			 title</header><text display-inline="yes-display-inline">This Act may be cited
			 as the <quote><short-title>Pipeline Safety, Regulatory
			 Certainty, and Job Creation Act of 2011</short-title></quote>.</text>
			</subsection><subsection id="HE53D95BD0C214D36A026955F83BA3997"><enum>(b)</enum><header>Amendment of title 49,
			 United States Code</header><text>Except as otherwise expressly provided,
			 whenever in this Act an amendment or repeal is expressed in terms of an
			 amendment to, or a repeal of, a section or other provision, the reference shall
			 be considered to be made to a section or other provision of title 49, United
			 States Code.</text>
			</subsection><subsection id="H9BA8B69572A74EFE8D833E5F0DA7908A"><enum>(c)</enum><header>Definitions</header><text>Any
			 term used in this Act that is defined in chapter 601 of title 49, United States
			 Code, shall have the meaning given that term in that chapter.</text>

				access</header><text display-inline="yes-display-inline">If the Secretary or
				the National Transportation Safety Board investigates an accident involving a
				pipeline facility, the operator of the facility shall—</text>
							<subparagraph id="H8FB4C07A2F9E4BDD80208413686034CE"><enum>(A)</enum><text>make available to the
				Secretary or the Board all records and information that in any way pertain to
				the accident (including integrity management plans and test results);
				and</text>
							</subparagraph><subparagraph id="HD901B035E48343F8B57D7C3CD1961B2C"><enum>(B)</enum><text>afford all reasonable
				assistance in the investigation of the accident.</text>
							</subparagraph></paragraph><paragraph id="HC5C7F2C3812A45208249EB3F1D89E658"><enum>(2)</enum><header>Operator assistance in
				investigations</header>
							<subparagraph id="H1651BA91A3A642CC9D4B3511108FB9C1"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary may
				impose a civil penalty under section 60122 on a person who obstructs or
				prevents the Secretary from carrying out inspections or investigations under
				this chapter.</text>
							</subparagraph><subparagraph id="H32AFBF6EBD174AC2BD2995C4ADC8488B"><enum>(B)</enum><header>Definitions</header><text>In
				this paragraph, the following definitions apply:</text>
								<clause id="H2F4B47616A604A88AAA1DF820DD8FC9B"><enum>(i)</enum><header>Obstructs</header><text display-inline="yes-display-inline">The term <quote>obstructs</quote> includes
				actions that were known, or reasonably should have been known, to prevent,
				hinder, or impede an investigation without good cause.</text>
								</clause><clause id="HC455EF4DE53C4D1B8603D0B5C0184171"><enum>(ii)</enum><header>Good
				cause</header><text display-inline="yes-display-inline">The term <quote>good
				cause</quote> includes, at a minimum, restricting access to facilities that are
				not secure or safe for non-pipeline personnel or
				visitors.</text>
								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA1D5BEB5A79D4BC59F156A738D7340F8"><enum>(c)</enum><header>Administrative penalty
			 caps inapplicable</header><text>Section 60120(a)(1) is amended by adding at the
			 end the following: <quote>The maximum amount of civil penalties for
			 administrative enforcement actions under section 60122 shall not apply to
			 enforcement actions under this section.</quote>.</text>
			</subsection><subsection id="H23A8061C22E44050A159B7D88D898D08"><enum>(d)</enum><header>Judicial review of
			 administrative enforcement orders</header><text>Section 60119(a) is
			 amended—</text>
				<paragraph id="HDA43840ACA824B4BB5EDE312A3F8DA44"><enum>(1)</enum><text>in the subsection heading
			 by striking <quote><header-in-text level="subsection" style="OLC">and Waiver
			 Orders</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">, Orders, and Other Final Agency
			 Actions</header-in-text></quote>; and</text>
				</paragraph><paragraph id="H70FF925878D34ACABBF5D56004B4CB01"><enum>(2)</enum><text>by striking <quote>about
			 an application for a waiver under section 60118(c) or (d) of this title</quote>
			 and inserting <quote>under this chapter</quote>.</text>
				</paragraph></subsection></section><section id="H212107D363D84A90AE61C4196ECC5EF5"><enum>3.</enum><header>Pipeline damage
			 prevention</header>
			<subsection id="H57EC8FD266F247C49E2B8200BEA484A8"><enum>(a)</enum><header>Minimum standards for
			 state one-Call notification programs</header><text>Section 6103(a) is amended
			 to read as follows:</text>

					<subsection id="HBB6791C1F4E04610B08A3FB96F5DCAC7"><enum>(a)</enum><header>Minimum
				standards</header>
						<paragraph id="H2D9870EA04E5426FA78695E50E571DCA"><enum>(1)</enum><header>In
				general</header><text>In order to qualify for a grant under section 6106, a
				State one-call notification program, at a minimum, shall provide for—</text>
							<subparagraph id="H067D09EDA3DC438E886D7DB669BB3D0F"><enum>(A)</enum><text>appropriate participation
				by all underground facility operators, including all government
				operators;</text>
							</subparagraph><subparagraph id="H901C5A8F5EC74D1CAA9D36C9EEEED9F6"><enum>(B)</enum><text>appropriate participation
				by all excavators, including all government and contract excavators; and</text>
							</subparagraph><subparagraph id="HD000D9341A3243AF93619D2262FB118E"><enum>(C)</enum><text>flexible and effective
				enforcement under State law with respect to participation in, and use of,
				one-call notification systems.</text>
							</subparagraph></paragraph><paragraph id="HD2426055FA1A4EF38699CCDA2FA324A0"><enum>(2)</enum><header>Exemptions
				prohibited</header><text>In order to qualify for a grant under section 6106, a
				State one-call notification program may not exempt municipalities, State
				agencies, or their contractors from its one-call notification system
				requirements.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD62BC229C5A0410D96D0607C28B601B9"><enum>(b)</enum><header>State damage prevention
			 programs</header><text>Section 60134(a) is amended—</text>
				<paragraph id="H0D4E664C8E034CC2BA1877A2C1C928F0"><enum>(1)</enum><text>in paragraph (1) by
			 striking <quote>and</quote> after the semicolon;</text>
				</paragraph><paragraph id="H66722B6E9B014828B9FED45FF7E1E137"><enum>(2)</enum><text>in paragraph (2)(B) by
			 striking <quote>(b).</quote> and inserting <quote>(b); and</quote>; and</text>
				</paragraph><paragraph id="HD87B333923684B5697A01914173A2A66"><enum>(3)</enum><text>by adding at the end the
			 following:</text>
					<quoted-block changed="added" committee-id="HPW00" id="H8DFB6C24DB9B4C4992BFD55EF2E8679E" reported-display-style="italic" style="OLC">
						<paragraph id="H6E1C487618704532BE591B92C9CB18DA"><enum>(3)</enum><text>does not provide any
