		<section id="HAAFA07EB32E7416A8F8351366ACA6E41" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Child and Family Services Extension
			 and Enhancement Act</short-title></quote>.</text>
		</section><section id="H8557CE097EDB436C8D70CD511B5F205D"><enum>2.</enum><header>Extension of
			 stephanie tubbs jones child welfare services program</header>
			<subsection id="H0140EC8F2840418E880E83BE689526DB"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 425 of the
			 Social Security Act (42 U.S.C. 625) is amended by striking <quote>2007 through
			 2011</quote> and inserting <quote>2012 through 2016</quote>.</text>
			</subsection><subsection id="H112055C351484769ADCC10A73C9A9C96"><enum>(b)</enum><header>Modification of
			 certain State plan requirements</header>
				<paragraph id="H530F9D9E7F1743B89E7E9A50E0494972"><enum>(1)</enum><header>Response to
			 emotional trauma</header><text>Section 422(b)(15)(A)(ii) of such Act (42 U.S.C.
			 622(b)(15)(A)(ii)) is amended by inserting <quote>, including emotional trauma
			 associated with a child’s maltreatment and removal from home</quote> before the
			 semicolon.</text>
				</paragraph><paragraph id="H6EB582E7AA794D0E892FD0DC5CC8735E"><enum>(2)</enum><header>Procedures on
			 the use of psychotropic medications</header><text>Section 422(b)(15)(A)(v) of
			 such Act (42 U.S.C. 622(b)(15)(A)(v)) is amended by inserting <quote>,
			 including protocols for the appropriate use and monitoring of psychotropic
			 medications</quote> before the semicolon.</text>
				</paragraph><paragraph id="H81301B42BF8246238556E8F10E0BFDF1"><enum>(3)</enum><header>Description of
			 activities to address developmental needs of very young
			 children</header><text>Section 422(b) of such Act (42 U.S.C. 622(b)) is
			 amended—</text>
					<subparagraph id="HD1BCE847E6984FAEB85071FB54F11CAB"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (16);</text>
					</subparagraph><subparagraph id="H5D38CB9E0FE64BF3A63CD3E3DFF7F7E6"><enum>(B)</enum><text>by striking the
			 period at the end of paragraph (17) and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="H65D59C80ADEE4036BC227FED1A21398A"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H3AEBA319751D44F48AEF06BB7753CA28" style="OLC">
							<paragraph id="H0B4ED66D78354E0D830EB8B2B5F6BDE2"><enum>(18)</enum><text display-inline="yes-display-inline">include a description of the activities
				that the State has undertaken to reduce the length of time children who have
				not attained 5 years of age are without a permanent family placement, and the
				activities the State undertakes to address the developmental needs of such
				children who receive benefits or services under this part or part
				E.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="HF7896957773A4C9DB96A712F825D6471"><enum>(c)</enum><header>Child visitation
			 by caseworkers</header><text display-inline="yes-display-inline">Section 424 of
			 such Act (42 U.S.C. 624) is amended by striking the 2nd subsection (e), as
			 added by section 7(b) of the Child and Family Services Improvement Act of 2006,
			 and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H383A44B63BBA4BF5AC6793F1AF6BCC20" style="OLC">
					<subsection id="H572911F1B5D243F5A9EEE3F774132BBE"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H9AEBE8E503D249C4883CEDE3C6E7126A"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HF8A2FE1AF4CA483AA9C47E7F7ED263BB"><enum>(A)</enum><text>Each State shall take
				such steps as are necessary to ensure that the total number of visits made by
				caseworkers on a monthly basis to children in foster care under the
				responsibility of the State during a fiscal year is not less than 90 percent of
				the total number of such visits that would occur during the fiscal year if each
				such child were so visited once every month while in such care.</text>
							</subparagraph><subparagraph display-inline="no-display-inline" id="H4C6F09683B384792B55C7D518D7C5FAA" indent="up2"><enum>(B)</enum><text>If the Secretary determines that a
				State has failed to comply with subparagraph (A) for a fiscal year, then the
				percentage that would otherwise apply for purposes of subsection (a) for the
				fiscal year shall be reduced by—</text>
