			 <quote><short-title>Clean Up Government Act of
			 2011</short-title></quote>.</text>
		</section><section id="H0E3E48C7DCCF412DACA449E4A993BF72"><enum>2.</enum><header>Venue for Federal
			 offenses</header><text display-inline="no-display-inline">Section 3237(a) of
			 title 18, United States Code, is amended by inserting after <quote>begun,
			 continued, or completed</quote> the following: <quote>or in any district in
			 which an act in furtherance of an offense is committed</quote>.</text>
		</section><section commented="no" id="H0D24D8DF37CC474488C17096072E1EF7"><enum>3.</enum><header>Theft or bribery
			 concerning programs receiving Federal financial assistance</header><text display-inline="no-display-inline">Section 666(a) of title 18, United States
			 Code, is amended—</text>
			<paragraph commented="no" id="HF7F4321B59FC43CABE9469CB71B31AA2"><enum>(1)</enum><text>by striking <quote>10
			 years</quote> and inserting <quote>20 years</quote>;</text>
			</paragraph><paragraph commented="no" id="H1804D9C291CD40BAAAF18D1D599000D8"><enum>(2)</enum><text>by striking
			 <quote>$5,000</quote> the second place and the third place it appears and
			 inserting <quote>$1,000</quote>;</text>

			 <quote>anything of value</quote> each place it appears and inserting <quote>any

			 violations</header><text display-inline="no-display-inline">Section 641 of
			 title 18, United States Code, is amended by striking <quote>ten years</quote>
			 and inserting <quote>15 years</quote>.</text>
		</section><section id="H365AF542ED1347968F43D95F4A794C8A"><enum>5.</enum><header>Bribery and
			 graft</header><text display-inline="no-display-inline">Section 201 of title 18,
			 United States Code, is amended—</text>
			<paragraph id="HAEE92727F28643E39CE9E6C7DD94738E"><enum>(1)</enum><text>in subsection (a)—</text>
				<subparagraph id="H079FD9F4F7EF4189968B3EFEB93DB8B0"><enum>(A)</enum><text>in paragraph (2), by
			 striking <quote>and</quote> at the end;</text>
				</subparagraph><subparagraph id="H663E0E82FA45410ABD562858AECB529E"><enum>(B)</enum><text>in paragraph (3), by
			 striking the period at the end; and</text>
				</subparagraph><subparagraph id="H19838C946C5C4650843D628C5009DB55"><enum>(C)</enum><text>by adding at the end the
			 following:</text>

