		  improve the diagnosis and treatment of lymphedema under the Medicare program
		  and to reduce costs under such program related to the treatment of

		<section id="HD9A02283B81F4DE39FFA963F1FB71CD8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Lymphedema Diagnosis and Treatment
			 Cost-Saving Act of 2011</short-title></quote>.</text>
		</section><section id="H16625A16A759487995A11D519F2461E9"><enum>2.</enum><header>Coverage of
			 lymphedema diagnosis and treatment services under Medicare</header>
			<subsection id="H04CE4A8B744C4FB1B68954B68440DCA6"><enum>(a)</enum><header>Coverage of
			 services</header><text display-inline="yes-display-inline">Section 1861 of the
			 Social Security Act (42 U.S.C. 1395x) is amended—</text>
				<paragraph id="H88C5FCAC0A8248A798556D54F27FEFED"><enum>(1)</enum><text>in subsection
			 (s)(2)—</text>
					<subparagraph id="H61F292BEF3C44A5E9C3E1EA2D5E6D7E7"><enum>(A)</enum><text>in subparagraph
			 (EE), by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="H0959F1BE3A06474A821BBEA78CF9928A"><enum>(B)</enum><text>in subparagraph
			 (FF), by adding <quote>and</quote> at the end; and</text>
					</subparagraph><subparagraph id="HA91F17F42C2D4E1DB110CB65938E8CCE"><enum>(C)</enum><text>by adding at the
			 end the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="HC8924ACB55924895A22F857D4C42D5CC" style="OLC">
							<subparagraph commented="no" id="H6238CAB8287D40C3AE2853F738A6FCE0"><enum>(GG)</enum><clause commented="no" display-inline="yes-display-inline" id="HCCCAE72A5859467996B1452B773975CF"><enum>(i)</enum><text>lymphedema diagnosis
				services (as defined in subsection (iii)(1)) and lymphedema treatment services
				(as described in subsection (iii)(2)); and</text>
								</clause><clause id="HC1FCCEC909D645E89998F1F6B4823AAA" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">lymphedema compression treatment items (as
				defined in subsection (jjj)).</text>
								</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H38BDEA14790C463B8F03E11034D44DE1"><enum>(2)</enum><text>by adding at the
			 end the following new subsections:</text>
					<quoted-block display-inline="no-display-inline" id="HBFD83BFD3B4145768B12C7F511BABE0D" style="OLC">
						<subsection id="H5D11371D200E490ABA1011A83424D6ED"><enum>(iii)</enum><header>Lymphedema
				diagnosis and treatment services</header><paragraph commented="no" display-inline="yes-display-inline" id="H8C16BD7DC00245389379BB7718180C56"><enum>(1)</enum><header>Lymphedema diagnosis
				services</header><text display-inline="yes-display-inline">The term
				<term>lymphedema diagnosis services</term> means, with respect to an
				individual, the differential diagnosis of the source of the individual’s edema
				and the identification of the specific etiology and functional lymphatic
				deficiency, in which such diagnosis—</text>
								<subparagraph id="H6670082D7076439C8EBC5F6672F1BB42" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">is
				provided by a provider, as defined in paragraph (3), for the purpose of
				developing a lymphedema treatment plan; and</text>
								</subparagraph><subparagraph id="HACAD7302876E4515A6B873A1427FF951" indent="up1"><enum>(B)</enum><text>may utilize any diagnostic tools the
				provider determines to be reasonable and necessary.</text>
								</subparagraph></paragraph><paragraph id="H9BB69CDE1C09417984B7E6585A2531EB" indent="up1"><enum>(2)</enum><header>Lymphedema treatment
				services</header><text display-inline="yes-display-inline">The term
				<term>lymphedema treatment services</term> means, with respect to an
				individual, services for the treatment of lymphedema (regardless of
				cause)—</text>
								<subparagraph id="H1EE7EB43FE0748988281BEC522F8BFE9"><enum>(A)</enum><text>that are—</text>
									<clause id="HBBD10E02952B47E699116CBFAFDD7B54"><enum>(i)</enum><text>provided in an inpatient or
