		provisions relating to trade adjustment assistance</header>
								<subsection id="IDceadbd7c88334a5bb43c1e91f4844718"><enum>(a)</enum><header>Repeal of
		snapback</header><text>Section 1893 of the Trade and Globalization Adjustment
		Assistance Act of 2009 (Public Law 111–5; 123 Stat. 422) is repealed.</text>
								</subsection><subsection id="id6EA97EA1E0D74E9496F932CF04F9C024"><enum>(b)</enum><header>Applicability
		of certain provisions</header><text>Except as otherwise provided in this
		subtitle, the provisions of chapters 2 through 6 of title II of the Trade Act
		of 1974, as in effect on February 12, 2011, and as amended by this subtitle,
		shall—</text>
									<paragraph id="id9B89D6E14B9E40B99E6BB58294680A19"><enum>(1)</enum><text>take
		effect on the date of the enactment of this Act; and</text>
									</paragraph><paragraph id="ID44b87c411e9e4c00a661d24bb49a1ebc"><enum>(2)</enum><text>apply to
		petitions for certification filed under chapters 2, 3, or 6 of title II of the
		Trade Act of 1974 on or after such date of enactment.</text>
									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2E971A4A46F04DA3A76E3742A8D49E70"><enum>(c)</enum><header>References</header><text>Except
		as otherwise provided in this subtitle, whenever in this subtitle an amendment
		or repeal is expressed in terms of an amendment to, or repeal of, a provision
		of chapters 2 through 6 of title II of the Trade Act of 1974, the reference
		shall be considered to be made to a provision of any such chapter, as in effect
		on February 12, 2011.</text>

		adjustment assistance for workers</header>

		eligibility requirements</header>
								<subsection id="ID548fa7cfe0954233b015f254b8f9ce0b"><enum>(a)</enum><header>In
		general</header><text>Section 222 of the Trade Act of 1974 (19 U.S.C. 2272) is
		amended—</text>
									<paragraph id="ID1ccb651e54ff44fca6e4f1b96c512ab4"><enum>(1)</enum><text>by
		striking subsection (b);</text>
									</paragraph><paragraph id="ID33aa012b6586422fb4f2e2b6c35f07a2"><enum>(2)</enum><text>by
		redesignating subsections (c) through (f) as subsections (b) through (e),
		respectively;</text>
									</paragraph><paragraph id="id935B9CBA7AB24D30BA44F67258E23AED"><enum>(3)</enum><text>in
		paragraph (2) of subsection (b), as redesignated, by striking

		general</header><text>Section 231(c) of the Trade Act of 1974 (19 U.S.C.
		2291(c)) is amended—</text>
									<paragraph id="id4BB655305BA34A38979452D66CD0297B"><enum>(1)</enum><text>in
		paragraph (1)—</text>
										<subparagraph id="IDecb50be199934d8182d25922890f25d6"><enum>(A)</enum><text>by striking
		subparagraphs (A), (B), and (C); and</text>
										</subparagraph><subparagraph id="IDd76ea467c4af45aa8eb41422fede9ee1"><enum>(B)</enum><text>by redesignating
		subparagraphs (D), (E), and (F) as subparagraphs (A), (B), and (C),
		respectively; and</text>
										</subparagraph></paragraph><paragraph id="idB998260E07EF42A6810E8448D195EC84"><enum>(2)</enum><text>in
		paragraph (3)(B), by striking <quote>(D), (E), or (F)</quote> and inserting

									</paragraph></subsection><subsection commented="no" id="ID33ddeec9393541e7909e4bd0482190e3"><enum>(b)</enum><header>Good cause
		exception</header><text>Section 234(b) of the Trade Act of 1974 (19 U.S.C.
		2294(b)) is amended to read as follows:</text>

										<subsection commented="no" id="ID158d7b133e094593a1294a2d6f399932"><enum>(b)</enum><header>Special rule on
		  good cause for waiver of time limits or late filing of claims</header><text>The
		  Secretary shall establish procedures and criteria that allow for a waiver for
		  good cause of the time limitations with respect to an application for a trade
		  readjustment allowance or enrollment in training under this
		  chapter.</text>
										</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
								</subsection></section><section id="IDcb9f85f547c44cc2aa23d7bb2d8393c9"><enum>213.</enum><header>Limitations on
		trade readjustment allowances</header><text display-inline="no-display-inline">Section 233 of the Trade Act of 1974 (19
		U.S.C. 2293) is amended—</text>
								<paragraph id="IDb80a6d366d7345d5ada7d9bde6214e12"><enum>(1)</enum><text>in
		subsection (a)—</text>
									<subparagraph id="id5C26690092364A0DA19190D201CCFFC4"><enum>(A)</enum><text>in paragraph (2),
		in the matter preceding subparagraph (A), by striking <quote>(or</quote> and
		all that follows through <quote>period)</quote>; and</text>
									</subparagraph><subparagraph id="ID534a91e04235423ab6d6b7f07dedaadb"><enum>(B)</enum><text>in paragraph
		(3)—</text>
										<clause id="idE78C895066DD447AA44917357E840E0D"><enum>(i)</enum><text>in the
		matter preceding subparagraph (A), by striking <quote>78</quote> and inserting
		<quote>65</quote>; and</text>
										</clause><clause id="IDa3b206cc66794e1ba21ce7fb73307d71"><enum>(ii)</enum><text>by
		striking <quote>91-week period</quote> each place it appears and inserting
		<quote>78-week period</quote>; and</text>

		amending subsection (f) to read as follows:</text>
									<quoted-block display-inline="no-display-inline" id="id27CA893DA7ED41D2BB0A4F296310C8A8" style="OLC">
										<subsection commented="no" id="IDa0952018036641c6936f2dfc992264fb"><enum>(f)</enum><header>Payment of
		  trade readjustment allowances to complete
		  training</header><text>Notwithstanding any other provision of this section, in
		  order to assist an adversely affected worker to complete training approved for
		  the worker under section 236 that leads to the completion of a degree or
		  industry-recognized credential, payments may be made as trade readjustment
		  allowances for not more than 13 weeks within such period of eligibility as the
		  Secretary may prescribe to account for a break in training or for justifiable
		  cause that follows the last week for which the worker is otherwise entitled to
		  a trade readjustment allowance under this chapter if—</text>
											<paragraph commented="no" id="IDc17a981bb88c4dcd8b8936403f63b802"><enum>(1)</enum><text>payment of the
		  trade readjustment allowance for not more than 13 weeks is necessary for the
		  worker to complete the training;</text>
											</paragraph><paragraph commented="no" id="ID0aad62a1278a49b1adc25680ca7a530b"><enum>(2)</enum><text>the worker
		  participates in training in each such week; and</text>
											</paragraph><paragraph commented="no" id="ID7d7952c90e244e6eb83c75cc89bfdfbb"><enum>(3)</enum><text>the
		  worker—</text>
												<subparagraph commented="no" id="idE96AAB0E13404F60ABBEFC260FEA1039"><enum>(A)</enum><text>has substantially
		  met the performance benchmarks established as part of the training approved for
		  the worker;</text>
												</subparagraph><subparagraph commented="no" id="id535625DAF7974CC5A66F5FB944A03855"><enum>(B)</enum><text>is expected to
		  continue to make progress toward the completion of the training; and</text>
												</subparagraph><subparagraph commented="no" id="id49B0ECB6E00242EBA078028F4D778A6D"><enum>(C)</enum><text>will complete the
		  training during that period of
		  eligibility.</text>
												</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
								</paragraph></section><section id="ID4868c487ecf842849ff107e9844ae4b4"><enum>214.</enum><header>Funding of
		training, employment and case management services, and job search and
		relocation allowances</header>
								<subsection id="IDc2a48c9a10914dc0aafe25fc5d99cb0f"><enum>(a)</enum><header>In
		general</header><text>Section 236(a)(2) of the Trade Act of 1974 (19 U.S.C.
		2296(a)(2)) is amended—</text>
									<paragraph id="id3143DEC35E4B427E85B4E9D643B17E5A"><enum>(1)</enum><text>by
		inserting <quote>and sections 235, 237, and 238</quote> after <quote>to carry
		out this section</quote> each place it appears;</text>
									</paragraph><paragraph id="idC62AA57C0632421DAF22437DAAD91BCA"><enum>(2)</enum><text>in
		subparagraph (A)—</text>
										<subparagraph id="id97E3E18FACE547C79CFF76FB83111261"><enum>(A)</enum><text>in the matter
		preceding clause (i), by striking <quote>of payments that may be made under
		paragraph (1)</quote> and inserting <quote>of funds available to carry out this
		section and sections 235, 237, and 238</quote>; and</text>
										</subparagraph><subparagraph id="id03FB3DCD29C1415E9537D069F18F3AB1"><enum>(B)</enum><text>by striking
		clauses (i) and (ii) and inserting the following:</text>