				exemptions to municipalities, State agencies, or their contractors from its
				one-call notification system
				requirements.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H854CA00B53A449C5A304DD173A9F2A0E"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect 2
			 years after the date of enactment of this Act.</text>
			</subsection><subsection id="H0A3E4C19BC224698A232A085CB49AD67"><enum>(d)</enum><header>Third party
			 damage</header>
				<paragraph id="H3321C59C896D4B00AD2B2AC1719BBD18"><enum>(1)</enum><header>Study</header><text>The
			 Secretary of Transportation shall conduct a study on the impact of third party
			 damage on pipeline safety.</text>
				</paragraph><paragraph id="H8743DCB1A4E741DBB1C69530D2642249"><enum>(2)</enum><header>Contents</header><text>The
			 study shall include—</text>
					<subparagraph id="HCAB1A68473324C46918D2F2F600F472B"><enum>(A)</enum><text>an analysis of the
			 frequency and severity of different types of third party damage
			 incidents;</text>
					</subparagraph><subparagraph id="HC4318A40F07449D2AC3BCA3B8236331D"><enum>(B)</enum><text>an analysis of exemptions
			 to the one-call notification system requirements in each State;</text>
					</subparagraph><subparagraph id="H0CEA91437AD5454F894BD99A7ACB7C16"><enum>(C)</enum><text>a comparison of
			 exemptions to the one-call notification system requirements in each State to
			 the types of third party damage incidents in that State; and</text>
					</subparagraph><subparagraph id="HCFB65B85AFF84CCDACA441B53A2B67CA"><enum>(D)</enum><text>an analysis of the
			 potential safety benefits and adverse consequences of eliminating all
			 exemptions for mechanized excavation from State one-call notification
			 systems.</text>
					</subparagraph></paragraph><paragraph id="H235B62532A9A4E28BE35EC932071528A"><enum>(3)</enum><header>Report</header><text>Not
			 later than 2 years after the date of enactment of this Act, the Secretary shall
			 submit to the House of Representatives Committee on Transportation and
			 Infrastructure and Committee on Energy and Commerce and the Senate Committee on
			 Commerce, Science, and Transportation a report on the results of the
			 study.</text>
				</paragraph></subsection></section><section id="H8BB0A88B1ACF4FD9A1F20D3E2C35802D"><enum>4.</enum><header>Automatic and
			 remote-controlled shut-off valves</header><text display-inline="no-display-inline">Section 60102 is amended—</text>
			<paragraph id="H0A6FA52FF5DC4E0CB03BDBA9A51AD102"><enum>(1)</enum><text>by striking subsection
			 (j)(3); and</text>
			</paragraph><paragraph id="HBEC4798799A749A89FF22AB27F402665"><enum>(2)</enum><text>by adding at the end the
			 following:</text>
				<quoted-block changed="added" committee-id="HPW00" id="H42C080DABBB2446489EA1413D9B97CE6" reported-display-style="italic" style="OLC">
					<subsection id="HAAADBA12F1BA42F2B628358C976549C8"><enum>(n)</enum><header>Automatic and
				remote-Controlled shut-Off valves for new transmission pipelines</header>
						<paragraph id="H425D595F234C4391883152924063E793"><enum>(1)</enum><header>In
				general</header><text>The Secretary may require by regulation, if determined
				appropriate by the Secretary, the use of automatic or remote-controlled
				shut-off valves, or equivalent technology, where economically, technically, and
				operationally feasible on transmission pipeline facilities constructed or
				entirely replaced after the date on which the Secretary issues the final rule
				containing such requirement.</text>
						</paragraph><paragraph id="H37CE2948654A4C8880DC19CFD307A409"><enum>(2)</enum><header>Factors for
				consideration</header><text>In determining whether to proceed with a rulemaking
				under paragraph (1), the Secretary shall consider the factors specified in
				subsection
				(b)(2).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" id="H8126226F90874B2E85A15AD48C71215F"><enum>5.</enum><header>Integrity
			 management</header>
			<subsection commented="no" id="HDD450B9D00FA447B919200C3FEAC6419"><enum>(a)</enum><header>Evaluation</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
			 enactment of this Act, the Secretary of Transportation shall evaluate—</text>
				<paragraph commented="no" id="HE1681820E3AE46E28D621AAA60A4CF76"><enum>(1)</enum><text>whether integrity
			 management system requirements, or elements thereof, should be expanded beyond
			 high consequence areas; and</text>
				</paragraph><paragraph commented="no" id="H9CC0F97742B442FC9F2B68ADB66F4A7F"><enum>(2)</enum><text>with respect to gas
			 transmission pipeline facilities, whether applying integrity management program
			 requirements, or elements thereof, to additional areas would mitigate the need
			 for class location requirements.</text>
				</paragraph></subsection><subsection id="H043AD36891AE4CE4A8148AE18EE96D47"><enum>(b)</enum><header>Repair
			 criteria</header><text>In conducting the evaluation under subsection (a), the
			 Secretary shall consider applying repair criteria, such as pressure reductions
			 and special requirements for scheduling remediation, to areas that are not high
			 consequence areas.</text>
			</subsection><subsection commented="no" id="HF7DA77ADB7E54DB18DB7C5C19C05F301"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Based on the evaluation to be conducted
			 under subsection (a), the Secretary shall submit to the House of
			 Representatives Committee on Transportation and Infrastructure and Committee on
			 Energy and Commerce and the Senate Committee on Commerce, Science, and
			 Transportation a report containing the Secretary’s analysis and findings
			 regarding—</text>
				<paragraph id="H0AE6A411C7DB49068CD9AC0983EE8124"><enum>(1)</enum><text>expansion of integrity
			 management requirements, or elements thereof, beyond high consequence areas;
			 and</text>
				</paragraph><paragraph id="H0E61FDA1CEB840F092D5D3670B60FBC3"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to gas transmission pipeline
			 facilities, whether applying the integrity management program requirements, or
			 elements thereof, to additional areas would mitigate the need for class
			 location requirements.</text>
				</paragraph></subsection><subsection commented="no" id="HCFBDFBF1EB5F442B8BC5F9845ACCACC0"><enum>(d)</enum><header>Data
			 reporting</header><text>The Secretary shall collect any relevant data necessary
			 to complete the evaluation required by subsection (a).</text>
			</subsection><subsection commented="no" id="H771DB4305E334E0181357EB6DF506383"><enum>(e)</enum><header>Technical
			 correction</header><text>Section 60109(c)(3)(B) is amended to read as
			 follows:</text>
				<quoted-block changed="added" committee-id="HPW00" id="HFDE2690417F24E87B621D35E8CF14511" reported-display-style="italic" style="OLC">
