		<section id="HC60832BF4D85478CAB64F26FC5539765" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Harmful Algal Bloom and Hypoxia
			 Research and Control Amendments Act of 2011</short-title></quote>.</text>
		</section><section id="H81F37416AFE4452498E79854D9389F27"><enum>2.</enum><header>Amendment of Harmful
			 Algal Bloom and Hypoxia Research and Control Act of 1998</header><text display-inline="no-display-inline">Except as otherwise expressly provided,
			 whenever in this Act an amendment or repeal is expressed in terms of an
			 amendment to, or repeal of, a section or other provision, the reference shall
			 be considered to be made to a section or other provision of the Harmful Algal
			 Bloom and Hypoxia Research and Control Act of 1998 (16 U.S.C. 1451
			 note).</text>
		</section><section id="H6EAC62D9A35943DCA9C2CE6665141CC4"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 602 is amended to read as
			 follows:</text>

					<paragraph id="H7CE305B2E8CF411F910B528B0DC457CC"><enum>(1)</enum><header>Administrator</header><text>The
				term <quote>Administrator</quote> means the Administrator of the Environmental
				Protection Agency.</text>
					</paragraph><paragraph id="HE56F3366763D4378B0778A052F903717"><enum>(2)</enum><header>NOAA</header><text>The
				term <quote>NOAA</quote> means the National Oceanic and Atmospheric
				Administration.</text>

				term <quote>Plan</quote> means the comprehensive research plan and action

				the several States of the United States, the District of Columbia, the
				Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, American
				Samoa, the Commonwealth of the Northern Mariana Islands, any other territory or
				possession of the United States, and any Indian tribe.</text>
					</paragraph><paragraph id="HA38390EFC6974E85AA0DFBF0B57DC5AA"><enum>(6)</enum><header>Task
				Force</header><text display-inline="yes-display-inline">The term <quote>Task
				Force</quote> means the Inter-Agency Task Force on Harmful Algal Blooms and
				Hypoxia under section 603(a)(1).</text>
					</paragraph><paragraph id="H2738C9DB73704F908C8F891756524D43"><enum>(7)</enum><header>Under
				Secretary</header><text>The term <quote>Under Secretary</quote> means the Under
				Secretary of Commerce for Oceans and
				Atmosphere.</text>

		</section><section id="H850583DB5BEA4D328937A7CBFE8E0986"><enum>4.</enum><header>Inter-Agency Task
			 Force</header><text display-inline="no-display-inline">Section 603(a) is
			 amended to read as follows:</text>

				Force</header>
					<paragraph id="H6117AB69532042CB83EE3066A809A2D3"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The President, through the Committee on
				Environment and Natural Resources of the National Science and Technology
				Council, shall establish an Inter-Agency Task Force on Harmful Algal Blooms and
				Hypoxia.</text>
					</paragraph><paragraph id="H4B8ADAC29163432A909CA285964E8F71"><enum>(2)</enum><header>Representation</header><text>The
				Task Force shall consist of representatives from the following:</text>
						<subparagraph id="HE9206E7CDCB14B1081959B2C9F1D28AB"><enum>(A)</enum><text>The Department of
				Commerce.</text>
						</subparagraph><subparagraph id="HDB6FC688C990477DAE6DF161C83F9045"><enum>(B)</enum><text>The Environmental
				Protection Agency.</text>
						</subparagraph><subparagraph id="HD17A725563EF4DEB8D6C81987F3484D8"><enum>(C)</enum><text>The Department of
				Agriculture.</text>
						</subparagraph><subparagraph id="H8C4256C0252540CEBFD941FCC9F683F6"><enum>(D)</enum><text>The Department of the
				Interior.</text>
						</subparagraph><subparagraph id="H5FDE5EEF465B437F87BBADB9FF1BBBAD"><enum>(E)</enum><text>The Department of the
				Navy.</text>
						</subparagraph><subparagraph id="H3F64074D9CDA41448ED23DD8702A9C4B"><enum>(F)</enum><text>The Department of Health

				agencies as the President considers appropriate.</text>
						</subparagraph></paragraph><paragraph id="HA3E1ED55BEE3470CB99B8C547A154FB1"><enum>(3)</enum><header>Chairperson</header><text>The
				Under Secretary from the Department of Commerce shall serve as the Chairperson
				of the Task Force.</text>
					</paragraph><paragraph id="HDE6493254544404A8AE04FB54453EF9B"><enum>(4)</enum><header>Required
				meetings</header>
						<subparagraph id="H8C001DC364DA484E966D976486CB689B"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Task Force shall
				meet, or otherwise communicate, to coordinate activities within each agency
				represented on the Task Force in order to fulfill the program requirements in
				section 604(b).</text>
						</subparagraph><subparagraph id="H6A989B8E42DC46B0A86E42AA1AA33E2D"><enum>(B)</enum><header>Frequency</header><text>The
				Task Force shall meet at least once per year.</text>
						</subparagraph></paragraph><paragraph id="HFF2197404FED4B82B427C5D9B1721E9C"><enum>(5)</enum><header>Budget
				coordination</header><text>The Task Force shall—</text>
						<subparagraph id="HF6E1BC57983946EABD66313A8488D0C3"><enum>(A)</enum><text display-inline="yes-display-inline">coordinate in the development of individual
				agency budgets for the activities described in section 604 that will ensure an
				appropriate balance among the research and action priorities; and</text>
						</subparagraph><subparagraph commented="no" id="H80F60433D0734A13A12E425BA0C933EB"><enum>(B)</enum><text>submit such budgets to
