		<section id="HF657047195F041A88C616068DC856E04" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Chimney Rock National Monument
			 Establishment Act</short-title></quote>.</text>
		</section><section id="H75A35899DC4F45308D98C0E818B1391C"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H8BFCC97564564C728A79A17A5A0454BE"><enum>(1)</enum><header>National
			 monument</header><text>The term <term>national monument</term> means the
			 Chimney Rock National Monument established by section 3(a).</text>
			</paragraph><paragraph id="H51192A4F7ABA4A2E92ECD29069343FEB"><enum>(2)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Agriculture.</text>
			</paragraph><paragraph id="H886012E0B18B4D85BC4F9C82441BD148"><enum>(3)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Colorado.</text>
			</paragraph></section><section id="H5BBB76528B874BE5AC212BCD0C3BC267"><enum>3.</enum><header>Establishment of
			 chimney rock national monument</header>
			<subsection id="H7E8816B68178463AB6E81858FA831DB3"><enum>(a)</enum><header>Establishment</header><text>There
			 is established in the State the Chimney Rock National Monument—</text>
				<paragraph id="H2D104C53813B4DEC826B5329480BEAFE"><enum>(1)</enum><text>to preserve,
			 protect, and restore the archeological, cultural, historic, geologic,
			 hydrologic, natural, educational, and scenic resources of Chimney Rock and
			 adjacent land; and</text>
				</paragraph><paragraph id="HA761CD2E14734B0C8794C4506FA325E4"><enum>(2)</enum><text>to provide for
			 public interpretation and recreation consistent with the protection of the
			 resources described in paragraph (1).</text>
				</paragraph></subsection><subsection id="HB9C22CEF0AA447528EE9527AA133489B"><enum>(b)</enum><header>Boundaries</header>
				<paragraph id="H83BCC233DDDB4993A5AD63D58E21D971"><enum>(1)</enum><header>In
			 general</header><text>The national monument shall consist of approximately
			 4,726 acres of land and interests in land, as generally depicted on the map
			 entitled <quote>Boundary Map, Chimney Rock National Monument</quote> and dated
			 January 5, 2010.</text>
				</paragraph><paragraph id="H6FF9D864E36B4393A4AECA3CC452652A"><enum>(2)</enum><header>Minor
			 adjustments</header><text>The Secretary may make minor adjustments to the
			 boundary of the national monument to reflect the inclusion of significant
			 archeological resources discovered after the date of the enactment of this Act
			 on adjacent National Forest System land.</text>
				</paragraph><paragraph id="H6299CC63F13244E4B9E8DF3F9306668B"><enum>(3)</enum><header>Availability of
			 map</header><text>The map described in paragraph (1) shall be on file and
			 available for public inspection in the appropriate offices of the Forest
			 Service.</text>
				</paragraph></subsection></section><section id="H020EF90063374A69BAFA3E633FF181B6"><enum>4.</enum><header>Administration</header>
			<subsection id="HFE39DF0711D545C68808196F67BBAEFC"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall—</text>
				<paragraph id="HFA16A8C12C3A4B2FA3A108C65E5561D2"><enum>(1)</enum><text>administer the
			 national monument—</text>
					<subparagraph id="H35DDAE311FD6497C8583633B1F45D133"><enum>(A)</enum><text>in furtherance of
			 the purposes for which the national monument was established; and</text>
					</subparagraph><subparagraph id="HCC56CDC46A6044DB8BF9B57139FA0F70"><enum>(B)</enum><text>in accordance
			 with—</text>
						<clause id="HF3A4A9CC056D4C0D999CB46ED604C6D5"><enum>(i)</enum><text>this
			 Act; and</text>
						</clause><clause id="H26C128B3573E40E691DC14F23BCC0F7F"><enum>(ii)</enum><text>any
			 laws generally applicable to the National Forest System; and</text>
						</clause></subparagraph></paragraph><paragraph id="H4DB60EA97192470C845ADF9C25BEFC40"><enum>(2)</enum><text>allow only such
			 uses of the national monument that the Secretary determines would further the
			 purposes described in section 3(a).</text>
				</paragraph></subsection><subsection id="H7894315A0A274C9C913957851518A68E"><enum>(b)</enum><header>Tribal
			 uses</header>
				<paragraph id="H813C364A3BE5421DB20AD7E5FC6425F5"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall administer the national monument in
			 accordance with—</text>
					<subparagraph id="H4EF2E9A2FB7B4564BEA609A0AF156E32"><enum>(A)</enum><text>the Native
			 American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001 et seq.</external-xref>); and</text>
					</subparagraph><subparagraph id="H70A3F3D086FA429198C7DC061502F787"><enum>(B)</enum><text>the policy
			 described in <external-xref legal-doc="public-law" parsable-cite="pl/95/341">Public Law 95–341</external-xref> (commonly known as
			 the <quote>American Indian Religious Freedom Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/42/1996">42 U.S.C.
