		<official-title>To amend title 38, United States Code, to allow for the
		  transfer of educational assistance under the Post-9/11 Educational Assistance
		  Program to certain dependents to be used for special
		  education.</official-title>

		<section id="H2D58C4EB47C949F4A4F8A8F79D46AE3F" section-type="section-one"><enum>1.</enum><header>Use of transferred Post-9/11
			 Educational Assistance Program benefits for special education</header>
			<subsection id="HAB3965184E484E30BCD98D3655381A7C"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 3319 of title
			 38, United States Code, is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H34056A5A0A1F480D899F96F25BE0BDEB" style="OLC">
					<subsection id="H15E3229E4DC14832AB3AF9B0DE31E4F4"><enum>(k)</enum><header>Use of
				transferred educational assistance for special education</header><paragraph commented="no" display-inline="yes-display-inline" id="H0C57827B127745BC85072A9630C3091D"><enum>(1)</enum><text display-inline="yes-display-inline">In accordance with paragraph (5), a
				dependent described in paragraph (2) to whom entitlement to educational
				assistance is transferred under this section may use such assistance for
				special education described in paragraph (3), regardless of whether such
				dependent has completed the requirements of a secondary school diploma (or
				equivalency certificate).</text>
						</paragraph><paragraph id="HC90847B5A7C747F492A37999811A4709" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">A
				dependent described in this paragraph is a dependent whom the Secretary of
				Defense determines—</text>
							<subparagraph id="HE6563D0C00D64722A3AF28471E214C6E"><enum>(A)</enum><text>is a student with an intellectual
				disability (as defined in section 760(2) of the Higher Education Act of 1965
				(20 U.S.C. 1140(2))); or</text>
							</subparagraph><subparagraph id="H0265D88A2A35431882B25F25E8C8211D"><enum>(B)</enum><text display-inline="yes-display-inline">has a developmental disability (as defined
				in section 102(8) of the Developmental Disabilities Assistance and Bill of
				Rights Act of 2000 (42 U.S.C. 15002(8))).</text>
							</subparagraph></paragraph><paragraph id="HA1A534094E144B80B2B7CDF046B71D4E" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Special education described in this
				paragraph includes the following, regardless of whether the instruction,
				program, or course is an approved program of education for purposes of section
				3313(b) of this title:</text>
							<subparagraph id="H3D21C1D1FE3349468D53E398BA7E6116"><enum>(A)</enum><text>Instruction described in section
				602(29) of the Individuals with Disabilities Education Act (20 U.S.C.
				1401).</text>
							</subparagraph><subparagraph id="H10AD5701389D442F8A2094620EE40877"><enum>(B)</enum><text display-inline="yes-display-inline">Model comprehensive transition and
				postsecondary programs under section 767 of the Higher Education Act of 1965
				(20 U.S.C. 1140g).</text>
							</subparagraph><subparagraph id="H015DE5C0BD76432BA1D495674ADB1A4F"><enum>(C)</enum><text display-inline="yes-display-inline">Educational summer camp programs.</text>
							</subparagraph><subparagraph id="H47B6AF31EBCB4060AEAB84EF9F0D4B0D"><enum>(D)</enum><text>Life skills courses.</text>
							</subparagraph><subparagraph id="HBE56CC23D6974143A6AA1CB1FB565383"><enum>(E)</enum><text>Programs with respect to training
				related to assistive technologies.</text>
							</subparagraph><subparagraph id="H5758349A4E6742E19027BFAAFBC099A0"><enum>(F)</enum><text display-inline="yes-display-inline">College preparatory courses or other
				programs related to transitioning after secondary education (or the
				equivalent).</text>
							</subparagraph><subparagraph id="H12FFDAEE6A1F43298B6725FEA325513F"><enum>(G)</enum><text display-inline="yes-display-inline">Programs regarding communication skills
				training, including training involving augmentative communication devices and
				other assistive technology.</text>
							</subparagraph><subparagraph id="H267E412193F845BBB3F8C89E9AD86881"><enum>(H)</enum><text display-inline="yes-display-inline">Functional skills training courses.</text>
							</subparagraph><subparagraph id="H1B5BB6AF4DAD4E10B9B3A471CDE176DC"><enum>(I)</enum><text>Service learning programs.</text>
							</subparagraph><subparagraph id="H56DE033814644FB6930AE237B6F34576"><enum>(J)</enum><text>Work study programs.</text>
							</subparagraph><subparagraph id="HFFD9AB32609042E2BDA76A396F617C90"><enum>(K)</enum><text>Vocational education programs.</text>
							</subparagraph></paragraph><paragraph id="H6BAD391A11F547579D94DA4109A22E68" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">The Secretary of Defense shall prescribe
				regulations to determine whether any dependents described in paragraph (2) who
				use educational assistance under this subsection for special education
				described in paragraph (3) shall be required to enroll in the exceptional
				family member program of the Department of Defense.</text>
						</paragraph><paragraph id="H7453BE585CE8451EBC6005A6B2A5BEC5" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">In the case of educational assistance used
				under this subsection for special education described in paragraph (3), the
				Secretary concerned shall not pay the monthly stipend described in section
				3313(c)(1)(B) of this title if the Secretary determines that the stipend is not
				relevant for such special education.</text>
						</paragraph><paragraph commented="no" id="H32F200A2CC924087B7EB528DBCF97F1B" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">Any educational assistance provided to a
				dependent under this subsection for special education described in paragraph
				(3)—</text>
							<subparagraph id="H3C0CAC32669E437BB6E2F1A6CF09D867"><enum>(A)</enum><text>is in addition to any other
				educational assistance benefits provided to the dependent by the Federal
				Government (other than under this chapter); and</text>
							</subparagraph><subparagraph id="HFE61B8CD92394C4E819FE3055A958C60"><enum>(B)</enum><text display-inline="yes-display-inline">may not be included in calculating income
				for purposes of determining whether such dependent is eligible for any other
				educational assistance benefits provided by the Federal
				Government.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HAA6EB0360D4C4C01B5B2C082FD8DC3C7"><enum>(b)</enum><header>Conforming
			 amendments</header><text display-inline="yes-display-inline">Such section is
			 further amended—</text>
				<paragraph id="H277B50FB03C545228D2BC989392A3A36"><enum>(1)</enum><text>in subsection
			 (g)(2), by striking <quote>in the case of</quote> and inserting <quote>except
			 as provided in subsection (k), in the case of</quote>; and</text>
				</paragraph><paragraph id="H5148B9E30C8246B4964AB745B82154B5"><enum>(2)</enum><text>in subsection
			 (h)—</text>
					<subparagraph id="H8712B323D82B44918BCB3AFB710042BD"><enum>(A)</enum><text>in paragraph (2),
			 by inserting <quote>and subsection (k)</quote> after <quote>(e)(2)</quote>;
			 and</text>
					</subparagraph><subparagraph id="HBCA37DC4BC3549259ECA1BEC0F060240"><enum>(B)</enum><text>in paragraph (6),
			 by striking the period at the end and inserting the following: <quote>and, in
			 the case of a dependent described in subsection (k)(2), the pursuit of special
			 education described in subsection (k)(3).</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H8829599F239143CC92FC36DAA9C32F5D"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this Act shall take effect on the
			 date that is 180 days after the date of the enactment of this Act.</text>
			</subsection></section></legis-body>