			 <quote>anything of value</quote> each place it appears and inserting <quote>any
			 thing or things of value of not less than $1,000</quote>.</text>
			</paragraph></section><section id="H7E6D6D76E95C4A88AAF3D16F983B275E"><enum>6.</enum><header>Addition of District of
			 Columbia to theft of public money offense</header><text display-inline="no-display-inline">Section 641 of title 18, United States Code,
			 is amended by inserting <quote>the District of Columbia or</quote> before
			 <quote>the United States</quote> each place such term appears.</text>
		</section><section id="H7676B4D1E6BB4D8EBF140CAEA1449A36"><enum>7.</enum><header>Clarification of crime
			 of illegal gratuities</header><text display-inline="no-display-inline">Subparagraphs (A) and (B) of section
			 201(c)(1) of title 18, United States Code, are each amended by inserting
			 <quote>the official’s or person’s official position or</quote> before
			 <quote>any official act</quote>.</text>
		</section><section id="H2847699FEBB54E608D98C8A55523C79D"><enum>8.</enum><header>Clarification of
			 definition of <quote>official act</quote></header><text display-inline="no-display-inline">Section 201(a)(3) of title 18, United States
			 Code, is amended to read as follows:</text>
			<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="HC78B06A60B154ECAA5B95A97E6A52024" reported-display-style="italic" style="USC">
				<paragraph id="H18E45AF68DCB460FA9917873DC650762"><enum>(3)</enum><text>the term <term>official
				act</term>—</text>
					<subparagraph id="H0794FEE50A524EC1B3CBDF2EE5842FDD"><enum>(A)</enum><text>means any act within the
				range of official duty, and any decision, recommendation, or action on any
				question, matter, cause, suit, proceeding, or controversy, which may at any
				time be pending, or which may by law be brought before any public official, in
				such public official’s official capacity or in such official’s place of trust
				or profit; and</text>
					</subparagraph><subparagraph id="H2204F3E8F8DD4BB5A4339A7E7ACD7A48"><enum>(B)</enum><text>may be a single act, more
				than one act, or a course of
				conduct.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HB7846890F3444EDE88B93E0471D2EE4B"><enum>9.</enum><header>Amendment of the
			 sentencing guidelines relating to certain crimes</header>
			<subsection id="H9C58955BCA1D4CD9829115F8A38F1EFD"><enum>(a)</enum><header>Directive to Sentencing
			 Commission</header><text display-inline="yes-display-inline">Pursuant to its
			 authority under section 994(p) of title 28, United States Code, and in
			 accordance with this section, the United States Sentencing Commission forthwith
			 shall review and, if appropriate, amend its guidelines and its policy
			 statements applicable to persons convicted of an offense under section 201,
			 641, or 666 of title 18, United States Code in order to reflect the intent of
			 Congress that such penalties meet the requirements in subsection (b) of this
			 section.</text>
			</subsection><subsection id="H5522B3C823B3419D8E70227F34D8C2F1"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">In carrying out this subsection, the
			 Commission shall—</text>
				<paragraph id="HBBB126FEB0404F10A208E432D02CFC8F"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that the sentencing guidelines and
			 policy statements reflect Congress’s intent that the guidelines and policy
			 statements reflect the serious nature of the offenses described in paragraph
			 (1), the incidence of such offenses, and the need for an effective deterrent
			 and appropriate punishment to prevent such offenses;</text>
				</paragraph><paragraph id="H865F50CB1E66452BB3DAC960CF5ABF53"><enum>(2)</enum><text display-inline="yes-display-inline">consider the extent to which the guidelines
			 may or may not appropriately account for—</text>
					<subparagraph id="H6E02B3148E594E0BBB463D4B9BA2989E"><enum>(A)</enum><text>the potential and actual
			 harm to the public and the amount of any loss resulting from the
			 offense;</text>
					</subparagraph><subparagraph id="HD8BD35E90C844CBE84046807E219D014"><enum>(B)</enum><text>the level of
			 sophistication and planning involved in the offense;</text>
					</subparagraph><subparagraph id="H2A1E39061C26442B90AA0A4C1186E499"><enum>(C)</enum><text>whether the offense was
			 committed for purposes of commercial advantage or private financial
			 benefit;</text>
					</subparagraph><subparagraph id="HF17AF71F7ED149009720A7B5EDF8FACB"><enum>(D)</enum><text>whether the defendant
			 acted with intent to cause either physical or property harm in committing the
			 offense;</text>
					</subparagraph><subparagraph id="HAFDA3A73B1AF44739C79D8561FCC277F"><enum>(E)</enum><text>the extent to which the
			 offense represented an abuse of trust by the offender and was committed in a
			 manner that undermined public confidence in the Federal, State or local
			 government; and</text>
					</subparagraph><subparagraph id="HA8892A02FC8940AAA68613DC17BE3B80"><enum>(F)</enum><text>whether the violation was
			 intended to or had the effect of creating a threat to public health or safety,
			 injury to any person or even death;</text>
					</subparagraph></paragraph><paragraph id="HA2F5988C4EEE41A1BD93AE3B79622BA3"><enum>(3)</enum><text>assure reasonable
			 consistency with other relevant directives and with other sentencing
			 guidelines;</text>
				</paragraph><paragraph id="H9032B8915DFC4AD58008B0E54FAB6C2F"><enum>(4)</enum><text>account for any
			 additional aggravating or mitigating circumstances that might justify
			 exceptions to the generally applicable sentencing ranges;</text>
				</paragraph><paragraph id="H20C763C8ED79435497CC004A3C1FCE6D"><enum>(5)</enum><text>make any necessary
			 conforming changes to the sentencing guidelines; and</text>
				</paragraph><paragraph id="H44A3584A1408469DA63311E99FB20F80"><enum>(6)</enum><text>assure that the
			 guidelines adequately meet the purposes of sentencing as set forth in section
			 3553(a)(2) of title 18, United States Code.</text>
				</paragraph></subsection></section><section id="HC494BD7440424906B22B067797E543E4"><enum>10.</enum><header>Extension of statute of
			 limitations for serious public corruption offenses</header>
			<subsection id="H8B7570DF390F47459C82479FB65FB06A"><enum>(a)</enum><header>In
			 general</header><text>Chapter 213 of title 18, United States Code, is amended
			 by adding at the end the following:</text>
				<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="HEB9854C79B94485B8C82B9604847D4CC" reported-display-style="italic" style="USC">
					<section id="HA293B891166C485D94A8166863E93A66"><enum>3302.</enum><header>Corruption
				offenses</header><text display-inline="no-display-inline">Unless an indictment
				is returned or the information is filed against a person within 6 years after
				the commission of the offense, a person may not be prosecuted, tried, or
				punished for a violation of, or a conspiracy or an attempt to violate the
				offense in—</text>
						<paragraph id="H44E8A49255F84A95B2FB3DFB55BEB598"><enum>(1)</enum><text>section 201 or
				666;</text>
						</paragraph><paragraph id="HEFF7B373B30E4FBEA53150AC1EF57DEE"><enum>(2)</enum><text>section 1341 or 1343,
				when charged in conjunction with section 1346 and where the offense involves a
				scheme or artifice to deprive another of the intangible right of honest
				services of a public official;</text>
						</paragraph><paragraph id="H816ACF9772BA4235A58B6B43BFBAC708"><enum>(3)</enum><text>section 1951, if the
				offense involves extortion under color of official right;</text>
						</paragraph><paragraph id="H7DA37FE422D4421D974090A7B5FB9EED"><enum>(4)</enum><text>section 1952, to the
				extent that the unlawful activity involves bribery; or</text>
						</paragraph><paragraph id="H8A93D76A50304F43811B5AFC8C5158D3"><enum>(5)</enum><text>section 1962, to the
				extent that the racketeering activity involves bribery chargeable under State
				law, involves a violation of section 201 or 666, section 1341 or 1343, when
				charged in conjunction with section 1346 and where the offense involves a
				scheme or artifice to deprive another of the intangible right of honest
				services of a public official, or section 1951, if the offense involves
				extortion under color of official
				right.</text>
						</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H217E73C721E04F1FB9491E8B7095E24C"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 213
			 of title 18, United States Code, is amended by adding at the end the following
			 new item:</text>

