			 apply:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="HB0D428D2E4DA41C4A8D550A5ED015CEA"><enum>(1)</enum><header display-inline="yes-display-inline">700 MHz band</header><text display-inline="yes-display-inline">The term <term>700 MHz band</term> means
			 the portion of the electromagnetic spectrum between the frequencies from 698
			 megahertz to 806 megahertz.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD8B0CBB760BA4B12AE2E393E75FCCC8B"><enum>(2)</enum><header display-inline="yes-display-inline">700 MHz D block spectrum</header><text display-inline="yes-display-inline">The term <term>700 MHz D block
			 spectrum</term> means the portion of the electromagnetic spectrum between the
			 frequencies from 758 megahertz to 763 megahertz and between the frequencies
			 from 788 megahertz to 793 megahertz.</text>
			</paragraph><paragraph id="HCC01C67816AE4CFF8F8B6FDAA8E4A57B"><enum>(3)</enum><header>Appropriate
			 committees of Congress</header><text>Except as otherwise specifically provided,
			 the term <quote>appropriate committees of Congress</quote> means—</text>
				<subparagraph id="H1591A2ED9A4342D592E272235911E5D4"><enum>(A)</enum><text>the Committee on
			 Commerce, Science, and Transportation of the Senate; and</text>
				</subparagraph><subparagraph id="H9A59841B6B8841A18D1BA3D49B3FE53D"><enum>(B)</enum><text>the Committee on
			 Energy and Commerce of the House of Representatives.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCE8E16CE515A45689CA4694AFDBC360E"><enum>(4)</enum><header display-inline="yes-display-inline">Assistant Secretary</header><text display-inline="yes-display-inline">The term <term>Assistant Secretary</term>
			 means the Assistant Secretary of Commerce for Communications and

			 Federal Communications Commission.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBD0B3692B41B44A9A9B468EBCBD3BD20"><enum>(6)</enum><header>Corporation</header><text>The
			 term <quote>Corporation</quote> means the Public Safety Broadband Corporation
			 established under subtitle A of title II.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8DA2B22C774344188DE0F2271204DF37"><enum>(7)</enum><header display-inline="yes-display-inline">Existing public safety broadband
			 spectrum</header><text display-inline="yes-display-inline">The term
			 <term>existing public safety broadband spectrum</term> means the portion of the
			 electromagnetic spectrum between the frequencies—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H6A74286D41524571A68D94850E6DBD54"><enum>(A)</enum><text display-inline="yes-display-inline">from 763 megahertz to 768 megahertz;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF96DCD2905B94BBE81F525C5EBDC4604"><enum>(B)</enum><text display-inline="yes-display-inline">from 793 megahertz to 798 megahertz;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD6D197DABC9F4762B5CC6CA585A1021D"><enum>(C)</enum><text display-inline="yes-display-inline">from 768 megahertz to 769 megahertz;
			 and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8D1C1545FF924F6CB34C832F6B24B8AE"><enum>(D)</enum><text display-inline="yes-display-inline">from 798 megahertz to 799 megahertz.</text>
				</subparagraph></paragraph><paragraph id="H6ED2EAE2577E4538B6A1DA9CDEC5CC2B"><enum>(8)</enum><header>Federal
			 entity</header><text>The term <quote>Federal entity</quote> has the same
			 meaning as in section 113(i) of the National Telecommunications and Information
			 Administration Organization Act (47 U.S.C. 923(i)).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC3746794B7434078B69CA2885D74C2A1"><enum>(9)</enum><header display-inline="yes-display-inline">Narrowband spectrum</header><text display-inline="yes-display-inline">The term <term>narrowband spectrum</term>
			 means the portion of the electromagnetic spectrum between the frequencies from
			 769 megahertz to 775 megahertz and between the frequencies from 799 megahertz
			 to 805 megahertz.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBEDA453D84F747E1945437BBC08DCDBF"><enum>(10)</enum><header>NIST</header><text>The
			 term <quote>NIST</quote> means the National Institute of Standards and
			 Technology.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H78EF3FDD7E444EA3B53D2A9367C47D0D"><enum>(11)</enum><header display-inline="yes-display-inline">NTIA</header><text display-inline="yes-display-inline">The term <term>NTIA</term> means the
			 National Telecommunications and Information Administration.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC5C050248A6B4F55A4E59B7758FF119E"><enum>(12)</enum><header>Public safety
			 entity</header><text>The term <quote>public safety entity</quote> means an
			 entity that provides public safety services.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAD25B223421741E28E4B525D6A048719"><enum>(13)</enum><header>Public safety
			 services</header><text>The term <quote>public safety services</quote>—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="HC0171094E4754574AF45F75F9DA6B07E"><enum>(A)</enum><text>has the meaning
			 given the term in section 337(f) of the Communications Act of 1934 (47 U.S.C.
			 337(f)); and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2DAE5A0C36704293805229226EC8CFB7"><enum>(B)</enum><text>includes services
			 provided by emergency response providers, as that term is defined in section 2
			 of the Homeland Security Act of 2002 (6 U.S.C. 101).</text>
				</subparagraph></paragraph></section><title commented="no" id="H6539C6854E614373BA2309251A3C67BA" level-type="subsequent"><enum>I</enum><header display-inline="yes-display-inline">Reallocation of public safety
			 spectrum</header>
			<section commented="no" display-inline="no-display-inline" id="H3829B1FFFBD243A29AC6E7994B6C6C54" section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">Reallocation of D block to public
			 safety</header>
				<subsection commented="no" display-inline="no-display-inline" id="HF56C371A5861419FB8A9703AE87D06A2"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Commission shall reallocate the 700 MHz
			 D block spectrum for use by public safety entities in accordance with the
			 provisions of this Act.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H9CA01B1090A94C0D9707CF4BADE4C5CA"><enum>(b)</enum><header display-inline="yes-display-inline">Spectrum allocation</header><text display-inline="yes-display-inline">Section 337(a) of the
			 <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (47 U.S.C.
			 337(a)) is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="HE927B6E7DD4D4CC391B3AE87F76FE57B"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>24</quote> in paragraph
			 (1) and inserting <quote>34</quote>; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8F525AA39E9F4E72881261E4662DCB56"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>36</quote> in paragraph
			 (2) and inserting <quote>26</quote>.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H7587AAD8B9774EEFBF286B945ADE0344" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Flexible use of narrowband
			 spectrum</header><text display-inline="no-display-inline">The Commission may
			 allow the narrowband spectrum to be used in a flexible manner, including usage
			 for public safety broadband communications, subject to such technical and
			 interference protection measures as the Commission may require.</text>
			</section></title><title id="HF401F7C631BC4B68A3FBCF4A73B928D9"><enum>II</enum><header>Governance of
			 public safety spectrum</header>
			<subtitle id="HCC75968631CE4061AAC146AB569D7213"><enum>A</enum><header>Public Safety
			 Broadband Corporation</header>
				<section id="HE5C7EE360E9149CFA44B2BA639D08797"><enum>201.</enum><header>Single public
			 safety wireless network licensee</header>
					<subsection id="HCB9D815885F54A8FAE4C796FBDB7BD98"><enum>(a)</enum><header>Reallocation and
			 grant of license</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 and subject to the provisions of this Act, the Commission shall reallocate and
			 grant a license to the Public Safety Broadband Corporation established under
			 section 202 for the use of the 700 MHz D block spectrum and existing public
			 safety broadband spectrum.</text>
					</subsection><subsection id="H4E61274B3C964761B8E3890D8209A777"><enum>(b)</enum><header>Term of
			 license</header>
						<paragraph id="H9CFC2BE5E1D6402B8BD4501F7D8917A6"><enum>(1)</enum><header>Initial
			 license</header><text>The license granted under subsection (a) shall be for an
			 initial term of 10 years from the date of the initial issuance of the
			 license.</text>
						</paragraph><paragraph id="H1724C00B4AA944DDB167C6FE33B24339"><enum>(2)</enum><header>Renewal of
			 license</header><text>Prior to expiration of the term of the initial license
			 granted under subsection (a) or the expiration of any subsequent renewal of
			 such license, the Corporation shall submit to the Commission an application for
			 the renewal of such license. Such renewal application shall demonstrate that,
			 during the preceding license term, the Corporation has met the duties and
			 obligations set forth under this Act. A renewal license granted under this
			 paragraph shall be for a term of not to exceed 10 years.</text>
						</paragraph></subsection><subsection id="H4E20BE4FD1B941D09EA08C4719831C8D"><enum>(c)</enum><header>Facilitation of
			 transition</header><text>The Commission shall take all actions necessary to
			 facilitate the transition of the existing public safety broadband spectrum to
			 the Public Safety Broadband Corporation established under section 202.</text>
					</subsection></section><section id="H5789F120DC7F43B39CCAF67854112E71"><enum>202.</enum><header>Establishment
			 of Public Safety Broadband Corporation</header>
					<subsection id="H1889BF2EB5CD4032823835248F28AB36"><enum>(a)</enum><header>Establishment</header><text>There
			 is authorized to be established a private, nonprofit corporation, to be known
			 as the <quote>Public Safety Broadband Corporation</quote>, which is neither an
			 agency nor establishment of the United States Government or the District of
			 Columbia Government.</text>
					</subsection><subsection id="HFDEC338F80B849B989A980032236D9EB"><enum>(b)</enum><header>Application of
			 provisions</header><text>The Corporation shall be subject to the provisions of
			 this Act, and, to the extent consistent with this Act, to the District of
			 <act-name parsable-cite="CNCA">Columbia Nonprofit Corporation Act</act-name>
			 (sec. 29–301.01 et seq., D.C. Official Code).</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="H945BD1292E6F4E82B8FC223249AC24AE"><enum>(c)</enum><header>Residence</header><text>The
			 Corporation shall have its place of business in the District of Columbia and
			 shall be considered, for purposes of venue in civil actions, to be a resident
			 of the District of Columbia.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="H5FEB3B7B53BF4229AC3F5227483DE46D"><enum>(d)</enum><header>Powers under DC
			 Act</header><text>In order to carry out the duties and activities of the
			 Corporation, the Corporation shall have the usual powers conferred upon a
			 nonprofit corporation by the District of Columbia Nonprofit Corporation
			 Act.</text>
					</subsection><subsection id="HBE0C3527A1F74909B5FF0F67C49D3DFC"><enum>(e)</enum><header>Incorporation</header><text>The
			 members of the initial Board of Directors of the Corporation shall serve as
			 incorporators and shall take whatever steps that are necessary to establish the
			 Corporation under the District of <act-name parsable-cite="CNCA">Columbia
			 Nonprofit Corporation Act</act-name>.</text>
					</subsection></section><section id="HFF605463741944E4AACB1169A1B2EE7C"><enum>203.</enum><header>Board of
			 Directors of the Corporation</header>
					<subsection id="H3236BC341C3B4198AFF74CA9ED6F0393"><enum>(a)</enum><header>Membership</header><text>The
			 management of the Corporation shall be vested in a Board of Directors (referred
			 to in this subtitle as the <quote>Board</quote>), which shall consist of the
			 following members:</text>
						<paragraph id="HA2441716CA214BAAB04A436F32823BE8"><enum>(1)</enum><header>Federal
			 members</header><text>The following individuals, or their respective designees,
			 shall serve as Federal members:</text>
							<subparagraph id="H9700D4735D96432D997BFAF729D3FFD7"><enum>(A)</enum><text>The Secretary of
			 Commerce.</text>
							</subparagraph><subparagraph id="HF28AB071871243C8935FF3763DEC0033"><enum>(B)</enum><text>The Secretary of
			 Homeland Security.</text>
							</subparagraph><subparagraph id="HECD7476876914395A42869A4154C4B0A"><enum>(C)</enum><text>The Attorney
			 General of the United States.</text>
							</subparagraph><subparagraph id="H062DAB2AB6BE483D95359E500F5667A1"><enum>(D)</enum><text>The Director of
			 the Office of Management and Budget.</text>
							</subparagraph></paragraph><paragraph id="H960FB1ACF4964E1E8073FC5ED3F752B7"><enum>(2)</enum><header>Non-Federal
			 members</header>
							<subparagraph id="HB619840E67A74209B90BBEFD4F6E8D4B"><enum>(A)</enum><header>In
			 general</header><text>The Secretary of Commerce shall appoint 11 individuals to
			 serve as non-Federal members of the Board.</text>
							</subparagraph><subparagraph id="HBA544647082C40DCB2540CE0D75477EE"><enum>(B)</enum><header>State and local
			 interests to be represented</header><text>In making appointments under
			 subparagraph (A), the Secretary of Commerce, in consultation with the Secretary
			 of Homeland Security and the Attorney General of the United States,
			 should—</text>
								<clause id="HC354D56530864131B2164003648ED02A"><enum>(i)</enum><text>appoint at least 3
			 individuals to represent the collective interests of the States, localities,
			 tribes, and territories;</text>
								</clause><clause id="HE09F3AAA74494A47AF4731C4535F3159"><enum>(ii)</enum><text>seek to ensure
			 geographic and regional representation of the United States in such
			 appointments; and</text>
								</clause><clause id="H3D1A87F893184BC5B5EB30E96ADBEE17"><enum>(iii)</enum><text>seek to ensure
			 rural and urban representation in such appointments.</text>
								</clause></subparagraph><subparagraph id="H951485DA402945FDAA55F435598C3802"><enum>(C)</enum><header>Public safety
			 interests to be represented</header><text>In making appointments under
			 subparagraph (A), the Secretary of Commerce should appoint at least 3
			 individuals who have served or are currently serving as public safety
			 professionals.</text>
							</subparagraph><subparagraph id="H83A7C745B31B4880BAE2E65E1BE7C5F2"><enum>(D)</enum><header>Required
			 qualifications</header>
								<clause id="HF85B6115115C4EF980C5A5D053048F67"><enum>(i)</enum><header>In
			 general</header><text>Each non-Federal member appointed under subparagraph (A)
			 should meet at least 1 of the following criteria:</text>
									<subclause id="HA82DF847BDFB48BF88451C6C39A23AE4"><enum>(I)</enum><header>Public safety
			 experience</header><text>Knowledge and experience in the use of Federal, State,
			 local, or tribal public safety or emergency response.</text>
									</subclause><subclause id="H489954FEF79548588FAAC85AECDB5D03"><enum>(II)</enum><header>Technical
			 expertise</header><text>Technical expertise and fluency regarding broadband
			 communications, including public safety communications.</text>
									</subclause><subclause id="HFA99855532D545289CC39C07A0EB51AE"><enum>(III)</enum><header>Network
			 expertise</header><text>Expertise in building, deploying, and operating
			 commercial telecommunications networks.</text>
									</subclause><subclause id="HF696190D22F14018B20C1071B15F15C8"><enum>(IV)</enum><header>Financial
			 expertise</header><text>Expertise in financing and funding telecommunications
			 networks.</text>
									</subclause></clause><clause id="H60581F107202442AA1D65548D8B08F36"><enum>(ii)</enum><header>Expertise to be
			 represented</header><text>In making appointments under subparagraph (A), the
			 Secretary of Commerce shall appoint—</text>
									<subclause id="H133315A1ECA1421B986E33899FA3943B"><enum>(I)</enum><text>at least one
			 individual who satisfies the requirement under subclause (II) of clause
			 (i);</text>
									</subclause><subclause id="H7FF89FBE852844519CFE5B9993304416"><enum>(II)</enum><text>at least one
			 individual who satisfies the requirement under subclause (III) of clause (i);
			 and</text>
									</subclause><subclause id="H6A679E77774649A1B5B9B11F8327432D"><enum>(III)</enum><text>at least one
			 individual who satisfies the requirement under subclause (IV) of clause
			 (i).</text>
									</subclause></clause></subparagraph><subparagraph id="H9AC2E152955F48258788E2447F6FC6D1"><enum>(E)</enum><header>Independence</header>
								<clause id="HBFD91AC49FFE415C84A4293C4B4EDFDB"><enum>(i)</enum><header>In
			 general</header><text>Each non-Federal member of the Board shall be independent
			 and neutral.</text>
								</clause><clause id="H1C0A4FE38DBB4CE6A91DEEDFD8DEDF0A"><enum>(ii)</enum><header>Independence
			 determination</header><text>In order to be considered independent for purposes
			 of this subparagraph, a member of the Board—</text>
									<subclause id="H7F4CAC6D2ADC4BF98F840D05CED01037"><enum>(I)</enum><text>may not, other
			 than in his or her capacity as a member of the Board or any committee
			 thereof—</text>
										<item id="H2576792C50554A4EB801E036CEF09443"><enum>(aa)</enum><text>accept any
			 consulting, advisory, or other compensatory fee from the Corporation; or</text>
										</item><item id="HF03D4CF909054BE087A24ED42959750C"><enum>(bb)</enum><text>be a
			 person associated with the Corporation or with any affiliated company thereof;
			 and</text>
										</item></subclause><subclause id="H3DD0B2CC014E405D92A13ED14B4B1E1A"><enum>(II)</enum><text>shall be
			 disqualified from any deliberation involving any transaction of the Corporation
			 in which the Board member has a financial interest in the outcome of the
			 transaction.</text>
									</subclause></clause></subparagraph><subparagraph id="HA1A999CDA1874F81A5C5938CC44B2D1E"><enum>(F)</enum><header>Not officers or
			 employees</header><text>The non-Federal members of the Board shall not, by
			 reason of such membership, be considered to be officers or employees of the
			 United States Government or of the District of Columbia Government.</text>
							</subparagraph><subparagraph id="HDF1BB5653CB04F6185AE1F6E956BE8B3"><enum>(G)</enum><header>Citizenship</header><text>No
			 individual other than a citizen of the United States may serve as a non-Federal
			 member of the Board.</text>
							</subparagraph></paragraph></subsection><subsection id="HD28AA1A5FC5E41C2A51CFF17EBD18F94"><enum>(b)</enum><header>Terms of
			 appointment</header>
						<paragraph id="HA7C68F42FB844D05908BB88DC47FD82A"><enum>(1)</enum><header>Initial
			 appointment deadline</header><text>Members of the Board shall be appointed not
			 later than 180 days after the date of the enactment of this Act.</text>
						</paragraph><paragraph id="HC4FE5A6F8439482EBFCFE2B408B44A08"><enum>(2)</enum><header>Terms</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="H06B24875E9014892A191B0ADA410325B"><enum>(A)</enum><header>Length</header>
								<clause commented="no" display-inline="no-display-inline" id="H60498550E00A4172A2DF405682474D2B"><enum>(i)</enum><header>Federal
			 members</header><text>Each Federal member of the Board shall serve as a member
			 of the Board for the life of the Corporation.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="H14FDAE8FEE984494B218C3554DFE007F"><enum>(ii)</enum><header>Non-Federal
			 members</header><text>The term of office of each non-Federal member of the
			 Board shall be 3 years. No non-Federal member of the Board may serve more than
			 2 consecutive full 3-year terms.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H04C90A8FA7E647C490F34F0FF36BD0C5"><enum>(B)</enum><header>Expiration of
			 term</header><text>Any member whose term has expired may serve until such
			 member’s successor has taken office, or until the end of the calendar year in
			 which such member’s term has expired, whichever is earlier.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD7F318467FC7402D85F917BCDE1B95CD"><enum>(C)</enum><header>Appointment to