				the Director of the Office of Management and Budget at the time designated by
				the Director for agencies to submit annual
				budgets.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H033F6495F85D4B0A85828BDE4DBF7BA7"><enum>5.</enum><header>National Harmful Algal
			 Bloom and Hypoxia Program</header><text display-inline="no-display-inline">The
			 Act is amended—</text>
			<paragraph id="H85A2CA512D6E49418684942811CD05D6"><enum>(1)</enum><text>by redesignating sections
			 605 and 606 as sections 608 and 609, respectively;</text>
			</paragraph><paragraph id="HBEB234ADE0434121A7466C2CCF41F96B"><enum>(2)</enum><text>by redesignating section
			 604 as section 606; and</text>
			</paragraph><paragraph id="H0193FCD20C7747F68A5126DB9A119F4B"><enum>(3)</enum><text>by inserting after
			 section 603 the following:</text>

					<section id="H6E2FC8001453440D996592DEB7ACC08F"><enum>604.</enum><header>National Harmful Algal
				Bloom and Hypoxia Program</header>
						<subsection id="H193F7900A2744C8FA9C585DE5848CDAC"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided in
				subsection (d), the Under Secretary, through the Task Force, shall maintain a
				National Harmful Algal Bloom and Hypoxia Program in accordance with authorities
				under section 603 pursuant to this section.</text>
						</subsection><subsection id="HF1502816A9484604A5527C4D7B7D6366"><enum>(b)</enum><header>Duties</header><text display-inline="yes-display-inline">The Under Secretary, through the Program,
				shall coordinate the efforts of the Task Force to—</text>
							<paragraph id="H33604C7BAE2E434F8777702BD97241CF"><enum>(1)</enum><text>develop and promote a
				national strategy to understand, detect, monitor, predict, control, mitigate,
				and respond to marine and freshwater harmful algal bloom and hypoxia
				events;</text>
							</paragraph><paragraph id="H4612B83BECA947BBBADF5D48F7C4CFB4"><enum>(2)</enum><text display-inline="yes-display-inline">integrate the research of all Federal
				programs, including ocean and Great Lakes science and management programs and
				centers, that address the chemical, biological, and physical components of
				marine and freshwater harmful algal blooms and hypoxia;</text>
							</paragraph><paragraph id="H3835794724EA461CB072BE95DAEBB0F7"><enum>(3)</enum><text display-inline="yes-display-inline">assist and coordinate, where appropriate,
				with State, tribal, and local government agencies, programs, and regional
				efforts that address marine and freshwater harmful algal blooms and hypoxia,
				including the development and implementation of appropriate response plans,
				strategies, and tools;</text>
							</paragraph><paragraph id="H67CCDC709DF3483A80A93E1F2C1F53EA"><enum>(4)</enum><text display-inline="yes-display-inline">identify additional research, development,
				and demonstration needs and priorities relating to understanding, detection,
				monitoring, prediction, prevention, control, mitigation, and response to marine
				and freshwater harmful algal blooms and hypoxia;</text>
							</paragraph><paragraph id="HDEEB896A2DE64E8AB93C4358BBAE5C8F"><enum>(5)</enum><text>ensure the development
				and use of methods and technologies to protect the ecosystems affected by
				marine and freshwater harmful algal blooms and hypoxia;</text>
							</paragraph><paragraph display-inline="no-display-inline" id="H4569CA606C2A4FA6ACEA1FACF2C820E5"><enum>(6)</enum><text display-inline="yes-display-inline">encourage the appropriate exchange of
				research information with other countries in order to better mitigate, control,
				and respond to marine and freshwater harmful algal blooms;</text>
							</paragraph><paragraph id="H626104A94B5E4C038D1B89D1014F3375"><enum>(7)</enum><text display-inline="yes-display-inline">coordinate existing education programs to
				improve public understanding and awareness of the causes, impacts, and
				mitigation efforts for marine and freshwater harmful algal blooms and
				hypoxia;</text>
							</paragraph><paragraph id="H19AFCA5AEAD1453193CCBAE2FDAC4F04"><enum>(8)</enum><text display-inline="yes-display-inline">provide resources to assist in the training
				of State, tribal, and local water and coastal resource managers in the methods
				and technologies for detecting, monitoring, controlling, mitigating, and
				responding to the effects of marine and freshwater harmful algal bloom and
				hypoxia events;</text>
							</paragraph><paragraph id="H5712B57598764D9294EE647EC71D4D91"><enum>(9)</enum><text>oversee the development,
				review, and periodic updating of the Plan;</text>
							</paragraph><paragraph id="H1CB9C82C04E4498CBD5F583D81F04565"><enum>(10)</enum><text>administer
				peer-reviewed, merit-based, competitive grant funding to support—</text>
								<subparagraph id="H0B212A4104FE482CAF34D9F4298579BF"><enum>(A)</enum><text>the projects maintained
				and established by the Program; and</text>
								</subparagraph><subparagraph id="HB387F0139B474150BE801ACFFDFC2B80"><enum>(B)</enum><text>the research and
				management needs and priorities identified in the Plan; and</text>
								</subparagraph></paragraph><paragraph id="HAF090F8C0315454D9F057C068886FB8F"><enum>(11)</enum><text>encourage the
				development of innovative concepts for the beneficial utilization of—</text>
								<subparagraph id="H8C094D4DA8BC4AD4AA215E0EE7DAA4E5"><enum>(A)</enum><text>biomass from harmful
