</subsection></section><section id="HF84FFF6AAD9F460FB346DD4B08393E63"><enum>102.</enum><header>USPS balanced
budget minimum requirement</header><text display-inline="no-display-inline">Subsection (b) of section 404 is
amended—</text>
<paragraph id="H1676B48D7C5441138CBC8F49122CDF97"><enum>(1)</enum><text>by striking
<quote>(b)</quote> and inserting <quote>(b)(1)</quote>; and</text>
</paragraph><paragraph id="H1AB256CBDF1B494A956B78CCD8FE44B5"><enum>(2)</enum><text>by adding at the
end the following:</text>
<quoted-block display-inline="no-display-inline" id="H84EFC6925E594172A317E5883F10F08C" style="OLC">

by this title, within 180 days after the date of enactment of this paragraph,
the Governors shall ensure that the rates and fees charged, and the level and
quality of services provided, shall be adjusted so that the total revenues
received by the Postal Service from all sources are at least equal to the total
costs incurred in the provision of postal services, except that the Governors
shall continue to provide all public services for which appropriations are made
to the Postal Service under section
2401.</text>

</paragraph></section><section id="H6CE2B51F28CA4849A6A96F9215C5B5F8"><enum>103.</enum><header>Enhanced
pricing flexibility</header><text display-inline="no-display-inline">The second
sentence of section 404(c) is repealed.</text>
</section><section id="H652486500AEC4B889B200CC4448A3255"><enum>104.</enum><header>Investment of
competitive product moneys</header><text display-inline="no-display-inline">Section 2003 is amended—</text>
<paragraph id="H795B8265A2DD48B8AE3541772A9DD536"><enum>(1)</enum><text>by redesignating
subsections (d) through (h) as subsections (e) through (i), respectively;
and</text>
</paragraph><paragraph id="H583E8091488846289E421489859AEFDF"><enum>(2)</enum><text>by inserting after
subsection (c) the following:</text>

market-dominant products cover attributable costs</header>
<subsection id="H85BD3EC8D29447E8AD845568BC8E7F5F"><enum>(a)</enum><header>Repeal</header><text display-inline="yes-display-inline">Paragraph (2) of section 3622(c) is
repealed.</text>
</subsection><subsection id="HC2398C0814F54320A9FA3C6F714D2CE2"><enum>(b)</enum><header>Each class To
bear attributable costs</header><text>Section 3622(d)(1) is amended—</text>
<paragraph id="H59E86B137CBC4F95B4A8B92975A1CC1D"><enum>(1)</enum><text>by redesignating
subparagraphs (A) through (E) as subparagraphs (B) through (F);</text>

general</header><text display-inline="yes-display-inline">Chapter 2 is amended
by adding at the end the following:</text>