			 fill vacancy</header><text>Any non-Federal member appointed to fill a vacancy
			 occurring prior to the expiration of the term for which that member's
			 predecessor was appointed shall be appointed for the remainder of the
			 predecessor's term.</text>
							</subparagraph><subparagraph id="HA69CF9633FEC440A992B6622EE99894A"><enum>(D)</enum><header>Staggered
			 terms</header><text>With respect to the initial non-Federal members of the
			 Board—</text>
								<clause id="HECD8A2EC4D454E6E98EA962E43DDC0E0"><enum>(i)</enum><text>4
			 members shall serve for a term of 3 years;</text>
								</clause><clause id="H20AE8E9DC9504F41BAE82283DFEFB099"><enum>(ii)</enum><text>4
			 members shall serve for a term of 2 years; and</text>
								</clause><clause id="H8147516E13F546A3A939739724BEFC37"><enum>(iii)</enum><text>3
			 members shall serve for a term of 1 year.</text>
								</clause></subparagraph></paragraph><paragraph id="H1A75EE49AF0040E9ADA692203249507F"><enum>(3)</enum><header>Vacancies</header><text>A
			 vacancy in the membership of the Board shall not affect the Board’s powers, and
			 shall be filled in the same manner as the original member was appointed.</text>
						</paragraph></subsection><subsection id="HA980BA9A893147018AF6B85FD6736DED"><enum>(c)</enum><header>Chair</header>
						<paragraph id="H7156F7147C704296ACBEB882FEE8E3B9"><enum>(1)</enum><header>Selection</header><text>The
			 Secretary of Commerce shall select, from among the non-Federal members of the
			 Board, an individual to serve for a 2-year term as Chair of the Board.</text>
						</paragraph><paragraph id="HE8D7877C8AE64B7893A25FE041A06990"><enum>(2)</enum><header>Consecutive
			 terms</header><text>An individual may not serve for more than 2 consecutive
			 terms as Chair of the Board.</text>
						</paragraph><paragraph id="H311CB97BBC724050B5CEC50F9001C6A1"><enum>(3)</enum><header>Removal for
			 cause</header><text>The Secretary of Commerce may remove the Chair of the Board
			 and any non-Federal member for good cause.</text>
						</paragraph></subsection><subsection id="HF056FB7D5C4E477680036C1193E3C45E"><enum>(d)</enum><header>Removal</header><text>All
			 members of the Board may by majority vote—</text>
						<paragraph id="HF8958A91CE8949E0837CE39365AF6108"><enum>(1)</enum><text>remove any
			 non-Federal member of the Board from office for conduct determined by the Board
			 to be detrimental to the Board or Corporation; and</text>
						</paragraph><paragraph id="H1866CC127E9B4C1BBAC393A14157D488"><enum>(2)</enum><text>request that the
			 Secretary of Commerce exercise his or her authority to remove the Chair of the
			 Board for conduct determined by the Board to be detrimental to the Board or
			 Corporation.</text>
						</paragraph></subsection><subsection id="H6B0671C58DFF4110B64C82669B9C5B35"><enum>(e)</enum><header>Meetings</header>
						<paragraph id="HE5AD433EEB954B69ABD71764A99F09BE"><enum>(1)</enum><header>Frequency</header><text>The
			 Board shall meet in accordance with the bylaws of the Corporation—</text>
							<subparagraph id="HFF6BB9F3DD924AF9B6944EFC418CF1CD"><enum>(A)</enum><text>at the call of the
			 Chairperson; and</text>
							</subparagraph><subparagraph id="HB9A0BBF9141443ADABC5ABC07A7A54A4"><enum>(B)</enum><text>not less
			 frequently than once each quarter.</text>
							</subparagraph></paragraph><paragraph id="H933E674DF9374309BC7D5298FC22E55A"><enum>(2)</enum><header>Transparency</header><text>Meetings
			 of the Board, including any committee of the Board, shall be open to the
			 public. The Board may, by majority vote, close any such meeting only for the
			 time necessary to preserve the confidentiality of commercial or financial
			 information that is privileged or confidential, to discuss personnel matters,
			 or to discuss legal matters affecting the Corporation, including pending or
			 potential litigation.</text>
						</paragraph></subsection><subsection id="HD3D4F39528234F80AFAB6D0C5D532E14"><enum>(f)</enum><header>Quorum</header><text>Eight
			 members of the Board shall constitute a quorum, including at least 6
			 non-Federal members of the Board.</text>
					</subsection><subsection id="H2CE8704DB62D49F1B2A384E0C5FBA3B2"><enum>(g)</enum><header>Bylaws</header><text>A
			 majority of the members of the Board of Directors may amend the bylaws of the
			 Corporation.</text>
					</subsection><subsection id="H7329D3DFE3E147B0865711686E9F91B3"><enum>(h)</enum><header>Attendance</header><text>Members
			 of the Board of Directors may attend meetings of the Corporation and vote in
			 person, via telephone conference, or via video conference.</text>
					</subsection><subsection id="HABFF512B9817407FACC37302EE5F20A9"><enum>(i)</enum><header>Prohibition on
			 compensation</header><text>A member of the Board of the Corporation shall serve
			 without pay, and shall not otherwise benefit, directly or indirectly, as a
			 result of their service to the Corporation, but shall be allowed a per diem
			 allowance for travel expenses, at rates authorized for an employee of an agency
			 under subchapter I of chapter 57 of title 5, United States Code, while away
			 from the home or regular place of business of the member in the performance of
			 the duties of the Corporation.</text>
					</subsection></section><section id="H31FD50E09D224B0FBFCC7D8B9DCD4194"><enum>204.</enum><header>Officers,
			 employees, and committees of the Corporation</header>
					<subsection id="H946E9492A0A24A1ABD6CFD90C0C3AE1E"><enum>(a)</enum><header>Officers and
			 employees</header>
						<paragraph id="HE027BEB31EF6425BAF8A9830F7D3ADFE"><enum>(1)</enum><header>In
			 general</header><text>The Corporation shall have a Chief Executive Officer, and
			 such other officers and employees as may be named and appointed by the Board
			 for terms and at rates of compensation fixed by the Board pursuant to this
			 subsection. The Chief Executive Officer may name and appoint such employees as
			 are necessary. All officers and employees shall serve at the pleasure of the
			 Board.</text>
						</paragraph><paragraph id="H83EE4352D82043069CA3E3C91E585229"><enum>(2)</enum><header>Limitation</header><text>No
			 individual other than a citizen of the United States may be an officer of the
			 Corporation.</text>
						</paragraph><paragraph id="H3A7E2D11E10D43B18E5E61EBD91C2306"><enum>(3)</enum><header>Nonpolitical
			 nature of appointment</header><text>No political test or qualification shall be
			 used in selecting, appointing, promoting, or taking other personnel actions
			 with respect to officers, agents, or employees of the Corporation.</text>
						</paragraph><paragraph id="H03AF4980E08B422D973ACAB8828959B7"><enum>(4)</enum><header>Compensation</header>
							<subparagraph id="H17790FDA08BC4EAC9FE7E59E1B8D2EEB"><enum>(A)</enum><header>In
			 general</header><text>The Board may hire and fix the compensation of employees
			 hired under this subsection as may be necessary to carry out the purposes of
			 the Corporation.</text>
							</subparagraph><subparagraph id="H3CDC33B4EFFA4508BF8BA2EB3F4C587D"><enum>(B)</enum><header>Approval of
			 compensation by Federal Members</header><text>Notwithstanding any other
			 provision of law, or any bylaw adopted by the Corporation, all rates of
			 compensation, including benefit plans and salary ranges, for officers and
			 employees of the Board, shall be jointly approved by the Federal members of the
			 Board.</text>
							</subparagraph><subparagraph id="H17349A6FD0BE49C7A30579E2E07DE0C5"><enum>(C)</enum><header>Limitation on
			 other compensation</header><text>No officer or employee of the Corporation may
			 receive any salary or other compensation (except for compensation for services
			 on boards of directors of other organizations that do not receive funds from
			 the Corporation, on committees of such boards, and in similar activities for
			 such organizations) from any sources other than the Corporation for services
			 rendered during the period of the employment of the officer or employee by the
			 Corporation.</text>
							</subparagraph></paragraph><paragraph id="H810AD2F6D90A49F481054DE03BD7A021"><enum>(5)</enum><header>Service on other
			 boards</header><text>Service by any officer on boards of directors of other
			 organizations, on committees of such boards, and in similar activities for such
			 organizations shall be subject to annual advance approval by the Board and
			 subject to the provisions of the Corporation's Statement of Ethical
			 Conduct.</text>
						</paragraph><paragraph id="H6B413A0C000A43C1978F770C5F528F07"><enum>(6)</enum><header>Rule of
			 construction</header><text>No officer or employee of the Board or of the
			 Corporation shall be considered to be an officer or employee of the United
			 States Government or of the government of the District of Columbia.</text>
						</paragraph></subsection><subsection id="H05BA891C22D0463781E31609FF73F8A8"><enum>(b)</enum><header>Advisory
			 committees</header><text>The Board—</text>
						<paragraph id="H3BFC43020C9D44A2A55922C2FD707ECA"><enum>(1)</enum><text>shall establish a
			 standing public safety advisory committee to assist the Board in carrying out
			 its duties and responsibilities under this subtitle; and</text>
						</paragraph><paragraph id="HF6DAF8042B274947BB20FF7EC2853E08"><enum>(2)</enum><text>may establish
			 additional standing or ad hoc committees, panels, or councils as the Board
			 determines are necessary.</text>
						</paragraph></subsection><subsection id="H82D93ABB4E4A4B26916DBD7E4961AB40"><enum>(c)</enum><header>Selection of
			 agents, consultants, and experts</header>
						<paragraph id="HFF64395E5385485ABF7F04B98B7917A6"><enum>(1)</enum><header>In
			 general</header><text>The Board shall select parties to serve as its agents,
			 consultants, or experts in a fair, transparent, and objective manner.</text>
						</paragraph><paragraph id="H999B1A9C14E14030BCDFBED6829D2221"><enum>(2)</enum><header>Binding and
			 final</header><text>If the selection of an agent, consultant, or expert
			 satisfies the requirements under paragraph (1), the selection of that agent,
			 consultant, or expert shall be final and binding.</text>
						</paragraph></subsection></section><section id="H2C4582FAF48D42D0ADEB9BAB2055E88C"><enum>205.</enum><header>Nonprofit and
			 nonpolitical nature of the Corporation</header>
					<subsection id="H7276A2F6E3B941C18903DCC6EF97BDF3"><enum>(a)</enum><header>Stock</header><text>The
			 Corporation shall have no power to issue any shares of stock, or to declare or
			 pay any dividends.</text>
					</subsection><subsection id="H106443AE8AF845E9A8C78458A6352008"><enum>(b)</enum><header>Profit</header><text>No
			 part of the income or assets of the Corporation shall inure to the benefit of
			 any director, officer, employee, or any other individual associated with the
			 Corporation, except as salary or reasonable compensation for services.</text>
					</subsection><subsection id="HC1543794939A4ABB889599B71D763612"><enum>(c)</enum><header>Politics</header><text>The
			 Corporation may not contribute to or otherwise support any political party or
			 candidate for elective public office.</text>
					</subsection><subsection id="HEFED6ADC50494BAEA7DB75F611E364D8"><enum>(d)</enum><header>Prohibition on
			 lobbying activities</header><text>The Corporation shall not engage in lobbying
			 activities (as defined in section 3(7) of the Lobbying Disclosure Act of 1995
			 (5 U.S.C. 1602(7))).</text>
					</subsection></section><section id="HF04CF0D016934623B407F465ACE5BD0E"><enum>206.</enum><header>Powers, duties,
			 and responsibilities of the Corporation</header>
					<subsection id="H94BD5AC88B934FF8906EB0A241563C76"><enum>(a)</enum><header>General
			 powers</header><text display-inline="yes-display-inline">The Corporation shall
			 have the authority to do the following:</text>
						<paragraph id="H70B4531C1AE3435486140A48D31F39D9"><enum>(1)</enum><text>To adopt and use a
			 corporate seal.</text>
						</paragraph><paragraph id="HE0668334885D45EFA456AEEB2E66E23A"><enum>(2)</enum><text>To have succession
			 until dissolved by an Act of Congress.</text>
						</paragraph><paragraph id="HA5A13D13C2FD4FABA47C53FFBF8C6589"><enum>(3)</enum><text>To prescribe,
			 through the actions of its Board, bylaws not inconsistent with Federal law and
			 the laws of the District of Columbia, regulating the manner in which the
			 Corporation's general business may be conducted and the manner in which the
			 privileges granted to the Corporation by law may be exercised.</text>
						</paragraph><paragraph id="HEEA3E25903D14D7EABA0B4EC9B78065F"><enum>(4)</enum><text>To exercise,
			 through the actions of its Board, all powers specifically granted by the
			 provisions of this subtitle, and such incidental powers as shall be
			 necessary.</text>
						</paragraph><paragraph id="HC6190945D4C84582B8CAE98210C09E0C"><enum>(5)</enum><text>To hold such
			 hearings, sit and act at such times and places, take such testimony, and
			 receive such evidence as the Corporation considers necessary to carry out its
			 responsibilities and duties.</text>
						</paragraph><paragraph id="HF9494CC5A0F24FE2BB69A19A30DEFE06"><enum>(6)</enum><text>To obtain grants
			 and funds from and make contracts with individuals, private companies,
			 organizations, institutions, and Federal, State, regional, and local
			 agencies.</text>
						</paragraph><paragraph id="HFFD59CBB109E49048A4EBD9AB6684206"><enum>(7)</enum><text>To accept, hold,
			 administer, and utilize gifts, donations, and bequests of property, both real
			 and personal, for the purposes of aiding or facilitating the work of the
			 Corporation.</text>
						</paragraph><paragraph id="H99BE9B5903CE48DB8C1896AF1CE33AD0"><enum>(8)</enum><text>To issue notes or
			 bonds to purchasers of such instruments in the private capital markets.</text>
						</paragraph><paragraph id="HF6569A1A12D84036B0E7DF64A052A564"><enum>(9)</enum><text>To incur
			 indebtedness to carry out the purposes of this subtitle.</text>
						</paragraph><paragraph id="H51F478B6C79748FE92C7D2F850EBE743"><enum>(10)</enum><text>To spend funds
			 under paragraph (6) in a manner authorized by the Board, but only for purposes
			 that will advance or enhance public safety communications consistent with this
			 Act.</text>
						</paragraph><paragraph id="H7DD502AF90194768A58B902235971D70"><enum>(11)</enum><text>To establish
			 reserve accounts with funds that the Corporation may receive from time to time
			 that exceed the amounts required by the Corporation to timely pay its debt
			 service and other obligations.</text>
						</paragraph><paragraph id="H616914CEED844216A03E1310359FA2C4"><enum>(12)</enum><text>To expend the
			 funds placed in any reserve accounts established under paragraph (11)
			 (including interest earned on any such amounts) in a manner authorized by the
			 Board, but only for purposes that—</text>
							<subparagraph id="H8C613C5509D24D3FB118EF5CF56BB07E"><enum>(A)</enum><text>will advance or
			 enhance public safety communications consistent with this Act; or</text>
							</subparagraph><subparagraph id="H7B7497D00B294BA2B24BF396D5F6C173"><enum>(B)</enum><text>are otherwise
			 approved by an Act of Congress.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFC2663BDCAA94522AC37B5AD15A5AFA6"><enum>(13)</enum><text>To take such
			 other actions as the Corporation (through its Board) may from time to time
			 determine necessary, appropriate, or advisable to accomplish the purposes of
			 this subtitle.</text>
						</paragraph></subsection><subsection id="HD4C8B54CF7EA4ACBADFD50EAC3101064"><enum>(b)</enum><header>Duty and
			 responsibility To deploy and operate a nationwide public safety interoperable
			 broadband network</header>
						<paragraph id="HC6886B8FB33E4407A103CA81ACF70F34"><enum>(1)</enum><header>In
			 general</header><text>The Corporation shall hold the single public safety
			 wireless license granted under section 201 and take all actions necessary to
			 ensure the building, deployment, and operation of a nationwide public safety
			 interoperable broadband network in consultation with Federal, State, tribal,
			 and local public safety entities, the Director of NIST, the Commission, and the
			 public safety advisory committee established in section 204(b)(1), including
			 by, at a minimum—</text>
							<subparagraph id="HDF9395618C8F4C8B84BA18396C3513EF"><enum>(A)</enum><text>ensuring
			 nationwide standards for use and access of the network;</text>
							</subparagraph><subparagraph id="H1F8BF04470FE4C4F82BD58BBC1524D0B"><enum>(B)</enum><text>issuing open,
			 transparent, and competitive requests for proposals to private sector entities
			 for the purposes of building, operating, and maintaining the network;</text>
							</subparagraph><subparagraph id="H3B17B83E28A94FB1AAED2A15A0CF4605"><enum>(C)</enum><text>encouraging that
			 such requests leverage, to the maximum extent economically desirable, existing
			 commercial wireless infrastructure to speed deployment of the network;
			 and</text>
							</subparagraph><subparagraph id="H4343BA814DDF41F69293045DD5B43F51"><enum>(D)</enum><text>managing and
			 overseeing the implementation and execution of contracts or agreements with
			 non-Federal entities to build, operate, and maintain the network.</text>
							</subparagraph></paragraph><paragraph id="HDA3E3E52F00F40108CDCCE5A1B64CDDE"><enum>(2)</enum><header>Interoperability</header><text>In
			 carrying out the duties and responsibilities of this subsection, including
			 issuing requests for proposals, the Corporation shall—</text>
							<subparagraph id="H15ABBCC23B7240EC867B597AB80D5175"><enum>(A)</enum><text>ensure the safety,
			 security, and resiliency of the network, including requirements for protecting
			 and monitoring the network to protect against cyberattack;</text>
							</subparagraph><subparagraph id="H03CDD8634DCE42969A4C92DA93BC9E56"><enum>(B)</enum><text>promote
			 competition in the equipment market, including devices for public safety
			 communications, by requiring that equipment for use on the network be—</text>
								<clause id="H726504694E9041F68CE104E6327AC946"><enum>(i)</enum><text>built to open,
			 non-proprietary, commercially available standards;</text>
								</clause><clause id="HC69249583F6544D29413424CC5B8805B"><enum>(ii)</enum><text>capable of being
			 used by any public safety entity and by multiple vendors across all public
			 safety broadband networks operating in the 700 MHz band; and</text>
								</clause><clause id="H9C19BEE7C29B49C68197D57BA17E901A"><enum>(iii)</enum><text>backward-compatible
			 with existing second and third generation commercial networks to the extent
			 that such capabilities are necessary and technically and economically
			 reasonable; and</text>
								</clause></subparagraph><subparagraph id="H7EC3BC7FCAFC45499A7881DCDAF63109"><enum>(C)</enum><text>promote
			 integration of the network with public safety answering points or their
			 equivalent.</text>
							</subparagraph></paragraph><paragraph id="HA6D87D9D4718422DB32A895EDC041769"><enum>(3)</enum><header>Rural
			 coverage</header><text>In carrying out the duties and responsibilities of this
			 subsection, including issuing requests for proposals, the Corporation,
			 consistent with the license granted under section 201, shall require deployment
			 phases with substantial rural coverage milestones as part of each phase of the
			 construction and deployment of the network. To the maximum extent economically
			 desirable, such proposals shall include partnerships with existing commercial
			 mobile providers to utilize cost-effective opportunities to speed deployment in
			 rural areas.</text>
						</paragraph><paragraph id="H574CFDC16A3D4D71B91A8131F05217B9"><enum>(4)</enum><header>Execution of
			 authority</header><text>In carrying out the duties and responsibilities of this
			 subsection, the Corporation may—</text>
							<subparagraph id="H5AB945545F2F443497641F5018A81568"><enum>(A)</enum><text>obtain grants from
			 and make contracts with individuals, private companies, and Federal, State,
			 regional, and local agencies;</text>
							</subparagraph><subparagraph id="H012A93B4C1774C918992A4679E7ADD0A"><enum>(B)</enum><text>hire or accept
			 voluntary services of consultants, experts, advisory boards, and panels to aid