		  years 2012 and 2013; and</text>
												</clause><clause id="id81CCFE172D1D46B29FF6F9A936E32622" indent="up1"><enum>(ii)</enum><text>$143,750,000 for the 3-month
		  period beginning on October 1, 2013, and ending on December 31,
		  2013.</text>
												</clause><after-quoted-block>; </after-quoted-block></quoted-block>
										</subparagraph></paragraph><paragraph id="id0951FBAC08BA4F8D84BFFDF11DEB5B95"><enum>(3)</enum><text>in
		subparagraph (C)(ii)(V), by striking <quote>relating to the provision of
		training under this section</quote> and inserting <quote>to carry out this
		section and sections 235, 237, and 238</quote>; and</text>
									</paragraph><paragraph id="idEF5552E261BE4FC8B37AA07306B7CF99"><enum>(4)</enum><text>in
		subparagraph (E), by striking <quote>to pay the costs of training approved
		under this section</quote> and inserting <quote>to carry out this section and

		administrative expenses and employment and case management services</header>
									<paragraph commented="no" id="id405D77F5CC644972A795DBF9C87F1684"><enum>(1)</enum><header>In
		general</header><text display-inline="yes-display-inline">Section 235A of the
		Trade Act of 1974 (19 U.S.C. 2295a) is amended—</text>
										<subparagraph commented="no" id="id343CB00D63674C50BBE9C1C9356E3EBB"><enum>(A)</enum><text display-inline="yes-display-inline">in the section heading, by striking
		<quote><header-in-text level="section" style="OLC">Funding
		for</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Limitations on</header-in-text></quote>; and</text>
										</subparagraph><subparagraph commented="no" id="id2299A4867CAC4814991449BB1C1BBB16"><enum>(B)</enum><text>by striking
		subsections (a) and (b) and inserting the following:</text>
											<quoted-block display-inline="no-display-inline" id="idB458CAD43F834F46ADE3C361A92D99DA" style="OLC">
												<section display-inline="yes-display-inline" id="id7AD134C227D4433E98D88AED06195BEC" section-type="undesignated-section"><text display-inline="no-display-inline">Of
		  the funds made available to a State to carry out sections 235 through 238 for a
		  fiscal year, the State shall use—</text>
													<paragraph commented="no" id="ID84330A33393A49ACA2D2132FBD63610B"><enum>(1)</enum><text>not more than 10
		  percent for the administration of the trade adjustment assistance for workers
		  program under this chapter, including for—</text>
														<subparagraph commented="no" id="ID877C7DD0BBD548F9B3EB966222F723F1"><enum>(A)</enum><text>processing
		  waivers of training requirements under section 231;</text>
														</subparagraph><subparagraph commented="no" id="IDDA866ED86BC344ADB4C38664CFAFD2F2"><enum>(B)</enum><text>collecting,
		  validating, and reporting data required under this chapter; and</text>
														</subparagraph><subparagraph commented="no" id="ID705EA886D3E647058D3C7C62D015A5CB"><enum>(C)</enum><text>providing
		  reemployment trade adjustment assistance under section 246; and</text>
														</subparagraph></paragraph><paragraph commented="no" id="ID2BFB08757F9F4D17A0C5A068E2E33968"><enum>(2)</enum><text>not less than 5
		  percent for employment and case management services under section
		  235.</text>

		  general</header><text>The Secretary may—</text>

		  that were allotted to any State to carry out sections 235 through 238 and that
		  remain unobligated by the State during the second or third fiscal year after
		  the fiscal year in which the funds were provided to the State; and</text>
												</subparagraph><subparagraph commented="no" id="id31BB7324D915401881D8F082B3C75F1D"><enum>(B)</enum><text>provide such
		  realloted funds to States to carry out sections 235 through 238 in accordance
		  with procedures established by the Secretary.</text>
												</subparagraph></paragraph><paragraph commented="no" id="id7C74AF6FFA514BB0BE6BDC93979F045E"><enum>(2)</enum><header>Requests by
		  States</header><text>In establishing procedures under paragraph (1)(B), the
		  Secretary shall include procedures that provide for the distribution of
		  realloted funds under that paragraph pursuant to requests submitted by States
		  in need of such funds.</text>
											</paragraph><paragraph commented="no" id="id656EEAE370D7462EBC43E0B46B49CE98"><enum>(3)</enum><header>Availability of
		  amounts</header><text>The reallotment of funds under paragraph (1) shall not
		  extend the period for which such funds are available for
		  expenditure.</text>

		  confidential information</header>
													<paragraph id="id41F585DB57C84771AE075AC2F4F5C49B"><enum>(1)</enum><header>In
		  general</header><text>The Secretary may not release information described in
		  subsection (a) that the Secretary considers to be confidential business
		  information unless the person submitting the confidential business information
		  had notice, at the time of submission, that such information would be released
		  by the Secretary, or such person subsequently consents to the release of the
		  information.</text>
													</paragraph><paragraph id="id5BEE61939CFE4020B794E53439B7B1B2"><enum>(2)</enum><header>Rule of
		  construction</header><text>Nothing in this subsection shall be construed to
		  prohibit the Secretary from providing information the Secretary considers to be
		  confidential business information under paragraph (1) to a court in camera or
		  to another party under a protective order issued by a

		  petitions filed.</text>
												</paragraph><paragraph id="ID81ef5f7e463a460ab6f5ce3927ec8647"><enum>(4)</enum><text>The number of