					<subparagraph commented="no" id="HCD2CF139DDD248EFBA8BBD1F99D44ADF"><enum>(B)</enum><text>Subject to paragraph (5),
				periodic reassessments of the facility, at a minimum of once every 7 calendar
				years, using methods described in subparagraph (A). Such deadline shall be
				extended for an additional 6 months if the operator submits written notice to
				the Secretary that includes an explanation of the need for the
				extension.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HCFC0FB32184A4B04861B83024B2EC423"><enum>(f)</enum><header>Rulemaking
			 requirements</header>
				<paragraph id="HFF99458BEDF64ED38BE52039ED65A9C1"><enum>(1)</enum><header>Review period
			 defined</header><text display-inline="yes-display-inline">In this subsection,
			 the term <quote>review period</quote> means the period beginning on the date of
			 enactment of this Act and ending on the earlier of—</text>
					<subparagraph id="HED2EC60FB1474438A7F36161FDEFE74E"><enum>(A)</enum><text>the date that is 1 year
			 after the date of completion of the report under subsection (c); or</text>
					</subparagraph><subparagraph id="H66C7C2ECB33849369121DB777B9A8D84"><enum>(B)</enum><text>the date that is 3 years
			 after the date of enactment of this Act.</text>
					</subparagraph></paragraph><paragraph id="HC933ECD280A448B5B26240F2D5C07DAC"><enum>(2)</enum><header>Congressional
			 authority</header><text>In order to provide Congress the necessary time to
			 review the results of the report required by subsection (c) and implement
			 appropriate recommendations, the Secretary shall not, during the review period,
			 proceed with a rulemaking to prescribe regulations described in paragraph
			 (3).</text>
				</paragraph><paragraph id="HE8FA1E57F3F04C3FA495B148BF55E9D5"><enum>(3)</enum><header>Standards</header><text>Following
			 the review period, the Secretary may, as appropriate, prescribe regulations
			 that—</text>
					<subparagraph id="H3B99A112DE9C4583B097AA9F825922EF"><enum>(A)</enum><text>expand integrity
			 management system requirements, or elements thereof, beyond high consequence
			 areas; and</text>
					</subparagraph><subparagraph id="H57DEE605699C4DDE93162074F4B752B8"><enum>(B)</enum><text>remove redundant class
			 location requirements for gas transmission pipeline facilities that are
			 regulated under an integrity management program adopted and implemented under
			 section 60109(c)(2) of title 49, United States Code.</text>
					</subparagraph></paragraph><paragraph id="HEDC1361072804279818A50D647CCC8A4"><enum>(4)</enum><header>Savings clause</header>
					<subparagraph id="HC700DF7150834D7E8BC69B1D900301BF"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Notwithstanding any
			 other provision of this subsection, the Secretary, during the review period,
			 may proceed to a rulemaking to prescribe regulations described in paragraph
			 (3), and may prescribe the regulations, if the Secretary determines that a
			 condition that poses a risk to public safety, property, or the environment is
			 present or an imminent hazard exists and that the rulemaking will address the
			 risk or hazard.</text>
					</subparagraph><subparagraph id="H362A99C4B9744713A94F4C31EC95563E"><enum>(B)</enum><header>Imminent hazard
			 defined</header><text>In subparagraph (A), the term <quote>imminent
			 hazard</quote> means the existence of a condition related to pipelines or
			 pipeline operations that presents a substantial likelihood that death, serious
			 illness, severe personal injury, or substantial endangerment to health,
			 property, or the environment may occur.</text>
					</subparagraph></paragraph></subsection><subsection id="H8852C51A44084DB78685D0EC829A525D"><enum>(g)</enum><header>Report to Congress on
			 risk-Based pipeline reassessment intervals</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
			 enactment of this Act, the Comptroller General of the United States shall
			 evaluate—</text>
				<paragraph id="H3E0A55967C8D46FF87A6BDF6D5A25CA2"><enum>(1)</enum><text display-inline="yes-display-inline">whether risk-based reassessment intervals
			 are a more effective alternative for managing risks to pipelines in
			 high-consequence areas once baseline assessments are complete when compared to
			 a 7-year reassessment interval;</text>
				</paragraph><paragraph id="HE0EC283EBB6C488BA2BDEF803D558C1F"><enum>(2)</enum><text>the number of anomalies
			 found in baseline assessments required under section 60109(c)(3)(A) of title
			 49, United States Code, as compared to the number of anomalies found in
			 reassessments required under section 60109(c)(3)(B) of such title; and</text>
				</paragraph><paragraph id="HAFF5F90677F5480589C72DECCE85D172"><enum>(3)</enum><text>the progress made in
			 incorporating the recommendations in GAO Report 06–945 and the current
			 relevance of recommendations not incorporated to date.</text>
				</paragraph></subsection><subsection id="H27E7D81437044DBFB1FA6CD636A48DAC"><enum>(h)</enum><header>High consequence area
			 defined</header><text display-inline="yes-display-inline">In this section, the
			 term <quote>high consequence area</quote> means an area described in section
			 60109(a) of title 49, United States Code.</text>
			</subsection></section><section commented="no" id="HC01EB1E92CC944209679911BAD3D2EB2"><enum>6.</enum><header>Public education and
			 awareness</header>
			<subsection id="HBBA6700065E04EF8A8570083C5A6C084"><enum>(a)</enum><header>National pipeline
			 mapping system</header>
				<paragraph id="H3B1A924EF6A84AAFA006DD7E7EECCEB9"><enum>(1)</enum><header>Map of high consequence
			 areas</header><text>The Secretary of Transportation shall—</text>
					<subparagraph id="HF4953DB3A32348D9B2BA69D2AD9F5F15"><enum>(A)</enum><text>maintain, as part of the
			 National Pipeline Mapping System, a map of all designated high consequence
			 areas (as described in section 60109(a) of title 49, United States Code) in
			 which pipelines are required to meet integrity management safety regulations,
			 excluding any proprietary or sensitive security information; and</text>
					</subparagraph><subparagraph id="H1983B759ADA0455DA3B20EE42292284C"><enum>(B)</enum><text>update the map
			 biennially.</text>
					</subparagraph></paragraph><paragraph id="H7A7639DC05CF4A2FAD9B7C5DF71DF1C8"><enum>(2)</enum><header>Program to promote
			 awareness of National Pipeline Mapping System</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
			 enactment of this Act, the Secretary shall develop and implement a program
			 promoting greater awareness of the existence of the National Pipeline Mapping
			 System to State and local emergency responders and other interested parties.