			 the Corporation in carrying out such duties and responsibilities;</text>
							</subparagraph><subparagraph id="H0BD0A25CA44E46EA94BE636E51F7A79D"><enum>(C)</enum><text>receive payment
			 for use of—</text>
								<clause id="H5C185228772649D59897D1D8AA1904FA"><enum>(i)</enum><text>network capacity
			 licensed to the Corporation; and</text>
								</clause><clause id="H066A9022A59A4B80BB1A71BDA432FE50"><enum>(ii)</enum><text>network
			 infrastructure constructed, owned, or operated by the Corporation; and</text>
								</clause></subparagraph><subparagraph id="H8609142DD095431085A0203CDF33ADA2"><enum>(D)</enum><text>take such other
			 actions as may be necessary to accomplish the purposes set forth in this
			 subsection.</text>
							</subparagraph></paragraph></subsection><subsection id="HA0FD8F5F251F4BED831C6CE159ACCF23"><enum>(c)</enum><header>Other specific
			 duties and responsibilities</header>
						<paragraph id="HEE4EE487557241DC971CA00750669D31"><enum>(1)</enum><header>Establishment of
			 network policies</header><text>In carrying out the requirements under
			 subsection (b), the Corporation shall develop—</text>
							<subparagraph id="HE3F7074920574B3B9B07950BEA8AF825"><enum>(A)</enum><text>requests for
			 proposals with appropriate—</text>
								<clause id="H620126A9B46A433282DB616B8E033150"><enum>(i)</enum><text>timetables for
			 construction, including by taking into consideration the time needed to build
			 out to rural areas and the advantages offered through partnerships with
			 existing commercial providers under paragraph (3);</text>
								</clause><clause id="H10EA73AE721B42AD88937CC08A84BD9C"><enum>(ii)</enum><text>coverage areas,
			 including coverage in rural and nonurban areas;</text>
								</clause><clause id="H8B332428FDB44CEAAB28F9F8536BD7A7"><enum>(iii)</enum><text>service
			 levels;</text>
								</clause><clause id="HB5EFDBC830EA4B56AE8BE085DF05C355"><enum>(iv)</enum><text>performance
			 criteria; and</text>
								</clause><clause id="HCBB48AB16ACE45D092ABEF22C033E3E7"><enum>(v)</enum><text>other similar
			 matters for the construction and deployment of such network;</text>
								</clause></subparagraph><subparagraph id="H97C0478B3C1B4BF1A9029959040C259B"><enum>(B)</enum><text>the technical and
			 operational requirements of the network;</text>
							</subparagraph><subparagraph id="H2542C5D83B5345F8B591086A902F0C62"><enum>(C)</enum><text>practices,
			 procedures, and standards for the management and operation of such
			 network;</text>
							</subparagraph><subparagraph id="H967991FECEAD4518AAB316B5BB95C188"><enum>(D)</enum><text>terms of service
			 for the use of such network, including billing practices; and</text>
							</subparagraph><subparagraph id="H21A1C073F1B7404BB9D7C66767473011"><enum>(E)</enum><text>ongoing compliance
			 review and monitoring of the—</text>
								<clause id="HDD0A7B18BD93483AB7006E5135FD0D6F"><enum>(i)</enum><text>management and
			 operation of such network;</text>
								</clause><clause id="H17C8CF9D398E4776B557251BDC8E0AD4"><enum>(ii)</enum><text>practices and
			 procedures of the entities operating on and the personnel using such network;
			 and</text>
								</clause><clause id="H7963C88CE4DE46CDA71513F452D02AA6"><enum>(iii)</enum><text>necessary
			 training needs of network operators and users.</text>
								</clause></subparagraph></paragraph><paragraph id="H9F6309A1061B4CE7BABDBFD732D148E3"><enum>(2)</enum><header>State and local
			 planning</header>
							<subparagraph id="H79FD7342FCF447F1AB3DB26584F80455"><enum>(A)</enum><header>Required
			 consultation</header><text>In developing requests for proposals and otherwise
			 carrying out its responsibilities under this Act, the Corporation shall consult
			 with regional, State, tribal, and local jurisdictions regarding the
			 distribution and expenditure of any amounts required to carry out the policies
			 established under paragraph (1), including with regard to the—</text>
								<clause id="HC18840E911764EC5B8ADC8C2AE36CABC"><enum>(i)</enum><text>construction of an
			 Evolved Packet Core and any Radio Access Network build out;</text>
								</clause><clause id="HA6B0D03319E34FBEB6A908E9DC3BBD58"><enum>(ii)</enum><text>placement of
			 towers;</text>
								</clause><clause id="H519C7806428349A79BB9D859B67619FF"><enum>(iii)</enum><text>coverage areas
			 of the network, whether at the regional, State, tribal, or local level;</text>
								</clause><clause id="H1DC4C57AA03446A2B6510E69964A5A27"><enum>(iv)</enum><text>adequacy of
			 hardening, security, reliability, and resiliency requirements;</text>
								</clause><clause id="H4CEF4DAE188245DFAC0CE094ACF4364D"><enum>(v)</enum><text>assignment of
			 priority to local users;</text>
								</clause><clause id="H9A990F94E0B74CAABEEA01DBE6F2CB89"><enum>(vi)</enum><text>assignment of
			 priority and selection of entities seeking access to or use of the nationwide
			 public safety interoperable broadband network established under subsection (b);
			 and</text>
								</clause><clause id="HFFF7795E34CB4ECBA49E0ECBEE356516"><enum>(vii)</enum><text>training needs
			 of local users.</text>
								</clause></subparagraph><subparagraph id="H1CE530CB5FCC427B98C25F7338AE9CE9"><enum>(B)</enum><header>Method of
			 consultation</header><text>The consultation required under subparagraph (A)
			 shall occur between the Corporation and the single officer or governmental body
			 designated under section 222(d).</text>
							</subparagraph></paragraph><paragraph id="H7A5DD78A532A48A780EE863B6538C820"><enum>(3)</enum><header>Leveraging
			 existing infrastructure</header><text>In carrying out the requirement under
			 subsection (b), the Corporation shall enter into agreements to utilize, to the
			 maximum extent economically desirable, existing—</text>
							<subparagraph id="H3707A6863A5A4B42AAEB7ED90A982ADD"><enum>(A)</enum><text>commercial or
			 other communications infrastructure; and</text>
							</subparagraph><subparagraph id="H89A567F0B2204390B42470ED4EE88740"><enum>(B)</enum><text>Federal, State,
			 tribal, or local infrastructure.</text>
							</subparagraph></paragraph><paragraph id="H654DB952D4FF48088F7730F54B3B9310"><enum>(4)</enum><header>Maintenance and
			 upgrades</header><text>The Corporation shall ensure the maintenance, operation,
			 and improvement of the nationwide public safety interoperable broadband network
			 established under subsection (b), including by ensuring that the Corporation
			 updates and revises any policies established under paragraph (1) to take into
			 account new and evolving technologies.</text>
						</paragraph><paragraph id="H8EFFC295279E4C0489A7546B41CE658F"><enum>(5)</enum><header>Roaming
			 agreements</header><text>The Corporation shall negotiate and enter into, as it
			 determines appropriate, roaming agreements with commercial network providers to
			 allow the nationwide public safety interoperable broadband network to roam onto
			 commercial networks and gain prioritization of public safety communications
			 over such networks in times of an emergency.</text>
						</paragraph><paragraph id="H9BFC4E4ED31447289AF5E2AD39F35DA4"><enum>(6)</enum><header>Network
			 infrastructure and device criteria</header><text>The Director of NIST, in
			 consultation with the Corporation and the Commission, shall ensure the
			 development of a list of certified devices and components meeting appropriate
			 protocols and standards for public safety entities and commercial vendors to
			 adhere to, if such entities or vendors seek to have access to, use of, or
			 compatibility with the nationwide public safety interoperable broadband network
			 established under subsection (b).</text>
						</paragraph><paragraph id="H18B3B62F945243D39C9C11F5964E6EEA"><enum>(7)</enum><header>Representation
			 before standard setting entities</header><text>The Director of NIST, in
			 consultation with the Corporation, the Commission, and the public safety
			 advisory committee established under section 204(b)(1), shall represent the
			 interests of public safety users of the nationwide public safety interoperable
			 broadband network established under subsection (b) before any proceeding,
			 negotiation, or other matter in which a standards organization, standards body,
			 standards development organization, or any other recognized standards-setting
			 entity regarding the development of standards relating to
			 interoperability.</text>
						</paragraph><paragraph id="HBBB07F465CE44AF6AF904B997601A308"><enum>(8)</enum><header>Prohibition on
			 negotiation with foreign governments</header><text>The Corporation shall not
			 have the authority to negotiate or enter into any agreements with a foreign
			 government on behalf of the United States.</text>
						</paragraph></subsection><subsection id="H8572003D9CD34A92AA3096BCDE7705D6"><enum>(d)</enum><header>Use of
			 mails</header><text>The Corporation may use the United States mails in the same
			 manner and under the same conditions as the departments and agencies of the
			 United States.</text>
					</subsection></section><section commented="no" display-inline="no-display-inline" id="H570E1213C8E644BE814A6BBA2DDECEEE"><enum>207.</enum><header>Initial funding
			 for the Corporation</header>
					<subsection commented="no" display-inline="no-display-inline" id="H926942C10AA445F9BBDF294908573555"><enum>(a)</enum><header>NTIA loans to
			 the Corporation</header>
						<paragraph commented="no" display-inline="no-display-inline" id="H8C0A4275B46F479494B7C207750AF781"><enum>(1)</enum><header>In
			 general</header><text>Prior to the commencement of incentive auctions to be
			 carried out under section 309(j)(8)(F) of the Communications Act of 1934 or the
			 auction of spectrum pursuant to section 302, the NTIA is authorized to make
			 loans to the Corporation.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAE8C1B769BE24C94860B08F26CB8790F"><enum>(2)</enum><header>Condition of
			 loans</header><text>At the time of application for, and as a condition to, any
			 such loan, the Corporation shall file with the NTIA a statement with respect to
			 the anticipated use of the proceeds of the loan.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H82DA143BF5ED4726B5C71A13DF10E47E"><enum>(3)</enum><header>NTIA
			 approval</header><text>If the NTIA determines that such loan is necessary for
			 the Corporation to carry out its duties and responsibilities under this
			 subtitle and that the Corporation has submitted a plan which provides as
			 reasonable an assurance of prompt repayment as may be feasible under the
			 circumstances, then the NTIA shall so certify to the Secretary of the Treasury,
			 and issue notes or other obligations to the Secretary of the Treasury pursuant
			 to subsection (b).</text>
						</paragraph></subsection><subsection id="HA50FD8C7FC35408BAC4AE5CB158537E5"><enum>(b)</enum><header>NTIA notes
			 issued to Treasury</header>
						<paragraph id="H016EF8A4BE6B4739965EF6857ACD180F"><enum>(1)</enum><header>In
			 general</header><text>To enable the NTIA to make loans under subsection (a),
			 the NTIA is authorized to issue to the Secretary of the Treasury notes or other
			 obligations, in such forms and denominations, bearing such maturities, and
			 subject to such terms and conditions, as may be prescribed by the Secretary of
			 the Treasury.</text>
						</paragraph><paragraph id="H14485E63523B438AA50F55CE3E9C6315"><enum>(2)</enum><header>Interest on
			 notes</header>
							<subparagraph id="HF7B616761C3D4D13849FBB8365C93F8B"><enum>(A)</enum><header>Establishment</header><text>Any
			 notes or other obligations issued pursuant to paragraph (1) shall bear interest
			 at a rate determined by the Secretary of the Treasury, taking into
			 consideration the current average market yield on outstanding marketable
			 obligations of the United States of comparable maturities during the month
			 preceding the issuance of the notes or other obligations.</text>
							</subparagraph><subparagraph id="HCD3AA2F21DED4FD9B5A3DD293501C438"><enum>(B)</enum><header>Reduction</header><text>The
			 Secretary of the Treasury may reduce the interest rate set forth under
			 subparagraph (A) if he determines such reduction to be in the national
			 interest.</text>
							</subparagraph></paragraph><paragraph id="H5ABD1FEBC1284481BEADA8B5309908D8"><enum>(3)</enum><header>Authority of the
			 Treasury to sell notes</header><text>The Secretary of the Treasury may at any
			 time sell any of the notes or other obligations acquired by him under this
			 subsection. All redemptions, purchases, and sales by the Secretary of the
			 Treasury of such notes or other obligations shall be treated as public debt
			 transactions of the United States.</text>
						</paragraph></subsection></section><section id="HB0E58F5D43E14A9FAB6A80E02123E9F5"><enum>208.</enum><header>Permanent
			 self-funding; duty to assess and collect fees for network use</header>
					<subsection id="H007D5275EA8A42E28A2FD8B5CDC52B0B"><enum>(a)</enum><header>In
			 general</header><text>The Corporation is authorized to assess and collect the
			 following fees:</text>
						<paragraph id="H92D12F51D6E44C85BAC680AC5AF62BC4"><enum>(1)</enum><header>Network user
			 fee</header><text>A user or subscription fee from each entity, including any
			 public safety entity or secondary user, that seeks access to or use of the
			 nationwide public safety interoperable broadband network established under this
			 subtitle.</text>
						</paragraph><paragraph id="H9295F124713A450FABAF80266EAD7BDC"><enum>(2)</enum><header>Lease fees
			 related to network capacity</header>
							<subparagraph id="H155E4043B9A44A05BF0EED4C4B574A90"><enum>(A)</enum><header>In
			 general</header><text>A fee from any entity that seeks to enter into a covered
			 leasing agreement.</text>
							</subparagraph><subparagraph id="H3DF1630CC4C24CD6BB0CE6FF79586797"><enum>(B)</enum><header>Covered leasing
			 agreement</header><text>For purposes of subparagraph (A), a <quote>covered
			 leasing agreement</quote> means a written agreement between the Corporation and
			 secondary user to permit—</text>
								<clause id="H0360C81D50FF4B488D4E8DF1BD0276AF"><enum>(i)</enum><text>access to network
			 capacity on a secondary basis for non-public safety services; and</text>
								</clause><clause id="H4512497617C4475C9E3D5E12D65AE74A"><enum>(ii)</enum><text>the
			 spectrum allocated to such entity to be used for commercial transmissions along
			 the dark fiber of the long-haul network of such entity.</text>
								</clause></subparagraph></paragraph><paragraph id="H6B31DDFAB4EF4A88A48C2592F5F25202"><enum>(3)</enum><header>Lease fees
			 related to network equipment and infrastructure</header><text>A fee from any
			 entity that seeks access to or use of any equipment or infrastructure,
			 including antennas or towers, constructed or otherwise owned by the
			 Corporation.</text>
						</paragraph></subsection><subsection commented="no" id="H0D592DA8A254402C8D37A275E6D8B144"><enum>(b)</enum><header>Establishment of
			 fee amounts; permanent self-Funding</header><text>The total amount of the fees
			 assessed for each fiscal year pursuant to this section shall be sufficient, and
			 shall not exceed the amount necessary, to recoup the total expenses of the
			 Corporation in carrying out its duties and responsibilities described under
			 this subtitle for the fiscal year involved.</text>
					</subsection><subsection commented="no" id="H8FAD8572BD4348DCB7FE4020501CB301"><enum>(c)</enum><header>Required
			 reinvestment of funds</header><text>The Corporation shall reinvest amounts
			 received from the assessment of fees under this section in the nationwide
			 public safety interoperable broadband network by using such funds only for
			 constructing, maintaining, or improving the network.</text>
					</subsection></section><section commented="no" display-inline="no-display-inline" id="H27BC3EE1B6CA40E191C6D8F313E3DEA2"><enum>209.</enum><header>Audit and
			 report</header>
					<subsection commented="no" display-inline="no-display-inline" id="H87D0381E37D7489FA3110F666EF5A580"><enum>(a)</enum><header>Audit</header>
						<paragraph commented="no" display-inline="no-display-inline" id="H8653110C6E974967AD1E20B921CE38ED"><enum>(1)</enum><header>In
			 general</header><text>The financial transactions of the Corporation for any
			 fiscal year during which Federal funds are available to finance any portion of
			 its operations shall be audited by the Comptroller General of the United States
			 annually in accordance with the principles and procedures applicable to
			 commercial corporate transactions and under such rules and regulations as may
			 be prescribed by the Comptroller General. Each audit conducted by the
			 Comptroller General under this paragraph shall be made available to
			 Congress.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1D4D523C8C1B404BA18D6EAA66296AF1"><enum>(2)</enum><header>Location</header><text>Any
			 audit conducted under paragraph (1) shall be conducted at the place or places
			 where accounts of the Corporation are normally kept.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H712F5D364BF84DA09B291203B45069DA"><enum>(3)</enum><header>Access to
			 Corporation books and documents</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="H7842C344EB5A462D81B9618056ED160A"><enum>(A)</enum><header>In
			 general</header><text>For purposes of an audit conducted under paragraph (1),
			 the representatives of the Comptroller General shall—</text>
								<clause commented="no" display-inline="no-display-inline" id="H2560588DECA9459698FF60B6EEE503C5"><enum>(i)</enum><text>have access to all
			 books, accounts, records, reports, files, and all other papers, things, or
			 property belonging to or in use by the Corporation that pertain to the
			 financial transactions of the Corporation and are necessary to facilitate the
			 audit; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="H39B23B73D85B4FB6B43BA3E10DB1A2B9"><enum>(ii)</enum><text>be afforded full
			 facilities for verifying transactions with the balances or securities held by
			 depositories, fiscal agents, and custodians.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2E28528DDB4F480E82E7DC8A8C0E9976"><enum>(B)</enum><header>Requirement</header><text>All
			 books, accounts, records, reports, files, papers, and property of the
			 Corporation shall remain in the possession and custody of the
			 Corporation.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF324A8BB91AE4C5B944F8ADAC7B95B55"><enum>(b)</enum><header>Report</header>
						<paragraph commented="no" display-inline="no-display-inline" id="H7C9D5F3AC622486D8FF1942002BE2660"><enum>(1)</enum><header>In
			 general</header><text>The Comptroller General of the United States shall submit
			 a report of each audit conducted under subsection (a) to—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="H804CD0BA729743EA9F57B0702C53EC10"><enum>(A)</enum><text>the appropriate
			 committees of Congress;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD2122A2F6A814916A1AF1ACE99E487AE"><enum>(B)</enum><text>the President;
			 and</text>

			 Corporation.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1570377ADC9C4E179A149592E2A3DF0F"><enum>(2)</enum><header>Contents</header><text>Each
			 report submitted under paragraph (1) shall contain—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="HC0D420C2A8B6440882AA7C025CBE8A31"><enum>(A)</enum><text>such comments and
			 information as the Comptroller General determines necessary to inform Congress
			 of the financial operations and condition of the Corporation;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H200ECE389A2141D7ADE6A6B546C5285F"><enum>(B)</enum><text>any
			 recommendations of the Comptroller General relating to the financial operations
			 and condition of the Corporation; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6F9D97421A83463C97612AC34732AEA1"><enum>(C)</enum><text>a description of
			 any program, expenditure, or other financial transaction or undertaking of the
			 Corporation that was observed during the course of the audit, which, in the
			 opinion of the Comptroller General, has been carried on or made without the
			 authority of law.</text>