				algal blooms that have been removed from the natural system; and</text>
								</subparagraph><subparagraph id="HB3C9BB0E740E431AA98C654E12F04984"><enum>(B)</enum><text>the growth of certain
				biofuel crops that reduce runoff that causes harmful algal blooms.</text>
								</subparagraph></paragraph></subsection><subsection id="H297EAEBBEFFD4531963644CFD36A6454"><enum>(c)</enum><header>Cooperative
				efforts</header><text>The Under Secretary shall work cooperatively and avoid
				duplication of efforts with other offices, centers, and programs within NOAA
				and other agencies represented on the Task Force, States, tribes, and
				nongovernmental organizations concerned with marine and freshwater aquatic
				issues related to harmful algal blooms and hypoxia.</text>
						</subsection><subsection id="H9A9CEFAEE8AB420AB1BB86DE0628B10D"><enum>(d)</enum><header>Freshwater
				program</header>
							<paragraph id="HCAB7E3794F8147D19415712F10541372"><enum>(1)</enum><header>In
				general</header><text>With respect to the freshwater aspects of the Program,
				the Administrator and the Under Secretary, through the Task Force, shall carry
				out the duties otherwise assigned to the Under Secretary under this section,
				excluding the activities described in subsection (e).</text>
							</paragraph><paragraph id="HD3742DBFAE2141D2A171E6A6C6B6E7D8"><enum>(2)</enum><header>Participation</header><text>The
				Administrator’s participation under this subsection shall include—</text>
								<subparagraph id="H1DB830BF51904B21A55D60CDB6992103"><enum>(A)</enum><text>research on the ecology
				of freshwater harmful algal blooms;</text>
								</subparagraph><subparagraph id="HC880A6AA5FB3489B9BE1F6A9DA2AB8E1"><enum>(B)</enum><text>monitoring of and event
				response to freshwater harmful algal blooms in lakes, rivers, estuaries
				(including their tributaries), and reservoirs; and</text>
								</subparagraph><subparagraph id="HAA3049F7B72549AD950587411FA4714F"><enum>(C)</enum><text>mitigation and control of
				freshwater harmful algal blooms.</text>
								</subparagraph></paragraph><paragraph id="H1693954D02754F5BA422830B813293D1"><enum>(3)</enum><header>Nonduplication</header><text display-inline="yes-display-inline">The Administrator shall ensure that
				activities carried out under this Act shall focus on new approaches to
				addressing freshwater harmful algal blooms and are not duplicative of existing
				research and development programs authorized by this or any other Act.</text>
							</paragraph><paragraph id="HE1F227D743C34B00B7AE17B6844F8330"><enum>(4)</enum><header>Report</header><text>Not
				later than 1 year after the date of enactment of the
				<short-title>Harmful Algal Bloom and Hypoxia Research and
				Control Amendments Act of 2011</short-title>, the Administrator shall prepare
				and transmit to the Committee on Science, Space, and Technology of the House of
				Representatives a report containing—</text>
								<subparagraph id="HD064952DBA37459495E5C0B06486BAB3"><enum>(A)</enum><text>a detailed budget
				explanation for all of the activities conducted by the Administrator under this
				Act; and</text>
								</subparagraph><subparagraph id="H3CBBCCE88DF2437988D29C94490E89FD"><enum>(B)</enum><text>a description of how such
				activities reduce the effects of freshwater harmful algal blooms and improve
				water quality.</text>
								</subparagraph></paragraph></subsection><subsection id="HE2DD1D1F80974B4A9C2B8E65EDA567B5"><enum>(e)</enum><header>NOAA
				Activities</header><text display-inline="yes-display-inline">As part of the
				program under this section, the Under Secretary shall—</text>
							<paragraph id="HA9065E47566E4031ABC80FAAFE66D935"><enum>(1)</enum><text display-inline="yes-display-inline">maintain existing peer-reviewed competitive
				grant programs at NOAA relating to marine and freshwater harmful algal blooms
				and hypoxia;</text>
							</paragraph><paragraph id="HB114AA63EA5B4C29B96D3B4FF61D31ED"><enum>(2)</enum><text>conduct marine and
				freshwater harmful algal bloom and hypoxia event response activities;
				and</text>
							</paragraph><paragraph id="HB30D100711444B37878DE6F2C48F9D4F"><enum>(3)</enum><text display-inline="yes-display-inline">ensure communication and coordination among
				Federal agencies carrying out marine and freshwater harmful algal bloom and
				hypoxia activities and increase the availability to appropriate public and
				private entities of—</text>
								<subparagraph id="HC7B850443069467A9D55968A6931A0D7"><enum>(A)</enum><text>analytical facilities and
				technologies;</text>
								</subparagraph><subparagraph id="HF4E06C4921474B68A70E598729B7FA9A"><enum>(B)</enum><text>operational forecasts;
				and</text>
								</subparagraph><subparagraph id="HC793EFDEBA6748E091DA0AF59642E5FA"><enum>(C)</enum><text>reference and research
				materials.</text>
								</subparagraph></paragraph></subsection><subsection id="HB270CED6CD0240EEBACD60A48B769834"><enum>(f)</enum><header>Integrated coastal and
				ocean observation system</header><text display-inline="yes-display-inline">All
				monitoring and observation data collected under this Act shall be collected in
				compliance with all data standards and protocols developed pursuant to the
				National Integrated Coastal and Ocean Observation System Act of 2009 (33 U.S.C.