<section id="H106D57E9CFE84EE483800DAC4A034BC1"><enum>209.</enum><header>USPS innovation
officer and accountability</header>
<subsection id="H599DBCBB40FF4DF29E4E579E8D7AD270"><enum>(a)</enum><header>In
general</header><text>There shall be in the Postal Service a Chief Innovation
Officer selected by the Postmaster General who shall have proven expertise and
a record of success in 1 or more of the postal and shipping industry,
innovation product research and development, marketing brand strategy, emerging
communications technology, or business process management. The Chief Innovation
Officer shall manage the Postal Service’s development and implementation of
innovative postal and nonpostal products and services.</text>
</subsection><subsection id="H7E356A51B5BF4C8E9391443D434C1871"><enum>(b)</enum><header>Duties</header><text>The
Chief Innovation Officer shall have as primary duties—</text>
<paragraph id="H0DB4A4B7102E46A89083D00B89CC4E5F"><enum>(1)</enum><text>leading the
development of innovative nonpostal products and services that will maximize
revenue to the Postal Service;</text>
</paragraph><paragraph id="H2C7215988D814EB2BD0518D1D3424CD8"><enum>(2)</enum><text>developing
innovative postal products and services, particularly those that utilize
emerging information technologies, to maximize revenue to the Postal
Service;</text>
</paragraph><paragraph id="HC8F4B27A51764EE49DB03A0A53E07557"><enum>(3)</enum><text>monitoring the
performance of these products and services and revising them as needed to meet
changing market trends; and</text>
</paragraph><paragraph id="H8B3F2928F0B7485E887FB55262CBB8D1"><enum>(4)</enum><text>taking into
consideration comments or advisory opinions, if applicable, issued by the
Postal Regulatory Committee prior to the initial sale of innovative postal or
nonpostal products and services.</text>
</paragraph></subsection><subsection id="HB7AD3AA36331490295936423526B501B"><enum>(c)</enum><header>Designation</header>
<paragraph id="HBFD955D09C5F4DBC863C4CED6D6F4DD9"><enum>(1)</enum><header>Deadline</header><text>As
soon as practicable after the date of enactment of this section, but no later
than October 1, 2012, the Postmaster General shall designate a Chief Innovation
Officer.</text>
</paragraph><paragraph id="H46EF5211471A4890A94B122D0E16175F"><enum>(2)</enum><header>Condition</header><text>Nothing
in this section shall be construed to prohibit an individual who holds another
office or position in the Postal Service from serving as the Chief Innovation
Officer under this chapter. However, the Chief Innovation Officer may not,
while serving in such office, concurrently hold any other office or position in
the Postal Service.</text>
</paragraph></subsection><subsection id="HEE8E6BEC773743839D04C6B9C1C119F7"><enum>(d)</enum><header>Innovation
strategy</header>
<paragraph id="H79DDA52635364C409ED63E1CE532D6D8"><enum>(1)</enum><header>In
general</header><text>Not later than 24 months after the date of enactment of
this section, the Postmaster General shall submit to the Committee on Homeland
Security and Governmental Affairs of the Senate and the Committee on Oversight
and Government Reform of the House of Representatives a comprehensive strategy
for maximizing revenues through innovative postal and nonpostal products and
services.</text>
</paragraph><paragraph id="H4EB74CD031AE47B595D596A7253C544B"><enum>(2)</enum><header>Matters to be
addressed</header><text>At a minimum, the strategy required by this section
shall address—</text>
<subparagraph id="H07C115271D4340D29BABEC172137F8CD"><enum>(A)</enum><text>the specific
innovative postal and nonpostal products and services to be developed and
offered by the Postal Service, including the nature of the market to be filled
by each product and service and the likely date by which each product and
service will be introduced;</text>
</subparagraph><subparagraph id="H1E20E2F5FC8347618BB51F94A3A2037E"><enum>(B)</enum><text>the cost of
developing and offering each product or service;</text>
</subparagraph><subparagraph id="HBAEABE06BE0E40D49E8F9A212767ADF5"><enum>(C)</enum><text>the anticipated
sales volume of each product and service;</text>
</subparagraph><subparagraph id="HAFA0461B0ACB4CCD93B894BB8264F249"><enum>(D)</enum><text>the anticipated
revenues and profits expected to be generated by each product and
service;</text>
</subparagraph><subparagraph id="HF780A6FD96324197BE078DB3768FB414"><enum>(E)</enum><text>the likelihood of
success of each innovative product and service as well as the risks associated
with the development and sale of each innovative product and service;</text>
</subparagraph><subparagraph id="HC7F0EB3411754AD6960AD2B9A9E80B07"><enum>(F)</enum><text>the trends
anticipated in market conditions that may affect the success of each product
and service over the next 5 years; and</text>
</subparagraph><subparagraph id="H821358689769457DB4FAC707372D6715"><enum>(G)</enum><text>the metrics that
