		  Administration from the collective bargaining rights of Federal employees and
		  provide employment rights and an employee engagement mechanism for passenger

		<section id="HF00E19A458AF483D97D2753986DAE3A0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Transportation Security Administration
			 Employee Freedom Act of 2011</short-title></quote>.</text>
		</section><section id="H74DCB514F9BA4967BD89E4B1AFA5D3CE"><enum>2.</enum><header>Exclusion of
			 employees of the Transportation Security Administration from the collective
			 bargaining rights of Federal employees</header>
			<subsection id="H7455D81BD19A43969BD738B67465452D"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">Section 7103(a) of
			 title 5, United States Code, is amended—</text>
				<paragraph id="HD8C14ED497184A10BF2456B704B85A1B"><enum>(1)</enum><text>in paragraph
			 (2)—</text>
					<subparagraph id="HFFDC168BF07F4D3E8351C6668A7A7050"><enum>(A)</enum><text>in clause (iv), by
			 striking <quote>; or</quote> and inserting a semicolon;</text>
					</subparagraph><subparagraph id="HAF253A5B1F5C4F75BA329BD101FABA36"><enum>(B)</enum><text>in clause (v), by
			 striking the semicolon and inserting <quote>; or</quote>; and</text>
					</subparagraph><subparagraph id="H715293BFE0464EEA853C3F479141BF6A"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H77E970676BD54D7F8FC964B7942CCEE0" style="OLC">
							<clause id="H5B3DF25B3CFE4AC3ACDCB357BEF28A8C" indent="up1"><enum>(vi)</enum><text>an officer or employee of the
				Transportation Security Administration of the Department of Homeland
				Security;</text>
							</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H2296C53D912648D686DD0CC81BC5E763"><enum>(2)</enum><text>in paragraph
			 (3)—</text>
					<subparagraph id="H0879673316DF4FE8B54648A4919F14CF"><enum>(A)</enum><text>in subparagraph
			 (G), by striking <quote>; or</quote> and inserting a semicolon;</text>
					</subparagraph><subparagraph id="H46422FB13B814ED3BCB8D1A3AD5A2C83"><enum>(B)</enum><text>in subparagraph
			 (H), by striking the period and inserting <quote>; or</quote>; and</text>
					</subparagraph><subparagraph id="H4141157329514BB3AEBECA237C0E9854"><enum>(C)</enum><text>by adding at the
			 end the following:</text>

							<subparagraph id="H1BEBD83E358840CCA1018DBE096FDC5E"><enum>(I)</enum><text>the Transportation
				Security Administration of the Department of Homeland
				Security;</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H0B7A42FDC1284537A5230FE410DAA7FB"><enum>(b)</enum><header>Amendments to
			 title 49</header>
				<paragraph id="H516C354EFFC34387BEB0415C11CAC5AA"><enum>(1)</enum><header>Transportation
			 Security Administration</header><text>Section 114(n) of title 49, United States
			 Code, is amended by adding <quote>This subsection shall be subject to section
			 7103(a)(2)(vi) and (3)(I) of title 5, United States Code.</quote> at the
			 end.</text>
				</paragraph><paragraph id="H1E6CB61814D04A029739A87D06AEF66D"><enum>(2)</enum><header>Personnel
			 management system</header><text>Section 40122 of title 49, United States Code,
			 is amended—</text>
					<subparagraph id="H8B9D3652105C440082BBAFFC4B3F07B9"><enum>(A)</enum><text>by redesignating
			 subsection (j) as subsection (k); and</text>
					</subparagraph><subparagraph id="H5949AD86E3A64703A9C473A6CB07F724"><enum>(B)</enum><text>by inserting after
			 subsection (i) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H1822121CB762427E89293EC3079493A1" style="OLC">
							<subsection id="H9D3D14D57E604EBB9E0C92F253046BF4"><enum>(j)</enum><header>Transportation
				Security Administration</header><text>Notwithstanding any other provision of
				this section (including subsection (g)(2)(C)), this section shall be subject to
				section 7103(a)(2)(vi) and (3)(I) of title 5, United States
				Code.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H4C2EDCBE424445099AFE16D95CD6DC87"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on the
			 date of enactment of this Act and apply to any collective bargaining agreement
			 (as defined under section 7103(a)(8) of title 5, United States Code) entered