			 1996</external-xref>).</text>
					</subparagraph></paragraph><paragraph id="H0D316FD46A134AE6A98FE5B4B92C4499"><enum>(2)</enum><header>Traditional
			 uses</header><text>Subject to any terms and conditions the Secretary determines
			 to be necessary and in accordance with applicable law, the Secretary shall
			 allow for the continued use of the national monument by members of Indian
			 tribes—</text>
					<subparagraph id="H2E9F50A588D545EFAD23A4B3A76306C3"><enum>(A)</enum><text>for traditional
			 ceremonies; and</text>
					</subparagraph><subparagraph id="H177918BFA1CE48A9848690F684E8DE80"><enum>(B)</enum><text>as a source of
			 traditional plants and other materials.</text>
					</subparagraph></paragraph></subsection><subsection id="H7D343E1AE728484783B5B2DDF359CA8F"><enum>(c)</enum><header>Vegetation
			 management</header><text>The Secretary may carry out vegetation management
			 treatments within the national monument, except that the harvesting of timber
			 shall only be used if the Secretary determines that the harvesting is necessary
			 for—</text>
				<paragraph id="HF5BA68210CD044A392E393D5FBE022B7"><enum>(1)</enum><text>ecosystem
			 restoration in furtherance of section 3(a); or</text>
				</paragraph><paragraph id="HC9FD4DF85E1445E9B4F9E8D2A18B7772"><enum>(2)</enum><text>the control of
			 fire, insects, or diseases.</text>
				</paragraph></subsection><subsection id="H5CC8C30C56EF4ADAA503FFB6D9E4BD01"><enum>(d)</enum><header>Motor vehicles
			 and mountain bikes</header><text>The use of motor vehicles and mountain bikes
			 in the national monument shall be limited to the roads and trails identified by
			 the Secretary as appropriate for the use of motor vehicles and mountain
			 bikes.</text>
			</subsection><subsection id="HE5F7B99CDDA64579B62CE38CB8E8D328"><enum>(e)</enum><header>Grazing</header><text>The
			 Secretary shall permit grazing within the national monument, where established
			 before the date of the enactment of this Act—</text>
				<paragraph id="HF34AC65A72424AEDB1230216C90103D2"><enum>(1)</enum><text>subject to all
			 applicable laws (including regulations); and</text>
				</paragraph><paragraph id="H6C1C94C202D2421D8748B439E14D6F2F"><enum>(2)</enum><text>consistent with
			 the purposes described in section 3(a).</text>
				</paragraph></subsection><subsection id="H75C840EBC3ED42B89238931A4F442AFA"><enum>(f)</enum><header>Utility
			 right-of-Way upgrades</header><text>Nothing in this Act precludes the Secretary
			 from renewing or authorizing the upgrading of a utility right-of-way in
			 existence as of the date of the enactment of this Act through the national
			 monument—</text>
				<paragraph id="H1E7B222EA0664443A419F9E34D395739"><enum>(1)</enum><text>in accordance
			 with—</text>
					<subparagraph id="H8C97CFC4B20A4901A4B6E664DC460804"><enum>(A)</enum><text>the National
			 Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>); and</text>
					</subparagraph><subparagraph id="HA321E23B9CBD46AEBF2AF643CB2FF624"><enum>(B)</enum><text>any other
			 applicable law; and</text>
					</subparagraph></paragraph><paragraph id="H60027C0083E84CABAEF99F9B78DFC564"><enum>(2)</enum><text>subject to such
			 terms and conditions as the Secretary determines to be appropriate.</text>
				</paragraph></subsection><subsection id="H94E138ABDF8D4BD3848C04AFD9C58D5E"><enum>(g)</enum><header>Volunteers</header><text>The
			 Secretary shall allow for the continued access and work of volunteers at the