will be utilized to assess the effectiveness of the innovation strategy.</text>
</subparagraph></paragraph><paragraph id="HD9B815CA06384530BAAC8D3D404CE538"><enum>(3)</enum><header>Strategy
updates</header><text display-inline="yes-display-inline">The strategy required
by this section shall be updated every 3 years and submitted to the Committee
on Homeland Security and Governmental Affairs of the Senate, the Committee on
Oversight and Government Reform of the House of Representatives, and the Postal
Regulatory Commission with the President’s annual budget request.</text>
</paragraph></subsection><subsection id="H7AAFFC6D184F4E71ABC215AE03F0B9EC"><enum>(e)</enum><header>Report on
performance</header>
<paragraph id="HD953BC2BC1D14A09A6A25C15632C084E"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">The Postmaster
General shall submit to the Committee on Homeland Security and Governmental
Affairs of the Senate, the Committee on Oversight and Government Reform of the
House of Representatives, and the Postal Regulatory Commission with the
President’s annual budget request a report that details the Postal Service’s
progress in implementing the Innovation Strategy.</text>
</paragraph><paragraph id="H054AFFFA62284AF3B3745BA36C8FF22F"><enum>(2)</enum><header>Matters to be
addressed</header><text>At a minimum, the report required by this section shall
address—</text>
<subparagraph id="HC910A40399444210AA2DF6D953D863F8"><enum>(A)</enum><text>the revenue
generated by each product and service developed through the Innovation Strategy
and the costs of developing and offering each such product and service for the
preceding year;</text>
</subparagraph><subparagraph id="H002405D872FA4F269CDAB4DAE2914EC7"><enum>(B)</enum><text>the total sales
volume and revenue generated by each product and service on a monthly basis for
the preceding year;</text>
</subparagraph><subparagraph id="HB3A92D386A3B48BFB957D62B6FD2421B"><enum>(C)</enum><text>trends in the
markets filled by each product and service;</text>
</subparagraph><subparagraph id="H9EBE80BDF65F430E8E25EA24B3421238"><enum>(D)</enum><text>products and
services identified in the Innovation Strategy that are to be discontinued, the
date on which the discontinuance will occur, and the reasons for the
discontinuance;</text>
</subparagraph><subparagraph id="HBE64ACCD9C2A41A7BB8B0F3786D5F9BF"><enum>(E)</enum><text>alterations in
products and services identified in the Innovation Strategy that will be made
to meet changing market conditions, and an explanation of how these alterations
will ensure the success of the products and services; and</text>
</subparagraph><subparagraph id="H4D18E22EF5224DABBFD9D3A40C1C6E4F"><enum>(F)</enum><text>the performance of
the Innovation Strategy according to the metrics identified in subsection
(d)(2)(G).</text>
</subparagraph></paragraph></subsection><subsection id="HCDA0F82D7A3F4626AECE34B4D89F8B75"><enum>(f)</enum><header>Comptroller
General</header>
<paragraph id="H17D3166AC2044F24BECB3996CB2033F8"><enum>(1)</enum><header>In
general</header><text>The Comptroller General shall conduct a study on the
implementation of the innovation strategy not later than 4 years after the date
of enactment of this section.</text>
</paragraph><paragraph id="H102430CB56164F80B5AED535FF4D50E2"><enum>(2)</enum><header>Contents</header><text>At
a minimum, the Comptroller General shall assess the effectiveness of the Postal
Service in identifying, developing, and selling innovative postal and nonpostal
products and services. The study shall also include—</text>
<subparagraph id="H2704AA93DCEE4E7497234F12658F9176"><enum>(A)</enum><text>an audit of the
costs of developing each innovative postal and nonpostal product and service
developed or offered by the Postal Service;</text>
</subparagraph><subparagraph id="H3A839FA3E75B402FAA96D85B7288A6D1"><enum>(B)</enum><text>the sales volume
of each such product and service;</text>
</subparagraph><subparagraph id="H44E07AD999D84A21BFD0E67AEE042F71"><enum>(C)</enum><text>the revenues and
profits generated by each such product and service; and</text>
</subparagraph><subparagraph id="HB06ED85C967943119BE58BBAC1E0E54C"><enum>(D)</enum><text>the likelihood of
continued success of each such product and service.</text>
</subparagraph></paragraph><paragraph id="HE419ADC68BE24BC195CC4B7472D3AD0C"><enum>(3)</enum><header>Submission</header><text>The
results of the study required under this subsection shall be submitted to the
Committee on Homeland Security and Governmental Affairs of the Senate and the
Committee on Oversight and Government Reform of the House of
Representatives.</text>
</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection id="HBEDA2E77EEC942B89AFB652D39A9BD9B"><enum>(b)</enum><header>Clerical
amendment</header><text>The table of sections at the beginning of chapter 2 is
amended by adding at the end the following:</text>