							</subparagraph></paragraph></subsection></section><section id="HE2D791779A384425A854C3D39CEF334E"><enum>210.</enum><header>Annual report
			 to Congress</header>
					<subsection id="H4EA0292D54C24AB5B9E21AB25FBC3925"><enum>(a)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 Act, and each year thereafter, the Corporation shall submit an annual report
			 covering the preceding fiscal year to the appropriate committees of
			 Congress.</text>
					</subsection><subsection id="HB07F38CC42D8411DA1C76B0010D5D18B"><enum>(b)</enum><header>Required
			 content</header><text>The report required under subsection (a) shall
			 include—</text>
						<paragraph id="H5C4DA777D0E145E59191E867F62A5DBD"><enum>(1)</enum><text>a
			 comprehensive and detailed report of the operations, activities, financial
			 condition, and accomplishments of the Corporation under this section;
			 and</text>
						</paragraph><paragraph id="H9ACDF2D6F0C54BAFB1F1E03AEF32D15F"><enum>(2)</enum><text>such
			 recommendations or proposals for legislative or administrative action as the
			 Corporation deems appropriate.</text>
						</paragraph></subsection><subsection id="HFFB9128FFE2541B19EA56B826E761E01"><enum>(c)</enum><header>Availability To
			 testify</header><text>The directors, officers, employees, and agents of the
			 Corporation shall be available to testify before the appropriate committees of
			 the Congress with respect to—</text>
						<paragraph id="H7DE4A512EE984CC0A662A8C648924B2A"><enum>(1)</enum><text>the report
			 required under subsection (a);</text>
						</paragraph><paragraph id="H90A8A4A2DC87409BAA0D5C6839451DCC"><enum>(2)</enum><text>the report of any
			 audit made by the Comptroller General under section 209; or</text>
						</paragraph><paragraph id="HD7B9E62D8F074D8C80013FE38D3EFEA9"><enum>(3)</enum><text>any other matter
			 which such committees may determine appropriate.</text>
						</paragraph></subsection></section><section id="H4E501223F2A0447F95D79EFE6386FA9A"><enum>211.</enum><header>Public safety
			 roaming and priority access</header><text display-inline="no-display-inline">The Commission may adopt rules, if necessary
			 in the public interest, to improve the ability of public safety networks to
			 roam onto commercial networks and to gain priority access to commercial
			 networks in an emergency if—</text>
					<paragraph id="HE9C16153A11F42D8B01B7AE5E778CABD"><enum>(1)</enum><text>the public safety
			 entity equipment is technically compatible with the commercial network;</text>
					</paragraph><paragraph id="H95BC2E2A719D4F28B26B76DC90D53520"><enum>(2)</enum><text>the commercial
			 network is reasonably compensated; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE31F7A6113A945C4862991F8E0BC63CC"><enum>(3)</enum><text>such access does
			 not preempt or otherwise terminate or degrade all existing voice conversations
			 or data sessions.</text>
					</paragraph></section><section commented="no" display-inline="no-display-inline" id="H98D6DBC301EF4AC8BED86E299EA733A0"><enum>212.</enum><header>Transitional
			 analysis of public safety network attributes</header>
					<subsection commented="no" display-inline="no-display-inline" id="H8A83B10890214ECCB9FDDAD9AB4ADDD4"><enum>(a)</enum><header>Establishment of
			 evaluation framework</header><text>Not later than 180 days after the date of
			 enactment of this Act, the Director of NIST, in consultation with the Secretary
			 of Homeland Security, the Attorney General, and the Director of the Office of
			 Management and Budget, shall develop an evaluation framework. The development
			 of such an evaluation framework shall be informed by a study commissioned by
			 the Director of NIST and completed by an independent and neutral agent,
			 consultant, or expert, who has—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H2CD88202357E417382EB627567BF2756"><enum>(1)</enum><text>at least 5 years
			 of technical and economic experience in analyzing the costs and effectiveness
			 of communications networks; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCB4329A8FDE5440A81033E172A408F9C"><enum>(2)</enum><text>agreed not to
			 contract or subcontract with the Corporation for at least 3 years from the date
			 such study is completed other than for follow-on and related studies.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HAD9E58DB938F4D49ADC23EA81F75C1A6"><enum>(b)</enum><header>Considerations</header><text>The
			 evaluation framework required to be developed under subsection (a) shall take
			 into consideration the public safety network attributes identified in a report
			 completed by the Visiting Committee on Advanced Technology of NIST. The report
			 required under this subsection shall identify the desired attributes of the
			 nationwide public safety interoperable broadband network to be established
			 under this title, as well as any other attributes the Secretary of Commerce may
			 request.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="H7B547890308C4A449F06DF472215DFA5"><enum>(c)</enum><header>Required
			 evaluations</header><text>The evaluation framework required to be developed
			 under subsection (a) shall evaluate—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H3DE6910D07F74286B93F424EAF53A8F0"><enum>(1)</enum><text>the marginal cost
			 of each public safety network attribute in developing, deploying, and operating
			 the nationwide public safety interoperable broadband network to be established
			 under this title;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA7C9CBA915EB4775A5A427F02F620449"><enum>(2)</enum><text>the benefit of
			 each public safety network attribute to the nationwide public safety
			 interoperable broadband network;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H092EE2D0031441E88E6496AD474DDB3F"><enum>(3)</enum><text>the economic
			 feasibility of requiring that each public safety attribute be required as part
			 of the nationwide public safety interoperable broadband network;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8C32B17EA4D3481FB4218FBD5C13CD56"><enum>(4)</enum><text>the resulting
			 competitive vendor supply ecosystem created by each public safety attribute
			 that is a part of the nationwide public safety interoperable broadband network;
			 and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1B8B205F043B4EDCBFA1E907ED035981"><enum>(5)</enum><text>the level of
			 variability in regional requirements for each public safety attribute that is a
			 part of the nationwide public safety interoperable broadband network.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HDA7751E4DC274E65ACBD264E431AD598"><enum>(d)</enum><header>Provision of
			 framework to the Corporation</header><text display-inline="yes-display-inline">The evaluation framework required to be
			 developed under subsection (a) shall be provided to the Board of Directors of
			 the Corporation, and the Corporation shall utilize the findings of such
			 framework to develop a cost-benefit analysis to inform the building,
			 deployment, and operation of the nationwide public safety interoperable
			 broadband network to be established under this title.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="HA56B104CA8524D94B2C852E9A76624A7"><enum>(e)</enum><header>OMB
			 responsibility</header><text>The Director of the Office of Management and
			 Budget, or his designee, as a member of the Board of Directors of the
			 Corporation, shall have the responsibility to ensure that evaluation framework
			 required to be developed under subsection (a) is appropriately utilized by the
			 Corporation.</text>
					</subsection></section><section id="H2F6A788FBE45432ABC1A32A804CDF58C"><enum>213.</enum><header>Prohibition on
			 direct offering of commercial telecommunications service directly to
			 consumers</header>
					<subsection id="H1ECD50B874D04C58A28215907F4CC0D2"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Corporation shall
			 not offer, provide, or market commercial telecommunications or information
			 services directly to consumers.</text>
					</subsection><subsection id="H51C01BFCB2C84C5D9F4BEAE609700DD0"><enum>(b)</enum><header>Rule of
			 construction</header><text display-inline="yes-display-inline">Nothing in this
			 section shall be construed to prohibit the Corporation and a secondary user
			 from entering into a covered leasing agreement pursuant to section
			 208(a)(2)(B). Nothing in this section shall be construed to limit the
			 Corporation from collecting lease fees related to network equipment and
			 infrastructure pursuant to section 208(a)(3).</text>
					</subsection></section><section commented="no" display-inline="no-display-inline" id="H303F66265F36465597B3FC9ED53541F9"><enum>214.</enum><header>Provision of
			 technical assistance</header><text display-inline="no-display-inline">The
			 Commission may provide technical assistance to the Corporation and may take any
			 action necessary to assist the Corporation in effectuating its duties and
			 responsibilities under this subtitle.</text>
				</section></subtitle><subtitle id="H9D4FB8E116DB4AC88B081193047DC9CE"><enum>B</enum><header>Public safety
			 commitments</header>
				<section id="HAB492DB987AB4FAA856C162EE377A285"><enum>221.</enum><header>State and Local
			 Implementation Fund</header>
					<subsection id="H4660211A243443AE84CFC246D165F726"><enum>(a)</enum><header>Establishment</header><text>There
			 is established in the Treasury of the United States a fund to be known as the
			 <quote>State and Local Implementation Fund</quote>.</text>
					</subsection><subsection id="HF76AD6D72C42419BBAB1ACBCB36103D7"><enum>(b)</enum><header>Purpose</header><text>The
			 Assistant Secretary shall establish and administer the grant program under
			 section 222 using the funds deposited in the State and Local Implementation
			 Fund.</text>
					</subsection><subsection id="HC6F460C82E194551AF661956E8ECECC3"><enum>(c)</enum><header>Crediting of
			 receipts</header><text>There shall be deposited into or credited to the State
			 and Local Implementation Fund—</text>
						<paragraph id="H5EDA4794C7D84C75B1033F53B4B02C5D"><enum>(1)</enum><text>any amounts
			 specified in section 401; and</text>
						</paragraph><paragraph id="H51523D48657A4003BD63E814854A23BB"><enum>(2)</enum><text>any amounts
			 borrowed by the Assistant Secretary under subsection (d).</text>
						</paragraph></subsection><subsection id="HA2AC0978E2064B36ABFB431E172EC2CD"><enum>(d)</enum><header>Borrowing
			 authority</header>
						<paragraph id="H9604DCC3134642CA99B6AAE224C99254"><enum>(1)</enum><header>In
			 general</header><text>The Assistant Secretary may borrow from the general fund
			 of the Treasury beginning on October 1, 2011, such sums as may be necessary,
			 but not to exceed $250,000,000, to implement section 222.</text>
						</paragraph><paragraph id="H4C4D5A5CCBCA4CEAA7C44B672AC7DF22"><enum>(2)</enum><header>Reimbursement</header><text>The
			 Assistant Secretary shall reimburse the general fund of the Treasury, without
			 interest, for any amounts borrowed under subparagraph (A) as funds are
			 deposited into the State and Local Implementation Fund.</text>
						</paragraph></subsection></section><section id="HD91D77084A4C4A38B38DEFC12BA09EC8"><enum>222.</enum><header>State and local
			 implementation</header>
					<subsection id="H8B3A39864D3744349AB52202C5DC13F6"><enum>(a)</enum><header>Establishment of
			 State and local implementation grant program</header><text>The Assistant
			 Secretary, in consultation with the Corporation, shall take such action as is
			 necessary to establish a grant program to make grants to States to assist
			 State, regional, tribal, and local jurisdictions to identify, plan, and
			 implement the most efficient and effective way for such jurisdictions to
			 utilize and integrate the infrastructure, equipment, and other architecture
			 associated with the nationwide public safety interoperable broadband network
			 established under subtitle A to satisfy the wireless communications and data
			 services needs of that jurisdiction, including with regards to coverage,
			 siting, and other needs.</text>
					</subsection><subsection id="H59FAD080FE9649A2B88387E32F96A5A0"><enum>(b)</enum><header>Matching
			 requirements; Federal share</header>
						<paragraph id="HA6876B1B6FC140649540399DD55223FE"><enum>(1)</enum><header>In
			 general</header><text>The Federal share of the cost of any activity carried out
			 using a grant under this section may not exceed 80 percent of the eligible
			 costs of carrying out that activity, as determined by the Assistant Secretary,
			 in consultation with the Corporation.</text>
						</paragraph><paragraph id="H070E37D019E4472AB95AB3BD21AA8AE8"><enum>(2)</enum><header>Waiver</header><text>The
			 Assistant Secretary may waive, in whole or in part, the requirements of
			 paragraph (1) for good cause shown if the Assistant Secretary determines that
			 such a waiver is in the public interest.</text>
						</paragraph></subsection><subsection id="HF3DF9F448C7E462F818A1690FC953BE8"><enum>(c)</enum><header>Programmatic
			 requirements</header><text>Not later than 6 months after the establishment of
			 the bylaws of the Corporation pursuant to section 206, the Assistant Secretary,
			 in consultation with the Corporation, shall establish requirements relating to
			 the grant program to be carried out under this section, including the
			 following:</text>
						<paragraph id="HFA449A827A414D408E4AF9BF5D22E586"><enum>(1)</enum><text>Defining eligible
			 costs for purposes of subsection (b)(1).</text>
						</paragraph><paragraph id="H88742E8B0DB847A381B412E13149FC8C"><enum>(2)</enum><text>Determining the
			 scope of eligible activities for grant funding under this section.</text>
						</paragraph><paragraph id="HAA786E594D1F486CA5A5E144E9010813"><enum>(3)</enum><text>Prioritizing
			 grants for activities that ensure coverage in rural as well as urban
			 areas.</text>
						</paragraph></subsection><subsection id="HD675B4F0D7344951A860899C89E9BE45"><enum>(d)</enum><header>Certification
			 and designation of officer or governmental body</header><text>In carrying out
			 the grant program established under this section, the Assistant Secretary shall
			 require each State to certify in its application for grant funds that the State
			 has designated a single officer or governmental body to serve as the
			 coordinator of implementation of the grant funds.</text>
					</subsection></section><section id="HA42EDB08358F46E696E543CA166B4CC4"><enum>223.</enum><header>Public safety
			 wireless communications research and development</header>
					<subsection id="HB0A6F3054588498B88209031CE05E8D7"><enum>(a)</enum><header>NIST directed
			 research and development program</header><text>From amounts made available from
			 the Public Safety Trust Fund established under section 401, the Director of
			 NIST, in consultation with the Commission, the Secretary of Homeland Security,
			 and the National Institute of Justice of the Department of Justice, as
			 appropriate, shall conduct research and assist with the development of
			 standards, technologies, and applications to advance wireless public safety
			 communications.</text>
					</subsection><subsection id="H9ABFE84C05A8448F824587B3A75E2929"><enum>(b)</enum><header>Required
			 activities</header><text>In carrying out the requirement under subsection (a),
			 the Director of NIST, in consultation with the Corporation and the public
			 safety advisory committee established under section 204(b)(1), shall—</text>
						<paragraph id="HDC6CD7B8F2FF4DFDB4C6E1C1C4D0B45D"><enum>(1)</enum><text>document public
			 safety wireless communications technical requirements;</text>
						</paragraph><paragraph id="HF0B0A1C12E7B4192AA9EBE3CEF4EDA89"><enum>(2)</enum><text>accelerate the
			 development of the capability for communications between currently deployed
			 public safety narrowband systems and the nationwide public safety interoperable
			 broadband network to be established under this title;</text>
						</paragraph><paragraph id="HB03EA68747174901B65E88D9BDA42948"><enum>(3)</enum><text>establish a
			 research plan, and direct research, that addresses the wireless communications
			 needs of public safety entities beyond what can be provided by the current
			 generation of broadband technology;</text>
						</paragraph><paragraph id="HD85A99A449BB428197B59BF76912ED6E"><enum>(4)</enum><text>accelerate the
			 development of mission critical voice, including device-to-device
			 <quote>talkaround</quote> capability over broadband networks, public safety
			 prioritization, authentication capabilities, and standard application
			 programing interfaces for the nationwide public safety interoperable broadband
			 network to be established under this title, if necessary and practical;</text>
						</paragraph><paragraph id="HF3193EE2D460410BBADD9206C31ED154"><enum>(5)</enum><text>accelerate the
			 development of communications technology and equipment that can facilitate the
			 eventual migration of public safety narrowband communications to the nationwide
			 public safety interoperable broadband network to be established under this
			 title; and</text>
						</paragraph><paragraph id="HC9C96AC9A82F46AFAEA6A89222E301D5"><enum>(6)</enum><text>convene working
			 groups of relevant government and commercial parties to achieve the
			 requirements in paragraphs (1) through (5).</text>
						</paragraph></subsection></section><section id="HE0C24AAFD1CE4F8C823E2813DC9ADB34"><enum>224.</enum><header>Advanced
			 information and communications technology research</header>
					<subsection id="H6D1C26A6DB70412DB1BBB9BD23DFC50A"><enum>(a)</enum><header>Advanced
			 communications services for all Americans</header><text>The Director of NIST
			 shall continue to support research and support standards development in
			 advanced information and communications technologies focused on enhancing or
			 facilitating the availability and affordability of advanced communications
			 services to all Americans, in order to implement the Institute's
			 responsibilities under section 2(c)(12) of the National Institute of Standards
			 and Technology Act (15 U.S.C. 272(c)(12)). The Director of NIST shall support
			 intramural research and cooperative research with institutions of higher
			 education (as defined in section 101(a) of the Higher Education Act of 1965 (20
			 U.S.C. 1001(a))) and industry.</text>
					</subsection><subsection commented="no" id="HC16E25A487EB420D8E715A66D8510600"><enum>(b)</enum><header>DARPA
			 research</header>
						<paragraph commented="no" id="HD150D8F89D2C415DA12DE1E0419C35A6"><enum>(1)</enum><header>In
			 general</header><text>From amounts made available from the Public Safety Trust
			 Fund established under section 401, the Defense Advanced Research Projects
			 Agency (referred to in this subsection as <term>DARPA</term>) shall conduct
			 wireless communications research to develop more secure, reliable, and flexible
			 radio-frequency systems for Federal wireless users. Areas of research to be
			 supported by this subsection include, but are not limited to—</text>
							<subparagraph id="H3B4128A7AC6A4FCFA06F600792018120"><enum>(A)</enum><text>technologies to
			 increase wireless data transmission speeds to enable the next generation of
			 Federal networks;</text>
							</subparagraph><subparagraph id="H9B01EDCBBCC6401C8FE773F578497B37"><enum>(B)</enum><text>spectrum sharing
			 and interference mitigation techniques to enable more efficient uses of
			 wireless spectrum;</text>
							</subparagraph><subparagraph id="H720ABD46E9D14AEC84962A52E893631B"><enum>(C)</enum><text>technologies to
			 allow and foster the reallocation of spectrum, if appropriate, for non-Federal
			 use; and</text>
							</subparagraph><subparagraph id="HFFCA5EE72F0A4C8BB9C71ABF1F9D45F5"><enum>(D)</enum><text>research that
			 fosters the conversion of the Department of Defense’s wireless communications
			 systems, and those of other Federal users, to more advanced or more efficient
			 systems.</text>
							</subparagraph></paragraph><paragraph commented="no" id="H19C7B36D46024534BA286CEA4BE1D3B6"><enum>(2)</enum><header>Cooperation</header><text>In
			 carrying out this subsection, DARPA shall collaborate where appropriate with
			 NTIA, NIST, NSF, and other interested Federal agencies.</text>