				3601 et seq.), and such data shall be made available through the system
				established under that Act.</text>
						</subsection><subsection id="H1BF41E4F52D4490080C7637E43595C63"><enum>(g)</enum><header>Technology research,
				development, and demonstration</header>
							<paragraph id="H54726750AF1A4B3CB6AD03BC6D1DC67C"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">As part of the duties
				described in subsection (b), the Under Secretary and the Administrator, through
				the Task Force, shall maintain a focus on technology research and development
				for each of the categories of marine harmful algal blooms, freshwater harmful
				algal blooms, and hypoxia in the following areas:</text>
								<subparagraph id="H7C0B28555AF448EDB7739E00FC68BDE4"><enum>(A)</enum><text>Monitoring.</text>
								</subparagraph><subparagraph id="HED9ADA65CDC74309985D2D6969C29EAB"><enum>(B)</enum><text>Prediction.</text>
								</subparagraph><subparagraph id="HD725160A19624AA9BEDF5AD51FB6D34A"><enum>(C)</enum><text>Prevention.</text>
								</subparagraph><subparagraph id="HFD55D0C18E0E4DBE945D4D23CF8C1A43"><enum>(D)</enum><text>Control.</text>
								</subparagraph><subparagraph id="H49B4923AB3844546B1C9F8CC93D04A07"><enum>(E)</enum><text>Mitigation.</text>
								</subparagraph><subparagraph id="HAF4AD0C017104F66850F9BA5C71C96B2"><enum>(F)</enum><text>Response to events,
				including remediation.</text>
								</subparagraph></paragraph><paragraph id="H4187B1B65A3D4BC39B2EDB01783F1487"><enum>(2)</enum><header>Enumeration</header><text display-inline="yes-display-inline">As part of the report required under
				<internal-xref idref="H398BD552AA3A4EBBBC9B7CB3CDC48396" legis-path="604.(i)">subsection (i)</internal-xref>, the Under Secretary, in
				coordination with the Administrator, shall enumerate the technology research
				and development conducted for each of the areas identified in
				<internal-xref idref="H54726750AF1A4B3CB6AD03BC6D1DC67C" legis-path="604.(g)(1)">paragraph (1)</internal-xref>.</text>
							</paragraph><paragraph id="H7DA18A5C955B4FA3A749011410D3F0DB"><enum>(3)</enum><header>Protocol</header><text display-inline="yes-display-inline">The Under Secretary, in coordination with
				the Administrator, shall develop a protocol for—</text>
								<subparagraph id="HC2214495C0604AE5951232DFEBF350C9"><enum>(A)</enum><text display-inline="yes-display-inline">assessing the stage of technology
				development that is ready to move from lab testing to field testing;</text>
								</subparagraph><subparagraph id="HF3AAD3A42E214EBB9FFFACFF53A2D840"><enum>(B)</enum><text>coordinating local,
				State, and Federal authorities to facilitate measures necessary to conduct
				field tests in a timely manner; and</text>
								</subparagraph><subparagraph id="HCA75ACC1152B4F3D9DD1F857B9DBD331"><enum>(C)</enum><text>working with local and
				State entities, programs, and interested stakeholders to conduct outreach and
				education on technology field testing projects.</text>
								</subparagraph></paragraph></subsection><subsection id="H0B109F62A8A147F6823C5067BA5FDD79"><enum>(h)</enum><header>Information
				clearinghouse</header>
							<paragraph id="H23B3F37A27F545CA9841A427A84437C4"><enum>(1)</enum><header>Electronic
				information</header><text display-inline="yes-display-inline">Using the
				authority under section 603(i)(2)(B), the Under Secretary, in coordination with
				the Administrator, shall expand the existing electronic clearinghouse to
				provide information about marine and freshwater harmful algal blooms and
				hypoxia, including—</text>
								<subparagraph id="H72F2BA9B47284F91A5A6774536B1D8A8"><enum>(A)</enum><text display-inline="yes-display-inline">the Federal agencies involved in research
				and development on understanding, detection, monitoring, prediction,
				prevention, control, mitigation, and response activities;</text>
								</subparagraph><subparagraph id="H55D8CEAAFFBF4FDEB9EF5BFE7CE1CA51"><enum>(B)</enum><text display-inline="yes-display-inline">tools available to predict and model
				events; and</text>
								</subparagraph><subparagraph id="H9F2C8E0F3D9249B8AC7F0CCC58A4355C"><enum>(C)</enum><text display-inline="yes-display-inline">current or developing technologies for
				detection, monitoring, prediction, prevention, control, mitigation, and
				response, including remediation.</text>
								</subparagraph></paragraph><paragraph id="H75A50998D4484C2BBD32468D9973117F"><enum>(2)</enum><header>Toxin
				standards</header><text display-inline="yes-display-inline">The Under
				Secretary, in consultation with the Administrator, shall—</text>
								<subparagraph id="H3F46082FB6624B808C71CC2CD4B8D44A"><enum>(A)</enum><text display-inline="yes-display-inline">develop a mechanism to provide a reliable
				and cost-effective supply of toxin standards for comparative research;
				and</text>
								</subparagraph><subparagraph id="H6EC0482AAACE41AF82DF8E3CDA0D4A86"><enum>(B)</enum><text>notify the Congress of
				such mechanism as part of the report required under
				<internal-xref idref="H398BD552AA3A4EBBBC9B7CB3CDC48396" legis-path="604.(i)">subsection (i)</internal-xref>.</text>
								</subparagraph></paragraph></subsection><subsection id="H398BD552AA3A4EBBBC9B7CB3CDC48396"><enum>(i)</enum><header>Report</header><text>Not
				later than 1 year after the submission of the Plan, the Under Secretary,
				through the Task Force, shall prepare and transmit to the Congress a report
				that describes—</text>
							<paragraph id="HCBA5331A067E44B4AF7DDA90FFA166D3"><enum>(1)</enum><text>the activities carried