surplus contributions to Federal Employees’ Retirement System</header><text display-inline="no-display-inline">Section 8423(b) of title 5, United States
Code, is amended—</text>
<paragraph id="H00358A65CDFC48ADA911C8FB07708956"><enum>(1)</enum><text>by redesignating
paragraph (5) as paragraph (6); and</text>
</paragraph><paragraph id="H1C3796A253794CF0A068EC9E097F26D8"><enum>(2)</enum><text>by inserting after
paragraph (4) the following:</text>

</paragraph></section><section id="H9CEF3F2103874DAEADF23F1204BDB54C"><enum>202.</enum><header>Contributions
to Thrift Savings Fund of voluntary separation incentive payments</header>
<subsection id="HB346CDFA1F414B9F9BDCF52D6BAABE9D"><enum>(a)</enum><text>Section 8351(b)(2)
of title 5, United States Code, is amended—</text>
<paragraph id="H7F82788059004557BD6515A13641D833"><enum>(1)</enum><text>by striking the
matter before subparagraph (C) and inserting the following:</text>

</subsection></section><section id="H2C25120CDCFC4E778AF13DAC5CF2D43E"><enum>203.</enum><header>Modification of
prepayment schedule relating to Postal Service Retiree Health Benefits
Fund</header>
<subsection id="H957B6F99E00C4745BD23607F04B27123"><enum>(a)</enum><text display-inline="yes-display-inline">Section 8909a(d)(2)(B) of title 5, United
States Code, is amended—</text>
<paragraph id="H7ECFFA7388EB433197E21C2BAC69DA9C"><enum>(1)</enum><text>by striking
<quote>2017</quote> and inserting <quote>2012</quote>;</text>

