for fiscal year 2012. Any amount remaining after all payments are made under
such allowances for fiscal year 2012 shall be deposited in the Treasury and
used for deficit reduction (or, if there is no Federal budget deficit after all
such payments have been made, for reducing the Federal debt, in such manner as
the Secretary of the Treasury considers appropriate).</text>

</subsection><subsection changed="deleted" committee-id="SSAP00" id="HB1F603ED99FC49CB84C3EFE3CC85C672" reported-display-style="strikethrough"><enum>(b)</enum><header>Investigation of
application; report</header><text display-inline="yes-display-inline">The Chief
shall investigate each application for the waiver of a claim under subsection
(a) and shall submit a written report of the investigation to the Capitol
Police Board, except that if the aggregate amount of the claim involved exceeds
$1,500, the Comptroller General may also
investigate the application and submit a written report of the investigation to
the Capitol Police Board.</text>
</subsection><subsection changed="deleted" committee-id="SSAP00" id="H9F38F587B2CF4438BA7C5A990E8B2FE7" reported-display-style="strikethrough"><enum>(c)</enum><header>Prohibition of
waiver under certain circumstances</header><text>The Chief may not exercise the
authority to waive a claim under subsection (a) if—</text>
<paragraph id="H6184FB7751094C57934C0932E5B147E3"><enum>(1)</enum><text display-inline="yes-display-inline">in the Chief’s opinion, there exists in
connection with the claim an indication of fraud, misrepresentation, fault, or
lack of good faith on the part of the officer, member, or employee involved or
of any other person having an interest in obtaining a waiver of the claim;
or</text>
</paragraph><paragraph id="HEBC421A07B914EE3894A7AA9D03FC36E"><enum>(2)</enum><text>the Chief receives
the application for the waiver after the expiration of the 3-year period that
begins on the date on which the erroneous payment of pay or allowances was
discovered.</text>
</paragraph></subsection><subsection changed="deleted" committee-id="SSAP00" id="H8618A2689FA640B0B95804BCC3E3EE95" reported-display-style="strikethrough"><enum>(d)</enum><header>Credit for
waiver</header><text display-inline="yes-display-inline">In the audit and
settlement of accounts of any accountable officer or official, full credit
shall be given for any amounts with respect to which collection by the United
States is waived under subsection (a).</text>
</subsection><subsection changed="deleted" committee-id="SSAP00" id="HC64F0D163F6C47F083536F03DC32F254" reported-display-style="strikethrough"><enum>(e)</enum><header>Effect of
waiver</header><text display-inline="yes-display-inline">An erroneous payment,
the collection of which is waived under subsection (a), is deemed a valid
payment for all purposes.</text>
</subsection><subsection changed="deleted" committee-id="SSAP00" id="HBA6DBA5F0ADF4C7DB2F146D69CAA053D" reported-display-style="strikethrough"><enum>(f)</enum><header>Construction
with other laws</header><text display-inline="yes-display-inline">This section
does not affect any authority under any other law to litigate, settle,
compromise, or waive any claim of the United States.</text>
</subsection><subsection changed="deleted" committee-id="SSAP00" id="HC4689206F2D9454D8607056687896F15" reported-display-style="strikethrough"><enum>(g)</enum><header>Rules and
regulations</header><text>The Chief shall promulgate rules and regulations to
carry out this section.</text>
</subsection><subsection changed="deleted" committee-id="SSAP00" id="HF5ED21E50BA74409A52CB8AE4D572F5D" reported-display-style="strikethrough"><enum>(h)</enum><header>Effective
date</header><text>This section shall apply with respect to payments of pay and
allowances made at any time after the Chief became the disbursing officer for

Federal Judiciary Building and the Folger Shakespeare Library, expenses for
which shall be advanced or reimbursed upon request of the Architect of the
Capitol and amounts so received shall be deposited into the Treasury to the
credit of this appropriation, $127,159,000, of
which $33,377,000 shall remain available until
September 30, 2016:

$9,000,000 of the funds credited or to be
reimbursed to this appropriation as herein provided shall be available for
obligation during fiscal year 2012.</text>

expenses for the mechanical and structural maintenance, care and operation of

expenses of the Government Accountability Office, including not more than
$12,500 to be expended on the certification of
the Comptroller General of the United States in connection with official
representation and reception expenses; temporary or intermittent services under
section 3109(b) of title 5, United States Code, but at rates for individuals
not more than the daily equivalent of the annual rate of basic pay for level IV
of the Executive Schedule under section 5315 of such title; hire of one
passenger motor vehicle; advance payments in foreign countries in accordance
with section 3324 of title 31, United States Code; benefits comparable to those
payable under sections 901(5), (6), and (8) of the

private vehicles, except for emergency assistance and cleaning as may be
provided under regulations relating to parking facilities for the House of

