<enum>I</enum><header>Extension of Surface Transportation Programs</header> <section id="HD02D8CF1962E4CBDACDEDBF2BD3A5562"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Surface Transportation Extension Act of 2011, Part II</quote>.</text> </section> <subtitle id="HB88F116B834C47B3A57B97F8A62E8F46"><enum>A</enum><header>Federal-Aid Highways</header> <section display-inline="no-display-inline" id="H661B7739F5464FB79B1EC310C22D1572"><enum>111.</enum><header>Extension of Federal-aid highway programs</header> <subsection id="H7EE84ED93FD647BDA969BCE7B43887D8"><enum>(a)</enum><header>In general</header><text>Except as provided in this title, requirements, authorities, conditions, eligibilities, limitations, and other provisions authorized under titles I, V, and VI of SAFETEA–LU (Public Law 109–59), the SAFETEA–LU Technical Corrections Act of 2008 (Public Law 110–244), titles I and VI of the Intermodal Surface Transportation Act of 1991 (Public Law 102–240), titles I and V of the Transportation Equity Act for the 21st Century (Public Law 105–178), and title 23, United States Code (excluding chapter 4 of that title), which would otherwise expire on or cease to apply after September 30, 2011, under section 411(a) of the Surface Transportation Extension Act of 2010 (title IV of Public Law 111–147) are incorporated by reference and shall continue in effect until March 31, 2012.</text> </subsection> <subsection id="H8996BE8A087141E9996EDF3C02BD75EA"><enum>(b)</enum><header>Authorization of appropriations</header><text>Except as provided in <internal-xref idref="HF7B10CEB50D146DC9893CDCBD5D207B6" legis-path="3.">section 112</internal-xref>, there is authorized to be appropriated out of the Highway Trust Fund (other than the Mass Transit Account) for the period beginning on October 1, 2011, and ending on March 31, 2012, a sum equal to <fraction>½</fraction> of the total amount authorized to be appropriated out of the Highway Trust Fund for programs, projects, and activities for fiscal year 2011 under titles I, V, and VI of SAFETEA–LU (119 Stat. 1144) and title 23, United States Code (excluding chapter 4 of that title).</text> </subsection> <subsection id="HA6F926968600474C91DC6E3B4B349A99"><enum>(c)</enum><header>Use of funds</header> <paragraph id="H3739FDD59B314CC3A68030866D5849EF"><enum>(1)</enum><header>Fiscal year 2012</header><text>Except as otherwise expressly provided in this title, funds authorized to be appropriated under subsection (b) for the period beginning on October 1, 2011, and ending on March 31, 2012, shall be distributed, administered, limited, and made available for obligation in the same manner and at the same level as <fraction>½</fraction> of the total amount of funds authorized to be appropriated out of the Highway Trust Fund for fiscal year 2011 to carry out programs, projects, activities, eligibilities, and requirements under SAFETEA–LU (Public Law 109–59), the SAFETEA–LU Technical Corrections Act of 2008 (Public Law 110–244), titles I and VI of the Intermodal Surface Transportation Act of 1991 (Public Law 102–240), titles I and V of the Transportation Equity Act for the 21st Century (Public Law 105–178), and title 23, United States Code (excluding chapter 4 of that title).</text> </paragraph> <paragraph id="H5B2F97CEE8534CD5B1D472AA2B3B9726"><enum>(2)</enum><header>Calculation</header><text display-inline="yes-display-inline">The amounts authorized to be appropriated under subsection (b) shall be calculated taking into account any rescission or cancellation of funds or contract authority for fiscal year 2011 required by the Department of Defense and Full-Year Continuing Appropriations Act, 2011 (Public Law 112–10) or any other law.