				out under the Program and the Plan and the budget related to such activities;
				and</text>
							</paragraph><paragraph id="H16933AE015DD40D1885CF851D23D64A3"><enum>(2)</enum><text display-inline="yes-display-inline">the need to revise or terminate activities
				or projects under the
				Program.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H25AAED8C159946D5B87881B57FEC656E"><enum>6.</enum><header>Comprehensive research
			 plan and action strategy</header><text display-inline="no-display-inline">The
			 Act is amended by inserting after section 604, as added by section 5(3) of this
			 Act, the following:</text>

				<section id="H2C27A51937144DA09289783F1A5207AF"><enum>605.</enum><header>Comprehensive research
				plan and action strategy</header>
					<subsection id="HBC94693C242340D4BDA4153F109CD48E"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 2
				years after the date of enactment of the <short-title>Harmful Algal Bloom and Hypoxia Research and Control
				Amendments Act of 2011</short-title>, the Under Secretary, through the Task
				Force, shall transmit to the Congress a comprehensive research plan and action
				strategy to address marine and freshwater harmful algal blooms and hypoxia that
				identifies—</text>
						<paragraph id="H1D67A87112264968993F4ACE0FC54D34"><enum>(1)</enum><text display-inline="yes-display-inline">the specific activities to be carried out
				by the Program and the timeline for carrying out such activities;</text>
						</paragraph><paragraph id="HB90A0BBC1BE641F19180FCC55CA27525"><enum>(2)</enum><text display-inline="yes-display-inline">the roles and responsibilities of each
				Federal agency in the Task Force in carrying out Program activities; and</text>
						</paragraph><paragraph id="H3CE447C5C55F4FDABD984C5046484919"><enum>(3)</enum><text display-inline="yes-display-inline">appropriate regions and subregions
				requiring specific research and activities to address local, State, and
				regional harmful algal blooms and hypoxia.</text>
						</paragraph></subsection><subsection id="H51C85FD607EA4A1C93F951F54FCA52B6"><enum>(b)</enum><header>Regional
				focus</header><text display-inline="yes-display-inline">The regional and
				subregional parts of the Plan shall identify—</text>
						<paragraph id="HEA4BE2C4BEF84D10B6A7289C256C6BAA"><enum>(1)</enum><text>regional priorities for
				ecological, economic, and social research on issues related to the impacts of
				harmful algal blooms and hypoxia;</text>
						</paragraph><paragraph id="H5DAB983E6DAD4CD4B614D60BEF2DCEFD"><enum>(2)</enum><text display-inline="yes-display-inline">research, development, and demonstration
				activities needed to develop and advance technologies and techniques for
				minimizing the occurrence of harmful algal blooms and hypoxia and improving
				capabilities to detect, predict, monitor, control, mitigate, respond to, and
				remediate harmful algal blooms and hypoxia;</text>
						</paragraph><paragraph id="H024F74F3A1604596B44B5F9E3C7B9F17"><enum>(3)</enum><text>ways to reduce the
				duration and intensity of harmful algal blooms and hypoxia, including
				deployment of response technologies in a timely manner;</text>
						</paragraph><paragraph id="HE443B4E678CC4CAFBE4F2D23366647C3"><enum>(4)</enum><text>research and methods to
				address human health dimensions of harmful algal blooms and hypoxia;</text>
						</paragraph><paragraph id="HDBAA73FFD3B64C5C9D27C7EE944B8FF5"><enum>(5)</enum><text display-inline="yes-display-inline">mechanisms, including the potential costs
				and benefits of those mechanisms, to protect ecosystems that may be or have
				been affected by harmful algal bloom and hypoxia events;</text>
						</paragraph><paragraph id="H556FE9A6BC394A0EAC0C2E0C8C5CF9E9"><enum>(6)</enum><text>mechanisms by which data,
				information, and products may be transferred between the Program and State,
				tribal, and local governments and relevant research entities;</text>
						</paragraph><paragraph id="HB75453BAA9B84B5FA1B497E3A392B688"><enum>(7)</enum><text display-inline="yes-display-inline">communication and information dissemination
				methods that State, tribal, and local governments may undertake to educate and
				inform the public concerning harmful algal blooms and hypoxia; and</text>
						</paragraph><paragraph id="H9EFADA56B95C42C6A894CE00407886A3"><enum>(8)</enum><text>the roles that Federal
				agencies may have to assist in the implementation of the Plan.</text>
						</paragraph></subsection><subsection id="HEB37DB8FAA8942D99185EB8229F80053"><enum>(c)</enum><header>Utilizing available
				studies and information</header><text display-inline="yes-display-inline">In
				developing the Plan, the Under Secretary shall utilize existing research,
				assessments, reports, and program activities, including—</text>
						<paragraph id="HE7B8D97C5F574709AA61C27BA06D3FD4"><enum>(1)</enum><text>those carried out
				pursuant to existing law; and</text>
						</paragraph><paragraph id="H6CB70589E5C843C0A7C0BC40077AE2A4"><enum>(2)</enum><text>other relevant
				peer-reviewed and published sources.</text>
						</paragraph></subsection><subsection id="H8DA720FEAAEF43A381ECD034CAF3D029"><enum>(d)</enum><header>Development of the
				Plan</header><text>In developing the Plan, the Under Secretary shall, as
				appropriate—</text>
						<paragraph id="HED2BEE9BA1A24E5892584E3DBA6734F4"><enum>(1)</enum><text>coordinate with—</text>
							<subparagraph id="H3672FC541CFA4A2EB329F7E776552A5D"><enum>(A)</enum><text>State coastal management
				and planning officials;</text>
							</subparagraph><subparagraph id="HE1536A9F68294BE88CAC92F6CC183E59"><enum>(B)</enum><text display-inline="yes-display-inline">tribal resource management officials;