		provisions</header>
							<section id="IDeb2a62686c82426e9ceb3e127b9d51a8"><enum>231.</enum><header>Applicability
		of trade adjustment assistance provisions</header>
								<subsection id="ID0b819de241f3445c9b6df7c677685e2d"><enum>(a)</enum><header>Trade
		adjustment assistance for workers</header>
									<paragraph id="id8959DA11A0F148B7ABCB56DF59BFAE2E"><enum>(1)</enum><header>Petitions filed
		on or after February 13, 2011, and before date of enactment</header>
										<subparagraph id="id598239417421499D8F93A757310C01EA"><enum>(A)</enum><header>Certifications
		of workers not certified before date of enactment</header>
											<clause id="ID864220aa454f47a0823e77064dc5192d"><enum>(i)</enum><header>Criteria if a
		determination has not been made</header><text>If, as of the date of the
		enactment of this Act, the Secretary of Labor has not made a determination with
		respect to whether to certify a group of workers as eligible to apply for
		adjustment assistance under section 222 of the Trade Act of 1974 pursuant to a
		petition described in clause (iii), the Secretary shall make that determination
		based on the requirements of section 222 of the Trade Act of 1974, as in effect
		on such date of enactment.</text>
											</clause><clause id="IDe81b6e15525148f5ac026056b1cfd7a5"><enum>(ii)</enum><header>Reconsideration
		of denials of certifications</header><text>If, before the date of the enactment
		of this Act, the Secretary made a determination not to certify a group of
		workers as eligible to apply for adjustment assistance under section 222 of the
		Trade Act of 1974 pursuant to a petition described in clause (iii), the
		Secretary shall—</text>
												<subclause id="IDde11e1bdf7624f74973454cf72bef4d6"><enum>(I)</enum><text>reconsider that
		determination; and</text>
												</subclause><subclause id="ID79565e8ee0684cbbbd3946f0a1d9029c"><enum>(II)</enum><text>if
		the group of workers meets the requirements of section 222 of the Trade Act of
		1974, as in effect on such date of enactment, certify the group of workers as
		eligible to apply for adjustment assistance.</text>
												</subclause></clause><clause id="ID0d2b0e9bd52644ef8704b99744980a3d"><enum>(iii)</enum><header>Petition
		described</header><text>A petition described in this clause is a petition for a
		certification of eligibility for a group of workers filed under section 221 of
		the Trade Act of 1974 on or after February 13, 2011, and before the date of the
		enactment of this Act.</text>
											</clause></subparagraph><subparagraph id="idEF988830749D4BC19982F559718D26E1"><enum>(B)</enum><header>Eligibility for
		benefits</header>
											<clause id="id1EF0D45E800F4ED8AA7972E6E8468DD3"><enum>(i)</enum><header>In
		general</header><text>Except as provided in clause (ii), a worker certified as
		eligible to apply for adjustment assistance under section 222 of the Trade Act
		of 1974 pursuant to a petition described in subparagraph (A)(iii) shall be
		eligible, on and after the date that is 60 days after the date of the enactment
		of this Act, to receive benefits only under the provisions of chapter 2 of
		title II of the Trade Act of 1974, as in effect on such date of
		enactment.</text>
											</clause><clause id="idFA6DBE2A866F4B338C480C4F3C75CD85"><enum>(ii)</enum><header>Election for
		workers receiving benefits on the 60th day after enactment</header>
												<subclause id="idCE3086CCFA864C4691D15DF5D142B954"><enum>(I)</enum><header>In
		general</header><text>A worker certified as eligible to apply for adjustment
		assistance under section 222 of the Trade Act of 1974 pursuant to a petition
		described in subparagraph (A)(iii) who is receiving benefits under chapter 2 of
		title II of the Trade Act of 1974 as of the date that is 60 days after the date
		of the enactment of this Act may, not later than the date that is 150 days
		after such date of enactment, make a one-time election to receive benefits
		pursuant to—</text>
													<item commented="no" id="ID7233e09b328442a693333f6627db8aab"><enum>(aa)</enum><text>the provisions
		of chapter 2 of title II of the Trade Act of 1974, as in effect on such date of
		enactment; or</text>
													</item><item commented="no" id="ID942f40a8818b47679ddba131cdb54619"><enum>(bb)</enum><text>the provisions
		of chapter 2 of title II of the Trade Act of 1974, as in effect on February 13,
		2011.</text>
													</item></subclause><subclause commented="no" id="id0E1530BAB0D94F0A941EFF34481AACC2"><enum>(II)</enum><header>Effect of
		failure to make election</header><text>A worker described in subclause (I) who
		does not make the election described in that subclause on or before the date
		that is 150 days after the date of the enactment of this Act shall be eligible
		to receive benefits only under the provisions of chapter 2 of title II of the
		Trade Act of 1974, as in effect on February 13, 2011.</text>
												</subclause><subclause commented="no" id="IDb77368bd189d4418a0bed9bbfa8e4372"><enum>(III)</enum><header>Computation
		of maximum benefits</header><text>Benefits received by a worker described in
		subclause (I) under chapter 2 of title II of the Trade Act of 1974, as in
		effect on February 13, 2011, before the worker makes the election described in
		that subclause shall be included in any determination of the maximum benefits
		for which the worker is eligible under the provisions of chapter 2 of title II
		of the Trade Act of 1974, as in effect on the date of the enactment of this
		Act, or as in effect on February 13, 2011, whichever is applicable after the
		election of the worker under subclause (I).</text>
												</subclause></clause></subparagraph></paragraph><paragraph id="IDa1525c556dd34a0c826146113c0790c7"><enum>(2)</enum><header>Petitions filed
		before February 13, 2011</header><text>A worker certified as eligible to apply
		for adjustment assistance pursuant to a petition filed under section 221 of the
		Trade Act of 1974—</text>
										<subparagraph id="ID1a279bdda3d541e297e029ca32acf662"><enum>(A)</enum><text>on or after May
		18, 2009, and on or before February 12, 2011, shall continue to be eligible to
		apply for and receive benefits under the provisions of chapter 2 of title II of
		such Act, as in effect on February 12, 2011; or</text>
										</subparagraph><subparagraph id="ID62ceafd62ad342dba48a2233f32600f8"><enum>(B)</enum><text>before May 18,
		2009, shall continue to be eligible to apply for and receive benefits under the
		provisions of chapter 2 of title II of such Act, as in effect on May 17,
		2009.</text>
										</subparagraph></paragraph><paragraph id="ID118373a08a744078b5663130ce1a3931"><enum>(3)</enum><header>Qualifying
		separations with respect to petitions filed within 90 days of date of
		enactment</header><text>Section 223(b) of the Trade Act of 1974, as in effect
		on the date of the enactment of this Act, shall be applied and administered by
		substituting <quote>before February 13, 2010</quote> for <quote>more than one
		year before the date of the petition on which such certification was
		granted</quote> for purposes of determining whether a worker is eligible to
		apply for adjustment assistance pursuant to a petition filed under section 221
		of the Trade Act of 1974 on or after the date of the enactment of this Act and
		on or before the date that is 90 days after such date of enactment.</text>
									</paragraph></subsection><subsection id="ID7a46c28be6cf402eb41550f07473a22f"><enum>(b)</enum><header>Trade
		adjustment assistance for firms</header>
									<paragraph id="idCB62C52AB20A4A69B8220526B82114EA"><enum>(1)</enum><header>Certification
		of firms not certified before date of enactment</header>
										<subparagraph id="ID53b52334b31743bcb62fa26a5a579b36"><enum>(A)</enum><header>Criteria if a
		determination has not been made</header><text>If, as of the date of the
		enactment of this Act, the Secretary of Commerce has not made a determination
		with respect to whether to certify a firm as eligible to apply for adjustment
		assistance under section 251 of the Trade Act of 1974 pursuant to a petition
		described in subparagraph (C), the Secretary shall make that determination
		based on the requirements of section 251 of the Trade Act of 1974, as in effect
		on such date of enactment.</text>
										</subparagraph><subparagraph id="IDf7600c11802740e59555dca4434a479a"><enum>(B)</enum><header>Reconsideration
		of denial of certain petitions</header><text>If, before the date of the
		enactment of this Act, the Secretary made a determination not to certify a firm
		as eligible to apply for adjustment assistance under section 251 of the Trade
		Act of 1974 pursuant to a petition described in subparagraph (C), the Secretary
		shall—</text>
											<clause id="IDf7775056be9b4aeb9089e9f762a65a97"><enum>(i)</enum><text>reconsider that
		determination; and</text>
											</clause><clause id="ID6ee69e624f744d3687de4f94c2d91b7b"><enum>(ii)</enum><text>if the
		firm meets the requirements of section 251 of the Trade Act of 1974, as in
		effect on such date of enactment, certify the firm as eligible to apply for
		adjustment assistance.</text>
											</clause></subparagraph><subparagraph id="ID023fc5285a0843fca179f28cc36153b9"><enum>(C)</enum><header>Petition
		described</header><text>A petition described in this subparagraph is a petition
		for a certification of eligibility filed by a firm or its representative under
		section 251 of the Trade Act of 1974 on or after February 13, 2011, and before
		the date of the enactment of this Act.</text>
										</subparagraph></paragraph><paragraph id="id68E4FC971E3245D0AE9AA50EF05B8FAA"><enum>(2)</enum><header>Certification
		of firms that did not submit petitions between February 13, 2011, and date of
		enactment</header>
										<subparagraph id="id514DE6A2281B42B09EAC1C45364F3C1D"><enum>(A)</enum><header>In
		general</header><text>The Secretary of Commerce shall certify a firm described
		in subparagraph (B) as eligible to apply for adjustment assistance under
		section 251 of the Trade Act of 1974, as in effect on the date of the enactment
		of this Act, if the firm or its representative files a petition for a
		certification of eligibility under section 251 of the Trade Act of 1974 not
		later than 90 days after such date of enactment.</text>
										</subparagraph><subparagraph id="idBB0CD33415EF4B838467F359EDD638AF"><enum>(B)</enum><header>Firm
		described</header><text>A firm described in this subparagraph is a firm that
		the Secretary determines would have been certified as eligible to apply for
		adjustment assistance if—</text>
											<clause id="id3FC1574BF89D433A9A4F03176E8CEABC"><enum>(i)</enum><text>the
		firm or its representative had filed a petition for a certification of
		eligibility under section 251 of the Trade Act of 1974 on a date during the
		period beginning on February 13, 2011, and ending on the day before the date of
		the enactment of this Act; and</text>
											</clause><clause id="idE0D0AB436DBE4F299C03EF7669C4D840"><enum>(ii)</enum><text>the
		provisions of chapter 3 of title II of the Trade Act of 1974, as in effect on
		such date of enactment, had been in effect on that date during the period
		described in clause (i).</text>
											</clause></subparagraph></paragraph></subsection></section><section id="IDc24dc0aa8fdd46f6870b7216c921fba5"><enum>232.</enum><header>Termination
		provisions</header><text display-inline="no-display-inline">Section 285 of the
		Trade Act of 1974 (19 U.S.C. 2271 note) is amended—</text>
								<paragraph id="id2DE082A544014077A71680FB0C5448F0"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>February 12,
		2011</quote> each place it appears and inserting <quote>December 31,
		2013</quote>;</text>
								</paragraph><paragraph id="idDBF7B3402586487E8E21EBD363DD4AC5"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (a)(2)—</text>
									<subparagraph id="id6AF4EDA0218A4410890E07BAC7F7C7FB"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A),
		by striking <quote>that chapter</quote> and all that follows through <quote>the
		worker is—</quote> and inserting <quote>that chapter if the worker is—</quote>;
		and</text>
									</subparagraph><subparagraph id="id0B42E6B9A3214E8F84DE494C029E9D19"><enum>(B)</enum><text>in subparagraph