</subsection></section><section id="H92B2CAE7065D4BF1AA3488A31091E54F"><enum>204.</enum><header>Study on USPS
workforce realignment and right-sizing options</header>
<subsection id="H22C962A173B447959F9A6293698FAC5B"><enum>(a)</enum><header>In
general</header><text>Not later than 180 days after the date of enactment of
this Act, the Comptroller General shall submit to the Committee on Oversight
and Government Reform of the House of Representatives and the Committee on
Homeland Security and Governmental Affairs of the Senate a report on workforce
reduction or realignment methods which could be used by the United States
Postal Service to align its workforce with its needs.</text>
</subsection><subsection id="H66262A907D7E401CB7FFDF6CCEAF6E5F"><enum>(b)</enum><header>Contents of the
report</header><text>The report required under subsection (a) shall include the
following:</text>
<paragraph id="HFC5E18D7B27B4EBB9CB2AAC1D18AC6E3"><enum>(1)</enum><text>The projected
workforce needs of the Postal Service, given the current mail volumes and the
demand for Postal services.</text>
</paragraph><paragraph id="H180A4FAC2C8F4F0BA052A1728C5C9B42"><enum>(2)</enum><text>Possible options
for allowing Postal Service employees who are eligible for voluntary early
retirement to deposit voluntary separation incentive payments to obtain service
credit or to otherwise allow such payments to be credited in the computation of
retirement annuity benefits.</text>
</paragraph><paragraph id="H0F2B52067BA54979A9FA87C1DCAF94CF"><enum>(3)</enum><text>The workforce
authorities available to the Postal Service under existing law, including for
reductions in force and voluntary separation incentive payments.</text>
</paragraph><paragraph id="HEBD86D9ED7F544E689ABAA6137AA08D3"><enum>(4)</enum><text>Any training,
retraining, or hiring that may be required by the authority the Postal Service
is granted under this Act to develop and offer for sale nonpostal products and
services.</text>
</paragraph></subsection></section><section id="HB4DE04E16E134AAFBB711FD7D306B875"><enum>205.</enum><header>Applicability
of provisions relating to reductions in force</header><text display-inline="no-display-inline">Section 1005 is amended by adding at the end
the following:</text>
<quoted-block display-inline="no-display-inline" id="HD1863908E2954FBFB3C0AD582319FEB1" style="USC">
<subsection id="HB2089468A7734C63BE19FB11A56FB20B"><enum>(g)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HEC8317D5F4284BF9AEFF4D3D07AD767D"><enum>(1)</enum><text>Except as otherwise
provided by any collective bargaining agreement entered into under chapter 12,
the provisions of subchapter I of chapter 35 of title 5 and the regulations
implementing such subchapter, shall apply to employees of the Postal Service
who hold positions that are within bargaining units under section 1202.</text>
</paragraph><paragraph id="HD0E31ED3201F4F698BCF07D8435FDB52" indent="up1"><enum>(2)</enum><text>Before using the authority provided
in paragraph (1), the Postal Service shall demonstrate to the Office of
Personnel Management how it will comply with section 3502(a)(4) of title
5.</text>
</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section id="H517BCF0AB0044B22944C1AE2C09B05B5" section-type="subsequent-section"><enum>206.</enum><header>Enhanced reporting
on facility network initiatives</header><text display-inline="no-display-inline">Section 404(d) is amended by adding at the
end the following:</text>
<quoted-block display-inline="no-display-inline" id="H2C9DC027651B423CA7FF63AA743F0DF2" style="USC">
<paragraph id="H0BE7098CF74A46948118580E5AB7C84A" indent="up1"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HEE320C96BFA44017808ED7CA4062BACE"><enum>(A)</enum><text display-inline="yes-display-inline">The Postmaster General shall submit to the
Committee on Homeland Security and Governmental Affairs of the Senate and the
Committee on Oversight and Government Reform of the House of Representatives
and the Postal Regulatory Commission a report that details plans to close or
suspend a Postal Service retail or processing facility during the period to
which such report pertains. The first such report shall be submitted not later
than 120 days after the date of enactment of this paragraph. Reports shall be
submitted semiannually thereafter.</text>
</subparagraph><subparagraph id="H13A0303EF2544ED991612A48AA0841F0" indent="up1"><enum>(B)</enum><text>Each report submitted by the Postal
Service under subparagraph (A) shall address, at a minimum—</text>
<clause id="H7FF6014ABDBC4752939D2672E9048517"><enum>(i)</enum><text>the specific retail and processing
facilities the Postal Service plans to suspend or close;</text>
</clause><clause id="HD3678ED977414A2E882AA6C015AD76E6"><enum>(ii)</enum><text>the anticipated date of suspension or
closure of each such facility;</text>
</clause><clause id="HDEB2276768C14ECD86A53BE1A5FBDA34"><enum>(iii)</enum><text>the cost of continued operations at
the facilities for which closure is planned;</text>
</clause><clause id="H74D7FFFEA0FE45DB937D740734798A94"><enum>(iv)</enum><text>the purpose of each such suspension
or closure, as determined by paragraph (2)(A);</text>
</clause><clause id="H3E16653497DD479BB6DD5746675C5759"><enum>(v)</enum><text>plans for the establishment of
alternative access points for retail facilities listed in clause (i), including
the date on which each such alternative access point shall open for business
and the planned location of each such alternative access point;</text>
</clause><clause id="H675EBFAAC6184ED1AC259B2EB7112BD4"><enum>(vi)</enum><text>how each facility closure conforms
with previously filed actions for suspension or closure;</text>
</clause><clause id="H5F7709C85221492791356D9C5049CE3F"><enum>(vii)</enum><text>the timeline for closure or
suspension activities described in paragraphs (1) and (3), and all other formal
closure or suspension activities planned in connection with the retail facility
closure;</text>
</clause><clause id="HE879BDB867CF479187B58DFECA517861"><enum>(viii)</enum><text>how work performed at mail
processing facilities recommended for closure or consolidation will be
transferred or absorbed by other facilities within the network;</text>
</clause><clause id="H72EDE33638C64ABFB4634C129167E760"><enum>(ix)</enum><text>cost savings expected or achieved
from consolidation of both retail and mail processing facilities;</text>
</clause><clause id="HB232BCD713A74FDB9A3EF941BAAC5BAC"><enum>(x)</enum><text>the impact of each planned closure on
postal employees, including relocation or reassignment plans; and</text>
</clause><clause id="H1E5A2833BE8A490394CA89D8A0836A23"><enum>(xi)</enum><text>the status of ongoing suspensions or
closures identified in previous
reports.</text>
</clause></subparagraph></paragraph><after-quoted-block>.
</after-quoted-block></quoted-block>
</section><enum>III</enum><header>Postal Service
Improvements and Regulatory Relief</header>
<section id="H1207E9E11EBA4757AB8EDB8E06D015F0"><enum>301.</enum><header>Permit appeal
rights for closing of postal stations and branches</header><text display-inline="no-display-inline">Section
404(d) is amended by adding after paragraph (7) (as added by section 206) the
following:</text>
<quoted-block display-inline="no-display-inline" id="HA26978989DA84BB9A20315E8A5060A3A" style="USC">
<paragraph id="H8CB1ED5D5B664629889113826D486360" indent="up1"><enum>(8)</enum><text display-inline="yes-display-inline">The provisions of paragraphs (1) through