						</paragraph><paragraph id="HD2A8D2F1ADA04D1D99089D00100FE9CB"><enum>(3)</enum><header>Limitation on
			 use</header><text>Not more than 5 percent of any amounts made available in a
			 fiscal year from the Public Safety Trust Fund established under section 401 may
			 be used by DARPA to cover the administrative expenses incurred in carrying out
			 this subsection.</text>
						</paragraph><paragraph id="HD6A6B4ADF7A34359AE40704B28D0AF48"><enum>(4)</enum><header>OMB
			 Review</header><text>Amounts appropriated to DARPA under this subsection shall
			 be available upon approval by the Director of the Office of Management and
			 Budget of an implementation plan that has been developed and submitted to the
			 Director by the head of DARPA.</text>
						</paragraph></subsection></section></subtitle></title><title commented="no" id="HAA682F0D415542869F057AFC28345540" level-type="subsequent"><enum>III</enum><header display-inline="yes-display-inline">Spectrum auction authority</header>
			<section commented="no" display-inline="no-display-inline" id="H319A66A168AC4BA890332A5398CFC520"><enum>301.</enum><header display-inline="yes-display-inline">Extension of auction
			 authority</header><text display-inline="no-display-inline">Section 309(j)(11)
			 of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (47
			 U.S.C. 309(j)(11)) is amended by striking <quote>2012</quote> and inserting
			 <quote>2021</quote>.</text>
			</section><section commented="no" display-inline="no-display-inline" id="H8DB04E467FEE430ABE3DC3AAB9FCE7A8" section-type="subsequent-section"><enum>302.</enum><header display-inline="yes-display-inline">Auction of spectrum</header>
				<subsection commented="no" display-inline="no-display-inline" id="HA5AE60E59FCA4566B03E4157D41466F9"><enum>(a)</enum><header display-inline="yes-display-inline">Identification of spectrum</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
			 enactment of this Act, the Assistant Secretary shall identify and make
			 available for immediate reallocation, at a minimum, 15 megahertz of contiguous
			 spectrum at frequencies located between 1675 megahertz and 1710 megahertz,
			 inclusive, minus the geographic exclusion zones, or any amendment thereof,
			 identified in NTIA’s October 2010 report entitled <quote>An Assessment of
			 Near-Term Viability of Accommodating Wireless Broadband Systems in 1675–1710
			 MHz, 1755–1780 MHz, 3500–3650 MHz, and 4200–4220 MHz, 4380–4400 MHz
			 Bands</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H11CE2809E1374CDFB684F3DE0767C77D"><enum>(b)</enum><header display-inline="yes-display-inline">Auction</header><text display-inline="yes-display-inline">Not later than January 31, 2014, the
			 Commission shall conduct the auctions of the following licenses, by commencing
			 the bidding for:</text>
					<paragraph id="HA1A7B17155BD4FCEAC1138DC28575252"><enum>(1)</enum><text>The spectrum
			 between the frequencies of 1915 megahertz and 1920 megahertz, inclusive.</text>
					</paragraph><paragraph id="H583516C5297944909C6D9CB7C0BDFB40"><enum>(2)</enum><text>The spectrum
			 between the frequencies of 1995 megahertz and 2000 megahertz, inclusive.</text>
					</paragraph><paragraph id="H01FB8911D50C425CA53B22F4B62EB67E"><enum>(3)</enum><text>The spectrum
			 between the frequencies of 2020 megahertz and 2025 megahertz, inclusive.</text>
					</paragraph><paragraph id="H9B4C0B94B02D4AA2A61EAA67BA442930"><enum>(4)</enum><text>The spectrum
			 between the frequencies of 2155 megahertz and 2175 megahertz, inclusive.</text>
					</paragraph><paragraph id="H4EF75ECA4AF74695A347C5F3C744EFB5"><enum>(5)</enum><text>The spectrum
			 between the frequencies of 2175 megahertz and 2180 megahertz, inclusive.</text>
					</paragraph><paragraph commented="no" id="H25A39CFA5EA144578E79F860D6919EAD"><enum>(6)</enum><text>The spectrum
			 between the frequencies of 1755 megahertz and 1850 megahertz, inclusive.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1D34138319144AB4B958799C31ABAB67"><enum>(7)</enum><text display-inline="yes-display-inline">The spectrum identified pursuant to
			 subsection (a).</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H0E33E07613854B899DDCD95319047457"><enum>(c)</enum><header>Auction
			 organization</header><text>The Commission may, if technically feasible and
			 consistent with the public interest, combine the spectrum identified in
			 paragraphs (4), (5), and the portion of paragraph (6) between the frequencies
			 of 1755 megahertz and 1780 megahertz, inclusive, of subsection (b) in an
			 auction of licenses for paired spectrum blocks.</text>
				</subsection><subsection id="H8DFA4C5646584132A022BA26A43FC613"><enum>(d)</enum><header>Further
			 reallocation of certain other spectrum</header>
					<paragraph id="HF5FA9D98CF244E95A1F6777B10CCD73B"><enum>(1)</enum><header>Covered
			 spectrum</header><text>For purposes of this subsection, the term <quote>covered
			 spectrum</quote> means the portion of the electromagnetic spectrum between the
			 frequencies of 3550 to 3650 megahertz, inclusive, minus the geographic
			 exclusion zones, or any amendment thereof, identified in NTIA’s October 2010
			 report entitled <quote>An Assessment of Near-Term Viability of Accommodating
			 Wireless Broadband Systems in 1675–1710 MHz, 1755–1780 MHz, 3550–3650 MHz, and
			 4200–4220 MHz, 4380–4400 MHz Bands</quote>.</text>
					</paragraph><paragraph id="H3B5C8D778BAD4FF38389ADC19026ED43"><enum>(2)</enum><header>In
			 general</header><text>Consistent with requirements of section 309(j) of the
			 Communications Act of 1934, the Commission shall reallocate covered spectrum
			 for assignment by competitive bidding unless the President of the United States
			 determines that—</text>
						<subparagraph id="H0C1F19E9D8C146BE82155AFE1DA94068"><enum>(A)</enum><text>such spectrum
			 cannot be reallocated due to the need to protect incumbent Federal systems from
			 interference; or</text>
						</subparagraph><subparagraph id="H08C9B4A83FB94B00999C288A1EDB72F7"><enum>(B)</enum><text>allocation of
			 other spectrum—</text>
							<clause id="HE0C2B7F9A2AF451DA949EAD632BF18B1"><enum>(i)</enum><text>better serves the
			 public interest, convenience, and necessity; and</text>
							</clause><clause id="H443003B1927D4DFEAE07E2772F8CB55B"><enum>(ii)</enum><text>can
			 reasonably be expected to produce receipts comparable to what the covered
			 spectrum might auction for without the geographic exclusion zones.</text>
							</clause></subparagraph></paragraph><paragraph id="HF20C4D41D34F4EECA8E18A5CCE531175"><enum>(3)</enum><header>Actions required
			 if covered spectrum cannot be reallocated</header>
						<subparagraph id="H865281C8DEB7416CAE138300FC11540B"><enum>(A)</enum><header>In
			 general</header><text>If the President makes a determination under paragraph
			 (2) that the covered spectrum cannot be reallocated, then the President shall,
			 within 1 year after the date of such determination—</text>
							<clause id="HA0BA9956F10A49648DEBDCEA2069EA8F"><enum>(i)</enum><text>identify
			 alternative bands of frequencies totaling more than 20 megahertz and no more
			 than 100 megahertz of spectrum used primarily by Federal agencies that satisfy
			 the requirements of clauses (i) and (ii) of paragraph (2)(B);</text>
							</clause><clause id="H28E31D7E64EC417B8CDFAE566B2D7578"><enum>(ii)</enum><text>report to the
			 appropriate committees of Congress and the Commission an identification of such
			 alternative spectrum for assignment by competitive bidding; and</text>
							</clause><clause id="HD79245FA938C44689E5F72F7704311C2"><enum>(iii)</enum><text>make such
			 alternative spectrum for assignment immediately available for
			 reallocation.</text>
							</clause></subparagraph><subparagraph id="H398446858D644D2FA01F0DCE68FAD80A"><enum>(B)</enum><header>Auction</header><text>If
			 the President makes a determination under paragraph (2) that the covered
			 spectrum cannot be reallocated, the Commission shall commence the bidding of
			 the alternative spectrum identified pursuant to subparagraph (A) within 3 years
			 of the date of enactment of this Act.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H953FEE3E7D164E7F9F5431CF63C5F5EA"><enum>(4)</enum><header>Actions required
			 if covered spectrum can be reallocated</header><text>If the President does not
			 make a determination under paragraph (1) that the covered spectrum cannot be
			 reallocated, the Commission shall commence the competitive bidding for the
			 covered spectrum within 3 years of the date of enactment of this Act.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HDB585741D0354166B9D17FE6E4815614"><enum>(e)</enum><header display-inline="yes-display-inline">Proceeds</header><text display-inline="yes-display-inline">Notwithstanding section 309(j)(8)(A) of the
			 Communications Act of 1934, and except as provided in subparagraphs (B), (C),
			 and (D) of such section 309(j)(8), all proceeds (including deposits and up
			 front payments from successful bidders) from the auctions to be carried out
			 pursuant to subsections (b) and (d) shall be deposited with the Public Safety
			 Trust Fund established under section 401.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HED2301CB5E23474FA378A04EF098B987"><enum>(f)</enum><header>Amendments To
			 design requirements related to competitive bidding</header><text>Section 309(j)
			 of the Communications Act of 1934 (47 U.S.C. 309(j)) is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="H73CEB2AF209544718453AF0AF9E6ECBC"><enum>(1)</enum><text>in paragraph
			 (3)—</text>
						<subparagraph id="H3B7F714851D74723B231BAF867CD4AC7"><enum>(A)</enum><text>in subparagraph
			 (E)(ii), by striking <quote>; and</quote> and inserting a semicolon;</text>
						</subparagraph><subparagraph id="H154D75A7733C43A0816902C05666A4FB"><enum>(B)</enum><text>in subparagraph
			 (F), by striking the period at the end and inserting a semicolon; and</text>
						</subparagraph><subparagraph id="H6E93BF30C1454EE19ED7265CC2E24ED5"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
							<quoted-block display-inline="no-display-inline" id="HE899CF73FAF349C2ADBD169B81232CFD" style="OLC">
								<subparagraph id="HB5EA3DD856FE4300BF00DFA89E4904F1"><enum>(G)</enum><text>ensuring that
				there is an adequate opportunity for applicants to obtain licenses covering
				both large and small geographic areas, as such areas are determined by the
				Commission.</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="HBBEA75C767F1496ABAC71592CEA6D819"><enum>(2)</enum><text>by amending clause
			 (i) of the second sentence of paragraph (8)(C) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="HFD4492EC26A34F7DADA0D9A7893C66F7" style="OLC">
							<clause id="HF5F1FAB98F93448BB650F2451110E2E6"><enum>(i)</enum><text>the
				deposits—</text>
								<subclause id="HEEAA99FFB4EA4D77A606F8ADCC4738E0"><enum>(I)</enum><text>of successful
				bidders of any auction conducted pursuant to subparagraph (F) or to section 302
				of the <short-title>Public Safety Spectrum and Wireless
				Innovation Act</short-title> shall be paid to the Public Safety Trust Fund
				established under section 401 of such Act; and</text>
								</subclause><subclause id="H16FE1F21604745C98B409672505B8FF6"><enum>(II)</enum><text>of successful
				bidders of any other auction shall be paid to the
				Treasury;</text>
								</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H6165F7F0617244A5AFD6F80A7E975AB4"><enum>303.</enum><header display-inline="yes-display-inline">Incentive auction authority</header>
				<subsection commented="no" display-inline="no-display-inline" id="H5C66D68CEA66442EB74653EEA3E7815C"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Paragraph (8) of section 309(j) of the
			 <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (47 U.S.C.
			 309(j)) is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="HA657C49518894FCFBE69DC62F1386E26"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking
			 <quote>(B), (D), and (E),</quote> and inserting <quote>(B), (D), (E), and
			 (F),</quote>; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF0201A35782240499ACA2A9B3ACE18DF"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="HDC1C8A335CC64494811699E4440406FF" style="OLC">
							<subparagraph commented="no" display-inline="no-display-inline" id="H6542B410E96A410ABC6402A6A24BE699"><enum>(F)</enum><header display-inline="yes-display-inline">Incentive auction authority</header>
								<clause commented="no" display-inline="no-display-inline" id="H21DFE286B3AE4FE5A258E87AB72CE8AA"><enum>(i)</enum><header display-inline="yes-display-inline">Authority</header><text>Notwithstanding any
				other provision of law, if the Commission determines that it is consistent with
				the public interest in utilization of the spectrum for a licensee to relinquish
				voluntarily some or all of its licensed spectrum usage rights in order to
				permit the assignment of new initial licenses through a competitive bidding
				process subject to new service rules, or the designation of new spectrum for
				unlicensed use, the Commission may disburse to that licensee a portion of any
				auction proceeds that the Commission determines, in its discretion, are
				attributable to the licensee’s relinquished spectrum usage rights, provided
				that television broadcast stations required to be carried pursuant to sections
				338, 614, or 615 that voluntarily elect to share a channel shall retain the
				rights to carriage set forth in such sections and the rules of the Commission,
				as such rights apply to such station at its shared location.</text>
								</clause><clause id="HC4A8C8997EE74926B6B25818A173809F"><enum>(ii)</enum><header>Limitation</header><text>The
				Commission may not conduct more than one incentive auction of frequencies
				licensed to television stations pursuant to the provisions of section 303 of
				this Act.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="H4BEA689A20EE4B9AB42BCAED7320D065"><enum>(iii)</enum><header>Prohibition</header>
									<subclause commented="no" display-inline="no-display-inline" id="H8425DB5F83F24E4289FA3DEE76CE5908"><enum>(I)</enum><header>In
				general</header><text>The Commission may not reclaim spectrum licensed on a
				primary basis to a television broadcast station, directly or indirectly, on an
				involuntary basis for purposes of providing spectrum to carry out an incentive
				auction under this subparagraph.</text>
									</subclause><subclause id="HB1E0E0D162E245D3A716639AA03110B0"><enum>(II)</enum><header>Modification or
				revocation</header><text display-inline="yes-display-inline">Notwithstanding
				the provisions in sections 303 and 304, the Commission shall have no authority
				to modify or revoke a license or take any action if the effect of such
				modification, revocation, or other action is to compel a licensee to
				participate in an incentive auction as authorized in this section or otherwise
				make frequencies available for such an auction.</text>
									</subclause><subclause id="H79A8A290FEB442FCB880D3581AED14A5"><enum>(III)</enum><header>Repacking
				permitted</header><text>The Commission may reassign the frequency which a
				television broadcast station licensee is permitted to utilize, or a portion
				thereof in accordance with the provisions of this section, only if such
				reassignment—</text>
										<item id="HAE5E633BD83F45D399291CEB2BB67A1E"><enum>(aa)</enum><text>consists of a 6
				MHz channel, located between channels 14 and 50, inclusive, in the same
				geographic market and with the same city of license, to each such licensee,
				and</text>
										</item><item id="H1BC269E9F6584F10BB5917B2F31C3D34"><enum>(bb)</enum><text>preserves such
				licensee’s—</text>
											<subitem id="H4EF167BEE96C4812AE2A05A404FE16C1"><enum>(AA)</enum><text>signal power
				level;</text>
											</subitem><subitem id="H163E0D31C1714E4EAA47810707AA3988"><enum>(BB)</enum><text>tower height or
				transmission architecture; and</text>
											</subitem><subitem id="H86399DCB1020451BB7B06B19FE14E852"><enum>(CC)</enum><text>interference
				levels with respect to such licensee’s signal.</text>
											</subitem></item></subclause><subclause id="HC8C1ED54AEAC4F8F996B042F9799780E"><enum>(IV)</enum><header>Low-power
				television</header>
										<item id="H5E87E217A1D24A7B86B4BA699569C063"><enum>(aa)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Commission may
				not reclaim spectrum licensed to a low-power television licensee, directly or
				indirectly, on an involuntary basis, unless the Commission finds the low-power
				television licensee a replacement channel with similar population coverage in
				the UHF television band of frequencies.</text>
										</item><item id="HBCA9995703BF4029A64BED02612AA181"><enum>(bb)</enum><header>Exception</header><text display-inline="yes-display-inline">If the Commission or the licensee cannot
				locate a suitable channel within the UHF band, after an explanation to the
				licensee showing the basis for the determination that no channel is available,
				the Commission shall—</text>
											<subitem id="HE7AF9B59B44C40BAAEADBBCE29D28C57"><enum>(AA)</enum><text display-inline="yes-display-inline">collocate multiple low-power television
				licensees in a channel in the UHF band, by using channel sharing, with each
				licensee assigned half of the total bandwidth; or</text>
											</subitem><subitem id="H3A826BE1AC0C4A1CB6D0F94CBBE528A6"><enum>(BB)</enum><text display-inline="yes-display-inline">if no space exists for collocation of
				low-power television licensees in the UHF band as described in item (aa),
				assign a low-power television licensee a full channel between channels seven
				and 13, inclusive, in the VHF band.</text>
											</subitem></item></subclause><subclause id="HF0458F246B304BE0903B5068C5F650E7"><enum>(V)</enum><header>Prohibition</header><text>The
				Commission may not require any television station licensee involuntarily to
				collocate its facilities with the facilities of any other television broadcast
				station licensee in order to transmit on the same frequency.</text>
									</subclause><subclause id="H4A41F550E41A46658572CAEC6D1A3F13"><enum>(VI)</enum><header>Collocation
				permitted</header><text>Notwithstanding the requirement of subclause (III)(aa)
				that a frequency reassignment must consist of a 6 MHz channel, in any given
				market any 2 television broadcast station licensees shall be permitted to
				collocate their facilities in order to transmit on the same frequency.</text>
									</subclause><subclause id="H9F902130003D411689B6791E6E881BCF"><enum>(VII)</enum><header>Treatment of
				transmission from collocated facilities</header><text>The transmission of any
				television broadcast stations voluntarily electing to share a 6 MHz channel
				shall each be treated as a <quote>primary channel</quote> for purposes of the
				Commission’s regulations implementing sections 338, 614, and 615 as in effect
				on the date of enactment of this subclause.</text>
									</subclause><subclause id="HDA0F6EDA96B446C1AFABA75BD8A7A855"><enum>(VIII)</enum><header>Reimbursement
				of costs</header><text>Any licensee that is affected, directly or indirectly,
				by the Commission reassigning a licensee to a different channel shall be
				reimbursed for the costs resulting from such reassignment, including—</text>
										<item id="HB3F2113F4BB34416A22579D854DA239D"><enum>(aa)</enum><text>those associated
				with the modification or replacement of broadcast signal transmission
				facilities and equipment, including the cost of temporary facilities;</text>
										</item><item id="HD85269240E274E66A1EE93F08DB96EE7"><enum>(bb)</enum><text>those associated
				with the construction, replacement, or relocation of a broadcast transmission
				tower, to the extent that those costs are related either to the reassignment to
				a different channel that a licensee is authorized to utilize, or to mitigate
				interference resulting from the reassignment of another licensee;</text>
										</item><item id="HE13A4781EE7D49098D7AC2CD47137E3B"><enum>(cc)</enum><text>those associated
				with the upgrade, replacement, or relocation of translator or booster stations
				affiliated with the relevant full-power licensee;</text>