<appropriations-small id="id5ADD2C413E9E4048A0B8B8F08FECE4A6"><header>Fiscal year
limitation</header>
</appropriations-small></section><section id="ID2D4A60DDB74E47589CCBAC74495B7291"><enum>202.</enum><text>No part of the
funds appropriated in this Act shall remain available for obligation beyond
fiscal year 2012 unless expressly so provided in this Act.</text>

</appropriations-small></section><section id="IDA22F13D14D4A4370A1C6AAD05A7F8735"><enum>203.</enum><text>Whenever in this
Act any office or position not specifically established by the Legislative Pay
Act of 1929 (46 Stat. 32 et seq.) is appropriated for or the rate of
compensation or designation of any office or position appropriated for is
different from that specifically established by such Act, the rate of
compensation and the designation in this Act shall be the permanent law with
respect thereto:
<proviso><italic>Provided</italic></proviso>, That the provisions in
this Act for the various items of official expenses of Members, officers, and
committees of the House of Representatives and Senate, and clerk hire for
Senators and Members of the House of Representatives shall be the permanent law
with respect thereto.</text>
<appropriations-small id="id772DD73773CE4588A291E22BFB4D7BD8"><header>Consulting
services</header>
</appropriations-small></section><section id="IDC86DD2948C294D26A2C79C06D11BC0AA"><enum>204.</enum><text>The expenditure
of any appropriation under this Act for any consulting service through
procurement contract, under section 3109 of title 5, United States Code, shall
be limited to those contracts where such expenditures are a matter of public
record and available for public inspection, except where otherwise provided
under existing law, or under existing Executive order issued under existing
law.</text>
<appropriations-small id="id53DB0DD373FF4EB5827A82019EA17FAF"><header>Awards and
settlements</header>
</appropriations-small></section><section id="ID19FEDAEA592A404F891750EF7DD426EA"><enum>205.</enum><text>Such sums as may
be necessary are appropriated to the account described in subsection (a) of
section 415 of the Congressional Accountability Act of 1995 (2 U.S.C. 1415(a))
to pay awards and settlements as authorized under such subsection.</text>
<appropriations-small id="id15E3495E2FF641BFBBF5A04C3688256B"><header>Costs of
lbfmc</header>
</appropriations-small></section><section id="H3CDA7BE947ED43F8B34CE12C9C780E99"><enum>206.</enum><text>Amounts available
for administrative expenses of any legislative branch entity which participates
in the Legislative Branch Financial Managers Council (LBFMC) established by
charter on March 26, 1996, shall be available to finance an appropriate share
of LBFMC costs as determined by the LBFMC, except that the total LBFMC costs to
be shared among all participating legislative branch entities (in such
allocations among the entities as the entities may determine) may not exceed
$2,000.</text>
<appropriations-small id="id9D6A9851891B4EBEA5C19116EE6A4952"><header>Landscape
maintenance</header>
</appropriations-small></section><section id="HBBF171F0B81C437982455EEB058A821A"><enum>207.</enum><text>The Architect of
the Capitol, in consultation with the District of Columbia, is authorized to
maintain and improve the landscape features, excluding streets, in the
irregular shaped grassy areas bounded by Washington Avenue, SW on the
northeast, Second Street SW on the west, Square 582 on the south, and the
beginning of the I–395 tunnel on the southeast.</text>
<appropriations-small id="idD2F4A097A9534F3FA45B1D362668ECB8"><header>Limitation on
transfers</header>
</appropriations-small></section><section id="ID7023747F89CC453E8C26E0BE5B61D684"><enum>208.</enum><text>None of the funds
made available in this Act may be transferred to any department, agency, or
instrumentality of the United States Government, except pursuant to a transfer
made by, or transfer authority provided in, this Act or any other appropriation
Act.</text>
<appropriations-small id="idEB1B9436321245CDBF99899C9B456D3B"><header>Guided tours of the
capitol</header>
</appropriations-small></section><section id="H66DD3E4D82A942DE9A641FD8006EB136"><enum>209.</enum><subsection commented="no" display-inline="yes-display-inline" id="HD5FDF2DB95C2406FB876C489A0CF87FF"><enum>(a)</enum><text>Except as provided in
subsection (b), none of the funds made available to the Architect of the
Capitol in this Act may be used to eliminate or restrict guided tours of the
United States Capitol which are led by employees and interns of offices of
Members of Congress and other offices of the House of Representatives and
Senate.</text>
</subsection><subsection changed="deleted" committee-id="SSAP00" id="H5D5A2647C052487DB5959718C7B6F0C4" reported-display-style="strikethrough"><enum>(b)</enum><text>At the direction
of the Capitol Police Board, or at the direction of the Architect of the
Capitol with the approval of the Capitol Police Board, guided tours of the
United States Capitol which are led by employees and interns described in
subsection (a) may be suspended temporarily or otherwise subject to restriction
for security or related reasons to the same extent as guided tours of the
United States Capitol which are led by the Architect of the Capitol.</text>
</subsection></section><appropriations-small id="HFC270B91DB6842E388CC34D4898D169E"><header>Spending reduction
account</header>
</appropriations-small><section id="H6FA0C955B7DA48A49113C3A1EF332BDE" section-type="subsequent-section"><enum>210.</enum><text display-inline="yes-display-inline">The amount by which the applicable
allocation of new budget authority made by the Committee on Appropriations of
the House of Representatives under section 302(b) of the Congressional Budget
Act of 1974, excluding Senate items, exceeds the amount of proposed new budget
authority is $0 (increased by