</subsection><subsection commented="no" id="HB5336F2E46E84C599F8E45BA918C5C9A"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H85FF7558A45A474B9E630B9CCACCFBFB"><enum>(1)</enum><text>Subchapter III of
chapter 36 is amended by adding at the end the following:</text>

<section commented="no" id="H7CFC59C4E8704270BEF86BE94FFA638B"><enum>3643.</enum><header>New classes of
mail</header>
<subsection commented="no" id="H7C2BE6976A104DDBB59A94A6768E57BE"><enum>(a)</enum><header>In
general</header><text>Upon request of the Postal Service or users of the mails,
or upon its own initiative, the Postal Regulatory Commission may change the
classes of mail to which the annual limitation under section 3622(d)(1) applies
by adding new classes of mail. The Postal Regulatory Commission shall, within
18 months after the date of enactment of this section, promulgate (and may from
time to time thereafter revise) regulations to carry out this section.</text>
</subsection><subsection commented="no" id="H91E721674FA54ED19771AB297F496EEE"><enum>(b)</enum><header>Criteria</header><text>All
determinations by the Postal Regulatory Commission under subsection (a) shall
be made in accordance with the following criteria:</text>
<paragraph commented="no" id="H1099588AD20145C38A92CC01B6AAF2BB"><enum>(1)</enum><header>New
market</header><text>Dominant classes of mail shall consist of products in the
sale of which the Postal Service exercises sufficient market power that it can
effectively set the price of such product substantially above costs, raise
prices significantly, decrease quality, or decrease output, without risk of
losing a significant level of business to other firms offering similar
products.</text>
</paragraph><paragraph commented="no" id="H8901EA9535884F27A02FD21C91C27E80"><enum>(2)</enum><header>Products covered
by postal monopoly</header><text>Any new classes of mail containing any
products covered by the postal monopoly shall be subject to the requirements of
section 3622(d)(1). For purposes of the preceding sentence, the term
<term>product covered by the postal monopoly</term> means any product the
conveyance or transmission of which is reserved to the United States under
section 1696 of title 18, subject to the same exception as set forth in the
last sentence of section 409(e)(1).</text>
</paragraph><paragraph commented="no" id="HB670A1A25CF0475A83149C68E05AA508"><enum>(3)</enum><header>Additional
considerations</header><text>In making any decision under this section, due
regard shall be given to—</text>
<subparagraph commented="no" id="HDA4EFE3AEAF041EEB26856D27C328F30"><enum>(A)</enum><text>the availability
and nature of enterprises in the private sector engaged in the delivery of the
product involved;</text>
</subparagraph><subparagraph commented="no" id="HE0E7D8BC4B774511A77FCE06B29B43F3"><enum>(B)</enum><text>the views of those
who use the product involved on the appropriateness of the proposed action;
and</text>
</subparagraph><subparagraph commented="no" id="H2D9412323DBE4A019B2C270CA267E4F3"><enum>(C)</enum><text>the likely impact
of the proposed action on small business concerns (within the meaning of
section 3641(h)).</text>
</subparagraph></paragraph></subsection><subsection commented="no" id="HBFD7C09D23E24CE29C21A9986DA69A78"><enum>(c)</enum><header>Notification and