										</item><item id="H230CB5D2057F4B83B257935CEC58B62E"><enum>(dd)</enum><text>those associated
				with consumer education efforts concerning the effect of a Commission
				reassignment of channels in a designated market area; and</text>
										</item><item id="HAAB72E361C99490E86482760CF5DFBF6"><enum>(ee)</enum><text>any
				other costs directly or indirectly resulting from the reassignment of channels
				in a designated market area.</text>
										</item></subclause><subclause id="H7BF8A9F1A7A74C919CEA436CEE7B3578"><enum>(IX)</enum><header>Unlicensed
				spectrum</header><text>With respect to frequency bands between 54 and 72 MHz,
				76 and 88 MHz, 174 and 216 MHz, 470 and 698 MHz, 84 MHz shall be assigned via a
				competitive bidding process. A portion of the proceeds from the competitive
				bidding of the frequency bands identified in the prior sentence may, if
				consistent with the public interest, be disbursed to other licensees, for the
				purpose of ensuring that unlicensed spectrum remains available in these
				frequency bands, nationwide, and in each local market.</text>
									</subclause></clause><clause id="HAB40CBEF72FD492F8FB2530570DFC9D6"><enum>(iv)</enum><header>Treatment of
				revenues</header><text>Notwithstanding subparagraph (A), and except as provided
				in subparagraphs (B), (C), and (D), all proceeds (including deposits and up
				front payments from successful bidders) from the auction of spectrum under this
				subparagraph shall be deposited with the Public Safety Trust Fund established
				under section 401 of the <short-title>Public Safety
				Spectrum and Wireless Innovation Act</short-title>.</text>
								</clause></subparagraph><subparagraph id="H97D887C969BD4633B55054F774FDCDEB"><enum>(G)</enum><header>Establishment of
				Incentive Auction Relocation Fund</header>
								<clause id="H58ABECE8B1964F08A4FE06C0BC409A31"><enum>(i)</enum><header>In
				general</header><text>There is established in the Treasury of the United States
				a fund to be known as the <quote>Incentive Auction Relocation
				Fund</quote>.</text>
								</clause><clause id="HB09E5AF5678342848F336B001A0AF964"><enum>(ii)</enum><header>Administration</header><text>The
				Assistant Secretary shall administer the Incentive Auction Relocation Fund
				using the amounts deposited pursuant to this section.</text>
								</clause><clause id="H2A3B693621F744A6AF3021967B56C19F"><enum>(iii)</enum><header>Crediting of
				receipts</header><text>There shall be deposited into or credited to the
				Incentive Auction Relocation Fund any amounts specified in section 401 of the
				<short-title>Public Safety Spectrum and Wireless
				Innovation Act</short-title>.</text>
								</clause><clause id="HD00218571AA64EE6A2FE84E5D3FF3F39"><enum>(iv)</enum><header>Availability</header><text>Amounts
				in the Incentive Auction Relocation Fund shall be available to the NTIA for
				use—</text>
									<subclause id="HD663E9D695344B5AA47EF5FE10E4F1C7"><enum>(I)</enum><text>for a period not
				to exceed 18 months following the later of—</text>
										<item id="H8E3AB6DE733C4E2EA90CA5414F31D7F7"><enum>(aa)</enum><text>the
				completion of incentive auction from which such amounts were derived; or</text>
										</item><item id="HD87FEAF27C524786A8569A33396B7084"><enum>(bb)</enum><text>the
				date on which the Commission issues all the new channel assignments pursuant to
				any repacking required under subparagraph (F)(iii)(III); and</text>
										</item></subclause><subclause id="H41F3A03F0B124165BDDA3AAECE3BEE37"><enum>(II)</enum><text>without further
				appropriation.</text>
									</subclause></clause><clause id="H07D6B6757BC74C2ABF99EBBC27642611"><enum>(v)</enum><header>Use of
				funds</header><text>Amounts in the Incentive Auction Relocation Fund may only
				be used by the NTIA, in consultation with the Commission, to cover—</text>
									<subclause id="H436E852AECEA48C4B273DC37E62CB01E"><enum>(I)</enum><text display-inline="yes-display-inline">the costs identified in subparagraph
				(F)(iii)(VIII); and</text>
									</subclause><subclause id="H15C52A94B20F49AFB002CE6C1ECC716E"><enum>(II)</enum><text>the costs
				incurred by multichannel video programming distributors for new equipment,
				installation, and construction related to the carriage of such relocated
				stations or the carriage of stations that voluntarily elect to share a channel,
				but retain their existing rights to carriage pursuant to sections 338, 614, and
				615.</text>
									</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HCC14C69FD8194778BDD31E4EDEE6895B"><enum>(b)</enum><header display-inline="yes-display-inline">Incentive auctions To repurpose certain
			 mobile satellite services spectrum for terrestrial broadband
			 use</header><text>To the extent that the Commission makes available spectrum
			 licenses on some or all of the frequencies between 2000 and 2020 MHz and 2180
			 and 2200 MHz for terrestrial broadband use, such licenses shall be assigned
			 pursuant to the authority provided in section 309(j)(8) of the Communications
			 Act of 1934 (47 U.S.C. 309(j)(8)), including, as appropriate, subparagraph (F)
			 of such section.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H19415DF647D449B0B7BE434138C06035"><enum>(c)</enum><header>Sense of
			 Congress</header><text>It is the sense of Congress that any spectrum identified
			 for auction under this section should be licensed—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="H3AFA18C54B464629B0ADD029E9752357"><enum>(1)</enum><text>on a flexible use
			 basis to the extent technologically feasible; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF41C49C0170D49F48502A81BC25FB808"><enum>(2)</enum><text>consistent with
			 the public interest, convenience, and necessity.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H24431DB906334715A8AB8C3AF95354C9" section-type="subsequent-section"><enum>304.</enum><header display-inline="yes-display-inline">Efficient use of public safety
			 spectrum</header>
				<subsection id="HDE0FF708723E44A483EE9BF65756C68B"><enum>(a)</enum><header>Study and
			 report</header><text>Not later than 180 days after the date of enactment of
			 this Act and not later than every 2 years thereafter, the Commission shall
			 conduct a study and submit a report to the appropriate committees of Congress
			 and to the Corporation on the spectrum used by public safety licensees or for
			 public safety services pursuant to section 337(f) of the Communications Act of
			 1934 (47 U.S.C. 337).</text>
				</subsection><subsection id="HF8843D066C854BE0934B7E011FE749CB"><enum>(b)</enum><header>Requirements</header><text>The
			 report required under subsection (a) shall—</text>
					<paragraph id="H3DF465BA52EA4C5EA4A61FC3188B2DBC"><enum>(1)</enum><text>inventory the
			 spectrum assigned to public safety use; and</text>
					</paragraph><paragraph id="HCAFC39D6129D4BE68E33BA90004683D9"><enum>(2)</enum><text>include—</text>
						<subparagraph id="HDEA4C3AFF8614805AD568F1FCFF94361"><enum>(A)</enum><text>the amount of
			 spectrum allocated to public safety use;</text>
						</subparagraph><subparagraph id="H2F9531A2396B4F568658390E83659A25"><enum>(B)</enum><text>the number of
			 licensees and amount of spectrum assigned to each licensee;</text>
						</subparagraph><subparagraph id="H09486EB89E7549648417D6B3CE490429"><enum>(C)</enum><text>a general
			 description of technologies and systems in each band;</text>
						</subparagraph><subparagraph id="HADF53D0D121544F1935139116328B6DA"><enum>(D)</enum><text>an approximation
			 of network coverage, as appropriate, of major systems (such as an estimation of
			 land mobile radio coverage by population) in major metropolitan areas;
			 and</text>
						</subparagraph><subparagraph id="H96A32387492E4931B5072B41A84664E6"><enum>(E)</enum><text>an approximate
			 number of users of major systems, such as the number of first responders using
			 land mobile radio, in major metro areas;</text>
						</subparagraph></paragraph><paragraph id="HBF13F54436BD4001A555EB0594310AC5"><enum>(3)</enum><text>assess if spectrum
			 is adequate to meet the current and future needs for public safety services;
			 and</text>
					</paragraph><paragraph id="H8A5E532BFF2F4E5E9CE1B67BF4A0DED7"><enum>(4)</enum><text>assess the
			 opportunity for return of any additional spectrum to the Commission for
			 reallocation.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H1445589438C84FC29886B3D923F44697" section-type="subsequent-section"><enum>305.</enum><header display-inline="yes-display-inline">Report on satellite broadband</header><text display-inline="no-display-inline">Not later than 2 years after the date of
			 enactment of this Act, the Comptroller General of the United States shall
			 conduct a study and submit to the appropriate committees of Congress a report
			 on the current and future capabilities of fixed and mobile satellite broadband
			 to assist public safety entities during an emergency.</text>
			</section><section commented="no" display-inline="no-display-inline" id="H5E61309FB45B4025BBF3A2728B2E0A76" section-type="subsequent-section"><enum>306.</enum><header display-inline="yes-display-inline">Federal infrastructure
			 sharing</header><text display-inline="no-display-inline">The Administrator of
			 General Services shall establish rules to allow public safety entities licensed
			 or otherwise permitted to use spectrum allocated to the Public Safety Broadband
			 Corporation to have access to those components of Federal infrastructure
			 appropriate for the construction and maintenance of the nationwide public
			 safety interoperable broadband network to be established under title II.</text>
			</section><section id="H62FAE213732544A182365C604D28C6A5"><enum>307.</enum><header>Report on
			 unlicensed spectrum</header><text display-inline="no-display-inline">Not later
			 than 5 years after the date of enactment of this Act, the Commission shall
			 submit to the appropriate committees of Congress a report on—</text>
				<paragraph id="HB8BF59C18A1844DEBD45846BA4D3A25C"><enum>(1)</enum><text display-inline="yes-display-inline">the status of development of any spectrum
			 designated as unlicensed spectrum by the Commission under this Act; and</text>
				</paragraph><paragraph id="HC2A15407CB9F4B148C74EC25B7629E73"><enum>(2)</enum><text>the use of any
			 unlicensed spectrum described in paragraph (1).</text>
				</paragraph></section></title><title id="H03E1B71E3E2848C8A35DA3D414300B1D"><enum>IV</enum><header>Public Safety
			 Trust Fund</header>
			<section id="HE61E9711B5114C6A99A5EABAED458B05"><enum>401.</enum><header>Public Safety
			 Trust Fund</header>
				<subsection id="H01DC172600904B82B2D652AE659361D2"><enum>(a)</enum><header>Establishment of
			 Public Safety Trust Fund</header>
					<paragraph id="H57412079327E47A6B4C1AED07A1210E2"><enum>(1)</enum><header>In
			 general</header><text>There is established in the Treasury of the United States
			 a trust fund to be known as the <quote>Public Safety Trust Fund</quote>.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H22054C97AF9849BCA60C473693239129"><enum>(2)</enum><header>Crediting of
			 receipts</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="H7D4FFED030BC44ED82FA3F0B79C8380C"><enum>(A)</enum><header>In
			 general</header><text>There shall be deposited into or credited to the Public
			 Safety Trust Fund the proceeds from the auction of spectrum carried out
			 pursuant to—</text>
							<clause commented="no" display-inline="no-display-inline" id="H9ECDFE5957DB41EAAE5636734DD1E29F"><enum>(i)</enum><text>section 302 of
			 this Act; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HE82BE6175AA84A21986367DA313FFBD1"><enum>(ii)</enum><text>section
			 309(j)(8)(F) of the Communications Act of 1934, as added by section 303 of this
			 Act.</text>
							</clause></subparagraph><subparagraph id="H920C3ACE3C8145A4B4D9A369D89C48BC"><enum>(B)</enum><header>Availability</header><text>Amounts
			 deposited into or credited to the Public Safety Trust Fund in accordance with
			 subparagraph (A) shall remain available until the end of fiscal year 2021. Upon
			 the expiration of the period described in the prior sentence such amounts shall
			 be deposited in the General Fund of the Treasury, where such amounts shall be
			 dedicated for the sole purpose of deficit reduction.</text>
						</subparagraph></paragraph></subsection><subsection id="H4AAD65A7E9A646F493FF3432A1B90020"><enum>(b)</enum><header>Use of
			 Fund</header><text>Amounts deposited in the Public Safety Trust Fund shall be
			 used in the following manner:</text>
					<paragraph id="H7D3622693A7B4C4CBFB69537F73DB5E2"><enum>(1)</enum><header>Payment of
			 auction incentive</header>
						<subparagraph id="HD9D99822BBA04567A33AD99C99B94CB5"><enum>(A)</enum><header>Required
			 disbursals</header><text>Amounts in the Public Safety Trust Fund shall be used
			 to make any required disbursal of payments to licensees required pursuant
			 to—</text>
							<clause id="H0543315123F14CBE825F251A8950EE83"><enum>(i)</enum><text>clause (i) and
			 subclause (VIII) of clause (iii) of section 309(j)(8)(F) of the Communications
			 Act of 1934; and</text>
							</clause><clause id="H6E877DB08E8C482F96B2DEF06C6CD495"><enum>(ii)</enum><text>section 303(b) of
			 this Act.</text>
							</clause></subparagraph><subparagraph id="H0934704CA5D041C2B18CBC651DAF882A"><enum>(B)</enum><header>Notification to
			 Congress</header>
							<clause id="H708D265A186A4707A00F7BBD95324029"><enum>(i)</enum><header>In
			 general</header><text>At least 3 months in advance of any incentive auction
			 conducted pursuant to subparagraph (F) of section 309(j)(8) of the
			 Communications Act of 1934, the Chairman of the Commission, in consultation
			 with the Director of the Office of Management and Budget, shall notify the
			 appropriate committees of Congress—</text>
								<subclause id="HAD7397100CEE4E1981C65882C8F3A1CE"><enum>(I)</enum><text>of the methodology
			 for calculating the disbursal of payments to certain licensees required
			 pursuant to clause (i) and subclause (VIII) of clause (iii) of such
			 subparagraph; and</text>
								</subclause><subclause id="H2B8D1DE1C6BD4B52B3EB104E3D5FF235"><enum>(II)</enum><text>that such
			 methodology considers the value of the spectrum voluntarily relinquished in its
			 current use and the timeliness with which the licensee will clear its use of
			 such spectrum.</text>
								</subclause></clause><clause id="HE5C06823834D42E39CE8BAB43F575D42"><enum>(ii)</enum><header>Definition</header><text>In
			 this clause, the term <quote>appropriate committees of Congress</quote>
			 means—</text>
								<subclause id="H5B2D823168904BE5B45B787FE32748A4"><enum>(I)</enum><text>the Committee on
			 Commerce, Science, and Transportation of the Senate;</text>
								</subclause><subclause id="HCA3AE4A761E74B99A1DEA4EF732BFC84"><enum>(II)</enum><text>the Committee on
			 Appropriations of the Senate;</text>
								</subclause><subclause id="H462C847A1F374B399D7B5A74C46D21EB"><enum>(III)</enum><text>the Committee on
			 Energy and Commerce of the House of Representatives; and</text>
								</subclause><subclause id="H8638598248B146638A4B2C9E322299DF"><enum>(IV)</enum><text>the Committee on
			 Appropriations of the House of Representatives.</text>
								</subclause></clause></subparagraph></paragraph><paragraph id="H9660D5DD64FD41B6BF6F0558B996D97C"><enum>(2)</enum><header>Incentive
			 Auction Relocation Fund</header><text>Not less than 5 percent of the amounts in
			 the Public Safety Trust Fund but not more than $1,500,000,000 shall be
			 deposited in the Incentive Auction Relocation Fund established under section
			 309(j)(8)(G) of the Communications Act of 1934.</text>
					</paragraph><paragraph id="H744D1FEC330C4FCBBF694B2A6B2B3AC1"><enum>(3)</enum><header>State and Local
			 Implementation Fund</header><text>$250,000,000 shall be deposited in the State
			 and Local Implementation Fund established under section 221.</text>
					</paragraph><paragraph id="HB550BC9D85004B28AB1819A4C1283059"><enum>(4)</enum><header>Public Safety
			 Broadband Corporation</header><text>$11,750,000,000 shall deposited with the
			 Public Safety Broadband Corporation established under section 202, of which
			 pursuant to its responsibilities and duties set forth under section 206 to
			 deploy and operate a nationwide public safety interoperable broadband
			 network—</text>
						<subparagraph id="HDE892885051645D6A8825A68056A3788"><enum>(A)</enum><text>not less than
			 $10,500,000,000 shall be made available for any Radio Access Network build out;
			 and</text>
						</subparagraph><subparagraph id="HBB90C7799E514B81AEE2FC52A9EE8BCC"><enum>(B)</enum><text>not less than
			 $1,250,000,000 shall be made available to develop an Evolved Packet
			 Core.</text>
						</subparagraph></paragraph><paragraph id="H4C40BE37C8664ED8A5D8C32D588B31C1"><enum>(5)</enum><header>Public safety
			 research and development</header><text>$100,000,000 per year for each of the
			 fiscal years 2012 through 2016 shall be made available for use by the Director
			 of NIST to carry out the research program established under section 223.</text>
					</paragraph><paragraph id="H4850B73357024DFE81AB076FBEC00C92"><enum>(6)</enum><header>Advanced
			 information and technology research</header><text display-inline="yes-display-inline">$70,000,000 per year for each of the fiscal
			 years 2012 through 2016 shall be made available to carry out the research
			 program established under section 224(b).</text>
					</paragraph><paragraph id="H6D9CEF3572FC40FA84A3FE9BE8CEB032"><enum>(7)</enum><header>Deficit
			 reduction</header><text>Any amounts remaining after the deduction of the
			 amounts required under paragraphs (1) through (6) shall be deposited in the
			 General Fund of the Treasury, where such amounts shall be dedicated for the
			 sole purpose of deficit reduction.</text>
					</paragraph></subsection><subsection id="H2B0D4BF2951544CFBC77D035E5D21978"><enum>(c)</enum><header>Investment</header><text>Amounts
			 in the Public Safety Trust Fund shall be invested in accordance with section
			 9702 of title 31, United States Code, and any interest on, and proceeds from,
			 any such investment shall be credited to, and become a part of, the
			 Fund.</text>
				</subsection></section></title><title id="H5D842973075D4D6FBEEF7F3E312B69C1"><enum>V</enum><header>Spectrum
			 policy</header>
			<subtitle id="HA7ACCDF199DD4A5890123E4E552C4F5E"><enum>A</enum><header>Inventory and
			 planning</header>
				<section id="HF9B0BC27D0CB49C68433BADFA9631B83"><enum>501.</enum><header>Radio spectrum
			 inventory</header>
					<subsection id="HC4FF5758FC6245C5B819475B1762F621"><enum>(a)</enum><header>Spectrum
			 Inventory</header><text display-inline="yes-display-inline">Part I of title III
			 of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (47
			 U.S.C. 301 et seq.) is amended by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H769A0AEB39354E1D8E94D44AD346C17B" style="OLC">
							<section id="HF48DDBC4E80D4D668FE2D26E874E0E9D"><enum>342.</enum><header>Spectrum
				inventory</header>
								<subsection id="H2CCDC765FE5C4B5EAEC7A0D5F74F0072"><enum>(a)</enum><header>Radio spectrum
				inventory</header><text>Not later than 180 days after the date of enactment of
				the <short-title>Public Safety Spectrum and Wireless
				Innovation Act</short-title>, and biennially thereafter, the Commission, in
				consultation with the NTIA and the Office of Science and Technology Policy,
				shall carry out the following activities:</text>
									<paragraph id="HB48B0790D5A44009B603C562C132B681"><enum>(1)</enum><header>Report</header><text>Prepare
				a report that includes an inventory of each radio spectrum band, from 300 MHz
				to 3.5 GHz, at a minimum, managed by each such agency. Except as provided in
				subsection (b), the report shall include—</text>
										<subparagraph id="HC0158B3A316740008E958167F2BB2165"><enum>(A)</enum><text>the licensee or
				government user authorized in the band;</text>
										</subparagraph><subparagraph id="HF32BA7818FF1414F80287EF932908018"><enum>(B)</enum><text>the total spectrum
				authorized for each licensee or government user (in percentage terms and in
				sum) in the band;</text>
										</subparagraph><subparagraph id="H5BB491982C164E189CB6D79EC9C493AC"><enum>(C)</enum><text>the approximate
