		<official-title>To amend title 39, United States Code, to provide for
		  additional criteria for the United States Postal Service to consider with
		  respect to closing or consolidating a post office, and for other
		  purposes.</official-title>

		<section id="H6232E8F993BE4E79BB5A227B33CE341B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fair and Equitable Postal Service Access
			 Act</short-title></quote>.</text>
		</section><section id="H9A95380A9E804ED2B569DA2620AC1940"><enum>2.</enum><header>Amendments to
			 Post Office closure or consolidation procedures</header>
			<subsection id="H5B2D85E2AD124B04867CAD21DD597968"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 404(d) of
			 title 39, United States Code, is amended—</text>
				<paragraph id="H29E91490188C46C69CDDC23D7D04B822"><enum>(1)</enum><text>in paragraph
			 (2)(A)(i), by inserting before the semicolon the following: <quote>, including
			 whether such closing or consolidation will decrease access to postal or
			 nonpostal service offered at such post office in such community with respect to
			 elderly individuals, economically disadvantaged individuals, individuals with
			 limited mobility, or individuals without reliable and affordable access to the
			 Internet</quote>;</text>
				</paragraph><paragraph id="HF8C561CD816648E7A5AA3091DECCF9CF"><enum>(2)</enum><text>in paragraph
			 (2)(A)(v), by inserting before the semicolon the following: <quote>, including,
			 during the previous 5 years: the number of, and revenue derived from,
			 money-order transactions processed by such post office; the volume of
			 international mail processed by such post office; and the number of customers
			 served at such post office </quote>;</text>
				</paragraph><paragraph id="HC5233DCCE4E142D49C300FDC8E62A01F"><enum>(3)</enum><text>by striking
			 paragraph (3) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H4157686414DD4D14B03C925C76FA18F3" style="USC">
						<paragraph id="H19CAC1E9319B48748902F7D3B736757F" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HFF047D32D42D4366A8B70A06BE14B60A"><enum>(A)</enum><text>Any determination of the
				Postal Service to close or consolidate a post office shall be in writing and
				shall include the findings of the Postal Service with respect to the
				considerations required to be made under paragraph (2). Such determination and
				findings shall be made available to individuals served by such post
				office.</text>
							</subparagraph><subparagraph id="H3A35C553DAF44538ADFC7F9D53A1EE99" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">With respect to the closing or
				consolidation of a post office located in a community where individuals listed
				in paragraph (2)(A)(i) reside, the analysis required under paragraph (2) shall
				include an assessment of the effect such closing or consolidation will have on
				such individuals.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H1862C995A55946A18903AA2F44FB8B80"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H9398A161322F4DD7902D774B86C90791" style="USC">
						<paragraph id="H242608AA6A664219B5D00F84B4198CEF" indent="up1"><enum>(7)</enum><text display-inline="yes-display-inline">The Postal Service shall not close or
				consolidate a post office if such closing or consolidation would result in a
				disproportionate, unreasonable, or undue burden on a class of individuals
				listed in paragraph (2)(A)(i).</text>
						</paragraph><paragraph id="H2362604FD5C64FEFB4B164761A3CB43A" indent="up1"><enum>(8)</enum><text>For purposes of this
				subsection—</text>
							<subparagraph id="H1FB819CEDC264B49B7D5F51C177DFA0F"><enum>(A)</enum><text display-inline="yes-display-inline">an
				individual is <quote>economically disadvantaged</quote> if, with respect to the
				community in which such individual lives, at least 60 percent of the households
				have children who are eligible for free or reduced price lunches under the
				school lunch program under the Richard B. Russell National School Lunch Act (42
				U.S.C. 1751 et seq.);</text>
							</subparagraph><subparagraph id="H463C85349E6549E682260201E775C8CB"><enum>(B)</enum><text display-inline="yes-display-inline">the term <quote>elderly</quote>, used with
				respect to an individual, means age 65 or older;</text>
							</subparagraph><subparagraph id="HCA3ABA703AC94C24B865D6755852130C"><enum>(C)</enum><text>the term <quote>post office</quote>
				includes a branch post office and a post office station;</text>
							</subparagraph><subparagraph id="H634E80F23DA64DA19D49917E84C0A9E2"><enum>(D)</enum><text display-inline="yes-display-inline">whether an individual has limited mobility
				shall be determined by, with respect to the community in which such individual
				lives—</text>
								<clause id="H283CFD9B12A849B29BF077B1E7896D45"><enum>(i)</enum><text>how accessible public
				transportation is, as measured by the availability of public transportation
				options in the community; the frequency of service on such options; and the
				time and distance required to access such options as a pedestrian; and</text>
								</clause><clause id="H26049A0030E344399D9D33697CAED81D"><enum>(ii)</enum><text display-inline="yes-display-inline">the rate of highway motor vehicle
				ownership, as measured by, in the most recent American Community Survey
				published by the Bureau of the Census, the difference between the number of
				individuals in such community that own or lease a highway motor vehicle and the
				statewide average of individuals who own or lease such a vehicle;</text>
								</clause></subparagraph><subparagraph id="H4CCE03EAA58349C380ACEA2DD8208F87"><enum>(E)</enum><text>in order to determine whether an
				individual has reliable and affordable access to the Internet, the Postal
				Service shall use the Internet Use Supplement in the most recent Current
				Population Survey published by the Bureau of the Census; and</text>
							</subparagraph><subparagraph id="H40BEEFE3C24F4E7B850CFA81F40AA20E"><enum>(F)</enum><text>in order to determine the statistical
				data required under this subsection with respect to a class of individuals
				listed in paragraph (2)(A)(i), the Postal Service may use any available data
				from local or State governments or the Federal
				Government.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" id="H99BC00FB3D074D47903C2B80BBAF1F71"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply with respect
			 to any post office—</text>
				<paragraph commented="no" id="HAE64A04004CE42B1B9D3C5CE33D7EF0F"><enum>(1)</enum><text>that has been
			 determined to be necessary for closing or consolidation under section 404(d) of
			 title 39, United States Code; or</text>
				</paragraph><paragraph commented="no" id="HDCEB448A71684E41A35240AD45B7A252"><enum>(2)</enum><text>that is included
			 in a proposal—</text>
					<subparagraph commented="no" id="HF321E4285F8D45A29DA350D884B460FB"><enum>(A)</enum><text>to change the
			 nature of postal services on a nationwide or substantially nationwide basis;
			 and</text>
					</subparagraph><subparagraph commented="no" id="HB344372EA1D647B18E2C38DADEACB7B3"><enum>(B)</enum><text>for which the
			 Postal Service has requested an advisory opinion from the Postal Regulatory
			 Commission pursuant to section 3661(b) of such title.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