									</subparagraph></paragraph></section><section id="IDf77adbead997438db001023e958169d7"><enum>233.</enum><header>Sunset
		provisions</header>
								<subsection id="ID857006b5087e45639e5264c46e427265"><enum>(a)</enum><header>Application of
		prior law</header><text>Subject to subsection (b), beginning on January 1,
		2014, the provisions of chapters 2, 3, 5, and 6 of title II of the Trade Act of
		1974 (19 U.S.C. 2271 et seq.), as in effect on February 13, 2011, shall apply,
		except that in applying and administering such chapters—</text>
									<paragraph commented="no" id="IDa482d75fda5c428bad1236f9d6d3488c"><enum>(1)</enum><text>paragraph (1) of
		section 231(c) of that Act shall be applied and administered as if
		subparagraphs (A), (B), and (C) of that paragraph were not in effect;</text>
									</paragraph><paragraph commented="no" id="id5E9A2A23306449E492C8483C0A9512E2"><enum>(2)</enum><text>section 233 of
		that Act shall be applied and administered—</text>
										<subparagraph commented="no" id="id47E20D063BBE4B169CC61D4CFD3752B3"><enum>(A)</enum><text>in subsection
		(a)—</text>
											<clause commented="no" id="id9D28ABDB667F489CBD312AD63A00F892"><enum>(i)</enum><text>in paragraph (2),
		by substituting <quote>104-week period</quote> for <quote>104-week
		period</quote> and all that follows through <quote>130-week period)</quote>;
		and</text>
											</clause><clause commented="no" id="id8E50E0DB212C407DAC93A03BDC5226ED"><enum>(ii)</enum><text>in paragraph
		(3)—</text>
												<subclause commented="no" id="ID36d1ee7a8e2943328da9eaadb1e9458c"><enum>(I)</enum><text>in the matter
		preceding subparagraph (A), by substituting <quote>65</quote> for
		<quote>52</quote>; and</text>