</text> </paragraph> <paragraph id="H1DFB675DDB084665AC6556B239FCBA44"><enum>(3)</enum><header>Contract authority</header> <subparagraph id="H3268248186D244FDB4839836BB7FB5FF"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), funds authorized to be appropriated under this section shall be available for obligation and shall be administered in the same manner as if such funds were apportioned under chapter 1 of title 23, United States Code, and for the period beginning on October 1, 2011, and ending on March 31, 2012, shall be subject to a limitation on obligations for Federal-aid highways and highway safety construction programs included in an Act making appropriations for fiscal year 2012 or a portion of that fiscal year, except that during such period obligations subject to such limitation shall not exceed <fraction>½</fraction> of the limitation on obligations included in an Act making appropriations for fiscal year 2012.</text> </subparagraph> <subparagraph id="H0D3847108A744827905D324ED75BC33F"><enum>(B)</enum><header>Exceptions</header><text>A limitation on obligations described in subparagraph (A) shall not apply to any obligation under—</text> <clause id="H871BAACDDACA4F1FA07BCD1AE89C130C"><enum>(i)</enum><text>section 125 of title 23, United States Code; or</text> </clause> <clause id="HD6F5DD1ADA3843B9BB9A6A655AF3DDED"><enum>(ii)</enum><text>section 105 of title 23, United States Code, for the period beginning on October 1, 2011, and ending on March 31, 2012, only in an amount equal to $319,500,000.</text> </clause></subparagraph></paragraph> <paragraph id="H1A173DD4419E480E9A432C357B983DAE"><enum>(4)</enum><header>Calculations for distribution of obligation limitation</header><text>Upon enactment of an Act making appropriations for the Department of Transportation for fiscal year 2012 (other than an Act or resolution making continuing appropriations), the Secretary shall—</text> <subparagraph id="HA9F73CA6A5AA45FF87DD7E30AF77E946"><enum>(A)</enum><text>as necessary for purposes of making the calculations for the distribution of any obligation limitation under such Act, annualize the amount of contract authority provided under this title for the period beginning on October 1, 2011, and ending on March 31, 2012, for Federal-aid highways and highway safety construction programs; and</text> </subparagraph> <subparagraph id="H466902AEF80D4EA9943B549C300F8ACE"><enum>(B)</enum><text>multiply the resulting distribution of any obligation limitation under such Act by <fraction>½</fraction>.</text> </subparagraph></paragraph></subsection> <subsection id="HB89A4DD05D5D4B828D9146638F84530C"><enum>(d)</enum><header>Extension and flexibility for certain allocated programs</header> <paragraph id="H3053AF0FF4164E4CB02E39196D479357"><enum>(1)</enum><header>Fiscal year 2012</header><text>Notwithstanding any other provision of law, for the period beginning on October 1, 2011, and ending on March 31, 2012, the portion of the share of funds of a State under subsection (b) determined by <fraction>½</fraction> of the amount that the State received or was authorized to receive for fiscal year 2011 to carry out sections 1301, 1302, 1307, 1702, and 1934 of SAFETEA–LU (119 Stat. 1198, 1204, 1217, 1256, and 1485) and section 144(f)(1) of title 23, United States Code, shall be—</text> <subparagraph id="H5D42168078D04C2D8C9F50B4CBA8515D"><enum>(A)</enum><text>made available to the State for programs apportioned under sections 104(b) and 144 of title 23, United States Code, and in the same proportion for each such program that—</text> <clause id="H892A9C0FEE9540C9AAAD438DCED2F999"><enum>(i)</enum><text>the amount apportioned to the State for that program for fiscal year 2011; bears to</text> </clause> <clause id="HCCBEF90A7BCC4F939BB45F38300AC8A8"><enum>(ii)</enum><text>the amount apportioned to the State for fiscal year 2011 for all programs apportioned under such sections of such Code; and</text> </clause></subparagraph> <subparagraph id="H02EF845D60CF4DCF88C7ECA079A5AB5C"><enum>(B)</enum><text>administered in the same manner and with the same period of availability as such funding is administered under programs identified in subparagraph (A), except that no funds may be used to carry out the project described in section 1307(d)(1) of SAFETEA–LU (119 Stat. 1217; 122 Stat. 1577).