		<official-title>To amend the Internal Revenue Code of 1986 to provide a
		  temporary dividends received deduction and to create the Jobs Trust Fund to
		  fund infrastructure projects.</official-title>

		<section id="H5D6DA0A126644768B1C58136498E81CB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Putting America Back to Work Act of
			 2011</short-title></quote>.</text>
		</section><section id="HEB1B6AA41FAA418F8DEC3B9AFC2B410B"><enum>2.</enum><header>Temporary
			 dividends received deduction allowed for 2011 or 2012</header>
			<subsection id="HF8000DA63547425F9405F111D223A96D"><enum>(a)</enum><header>15 percent tax
			 on repatriated amounts</header><text>Paragraph (1) of section 965(a) of the
			 Internal Revenue Code of 1986 is amended by striking <quote>85 percent</quote>
			 and inserting <quote>57 percent</quote>.</text>
			</subsection><subsection display-inline="no-display-inline" id="H94D1C4855DC04AC0AA14F23E39DD4B40"><enum>(b)</enum><header>Base
			 period</header><text>Section 965 of such Code is amended by striking
			 <quote>June 30, 2003</quote> each place it occurs and inserting <quote>the date
			 of the enactment of the <short-title>Putting America Back
			 to Work Act of 2011</short-title></quote>.</text>
			</subsection><subsection display-inline="no-display-inline" id="HF1513CCD251643B4A9EED488C013EE27"><enum>(c)</enum><header>Election</header><text display-inline="yes-display-inline">Subsection (f) of section 965 of such Code
			 is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H2D65A061FF6B4712BEBC6909562CF571" style="OLC">
					<subsection id="H7A4C367C902B4B48AB9CFF3C874739D8"><enum>(f)</enum><header>Election</header><text display-inline="yes-display-inline">The taxpayer may elect to apply this
				section to—</text>
						<paragraph id="H3BC04D18E858477BB89BEE7762071DF3"><enum>(1)</enum><text>the taxpayer’s
				last taxable year which begins before the date of the enactment of the
				<short-title>Putting America Back to Work Act of
				2011</short-title>, or</text>
						</paragraph><paragraph id="H2E25121F02024EDB915FE74DDB2F6E90"><enum>(2)</enum><text>the taxpayer’s
				first taxable year which begins during the 1-year period beginning on such
				date.</text>
						</paragraph><continuation-text continuation-text-level="subsection">Such
				election may be made for a taxable year only if made on or before the due date
				(including extensions) for filing the return of tax for such taxable
				year.</continuation-text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection display-inline="no-display-inline" id="H5C2A375680F241F1A0CD85DB9E56FCB1"><enum>(d)</enum><header>Indebtedness
			 determination date</header><text>Subparagraph (B) of section 965(b)(3) of such
			 Code is amended by striking <quote>October 3, 2004</quote> and inserting
			 <quote>the date of the enactment of the <short-title>Putting America Back to Work Act of
			 2011</short-title></quote>.</text>
			</subsection><subsection display-inline="no-display-inline" id="H776BCAB61ED9425CA2F2495A6484C86C"><enum>(e)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to taxable years ending on or after the day before the
			 date of the enactment of this Act.</text>
			</subsection></section><section id="H6C2E9AEA020D447EA9963B65543A68AB"><enum>3.</enum><header>Establishment of
			 the Jobs Trust Fund</header>
			<subsection id="H8AAC6DAC60F54863A1E180C130F5DDC9"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter A of
			 chapter 98 of the Internal Revenue Code of 1986 is amended by adding at the end
			 the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HB72BDE4EE5AC4D6184749BC7754084BA" style="OLC">
					<section id="H2DB4848400044F81A6B9E6BEC0E524C8"><enum>9512.</enum><header>Jobs Trust
				Fund</header>
						<subsection id="H181232BE0A61490ABDB675A2F41A5A42"><enum>(a)</enum><header>Creation of
				Trust Fund</header><text>There is established in the Treasury of the United
				States a trust fund to be known as the <term>Jobs Trust Fund</term>, consisting
				of such amounts as may be appropriated or credited to such fund as provided in
				this section or section 9602(b).</text>
						</subsection><subsection id="H0195D1ACA98843C9A94B27C977D6CF5C"><enum>(b)</enum><header>Transfers to
				Trust Fund</header>
							<paragraph id="H537CEFCCD4404B24A53FC0B5157BE88D"><enum>(1)</enum><header>In
				general</header><text>There are hereby appropriated to the Jobs Trust Fund
				amounts equivalent to the repatriation revenue of the Federal Government.</text>
							</paragraph><paragraph id="H3CC8E7D1543647CFB5EAE3AF5DBC89AF"><enum>(2)</enum><header>Repatriation
				revenue of the Federal Government</header><text>For purposes of this
				subsection, the term <quote>repatriation revenue of the Federal
				Government</quote> means the excess (as determined by the Secretary) of—</text>
								<subparagraph id="H4B659876EA1F4929B06110BD1AA5CBC2"><enum>(A)</enum><text>the amount of
				revenue to the Federal Government with respect to taxable years ending on or
				after the day before the date of the enactment of this section, over</text>
								</subparagraph><subparagraph id="H2AA783A3DA5C4791BC5B34D03C15E593"><enum>(B)</enum><text>the amount of
				revenue which would be described in subparagraph (A) if the amendments made by
				section 2 of the <short-title>Putting America Back to Work
				Act of 2011</short-title> had never been enacted.</text>
								</subparagraph></paragraph></subsection><subsection id="H7761E50835514DE9A1D762DDD844ECAD"><enum>(c)</enum><header>Expenditures</header>
							<paragraph id="H84744B0EFC554F93A191BD453CAAE298"><enum>(1)</enum><header>In
				general</header><text>Amounts in the Jobs Trust Fund shall be available, as
				provided in appropriation Acts, only for the purpose of funding infrastructure
				projects and improvements in the United States. Such amounts shall be used to
				supplement, not supplant, existing funding for such projects and
				improvements.</text>
							</paragraph><paragraph id="H0FBB33D1A78F44EAB7C5DE366EF7D9C4"><enum>(2)</enum><header>Buy
				America</header>
								<subparagraph id="H1F2ACED53BFE461998483C4D94C42833"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding any other provision of law, amounts made
				available from the Jobs Trust Fund may be used for the acquisition of steel,
				iron, cement, concrete, and manufactured products only if such material or
				product is produced in the United States.</text>
								</subparagraph><subparagraph id="H470A912E788F4DC08F7FA2FA84B9234E"><enum>(B)</enum><header>Exceptions</header><text>Subparagraph
				(A) shall not apply if the head of the Federal agency concerned finds—</text>
									<clause id="HBE98A73C3DE94D0DA70E24D3B229680F"><enum>(i)</enum><text>that the
				application of such subparagraph would be inconsistent with the public
				interest, or</text>
									</clause><clause id="HFBA4D9CE91B841C48B9C82859AFFC4F7"><enum>(ii)</enum><text>that the material
				or product is not produced in the United States in sufficient and reasonably
				available quantities and of a satisfactory quality.</text>
									</clause></subparagraph><subparagraph id="H4370FC675A984F05824C95F92AEA0270"><enum>(C)</enum><header>Compliance with
				international agreements</header><text>Subparagraph (A) shall be applied in a
				manner consistent with United States obligations under international
				agreements.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H1B3B1393A5E54465BDA934D0025E636B"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections for subchapter A of chapter 98 of
			 such Code is amended by adding at the end the following new item:</text>

					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5ABE73A0401C406B95194AFF9C218888"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on the
			 date of the enactment of this Act.</text>