								<clause id="HEC8A66BD71D64F8C8F8D55C0769BE95B"><enum>(i)</enum><text>1, if the number of full percentage
				points by which the State fell short of the percentage specified in
				subparagraph (A) is less than 10;</text>
								</clause><clause id="HA4887D67E33F43F88117E545595E99DB"><enum>(ii)</enum><text>3, if the number of full percentage
				points by which the State fell short, as described in clause (i), is not less
				than 10 and less than 20; or</text>
								</clause><clause id="H3F2F8251889949B8B0DA1F5A149D0152"><enum>(iii)</enum><text>5, if the number of full percentage
				points by which the State fell short, as described in clause (i), is not less
				than 20.</text>
								</clause></subparagraph></paragraph><paragraph id="HF367382DA8CE47A6B4606BE8CAC56A59" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H27517B33263240AEA7F96EC2D592D9C7"><enum>(A)</enum><text>Each State shall take
				such steps as are necessary to ensure that not less than 50 percent of the
				total number of visits made by caseworkers to children in foster care under the
				responsibility of the State during a fiscal year occur in the residence of the
				child involved.</text>
							</subparagraph><subparagraph display-inline="no-display-inline" id="H77122AC24D6741688FF05026E5677882" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">If the Secretary determines that a State
				has failed to comply with subparagraph (A) for a fiscal year, then the
				percentage that would otherwise apply for purposes of subsection (a) for the
				fiscal year shall be reduced by—</text>
								<clause id="HEFE7E70922274301AD93BC2B2A640FED"><enum>(i)</enum><text>1, if the number of full percentage
				points by which the State fell short of the percentage specified in
				subparagraph (A) is less than 10;</text>
								</clause><clause id="HD2309001E2EA4933A6EA2DCDF6B02E90"><enum>(ii)</enum><text>3, if the number of full percentage
				points by which the State fell short, as described in clause (i), is not less
				than 10 and less than 20; or</text>
								</clause><clause id="H711CE52A85E94FEA82500AD243A17565"><enum>(iii)</enum><text>5, if the number of full percentage
				points by which the State fell short, as described in clause (i), is not less
				than
				20.</text>
								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF22740F903A449F1A5011D5E9AB0F6D8"><enum>(d)</enum><header>Technical
			 correction</header><text display-inline="yes-display-inline">Section 423(b) of
			 such Act (42 U.S.C. 623(b)) is amended by striking <quote>per centum</quote>
			 each place it appears and inserting <quote>percent</quote>.</text>
			</subsection></section><section id="H9820571165214E0BB0D2A8EC9D33E547"><enum>3.</enum><header>Extension of
			 program to promote safe and stable families</header>
			<subsection id="H16AD72FBB2EB46B2AC3B305E93C721BF"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 436 of the
			 Social Security Act (42 U.S.C. 629f) is amended—</text>
				<paragraph id="H219A72BCB5574F5E828B625FFF7E3F2B"><enum>(1)</enum><text>in subsection (a),
			 by striking all that follows <quote>$345,000,000</quote> and inserting
			 <quote>for each of fiscal years 2012 through 2016.</quote>; and</text>
				</paragraph><paragraph id="H824A3069876F49F8BE94605F8D30B83B"><enum>(2)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="H785630416A89417ABD154BF89EAB3555"><enum>(A)</enum><text>in paragraph (2),
			 by striking <quote>$30,000,000</quote> and inserting
			 <quote>$20,000,000</quote>;</text>
					</subparagraph><subparagraph id="HE30823A5F23C41C3BA319C5406627D6F"><enum>(B)</enum><text>in paragraph
			 (4)(A), by striking <quote>433(e)</quote> and all that follows and inserting
			 <quote>433(e) $20,000,000 for each of fiscal years 2012 through 2016.</quote>;
			 and</text>
					</subparagraph><subparagraph id="HAB2A33722AB148D98C1AFB0679C49B4B"><enum>(C)</enum><text>in paragraph (5),
			 by striking <quote>437(f)</quote> and all that follows and inserting
			 <quote>437(f) $20,000,000 for each of fiscal years 2012 through

					</subparagraph></paragraph></subsection><subsection id="H43AA4DC56793430DA7E00DF11203A00D"><enum>(b)</enum><header>Discretionary
			 and targeted grants</header><text>Section 437 of such Act (42 U.S.C. 629g) is
