		<official-title>To amend the Horse Protection Act to prohibit the
		  shipping, transporting, moving, delivering, receiving, possessing, purchasing,
		  selling, or donation of horses and other equines to be slaughtered for human
		  consumption, and for other purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="HE5AEFACA787746F9AC6A6EF20F320C6A" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>American Horse Slaughter Prevention
			 Act of 2011</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H84F1978D50024E758043811D813D27EF" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Prohibition on shipping, transporting,
			 moving, delivering, receiving, possessing, purchasing, selling, or donation of
			 horses and other equines for slaughter for human consumption</header>
			<subsection commented="no" display-inline="no-display-inline" id="H08704B7B1DED41A58A3C79033C2F0694"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">Section 2 of the Horse Protection Act (15
			 U.S.C. 1821) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H80ED4EFEDF95424C8112839FF4550BA0"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1), (2), (3),
			 and (4) as paragraphs (2), (3), (5), and (6), respectively;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE22381A45D9F4240B7CAB2533A2C67BA"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting before paragraph (2) (as
			 redesignated by paragraph (1)) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HBA9EA75F6C7446B0AB78982883352189" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="H22CC6DD56614480592A812DDBAB0FD77"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>human consumption</quote>
				means ingestion by people as a source of
				food.</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H79C6F5D198DD4C0E8EBD00C6C954874A"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (3) (as
			 redesignated by paragraph (1)) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H74F1218966B2477496E4B365099F56A4" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="H9A979427F9D14871B5ECA9BE20B37096"><enum>(4)</enum><text display-inline="yes-display-inline">The term <quote>slaughter</quote> means the
				killing of 1 or more horses or other equines with the intent to sell or trade
				the flesh for human
				consumption.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA4318392DFF04DA3BE12D676BF98AFA0"><enum>(b)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Section 3 of the Horse Protection Act (15
			 U.S.C. 1822) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H030DE797B0944D978EE1025648A10002"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) through (5)
			 as paragraphs (6) through (10), respectively;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H731F802B5BCA4C41894452EA60A4F50E"><enum>(2)</enum><text display-inline="yes-display-inline">by adding before paragraph (6) (as
			 redesignated by paragraph (1)) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H21D3D060AED243E088914DDE6968DFDD" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="H418296739C8F4383BCE25E18AE10D6B0"><enum>(1)</enum><text display-inline="yes-display-inline">horses and other equines play a vital role
				in the collective experience of the United States and deserve protection and
				compassion;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3DD988065C744DFE9DD4BF0751D73D65"><enum>(2)</enum><text display-inline="yes-display-inline">horses and other equines are domestic
				animals that are used primarily for recreation, pleasure, and sport;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H25FFB70BB3724B1095D47737CB82F8ED"><enum>(3)</enum><text display-inline="yes-display-inline">unlike cows, pigs, and many other animals,
				horses and other equines are not raised for the purpose of being slaughtered
				for human consumption;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC306E7DFCABD472888487F9FF3861222"><enum>(4)</enum><text display-inline="yes-display-inline">individuals selling horses or other equines
				at auctions are seldom aware that the animals may be bought for the purpose of
				being slaughtered for human consumption;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HADE28D6B6A3A4B088B77D35CA5DA3725"><enum>(5)</enum><text display-inline="yes-display-inline">the Animal and Plant Health Inspection
				Service of the Department of Agriculture has found that horses and other
				equines cannot be safely and humanely transported in double deck
				trailers;</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8BEAC3C084B240C58C8B4E9E698A2A54"><enum>(3)</enum><text display-inline="yes-display-inline">by striking paragraph (8) (as redesignated
			 by paragraph (1)) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H8BEE0491FEE34C5BAAC36343F794E80E" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="HDA929A040FAF4D54BEF4B7F3818B6BBD"><enum>(8)</enum><text display-inline="yes-display-inline">the movement, showing, exhibition, or sale
				of sore horses in intrastate commerce, and the shipping, transporting, moving,
				delivering, receiving, possessing, purchasing, selling, or donation in
				intrastate commerce of horses and other equines to be slaughtered for human
				consumption, adversely affect and burden interstate and foreign
				commerce;</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC076F56003C14D4197131E552F92D660"><enum>(c)</enum><header display-inline="yes-display-inline">Prohibition</header><text display-inline="yes-display-inline">Section 5 of the Horse Protection Act (15
			 U.S.C. 1824) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H8E9A8F9EFB514893AD072DACD569F285"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (8) through
			 (11) as paragraphs (9) through (12), respectively; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0BD9F02AD7FB4A81BAF4E1CBE4BC2F58"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph 7 the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="HC0259C5008B64FF2A54AFF9C8D320ADA" style="traditional">
						<paragraph commented="no" display-inline="no-display-inline" id="HFA49F8DEDDFE49A294AAC1E7C8DABBE2"><enum>(8)</enum><text display-inline="yes-display-inline">The shipping, transporting, moving,
				delivering, receiving, possessing, purchasing, selling, or donation of any
				horse or other equine to be slaughtered for human
				consumption.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H45BD587E8E054810A13E4F90DB6A9EF6"><enum>(d)</enum><header display-inline="yes-display-inline">Authority To detain</header><text display-inline="yes-display-inline">Section 6(e) of the Horse Protection Act
			 (15 U.S.C. 1825(e)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H700DAEC6731D4D4B9BC492597A694CD9"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the first sentence of paragraph
			 (1);</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA0B9A95BA5204CE1BE28D35DA8C609CF"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) and (2) and
			 as paragraphs (2) and (3), respectively; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5A924800579A4FEB807051637E3F0D88"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting before paragraph (2) (as
			 redesignated by paragraph (2)) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HB91182CF1700498BBEAC1A94DA10320C" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="H0028EC86429A441BA5681C5504E26AEC" indent="up1"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary may detain for examination,
				testing, or the taking of evidence—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="H9817AACC5FE0435A827F1FD010240EB7"><enum>(A)</enum><text display-inline="yes-display-inline">any horse at any horse show, horse
				exhibition, or horse sale or auction that is sore or that the Secretary has
				probable cause to believe is sore; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAF209C22D6844FF69C4567BCC791C546"><enum>(B)</enum><text display-inline="yes-display-inline">any horse or other equine that the
				Secretary has probable cause to believe is being shipped, transported, moved,
				delivered, received, possessed, purchased, sold, or donated in violation of
				section
				5(8).</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H5D9DAAC527F54A7092CFD0F480873F99"><enum>(e)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">Section 12 of
			 the Horse Protection Act (15 U.S.C. 1831) is amended by striking
			 <quote>$500,000</quote> and inserting <quote>$5,000,000</quote>.</text>
