		<official-title>To amend the Magnuson-Stevens Fishery Conservation and
		  Management Act to reform procedures for the payment of funds from the asset
		  forfeiture fund, and for other purposes.</official-title>

		<section id="H089EE391CDAF40A7BE37D20A37BC34E9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Asset Forfeiture Fund Reform and
			 Distribution Act of 2011</short-title></quote>.</text>
		</section><section id="H8A783FF17CC64FDDAC648296FA19685D"><enum>2.</enum><header>Asset forfeiture
			 fund reform</header>
			<subsection id="HB18B7858B5FC40768F2A66ECB8042922"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 311(e) of the
			 Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1861(e)) is
			 amended—</text>
				<paragraph display-inline="no-display-inline" id="H5DFAC71B175643A29C021CC4B358699E"><enum>(1)</enum><text>by striking
			 <quote>(1) Notwithstanding </quote> and inserting <quote>(1)(A)
			 Notwithstanding</quote>; and</text>
				</paragraph><paragraph id="HC1DB004EBADF4FEBB46DDBCF6BF8E31E"><enum>(2)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="H905BD6A0A6674183808A276558ABEBDB"><enum>(A)</enum><text>by striking
			 <quote>may pay from</quote> and inserting <quote>shall use each of the</quote>;
			 and</text>
					</subparagraph><subparagraph id="HB63A2BDBCD224099B7E2BA0CD906C451"><enum>(B)</enum><text>by striking
			 <quote>(16 U.S.C. 3371 et seq.)—</quote> and all that follows through the end
			 of the paragraph and inserting the
			 following:</text>
						<quoted-block display-inline="yes-display-inline" id="HE09929AE8349443E85EDF00B8557B1E0" style="OLC">
							<text>(16 U.S.C. 3371 et seq.), to make a
			 payment, in the amount of the sum received—</text><clause id="H7C44D766BAD040E4A9FFD0D655626D68" indent="up2"><enum>(i)</enum><text display-inline="yes-display-inline">if
				the violation occurred in a State, to such State;</text>
							</clause><clause id="H0F3E8E0981084BB8A2A7CCF20BFD11F0" indent="up2"><enum>(ii)</enum><text>if the violation did not occur in a
				State, to the State in which the vessel involved in the violation is
				homeported; or</text>
							</clause><clause id="H5C758A5155B4495DAD356418213D4315" indent="up2"><enum>(iii)</enum><text>if the violation did not occur in a
				State and did not involve a vessel, to the State which is most directly
				affected by the violation.</text>
							</clause><subparagraph id="H754AC34EDC774A8997D76603BB14C4B7" indent="up2"><enum>(B)</enum><text>Amounts paid to a State under
				subparagraph (A) shall be used for research and monitoring activities as
				determined appropriate by the head of the agency of the State that is
				responsible for management of marine fisheries. Such activities may
				include—</text>
								<clause id="H99F901B61CD1475BA514699E205565F0"><enum>(i)</enum><text display-inline="yes-display-inline">fishery research and independent stock
				assessments, including cooperative research;</text>
								</clause><clause id="H9337A86DEAB34E18AE89BC57A39B7A45"><enum>(ii)</enum><text>socioeconomic assessments, including
				socioeconomic conditions of fishing communities;</text>
								</clause><clause id="HDDE19E30EE224DA9A3D0CAF82A28F2F9"><enum>(iii)</enum><text>data collection, including creation
				of an information system that will enable timely audit and transmission of data
				for utilization by researchers and other collaborating institutions;</text>
								</clause><clause id="H3972666A4C5E4712824C567FB911231F"><enum>(iv)</enum><text>compensation for the costs of
				analyzing the economic impacts of fishery management decisions and to analyze
				potential methods to provide targeted compensation to fisherman that have been
				harmed by such management decisions;</text>
								</clause><clause id="H68329697DF874F3CB5B54D1F9EFACEC3"><enum>(v)</enum><text>at-sea and shoreside monitoring of
				fishing;</text>
								</clause><clause id="HFA7C6B38B5EA418D8FBFB01E43440FC1"><enum>(vi)</enum><text>preparation of fishery impact
				statements; and</text>
								</clause><clause id="H6E8E4A8891F34B758C360F880B2AF3DF"><enum>(vii)</enum><text>other activities that a Regional