				outpatient setting;</text>
									</clause><clause id="HF2EABF1CF1BD4829B245C670A9678B4C"><enum>(ii)</enum><text>provided by a provider, as defined
				in paragraph (3), within the established scope of practice of such provider;
				and</text>
									</clause><clause id="H1F020EAAB3F845AB9EEF81B3A4B57C90"><enum>(iii)</enum><text>medically necessary, in
				accordance with the current standard of lymphedema treatment, including
				complete decongestive therapy, which is a multi-modal therapy comprising of
				manual lymph drainage, compression therapy utilizing multilayer bandage
				systems, compression garments and devices, exercise, skin care, patient
				education, and any other lymphedema treatment modalities determined by the
				Secretary to be safe and effective; and</text>
									</clause></subparagraph><subparagraph id="H54D767FDE9BD4E9F8B71D46E02883B04"><enum>(B)</enum><text>which shall—</text>
									<clause id="H75E8B83B134D4F028370EA14BE67638D"><enum>(i)</enum><text>include as medically necessary with
				respect to the individual—</text>
										<subclause id="H3F9BEB3B22604DCCA1AD3AF6A81B6DAE"><enum>(I)</enum><text>an initial evaluation and course of
				clinical treatment, including initial baseline measurements and subsequent
				measurements to assess treatment efficacy and progress;</text>
										</subclause><subclause id="H76FC8B469D1B446095F1FD7389CC161C"><enum>(II)</enum><text>follow-up courses of clinical
				treatment;</text>
										</subclause><subclause id="H6BE2D6A71FA440C1A4FC62ACE9356AFE"><enum>(III)</enum><text>in the case that such individual has
				cancer, clinical measurements, including initial pre-operative baseline
				measurements and periodic subsequent measurements to diagnose the presence of
				lymphedema; and</text>
										</subclause><subclause id="H571205A8DD8B4F6887ED426E6B255AD3"><enum>(IV)</enum><text>any other treatment modality approved by
				the Secretary; and</text>
										</subclause></clause><clause id="H20418A71F5624809807320D531CE881B"><enum>(ii)</enum><text>be provided in accordance with
				such schedule, duration, and number of treatments as determined medically
				necessary.</text>
									</clause></subparagraph></paragraph><paragraph id="HA617BA92BA05454AB19F6AA08B5A8A9C" indent="up1"><enum>(3)</enum><header>Provider defined</header><text display-inline="yes-display-inline">For purposes of this subsection and
				subsection (jjj), the term <term>provider</term> means any licensed medical or
				health care provider whose State licensing board recognizes lymphedema
				diagnosis, lymphedema treatment, or both to fall within the scope of practice
				of such medical or health care provider.</text>
							</paragraph></subsection><subsection display-inline="no-display-inline" id="H3911F86F8A0B4953A13211C0792D577B"><enum>(jjj)</enum><header>Lymphedema
				compression treatment items</header><text>The term <term>lymphedema compression
				treatment items</term> means, with respect to an individual, compression
				garments, devices, bandaging systems, components, and supplies that are
				primarily and customarily used in the medical treatment of lymphedema of the
				arms, hands, legs, feet, torso, face and neck, breast and chest, abdomen, and
				genitalia, as prescribed by a provider, as defined in subsection (iii)(3). Such
				term includes—</text>
							<paragraph id="H585BBA8849EB4C07931968A93BDD6D64"><enum>(1)</enum><text>multilayer
				compression bandaging systems, including short-stretch and medium-stretch
				compression bandages; cotton, synthetic, or foam padding; gauze or elastic
				finger and toe bandages; foam pads; directional flow padding; and tubular
				bandages;</text>
							</paragraph><paragraph id="H2E10807A79C1497BB2362622FBE73904"><enum>(2)</enum><text>custom or standard
				fit gradient compression garments;</text>