			 The program shall include guidance on how to use the National Pipeline Mapping
			 System to locate pipelines in communities and local jurisdictions.</text>
				</paragraph></subsection><subsection id="H934DBF32669E42BD8F463F088535001F"><enum>(b)</enum><header>Information to
			 emergency response agencies</header>
				<paragraph id="H9673CD6DBE064F4482BE266150DC3D3C"><enum>(1)</enum><header>Guidance</header><text>Not
			 later than 18 months after the date of enactment of this Act, the Secretary
			 shall issue guidance to owners and operators of pipeline facilities on the
			 importance of providing system-specific information about their pipeline
			 facilities to emergency response agencies of the communities and jurisdictions
			 in which those facilities are located.</text>
				</paragraph><paragraph id="H30AFE71E71B245518760E718C1CCA5D7"><enum>(2)</enum><header>Consultation</header><text>Before
			 issuing guidance under paragraph (1), the Secretary shall consult with owners
			 and operators of pipeline facilities to determine the extent to which the
			 owners and operators are already providing system-specific information about
			 their pipeline facilities to emergency response agencies.</text>
				</paragraph></subsection></section><section id="H1DC359361B9F4EA28101DE2F559B2E91"><enum>7.</enum><header>Cast iron gas
			 pipelines</header>
			<subsection id="H306F8854C37C4B459AF42B033438E50E"><enum>(a)</enum><header>Follow-Up
			 surveys</header><text display-inline="yes-display-inline">Section 60108(d) is
			 amended by adding at the end the following:</text>
				<quoted-block changed="added" committee-id="HPW00" id="H4C0560AFD69C4D87840D1A04D9D34839" reported-display-style="italic" style="OLC">
					<paragraph id="H7A9906BAB8EA47C3AFF1EE383B7A482D" indent="up1"><enum>(4)</enum><text>Not later than December
				31, 2012, and every 2 years thereafter, the Secretary shall conduct a follow-up
				survey to measure the progress that owners and operators of pipeline facilities
				have made in implementing their plans for the safe management and replacement
				of cast iron gas
				pipelines.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H2B7B26A1CA9B4B6C8AA23FA5769B36AF"><enum>(b)</enum><header>Status
			 report</header><text display-inline="yes-display-inline">Not later than
			 December 31, 2013, the Secretary of Transportation shall transmit to the House
			 of Representatives Committee on Transportation and Infrastructure and Committee
			 on Energy and Commerce and the Senate Committee on Commerce, Science, and
			 Transportation a report that—</text>
				<paragraph id="H3C303DCA545F4FD1B80B1A3A97169970"><enum>(1)</enum><text>identifies the total
			 mileage of cast iron gas pipelines in the United States; and</text>
				</paragraph><paragraph id="H62FD4EE487DC440E84B5791AE26F5EE6"><enum>(2)</enum><text>evaluates the progress
			 that owners and operators of pipeline facilities have made in implementing
			 their plans for the safe management and replacement of cast iron gas
			 pipelines.</text>
				</paragraph></subsection></section><section commented="no" id="H56F86EE1DF84433A8D06E3B6F1CE1C64"><enum>8.</enum><header>Leak detection</header>
			<subsection commented="no" id="H4AE9CC0A1E3A437981B9891CC02B4828"><enum>(a)</enum><header>Leak detection
			 report</header>
				<paragraph id="HAC84810AC965485C85B122069C7CC663"><enum>(1)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 Act, the Secretary of Transportation shall submit to the Senate Committee on
			 Commerce, Science, and Transportation and the House of Representatives
			 Committee on Transportation and Infrastructure and Committee on Energy and
			 Commerce a report on leak detection systems utilized by operators of hazardous
			 liquid pipeline facilities and transportation-related flow lines.</text>
				</paragraph><paragraph id="HF24AF4FA13FB4A8FB11BF6F00C9AED59"><enum>(2)</enum><header>Contents</header><text>The
			 report shall include—</text>
					<subparagraph id="HC87261B62D3F4B9B9FF7DD5B78CBC14B"><enum>(A)</enum><text>an analysis of the
			 technical limitations of current leak detection systems, including the systems’
			 ability to detect ruptures and small leaks that are ongoing or intermittent,
			 and what can be done to foster development of better technologies; and</text>
					</subparagraph><subparagraph id="HC01CCFB57F3645A8B8DBF3FF47188A89"><enum>(B)</enum><text>an analysis of the
			 feasibility of establishing technically, operationally, and economically
			 feasible standards for the capability of such systems to detect leaks, and the
			 safety benefits and adverse consequences of requiring operators to use leak
			 detection systems.</text>
					</subparagraph></paragraph></subsection><subsection id="HE289A757E62446F3B8457BCA9CB3A2EE"><enum>(b)</enum><header>Rulemaking
			 requirements</header>
				<paragraph id="H674F003D6C79438AAF4B90F8DA84BD6F"><enum>(1)</enum><header>Review period
			 defined</header><text display-inline="yes-display-inline">In this subsection,
			 the term <quote>review period</quote> means the period beginning on the date of
			 enactment of this Act and ending on the earlier of—</text>
					<subparagraph id="H508E1DF8D3124171949F969DA619C714"><enum>(A)</enum><text>the date that is 1 year
			 after the date of completion of the report under subsection (a); or</text>