			 amended in each of subsections (a) and (f)(3)(A) by striking <quote>2007
			 through 2011</quote> and inserting <quote>2012 through 2016</quote>.</text>
			</subsection><subsection id="H538D8AAFD8E6475B9CFDA208AC6DA576"><enum>(c)</enum><header>Entitlement
			 funding for state courts To assess and improve handling of proceedings relating
			 to foster care and adoption</header><text display-inline="yes-display-inline">Section 438 of such Act (42 U.S.C. 629h) is
			 amended—</text>
				<paragraph id="HE60E46CEF09E47388E36D1960ED1BF80"><enum>(1)</enum><text>in subsection
			 (a)(2)(A), by inserting <quote>, including the requirements in the Act related
			 to concurrent planning and the ability to bypass reunification efforts in
			 certain egregious situations</quote> before the semicolon;</text>
				</paragraph><paragraph id="H2EBA6B8494D24AD8A5480DB5ABE87465"><enum>(2)</enum><text>in each of
			 subsections (c)(1)(A) and (d), by striking <quote>2002 through 2011</quote> and
			 inserting <quote>2012 through 2016</quote>;</text>
				</paragraph><paragraph id="HA393CB8EB6FC4963AEC184E2388FB895"><enum>(3)</enum><text>in subsection
			 (c)(2)(A)—</text>
					<subparagraph id="HB4AE4B0E2CBB4197940EC89870FA92CC"><enum>(A)</enum><text>by striking
			 <quote>2006 through 2011</quote> and inserting <quote>2012 through

					</subparagraph></paragraph><paragraph id="H7EE05A62645C43ACBD84742717B7AF39"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (c)(2)(B), by striking
			 <quote>the amount made available under subsection (e) for such a grant</quote>
			 and inserting <quote>the amount reserved pursuant to section 436(b)(2) (and the
			 amount, if any, reserved pursuant to section 437(b)(2))</quote>; and</text>

				September 30 of each year, the Secretary shall publish the compilation on the
				Web site of the Department of Health and Human Services in a location easily
				accessible by the
				public.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H87AE00578B1F46FDB1D469E46B888C2C"><enum>(e)</enum><header>Elimination of
			 references to methamphetamines in substance abuse grants</header><text display-inline="yes-display-inline">Section 437(f) of such Act (42 U.S.C.
			 629g(f)) is amended—</text>
				<paragraph id="H14C111023CA9436EACC1A1C4AB5EF972"><enum>(1)</enum><text>in the subsection
			 heading, by striking <quote><header-in-text level="subsection" style="OLC">methamphetamine or other</header-in-text></quote>;</text>
				</paragraph><paragraph id="H8E74EBBB2B3A4A6F89DAB2F00C633A45"><enum>(2)</enum><text>in each of
			 paragraphs (1), (4)(A), (7)(A)(i), and (9)(B)(iii), by striking

			 programs for mentoring children of prisoners</header><text>Section 439 of such
			 Act (42 U.S.C. 629i) is amended—</text>

			 subsection (a)(2) and inserting the following:</text>

						<paragraph id="H8F8B48F79B19489895731579245F2902"><enum>(2)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this section is to authorize
				the Secretary to make competitive grants to applicants in areas with
				substantial numbers of children of incarcerated parents, in order to support
				the establishment or expansion and operation of programs using a network of
				public and private community entities to provide mentoring services for
				children of
				prisoners.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H4DFB0F48C0884EDC8FCAA2F5CD7430C8"><enum>(2)</enum><text>in subsection
			 (c)—</text>

			 of such Act (42 U.S.C. 638(b))</quote> inserting <quote>438(b)(1) of such Act
			 (42 U.S.C. 629h(b)(1))</quote>.</text>

							<subsection id="H64C1418CEED347E9B70FD7FA5A01194E"><enum>(a)</enum><header>Standard data
				elements</header>
								<paragraph id="H275740D6D78A40F48698155B88A8DCEF"><enum>(1)</enum><header>Designation</header><text>The
				Secretary, in consultation with an interagency work group established by the
				Office of Management and Budget, and considering State perspectives, shall, by
				rule, designate standard data elements for any category of information required
				to be reported under this part.</text>
								</paragraph><paragraph id="H321865CD57994399A7FAACC20121B665"><enum>(2)</enum><header>Data elements
				must be nonproprietary and interoperable</header><text>The standard data