							</paragraph><paragraph id="H92B6743E12C94DD8B914A521F38DA8E0"><enum>(3)</enum><text>non-elastic and
				low-elastic compression garments, manually adjustable or fitted padded
				directional flow garments (with or without elastic or non-elastic compression
				jackets) and compression wraps and directional flow pads;</text>
							</paragraph><paragraph id="H2BFB3007FF2048ACB9DA8E238D313C28"><enum>(4)</enum><text>aids and ancillary
				equipment consisting of donning aids, bandage rollers, shoes to fit over
				compression items, and other specialized items used with the items described in
				paragraphs (1) through (3);</text>
							</paragraph><paragraph id="H85F1E6D5A1694BC08B7A3F496E732FCB"><enum>(5)</enum><text>pneumatic
				appliances connected to and used in conjunction with pneumatic sequential
				compression controllers;</text>
							</paragraph><paragraph id="H350FB0D997A64A3386D98BB9AD1BB7DC"><enum>(6)</enum><text>any other
				compression garments, bandaging systems, devices, and aids determined by the
				Secretary to be effective in the prevention or treatment of lymphedema;
				and</text>
							</paragraph><paragraph id="H9B1C5F4F33AB4A12B739C2C6CBACF07A"><enum>(7)</enum><text>replacements of
				any items under this subsection in accordance with section
				1834(p)(3).</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H15FDA018D1A44383B1B256880B9FEE66"><enum>(b)</enum><header>Payment</header>
				<paragraph id="H984A34979ECD43E6B99109B6802A066B"><enum>(1)</enum><header>Lymphedema
			 compression treatment items</header>
					<subparagraph id="HE15B1ED5093B46349FA691104A0E2537"><enum>(A)</enum><header>In
			 general</header><text>Section 1833(a) of such Act (42 U.S.C. 1395l(a)) is
			 amended—</text>
						<clause id="H2EC75C4E33804796AB3E3A8344CF894F"><enum>(i)</enum><text>in
			 paragraph (8), by striking at the end <quote>and</quote>;</text>
						</clause><clause id="H6D9EA86E71D4412A91E202A72620C9D5"><enum>(ii)</enum><text>in
			 paragraph (9), by striking at the end the period and inserting a semi-colon;
			 and</text>
						</clause><clause id="HE1ED5457C91B43618B1A889914266911"><enum>(iii)</enum><text>by
			 adding at the end the following new paragraph:</text>
							<quoted-block display-inline="no-display-inline" id="H73AFEE089F1C4D818A8652EDE0F69C82" style="OLC">
								<paragraph id="H4049A243928044BDB8D9527F92798D30"><enum>(10)</enum><text display-inline="yes-display-inline">in the case of lymphedema compression
				treatment items described in section 1861(jjj), the amount determined under
				section 1834(p);
				and</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph commented="no" id="HD7576823973D44F2B9BD59DE3E596809"><enum>(B)</enum><header>Payment
			 determined</header><text>Section 1834 of such Act (42 U.S.C. 1395m) is amended
			 by adding at the end the following new subsection:</text>
						<quoted-block display-inline="no-display-inline" id="H33E55A7530594A58B144160BCFE1F234" style="OLC">
							<subsection commented="no" id="H5EBC2AAFEFBF496A9654606D17CC16D1"><enum>(p)</enum><header>Payment for
				lymphedema compression treatment items</header>
								<paragraph commented="no" id="HEC2DAAB926CE49C188C0E11CB87070CF"><enum>(1)</enum><header>General rule for
				payment</header>
									<subparagraph commented="no" id="HFCF048184601488A92205229A073F4CD"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">With respect to a
				lymphedema compression treatment item as defined in section 1861(jjj)) for
				which payment is determined under this subsection, subject to subparagraph (D),
				payment shall be made in an amount equal to 80 percent of the payment basis
				described in subparagraph (B).</text>
									</subparagraph><subparagraph commented="no" id="H4EDBFBCFB62E4409B1EC7A16987F6B6E"><enum>(B)</enum><header>Payment
				basis</header><text display-inline="yes-display-inline">The payment basis