					</subparagraph><subparagraph id="HFE4AD5A641994918A139976E6090A2DE"><enum>(B)</enum><text>the date that is 2 years
			 after the date of enactment of this Act.</text>
					</subparagraph></paragraph><paragraph id="H030A783E6AD344538AA776AC8025B1B4"><enum>(2)</enum><header>Congressional
			 authority</header><text display-inline="yes-display-inline">In order to provide
			 Congress the necessary time to review the results of the report required by
			 subsection (a) and implement appropriate recommendations, the Secretary shall
			 not, during the review period, proceed with a rulemaking to prescribe
			 regulations described in paragraph (3).</text>
				</paragraph><paragraph display-inline="no-display-inline" id="H651FA5C06EC44E71B746825391EE3A1E"><enum>(3)</enum><header>Standards</header><text>Following
			 the review period, the Secretary may, as appropriate, prescribe regulations
			 that—</text>
					<subparagraph id="HE57DEA8D0ABE467488E9049610D83694"><enum>(A)</enum><text>require operators of
			 hazardous liquid pipeline facilities to use leak detection systems; and</text>
					</subparagraph><subparagraph id="H9FED7DF720F2404F9F210B2B270DB4F4"><enum>(B)</enum><text>establish technically,
			 operationally, and economically feasible standards for the capability of such
			 systems to detect leaks.</text>
					</subparagraph></paragraph><paragraph id="H250A34FD97BA46A6AA1174055051FDCF"><enum>(4)</enum><header>Savings clause</header>
					<subparagraph id="H89ACCD1C7EEF4C17ABF65591E82F9271"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Notwithstanding any
			 other provision of this subsection, the Secretary, during the review period,
			 may proceed to a rulemaking to prescribe regulations described in paragraph
			 (3), and may prescribe the regulations, if the Secretary determines that a

					</subparagraph><subparagraph id="HD7C9182A7106470BB129B4CC5BFD555C"><enum>(B)</enum><header>Imminent hazard
			 defined</header><text>In subparagraph (A), the term <quote>imminent
			 hazard</quote> means the existence of a condition related to pipelines or
			 pipeline operations that presents a substantial likelihood that death, serious
			 illness, severe personal injury, or substantial endangerment to health,
			 property, or the environment may occur.</text>
					</subparagraph></paragraph></subsection></section><section id="H6A090024BCDA4C23911CC3CB5DB0FA8F"><enum>9.</enum><header>Accident and incident
			 notification</header>
			<subsection id="H62DA2050FF9C4B9D9A654CC34AAA2A13"><enum>(a)</enum><header>Revision of
			 regulations</header><text display-inline="yes-display-inline">Not later than 18
			 months after the date of enactment of this Act, the Secretary of Transportation
			 shall revise regulations issued under sections 191.5 and 195.52 of title 49,
			 Code of Federal Regulations, to establish specific time limits for telephonic
			 or electronic notice of accidents and incidents involving pipeline facilities
			 to the Secretary and the National Response Center.</text>
			</subsection><subsection id="H7519D9A01BCE4B419B77A0FAD35EE1FF"><enum>(b)</enum><header>Minimum
			 requirements</header><text>In revising the regulations, the Secretary, at a
			 minimum, shall—</text>
				<paragraph id="H743B6659DBB34BF4BBAF8CA6A318E45A"><enum>(1)</enum><text>establish time limits for
			 telephonic or electronic notification of an accident or incident to require
			 such notification not less than 1 hour and not more than 2 hours after
			 discovery of the accident or incident;</text>
				</paragraph><paragraph id="HB7DFAA9CDF17430EB73A6CF90413B103"><enum>(2)</enum><text>review procedures for
			 owners and operators of pipeline facilities and the National Response Center to
			 provide thorough and coordinated notification to all relevant State and local
			 emergency response officials, including 911 emergency call centers, for the
			 jurisdictions in which those pipeline facilities are located in the event of an
			 accident or incident, and revise such procedures as appropriate; and</text>
				</paragraph><paragraph id="HF2F8F8B5A9C5445585C88CE1F2FF4683"><enum>(3)</enum><text>require such owners and
			 operators to revise their initial telephonic or electronic notice to the
			 Secretary and the National Response Center with an estimated amount of the
			 product released, an estimated number of fatalities and injuries, if any, and
			 any other information determined appropriate by the Secretary within 24 to 48
			 hours of the accident or incident, to the extent practicable.</text>
				</paragraph></subsection><subsection id="H65DB73B306994CB9B59BE1D3A1D458A9"><enum>(c)</enum><header>Updating of
			 reports</header><text>After receiving revisions described in subsection (b)(3),
			 the National Response Center shall update the initial report on an accident or
			 incident instead of generating a new report.</text>
			</subsection></section><section commented="no" id="HAB99D1C9EDB8470BA5A4A982069AAC93"><enum>10.</enum><header>Transportation-related
			 onshore facility response plan compliance</header>
			<subsection commented="no" display-inline="no-display-inline" id="HEF0CCFEA3B794E439DE194EC659A1E69"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subparagraphs (A) and
			 (B) of section 311(m)(2) of the Federal Water Pollution Control Act (33 U.S.C.