			 into on or after that date, including the renewal of any collective bargaining
			 agreement in effect on that date.</text>
			</subsection></section><section id="HA0F90736E307452F8B5213409529868A" section-type="subsequent-section"><enum>3.</enum><header>Employee rights and
			 engagement mechanism for passenger and property screeners</header>
			<subsection id="H70091F76A6A546BAA2D8F3490D149075"><enum>(a)</enum><header>Labor
			 organization membership; appeal rights; engagement mechanism for workplace
			 issues</header>
				<paragraph id="H88C20FADBA274A1EA262E59DE6523FF1"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 111(d) of the
			 Aviation and Transportation Security Act (49 U.S.C. 44935 note) is
			 amended—</text>
					<subparagraph id="HB43FCA1142044C89A871FD112469C1A8"><enum>(A)</enum><text>by striking
			 <quote>Notwithstanding</quote> and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="H908B43FD7A114395BA33306B08BF3367" style="OLC">
							<paragraph id="HD7EA8BC0AAFF4B78B37EB34F7D1DDF1D"><enum>(1)</enum><header>In
				general</header><text>Except as provided in section 883 of the Homeland
				Security Act of 2002 (6 U.S.C. 463) and paragraphs (2) through (5),
				notwithstanding</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H2B45EFEC0C0F42059C949AD1891150E7"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H348440E4905D448B961E539480F2C25B" style="OLC">
							<paragraph commented="no" display-inline="no-display-inline" id="HEBCE00008D0B4E2EA121ED8CFFD920F0"><enum>(2)</enum><header display-inline="yes-display-inline">Labor organization membership</header><text display-inline="yes-display-inline">Nothing in this section shall be construed
				to prohibit an individual described in paragraph (2) from joining a labor
				organization.</text>
							</paragraph><paragraph id="H0DD203CC1141400795FF231869CAC583"><enum>(3)</enum><header>Right to appeal
				adverse action</header><text>An individual employed or appointed to carry out
				the screening functions of the Administrator under section 44901 of title 49,
				United States Code, may submit an appeal of an adverse action covered by
				section 7512 of title 5, United States Code, and finalized after the date of
				the enactment of the FAA Air Transportation Modernization and Safety
				Improvement Act, to the Merit Systems Protection Board and may seek judicial
				review of any resulting orders or decisions of the Merit Systems Protection
				Board.</text>
							</paragraph><paragraph id="HC9C612C089924B638A3A11AA6D810C01"><enum>(4)</enum><header>Employee
				engagement mechanism for addressing workplace issues</header><text>At every
				airport at which the Transportation Security Administration screens passengers
				and property under section 44901 of title 49, United States Code, the
				Administrator shall provide a collaborative, integrated employee engagement
				mechanism to address workplace
				issues.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HCB659806E6D6417BBA035D4ED059F883"><enum>(2)</enum><header>Conforming
			 amendments</header><text>Section 111(d)(1) of such Act, as redesignated by
			 paragraph (1)(A), is amended—</text>
					<subparagraph id="H04B448AB64AC402B9FBF5414B468E5CD"><enum>(A)</enum><text>by striking
			 <quote>Under Secretary of Transportation for Security</quote> and inserting
			 <quote>Administrator of the Transportation Security Administration</quote>;
			 and</text>
					</subparagraph><subparagraph id="H3321217F0BF7482FA41A2A24E18BBA0A"><enum>(B)</enum><text>by striking
			 <quote>Under Secretary</quote> each place it appears and inserting
			 <quote>Administrator</quote>.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H91CE454FBE0346D1B55A8591CB6FB3CE"><enum>(b)</enum><header>Whistleblower
			 protections</header><text display-inline="yes-display-inline">Section 883 of
			 the Homeland Security Act of 2002 (6 U.S.C. 463) is amended, in the matter
			 preceding paragraph (1), by inserting <quote>, or section 111(d) of the
			 Aviation and Transportation Security Act (49 U.S.C. 44935 note),</quote> after
			 <quote>this Act</quote>.</text>
