		<official-title>To amend the Implementing Recommendations of the 9/11
		  Commission Act of 2007 to provide immunity for reporting and responding to
		  suspicious transactions, activities, and occurrences that involve a vessel,
		  facility, port, or waterway, and for other purposes.</official-title>

		<section id="H544EDEF9F78B4AB88C5CB1C8B9814F78" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Suspected Maritime Activities
			 Reporting of Terrorism Immunity Act</short-title></quote> or the
			 <quote><short-title>SMART Immunity
			 Act</short-title></quote>.</text>
		</section><section id="HFDF2E14C56664DD6A800D7874711E42E"><enum>2.</enum><header>Immunity for
			 reporting and responding to suspicious transactions, etc. involving a vessel,
			 facility, port, or waterway</header><text display-inline="no-display-inline">Section 1206(d)(2) of the Implementing
			 Recommendations of the 9/11 Commission Act of 2007 (6 U.S.C. 1104(d)(2)) is
			 amended—</text>
			<paragraph id="H803A4B906DF14CDC8BA3DDF1919A0562"><enum>(1)</enum><text>by striking
			 <quote>directed against a passenger transportation system</quote> and inserting
			 the following:</text>
				<quoted-block display-inline="yes-display-inline" id="H35D6C75B852C4B56AB273BFD0AE04858" style="OLC">
					<text>directed
			 against—</text><paragraph id="H791E12ACEB0F4C74A527BDDE0F444F53"><enum>(1)</enum><text display-inline="yes-display-inline">a passenger transportation
				system—</text>
					</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H7227BF9E36794EFCAF05142CF2C9EEB5"><enum>(2)</enum><text>by redesignating
			 subparagraphs (A) and (B) as clauses (i) and (ii), and moving them 2 ems to the
			 right;</text>
			</paragraph><paragraph id="H83A68866594D41D980C881B8269F0B00"><enum>(3)</enum><text>by striking the
			 period at the end and inserting <quote>; or</quote>; and</text>
			</paragraph><paragraph id="H8ED7387C4F16496E94B3ED42DF3E0415"><enum>(4)</enum><text>by adding at the
			 end the following new subparagraph:</text>
				<quoted-block id="H7122E9801131434982EAD10A4F40DAC4" style="OLC">
					<subparagraph id="HA603F8A4890649B1889035D3E4B34CE7"><enum>(B)</enum><text>a vessel, facility
				(as that term is defined in section 70101 of title 46, United States Code),
				port, or waterway, whether or not a passenger is threatened, indicating that an
				individual may be engaging, or preparing to engage, in a violation of law
				relating to—</text>
						<clause id="HC63771428700485E97DC966F052DEE8C"><enum>(i)</enum><text>a
				threat to a vessel, facility (as so defined), port, or waterway; or</text>
						</clause><clause id="H49B3C7C438BF47FD9671AC7D778173A3"><enum>(ii)</enum><text>an act of
				terrorism (as that term is defined in section 3077 of title 18, United States
				Code) against a vessel, facility, port, or
				waterway.</text>
