		<official-title display="yes">To prohibit operators of civil aircraft of
		  the United States from participating in the European Union’s emissions trading
		  scheme, and for other purposes.</official-title>

		<section id="H63A0CB3A48BE44EE91E4845D94C1C04D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>European Union Emissions Trading
			 Scheme Prohibition Act of 2011</short-title></quote>.</text>
		</section><section id="H9DDD12ECD516428383C197BCE488A385"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="HD2F2B58965F746EEBF2B90582D6729CA"><enum>(1)</enum><text display-inline="yes-display-inline">The European Union has unilaterally imposed
			 an emissions trading scheme (in this section referred to as the
			 <quote>ETS</quote>) on non-European Union aircraft flying to and from, as well
			 as within, Europe.</text>
			</paragraph><paragraph id="H670E37C2D2EB400E93203B62698E31DF"><enum>(2)</enum><text display-inline="yes-display-inline">United States airlines and other United
			 States aircraft operators will be required under the ETS to pay for European
			 Union emissions allowances for aircraft operations within the United States,
			 over other non-European Union countries, and in international airspace for
			 flights serving the European Union.</text>
			</paragraph><paragraph id="H1A757F00512F454A8CB7F1519E61B831"><enum>(3)</enum><text display-inline="yes-display-inline">The European Union’s extraterritorial
			 action is inconsistent with long-established international law and practice,
			 including the Chicago Convention of 1944 and the Air Transport Agreement
			 between the United States and the European Union and its member states, and
			 directly infringes on the sovereignty of the United States.</text>
			</paragraph><paragraph id="H008D3015A9954A348DF3E96B7E958835"><enum>(4)</enum><text display-inline="yes-display-inline">The European Union’s action undermines
			 ongoing efforts at the International Civil Aviation Organization to develop a
			 unified, worldwide approach to reducing aircraft greenhouse gas emissions and
			 has generated unnecessary friction within the international civil aviation
			 community as it endeavors to reduce such emissions.</text>
			</paragraph><paragraph id="H576F9BA5B12F4665929618C37564A684"><enum>(5)</enum><text display-inline="yes-display-inline">The European Union and its member states
			 should instead work with other contracting states of the International Civil
			 Aviation Organization to develop such an approach.</text>
			</paragraph><paragraph id="H378D4E6FB0CE404DADC84D5D18D5E746"><enum>(6)</enum><text display-inline="yes-display-inline">There is no assurance that ETS revenues
			 will be used for aviation environmental purposes by the European Union member
			 states that will collect them.</text>
			</paragraph><paragraph id="HC089FAEC42AD43908BB5F47C6BFFD222"><enum>(7)</enum><text display-inline="yes-display-inline">The United States Government expressed
			 these and other serious objections relating to the ETS to representatives of
			 the European Union and its member states during June 2011, but has not received
			 satisfactory answers to those objections.</text>
			</paragraph></section><section id="HA47983D52DCC45F68949C54CF723D99F"><enum>3.</enum><header>Prohibition on
			 participation in the European Union’s emissions trading scheme</header><text display-inline="no-display-inline">The Secretary of Transportation shall
			 prohibit an operator of a civil aircraft of the United States from
			 participating in any emissions trading scheme unilaterally established by the
			 European Union.</text>
		</section><section id="HE60BF5E745B54FB59476BE2F97216E39"><enum>4.</enum><header>Negotiations</header><text display-inline="no-display-inline">The Secretary of Transportation, the
			 Administrator of the Federal Aviation Administration, and other appropriate
			 officials of the United States Government shall use their authority to conduct
			 international negotiations and take other actions necessary to ensure that
			 operators of civil aircraft of the United States are held harmless from any
			 emissions trading scheme unilaterally established by the European Union.</text>
		</section><section id="HF4CC2E996152440E8FD8C54C11368668"><enum>5.</enum><header>Civil aircraft of
			 the United States defined</header><text display-inline="no-display-inline">In
			 this Act, the term <term>civil aircraft of the United States</term> has the
			 meaning given that term under
			 <external-xref legal-doc="usc" parsable-cite="usc/49/40102">section
			 40102(a)</external-xref> of title 49, United States Code.</text>