</text> </subparagraph></paragraph> <paragraph id="HCBB390DE660B4BE8A821658A14C03C46"><enum>(2)</enum><header>Territories and Puerto Rico</header> <subparagraph id="HF579EA0DE2D349E0A8D1D6A87B09A06D"><enum>(A)</enum><header>Fiscal year 2012</header><text>Notwithstanding any other provision of law, for the period beginning on October 1, 2011, and ending on March 31, 2012, the portion of the share of funds of a territory or Puerto Rico under subsection (b) determined by <fraction>½</fraction> of the amount that the territory or Puerto Rico received or was authorized to receive for fiscal year 2011 to carry out section 1934 of SAFETEA–LU (119 Stat. 1485), shall be—</text> <clause id="HB62FA7A831974A35B2154DE268CC0FA5"><enum>(i)</enum><text>for a territory, made available and administered in the same manner as funding is made available and administered under section 215 of title 23, United States Code; and</text> </clause> <clause id="HEF505E1804104D5BB9AC4FC7E613D663"><enum>(ii)</enum><text>for Puerto Rico, made available and administered in the same manner as funding is made available and administered under section 165 of title 23, United States Code.</text> </clause></subparagraph> <subparagraph id="H939BD8AA82D148CEA768C9284919544A"><enum>(B)</enum><header>Territory defined</header><text>In this paragraph, the term <quote>territory</quote> means any of the following territories of the United States: American Samoa, the Commonwealth of the Northern Mariana Islands, Guam, or the United States Virgin Islands.</text> </subparagraph></paragraph> <paragraph commented="no" id="H89D184EA0CE04AC5AFA3179531A2844F"><enum>(3)</enum><header>Additional funds</header> <subparagraph commented="no" id="H291E3E9FF22D4F21BC9B7F127AF29C4F"><enum>(A)</enum><header>In general</header><text>No additional funds shall be provided for any project or activity under subsection (c), or paragraph (1) of this subsection, that the Secretary of Transportation determines was sufficiently funded before or during fiscal year 2011 to achieve the authorized purpose of the project or activity.</text> </subparagraph> <subparagraph commented="no" id="HAA18A32D36A14BFD8EB4B393F15B7154"><enum>(B)</enum><header>Reservation and redistribution of funds</header><text>Funds made available in accordance with paragraph (1) of subsection (c) or paragraph (1) of this subsection for a project or activity described in subparagraph (A) shall be—</text> <clause commented="no" id="H8B42FD6C54354B61BAA8BE75020CB06B"><enum>(i)</enum><text>reserved by the Secretary of Transportation; and</text> </clause> <clause commented="no" id="H475C012DC61A40DAA9D6B072707304A4"><enum>(ii)</enum><text>distributed to each State in accordance with paragraph (1) of subsection (c), or paragraph (1) of this subsection, as appropriate, for use in carrying out other highway projects and activities extended by subsection (c) or this subsection, in the proportion that—</text> <subclause commented="no" id="H59371CAF200746FFB42B57E441A26B31"><enum>(I)</enum><text>the total amount of funds made available for fiscal year 2011 for projects and activities described in subparagraph (A) in the State; bears to</text> </subclause> <subclause commented="no" id="H1B01A36995BB4817827F0716DA1D2074"><enum>(II)</enum><text>the total amount of funds made available for fiscal year 2011 for those projects and activities in all States.</text> </subclause></clause></subparagraph></paragraph></subsection> <subsection id="H952B7792B17B4F5A894B78E11319FBF4"><enum>(e)</enum><header>Extension of authorizations under title V of SAFETEA–LU</header> <paragraph id="H710C496700D34C5FA3833EB11FB8E27A"><enum>(1)</enum><header>In general</header><text>The programs authorized under paragraphs (1) through (5) of section 5101(a) of SAFETEA–LU (119 Stat. 1779) shall be continued for the period beginning on October 1, 2011, and ending on March 31, 2012, at <fraction>½</fraction> of the funding levels authorized for those programs for fiscal year 2011.</text> </paragraph> <paragraph id="HB0CE93AFE90D4E3ABA6062638C6486F9"><enum>(2)</enum><header>Distribution of funds</header><text>Funds for programs continued under paragraph (1) shall be distributed to major program areas under those programs in the same proportions as funds were allocated for those program areas for fiscal year 2011, except that designations for specific activities shall not be required to be continued for the period beginning on October 1, 2011, and ending on March 31, 2012.