Act may be used to deliver a printed copy of any version of the Congressional
Record to the office of a Member of the House of Representatives (including a
Delegate or Resident Commissioner to the Congress).</text>
</section><section id="H74968BC4B5A2463DB043B12EAD76800A"><enum>213.</enum><text display-inline="yes-display-inline">None of the funds made available in this
Act may be used by the Chief Administrative Officer of the House of
Representatives to make any payments from any Members’ Representational
Allowance for the leasing of a vehicle in an aggregate amount that exceeds
$1,000 for the vehicle in any month.</text>

REPRESENTATIVES—<header-in-text level="subsection">Salaries and
Expenses</header-in-text>—<header-in-text level="subsection">Members'
Representational Allowances</header-in-text></quote> shall be available only
for fiscal year 2012. Any amount remaining after all payments are made under
such allowances for fiscal year 2012 shall be deposited in the Treasury and
used for deficit reduction (or, if there is no Federal budget deficit after all
such payments have been made, for reducing the Federal debt, in such manner as
the Secretary of the Treasury considers appropriate).</text>
</subsection><subsection changed="added" committee-id="SSAP00" id="idc6194b5e-c1e7-4e5c-80c2-e50fd9132444" reported-display-style="italic"><enum>(b)</enum><header>Regulations</header><text>The

issue a public report that discloses—</text>
<clause commented="no" display-inline="no-display-inline" id="id1FB77430AD7945958EF19C952280F29E"><enum>(i)</enum><text display-inline="yes-display-inline">each gift or bequest accepted under
subsection (a), including each gift or bequest of personal property,

</clause><clause commented="no" display-inline="no-display-inline" id="id8F5DA195ECC441E4A3DD84539BEF2813"><enum>(ii)</enum><text display-inline="yes-display-inline">details of any financial transaction
required under subsection (a) relating to each of those gifts or
bequests.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID903bf420cffd4a95ac29706b876c68fb"><enum>(B)</enum><header display-inline="yes-display-inline">Publication</header><text display-inline="yes-display-inline">Each public report issued under
subparagraph (A) shall be published in the Annual Report of the Librarian of
Congress and the annual Financial Statements of the Library of Congress, with
specific pagination of each gift or bequest listed in the table of contents or
index.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8c8f0c0733f74e30b524eaefccb5269b"><enum>(C)</enum><header display-inline="yes-display-inline">Website public access</header><text display-inline="yes-display-inline">The Annual Report of the Librarian of
Congress and the annual Financial Statements of the Library of Congress,
including the public report issued under subparagraph (A), shall be posted on
the website of the Library of Congress for public access.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id94F5BC69368C49DCBEEB26FDDD5E1D5D"><enum>(2)</enum><header display-inline="yes-display-inline">Notification</header><text display-inline="yes-display-inline">Not later than 5 business days before
acceptance or rejection of any gift or bequest under subsection (a), the
Librarian of Congress shall notify the Chairman and the Vice-Chairman of the
Joint Committee on the Library of—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="idF6D5CEF7D9514AEDB61E3A4B2AD0E355"><enum>(A)</enum><text display-inline="yes-display-inline">the determination of the Librarian of
Congress to accept or reject that gift or bequest; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC4C6538E83AC40F8A6BFB9DE9F99F10A"><enum>(B)</enum><text display-inline="yes-display-inline">if the gift or bequest is accepted, the
details of all financial transactions relating to that gift or
bequest.</text>