			 national monument.</text>
			</subsection><subsection id="HDE28C1DFFC584784B0A8BF5F1B0A2A2E"><enum>(h)</enum><header>Research</header><text>Scientific
			 research, including archeological research, educational, and interpretive uses
			 shall be permitted within the Monument.</text>
			</subsection><subsection id="HE3E971C2D8EF45DCA6B798E54560EEF7"><enum>(i)</enum><header>Other
			 administrative costs</header><text>Any signs, fixtures, alterations, or
			 additions needed in connection with the designation or advertisement of the
			 Monument shall be paid for only with non-Federal funds or amounts made
			 available for such purposes in prior Acts of appropriation.</text>
			</subsection><subsection id="H63209E45AE1745698B2FD08C12A53D02"><enum>(j)</enum><header>Designation of
			 manager</header><text display-inline="yes-display-inline">As soon as
			 practicable after the management plan is developed under section 5(a), the
			 Secretary shall designate an employee of the Department of Agriculture whose
			 duties shall include acting as the point of contact for the management of the
			 national monument.</text>
			</subsection><subsection id="HC056AEE7152747D892DA062E48D5BE8D"><enum>(k)</enum><header>Other
			 recreational uses</header><text>The Secretary shall allow continued use of the
			 national monument for hunting, fishing, and other recreational uses authorized
			 on the date of the enactment of this Act, except that the Secretary may
			 implement temporary emergency closures or restrictions of the smallest
			 practicable area to provide for public safety, resource conservation, or other
			 purposes authorized by law.</text>
			</subsection></section><section id="HE83344A076E24BAB82DD57406F3EF5AA"><enum>5.</enum><header>Management
			 plan</header>
			<subsection id="H1D1F523F46F14517A7058411723510A8"><enum>(a)</enum><header>In
			 general</header><text>Not later than 3 years after the date of the enactment of
			 this Act, the Secretary, in consultation with Indian tribes with a cultural or
			 historic tie to Chimney Rock, shall develop a management plan for the national
			 monument.</text>
			</subsection><subsection id="H956F913963354FFEBD452E552D5BE04C"><enum>(b)</enum><header>Public
			 comment</header><text>In developing the management plan, the Secretary shall
			 provide an opportunity for public comment by—</text>
				<paragraph id="H455839C3249741F6A41584BE2AA39216"><enum>(1)</enum><text>State and local
			 governments;</text>
				</paragraph><paragraph id="HDB4CD087B26A41B5A8784FA52E14E71E"><enum>(2)</enum><text>tribal
			 governments; and</text>
				</paragraph><paragraph id="H21390DC3B344404D850FBF735847D36C"><enum>(3)</enum><text>any other
			 interested organizations and individuals.</text>
				</paragraph></subsection></section><section id="H144073D42B9142ED8927D8268FE16658"><enum>6.</enum><header>Land
			 acquisition</header><text display-inline="no-display-inline">The Secretary may
			 acquire land and any interest in land within or adjacent to the boundary of the
			 national monument by—</text>
			<paragraph id="HEC81DFB625FD4A6689B4E116B429E5AD"><enum>(1)</enum><text>purchase from
			 willing sellers with donated or appropriated funds;</text>
			</paragraph><paragraph id="HE16CB336F4EC469CA58EBC273B00059F"><enum>(2)</enum><text>donation;
			 or</text>
			</paragraph><paragraph id="H6564B50ABC8C423A8212CAD8D163B707"><enum>(3)</enum><text>exchange.</text>