				Fishery Management Council of which the State is a member considers to be
				necessary to rebuild or maintain sustainable fisheries, ensure healthy
				ecosystems, provide socioeconomic economic assistance, or maintain fishing
				communities.</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H791A1468B13B4E87B543D8CD97F5B248"><enum>(b)</enum><header>Rule of
			 application</header><text display-inline="yes-display-inline">The amendments
			 made by subsection (a) shall apply with respect to amounts received under
			 section 311(e) of the Magnuson-Stevens Fishery Conservation and Management Act
			 (16 U.S.C. 1861(e)) after September 30, 2011.</text>
			</subsection><subsection id="HF1B301358DC349AD82F930132FAEC800"><enum>(c)</enum><header>Transition
			 rule</header>
				<paragraph id="HE8256E605B0943A79410432B597674AE"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary may use
			 any amount received as a fisheries enforcement penalty before October 1, 2011,
			 to reimburse appropriate legal fees and costs to a covered person in an amount
			 not to exceed $200,000 per covered person.</text>
				</paragraph><paragraph id="H15F27799142F494683748D772AB42D27"><enum>(2)</enum><header>Timing</header>
					<subparagraph id="H5E3AB59339BA494B8A10490B6C0B9961"><enum>(A)</enum><header>Submission of
			 application</header><text>A covered person seeking reimbursement of appropriate
			 legal fees and costs under paragraph (1) shall submit to the Secretary an
			 application for such reimbursement—</text>
						<clause id="H5262C2EC9AB14EEF84FAB9C6AE6158D5"><enum>(i)</enum><text>in
			 the case of a covered person described in paragraph (4)(B)(i), not later than
			 December 31, 2011; and</text>
						</clause><clause id="H9A0524818DD2460AA2B07DE629A4AFF6"><enum>(ii)</enum><text>in
			 the case of a covered person described in paragraph (4)(B)(ii), not later than
			 1 year after the date on which the Secretary directed that such covered person
			 shall receive a remittance of a fisheries enforcement penalty.</text>
						</clause></subparagraph><subparagraph id="H30C33BAA887A46539612AE5BF48E4CD4"><enum>(B)</enum><header>Determination</header><text>Not
			 later than 60 days after receiving an application under paragraph (1), the
			 Secretary shall make a final determination on whether to provide such
			 reimbursement and the amount of any such reimbursement.</text>
					</subparagraph></paragraph><paragraph id="H938097C06B284E87A8333B5E0C323BB7"><enum>(3)</enum><header>Remaining
			 funds</header><text>The Secretary shall use—</text>
					<subparagraph id="HDB66F746697F434383C1C3DBAECE1260"><enum>(A)</enum><text display-inline="yes-display-inline">80 percent of the amounts described in
			 paragraph (1) remaining after all reimbursements have been made under such
			 paragraph, for fishery stock assessments in the fishery management region that
			 the Secretary determines to be appropriate; and</text>
					</subparagraph><subparagraph id="H56E680E67F87424DA54DBD8A8130F4E7"><enum>(B)</enum><text display-inline="yes-display-inline">20 percent of such amounts to make payments
			 to States in accordance with section 311(e)(1) of the Magnuson-Stevens Fishery
			 Conservation and Management Act (16 U.S.C. 1861(e)(1)).</text>
					</subparagraph></paragraph><paragraph id="H6E8A47A2C1D2475E8E957ED05C7DAF18"><enum>(4)</enum><header>Definitions</header><text>In
			 this subsection:</text>
					<subparagraph id="HBA696899852E4D5AADEB48A0D4057192"><enum>(A)</enum><text>The term
			 <quote>appropriate legal fees and costs</quote> means the legal fees and costs
			 incurred by a covered person—</text>
						<clause id="H83493567C3A64008A5C1597AE70786E1"><enum>(i)</enum><text>that
			 the Secretary determines were appropriately incurred by the covered person in
			 successfully challenging a fisheries enforcement penalty; and</text>
						</clause><clause id="HCA9C492A4B8C4497861AF924281D8210"><enum>(ii)</enum><text>that were
			 incurred not later than 30 days after the date on which the Secretary directed
			 that such penalty shall be remitted to the covered person.</text>
						</clause></subparagraph><subparagraph id="HE143FCF88F0A4D61B76D2D5D82107568"><enum>(B)</enum><text>The term