			 1321(m)(2)) are each amended by striking <quote>Administrator or</quote> and
			 inserting <quote>Administrator, the Secretary of Transportation,
			 or</quote>.</text>
			</subsection><subsection commented="no" id="HA4F2BD12325F42649AFCC114433FDBEC"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Section 311(b)(6)(A) of the Federal Water Pollution
			 Control Act (33 U.S.C. 1321(b)(6)(A)) is amended by striking <quote>operating
			 or</quote> and inserting <quote>operating, the Secretary of Transportation,
			 or</quote>.</text>
			</subsection></section><section id="H51869D6076714B8D853591BE1725FF63"><enum>11.</enum><header>Transportation-related
			 oil flow lines</header><text display-inline="no-display-inline">Section 60102,
			 as amended by this Act, is further amended by adding at the end the
			 following:</text>

				collection</header><text>The Secretary may collect geospatial or technical data
				on transportation-related oil flow lines, including unregulated
				transportation-related oil flow lines.</text>
					</paragraph><paragraph id="HFCD9C7B1B82D4158A5DBCA7600E12227"><enum>(2)</enum><header>Transportation-related
				oil flow line defined</header><text>In this subsection, the term
				<term>transportation-related oil flow line</term> means a pipeline transporting
				oil off of the grounds of the well where it originated across areas not owned
				by the producer, regardless of the extent to which the oil has been processed,
				if at all.</text>
					</paragraph><paragraph id="H84DF1BCEAB3F4A03B1880E981D092454"><enum>(3)</enum><header>Limitation</header><text>Nothing
				in this subsection authorizes the Secretary to prescribe standards for the
				movement of oil through production, refining, or manufacturing facilities, or
				through oil production flow lines located on the grounds of
				wells.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H09CC4CFBA4C14FD58D459A8312E828AF"><enum>12.</enum><header>Cost recovery for
			 design reviews</header>
			<subsection id="H8A6B8818F3FD46C2B3F112BCDB5146C2"><enum>(a)</enum><header>In
			 general</header><text>Section 60117(n) is amended to read as follows:</text>
				<quoted-block changed="added" committee-id="HPW00" id="H2B75F56504C14556B2ABD5F0D7D513DF" reported-display-style="italic" style="OLC">
					<subsection id="H197CBAAE72064D4289737A1D138EFA63"><enum>(n)</enum><header>Cost recovery for
				design reviews</header>
						<paragraph id="HD2B771BF90704B3E93D938835D0EFDBE"><enum>(1)</enum><header>In general</header>
							<subparagraph id="H63A4E863CB5A449E9BB6C9FA5590A6B3"><enum>(A)</enum><header>Review
				costs</header><text display-inline="yes-display-inline">For any project
				described in subparagraph (B), if the Secretary conducts facility design safety
				reviews in connection with a proposal to construct, expand, or operate a new
				gas or hazardous liquid pipeline facility or liquefied natural gas pipeline
				facility, the Secretary may require the person proposing the project to pay the
				costs incurred by the Secretary relating to such reviews. If the Secretary
				exercises the cost recovery authority described in this subsection, the
				Secretary shall prescribe a fee structure and assessment methodology that is
				based on the costs of providing these reviews and shall prescribe procedures to
				collect fees under this subsection. The Secretary shall not collect design
				safety review fees under this chapter and section 60301 for the same design
				safety review.</text>
							</subparagraph><subparagraph id="H8FA0D45808B74C0997E4F8BE11825451"><enum>(B)</enum><header>Projects to which
				applicable</header><text>Subparagraph (A) applies to any project that—</text>
								<clause id="H031A5330C7784CB686840F93497759DD"><enum>(i)</enum><text>has design and
				construction costs totaling at least $3,400,000,000, as adjusted for inflation,
				based on a good faith estimate developed by the person proposing the project;
				or</text>
								</clause><clause id="H61DF1619CFA046C3AD325E0F0700B9BC"><enum>(ii)</enum><text>uses new or novel
				technologies or design.</text>
								</clause></subparagraph></paragraph><paragraph id="HA741CC185CEF46C39EEE6B9092CD44B0"><enum>(2)</enum><header>Notification</header><text>For
				any new pipeline facility construction project for which the Secretary will
				conduct design reviews, the person proposing the project shall notify the
				Secretary and provide the design specifications, construction plans and
				procedures, and related materials at least 120 days prior to the commencement
				of construction. If the Secretary determines that the proposed design of the
				project is inconsistent with pipeline safety, the Secretary shall provide
				written comments, feedback, and guidance on the project on or before the 60th
				day following the date of receipt of the design specifications, construction
				plans and procedures, and related materials for the project.</text>
						</paragraph><paragraph id="H28DC51B797EC4742BFDAA0A9A7D137FD"><enum>(3)</enum><header>Pipeline Safety Design
				Review Fund</header>
							<subparagraph id="H5283FC21FFA4484A89F9AF119B3EE8C1"><enum>(A)</enum><header>Establishment</header><text>There
				is established a Pipeline Safety Design Review Fund in the Treasury of the
				United States.</text>
							</subparagraph><subparagraph id="H4FF1907F7E904180BF3C6C84B16C78CF"><enum>(B)</enum><header>Deposits</header><text>The
				Secretary shall deposit funds paid under this subsection into the Fund.</text>
							</subparagraph><subparagraph id="H20E5C3F58B6A4F2FA2ED17354119B8AE"><enum>(C)</enum><header>Use</header><text display-inline="yes-display-inline">Amounts in the Fund shall be available to
				the Secretary, in amounts specified in appropriations Acts, to offset the costs
				of conducting facility design safety reviews under this subsection.</text>
							</subparagraph></paragraph><paragraph id="H293CC2EDC60E4B0E80C2739840C36128"><enum>(4)</enum><header>No additional
				permitting authority</header><text>Nothing in this subsection shall be
				construed as authorizing the Secretary to require a person to obtain a permit
				before beginning design and construction in connection with a project described
				in paragraph
				(1)(B).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HCD0B980E53064FD4BABD8C9949C8CDCE"><enum>(b)</enum><header>Guidance</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Secretary of
			 Transportation shall issue guidance to clarify the meaning of the term
			 <term>new or novel technologies or design</term> as used in section 60117(n) of
			 title 49, United States Code, as amended by subsection (a) of this
			 section.</text>
			</subsection></section><section id="H15A83C2B2EFB46CFAE7C0C89E90670F5"><enum>13.</enum><header>Biofuel
			 pipelines</header><text display-inline="no-display-inline">Section 60101(a)(4)
			 is amended—</text>
			<paragraph id="H9AC3AFB32FF54013843B0A278DC3D363"><enum>(1)</enum><text>in subparagraph (A) by