			 penalties for certain public corruption related offenses</header>
			<subsection id="H0FD8CF15926A462089CBCDA2ECB4F441"><enum>(a)</enum><header>Solicitation of
			 political contributions</header><text display-inline="yes-display-inline">Section 602(a)(4) of title 18, United
			 States Code, is amended by striking <quote>3 years</quote> and inserting
			 <quote>5 years</quote>.</text>
			</subsection><subsection id="H5D12707E1ADC4B3EA440D0AB444DA011"><enum>(b)</enum><header>Promise of employment
			 for political activity</header><text>Section 600 of title 18, United States
			 Code, is amended by striking <quote>one year</quote> and inserting <quote>3
			 years</quote>.</text>
			</subsection><subsection id="H54E46DFE5F8A4EAE9AA817B70AD34FC2"><enum>(c)</enum><header>Deprivation of
			 employment for political activity</header><text>Section 601(a) of title 18,
			 United States Code, is amended by striking <quote>one year</quote> and
			 inserting <quote>3 years</quote>.</text>
			</subsection><subsection id="H0FFE4842FE164C628B263CFD7182992A"><enum>(d)</enum><header>Intimidation To secure
			 political contributions</header><text>Section 606 of title 18, United States
			 Code, is amended by striking <quote>three years</quote> and inserting <quote>5
			 years</quote>.</text>
			</subsection><subsection id="H00E1C977C5EE40E4BF3750ABCF30D23A"><enum>(e)</enum><header>Solicitation and
			 acceptance of contributions in federal offices</header><text display-inline="yes-display-inline">Section 607(a)(2) of title 18, United
			 States Code, is amended by striking <quote>3 years</quote> and inserting
			 <quote>5 years</quote>.</text>
			</subsection><subsection id="HEC8022A6FD51402A9CBAB7C43F0E88A5"><enum>(f)</enum><header>Coercion of political
			 activity by federal employees</header><text display-inline="yes-display-inline">Section 610 of title 18, United States
			 Code, is amended by striking <quote>three years</quote> and inserting <quote>5
			 years</quote>.</text>