				and</text>
							</subparagraph><subparagraph id="HD7783E4826524D588C8A52072880265F"><enum>(C)</enum><text display-inline="yes-display-inline">water management and watershed officials
				from both coastal States and noncoastal States with water sources that drain
				into water bodies affected by harmful algal blooms and hypoxia; and</text>
							</subparagraph></paragraph><paragraph id="HCBD2B79281DE4D91B84FF01D55E68A59"><enum>(2)</enum><text>consult with—</text>
							<subparagraph id="H84455E79B8454967AC78737B1AA1A62A"><enum>(A)</enum><text>public health
				officials;</text>
							</subparagraph><subparagraph id="HAB0FF9B6F22A43C3855354876CFB10ED"><enum>(B)</enum><text>emergency management
				officials;</text>
							</subparagraph><subparagraph id="H482ACF4FE3E548A6BD7B34E92713F0C3"><enum>(C)</enum><text>science and technology
				development institutions;</text>
							</subparagraph><subparagraph id="HE8104F16E8B04098A210B3375F561076"><enum>(D)</enum><text>economists;</text>
							</subparagraph><subparagraph id="H73F9C64F72644923BCBAA8E627B1602A"><enum>(E)</enum><text>industries and businesses
				affected by marine and freshwater harmful algal blooms and hypoxia;</text>
							</subparagraph><subparagraph id="H8F795B474A2B4DADA9789222315F36D5"><enum>(F)</enum><text>scientists with expertise
				concerning harmful algal blooms or hypoxia from academic or research
				institutions; and</text>
							</subparagraph><subparagraph id="H3DCD089E32684FC18569BEEF72EDB7EB"><enum>(G)</enum><text>other
				stakeholders.</text>
							</subparagraph></paragraph></subsection><subsection id="H9097F5AD0B394FBCAD5F4EAAC847911C"><enum>(e)</enum><header>Federal
				Register</header><text display-inline="yes-display-inline">The Under Secretary
				shall publish the Plan in the Federal Register.</text>
					</subsection><subsection id="H5E2FFA93882248AF989C484324009C96"><enum>(f)</enum><header>Periodic
				revision</header><text display-inline="yes-display-inline">The Under Secretary,
				in coordination and consultation with the individuals and entities identified
				in subsection (d), shall periodically review and revise the Plan prepared under
				this section, as
				necessary.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H80E6AEB6884345C09CFB60E9452E5021"><enum>7.</enum><header>Northern Gulf of Mexico
			 hypoxia</header><text display-inline="no-display-inline">Section 606, as
			 redesignated by
			 <internal-xref idref="H85A2CA512D6E49418684942811CD05D6" legis-path="5.(a)(1)">section 5(2)</internal-xref> of this Act, is amended by
			 adding at the end the following:</text>

				general</header><text display-inline="yes-display-inline">Within 2 years after
				the date of enactment of the <short-title>Harmful Algal
				Bloom and Hypoxia Research and Control Amendments Act of 2011</short-title>,
				the Administrator, through the Mississippi River/Gulf of Mexico Watershed
				Nutrient Task Force, shall complete and submit to the Congress and the
				President an updated assessment and a revised action plan based on the updated
				assessment.</text>
					</paragraph><paragraph id="H6ED3E5A607014214A33575A2D5F65181"><enum>(2)</enum><header>Requirements</header><text>The
				updated assessment shall take into account the following:</text>
						<subparagraph id="H27535F4A568D4DA38E9D977CF22C13D8"><enum>(A)</enum><text display-inline="yes-display-inline">The role of nutrient influx in the context
				of water column stratification, seasonal flows and conditions, and wind and
				current dynamics in the Gulf of Mexico.</text>
						</subparagraph><subparagraph id="H73523EAF81FC4275BB3E7B7B46A98D95"><enum>(B)</enum><text>The contribution of the
				topography of the Gulf of Mexico in the effects of the characteristics
				described in subparagraph (A) on the hypoxic zone.</text>
						</subparagraph><subparagraph id="H04C44C885F4E4525AFBCF2085951D167"><enum>(C)</enum><text>The frequency and
				availability of monitoring to measure the size of the hypoxic zone.</text>
						</subparagraph><subparagraph id="H24B3BCBD51234E02BADA0A273B89AB57"><enum>(D)</enum><text>The potential of hypoxia
				hot-spot formation within the Gulf of Mexico and possible causes of such
				hot-spots.</text>
						</subparagraph><subparagraph id="H1DF58B0F8D6E4B77978414676798F02A"><enum>(E)</enum><text>The contribution of
				wetland loss to hypoxia events in the Gulf of Mexico.</text>
						</subparagraph><subparagraph id="H27011FCBA1EB4F8387BA178EB3CA97A1"><enum>(F)</enum><text>The actual effect of
				hypoxia on the ecosystem of the Gulf of Mexico and the benefits resulting from
				a reduced hypoxic zone size.</text>
						</subparagraph><subparagraph id="H62B781690AD54581AC5E2DD46D4006C3"><enum>(G)</enum><text>A scientifically
				generated, peer-reviewed goal for the size of the hypoxic zone in the Gulf of
				Mexico.</text>
						</subparagraph></paragraph><paragraph id="HEBBCA4FC19FF49D7A2CDAA4EF1D0A31B"><enum>(3)</enum><header>Research
				strategy</header><text display-inline="yes-display-inline">The updated plan
				shall include a research strategy—</text>
						<subparagraph id="HE7C40642F1434A8FBBED98E8FFA69400"><enum>(A)</enum><text>to enhance understanding
				of the contribution of topography, water column stratification, seasonal flows
				and conditions, and wind and current dynamics on the size of the hypoxic
				zone;</text>
						</subparagraph><subparagraph id="HFD9D026371A34D2FA0A4B4F9B2799CE3"><enum>(B)</enum><text>to develop models able
				to—</text>
							<clause id="H2B12FAEBF0D74AE89CB8C77144ACF088"><enum>(i)</enum><text>simulate different shelf