			</paragraph></section><section id="HAFF262B54D3E4448AACF2FCA772BE892"><enum>7.</enum><header>Withdrawal</header>
			<subsection id="H3DB5A13D19E549139BF6F5E5ACE0F6D8"><enum>(a)</enum><header>In
			 general</header><text>Subject to valid existing rights, all Federal land within
			 the national monument (including any land or interest in land acquired after
			 the date of the enactment of this Act) is withdrawn from—</text>
				<paragraph id="HD54255CD0A144E03A7A429C26742179A"><enum>(1)</enum><text>entry,
			 appropriation, or disposal under the public land laws;</text>
				</paragraph><paragraph id="H2DF0224482CF426CA1F8C3510AAD2142"><enum>(2)</enum><text>location, entry,
			 and patent under the mining laws; and</text>
				</paragraph><paragraph id="H0B2D0A91CBD44B2EA937EE96656D2367"><enum>(3)</enum><text>subject to
			 subsection (b), operation of the mineral leasing, mineral materials, and
			 geothermal leasing laws.</text>
				</paragraph></subsection><subsection id="H010E26CDE6BA46B8838BBE96B9E81CAB"><enum>(b)</enum><header>Limitation</header><text>Notwithstanding
			 subsection (a)(3), the Federal land is not withdrawn for the purposes of
			 issuance of gas pipeline rights-of-way within easements in existence as of the
			 date of the enactment of this Act.</text>
			</subsection></section><section id="H0AE7100FF3274078971FFF8FD08C443C"><enum>8.</enum><header>Effect</header>
			<subsection id="HAD0366A855334EA8ACB35C1520F6FE19"><enum>(a)</enum><header>Water
			 rights</header>
				<paragraph id="H5CC5BEBF81374F4EB6451717686B1CFB"><enum>(1)</enum><header>In
			 general</header><text>Nothing in this Act affects any valid water rights,
			 including water rights held by the United States.</text>
				</paragraph><paragraph id="HEB82D713A79645B29AD789847F93EACD"><enum>(2)</enum><header>Reserved water
			 right</header><text>The designation of the national monument does not create a
			 Federal reserved water right.</text>
				</paragraph></subsection><subsection id="H52A80D9EC59A45C08E653855B8C7ABB0"><enum>(b)</enum><header>Tribal
			 rights</header><text>Nothing in this Act affects—</text>
				<paragraph id="H4C8129E0266944F4B1A2FE648668510D"><enum>(1)</enum><text>the rights of any
			 Indian tribe on Indian land;</text>
				</paragraph><paragraph id="HBCB07097C8294C6FBE571775FF0FBE3F"><enum>(2)</enum><text>any individually
			 held trust land or Indian allotment; or</text>
				</paragraph><paragraph id="HFE19BC25EC2546D582F8255AD46D2A85"><enum>(3)</enum><text>any treaty rights
			 providing for nonexclusive access to or within the national monument by members
			 of Indian tribes for traditional and cultural purposes.</text>
				</paragraph></subsection><subsection id="HD813FC384B5E472EB05A882D9ECABF29"><enum>(c)</enum><header>Fish and
			 wildlife</header><text>Nothing in this Act affects the jurisdiction of the
			 State with respect to the management of fish and wildlife on public land in the
			 State.</text>
			</subsection><subsection id="HDC9625FF20E84D5983C36B117734257F"><enum>(d)</enum><header>Adjacent
			 uses</header><text>Nothing in this Act—</text>
				<paragraph id="HCCB556CE4C314212A272461CBBAB4410"><enum>(1)</enum><text>creates a
			 protective perimeter or buffer zone around the national monument; or</text>
				</paragraph><paragraph id="H6A97ECC7C0594A76AEC11FF756EACE62"><enum>(2)</enum><text>affects private
			 property outside of the boundary of the national monument.</text>
				</paragraph></subsection></section></legis-body>