</text> </paragraph> <paragraph commented="no" id="H0B4129EBD87C41FDA5F7D760A4998046"><enum>(3)</enum><header>Additional funds</header> <subparagraph commented="no" id="H3B2EECBDF9C94E6D80629933ACDEA305"><enum>(A)</enum><header>In general</header><text>No additional funds shall be provided for any project or activity under this subsection that the Secretary of Transportation determines was sufficiently funded before or during fiscal year 2011 to achieve the authorized purpose of the project or activity.</text> </subparagraph> <subparagraph commented="no" id="HC7CECF3B3D804A0DBB7BFC1CD7E47F78"><enum>(B)</enum><header>Distribution</header><text>Funds that would have been made available under paragraph (1) for a project or activity but for the prohibition under subparagraph (A) shall be distributed in accordance with paragraph (2).</text> </subparagraph></paragraph></subsection></section> <section display-inline="no-display-inline" id="HFA164F0D9ADB413CA8ED81F6A58EA2FB" section-type="subsequent-section"><enum>112.</enum><header>Administrative expenses</header> <subsection id="HD5325613CA66489DA3ED412882FBD838"><enum>(a)</enum><header>Authorization of contract authority</header><text>Notwithstanding any other provision of this title or any other law, there is authorized to be appropriated from the Highway Trust Fund (other than the Mass Transit Account), from amounts provided under <internal-xref idref="HF7B10CEB50D146DC9893CDCBD5D207B6" legis-path="2.">section 111</internal-xref>, for administrative expenses of the Federal-aid highway program $196,427,625 for the period beginning on October 1, 2011, and ending on March 31, 2012.</text> </subsection> <subsection id="H14CA882C4BF24F91A9CE1B0FAC53391A"><enum>(b)</enum><header>Contract authority</header><text>Funds authorized to be appropriated by this section shall be—</text> <paragraph id="H039E7AD0D6E645608B3C311ECB6C39A7"><enum>(1)</enum><text>available for obligation, and shall be administered, in the same manner as if such funds were apportioned under chapter 1 of title 23, United States Code; and</text> </paragraph> <paragraph id="H13B75C72DE764AB68BED84BDA2DDB5DF"><enum>(2)</enum><text>subject to a limitation on obligations for Federal-aid highways and highway safety construction programs, except that such funds shall remain available until expended.</text> </paragraph></subsection></section></subtitle> <subtitle id="H803708218E30442480916F5B1E9E03F8"><enum>B</enum><header>Extension of Highway Safety Programs</header> <section id="H6569470E29D34F64A08E912850E16168"><enum>121.</enum><header>Extension of National Highway Traffic Safety Administration highway safety programs</header> <subsection id="H135C68534094429FA446A76BE8708C79"><enum>(a)</enum><header>Chapter 4 highway safety programs</header><text>Section 2001(a)(1) of SAFETEA–LU (119 Stat. 1519) is amended by striking <quote>and $235,000,000 for fiscal year 2011.</quote> and inserting <quote>$235,000,000 for fiscal year 2011, and $117,500,000 for the period beginning on October 1, 2011, and ending on March 31, 2012.</quote>.</text> </subsection> <subsection id="H0DEDA31526D64C9B90FCB26ABEE3EBF9"><enum>(b)</enum><header>Highway safety research and development</header><text>Section 2001(a)(2) of SAFETEA–LU (119 Stat. 1519) is amended by striking <quote>and $108,244,000 for fiscal year 2011.</quote> and inserting <quote>$108,244,000 for fiscal year 2011, and $54,122,000 for the period beginning on October 1, 2011, and ending on March 31, 2012.</quote>.</text> </subsection> <subsection id="H0149F42FE7794CEC935460F013BF1F7E"><enum>(c)</enum><header>Occupant protection incentive grants</header> <paragraph id="HCDFA57C5563B4F30AFFC3830DCFB4503"><enum>(1)</enum><header>Extension of program</header><text display-inline="yes-display-inline">Section 405(a) of title 23, United States Code, is amended—</text> <enum>I</enum><header>Extension of Surface Transportation Programs</header> <section id="HD02D8CF1962E4CBDACDEDBF2BD3A5562"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Surface Transportation Extension Act of 2011, Part II</quote>.