		administering subsection (g) as if it read as follows:</text>
											<quoted-block display-inline="no-display-inline" id="id0B80106252364460950B991C65671EDF" style="OLC">
												<subsection commented="no" id="id7AB869E9D54442A4A0E6134134DDCEC2"><enum>(g)</enum><header>Payment of
		  trade readjustment allowances to complete
		  training</header><text>Notwithstanding any other provision of this section, in
		  order to assist an adversely affected worker to complete training approved for
		  the worker under section 236 that leads to the completion of a degree or
		  industry-recognized credential, payments may be made as trade readjustment
		  allowances for not more than 13 weeks within such period of eligibility as the
		  Secretary may prescribe to account for a break in training or for justifiable
		  cause that follows the last week for which the worker is otherwise entitled to
		  a trade readjustment allowance under this chapter if—</text>
													<paragraph commented="no" id="id5860687E0DD24AF4A77F3640E8A26972"><enum>(1)</enum><text>payment of the
		  trade readjustment allowance for not more than 13 weeks is necessary for the
		  worker to complete the training;</text>
													</paragraph><paragraph commented="no" id="id48633F16D0854B69ADB6B65CBF25CFCE"><enum>(2)</enum><text>the worker
		  participates in training in each such week; and</text>
													</paragraph><paragraph commented="no" id="idE9C86B961EE548C7B510BC867C859003"><enum>(3)</enum><text>the
		  worker—</text>
														<subparagraph commented="no" id="id52D6C3FFFCC24CBB9679773F29D25FF7"><enum>(A)</enum><text>has substantially
		  met the performance benchmarks established as part of the training approved for
		  the worker;</text>
														</subparagraph><subparagraph commented="no" id="idF53EDA61AE7748E4A021BBCC628C1D29"><enum>(B)</enum><text>is expected to
		  continue to make progress toward the completion of the training; and</text>
														</subparagraph><subparagraph commented="no" id="idA5A502AFAAEE40B19C4A4530270BAAE4"><enum>(C)</enum><text>will complete the
		  training during that period of
		  eligibility.</text>
														</subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
										</subparagraph></paragraph><paragraph commented="no" id="id19240ED9A1DC4A7AA3D772F784B81178"><enum>(3)</enum><text>section 245 of
		that Act shall be applied and administered by substituting <quote>2014</quote>
		for <quote>2007</quote>;</text>
									</paragraph><paragraph id="IDb4491044905646fca5615dfa977b9cf2"><enum>(4)</enum><text>section 246(b)(1)
		of that Act shall be applied and administered by substituting <quote>December
		31, 2014</quote> for <quote>the date that is 5 years</quote> and all that
		follows through <quote>State</quote>;</text>
									</paragraph><paragraph id="IDa70833bb0db04f6281113a47ea937a98"><enum>(5)</enum><text>section 256(b) of
		that Act shall be applied and administered by substituting <quote>the 1-year
		period beginning on January 1, 2014</quote> for <quote>each of fiscal years
		2003 through 2007, and $4,000,000 for the 3-month period beginning on October
		1, 2007</quote>;</text>
									</paragraph><paragraph id="ID832eea81600b46188b0833752342c9d5"><enum>(6)</enum><text>section 298(a) of
		that Act shall be applied and administered by substituting <quote>the 1-year
		period beginning on January 1, 2014</quote> for <quote>each of the fiscal
		years</quote> and all that follows through <quote>October 1, 2007</quote>;
		and</text>
									</paragraph><paragraph id="ID36b60656f25d4d3ead7a2a286cfa57a6"><enum>(7)</enum><text>section 285 of
		that Act shall be applied and administered—</text>
										<subparagraph id="IDdd861f4b96f948afa5c8d72fdddf4d9a"><enum>(A)</enum><text>in subsection
		(a), by substituting <quote>2014</quote> for <quote>2007</quote> each place it
		appears; and</text>
										</subparagraph><subparagraph id="ID189cd1812d6c4229aa15f29e7599063c"><enum>(B)</enum><text>by applying and
		administering subsection (b) as if it read as follows:</text>

		  general</header><text>Except as provided in subparagraph (B), assistance may
		  not be provided under chapter 3 after December 31, 2014.</text>
														</subparagraph><subparagraph id="ID9cc27fd4e16343cb834b0a70380f43bc"><enum>(B)</enum><header>Exception</header><text>Notwithstanding
		  subparagraph (A), any assistance approved under chapter 3 on or before December
		  31, 2014, may be provided—</text>
															<clause id="ID5b8d05b6e3914b659bbd3b55851af853"><enum>(i)</enum><text>to
		  the extent funds are available pursuant to such chapter for such purpose;
		  and</text>
															</clause><clause id="IDd855bf61ae20429c8a70839fc1755bc9"><enum>(ii)</enum><text>to
		  the extent the recipient of the assistance is otherwise eligible to receive
		  such assistance.</text>
															</clause></subparagraph></paragraph><paragraph commented="no" id="IDf0c07a498574426aa546759bf6cd6a44"><enum>(2)</enum><header>Farmers</header>
														<subparagraph commented="no" id="ID03e08bf115464637920000db44dd1e02"><enum>(A)</enum><header>In
		  general</header><text>Except as provided in subparagraph (B), assistance may
		  not be provided under chapter 6 after December 31, 2014.</text>
														</subparagraph><subparagraph commented="no" id="IDdddda9a2a8c849adaec2ffd2670d9b5c"><enum>(B)</enum><header>Exception</header><text>Notwithstanding
		  subparagraph (A), any assistance approved under chapter 6 on or before December
		  31, 2014, may be provided—</text>
															<clause commented="no" id="ID777e1c9bfa8545c9ba4a940cbdae4d81"><enum>(i)</enum><text>to the extent
		  funds are available pursuant to such chapter for such purpose; and</text>
															</clause><clause commented="no" id="ID76499399054647bc98e667072bd48d6a"><enum>(ii)</enum><text>to the extent
		  the recipient of the assistance is otherwise eligible to receive such
		  assistance.</text>
															</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
										</subparagraph></paragraph></subsection><subsection id="IDdaba3183c0144e6689e1dbb696d180ac"><enum>(b)</enum><header>Exceptions</header><text>The
		provisions of chapters 2, 3, 5, and 6 of title II of the Trade Act of 1974, as
		in effect on the date of the enactment of this Act, shall continue to apply on
		and after January 1, 2014, with respect to—</text>
									<paragraph id="IDc11cd099a9a645c38cbce2d2a687a26d"><enum>(1)</enum><text>workers certified
		as eligible for trade adjustment assistance benefits under chapter 2 of title
		II of that Act pursuant to petitions filed under section 221 of that Act before
		January 1, 2014;</text>
									</paragraph><paragraph id="ID1e43f51e05f348f083cda4153aed92ce"><enum>(2)</enum><text>firms certified
		as eligible for technical assistance or grants under chapter 3 of title II of
		that Act pursuant to petitions filed under section 251 of that Act before
		January 1, 2014; and</text>
									</paragraph><paragraph id="IDb538e494fd024b1dbcee4bb75f13a76d"><enum>(3)</enum><text>agricultural
		commodity producers certified as eligible for technical or financial assistance
		under chapter 6 of title II of that Act pursuant to petitions filed under
		section 292 of that Act before January 1, 2014.</text>
									</paragraph></subsection></section></part></subtitle><subtitle id="H6E0949CE0C2040B5BE40EF0D15812D8C"><enum>B</enum><header>Health
		Coverage Improvement</header>

