		  servicemembers increased protection during a funding gap.</official-title>

		<section id="H3A832B16C2E646B5A1342D6CFD051CA1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Don’t Default on Military Families
			 Act</short-title></quote>.</text>
		</section><section id="H68717584FF834ACBB0B0E43F90527468" section-type="subsequent-section"><enum>2.</enum><header>Protection of
			 servicemembers during funding gap</header>
			<subsection id="H1FE351DC63B44672A8A66527EB87DD7F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Title I of the
			 Servicemembers Civil Relief Act (50 U.S.C. App. 511 et seq.) is amended by
			 adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H235D1735ED804B0BAAD90F176A014FA1" style="OLC">
					<section id="H705D4AA5F0644722880301D69D8E279C"><enum>110.</enum><header>Protection of
				servicemembers during funding gap</header>
						<subsection id="H42861E2F9BB540CA98AD66F9F24F2926"><enum>(a)</enum><header>Application</header><text display-inline="yes-display-inline">Notwithstanding any other section of this
				Act, the provisions of this section shall apply to a servicemember during a
				funding gap affecting the Armed Forces.</text>
						</subsection><subsection id="H9DF6D13BB2E34340ADAAB6656C7DD7A9"><enum>(b)</enum><header>Evictions and
				distress</header><text display-inline="yes-display-inline">During a funding
				gap, section 301(a)(1)(A)(ii) shall not apply to a servicemember.</text>
						</subsection><subsection id="HADA6643E69C8445E91E07EBCC5D46583"><enum>(c)</enum><header>Protection under
				installment contracts for purchase or lease</header><text>During a funding gap,
				section 302(a)(2) shall not apply to a servicemember.</text>
						</subsection><subsection id="H615FB616F8564B7F86E934DE3520815A"><enum>(d)</enum><header>Mortgages and
				trust deeds</header>
							<paragraph id="H608CFEF067A246C5A6748CF07D9EBB82"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">During a funding gap,
				section 303(a)(1) shall apply to a servicemember by substituting <quote>before
				a funding gap that is the cause of an action described in subsection (b) or a
				sale, foreclosure, or seizure described in subsection (c)</quote> for
				<quote>before the period of the servicemember's military
				service</quote>.</text>
							</paragraph><paragraph commented="no" id="HD9074BD3258548A482F8D892A95153E6"><enum>(2)</enum><header>Credit
				rating</header><text display-inline="yes-display-inline">During a funding gap,
				the failure or delay of a servicemember to make a payment related to an
				obligation or liability consisting of a mortgage, trust deed, or other security
				in the nature of a mortgage, shall not itself (without regard to other
				considerations) provide the basis for an adverse report relating to the
				creditworthiness of the servicemember by or to a person engaged in the practice
				of assembling or evaluating consumer credit information if such servicemember
				notifies in good faith the creditor related to such obligation or liability
				that the funding gap is the cause of the failed or delayed payment.</text>
							</paragraph></subsection><subsection id="H1571B02B7C9F482790566A6C29B89D7E"><enum>(e)</enum><header>Funding gap
				defined</header><text display-inline="yes-display-inline">In this Act, the term
				<term>funding gap</term> means—</text>
							<paragraph id="H6D305196A2914243AB9D99FFFE5ED35E"><enum>(1)</enum><text>any period of time
				after the beginning of a fiscal year for which interim or full-year
				appropriations for the personnel accounts of the Armed Forces for that fiscal
				year have not been enacted; and</text>
							</paragraph><paragraph id="H4237393811F2447881D85FB395F751DB"><enum>(2)</enum><text display-inline="yes-display-inline">any period of time in which the debt of the
				United States Government, as defined in section 3101 of title 31, United States
				Code, reaches the statutory limit and the Secretary of Defense determines that
				sufficient amounts are not available in the personnel accounts of the Armed
				Forces to continue to provide pay and allowances (without interruption) to
				members of the Armed
				Forces.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HDB690171657E47A996399EE58BE164AF"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 contents in section 1(b) of such Act is amended by inserting after the item
			 relating to section 109 the following new item:</text>