</text> </section> <subtitle id="HB88F116B834C47B3A57B97F8A62E8F46"><enum>A</enum><header>Federal-Aid Highways</header> <section display-inline="no-display-inline" id="H661B7739F5464FB79B1EC310C22D1572"><enum>111.</enum><header>Extension of Federal-aid highway programs</header> <subsection id="H7EE84ED93FD647BDA969BCE7B43887D8"><enum>(a)</enum><header>In general</header><text>Except as provided in this title, requirements, authorities, conditions, eligibilities, limitations, and other provisions authorized under titles I, V, and VI of SAFETEA–LU (Public Law 109–59), the SAFETEA–LU Technical Corrections Act of 2008 (Public Law 110–244), titles I and VI of the Intermodal Surface Transportation Act of 1991 (Public Law 102–240), titles I and V of the Transportation Equity Act for the 21st Century (Public Law 105–178), and title 23, United States Code (excluding chapter 4 of that title), which would otherwise expire on or cease to apply after September 30, 2011, under section 411(a) of the Surface Transportation Extension Act of 2010 (title IV of Public Law 111–147) are incorporated by reference and shall continue in effect until March 31, 2012.</text> </subsection> <subsection id="H8996BE8A087141E9996EDF3C02BD75EA"><enum>(b)</enum><header>Authorization of appropriations</header><text>Except as provided in <internal-xref idref="HF7B10CEB50D146DC9893CDCBD5D207B6" legis-path="3.">section 112</internal-xref>, there is authorized to be appropriated out of the Highway Trust Fund (other than the Mass Transit Account) for the period beginning on October 1, 2011, and ending on March 31, 2012, a sum equal to <fraction>½</fraction> of the total amount authorized to be appropriated out of the Highway Trust Fund for programs, projects, and activities for fiscal year 2011 under titles I, V, and VI of SAFETEA–LU (119 Stat. 1144) and title 23, United States Code (excluding chapter 4 of that title).</text> </subsection> <subsection id="HA6F926968600474C91DC6E3B4B349A99"><enum>(c)</enum><header>Use of funds</header> <paragraph id="H3739FDD59B314CC3A68030866D5849EF"><enum>(1)</enum><header>Fiscal year 2012</header><text>Except as otherwise expressly provided in this title, funds authorized to be appropriated under subsection (b) for the period beginning on October 1, 2011, and ending on March 31, 2012, shall be distributed, administered, limited, and made available for obligation in the same manner and at the same level as <fraction>½</fraction> of the total amount of funds authorized to be appropriated out of the Highway Trust Fund for fiscal year 2011 to carry out programs, projects, activities, eligibilities, and requirements under SAFETEA–LU (Public Law 109–59), the SAFETEA–LU Technical Corrections Act of 2008 (Public Law 110–244), titles I and VI of the Intermodal Surface Transportation Act of 1991 (Public Law 102–240), titles I and V of the Transportation Equity Act for the 21st Century (Public Law 105–178), and title 23, United States Code (excluding chapter 4 of that title).</text> </paragraph> <paragraph id="H5B2F97CEE8534CD5B1D472AA2B3B9726"><enum>(2)</enum><header>Calculation</header><text display-inline="yes-display-inline">The amounts authorized to be appropriated under subsection (b) shall be calculated taking into account any rescission or cancellation of funds or contract authority for fiscal year 2011 required by the Department of Defense and Full-Year Continuing Appropriations Act, 2011 (Public Law 112–10) or any other law.</text> </paragraph> <paragraph id="H1DFB675DDB084665AC6556B239FCBA44"><enum>(3)</enum><header>Contract authority</header> <subparagraph id="H3268248186D244FDB4839836BB7FB5FF"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), funds authorized to be appropriated under this section shall be available for obligation and shall be administered in the same manner as if such funds were apportioned under chapter 1 of title 23, United States Code, and for the period beginning on October 1, 2011, and ending on March 31, 2012, shall be subject to a limitation on obligations for Federal-aid highways and highway safety construction programs included in an Act making appropriations for fiscal year 2012 or a portion of that fiscal year, except that during such period obligations subject to such limitation shall not exceed <fraction>½</fraction> of the limitation on obligations included in an Act making appropriations for fiscal year 2012.