				described in this subparagraph, with respect to a lymphedema compression
				treatment item described in section 1861(jjj), is the actual charge for the
				item.</text>
									</subparagraph><subparagraph commented="no" id="H032FFCBA06EB4DDEBA880ED13B980679"><enum>(C)</enum><header>Exclusive
				payment rule for home health agencies</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				title, this subsection shall constitute the exclusive provision of this title
				for payment for lymphedema compression treatment items described in section
				1861(jjj) under this part or under part A to a home health agency or for such
				items that are furnished as an incident to a physician’s professional
				service.</text>
									</subparagraph></paragraph><paragraph commented="no" id="HEEFEAE40A7CB41E89A6AA4E0A341DED6"><enum>(2)</enum><header>Allowable
				quantities</header><text display-inline="yes-display-inline">In the case it is
				determined by a provider, as defined in section 1861(iii)(3), that lymphedema
				compression treatment items are required as part of lymphedema treatment
				services under section 1861(iii)(2), then payment may be made under this title
				in accordance with this subsection for such items in the quantity which is
				customary, reasonable, and medically necessary.</text>
								</paragraph><paragraph commented="no" id="H6C56F109AABF45FC87C900DA751B6A8A"><enum>(3)</enum><header>Replacement of
				lymphedema compression treatment items</header>
									<subparagraph id="H63A14DF6BA93418CA3FE8F520F2B002A"><enum>(A)</enum><header>In
				general</header><text>Payment shall be made under this subsection, with respect
				to an individual, for the replacement of a lymphedema compression treatment
				item if the period of the reasonable and useful lifetime of the item (as
				described in subparagraph (B)) has expired or a provider, as defined in section
				1861(iii)(3), determines that a replacement, or repair, of such item, is
				medically necessary.</text>
									</subparagraph><subparagraph id="H7422A8148A0F41A197649F5D969D7461"><enum>(B)</enum><header>Reasonable and
				useful lifetime</header><text>For purposes of subparagraph (A), the period of
				the reasonable and useful lifetime of a lymphedema compression treatment item
				is as follows:</text>
										<clause id="HFDEAC853245840C2940CD0652ECD005B"><enum>(i)</enum><text display-inline="yes-display-inline">In the case of any item described in
				section 1861(jjj)(1), 1 year.</text>
										</clause><clause id="HE174E6260B724C3CBE44958D5DE2A0E8"><enum>(ii)</enum><text>In the case of
				any item described in section 1861(jjj)(2), 6 months.</text>
										</clause><clause id="H1A841028A3F24E4BAA0CA3EDFFC4F44B"><enum>(iii)</enum><text display-inline="yes-display-inline">In the case of any item described in
				section 1861(jjj)(3), 2 years.</text>
										</clause><clause id="H05ABB70232B04690886BE6EF97500806"><enum>(iv)</enum><text display-inline="yes-display-inline">In the case of any item described in
				section 1861(jjj)(4), 1 year.</text>
										</clause><clause id="HB8206D49776A498DBE352038291275BE"><enum>(v)</enum><text>In
				the case of any item described in section 1861(jjj)(5), 5 years.</text>
										</clause><clause id="HAD9D016B69A0479AA11A70335C0D349F"><enum>(vi)</enum><text>In the case of
				any item described in section 1861(jjj)(6), such period as determined by the
				Secretary, in consultation with appropriate health organizations, at the time
				the Secretary determines such item to be effective in the prevention or
				treatment of
				lymphedema.</text>
										</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" id="HFB1B237697A14C4491A5184C0DBD7BAC"><enum>(C)</enum><header>Application of
			 supplier requirements</header><text>Section 1834(j)(5) of such Act (42 U.S.C.
