		<official-title display="yes">To amend title 28, United States Code, to
		  clarify the time limits for appeals in civil cases to which United States
		  officers or employees are parties.</official-title>

		<section id="HECBFDB0B78424E51A59D67FCF18C9149" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Appeal Time Clarification Act of
			 2011</short-title></quote>.</text>
		</section><section id="H85F0A192C8DB4FC19D4730AB5D464D7C"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="HD004ABFDDC69464FB4510C3BFE86CDFE"><enum>(1)</enum><text>section 2107 of
			 title 28, United States Code, and rule 4 of the Federal Rules of Appellate
			 Procedure provide that the time to appeal for most civil actions is 30 days,
			 but that the appeal time for all parties is 60 days when the parties in the
			 civil action include the United States, a United States officer, or a United
			 States agency;</text>
			</paragraph><paragraph id="HB16E267D6526467C9D09789438924744"><enum>(2)</enum><text>the 60-day period
			 should apply if 1 of the parties is—</text>
				<subparagraph id="HB802952C883F4A27855674EA38025FD3"><enum>(A)</enum><text>the United
			 States;</text>
				</subparagraph><subparagraph id="HF409A491A1A94115A3AFD27463FD870F"><enum>(B)</enum><text>a United States
			 agency;</text>
				</subparagraph><subparagraph id="H5FE947F2BEE6479DAEED60A0A7E1657C"><enum>(C)</enum><text>a United States
			 officer or employee sued in an official capacity; or</text>
				</subparagraph><subparagraph id="H8762F2EF8AAF437B916F1A66727C1995"><enum>(D)</enum><text>a current or
			 former United States officer or employee sued in an individual capacity for an
			 act or omission occurring in connection with duties performed on behalf of the
			 United States;</text>
				</subparagraph></paragraph><paragraph id="H98B1F152955F4891A6FAE20E44CB1D81"><enum>(3)</enum><text>section 2107 of
			 title 28, United States Code, and rule 4 of the Federal Rules of Appellate
			 Procedure (as amended to take effect on December 1, 2011, in accordance with
			 section 2074 of that title) should uniformly apply the 60-day period to those
			 civil actions relating to a Federal officer or employee sued in an individual
			 capacity for an act or omission occurring in connection with Federal
			 duties;</text>
			</paragraph><paragraph id="H58BB558F9FB141BD8CC5CD35145D52E7"><enum>(4)</enum><text>the civil actions
			 to which the 60-day periods should apply include all civil actions in which a
			 legal officer of the United States represents the relevant officer or employee
			 when the judgment or order is entered or in which the United States files the
			 appeal for that officer or employee; and</text>
			</paragraph><paragraph id="H38FB56A562CD44C98E81257C28A4EF3F"><enum>(5)</enum><text>the application of
			 the 60-day period in section 2107 of title 28, United States Code, and rule 4
			 of the Federal Rules of Appellate Procedure—</text>
				<subparagraph id="H4BC8433BF9714B3EBA240BCCE14A5D28"><enum>(A)</enum><text>is not limited to
			 civil actions in which representation of the United States is provided by the
			 Department of Justice; and</text>
				</subparagraph><subparagraph id="H4930F0FC462F42CDB7667CD338330C9B"><enum>(B)</enum><text>includes all civil
			 actions in which the representation of the United States is provided by a
			 Federal legal officer acting in an official capacity, such as civil actions in
			 which a Member, officer, or employee of the Senate or the House of
			 Representatives is represented by the Office of Senate Legal Counsel or the
			 Office of General Counsel of the House of Representatives.</text>
				</subparagraph></paragraph></section><section id="H4F01BD3B880F487787A1FB3C91D8ABE4" section-type="subsequent-section"><enum>3.</enum><header>Time for appeals in
			 certain cases</header><text display-inline="no-display-inline">Section 2107 of
			 title 28, United States Code, is amended—</text>
			<paragraph id="H1106EED819514474972308C8281BED77"><enum>(1)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="H29C34076C3E94D6399BAADB2A0A7A6B2"><enum>(A)</enum><text>by striking
			 <quote>order or decree</quote> each place it appears and inserting
			 <quote>order, or decree</quote>;</text>
				</subparagraph><subparagraph id="H7DDDD64B963248F49CDBBF530F79D681"><enum>(B)</enum><text>by striking
			 <quote>suit or proceeding</quote> and inserting <quote>suit, or
			 proceeding</quote>; and</text>
				</subparagraph><subparagraph id="H51FC78546E1E4860898EDED60044FF31"><enum>(C)</enum><text>by striking
			 <quote>filed, within thirty</quote> and inserting <quote>filed within
			 30</quote>; and</text>
				</subparagraph></paragraph><paragraph id="H4CF6F0DAC0CC47888456D4928527F96A"><enum>(2)</enum><text>by amending
			 subsection (b) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HCBA290635649421EBF501450BE7C6C6F" style="OLC">
					<subsection id="H1584C76CA4E142FEA09D2729013EA9B6"><enum>(b)</enum><text display-inline="yes-display-inline">In any such action, suit, or proceeding,
				the time as to all parties shall be 60 days from such entry if one of the
				parties is—</text>
						<paragraph id="H7183F794D1E844FEBFFFF28E295CF45A"><enum>(1)</enum><text>the United
				States;</text>
						</paragraph><paragraph id="HCA057D44BBB949699D2FBD3B44EC98B3"><enum>(2)</enum><text>an agency of the
				United States;</text>
						</paragraph><paragraph id="H21D91BA6322F4E2A977A392AEACFC01A"><enum>(3)</enum><text>an officer or
				employee of the United States who is sued in an official capacity; or</text>
						</paragraph><paragraph id="H54228DC34E814A94B8B3536537AEEB31"><enum>(4)</enum><text>a current or
				former officer or employee of the United States who is sued in an individual
				capacity for an act or omission occurring in connection with duties performed
				on behalf of the United States, including any instance in which the United
				States represents that person when the judgment, order, or decree is entered or
				files the appeal for that
				person.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H5ABA73A6349540E38E3E196A625F2047"><enum>4.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall take effect on December 1, 2011.</text>