</text> </subparagraph> <subparagraph id="H0D3847108A744827905D324ED75BC33F"><enum>(B)</enum><header>Exceptions</header><text>A limitation on obligations described in subparagraph (A) shall not apply to any obligation under—</text> <clause id="H871BAACDDACA4F1FA07BCD1AE89C130C"><enum>(i)</enum><text>section 125 of title 23, United States Code; or</text> </clause> <clause id="HD6F5DD1ADA3843B9BB9A6A655AF3DDED"><enum>(ii)</enum><text>section 105 of title 23, United States Code, for the period beginning on October 1, 2011, and ending on March 31, 2012, only in an amount equal to $319,500,000.</text> </clause></subparagraph></paragraph> <paragraph id="H1A173DD4419E480E9A432C357B983DAE"><enum>(4)</enum><header>Calculations for distribution of obligation limitation</header><text>Upon enactment of an Act making appropriations for the Department of Transportation for fiscal year 2012 (other than an Act or resolution making continuing appropriations), the Secretary shall—</text> <subparagraph id="HA9F73CA6A5AA45FF87DD7E30AF77E946"><enum>(A)</enum><text>as necessary for purposes of making the calculations for the distribution of any obligation limitation under such Act, annualize the amount of contract authority provided under this title for the period beginning on October 1, 2011, and ending on March 31, 2012, for Federal-aid highways and highway safety construction programs; and</text> </subparagraph> <subparagraph id="H466902AEF80D4EA9943B549C300F8ACE"><enum>(B)</enum><text>multiply the resulting distribution of any obligation limitation under such Act by <fraction>½</fraction>.</text> </subparagraph></paragraph></subsection> <subsection id="HB89A4DD05D5D4B828D9146638F84530C"><enum>(d)</enum><header>Extension and flexibility for certain allocated programs</header> <paragraph id="H3053AF0FF4164E4CB02E39196D479357"><enum>(1)</enum><header>Fiscal year 2012</header><text>Notwithstanding any other provision of law, for the period beginning on October 1, 2011, and ending on March 31, 2012, the portion of the share of funds of a State under subsection (b) determined by <fraction>½</fraction> of the amount that the State received or was authorized to receive for fiscal year 2011 to carry out sections 1301, 1302, 1307, 1702, and 1934 of SAFETEA–LU (119 Stat. 1198, 1204, 1217, 1256, and 1485) and section 144(f)(1) of title 23, United States Code, shall be—</text> <subparagraph id="H5D42168078D04C2D8C9F50B4CBA8515D"><enum>(A)</enum><text>made available to the State for programs apportioned under sections 104(b) and 144 of title 23, United States Code, and in the same proportion for each such program that—</text> <clause id="H892A9C0FEE9540C9AAAD438DCED2F999"><enum>(i)</enum><text>the amount apportioned to the State for that program for fiscal year 2011; bears to</text> </clause> <clause id="HCCBEF90A7BCC4F939BB45F38300AC8A8"><enum>(ii)</enum><text>the amount apportioned to the State for fiscal year 2011 for all programs apportioned under such sections of such Code; and</text> </clause></subparagraph> <subparagraph id="H02EF845D60CF4DCF88C7ECA079A5AB5C"><enum>(B)</enum><text>administered in the same manner and with the same period of availability as such funding is administered under programs identified in subparagraph (A), except that no funds may be used to carry out the project described in section 1307(d)(1) of SAFETEA–LU (119 Stat. 1217; 122 Stat. 1577).