								</paragraph><paragraph id="H789C990871B54A01BB6D892F5002A871"><enum>(2)</enum><header>Transitional
		rules</header>
									<subparagraph id="HAF62C870F2424927B53C911ED57D36CA"><enum>(A)</enum><header>Benefit
		determinations</header><text>Notwithstanding the amendments made by this
		section (and the provisions of law amended thereby), a plan shall not be
		required to modify benefit determinations for the period beginning on February
		13, 2011, and ending 30 days after the date of the enactment of this Act, but a
		plan shall not fail to be qualified health insurance within the meaning of
		section 35(e) of the Internal Revenue Code of 1986 during this period merely
		due to such failure to modify benefit determinations.</text>
									</subparagraph><subparagraph id="HB096E3B39936423EBDB41E0FFAB0F1F3"><enum>(B)</enum><header>Guidance
		concerning periods before 30 days after enactment</header><text>Except as
		provided in subparagraph (A), the Secretary of the Treasury (or his designee),
		in consultation with the Secretary of Health and Human Services and the
		Secretary of Labor, may issue regulations or other guidance regarding the scope
		of the application of the amendments made by this section to periods before the
		date which is 30 days after the date of the enactment of this Act.</text>
									</subparagraph><subparagraph commented="no" id="HBEC4DA0DBC394AF5973FE73D431CE537"><enum>(C)</enum><header>Special rule
		relating to certain loss of coverage</header><text>In the case of a TAA-related
		loss of coverage (as defined in section 4980B(f)(5)(C)(iv) of the Internal
		Revenue Code of 1986) that occurs during the period beginning on February 13,
		2011, and ending 30 days after the date of the enactment of this Act, the 7-day
		period described in section 9801(c)(2)(D) of the Internal Revenue Code of 1986,
		section 701(c)(2)(C) of the Employee Retirement Income Security Act of 1974,
		and section 2701(c)(2)(C) of the Public Health Service Act shall be extended
		until 30 days after such date of enactment.</text>
									</subparagraph></paragraph></subsection></section><section id="H813B459C07574BC1BD9B200F7BA6CCD4"><enum>243.</enum><header>Extension of
		COBRA benefits for certain TAA-eligible individuals and PBGC
		recipients</header>

		compensation program integrity</header>
							<section id="ID5cf98a8c4c764ccbb4a332999c82752d"><enum>251.</enum><header>Mandatory
		penalty assessment on fraud claims</header>
								<subsection id="IDf49bd1cfe4ba4d0c8dddf42ba556b5e3"><enum>(a)</enum><header>In
		general</header><text>Section 303(a) of the Social Security Act (42 U.S.C.
		503(a)) is amended—</text>
									<paragraph id="ID0e42d44e4ff84ea8a6a7144924bb779a"><enum>(1)</enum><text>in
		paragraph (10), by striking the period at the end of subparagraph (B) and
		inserting <quote>; and</quote>; and</text>
									</paragraph><paragraph id="ID1230a6a708154570bcf4130a8c12a0e9"><enum>(2)</enum><text>by
		adding at the end the following new paragraph:</text>

		  an individual due to fraud committed by such individual, the assessment of a
		  penalty on the individual in an amount of not less than 15 percent of the
		  amount of the erroneous payment; and</text>
												</subparagraph><subparagraph id="IDccf259d51fc349e6b3644af3a996b106" indent="up1"><enum>(B)</enum><text>The immediate deposit of all
		  assessments paid pursuant to subparagraph (A) into the unemployment fund of the
		  State.</text>
												</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
									</paragraph></subsection><subsection id="IDcf95467825444b7eab4a55f35f434d92"><enum>(b)</enum><header>Application to
		Federal payments</header>
									<paragraph id="idEC7C5569FAFF4AF19D2DA91FABFD6BFD"><enum>(1)</enum><header>In
		general</header><text>As a condition for administering any unemployment
		compensation program of the United States (as defined in paragraph (2)) as an
		agent of the United States, if the State determines that an erroneous payment
		was made by the State to an individual under any such program due to fraud
		committed by such individual, the State shall assess a penalty on such
		individual and deposit any such penalty received in the same manner as the
		State assesses and deposits such penalties under provisions of State law
		implementing section 303(a)(11) of the Social Security Act, as added by
		subsection (a).</text>
									</paragraph><paragraph id="ID6675889a938143fe8dbb27d39b51bacd"><enum>(2)</enum><header>Definition</header><text>For
		purposes of this subsection, the term <quote>unemployment compensation program
		of the United States</quote> means—</text>
										<subparagraph id="ID600abf8deba44d9db813e31433c7de84"><enum>(A)</enum><text>unemployment
		compensation for Federal civilian employees under subchapter I of chapter 85 of
		title 5, United States Code;</text>
										</subparagraph><subparagraph id="ID89ff4e5ec49e45fda4aaa2a7fe816fc7"><enum>(B)</enum><text>unemployment
		compensation for ex-servicemembers under subchapter II of chapter 85 of title
		5, United States Code;</text>
										</subparagraph><subparagraph id="IDc7a56c4b95a44a3698d3b71baf7b6477"><enum>(C)</enum><text>trade
		readjustment allowances under sections 231 through 234 of the Trade Act of 1974
		(19 U.S.C. 2291–2294);</text>
										</subparagraph><subparagraph id="ID9e3c8f4f2e5e4d5cb73b44114eb96fc9"><enum>(D)</enum><text>disaster
		unemployment assistance under section 410(a) of the Robert T. Stafford Disaster
		Relief and Emergency Assistance Act (42 U.S.C. 5177(a));</text>
										</subparagraph><subparagraph id="ID82e8665676ab4867a5ecca5c6bccadd9"><enum>(E)</enum><text>any Federal
		temporary extension of unemployment compensation;</text>
										</subparagraph><subparagraph id="ID7e1df0bbdf3945c8bc514390072fa861"><enum>(F)</enum><text>any Federal
		program which increases the weekly amount of unemployment compensation payable
		to individuals; and</text>
										</subparagraph><subparagraph id="ID39e9ab91b5ca456fb7420e22a9532723"><enum>(G)</enum><text>any other Federal
		program providing for the payment of unemployment compensation.</text>
										</subparagraph></paragraph></subsection><subsection id="IDc745b29ada824a93a4bc52b9c4dcbf7e"><enum>(c)</enum><header>Effective
		date</header>
									<paragraph id="idAE3A67A17C22421C8C54E2FFD7AA8F8C"><enum>(1)</enum><header>In
		general</header><text>Except as provided in paragraph (2), the amendments made
		by this section shall apply to erroneous payments established after the end of
		the 2-year period beginning on the date of the enactment of this Act.</text>
									</paragraph><paragraph id="idBDA6AAE919A94AA78434EB8489E02B55"><enum>(2)</enum><header>Authority</header><text>A
		State may amend its State law to apply such amendments to erroneous payments
		established prior to the end of the period described in paragraph (1).</text>

		noncharging due to employer fault</header>
								<subsection id="ID3ea15ae91bbc4553a508c4f9a4d5c0ca"><enum>(a)</enum><header>In
		general</header><text>Section 3303 of the Internal Revenue Code of 1986 is
		amended—</text>
									<paragraph id="idC83EFE37BF0E4847B193E5CB4FDFCC23"><enum>(1)</enum><text>by
		striking subsections (f) and (g); and</text>
									</paragraph><paragraph id="idF055C6BBFEBA46449B5619CA12635B5F"><enum>(2)</enum><text>by
		inserting after subsection (e) the following new subsection:</text>