			 <quote>covered person</quote> means—</text>
						<clause id="HD2A8AC77D66B404EAFC1367A9A088B14"><enum>(i)</enum><text>a
			 person that the Secretary directed shall receive a remittance of a fisheries
			 enforcement penalty in the Decision Memorandum; or</text>
						</clause><clause id="H35A39762C0FF41C0B217DCEB682E1613"><enum>(ii)</enum><text>a
			 person that—</text>
							<subclause id="HBBA458547428453A83C638DD8B88BFF3"><enum>(I)</enum><text display-inline="yes-display-inline">received a Notice of Violation and
			 Assessment issued on or after March 17, 1994, for a fisheries enforcement
			 penalty that was settled or otherwise resolved prior to February 3,
			 2010;</text>
							</subclause><subclause id="HA7D4382A3A0C4E29BA9B6BCE0D3BC59C"><enum>(II)</enum><text>paid such
			 fisheries enforcement penalty;</text>
							</subclause><subclause id="HEE6FEE011AC54E24A05017A9047E4CF3"><enum>(III)</enum><text>submitted a
			 complaint prior to May 7, 2011, seeking remittance of such civil penalty;
			 and</text>
							</subclause><subclause id="H89C94703FEE14F109FCD6ECB716BE530"><enum>(IV)</enum><text display-inline="yes-display-inline">the Secretary directed shall receive a
			 remittance of a fisheries enforcement penalty or a portion of such
			 remittance.</text>
							</subclause></clause></subparagraph><subparagraph id="H7FE7C5A8D96A4A96ABB6DD9F1B239CC2"><enum>(C)</enum><text>The term
			 <quote>Decision Memorandum</quote> means the Secretarial Decision Memorandum
			 issued by the Secretary on May 17, 2011, entitled <quote>Decisions regarding
			 Certain NOAA Fisheries Enforcement Cases Based on Special Master Swartwood’s
			 Report and Recommendations</quote>.</text>
					</subparagraph><subparagraph id="H5CC30EFEE8314F9D9C8CC30897A93C08"><enum>(D)</enum><text display-inline="yes-display-inline">The term <quote>fisheries enforcement
			 penalty</quote> means any fine, penalty, or forfeiture of property imposed for
			 a violation of the Magnuson-Stevens Fishery Conservation and Management Act (16
			 U.S.C. 1801 et seq.) or of any other marine resource law enforced by the
			 Secretary, including the Lacey Act Amendments of 1981 (16 U.S.C. 3371 et
			 seq.).</text>
					</subparagraph><subparagraph id="H8100CAB92BB045AEBA18929BDBEAFBE7"><enum>(E)</enum><text>The term
			 <quote>Secretary</quote> means the Secretary of Commerce.</text>
					</subparagraph></paragraph></subsection></section><section id="H66FC389606B745FF911F33B5AFAD8509"><enum>3.</enum><header>Limitation on
			 administrative law judges in the National Oceanic and Atmospheric
			 Administration</header>
			<subsection id="H33F438FDD12B4E6D8A8BF1FEC348E380"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subject to subsection
			 (b), the Administrator of the National Oceanic and Atmospheric Administration
			 (referred to in this section as <quote>NOAA</quote>) may not assign any
			 proceeding required to be conducted in accordance with sections 556 and 557 of
			 title 5 to an individual who has served as an administrative law judge for NOAA
			 for a period of five or more years if such proceeding pertains to the same
			 fishery management region to which the majority of such proceedings that the
			 individual presided over within the period pertained.</text>
			</subsection><subsection id="H926D800395BF4B5DA90B2A465A60D077"><enum>(b)</enum><header>Reassignment
			 after five years</header><text display-inline="yes-display-inline">Subsection
			 (a) does not apply to an individual who has not served as an administrative law
			 judge for NOAA within a five-year period ending on the date of the assignment
			 described in such subsection.</text>
			</subsection></section><section id="H5D6B8B9E213A4947B7336AF0F12C7857"><enum>4.</enum><header>Definition of
			 fishery management region</header><text display-inline="no-display-inline">In
			 this Act, the term <quote>fishery management region</quote> means a region
			 under the jurisdiction of a Regional Fishery Management Council established
			 under section 302 of the Magnuson-Stevens Fishery Conservation and Management
			 Act (16 U.S.C. 1852).</text>