</text> </subparagraph></paragraph> <paragraph id="HCBB390DE660B4BE8A821658A14C03C46"><enum>(2)</enum><header>Territories and Puerto Rico</header> <subparagraph id="HF579EA0DE2D349E0A8D1D6A87B09A06D"><enum>(A)</enum><header>Fiscal year 2012</header><text>Notwithstanding any other provision of law, for the period beginning on October 1, 2011, and ending on March 31, 2012, the portion of the share of funds of a territory or Puerto Rico under subsection (b) determined by <fraction>½</fraction> of the amount that the territory or Puerto Rico received or was authorized to receive for fiscal year 2011 to carry out section 1934 of SAFETEA–LU (119 Stat. 1485), shall be—</text> <clause id="HB62FA7A831974A35B2154DE268CC0FA5"><enum>(i)</enum><text>for a territory, made available and administered in the same manner as funding is made available and administered under section 215 of title 23, United States Code; and</text> </clause> <clause id="HEF505E1804104D5BB9AC4FC7E613D663"><enum>(ii)</enum><text>for Puerto Rico, made available and administered in the same manner as funding is made available and administered under section 165 of title 23, United States Code.</text> </clause></subparagraph> <subparagraph id="H939BD8AA82D148CEA768C9284919544A"><enum>(B)</enum><header>Territory defined</header><text>In this paragraph, the term <quote>territory</quote> means any of the following territories of the United States: American Samoa, the Commonwealth of the Northern Mariana Islands, Guam, or the United States Virgin Islands.</text> </subparagraph></paragraph> <paragraph commented="no" id="H89D184EA0CE04AC5AFA3179531A2844F"><enum>(3)</enum><header>Additional funds</header> <subparagraph commented="no" id="H291E3E9FF22D4F21BC9B7F127AF29C4F"><enum>(A)</enum><header>In general</header><text>No additional funds shall be provided for any project or activity under subsection (c), or paragraph (1) of this subsection, that the Secretary of Transportation determines was sufficiently funded before or during fiscal year 2011 to achieve the authorized purpose of the project or activity.</text> </subparagraph> <subparagraph commented="no" id="HAA18A32D36A14BFD8EB4B393F15B7154"><enum>(B)</enum><header>Reservation and redistribution of funds</header><text>Funds made available in accordance with paragraph (1) of subsection (c) or paragraph (1) of this subsection for a project or activity described in subparagraph (A) shall be—</text> <clause commented="no" id="H8B42FD6C54354B61BAA8BE75020CB06B"><enum>(i)</enum><text>reserved by the Secretary of Transportation; and</text> </clause> <clause commented="no" id="H475C012DC61A40DAA9D6B072707304A4"><enum>(ii)</enum><text>distributed to each State in accordance with paragraph (1) of subsection (c), or paragraph (1) of this subsection, as appropriate, for use in carrying out other highway projects and activities extended by subsection (c) or this subsection, in the proportion that—</text> <subclause commented="no" id="H59371CAF200746FFB42B57E441A26B31"><enum>(I)</enum><text>the total amount of funds made available for fiscal year 2011 for projects and activities described in subparagraph (A) in the State; bears to</text> </subclause> <subclause commented="no" id="H1B01A36995BB4817827F0716DA1D2074"><enum>(II)</enum><text>the total amount of funds made available for fiscal year 2011 for those projects and activities in all States.</text> </subclause></clause></subparagraph></paragraph></subsection> <subsection id="H952B7792B17B4F5A894B78E11319FBF4"><enum>(e)</enum><header>Extension of authorizations under title V of SAFETEA–LU</header> <paragraph id="H710C496700D34C5FA3833EB11FB8E27A"><enum>(1)</enum><header>In general</header><text>The programs authorized under paragraphs (1) through (5) of section 5101(a) of SAFETEA–LU (119 Stat. 1779) shall be continued for the period beginning on October 1, 2011, and ending on March 31, 2012, at <fraction>½</fraction> of the funding levels authorized for those programs for fiscal year 2011.</text> </paragraph> <paragraph id="HB0CE93AFE90D4E3ABA6062638C6486F9"><enum>(2)</enum><header>Distribution of funds</header><text>Funds for programs continued under paragraph (1) shall be distributed to major program areas under those programs in the same proportions as funds were allocated for those program areas for fiscal year 2011, except that designations for specific activities shall not be required to be continued for the period beginning on October 1, 2011, and ending on March 31, 2012.