											<subsection id="ID0f1ec70d39f64271b9d6e642d49a83c8"><enum>(f)</enum><header>Prohibition on

		  general</header><text>A State law shall be treated as meeting the requirements
		  of subsection (a)(1) only if such law provides that an employer’s account shall
		  not be relieved of charges relating to a payment from the State unemployment
		  fund if the State agency determines that—</text>
													<subparagraph id="idF008F1F3C7A643F88A7535DB3E15CBAC"><enum>(A)</enum><text>the payment was
		  made because the employer, or an agent of the employer, was at fault for
		  failing to respond timely or adequately to the request of the agency for
		  information relating to the claim for compensation; and</text>
													</subparagraph><subparagraph id="idA9D5528457EE46F5868BA6EC27919C59"><enum>(B)</enum><text>the employer or
		  agent has established a pattern of failing to respond timely or adequately to
		  such requests.</text>
													</subparagraph></paragraph><paragraph id="id07092B56FA4D445DB873ADD083779EA1"><enum>(2)</enum><header>State authority
		  to impose stricter standards</header><text>Nothing in paragraph (1) shall limit
		  the authority of a State to provide that an employer’s account not be relieved
		  of charges relating to a payment from the State unemployment fund for reasons
		  other than the reasons described in subparagraphs (A) and (B) of such
		  paragraph, such as after the first instance of a failure to respond timely or
		  adequately to requests described in paragraph
		  (1)(A).</text>
												</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
									</paragraph></subsection><subsection id="id52D3E17746F645A4B9AD01B42933D22B"><enum>(b)</enum><header>Effective
		date</header>

		rehired employees to the directory of new hires</header>
								<subsection id="ID54ce54c1995845d7b6be454f94d62025"><enum>(a)</enum><header>Definition of
		newly hired employee</header><text>Section 453A(a)(2) of the Social Security
		Act (42 U.S.C. 653a(a)(2)) is amended by adding at the end the
		following:</text>
									<quoted-block display-inline="no-display-inline" id="idE66DF8E0C81E4A0691189857E3798822" style="OLC">
										<subparagraph id="id3B7AA971F9ED482E9EF31248591FDF04"><enum>(C)</enum><header>Newly hired
		  employee</header><text>The term <term>newly hired employee</term> means an
		  employee who—</text>
											<clause id="idA85BC00AFFD94DA895E37C3F883985E9"><enum>(i)</enum><text>has
		  not previously been employed by the employer; or</text>
											</clause><clause id="id2AA63FFD190E4F3C8BA896AE1E8AFB79"><enum>(ii)</enum><text>was
		  previously employed by the employer but has been separated from such prior
		  employment for at least 60 consecutive
		  days.</text>
											</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
								</subsection><subsection id="ID5976c8846b984a4bacffb242d2c38e0d"><enum>(b)</enum><header>Effective
		date</header>
									<paragraph id="ID91b687f29deb4511871741ef987377e1"><enum>(1)</enum><header>In
		general</header><text>Subject to paragraph (2), the amendments made by this
		section shall take effect 6 months after the date of the enactment of this
		Act.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID36119841ba25429b80396334ee7a699f"><enum>(2)</enum><header>Compliance
		transition period</header><text>If the Secretary of Health and Human Services
		determines that State legislation (other than legislation appropriating funds)
		is required in order for a State plan under part D of title IV of the Social
		Security Act to meet the additional requirement imposed by the amendment made
		by subsection (a), the plan shall not be regarded as failing to meet such
		requirement before the first day of the second calendar quarter beginning after
		the close of the first regular session of the State legislature that begins
		after the effective date of such amendment. If the State has a 2-year
		legislative session, each year of the session is deemed to be a separate
		regular session of the State legislature.</text>
									</paragraph></subsection></section></part><part id="id512BB071C01C43069FA2D908AD3D37C5"><enum>II</enum><header>Additional

		  improvement. Quality improvement organizations operating as of January 1, 2012,
		  shall be allowed to compete for new contracts (as determined appropriate by the
		  Secretary) along with other qualified organizations and are eligible for
		  renewal of contracts for terms five years thereafter (as determined appropriate
		  by the
		  Secretary).</text>
												</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
										</subparagraph><subparagraph id="IDb466a4631a074beb8efad4bf564c962e"><enum>(B)</enum><text>in subsection
		(c), by striking paragraphs (4) through (6) and redesignating paragraphs (7)
		and (8) as paragraphs (4) and (5), respectively; and</text>
										</subparagraph><subparagraph id="ID974b3da6ad6e4bb2babf2779196dc619"><enum>(C)</enum><text>by striking
		subsection (d).</text>
										</subparagraph></paragraph><paragraph id="id8431C4DE1A9845E5A14A93066B124088"><enum>(4)</enum><header>Administrative
		improvement</header><text>Section 1153(c)(5) of the Social Security Act (42
		U.S.C. 1320c–2(c)(5)), as redesignated by this subsection, is amended to read
		as follows:</text>
										<quoted-block display-inline="no-display-inline" id="id85D7D7393ECD4D08B09B699E34607141" style="OLC">
											<paragraph id="IDcc265a133bef4016800be024697db9ec"><enum>(5)</enum><text>reimbursement
		  shall be made to the organization on a monthly basis, with payments for any
		  month being made consistent with the Federal Acquisition
		  Regulation.</text>
											</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
									</paragraph></subsection><subsection id="ID754c48b4820a4114986accdbcf61a303"><enum>(c)</enum><header>Authority for
		quality improvement organizations To perform specialized functions and to
		eliminate conflicts of interest</header><text>Part B of title XI of the Social
		Security Act (42 U.S.C. 1320c et seq.) is amended—</text>
									<paragraph id="ID669de68f94db446693dc57a49700f246"><enum>(1)</enum><text>in
		section 1153—</text>
										<subparagraph id="ID959fec28de2843f8af06dbbf1b352df7"><enum>(A)</enum><text>in subsection
		(b)(1), as amended by subsection (b)(1)(B), by inserting after the first
		sentence the following new sentence: <quote>In entering into contracts with
		such qualified organizations, the Secretary shall, to the extent appropriate,
		seek to ensure that each of the functions described in section 1154(a) are
		carried out within an area established under subsection (a).</quote>;
		and</text>
										</subparagraph><subparagraph id="ID837c0284e36c46bfb1acfdc7e3e66def"><enum>(B)</enum><text>in subsection
		(c)(1), by striking <quote>the functions set forth in section 1154(a), or may
		subcontract for the performance of all or some of such functions</quote> and
		inserting <quote>a function or functions under section 1154 directly or may
		subcontract for the performance of all or some of such function or
		functions</quote>; and</text>
										</subparagraph></paragraph><paragraph id="ID6a6011c4590741ebbf1bb119e6485ee2"><enum>(2)</enum><text>in
		section 1154—</text>
										<subparagraph id="ID081eb47c6e9d456e81c1c2da9334ff7f"><enum>(A)</enum><text>in subsection
		(a)—</text>