<paragraph commented="no" id="H6A1E9D3DE70C4FA199AEEBD7E47B6382"><enum>(1)</enum><header>Notification
requirement</header><text>The Postal Service shall, whenever it requests to add
a new class of mail, file with the Postal Regulatory Commission and publish in
the Federal Register a notice setting out the basis for its determination that
the product satisfies the criteria under subsection (b). The provisions of
section 504(g) shall be available with respect to any information required to
be filed.</text>
</paragraph><paragraph commented="no" id="H246A32DE86484793871961904C9AB246"><enum>(2)</enum><header>Publication
requirement</header><text>The Postal Regulatory Commission shall, whenever it
changes the list of market-dominant classes of mail, prescribe new lists of
classes of mail. The revised lists shall indicate how and when any previous
lists are superseded, and shall be published in the Federal Register.</text>
</paragraph></subsection><subsection commented="no" id="HCDD6C50DDE8B48CD8C7AC6C24F8FED91"><enum>(d)</enum><header>Prohibition</header><text>Except
as provided in section 3641, a class of mail that involves the physical
delivery of letters, printed matter, or packages may be offered by the Postal
Service unless it has been assigned as a new class of mail—</text>
<paragraph commented="no" id="HA5CD056AB2FC4271AC3B0FCA3F556371"><enum>(1)</enum><text>under this
subchapter; or</text>
</paragraph><paragraph commented="no" id="H154F4BEAEA8C4006B7F3A49D1ED9D40A"><enum>(2)</enum><text>by or under any
other provision of
law.</text>

beginning of chapter 36 is amended by inserting after the item relating to

consideration of service changes by PRC</header><text display-inline="no-display-inline">Section 3661 is amended—</text>
<paragraph id="H39825F1EBDAC4D58A3666A9E158CC0EA"><enum>(1)</enum><text>by redesignating
subsection (c) as subsection (d); and</text>
</paragraph><paragraph id="HEAF4FFA9E1EC41D8B6A6C0F10A2C63A2"><enum>(2)</enum><text>by inserting after
subsection (b) the following:</text>

<subsection commented="no" id="H2259EC6C10EB4F0C81C6CB4AE44D80BA"><enum>(c)</enum><text>If the Postal
Service seeks expedited processing for time-sensitive advisory opinions, it
shall state such request in its proposal filed under subsection (b) and the
Commission, to the extent practical and in accordance with subsection (d),
shall comply with the request for expedited
consideration.</text>