</text> </paragraph> <paragraph commented="no" id="H0B4129EBD87C41FDA5F7D760A4998046"><enum>(3)</enum><header>Additional funds</header> <subparagraph commented="no" id="H3B2EECBDF9C94E6D80629933ACDEA305"><enum>(A)</enum><header>In general</header><text>No additional funds shall be provided for any project or activity under this subsection that the Secretary of Transportation determines was sufficiently funded before or during fiscal year 2011 to achieve the authorized purpose of the project or activity.</text> </subparagraph> <subparagraph commented="no" id="HC7CECF3B3D804A0DBB7BFC1CD7E47F78"><enum>(B)</enum><header>Distribution</header><text>Funds that would have been made available under paragraph (1) for a project or activity but for the prohibition under subparagraph (A) shall be distributed in accordance with paragraph (2).</text> </subparagraph></paragraph></subsection></section> <section display-inline="no-display-inline" id="HFA164F0D9ADB413CA8ED81F6A58EA2FB" section-type="subsequent-section"><enum>112.</enum><header>Administrative expenses</header> <subsection id="HD5325613CA66489DA3ED412882FBD838"><enum>(a)</enum><header>Authorization of contract authority</header><text>Notwithstanding any other provision of this title or any other law, there is authorized to be appropriated from the Highway Trust Fund (other than the Mass Transit Account), from amounts provided under <internal-xref idref="HF7B10CEB50D146DC9893CDCBD5D207B6" legis-path="2.">section 111</internal-xref>, for administrative expenses of the Federal-aid highway program $196,427,625 for the period beginning on October 1, 2011, and ending on March 31, 2012.</text> </subsection> <subsection id="H14CA882C4BF24F91A9CE1B0FAC53391A"><enum>(b)</enum><header>Contract authority</header><text>Funds authorized to be appropriated by this section shall be—</text> <paragraph id="H039E7AD0D6E645608B3C311ECB6C39A7"><enum>(1)</enum><text>available for obligation, and shall be administered, in the same manner as if such funds were apportioned under chapter 1 of title 23, United States Code; and</text> </paragraph> <paragraph id="H13B75C72DE764AB68BED84BDA2DDB5DF"><enum>(2)</enum><text>subject to a limitation on obligations for Federal-aid highways and highway safety construction programs, except that such funds shall remain available until expended.</text> </paragraph></subsection></section></subtitle> <subtitle id="H803708218E30442480916F5B1E9E03F8"><enum>B</enum><header>Extension of Highway Safety Programs</header> <section id="H6569470E29D34F64A08E912850E16168"><enum>121.</enum><header>Extension of National Highway Traffic Safety Administration highway safety programs</header> <subsection id="H135C68534094429FA446A76BE8708C79"><enum>(a)</enum><header>Chapter 4 highway safety programs</header><text>Section 2001(a)(1) of SAFETEA–LU (119 Stat. 1519) is amended by striking <quote>and $235,000,000 for fiscal year 2011.</quote> and inserting <quote>$235,000,000 for fiscal year 2011, and $117,500,000 for the period beginning on October 1, 2011, and ending on March 31, 2012.</quote>.</text> </subsection> <subsection id="H0DEDA31526D64C9B90FCB26ABEE3EBF9"><enum>(b)</enum><header>Highway safety research and development</header><text>Section 2001(a)(2) of SAFETEA–LU (119 Stat. 1519) is amended by striking <quote>and $108,244,000 for fiscal year 2011.</quote> and inserting <quote>$108,244,000 for fiscal year 2011, and $54,122,000 for the period beginning on October 1, 2011, and ending on March 31, 2012.</quote>.</text> </subsection> <subsection id="H0149F42FE7794CEC935460F013BF1F7E"><enum>(c)</enum><header>Occupant protection incentive grants</header> <paragraph id="HCDFA57C5563B4F30AFFC3830DCFB4503"><enum>(1)</enum><header>Extension of program</header><text display-inline="yes-display-inline">Section 405(a) of title 23, United States Code, is amended—</text> <subparagraph id="H781807ED5CA542928C4807B3A128EA0A"><enum>(A)</enum><text>in paragraph (3) by striking <quote>8</quote> and inserting <quote>9</quote>; and</text> </subparagraph> <subparagraph