				regions and the fundamental processes that act in each shelf region;</text>
							</clause><clause id="H0C15B974F33444D89DDF9DE148DA8726"><enum>(ii)</enum><text>differentiate between
				the separate effects of stratification and nutrient loading in the formation of
				hypoxia; and</text>
							</clause><clause id="H94E1D037B7854EF8A100A4FE3F74B3DB"><enum>(iii)</enum><text>be informed by
				realistic three-dimensional hydrodynamic and biogeochemical models;</text>
							</clause></subparagraph><subparagraph id="H95337BBE0D9C4BE59CDE8F66E145E840"><enum>(C)</enum><text>that determines the
				appropriate amount of monitoring and measuring necessary to get a
				scientifically robust accounting on the size of the Gulf of Mexico hypoxic
				zone; and</text>
						</subparagraph><subparagraph id="H3DFD46D36A7947BE878A381165A4BDD4"><enum>(D)</enum><text>that examines several
				potential solutions based on information provided by the updated assessment in
				paragraph
				(1).</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H2C66E341F7B84FA28A53ECE39CC205D4"><enum>8.</enum><header>Chesapeake Bay dead
			 zone</header>
			<subsection id="HFD05100442D34719A8680216E3FC402E"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Act is amended by
			 inserting after section 606, as redesignated by
			 <internal-xref idref="HBEB234ADE0434121A7466C2CCF41F96B" legis-path="5.(a)(2)">section 5(2)</internal-xref> of this Act, the
			 following:</text>

				after the date of enactment of the <short-title>Harmful
				Algal Bloom and Hypoxia Research and Control Amendments Act of
				2011</short-title>, the Task Force, in accordance with the authority under
				section 603, shall complete and submit to the Congress and the President an
				integrated assessment of hypoxia in the Chesapeake Bay that examines the status
				of and gaps within current research, monitoring, prevention, response, and
				control activities by—</text>
							<paragraph id="H8037142FE1C04CBCBB5CBAA94CC5702F"><enum>(1)</enum><text>Federal agencies;</text>
							</paragraph><paragraph id="HE3DF7CD878D2408899556CD513F273E1"><enum>(2)</enum><text>State agencies;</text>
							</paragraph><paragraph id="HD729807123F5497AA92A2D52A99F6598"><enum>(3)</enum><text>regional research
				consortia;</text>
							</paragraph><paragraph id="H5054D048C78A4860BB6A0B938E5A504F"><enum>(4)</enum><text>academia;</text>
							</paragraph><paragraph id="HC8F124476D014D33831953F68205CB20"><enum>(5)</enum><text>private industry;
				and</text>
							</paragraph><paragraph id="HF1865BA205EA4E4EBC644C3E947B50B3"><enum>(6)</enum><text>nongovernmental
				organizations.</text>
							</paragraph></subsection><subsection id="H6C5F832AA61241B89616F8AEC31F0419"><enum>(b)</enum><header>Research plan</header>
							<paragraph id="HC080EF06E74F4C289BE3789AF3DE1207"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 2
				years after the date of enactment of the <short-title>Harmful Algal Bloom and Hypoxia Research and Control
				Amendments Act of 2011</short-title>, the Task Force shall develop and submit
				to the Congress a plan, based on the integrated assessment submitted under
				subsection (a), for reducing, mitigating, and controlling hypoxia in the
				Chesapeake Bay.</text>
							</paragraph><paragraph id="H7435281A086E4D689E073529E2B0A6BC"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">In developing such plan, the Task Force
				shall—</text>
								<subparagraph id="HDC3D0857CB624928823E3C9440D346E1"><enum>(A)</enum><text>consult with State and
				local governments and representatives from academic, agricultural, industry,
				and other stakeholder groups;</text>
								</subparagraph><subparagraph id="H857EFE60E07842CD84AE6B7996F5C614"><enum>(B)</enum><text>ensure that the plan does
				not duplicate activities conducted by other Federal or State agencies;</text>
								</subparagraph><subparagraph id="H3A0FFB2498844715BED84CFA9B8ABFBD"><enum>(C)</enum><text>include incentive-based
				partnership approaches;</text>
								</subparagraph><subparagraph id="HBB0C9A0A33684837BAA1DBA502471012"><enum>(D)</enum><text>include an economic
				cost-benefit analysis of the measures for reducing, mitigating, and controlling
				hypoxia events;</text>
								</subparagraph><subparagraph id="HD77C4FA835AD44A283744689A6E5E90C"><enum>(E)</enum><text>utilize existing
				research, assessments, reports, and program activities;</text>
								</subparagraph><subparagraph id="HF437BAF64892417BAB3CAA919EDCE1C7"><enum>(F)</enum><text>publish a summary of the
				proposed plan in the Federal Register 90 days prior to the submission to the
				Congress of the completed plan; and</text>
								</subparagraph><subparagraph id="HD24F395A479A471E9EC468E4C71F7CF6"><enum>(G)</enum><text>provide progress reports
				every 2 years after the submission to the Congress of the completed plan on the
				activities leading toward attainment of the goals set forth in the plan.</text>
								</subparagraph></paragraph><paragraph id="H921E0FA5550E404095ABDEF891A23F81"><enum>(3)</enum><header>Contents</header><text display-inline="yes-display-inline">The plan shall—</text>
								<subparagraph id="H4B3F99E9B99E4069B0985ED9E355D8A1"><enum>(A)</enum><text>address the monitoring
				needs identified in the integrated assessment submitted under subsection (a)
				and develop a timeline and budgetary requirements for deployment of future
				assets;</text>
								</subparagraph><subparagraph id="HA73580A0B4D2468190C2AA89AD21D9A2"><enum>(B)</enum><text>detail procedures for the
				development and verification of Chesapeake Bay hypoxia models, including making