			 predicates</header><text display-inline="no-display-inline">Section 2516(1)(c)
			 of title 18, United States Code, is amended—</text>
			<paragraph id="HD79E4297C4A74A7D8C3787AAF01B2DB3"><enum>(1)</enum><text>by inserting
			 <quote>section 641 (relating to embezzlement or theft of public money,
			 property, or records), section 666 (relating to theft or bribery concerning
			 programs receiving Federal funds),</quote> after <quote>section 224 (bribery in
			 sporting contests),</quote>; and</text>
			</paragraph><paragraph id="H01FA273AF8454C0FB479156891DB1990"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>section 1031 (relating
			 to major fraud against the United States)</quote> after <quote>section 1014
			 (relating to loans and credit applications generally; renewals and

			 perjury and obstruction of justice proceedings</header>

			 title 18, United States Code, is amended to read as follows:</text>

				the term <term>scheme or artifice to defraud</term> also includes a scheme or
				artifice by a public official to engage in undisclosed self-dealing.</text>
						</subsection><subsection id="H91B6799178A14DD8B55D46C87CB27DD5"><enum>(b)</enum><header>Definitions</header><text>As
				used in this section:</text>
							<paragraph id="H59E260511BD24CAFBBD48A0E7A1FD312"><enum>(1)</enum><header>Official
				act</header><text>The term <term>official act</term>—</text>
								<subparagraph id="HFF00295F39E24887B67CAD39E256B89C"><enum>(A)</enum><text>means any act within the
				range of official duty, and any decision, recommendation, or action on any
				question, matter, cause, suit, proceeding, or controversy, which may at any
				time be pending, or which may by law be brought before any public official, in

								</subparagraph></paragraph><paragraph id="H0A3A0DB117B840A68577A19EA67EA21D"><enum>(2)</enum><header>Public
				official</header><text display-inline="yes-display-inline">The term
				<term>public official</term> means an officer, employee, or elected or
				appointed representative, or person acting for or on behalf of the United
				States, a State, or a subdivision of a State, or any department, agency or
				branch of government thereof, in any official function, under or by authority
				of any such department, agency, or branch of government.</text>
							</paragraph><paragraph id="H8552AEB49C8C4749BB90235E4C15CA4A"><enum>(3)</enum><header>State</header><text>The
				term <term>State</term> includes a State of the United States, the District of
				Columbia, and any commonwealth, territory, or possession of the United
				States.</text>
							</paragraph><paragraph id="H4509E4575CF6461CBAF894F3E37F8A4B"><enum>(4)</enum><header>Undisclosed
				self-dealing</header><text>The term <term>undisclosed self-dealing</term> means
				that—</text>
								<subparagraph id="H9AFB5D8DAB4D43A99FCAE739B2B73C1A"><enum>(A)</enum><text>a public official
				performs an official act for the purpose, in whole or in material part, of
				furthering or benefitting a financial interest, of which the public official
				has knowledge, of—</text>
									<clause id="H165860313C5640AA9D3087ECB02C8099"><enum>(i)</enum><text>the public
				official;</text>
									</clause><clause id="HA7E6BCB563694B3CB288C1A2F8C0C7A1"><enum>(ii)</enum><text>the spouse or minor
				child of a public official;</text>
									</clause><clause id="H99D15B905F754D08846CCFF01A997377"><enum>(iii)</enum><text>a general business
				partner of the public official;</text>
									</clause><clause id="H308CE356088E43D9B2979943DF72B6EC"><enum>(iv)</enum><text>a business or
				organization in which the public official is serving as an employee, officer,
				director, trustee, or general partner;</text>
									</clause><clause id="H9819F074BC314D21A23A296919BBF907"><enum>(v)</enum><text>an individual, business,
				or organization with whom the public official is negotiating for, or has any
				arrangement concerning, prospective employment or financial compensation;
				or</text>
									</clause><clause id="HAD2349AA762B45E6AEB604C80673B800"><enum>(vi)</enum><text display-inline="yes-display-inline">an individual, business, or organization
				from whom the public official has received any thing or things of value,
				otherwise than as provided by law for the proper discharge of official duty, or
				by rule or regulation; and</text>
									</clause></subparagraph><subparagraph id="H2406C1EBA5524640B4C3A3BB934D42B3"><enum>(B)</enum><text display-inline="yes-display-inline">the public official knowingly falsifies,
				conceals, or covers up material information that is required to be disclosed by
				any Federal, State, or local statute, rule, regulation, or charter applicable
				to the public official, or the knowing failure of the public official to
				disclose material information in a manner that is required by any Federal,
				State, or local statute, rule, regulation, or charter applicable to the public
				official.</text>
								</subparagraph></paragraph><paragraph id="H0C007CB7D8CA4204A2BEBB023D7E24C8"><enum>(5)</enum><header>Material
				information</header><text>The term <quote>material information</quote> means
				information—</text>
								<subparagraph id="H280DB0BC04034E36A0205FAA77D19FF5"><enum>(A)</enum><text>regarding a financial
				interest of a person described in clauses (i) through (iv) paragraph (4)(A);
				and</text>
								</subparagraph><subparagraph id="H8E6213BB1402444296D5B39C1AA7CD37"><enum>(B)</enum><text display-inline="yes-display-inline">regarding the association, connection, or
				dealings by a public official with an individual, business, or organization as
				described in clauses (iii) through (vi) of paragraph
				4.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC676C707ABE0492C95FE99397F6FD95C"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of sections for chapter 63 of title 18,
			 United States Code, is amended by inserting after the item relating to section
			 1346 the following new item:</text>