Act shall remain available for obligation beyond fiscal year 2012 unless

DESIGNATION</header>

not specifically established by the Legislative Pay Act of 1929 (46 Stat. 32 et
seq.) is appropriated for or the rate of compensation or designation of any
office or position appropriated for is different from that specifically
established by such Act, the rate of compensation and the designation in this
Act shall be the permanent law with respect thereto:
<proviso><italic>Provided</italic></proviso>, That the provisions in
this Act for the various items of official expenses of Members, officers, and
committees of the Senate and House of Representatives, and clerk hire for
Senators and Members of the House of Representatives shall be the permanent law
with respect thereto.</text>

SERVICES</header>
</appropriations-small></section><section commented="no" display-inline="no-display-inline" id="idD782E87923F047D5B7BE5675FEF8E120" section-type="subsequent-section"><enum>204.</enum><text display-inline="yes-display-inline">The expenditure of any appropriation under
this Act for any consulting service through procurement contract, under section
3109 of title 5, United States Code, shall be limited to those contracts where
such expenditures are a matter of public record and available for public
inspection, except where otherwise provided under existing law, or under
existing Executive order issued under existing law.</text>
<appropriations-small commented="no" id="id6D3A6684AD4E4F19AE361E68A950E53D"><header display-inline="yes-display-inline">AWARDS AND
SETTLEMENTS</header>

appropriated to the account described in subsection (a) of section 415 of the

expenses of any legislative branch entity which participates in the Legislative
Branch Financial Managers Council (LBFMC) established by charter on March 26,
1996, shall be available to finance an appropriate share of LBFMC costs as
determined by the LBFMC, except that the total LBFMC costs to be shared among
all participating legislative branch entities (in such allocations among the
entities as the entities may determine) may not exceed
$2,000.</text>

MAINTENANCE</header>

consultation with the District of Columbia, is authorized to maintain and
improve the landscape features, excluding streets, in the irregular shaped
grassy areas bounded by Washington Avenue, SW, on the northeast, Second Street,

</appropriations-small></section><section commented="no" display-inline="no-display-inline" id="id886618CD6FBA45D492DECED5F6A578BF" section-type="subsequent-section"><enum>208.</enum><text display-inline="yes-display-inline">None of the funds made available in this
Act may be transferred to any department, agency, or instrumentality of the
United States Government, except pursuant to a transfer made by, or transfer
authority provided in, this Act or any other appropriation Act.</text>

CAPITOL</header>
</appropriations-small></section><section commented="no" display-inline="no-display-inline" id="id422AAA47CDB6453BB484896CAD970644" section-type="subsequent-section"><enum>209.</enum><subsection commented="no" display-inline="yes-display-inline" id="idE8B68134593F4A7095671B23152B3D2F"><enum>(a)</enum><text display-inline="yes-display-inline">Except as provided in subsection (b), none
of the funds made available to the Architect of the Capitol in this Act may be
used to eliminate or restrict guided tours of the United States Capitol which
are led by employees and interns of offices of Members of Congress and other
offices of the House of Representatives and Senate.</text>
</subsection><subsection changed="added" commented="no" committee-id="SSAP00" display-inline="no-display-inline" id="id04A10D4851834099ADADE6EF68B167B2" reported-display-style="italic"><enum>(b)</enum><text display-inline="yes-display-inline">At the direction of the Capitol Police
Board, or at the direction of the Architect of the Capitol with the approval of
the Capitol Police Board, guided tours of the United States Capitol which are
led by employees and interns described in subsection (a) may be suspended
temporarily or otherwise subject to restriction for security or related reasons
to the same extent as guided tours of the United States Capitol which are led
by the Architect of the Capitol.</text>
</subsection></section><appropriations-small id="idB807C537D380478B9970AF6CE9DB57D8"><header>(RESCISSION)</header>
</appropriations-small><section id="id3CA45FF60BEE40AA8D9CFF1D0C0FCDB1"><enum>210.</enum><text display-inline="yes-display-inline">Of the unobligated balances available from
prior year appropriations under the heading <quote>Architect of the
Capitol</quote>$17,482,000 are hereby
rescinded.</text>

Act may be cited as the <quote><short-title>Legislative