				available to the public—</text>
									<clause id="H502A3C82865649C28B8D6C2B93798981"><enum>(i)</enum><text>all assumptions built
				into the models; and</text>
									</clause><clause id="HDC8BB292F38C4849873CC41181922FF9"><enum>(ii)</enum><text>data quality methods
				used to ensure the best available data is utilized; and</text>
									</clause></subparagraph><subparagraph id="H5C4CB1DA5A674DD18BF79DC460247445"><enum>(C)</enum><text>describe efforts to
				improve the assessment of the impacts of hypoxia by—</text>
									<clause id="H818AAA396FBA4AACA9B446CAEA8EA634"><enum>(i)</enum><text>characterizing current
				and past biological conditions in ecosystems affected by hypoxia; and</text>
									</clause><clause id="H5AADFB10FAD440F78FA013DE90B4B48A"><enum>(ii)</enum><text>quantifying effects,
				including economic effects, at the population and community
				level.</text>
									</clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HF50685D2373843F1A3D0314696F4F5CF"><enum>9.</enum><header>Authorization of
			 appropriations</header>
			<subsection id="H0B1EE426746B4329B7C79AA017AF4AB7"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">Section 608, as redesignated by
			 <internal-xref idref="H85A2CA512D6E49418684942811CD05D6" legis-path="5.(a)(1)">section 5(1)</internal-xref> of this Act, is amended to
			 read as follows:</text>

					<section id="H98C787B6CD814766854A098A4BB49162"><enum>608.</enum><header>Authorization of
				appropriations</header>
						<subsection id="H85DDB90DA819424B9814F9B26AB8D223"><enum>(a)</enum><header>Under
				Secretary</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated to the Under Secretary to carry out this Act
				$18,000,000 for each of fiscal years 2012 through 2015, of which, for each
				fiscal year—</text>
							<paragraph id="HDD7C381ACB924CFA848A0330493A91F3"><enum>(1)</enum><text display-inline="yes-display-inline">$1,000,000 may be used for the development
				of the comprehensive research plan and action strategy under section 605 and
				the assessment and reports required by sections 606 and 607;</text>
							</paragraph><paragraph id="H5DBCE825C1E94A9880A146D12589CE3D"><enum>(2)</enum><text>$4,000,000 may be used
				for the research and assessment activities related to marine and freshwater
				harmful algal blooms at research laboratories of NOAA;</text>
							</paragraph><paragraph id="HC857D4D3403241DCBD267E279CDA25F1"><enum>(3)</enum><text>$4,000,000 may be used to
				carry out the Ecology of Harmful Algal Blooms Program (ECOHAB);</text>
							</paragraph><paragraph id="HCF6BC33385184FA2B4B3A0E8A9C0809C"><enum>(4)</enum><text>$1,500,000 may be used to
				carry out the Monitoring and Event Response for Harmful Algal Blooms Program
				(MERHAB);</text>
							</paragraph><paragraph id="H0A507E59232E49499DE93E64AA84FF10"><enum>(5)</enum><text>$2,000,000 may be used to
				carry out research and assessment for the Northern Gulf of Mexico ecosystem and
				hypoxia activities;</text>
							</paragraph><paragraph id="HCA9EEE6522A24A878DF7AB4164ED5F88"><enum>(6)</enum><text>$1,500,000 may be used to
				carry out coastal hypoxia research activities;</text>
							</paragraph><paragraph id="H1E22EAA5EAF14B0FAEB9CF2694D6A8A8"><enum>(7)</enum><text>$1,500,000 may be used to
				carry out prevention, control, and mitigation activities;</text>
							</paragraph><paragraph id="H1385472F1EEF4E599B8FEFBB317F2000"><enum>(8)</enum><text>$500,000 may be used to
				carry out event response activities; and</text>
							</paragraph><paragraph id="HA70C49B0F7F54B8AB1E201FE1ED26576"><enum>(9)</enum><text>$500,000 may be used to
				carry out infrastructure activities.</text>
							</paragraph></subsection><subsection id="H1B87417F129F4EBF93FDADB3E3212992"><enum>(b)</enum><header>Administrator</header>
							<paragraph id="HEDCAB32D890E4EAC83BF036DC27F06F3"><enum>(1)</enum><header>In
				general</header><text>There are authorized to be appropriated to the
				Administrator $2,700,000 for each of the fiscal years 2012 through 2015 to
				carry out the activities authorized under this Act.</text>
							</paragraph><paragraph id="H3A9ABB3ADCDB47C2BB3DE9D54888DAD4"><enum>(2)</enum><header>Nonduplication</header><text>The
				Administrator shall ensure that activities carried out using the amounts
				authorized under paragraph (1) do not duplicate research and development
				activities related to harmful algal blooms and hypoxia conducted by Federal
				agencies represented on the Task Force, States, tribes, and nongovernmental
				organizations concerned with marine and freshwater aquatic
				issues.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3980A707F7E64B699490FB7668FDD2C6"><enum>(b)</enum><header>Extramural research
			 activities</header><text display-inline="yes-display-inline">The Under
			 Secretary of Commerce for Oceans and Atmosphere shall ensure that a substantial
			 portion of funds appropriated pursuant to section 608 of the Harmful Algal
			 Bloom and Hypoxia Research and Control Act of 1998 that are used for research
			 purposes are allocated to extramural research activities.</text>
			</subsection></section><section id="H01C6023A5E06465CAB8551362043450C"><enum>10.</enum><header>Clerical
			 amendments</header>
			<subsection id="H5F9375902E63413BBE99594DEDF81672"><enum>(a)</enum><header>Table of contents
			 amendment</header><text display-inline="yes-display-inline">The table of
			 contents in section 2 of the Coast Guard Authorization Act of 1998 is amended
			 by striking the items relating to sections 602 through 606 and inserting the
			 following:</text>