			 amendments made by this section apply to acts engaged in on or after the date
			 of the enactment of this Act.</text>
			</subsection></section><section id="HCD21D34B156340C1A6A0F7B99775DFCF"><enum>15.</enum><header>Disclosure of
			 information in complaints against judges</header><text display-inline="no-display-inline">Section 360(a) of title 28, United States
			 Code, is amended—</text>
			<paragraph id="H1C48EB3CD3E948EE9C0A77B60A2DA3DC"><enum>(1)</enum><text>in paragraph (2) by
			 striking “or”;</text>
			</paragraph><paragraph id="H994FAD8058984D929AFE0EDD655ACD09"><enum>(2)</enum><text>in paragraph (3), by
			 striking the period at the end, and inserting “; or”; and</text>
			</paragraph><paragraph id="H6F5D4FB2759345C7AAE7016BF9C88ABC"><enum>(3)</enum><text>by inserting after
			 paragraph (3) the following:</text>
				<quoted-block changed="added" committee-id="HJU00" display-inline="no-display-inline" id="HD8A2C04DE8F443B899E961EF609B6C0B" reported-display-style="italic" style="USC">

			</paragraph></section><section id="H2AB45DB704C74A2DBB88924FEF107668"><enum>16.</enum><header>Clarification of
			 exemption in certain bribery offenses</header><text display-inline="no-display-inline">Section 666(c) of title 18, United States
			 Code, is amended—</text>
			<paragraph id="HCB98AADCE5F04ACB9585BCF5B62B0B88"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>This section does not
			 apply to</quote>; and</text>
			</paragraph><paragraph id="H858BCF400D0642FCA4F928EA828F0F5B"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>The term
			 <quote>anything of value</quote> that is corruptly solicited, demanded,
			 accepted or agreed to be accepted in subsection (a)(1)(B) or corruptly given,
			 offered, or agreed to be given in subsection (a)(2) shall not include</quote>,
			 before <quote>bona fide salary</quote>.</text>

			 regarding appeals by United States</header><text display-inline="no-display-inline">Section 3731 of title 18, United States
			 Code, is amended by inserting after <quote>United States attorney</quote> the
			 following: <quote>, Deputy Attorney General, Assistant Attorney General, or the
			 Attorney General</quote>.</text>