			 striking <quote>and</quote> after the semicolon;</text>
			</paragraph><paragraph id="HC20A7CC926BE49AB8CF6325E71BB078D"><enum>(2)</enum><text>by redesignating
			 subparagraph (B) as subparagraph (C); and</text>
			</paragraph><paragraph id="H99D44184756D47B1A8C5F411EB4613E8"><enum>(3)</enum><text>by inserting after
			 subparagraph (A) the following:</text>

			 pipelines</header><text display-inline="no-display-inline">Section 60102(i) is
			 amended to read as follows:</text>

				for the transportation of carbon dioxide by pipeline in a gaseous state.</text>
					</paragraph><paragraph id="HDEAFFBE7883F4CA2BEFCB8C66C33A8B0"><enum>(2)</enum><header>Standards applicable to
				certain pipelines</header><text>For pipelines that transport carbon dioxide in
				both a liquid and gaseous state, the Secretary shall apply standards, in effect
				on the date of enactment of the Pipeline Safety, Regulatory Certainty, and Job
				Creation Act of 2011, for the transportation of carbon dioxide by pipeline in a
				liquid state to the transportation of carbon dioxide by pipeline in a gaseous
				state.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H012BCE2C86C141E5A077ED5983272ECB"><enum>15.</enum><header>Study of transportation
			 of diluted bitumen</header><text display-inline="no-display-inline">Not later
			 than 18 months after the date of enactment of this Act, the Secretary of
			 Transportation shall complete a comprehensive review of hazardous liquid
			 pipeline facility regulations to determine whether these regulations are
			 sufficient to regulate pipeline facilities used for the transportation of
			 diluted bitumen. In conducting this review, the Secretary shall conduct an
			 analysis of whether any increase in risk of release exists for pipeline
			 facilities transporting diluted bitumen. The Secretary shall report the results
			 of this review to the Senate Committee on Commerce, Science, and Transportation
			 and the House of Representatives Committee on Transportation and Infrastructure
			 and Committee on Energy and Commerce.</text>
		</section><section id="HAAAEEF30A5FE4609BB877F87B85E09F8"><enum>16.</enum><header>Study of non-petroleum
			 hazardous liquids transported by pipeline</header><text display-inline="no-display-inline">The Secretary of Transportation may conduct
			 an analysis of the transportation of non-petroleum hazardous liquids by
			 pipeline facility for the purpose of identifying the extent to which pipeline
			 facilities are currently being used to transport non-petroleum hazardous
			 liquids, such as chlorine, from chemical production facilities across land
			 areas not owned by the producer that are accessible to the public. The analysis
			 should identify the extent to which the safety of the pipeline facilities is
			 unregulated by the States and evaluate whether the transportation of such
			 chemicals by pipeline facility across areas accessible to the public would
			 present significant risks to public safety, property, or the environment in the
			 absence of regulation. The results of the analysis shall be made available to
			 the Senate Committee on Commerce, Science, and Transportation and the House of
			 Representatives Committee on Transportation and Infrastructure and Committee on
			 Energy and Commerce.</text>
		</section><section id="HE2DE9FAFC9EA4285A63C740902B4C1B9"><enum>17.</enum><header>Clarifications</header>
			<subsection id="H7C36B5E4A03645E2A1AF21E3E03830FA"><enum>(a)</enum><header>Amendment of procedures
			 clarification</header><text>Section 60108(a)(1) is amended by striking
			 <quote>an intrastate</quote> and inserting <quote>a</quote>.</text>
			</subsection><subsection id="HC563F3916278466CA548E6C7E0937EE5"><enum>(b)</enum><header>Owner and operator
			 clarification</header><text>Section 60102(a)(2)(A) is amended by striking
			 <quote>owners and operators</quote> and inserting <quote>any or all of the
			 owners or operators</quote>.</text>
			</subsection></section><section id="HF938C98177D0495D9349D541489D3E6B"><enum>18.</enum><header>Maintenance of
			 effort</header><text display-inline="no-display-inline">Section 60107(b) is
			 amended by adding at the end the following: <quote>For each of fiscal years
			 2012 and 2013, the Secretary shall grant such a wavier to a State if the State
			 can demonstrate an inability to maintain or increase the required funding share
			 of its pipeline safety program at or above the level required by this
			 subsection due to economic hardship in that State. For fiscal year 2014 and
			 each fiscal year thereafter, the Secretary may grant such a waiver to a State
			 if the State can make the demonstration described in the preceding
			 sentence.</quote>.</text>
		</section><section id="H4340A454177B44E6B09832842AB37856"><enum>19.</enum><header>Administrative
			 enforcement process</header>
			<subsection id="H5C69DB2130B94BD5A0B2FC1FA8454F2B"><enum>(a)</enum><header>Issuance of
			 regulations</header>
				<paragraph id="H5EAE125037D541EFAF0D665728B4C8E1"><enum>(1)</enum><header>In
			 general</header><text>Not later than 2 years after the date of enactment of
			 this Act, the Secretary shall prescribe regulations—</text>
					<subparagraph id="H29D4A457398649788F8DD3B270536298"><enum>(A)</enum><text>requiring hearings under
			 sections 60112, 60117, 60118, and 60122 to be convened before a presiding
			 official;</text>
					</subparagraph><subparagraph id="HE04A833DDFAA4E608A0F1DFB798B567D"><enum>(B)</enum><text>providing the opportunity
			 for any person requesting a hearing under section 60112, 60117, 60118, or 60122
			 to arrange for a transcript of that hearing, at the expense of the requesting
			 person;</text>
					</subparagraph><subparagraph id="H32B21C05132444A38DA3D613A4546413"><enum>(C)</enum><text display-inline="yes-display-inline">ensuring expedited review of any order
			 issued pursuant to section 60112(e);</text>
					</subparagraph><subparagraph id="H7E975F2844A54A9C8D6B50D635ABA021"><enum>(D)</enum><text>implementing a separation
			 of functions between personnel involved with investigative and prosecutorial
			 activities and advising the Secretary on findings and determinations;
			 and</text>
					</subparagraph><subparagraph id="H676738C03B37415AB7B1A69613672D6C"><enum>(E)</enum><text>prohibiting ex-parte
			 communication relevant to the question to be decided in the case by parties to
			 an investigation or hearing.</text>
					</subparagraph></paragraph><paragraph id="H4850ADEB63C44F0ABA7DAE533D7CFDC8"><enum>(2)</enum><header>Presiding
			 official</header><text>The regulations prescribed under this subsection
			 shall—</text>
					<subparagraph id="H12953BEB721C4A9AA9680225FA85A3F2"><enum>(A)</enum><text>define the term
			 <term>presiding official</term> to mean the person who conducts any hearing
			 relating to civil penalty assessments, compliance orders, safety orders, or