				elements designated under paragraph (1) shall, to the extent practicable, be
				nonproprietary and interoperable.</text>
								</paragraph><paragraph id="H4A27EE00DD2545AC8BC28114A5F5BA06"><enum>(3)</enum><header>Other
				requirements</header><text>In designating standard data elements under this
				subsection, the Secretary shall, to the extent practicable, incorporate—</text>
									<subparagraph id="H690F8747D28E4DA894F8DD241CF27EC8"><enum>(A)</enum><text>interoperable
				standards developed and maintained by an international voluntary consensus
				standards body, as defined by the Office of Management and Budget, such as the
				International Organization for Standardization;</text>
									</subparagraph><subparagraph id="H1E7BD5AAD92B4E24B820AA1C63B9585B"><enum>(B)</enum><text>interoperable
				standards developed and maintained by intergovernmental partnerships, such as
				the National Information Exchange Model; and</text>
									</subparagraph><subparagraph id="H98926FBC8FA243A3838D59062AE2E2C4"><enum>(C)</enum><text>interoperable
				standards developed and maintained by Federal entities with authority over
				contracting and financial assistance, such as the Federal Acquisition
				Regulations Council.</text>
									</subparagraph></paragraph></subsection><subsection id="H7DB5FB75A8234BBF98C8194C741F3177"><enum>(b)</enum><header>Data standards
				for reporting</header>
								<paragraph id="H90673DC1B61C47558FB4EF2FECC8A3FF"><enum>(1)</enum><header>Designation</header><text>The
				Secretary, in consultation with an interagency work group established by the
				Office of Management and Budget, and considering State government perspectives,
				shall, by rule, designate data reporting standards to govern the reporting
				required under this part.</text>
								</paragraph><paragraph id="H4151B149250A40DD8ACD592B40217A6A"><enum>(2)</enum><header>Requirements</header><text>The
				data reporting standards required by paragraph (1) shall, to the extent
				practicable—</text>
									<subparagraph id="H4952EA194AEF4B09817D5ADCC79815EC"><enum>(A)</enum><text>incorporate a
				widely accepted, non-proprietary, searchable, computer-readable format;</text>
									</subparagraph><subparagraph id="HBA55CFE8E9B648D3AEF8703C578770E1"><enum>(B)</enum><text>be consistent with
				and implement applicable accounting principles; and</text>
									</subparagraph><subparagraph id="H8B40D33EAB0E40C9877AC12A2BDE6190"><enum>(C)</enum><text>be capable of
				being continually upgraded as necessary.</text>
									</subparagraph></paragraph><paragraph id="H6D475D05FE1C400C8C66DEACAF5CBF3E"><enum>(3)</enum><header>Incorporation of
				nonproprietary standards</header><text>In designating reporting standards under
				this subsection, the Secretary shall, to the extent practicable, incorporate
				existing nonproprietary standards, such as the eXtensible Business Reporting
				Language.</text>
								</paragraph></subsection></section></subpart><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H32BC160F89994768849C5EBB6554E59A"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 subsection (a) shall take effect on October 1, 2012, and shall apply with
			 respect to information required to be reported on or after such date.</text>
			</subsection></section><section id="HA425A3E1D77C4D21AAEAB19D5CBEB2E1"><enum>5.</enum><header>Provisions
			 relating to foster care or adoption</header>
			<subsection id="HC80D8762C1644908843C17EE86DA628E"><enum>(a)</enum><header>Educational
			 stability for each foster placement</header><text>Section 475(1)(G) of the
			 Social Security Act (42 U.S.C. 675(1)(G)) is amended—</text>
				<paragraph id="H3DE41708298545938FAF77B5F4CE9A9B"><enum>(1)</enum><text>in clause (i), by
			 striking <quote>the placement</quote> and inserting <quote>each
			 placement</quote>; and</text>
				</paragraph><paragraph id="H5A3D5188CCBE4176BEF73A6869110EB3"><enum>(2)</enum><text>in clause (ii)(I),
			 by inserting <quote>each</quote> before <quote>placement</quote>.</text>
				</paragraph></subsection><subsection id="H44B16A13F53E488B805B76E994561DE3"><enum>(b)</enum><header>Study on
			 recruitment of and support for foster parents, adoptive parents, and kin
			 guardians</header>
