<official-title display="yes">To prohibit the sale of billfish.</official-title>

<section id="HD102E2D13FE54EC998573F6FE4630970" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Billfish Conservation Act of 2012</short-title></quote>.</text> </section> 
<section id="H6324158F67504FE3A961533950D29AF9" display-inline="no-display-inline"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H54C889EF01BF44E48A59E5DF0F1FB2AC"><enum>(1)</enum><text>The United States carefully regulates its domestic fisheries for billfish and participates in international fishery management bodies in the Atlantic and Pacific.</text></paragraph> 
<paragraph id="HDAE2CB8B2A1D49D68F114A2617A15339"><enum>(2)</enum><text>Global billfish populations have declined significantly, however, because of overfishing primarily through retention of bycatch by non-United States commercial fishing fleets.</text></paragraph> 
<paragraph id="H72A3CC1E24DD44C49EE9A0EF879F9114"><enum>(3)</enum><text>Ending the importation of foreign-caught billfish for sale in the United States aligns with U.S. management measures of billfish and protects the significant economic benefits to the U.S. economy of recreational fishing and marine commerce and the traditional cultural fisheries.</text></paragraph></section> 
<section id="HB1E93EC02D5D4B5BACAC88AA56F9BF7B"><enum>3.</enum><header>Statement of constitutional authority</header><text display-inline="no-display-inline">The Congress enacts this Act pursuant to clause 3 of section 8 of article I of the Constitution.</text> </section> 
<section id="H4EB15BEAED034674A6E6BD19945B8398"><enum>4.</enum><header>Prohibition on sale of billfish</header> 
<subsection id="H0A5D865FB1344815BDE7D7A1909E8D4E"><enum>(a)</enum><header>Prohibition</header><text>No person shall offer for sale, sell, or have custody, control, or possession of for purposes of offering for sale or selling billfish or products containing billfish.</text> </subsection> 
<subsection id="H94DB07561224482FBE54DC5E24F6B07D"><enum>(b)</enum><header>Penalty</header><text>For purposes of section 308(a) of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1858(a)), a violation of this section shall be treated as an act prohibited by section 307 of that Act (16 U.S.C. 1857).</text> </subsection> 
<subsection id="H77EDB34AA432459D8D0E90E767B7C6AF" display-inline="no-display-inline"><enum>(c)</enum><header>Exemptions for traditional fisheries and markets</header> 
<paragraph id="H07319EFC80364098A805C56B83706728"><enum>(1)</enum><text>Subsection (a) does not apply to billfish caught by US fishing vessels and landed in the State of Hawaii or Pacific Insular Areas as defined in section 3(35) of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1802(35)).</text></paragraph> 
<paragraph id="H960B7687705B4CB28E803752640B63D2"><enum>(2)</enum><text>Subsection (a) does not apply to billfish landed by foreign fishing vessels in the Pacific Insular Areas when the foreign caught billfish is exported to non-US markets or retained within Hawaii and the Pacific Insular Areas for local consumption.</text></paragraph></subsection> 
<subsection id="HC31D9DA90FFF458CAA9B0EDA81503B56"><enum>(d)</enum><header>Billfish defined</header><text>In this section the term <term>billfish</term>—</text> 
<paragraph id="H0E1FF9632F6640FF85E67AC4B881267D"><enum>(1)</enum><text>means any fish of the species—</text> 
<subparagraph id="H271F76EBD3AD4C7AA65718A488DBFBC8"><enum>(A)</enum><text>Makaira nigricans (blue marlin);</text> </subparagraph> 
<subparagraph id="HF8B71AFD862648BE8B1845128C744567"><enum>(B)</enum><text>Kajikia audax (striped marlin);</text> </subparagraph> 
<subparagraph id="HE27F572A94824557B62D73BC609E9593"><enum>(C)</enum><text>Istiompax indica (black marlin);</text> </subparagraph> 
<subparagraph id="HD5558CF11A184B268E942556569F863D"><enum>(D)</enum><text>Istiophorus platypterus (sailfish);</text> </subparagraph> 
<subparagraph id="HC696BA1339744E20B9E03891AD7CBF48"><enum>(E)</enum><text>Tetrapturus angustirostris (shortbill spearfish);</text> </subparagraph> 
<subparagraph id="H806EA705E3EB4126B13FA2CDEDA9DD32"><enum>(F)</enum><text>Kajikia albida (white marlin);</text> </subparagraph> 
<subparagraph id="H913B0CF956E948F298C29C35378E08C3"><enum>(G)</enum><text>Tetrapturus georgii (roundscale spearfish);</text> </subparagraph> 
<subparagraph id="H597882118A9341F09F6F28D9C958A006"><enum>(H)</enum><text>Tetrapturus belone (Mediterranean spearfish); and</text> </subparagraph> 
<subparagraph id="H183BB9D012DF4C3192F546C378F5E8DE"><enum>(I)</enum><text>Tetrapturus pfluegeri (longbill spearfish); and</text> </subparagraph></paragraph> 
<paragraph id="H9E653C0CFF384C848CC4C418DCF4FC20"><enum>(2)</enum><text>does not include the species Xiphias gladius (swordfish).</text> </paragraph></subsection></section>