				number of transmitters, end-user terminals, or receivers, excluding unintended
				radiators, that have been deployed or authorized, for each licensee or
				government user, in the band; and</text>
										</subparagraph><subparagraph id="H8D2F54A2017447FCB8F93E142F95B07F"><enum>(D)</enum><text>if such
				information is available—</text>
											<clause id="H4804F1CCD36E46EEBD79BFDBA72358B8"><enum>(i)</enum><text>the type of
				transmitters, end-user terminals, or receivers, excluding unintended radiators,
				operating in the band and whether they are space-, air-, or
				ground-based;</text>
											</clause><clause id="H7C4CB56579D340548F48CC1AE163F49F"><enum>(ii)</enum><text>the type of
				transmitters, end-user terminals, or receivers, excluding unintended radiators,
				authorized to operate in the band and whether they are space-, air-, or
				ground-based;</text>
											</clause><clause id="HA1BC55803CBB453CBB5D0D2D20B05AC2"><enum>(iii)</enum><text>contour maps or
				other information that illustrate the coverage area, receiver performance, and
				other parameters relevant to an assessment of the availability of spectrum in
				each band;</text>
											</clause><clause id="H4926756AE7984DF89A73A7E0B671DCBA"><enum>(iv)</enum><text>the approximate
				geolocation of base stations or fixed transmitters;</text>
											</clause><clause id="HD532DE5AD5CA405DA70E333BF0BD6B7B"><enum>(v)</enum><text>the approximate
				extent of use, by geography, of each band of frequencies, such as the amount
				and percentage of time of use, number of end-users, or other measures as
				appropriate to the particular band;</text>
											</clause><clause id="HB8E47A395F21416E97FA1848750C69AB"><enum>(vi)</enum><text>the activities,
				capabilities, functions, or missions supported by the transmitters, end-user
				terminals, or receivers; and</text>
											</clause><clause id="H5F3ACB38C68E4AB7863D229527D63B5A"><enum>(vii)</enum><text>the types of
				unlicensed devices authorized to operate in the band.</text>
											</clause></subparagraph></paragraph><paragraph id="H1C44B7981CBE42749021DDBC4D92AD39"><enum>(2)</enum><header>Public
				access</header><text>Create a centralized portal or website utilizing data from
				the Commission and the NTIA to make a centralized inventory of the bands of
				each agency available to the public via an Internet-accessible website.</text>
									</paragraph><paragraph id="H287F4DC153524A419B1EA66CCD620ED2"><enum>(3)</enum><header>Updates</header><text>Make
				all reasonable efforts to maintain and update the information required under
				paragraph (2) no less frequently than quarterly to reflect, at a minimum, any
				transfer or auction of licenses or change in allocation, assignment, or
				authorization.</text>
									</paragraph><paragraph id="HB0B5E8D1C7204A08A4EC71760AD656EB"><enum>(4)</enum><header>FCC to bear
				costs</header><text>Notwithstanding any other provision of law, all costs
				incurred by the Commission and the NTIA in establishing and maintaining the
				centralized inventory and the centralized portal or website shall be borne
				exclusively by the Commission.</text>
									</paragraph><paragraph id="HA1BBA8EC35CE4682A6FB93509B1CB76A"><enum>(5)</enum><header>Paperwork
				Reduction Act exemption</header><text>Any forms prescribed by the Commission
				under this section, and any information-gathering activities of the Commission
				under this section, shall not be subject to the provisions of sections 3507 or
				3512 of title 44, United States Code (44 U.S.C. 3507, 3512).</text>
									</paragraph></subsection><subsection id="H46E97181C9B545B2AE66BFDA85D921CB"><enum>(b)</enum><header>National
				security; classified information</header>
									<paragraph id="HCCB3FA9F17DB4929BA85EE760F9416B6"><enum>(1)</enum><header>In
				general</header><text>If the head of a Federal agency determines that
				disclosure of information required by subsection (a) would be harmful to the
				national security of the United States, the agency shall—</text>
										<subparagraph id="HEF17807E037B4D47B158EEC33B97155A"><enum>(A)</enum><text>notify the NTIA of
				its determination; and</text>
										</subparagraph><subparagraph id="H3B54D37A183F4312868E050BE092AB8C"><enum>(B)</enum><text>provide to the
				NTIA—</text>
											<clause id="H54C1C02D372A4C28AB52FE2C655326DC"><enum>(i)</enum><text>the other publicly
				releasable information required by subsection (a);</text>
											</clause><clause id="H38D7D88381C24D91AF4AA975A2CF4489"><enum>(ii)</enum><text>to the maximum
				extent practicable, a summary description of the information with respect to
				which the determination was made; and</text>
											</clause><clause id="HA9045F1AD8574F599218B9B3F2224FC4"><enum>(iii)</enum><text>an annex
				containing the information with respect to which the determination was
				made.</text>
											</clause></subparagraph></paragraph><paragraph id="H01F1CAD0A43F467FA4CFDE99CF9EEE4C"><enum>(2)</enum><header>Classified
				information</header><text>If the head of a Federal agency determines that any
				information required by subsection (a) is classified in accordance with
				Executive Order 13526 of December 29, 2009, or any successor Executive Order
				establishing or modifying the uniform system for classifying, safeguarding, and
				declassifying national security information, the agency shall—</text>
										<subparagraph id="H3A7B6AF9402F4BA1BD6475E7DC48D14E"><enum>(A)</enum><text>notify the NTIA of
				its determination; and</text>
										</subparagraph><subparagraph id="H2841A350248B409C98D543E7298C44D6"><enum>(B)</enum><text>provide to the
				NTIA—</text>
											<clause id="H4C2F8F8FF20E435294BD4E433B152878"><enum>(i)</enum><text>the information
				required by subsection (a)(1) that is not classified;</text>
											</clause><clause id="H9FCECEF9C5394617B348682CFF151919"><enum>(ii)</enum><text>to the maximum
				extent practicable, a summary description of the information that is
				classified; and</text>
											</clause><clause id="H17E35CFE31D140B6AA87B90F8D065134"><enum>(iii)</enum><text>an annex
				containing the information that is classified.</text>
											</clause></subparagraph></paragraph><paragraph id="H7B8C1C9711F340A28F7DD9690990159D"><enum>(3)</enum><header>Annex
				restriction</header><text>The NTIA shall make an annex described in paragraph
				(1)(B)(iii) or (2)(B)(iii) available to the Commission. Neither the NTIA nor
				the Commission may make any such annex available to the public pursuant to
				subsection (a)(2) or to any unauthorized person through any other means.</text>
									</paragraph></subsection><subsection id="HAEF4ECC48C1C4014A30AE91B82903C46"><enum>(c)</enum><header>Public safety
				nondisclosure</header>
									<paragraph id="H1AF1053A51BE4AE5A40356C3ADED1CAC"><enum>(1)</enum><header>In
				general</header><text>If a licensee of non-Federal spectrum determines that
				public disclosure of certain information held by that licensee and required to
				be included in the report under subsection (a) would reveal information for
				which public disclosure would be detrimental to public safety, or that the
				licensee is otherwise prohibited by law from disclosing, the licensee may
				petition the Commission for a partial or total exemption from inclusion on the
				centralized portal or website under subsection (a)(2) and in the reports
				required under subsection (d).</text>
									</paragraph><paragraph id="H2AA8ADD4EDA344628220D1AC9CF9A47C"><enum>(2)</enum><header>Burden</header><text>A
				licensee seeking an exemption under this subsection bears the burden of
				justifying the exemption and shall provide clear and convincing evidence to
				support the requested exemption.</text>
									</paragraph><paragraph id="H87BF29F3325B4717BF5DB67F3203C9D0"><enum>(3)</enum><header>Information
				required</header><text>If the Commission grants an exemption under this
				subsection, the licensee shall provide to the Commission—</text>
										<subparagraph id="HF1E824A0D7F2405289B4518930CA79C9"><enum>(A)</enum><text>the publicly
				releasable information required by subsection (a)(1) for the inventory;</text>
										</subparagraph><subparagraph id="H498CEC38EE914F81A4C4D2C5E190A9E8"><enum>(B)</enum><text>to the maximum
				extent practicable, a summary description, suitable for public release, of the
				information for which public disclosure would be detrimental to public safety
				or that the licensee is prohibited by law from disclosing; and</text>
										</subparagraph><subparagraph id="HA3C93EF62C614D8FA01181E6BC40D49C"><enum>(C)</enum><text>an annex, under
				appropriate cover, containing the information that the Commission has
				determined should be withheld from public disclosure.</text>
										</subparagraph></paragraph></subsection><subsection id="HE8C554793A154ADC9E1CE906BA04DBB2"><enum>(d)</enum><header>Informing the
				Congress</header>
									<paragraph id="H98EEAF3B97674D148FE7C48607903B21"><enum>(1)</enum><header>In
				general</header><text>Except as provided in paragraph (3), the NTIA and the
				Commission shall submit each report required by subsection (a)(1) to the
				appropriate committees of Congress.</text>
									</paragraph><paragraph id="H08172366D06148028BE46D1F98D81877"><enum>(2)</enum><header>Nondisclosure of
				annexes</header><text>Each such report shall be submitted in unclassified form,
				but may include 1 or more annexes as provided for by subsections
				(b)(1)(B)(iii), (b)(2)(B)(iii), and (c)(3)(C). No Congressional committee may
				make any such annex available to the public or to any unauthorized
				person.</text>
									</paragraph><paragraph id="HC9CDA36404474F019DA14161E30D9FE3"><enum>(3)</enum><header>Classified
				annexes</header><text>If a report includes a classified annex as provided for
				by subsection (b)(2)(B)(iii), the NTIA and the Commission shall—</text>
										<subparagraph id="H4F00939699BE46A78305B17A6CA8DAB6"><enum>(A)</enum><text>submit the
				classified annex only to the appropriate committees of Congress with primary
				oversight jurisdiction for the user agencies or licensees concerned; and</text>
										</subparagraph><subparagraph id="H123CEB1A97E24651865CC2EA218E7683"><enum>(B)</enum><text>provide notice of
				the submission to the other appropriate committees of Congress.</text>
										</subparagraph></paragraph></subsection><subsection id="H989FE37B09804288A9012310AD718F54"><enum>(e)</enum><header>Definitions</header><text>In
				this section:</text>
									<paragraph id="H4B749D4B018A4A2F8854DB49730E2480"><enum>(1)</enum><header>Appropriate
				committees of Congress</header><text>The term <term>appropriate committees of
				Congress</term> means the Committee on Commerce, Science, and Transportation of
				the Senate, the Committee on Energy and Commerce of the House of
				Representatives, and any other congressional committee with primary oversight
				jurisdiction for the user agencies or licensees concerned.</text>
									</paragraph><paragraph id="HB79C7EFAE2F94B3FB4B8E3CAB2AFF9A5"><enum>(2)</enum><header>NTIA</header><text>The
				term <term>NTIA</term> means the National Telecommunications and Information
				Administration.</text>
									</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H4E31CA49948D4A42B3B425721396A167"><enum>(b)</enum><header>Progress
			 report</header><text display-inline="yes-display-inline">Within 180 days after
			 the date of enactment of this title, the Commission and the NTIA shall provide
			 an update as to the status of the inventory and report required by section
			 342(a) of the <act-name parsable-cite="CA34">Communications Act of
			 1934</act-name>, as added by subsection (a), to the appropriate committees of
			 Congress.</text>
					</subsection></section><section id="HD970990D554F46059AECE6BCEB83AC50"><enum>502.</enum><header>Federal
			 spectrum planning</header>
					<subsection id="H91F85931DCC54C6A8F06EAA096597565"><enum>(a)</enum><header>Review of
			 evaluation process</header><text>Not later than 6 months after the date of
			 enactment of this title, the Comptroller General of the United States
			 shall—</text>
						<paragraph id="H9E99ED68D99C483E956410899F83FC41"><enum>(1)</enum><text>conduct a review
			 of the processes that Federal entities utilize to evaluate their spectrum needs
			 and manage their spectrum resources;</text>
						</paragraph><paragraph id="HB950F11DE65E4F98A52654BC8B747D64"><enum>(2)</enum><text>make
			 recommendations on how to improve such processes; and</text>
						</paragraph><paragraph id="HE2A7EC2DB4E54033B6CA461032832788"><enum>(3)</enum><text>submit a written
			 report to the appropriate committees of Congress on the review, analysis, and
			 recommendations made pursuant to paragraphs (1) and (2).</text>
						</paragraph></subsection><subsection id="H2FEE79E0389D4DA5967944E5978A20FA"><enum>(b)</enum><header>Revision of
			 evaluation process</header>
						<paragraph id="H881245EBAE7A4F4CA7D2193DBA11CE64"><enum>(1)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 title, each Federal entity shall establish, update, or revise the process used
			 by such entity to evaluate their proposed spectrum needs, taking into account
			 any applicable recommendations made in the report required under subsection
			 (a).</text>
						</paragraph><paragraph id="HA0754241CD0042CFB95EDB5EE65C41C5"><enum>(2)</enum><header>Required
			 inclusions</header>
							<subparagraph id="HB2D1E8115F444D84BD6D7F9D16E91C72"><enum>(A)</enum><header>Analysis of
			 options</header><text>Each process described under paragraph (1), whether newly
			 established or otherwise revised, shall include an analysis and assessment
			 of—</text>
								<clause id="H63B644F387FC44788A278996C24B9BB9"><enum>(i)</enum><text>the
			 options available to a Federal entity to obtain associated communications
			 services that are the most spectrum-efficient; and</text>
								</clause><clause id="HB53618E5D72F4CDE83469BFEF316BE94"><enum>(ii)</enum><text>the
			 effective alternatives available to such entity that will permit the entity to
			 continue to satisfy the mission requirements of the entity.</text>
								</clause></subparagraph><subparagraph id="HAB4C468B29DD45F6A2BB5CACB23F12B2"><enum>(B)</enum><header>Analysis
			 submitted to NTIA</header><text>The analysis and assessment carried out
			 pursuant to subparagraph (A) shall be submitted by the Federal entity to the
			 NTIA at the same time that the entity seeks certification or recertification,
			 if applicable, of spectrum support from the NTIA pursuant to the requirements
			 of the National Telecommunications and Information Administration Organization
			 Act and OMB Circular A–11.</text>
							</subparagraph></paragraph></subsection><subsection id="H156CEA2FFC7C491AAF8CB9AB6B727D6C"><enum>(c)</enum><header>Spectrum plans
			 of Federal entities</header>
						<paragraph id="H6D541B88B823415685EB99FFBC8A5641"><enum>(1)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 title, and every 2 years thereafter, each Federal entity shall provide an
			 entity-specific strategic spectrum plan to the Assistant Secretary and the
			 Director of the Office of Management and Budget.</text>
						</paragraph><paragraph id="HE8C76F80B77E414DB9BE272AEAE6824B"><enum>(2)</enum><header>Required
			 inclusions</header><text>Each strategic spectrum plan submitted pursuant to
			 paragraph (1) shall include—</text>
							<subparagraph id="HEE4A51839D8341579CEF41C3F2E026C0"><enum>(A)</enum><text>the spectrum
			 requirements of the entity;</text>
							</subparagraph><subparagraph id="H1468AA74D0C84A2EA7A3C1CC8AE1551E"><enum>(B)</enum><text>the planned uses
			 of new technologies or expanded services requiring spectrum over a period of
			 time agreed to by the entity;</text>
							</subparagraph><subparagraph id="H9518C68B17EF4C6BB22250029AD0CD05"><enum>(C)</enum><text>suggested
			 spectrum-efficient approaches to meeting the spectrum requirements identified
			 under subparagraph (A); and</text>
							</subparagraph><subparagraph id="H9B7CBC59BE3845798B8EDB493992EEA7"><enum>(D)</enum><text>progress reports
			 on what the entity is doing to improve its spectrum management.</text>
							</subparagraph></paragraph></subsection><subsection id="H41B00021864644A18EC13385DC77F9F3"><enum>(d)</enum><header>National
			 security; classified information</header>
						<paragraph id="H0E9846B4B90C42DF928D464C07CDB97E"><enum>(1)</enum><header>In
			 general</header><text>If the head of a Federal entity determines that
			 disclosure of information required by subsection (c) would be harmful to the
			 national security of the United States, the entity shall—</text>
							<subparagraph id="HBC084945716C4D4793BD616FC69C0AF6"><enum>(A)</enum><text>notify the NTIA of
			 its determination; and</text>
							</subparagraph><subparagraph id="H3CD84EF010D34F93BEE65A2F21B2F696"><enum>(B)</enum><text>provide to the
			 NTIA—</text>
								<clause id="H2E1DA668D3A84C9A8D9783C9052BA5F2"><enum>(i)</enum><text>the
			 other publicly releasable information required by subsection (c);</text>
								</clause><clause id="H0D459304F07A49D7B0655ACDBABC45C1"><enum>(ii)</enum><text>to
			 the maximum extent practicable, a summary description of the information with
			 respect to which the determination was made; and</text>
								</clause><clause id="HEB8DDAC3FB14411FBFDEB44F6EBCD70B"><enum>(iii)</enum><text>an
			 annex containing the information with respect to which the determination was
			 made.</text>
								</clause></subparagraph></paragraph><paragraph id="H1EE91F924B2F4915B69365B04BB2D4FB"><enum>(2)</enum><header>Classified
			 information</header><text>If the head of a Federal entity determines that any
			 information required by subsection (c) is classified in accordance with
			 Executive Order 13526 of December 29, 2009, or any successor Executive Order
			 establishing or modifying the uniform system for classifying, safeguarding, and
			 declassifying national security information, the entity shall—</text>
							<subparagraph id="H8FAC31C5A7124CFAA7B67CB473505F0B"><enum>(A)</enum><text>notify the NTIA of
			 its determination; and</text>
							</subparagraph><subparagraph id="H96B31B1EAE5E4D6CBEC8D485C9C9AE77"><enum>(B)</enum><text>provide to the
			 NTIA—</text>
								<clause id="HA3B5BBF7677243D4A7E811AE3400DDB2"><enum>(i)</enum><text>the
			 information required by subsection (c) that is not classified;</text>
								</clause><clause id="H0E2AA4F66D024E9FAC35F41976337F37"><enum>(ii)</enum><text>to
			 the maximum extent practicable, a summary description of the information that
			 is classified; and</text>
								</clause><clause id="H2B06C7ABD64841E59D961438E8E6FCEB"><enum>(iii)</enum><text>an
			 annex containing the information that is classified.</text>
								</clause></subparagraph></paragraph><paragraph id="HA66AC3C847CD4E92A2879D8E201480B5"><enum>(3)</enum><header>Annex
			 restriction</header><text>The NTIA shall make an annex described in paragraph
			 (1)(B)(iii) or (2)(B)(iii) available to the Secretary of Commerce and the
			 Director of the Office of Management and Budget. Neither the NTIA, the
			 Secretary of Commerce, nor the Director of the Office of Management and Budget
			 may make any such annex available to the public or to any unauthorized person
			 through any other means.</text>
						</paragraph></subsection><subsection id="H87E8930B3E3E4784BF4DF87938A90966"><enum>(e)</enum><header>Federal
			 Strategic Spectrum Plan</header>
						<paragraph id="HE7D1943F1A724886A5A0ECD063843E9B"><enum>(1)</enum><header>Development and
			 submission</header>
							<subparagraph id="HA626F2AFA89F4D459CFDD5C7608F65D8"><enum>(A)</enum><header>In
			 general</header><text>Not later than 6 months after the receipt of the initial
			 entity-specific strategic spectrum plans required under subsection (c), the
			 Secretary of Commerce shall develop a Federal Strategic Spectrum Plan, in
			 coordination with the Assistant Secretary and the Director of the Office of
			 Management and Budget.</text>
							</subparagraph><subparagraph id="HE08FD44A25824C6AB83194BDF7787228"><enum>(B)</enum><header>Submission to
			 Congress</header><text>Consistent with the requirements set forth in subsection