		inserting after paragraph (11) the following new paragraph:</text>

													<paragraph id="idCCE1A5034E9848F994B45D6522F29CEC"><enum>(12)</enum><text>As part of the
		  organization's review responsibility under paragraph (1), the organization
		  shall review all ambulatory surgical procedures specified pursuant to section
		  1833(i)(1)(A) which are performed in the area, or, at the discretion of the
		  Secretary, a sample of such procedures.</text>
													</paragraph><after-quoted-block>;
		  and</after-quoted-block></quoted-block>
											</clause><clause id="idA2E8DD739C09465C981D6C6AE18D45B2"><enum>(iv)</enum><text>in
		paragraph (15), by striking <quote>significant on-site review
		activities</quote> and all that follows before the period at the end and
		inserting <quote>on-site review activities as the Secretary determines
		appropriate</quote>.</text>
											</clause></subparagraph><subparagraph id="id4A6CA31E1D034DDBA0714D656E91774A"><enum>(B)</enum><text>by striking
		subsection (d) and redesignating subsections (b) and (c) as subsections (c) and
		(d), respectively; and</text>
										</subparagraph><subparagraph id="ID3f28d994f3954aaa869698a054ee9ac0"><enum>(C)</enum><text>by inserting
		after subsection (a) the following new subsection:</text>
											<quoted-block display-inline="no-display-inline" id="id2C7FC807994947AF90D12C006A8A38BB" style="OLC">
												<subsection id="ID8fb6a00d6ba2468b961b623f00e6eda4"><enum>(b)</enum><text>A
		  quality improvement organization entering into a contract with the Secretary to
		  perform a function described in a paragraph under subsection (a) must perform
		  all of the activities described in such paragraph, except to the extent
		  otherwise negotiated with the Secretary pursuant to the contract or except for
		  a function for which the Secretary determines it is not appropriate for the
		  organization to perform, such as a function that could cause a conflict of
		  interest with another function.</text>
												</subsection><after-quoted-block>.
		  </after-quoted-block></quoted-block>
										</subparagraph></paragraph></subsection><subsection id="ID01d4ce94c03a495db385894e6399687e"><enum>(d)</enum><header>Quality
		improvement as specified function</header><text>Section 1154(a) of the Social
		Security Act (42 U.S.C. 1320c–3(a)) is amended by adding at the end the
		following new paragraph:</text>
									<quoted-block display-inline="no-display-inline" id="id60B6FC513DCC4E92AADCE1A6C1C87A54" style="OLC">
										<paragraph id="ID9b5ab67bbc0441dd9e9c049e95b2848b"><enum>(18)</enum><text>The organization
		  shall perform, subject to the terms of the contract, such other activities as
		  the Secretary determines may be necessary for the purposes of improving the
		  quality of care furnished to individuals with respect to items and services for
		  which payment may be made under title
		  XVIII.</text>
										</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
								</subsection><subsection id="idAF9C6607629A44D0B95D200F772AE5D1"><enum>(e)</enum><header>Effective
		date</header><text>The amendments made by this section shall apply to contracts
		entered into or renewed on or after January 1, 2012.</text>
								</subsection></section><section id="idB0C85FA228264C05B7DD61EBEA6AB386"><enum>262.</enum><header>Rates for
		merchandise processing fees</header>
								<subsection id="IDd0e4e8fe267445e3a6bd6572ce1aafb8"><enum>(a)</enum><header>Fees for period
		from July 1, 2014, to November 30, 2015</header><text>For the period beginning
		on July 1, 2014, and ending on November 30, 2015, section 13031(a)(9) of the
		Consolidated Omnibus Budget Reconciliation Act of 1985 (19 U.S.C. 58c(a)(9))
		shall be applied and administered—</text>
									<paragraph id="ID5cbaf4ee222b4fe4a3b560a3d0d03704"><enum>(1)</enum><text>in
		subparagraph (A), by substituting <quote>0.3464</quote> for
		<quote>0.21</quote>; and</text>
									</paragraph><paragraph id="ID67212205e1ab41239ad8cdcfea3b152a"><enum>(2)</enum><text>in
		subparagraph (B)(i), by substituting <quote>0.3464</quote> for
		<quote>0.21</quote>.</text>
									</paragraph></subsection><subsection id="ID0c05ec203d884eaf81e1b211bc7875bc"><enum>(b)</enum><header>Fees for period
		from October 1, 2016, to September 30, 2019</header><text>For the period
		beginning on October 1, 2016, and ending on September 30, 2019, section
		13031(a)(9) of the Consolidated Omnibus Budget Reconciliation Act of 1985 (19
		U.S.C. 58c(a)(9)) shall be applied and administered—</text>
									<paragraph id="ID1ee1230da8e94e69ba7eb76e4bc9453d"><enum>(1)</enum><text>in
		subparagraph (A), by substituting <quote>0.1740</quote> for
		<quote>0.21</quote>; and</text>
									</paragraph><paragraph id="IDf43c39a6fc0c4b98b5bbbcf981ce973b"><enum>(2)</enum><text>in
		subparagraph (B)(i), by substituting <quote>0.1740</quote> for
		<quote>0.21</quote>.</text>
									</paragraph></subsection></section><section id="ID0e90fc61ae004bc894f494cb55a746aa"><enum>263.</enum><header>Time for
		remitting certain merchandise processing fees</header>
								<subsection id="ID9be7e964e54549839029e696960eb5f6"><enum>(a)</enum><header>In
		General</header><text>Notwithstanding any other provision of law, any fees
		authorized under paragraphs (9) and (10) of section 13031(a) of the
		Consolidated Omnibus Budget Reconciliation Act of 1985 (19 U.S.C. 58c(a) (9)
		and (10)) with respect to processing merchandise entered on or after October 1,
		2012, and before November 12, 2012, shall be paid not later than September 25,
		2012, in an amount equivalent to the amount of such fees paid by the person
		responsible for such fees with respect to merchandise entered on or after
		October 1, 2011, and before November 12, 2011, as determined by the Secretary
		of the Treasury.</text>
								</subsection><subsection id="ID5ea495e28e8f437282d67583cacf7a22"><enum>(b)</enum><header>Reconciliation
		of merchandise processing fees</header>
									<paragraph id="ID162ca8df239e4a5d8661a512ac7868cc"><enum>(1)</enum><header>In
		general</header><text>Not later than December 12, 2012, the Secretary of the
		Treasury shall reconcile the fees paid pursuant to subsection (a) with the fees
		for services actually provided on or after October 1, 2012, and before November
		12, 2012.</text>
									</paragraph><paragraph id="ID58ce00100d0049afa6389fff23fcd6f9"><enum>(2)</enum><header>Refunds of
		overpayments</header>
										<subparagraph id="IDc1dbf9bc6ca54e8ea9bf006a7c88ccda"><enum>(A)</enum><text>After making the
		reconciliation required under paragraph (1), the Secretary of the Treasury
		shall refund with interest any overpayment of such fees made under subsection
		(a) and make proper adjustments with respect to any underpayment of such
		fees.</text>
										</subparagraph><subparagraph id="IDc31c3f3e9d294a8b890648adb1dbdc1a"><enum>(B)</enum><text>No interest may
		be assessed with respect to any such underpayment that was based on the amount
		of fees paid for merchandise entered on or after October 1, 2012, and before
		November 12, 2012.</text>
										</subparagraph></paragraph></subsection></section></part></subtitle></title></amendment-block></amendment></engrossed-amendment-body>