			 1395m(j)(5)) is amended—</text>
						<clause id="HDB57B2AAF41743968999746B590C7872"><enum>(i)</enum><text>in
			 subparagraph (E), by striking at the end <quote>and</quote>;</text>
						</clause><clause id="H3C462B4BB999424BADE1EB2FA608D9F0"><enum>(ii)</enum><text>in
			 subparagraph (F), by striking at the end the period and inserting <quote>;
			 and</quote>; and</text>
						</clause><clause id="H72D7CDAFE3804936B6642792AE8655FE"><enum>(iii)</enum><text>by
			 adding at the end the following new subparagraph:</text>

						</clause></subparagraph></paragraph><paragraph id="H1F8A70760A4840D6951F8F311EBC6183"><enum>(2)</enum><header>Lymphedema
			 diagnosis and treatment services</header>
					<subparagraph id="H3C485B705E1E4793BEA1C4BD1D570201"><enum>(A)</enum><header>In
			 general</header><text>Section 1833(a) of such Act, as amended by paragraph
			 (1)(A), is further amended by adding at the end the following new
			 paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="H4B5EAFE012AE4032BC02D69A602E1818" style="OLC">
							<paragraph commented="no" id="H7BE66D34988F487EAA8076906A951AAB"><enum>(11)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H20FE0520123F444C9C84B9C2A6B9E2E7"><enum>(A)</enum><text>in the case of
				lymphedema diagnosis services (as defined in section 1861(iii)(1)) furnished by
				a provider (as defined in section 1861(iii)(3)) the amount described in section
				1834(q); and</text>
								</subparagraph><subparagraph id="HEDB12FEEDC594BB58FFCDBBEDD0FECBB" indent="up1"><enum>(B)</enum><text>in the case of lymphedema treatment
				services (as defined in section 1861(iii)(2)) furnished by a provider (as
				defined in section 1861(iii)(3)) the amount described in section
				1834(k).</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HF58863553DF44C989E9A5C3655757806"><enum>(B)</enum><header>Payment
			 method</header><text>Section 1834 of such Act, as amended by paragraph (1)(B),
			 is further amended by adding at the end the following new subsection:</text>
						<quoted-block display-inline="no-display-inline" id="H655793690EEC4289A30A7E28C241775F" style="OLC">
							<subsection commented="no" id="HA39EBE909378418193B615CC4ED66E50"><enum>(q)</enum><header>Payment for
				outpatient lymphedema diagnosis and treatment services by physicians and
				non-Physician practitioners</header>
								<paragraph commented="no" id="H84E3DADDB7E74BC5B4E086F7355C335B"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">For purposes of
				section 1833(a)(11), the amount described in this subsection, with respect to a
				lymphedema diagnosis service or lymphedema treatment service, is 80 percent of
				the lesser of—</text>
									<subparagraph commented="no" id="H6FF43869EC1E4CF2BD15A3FCB4986138"><enum>(A)</enum><text>the actual charge
				for the service; or</text>
									</subparagraph><subparagraph commented="no" id="HC28FC81910FC4172AE3F90474D22A12F"><enum>(B)</enum><text>the applicable fee
				schedule amount (as defined in paragraph (2)) for the service.</text>
									</subparagraph></paragraph><paragraph commented="no" id="H44182C336B0F42448D0B04F0ACF26B89"><enum>(2)</enum><header>Applicable fee
				schedule amount</header><text>In this subsection, the term <term>applicable fee
				schedule amount</term> means, with respect to services furnished in a year, the
				amount determined under the fee schedule established under section 1848 for
				such services furnished during the
				year.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H6E2D14911D22492F80347029CB3B6F30"><enum>(C)</enum><header>Conforming
			 amendment for payments under
			 <enum-in-header>1834(k)</enum-in-header></header><text display-inline="yes-display-inline">Section 1834(k)(1) of such Act (42 U.S.C.
			 1395m(k)(1)) is amended by striking <quote>or 1833(a)(9)</quote> and inserting
			 <quote>1833(a)(9), or 1833(a)(11)</quote>.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="H9FA584BF45ED4D56AF703717BDF9AB29"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to items and
			 services furnished on or after the date that is 180 days from the date of the
			 enactment of this Act.</text>