				<paragraph id="H87A6E2D00B11417A8A376E2DD831FA00"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Health and Human Services shall, in accordance with paragraph (2), conduct a
			 study on the recruitment of and support for families caring for children served
			 by any program funded under part E of title IV of the Social Security Act (42
			 U.S.C. 670 et seq.), including foster parents, adoptive parents, and kin
			 guardians.</text>
				</paragraph><paragraph id="HD2D93A9209434ADEBE4145CE5AC40D39"><enum>(2)</enum><header>Contents of
			 study</header><text>The study shall include—</text>
					<subparagraph id="H792504A154254AC9958FA045D6CCFBFD"><enum>(A)</enum><text>a survey of foster
			 parents, who care for children served by any foster care program funded under
			 part E of title IV of the Social Security Act;</text>
					</subparagraph><subparagraph id="HD46AFC2087C1442B86231C8C742EAD4C"><enum>(B)</enum><text>an evaluation of
			 the role of respite care training and services;</text>
					</subparagraph><subparagraph id="HC9F02F5F387349B8972361C5FE07A96A"><enum>(C)</enum><text>the identification
			 of the capacity of respite care service providers in each State;</text>
					</subparagraph><subparagraph id="H48A672DF28B1474E9D54EF072930820F"><enum>(D)</enum><text>the identification
			 of any barriers that limit the ability of States to successfully recruit and
			 retain foster families in the foster care system;</text>
					</subparagraph><subparagraph id="H7A902254169547499006C638C032263B"><enum>(E)</enum><text>the identification
			 of any barriers that limit the ability of States to successfully recruit and
			 support adoptive parents and relative caregivers; and</text>
					</subparagraph><subparagraph id="HF33F46643C3448868E973298875ABEEB"><enum>(F)</enum><text>any other matters
			 that the Secretary of Health and Human Services deems appropriate for this
			 study.</text>
					</subparagraph></paragraph><paragraph id="HC07C832172194FF887D46043EACFF1F1"><enum>(3)</enum><header>Report</header><text>Within
			 3 years after the date of the enactment of this Act, the Secretary of Health
			 and Human Services shall submit to Congress a report containing the findings of
			 the study required by paragraph (1), and such recommendations with respect to
			 the matters studied as the Secretary deems appropriate.</text>
				</paragraph></subsection><subsection id="HCB50BD54DA5044A79BEF22167F034DF8"><enum>(c)</enum><header>Description of
			 adoption spending</header><text>Section 473(a)(8) of the Social Security Act
			 (42 U.S.C. 673(a)(8)) is amended by inserting <quote>, and shall document how
			 such amounts are spent, including on post-adoption services</quote> before the
			 period.</text>
			</subsection></section><section id="HB6F24DF2D7514E63B91E73EB9DC893EE"><enum>6.</enum><header>Effective
			 date</header>
			<subsection id="H36DA2214A5514267A9AF6092A57E8D28"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as otherwise
			 provided in this Act, this Act and the amendments made by this Act shall take
			 effect on October 1, 2011, and shall apply to payments under parts B and E of
			 title IV of the Social Security Act for calendar quarters beginning on or after
			 such date, without regard to whether regulations to implement the amendments
			 are promulgated by such date.</text>
			</subsection><subsection id="H144399B1892144499AD5855F787ED37E"><enum>(b)</enum><header>Delay permitted
			 if state legislation required</header><text>If the Secretary of Health and
			 Human Services determines that State legislation (other than legislation
			 appropriating funds) is required in order for a State plan developed pursuant
			 to subpart 1 of part B, or a State plan approved under subpart 2 of part B or
			 part E, of title IV of the Social Security Act to meet the additional
			 requirements imposed by the amendments made by this Act, the plan shall not be
			 regarded as failing to meet any of the additional requirements before the 1st
			 day of the 1st calendar quarter beginning after the first regular session of
			 the State legislature that begins after the date of the enactment of this Act.
			 If the State has a 2-year legislative session, each year of the session is
			 deemed to be a separate regular session of the State legislature.</text>