			 corrective action orders; and</text>
					</subparagraph><subparagraph id="H50069030E02B4870A60B5571AF1866F1"><enum>(B)</enum><text>require that the
			 presiding official must be an attorney on the staff of the Deputy Chief Counsel
			 that is not engaged in investigative or prosecutorial functions, including the
			 preparation of notices of probable violations, notices relating to civil
			 penalty assessments, notices relating to compliance, or notices of proposed
			 corrective actions.</text>
					</subparagraph></paragraph><paragraph id="H63CFDE87513940DDB24A62934EBDE820"><enum>(3)</enum><header>Expedited
			 review</header><text display-inline="yes-display-inline">The regulations
			 prescribed under this subsection shall define the term <term>expedited
			 review</term> for the purposes of paragraph (1)(C).</text>
				</paragraph></subsection><subsection id="H71272C43FFCE41F7B418563C60AD55FB"><enum>(b)</enum><header>Standards of judicial
			 review</header><text>Section 60119(a) is amended by adding at the end the
			 following new paragraph:</text>
				<quoted-block changed="added" committee-id="HPW00" id="H00C2E6A017EC4269ACF35C867DA051A6" reported-display-style="italic" style="OLC">
					<paragraph id="H9270058F05A344509A803F14B65F53AC" indent="up1"><enum>(3)</enum><text>A judicial review of
				agency action under this section shall apply the standards of review
				established in section 706 of title
				5.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" id="HAAFDD9B4546C442A9CDD3FDB00176045"><enum>20.</enum><header>Gas and hazardous
			 liquid gathering lines</header>
			<subsection id="H82DBD666F19841DD80CA10E38CFC8230"><enum>(a)</enum><header>Review</header><text display-inline="yes-display-inline">The Secretary of Transportation shall
			 complete a review of existing Federal and State regulations for gas and
			 hazardous liquid gathering lines located onshore and offshore in the United
			 States, including within the inlets of the Gulf of Mexico.</text>
			</subsection><subsection id="H5B4C0C8C7C634F92B63611BF2EFE21A2"><enum>(b)</enum><header>Report to
			 Congress</header>
				<paragraph id="HDC5F8C40CF6B47A5A5EE49323341CB93"><enum>(1)</enum><header>In
			 general</header><text>Not later than 2 years after the date of enactment of
			 this Act, the Secretary shall submit to the House of Representatives Committee
			 on Transportation and Infrastructure and Committee on Energy and Commerce and
			 the Senate Committee on Commerce, Science, and Transportation a report on the
			 results of the review.</text>
				</paragraph><paragraph id="H7E51A952420D4CBB968ABAAEB9982E67"><enum>(2)</enum><header>Recommendations</header><text>The
			 report shall include the Secretary’s recommendations with respect to—</text>
					<subparagraph id="HD731F21C9AC042D781D13CCD8D424D51"><enum>(A)</enum><text>the sufficiency of
			 existing Federal and State laws and regulations to ensure the safety of gas and
			 hazardous liquid gathering lines;</text>
					</subparagraph><subparagraph id="HCEC3F714D9194399A0EB8EDA83E2F508"><enum>(B)</enum><text>quantifying the
			 economical and technical practicability and challenges of applying existing
			 Federal regulations to gathering lines that are currently not subject to
			 Federal regulation when compared to the public safety benefits; and</text>
					</subparagraph><subparagraph id="H353DEE0B3B38439B8EB34A81FCE385D5"><enum>(C)</enum><text>subject to a risk-based
			 assessment, the need to modify or revoke existing exemptions from Federal
			 regulation for gas and hazardous liquid gathering lines.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" id="H5D519C29676940859D953A76B91B7952"><enum>21.</enum><header>Authorization of
			 appropriations</header>
			<subsection commented="no" id="H53899044D7C7478EA0D08E6A62A4F169"><enum>(a)</enum><header>Gas and hazardous
			 liquid</header><text display-inline="yes-display-inline">Section 60125(a) is
			 amended to read as follows:</text>

				Transportation for each of fiscal years 2012 through 2015, from fees collected
				under section 60301, $88,014,000, of which $4,686,000 is for carrying out such
				section 12 and $34,461,000 is for making grants.</text>
						</paragraph><paragraph id="H4C06AD370B464D9EB41F3A259FAFD938"><enum>(2)</enum><header>Trust fund
				amounts</header><text>In addition to the amounts authorized to be appropriated
				by paragraph (1), there is authorized to be appropriated for each of fiscal
				years 2012 through 2015 from the Oil Spill Liability Trust Fund to carry out
				the provisions of this chapter related to hazardous liquid and section 12 of
				the Pipeline Safety Improvement Act of 2002 (49 U.S.C. 60101 note; Public Law
				107–355), $18,905,000, of which $2,185,000 is for carrying out such section 12
				and $4,985,000 is for making
				grants.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H196A4F30168D4F129C68AB1F9E9F9E23"><enum>(b)</enum><header>Emergency response
			 grants</header><text>Section 60125(b)(2) is amended by striking <quote>2007
			 through 2010</quote> and inserting <quote>2012 through 2015</quote>.</text>
			</subsection><subsection commented="no" id="H419961F2A08F4DE58AD864A1E500753E"><enum>(c)</enum><header>One-Call notification
			 programs</header><text>Section 6107 is amended—</text>

					<subparagraph id="HD3D27B105D2E4A1E8CE0300CC0664088"><enum>(A)</enum><text>by inserting <quote>to
			 grant recipients and their contractors</quote> after <quote>this
			 section</quote>; and</text>
					</subparagraph><subparagraph id="HD5706C34D6E547288DE46A8190316876"><enum>(B)</enum><text>by inserting <quote>, for
			 any type of advocacy activity for or against a pipeline construction or
			 expansion project,</quote> after <quote>for lobbying</quote>; and</text>
					</subparagraph></paragraph><paragraph commented="no" id="HBEE1474C65704538A427DA53A0EA80D4"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d) by striking

				out by the participating agencies, the Secretary of Transportation shall
				prepare a research and development program plan every 5 years thereafter and
				shall transmit a report to Congress on the status and results-to-date of
				implementation of the program every 2 years.</text>
							</subparagraph><subparagraph id="H453934EC5B6B4183B96333E9028356D8"><enum>(B)</enum><header>Consultation</header><text>The
				Secretary of Transportation shall comply with the consultation requirements of
				subsection (d)(2) when preparing the program plan and in the selection and
				prioritization of research and development projects.</text>
							</subparagraph><subparagraph id="HF507985B6D714095A4EA0601EB4FBE68"><enum>(C)</enum><header>Funding from
				non-Federal sources</header><text>When carrying out research and development
				activities, the Secretary, to the greatest extent practicable, shall obtain
				funding for research and development projects from non-Federal
				sources.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