			 (d)(3), the Secretary of Commerce shall submit the Federal Strategic Spectrum
			 Plan developed under subparagraph (A) to the appropriate committees of
			 Congress.</text>
							</subparagraph><subparagraph id="H285FFCED5D7047D49B109B918E19A7AE"><enum>(C)</enum><header>Nondisclosure of
			 annexes</header><text>The Federal Strategic Spectrum Plan required to be
			 submitted under subparagraph (B) shall be submitted in unclassified form, but
			 shall include, if appropriate, 1 or more annexes as provided for by subsections
			 (d)(1)(B)(iii) and (d)(2)(B)(iii). No Congressional committee may make any such
			 annex available to the public or to any unauthorized person.</text>
							</subparagraph><subparagraph id="HBD019E89E1A2484A8E64989938AAC3D5"><enum>(D)</enum><header>Classified
			 annexes</header><text>If the Federal Strategic Spectrum Plan includes a
			 classified annex as provided for by subsection (d)(2)(B)(iii), the Secretary of
			 Commerce shall—</text>
								<clause id="H655A28295ADF4311A72ED2690371E1CE"><enum>(i)</enum><text>submit the
			 classified annex only to the appropriate committees of Congress with primary
			 oversight jurisdiction for the user entities or licensees concerned; and</text>
								</clause><clause id="HB686ACC09E9446B4B611F8AE918E09A1"><enum>(ii)</enum><text>provide notice of
			 the submission to the other appropriate committees of Congress.</text>
								</clause></subparagraph><subparagraph id="H39BDBC2D8930456BB5CCDF28EAE1976F"><enum>(E)</enum><header>Definition</header><text>In
			 this subsection, the term <quote>appropriate committees of Congress</quote>
			 means the Committee on Commerce, Science, and Transportation of the Senate, the
			 Committee on Energy and Commerce of the House of Representatives, and any other
			 congressional committee with primary oversight jurisdiction for the user entity
			 or licensees concerned.</text>
							</subparagraph></paragraph><paragraph id="H25FAC3A0503344B391C18EFE70B740A3"><enum>(2)</enum><header>Incorporation of
			 entity plans</header><text>The Federal Strategic Spectrum Plan developed under
			 paragraph (1) shall incorporate, consistent with the requirements of subsection
			 (d), the initial entity-specific strategic spectrum plans submitted under
			 subsection (c).</text>
						</paragraph><paragraph id="HD066FA87AFEB4C3785AD5EDE05B5AF64"><enum>(3)</enum><header>Required
			 inclusions</header><text>The Federal Strategic Spectrum Plan developed under
			 paragraph (1) shall include—</text>
							<subparagraph id="H5CA5760C46A64A0F8BBB03E0190C6CCE"><enum>(A)</enum><text>information on how
			 spectrum assigned and used by Federal entities is being used;</text>
							</subparagraph><subparagraph id="H95895B8C4B3B49799DD9724B5888CC87"><enum>(B)</enum><text>opportunities to
			 increase efficient use of infrastructure and spectrum assigned and used by
			 Federal entities;</text>
							</subparagraph><subparagraph id="H26B02ED6D49545ADA8D91C8D6A179026"><enum>(C)</enum><text>an assessment of
			 the future spectrum needs of the Federal Government; and</text>
							</subparagraph><subparagraph id="H1AAF616FA65049519B807E039E70969D"><enum>(D)</enum><text>plans to
			 incorporate such needs in the NTIA’s frequency assignment, equipment
			 certification, and review processes.</text>
							</subparagraph></paragraph><paragraph id="H8496815250D84CED9CF81C6115467E31"><enum>(4)</enum><header>Updates</header><text>The
			 Secretary of Commerce shall revise and update the Federal Strategic Spectrum
			 Plan developed under paragraph (1) accordingly pursuant to the biennial
			 submission of the entity-specific strategic spectrum plans submitted under
			 subsection (c).</text>
						</paragraph></subsection><subsection id="H9EEBB933174E425E9C5468E5067576AE"><enum>(f)</enum><header>National
			 Strategic Spectrum Plan</header>
						<paragraph id="H62E3197D1EDD4899BC8C1FE2F86D6E2B"><enum>(1)</enum><header>In
			 general</header><text>Not later than 2 years after the date of enactment of
			 this title, the NTIA and the Commission, in consultation with other Federal,
			 State, local, and tribal governments and commercial spectrum interests, shall
			 develop a quadrennial National Strategic Spectrum Plan.</text>
						</paragraph><paragraph id="HFE1C0950D5DB4ED39FCDFC0AE083EB90"><enum>(2)</enum><header>Required
			 inclusion</header><text>The National Strategic Spectrum Plan shall include the
			 following:</text>
							<subparagraph id="HB4E781E080B14F218C3AC105487F326A"><enum>(A)</enum><text>The Federal
			 Strategic Spectrum Plan developed under subsection (e).</text>
							</subparagraph><subparagraph id="HE72002635EEA4B33BE16197B5FB08D97"><enum>(B)</enum><text>Long-range
			 spectrum planning of both commercial, State and local government, and Federal
			 Government users.</text>
							</subparagraph><subparagraph id="H6569B2B0B00143C0B50E7B24D8150CE8"><enum>(C)</enum><text>New technologies
			 or expanded services requiring spectrum.</text>
							</subparagraph><subparagraph id="H61954CC0999044AF8CF7B49D7065EB99"><enum>(D)</enum><text>The nature and
			 characteristics of the new radio communication systems required and the nature
			 and characteristics of the spectrum required.</text>
							</subparagraph><subparagraph id="H068DE8DDC9C64056BA64F15EF363E8C7"><enum>(E)</enum><text>Efficient
			 approaches to meeting the future spectrum requirements of all users,
			 including—</text>
								<clause id="HDE6A43D0488D434A8199E11B33BDE977"><enum>(i)</enum><text>requiring certain
			 standards-based technologies that improve spectrum efficiencies;</text>
								</clause><clause id="H2CC79E522FA8407A90F88D8330073A65"><enum>(ii)</enum><text>spectrum sharing
			 and reuse opportunities;</text>
								</clause><clause id="H9DF19E948508424F9026E878BAF608E0"><enum>(iii)</enum><text>possible
			 reallocation; and</text>
								</clause><clause id="HCE7E3687179741C684FD3764288C0C60"><enum>(iv)</enum><text>any
			 other approaches that promote efficient use of spectrum.</text>
								</clause></subparagraph><subparagraph id="H3676BCEA4FF94449A7CEAB57C96231F5"><enum>(F)</enum><text>An evaluation of
			 current auction processes to determine the effectiveness of such processes
			 in—</text>
								<clause id="HDF1681A84E8B43D5BD6977ED9B8031A7"><enum>(i)</enum><text>promoting
			 competition;</text>
								</clause><clause id="H2D64F58CE320442E9413A3A9B0D30E9D"><enum>(ii)</enum><text>improving
			 spectrum use efficiency; and</text>
								</clause><clause id="H7541FEE2E6964C0C9D1D3C8864E90222"><enum>(iii)</enum><text>maximizing the
			 full economic value to customers, industry, and the taxpayer of the
			 spectrum.</text>
								</clause></subparagraph></paragraph></subsection></section></subtitle><subtitle id="H4585FD8A01A441849D034F50EECC38AD"><enum>B</enum><header>Markets</header>
				<section id="HC38096A450DA4E97A713CB51DD986A4F"><enum>511.</enum><header>Promoting
			 secondary spectrum markets</header>
					<subsection id="H51DF9FF066D84E1B8D7A73550D75BCE8"><enum>(a)</enum><header>In
			 general</header><text>Not later than 18 months after the date of enactment of
			 this title, the Commission shall conduct a rulemaking proceeding to determine
			 how to further promote a more robust secondary spectrum market.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="H2780703FE5FA440EB2D00CE2478C5221"><enum>(b)</enum><header>Consideration</header><text>In
			 carrying out the rulemaking required under subsection (a), the Commission shall
			 consider the feasability and value of establishing a national database to
			 collect and disseminate information on secondary spectrum market
			 opportunities.</text>
					</subsection></section><section id="H3F91CEB3BC38407D8D648860891589FB"><enum>512.</enum><header>Unlicensed use
			 in 5 GHz</header>
					<subsection id="H5F4882398DD04344A6E7FDEFD04684C5"><enum>(a)</enum><header>Modification of
			 regulations</header>
						<paragraph id="H9500F8DE052A42AE9D9E2775385FFAC9"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 1 year
			 after the date of enactment of this title, the Commission shall modify part 15
			 of title 47, Code of Federal Regulations, to allow unlicensed devices intended
			 and marketed for indoor use to operate in the 5350–5470 MHz band.</text>
						</paragraph><paragraph id="H073C1803B2954BC3BAA93A354E57F8BF"><enum>(2)</enum><header>Concerns and
			 considerations</header><text display-inline="yes-display-inline">In carrying
			 out the modification requirement set forth under paragraph (1), the Commission
			 shall allow the unlicensed devices described in paragraph (1) to operate in the
			 5350–5470 MHz band, on an indoor basis only, if it—</text>
							<subparagraph id="HB06427F1010641B7AA7210F1E21F46AF"><enum>(A)</enum><text display-inline="yes-display-inline">finds that technical solutions will protect
			 licensed users, including use of existing, modified, or new spectrum sharing
			 technologies and solutions, such as dynamic frequency selection; and</text>
							</subparagraph><subparagraph id="HBAAF4420D5C74D9C936DC0F8D286AD2E"><enum>(B)</enum><text display-inline="yes-display-inline">determines that the primary mission of
			 Federal spectrum users in the 5350–5470 MHz band will not be compromised by the
			 introduction of unlicensed devices in the 5350–5470 MHz band.</text>
							</subparagraph></paragraph></subsection><subsection id="H70280DE68D1C4F9C9ACC61BE8305EE47"><enum>(b)</enum><header>NTIA
			 study</header>
						<paragraph id="H6B4E0C9EA43B414E8691EDEB16ABAC1F"><enum>(1)</enum><header>In
			 general</header><text>Not later than 8 months after the date of enactment of
			 this title, and in consultation with the Commission, the NTIA shall conduct and
			 submit a study as provided in paragraph (2) evaluating known and proposed
			 sharing technologies and the risk to Federal users if unlicensed U–NII devices
			 were allowed to operate indoors in the 5350–5470 MHz band.</text>
						</paragraph><paragraph id="H71E2EDD2BA494C2C91A8987D3C3E85C1"><enum>(2)</enum><header>Submitting
			 study</header><text>The study required by paragraph (1) shall be submitted to
			 the appropriate committees of Congress and the Commission.</text>
						</paragraph></subsection></section><section id="H0DCBF0732AC74F2CB146C796FF63EEFD"><enum>513.</enum><header>Experimental
			 licenses</header><text display-inline="no-display-inline">Not later than 9
			 months after the date of enactment of this title, the Commission shall revise
			 part 5 of chapter I of title 47, Code of Federal Regulations, to—</text>
					<paragraph id="HEA81B00B41BB4E1F963E3500928BCADE"><enum>(1)</enum><text>streamline such
			 regulations to promote greater experimentation;</text>
					</paragraph><paragraph id="HD0B0AF5004EC46A5A779680924DA4123"><enum>(2)</enum><text>broaden
			 opportunities for market trials;</text>
					</paragraph><paragraph id="HE973170FA24E4DA396FD8C2E4DB9E386"><enum>(3)</enum><text>promote
			 advancements in health care;</text>
					</paragraph><paragraph id="H80BCE22E46FC416BBA7F14AA75C08B51"><enum>(4)</enum><text>establish
			 innovation zones; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4381935F1E9442FCBCA8EECE3B13F0DC"><enum>(5)</enum><text>establish a
			 process by which qualified entities, including colleges, universities, public
			 and private companies, and non-profit research organizations, will be permitted
			 to use a broad range of radio frequencies for research and experimentation on a
			 non-interference basis without having to obtain prior authorization from the
			 Commission for the use of specific frequencies.</text>
					</paragraph></section><section commented="no" display-inline="no-display-inline" id="H389A48F33CE142228E333F438666D1F1"><enum>514.</enum><header>Repurposing
			 Federal spectrum for commercial purposes and Federal spectrum sharing</header>
					<subsection commented="no" display-inline="no-display-inline" id="H6C3979DC5B164D32A2425397A670FA51"><enum>(a)</enum><header>Eligible Federal
			 entities</header><text>Section 113(g)(1) of the National Telecommunications and
			 Information Administration Organization Act (47 U.S.C. 923(g)(1)) is amended to
			 read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="H0577BEF3837C444BB8C979F30AA8332F" style="OLC">
							<paragraph commented="no" display-inline="no-display-inline" id="H7020A9CA37B94735B3723F9C1C532D0F"><enum>(1)</enum><header>Eligible Federal
				entities</header><text>Any Federal entity that operates a Federal Government
				station authorized to use a band of frequencies specified in paragraph (2) and
				that incurs relocation costs because of planning for a potential auction of
				spectrum frequencies, a planned auction of spectrum frequencies, or the
				reallocation of spectrum frequencies from Federal use to exclusive non-Federal
				use, or shared Federal and non-Federal use shall receive payment for such costs
				from the Spectrum Relocation Fund, in accordance with section 118 of this Act.
				For purposes of this paragraph, Federal power agencies exempted under
				subsection (c)(4) that choose to relocate from the frequencies identified for
				reallocation pursuant to subsection (a), are eligible to receive payment under
				this
				paragraph.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="H48F8E9A23C324A348EA84C364D5F5A25"><enum>(b)</enum><header>Eligible
			 frequencies</header><text>Section 113(g)(2)(B) of the National
			 Telecommunications and Information Administration Organization Act (47 U.S.C.
			 923(g)(2)(B)) is amended to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="HF8C5607896F64149B58E6D1E7E9B65A2" style="OLC">
							<subparagraph id="H2D2F5F7974DC40019BA7891662FF57CF"><enum>(B)</enum><text>any other band of
				frequencies reallocated from Federal use to non-Federal or shared use, whether
				for licensed or unlicensed use, after January 1, 2003, that is assigned—</text>
								<clause id="H782E4802B7B141A98F7382057BCD15A9"><enum>(i)</enum><text>by
				competitive bidding pursuant to section 309(j) of the Communications Act of
				1934 (47 U.S.C. 309(j)); or</text>
								</clause><clause id="H1656A865E37A47148F8054E12028DE91"><enum>(ii)</enum><text>as a result of an
				Act of Congress or any other administrative or executive
				direction.</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="HCB89CA87786E445C8DB7758FA04EA77D"><enum>(c)</enum><header>Definition of
			 relocation and sharing costs</header><text>Section 113(g)(3) of the National
			 Telecommunications and Information Administration Organization Act (47 U.S.C.
			 923(g)(3)) is amended to read as follows:</text>

				relocation and sharing costs</header><text>For purposes of this subsection, the
				terms <quote>relocation costs</quote> and <quote>sharing costs</quote> mean the
				costs incurred by a Federal entity to plan for a potential or planned auction
				or sharing of spectrum frequencies and to achieve comparable capability of
				systems, regardless of whether that capability is achieved by relocating to a
				new frequency assignment, relocating a Federal Government station to a
				different geographic location, modifying Federal Government equipment to
				mitigate interference or use less spectrum, in terms of bandwidth, geography,
				or time, and thereby permitting spectrum sharing (including sharing among
				relocated Federal entities and incumbents to make spectrum available for
				non-Federal use) or relocation, or by utilizing an alternative technology.
				Comparable capability of systems includes the acquisition of state-of-the art
				replacement systems intended to meet comparable operational scope, which may
				include incidental increases in functionality, including those necessary to
				achieve security, reliability, and resiliency. Such costs include—</text>
								<subparagraph id="HF7B2B30E496344FA9A2C4A6E3110C54A"><enum>(A)</enum><text>the costs of any
				modification or replacement of equipment, spares, associated ancillary
				equipment, software, facilities, operating manuals, training costs, or
				regulations that are attributable to relocation or sharing;</text>
								</subparagraph><subparagraph id="H4761BB84F2154FC89259777AA8DB32FC"><enum>(B)</enum><text>the costs of all
				engineering, equipment, software, site acquisition, and construction costs, as
				well as any legitimate and prudent transaction expense, including term-limited
				Federal civil servant and contractor staff necessary to carry out the
				relocation activities of an eligible Federal entity, and reasonable additional
				costs incurred by the Federal entity that are attributable to relocation or
				sharing, including increased recurring costs associated with the replacement of
				facilities;</text>
								</subparagraph><subparagraph id="H502D5BD4496C4FDFA804DD137851655A"><enum>(C)</enum><text>the costs of
				research, engineering studies, economic analyses, or other expenses reasonably
				incurred in connection with—</text>
									<clause id="HC54F025E1AB8476D888E5E6E9A224144"><enum>(i)</enum><text>calculating the
				estimated relocation costs that are provided to the Commission pursuant to
				paragraph (4) of this subsection, or in calculating the estimated sharing
				costs;</text>
									</clause><clause id="H4C8320CC280741C9941DA544988CF24E"><enum>(ii)</enum><text>determining the
				technical or operational feasibility of relocation to 1 or more potential
				relocation bands; or</text>
									</clause><clause id="HBF3DCB43D4A744FEB1AA216F0641481A"><enum>(iii)</enum><text>planning for or
				managing a relocation or sharing project (including spectrum coordination with
				auction winners) or potential relocation or sharing project;</text>
									</clause></subparagraph><subparagraph id="H6A57078BFD1B4D7E803D0136A1C7C9EC"><enum>(D)</enum><text>the one-time costs
				of any modification of equipment reasonably necessary to accommodate commercial
				use of shared frequencies or, in the case of frequencies reallocated to
				exclusive commercial use, prior to the termination of the Federal entity’s
				primary allocation or protected status, when the eligible frequencies as
				defined in paragraph (2) of this subsection are made available for private
				sector uses by competitive bidding and a Federal entity retains primary
				allocation or protected status in those frequencies for a period of time after
				the completion of the competitive bidding process;</text>
								</subparagraph><subparagraph id="H17CF517DCBCB4243A7311692739D43F0"><enum>(E)</enum><text>the costs
				associated with the accelerated replacement of systems and equipment if such
				acceleration is necessary to ensure the timely relocation of systems to a new
				frequency assignment or the timely accommodation of sharing of Federal
				frequencies; and</text>
								</subparagraph><subparagraph id="H6B2D294FB25B44F7AFA468C73D0588BD"><enum>(F)</enum><text>the costs of the
				use of commercial systems (including systems not utilizing spectrum) to replace
				Federal systems discontinued or relocated pursuant to this Act, including lease
				(including lease of land), subscription, and equipment costs over an
				appropriate period, such as the anticipated life of an equivalent Federal
				system or other period determined by the Director of the Office of Management
				and
				Budget.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="H321C820FB80E4C3596ABB63561315AFA"><enum>(d)</enum><header>Spectrum
			 sharing</header><text>Section 113(g) of the National Telecommunications and
			 Information Administration Organization Act (47 U.S.C. 923(g)) is amended by
			 adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H78580D4500A74027AB9DDE050B68F45B" style="OLC">
							<paragraph id="H1D7349A8F0314394A0CFD6A19BA7D6BC"><enum>(7)</enum><header>Spectrum
				sharing</header><text>A Federal entity is permitted to allow access to its
				frequency assignments by a non-Federal entity upon approval of NTIA, in
				consultation with the Director of the Office of Management and Budget. Such
				non-Federal entities shall comply with all applicable rules of the Commission
				and the NTIA, including any regulations promulgated pursuant to this section.
				Any remuneration associated with such access shall be deposited into the
				Spectrum Relocation Fund established under section 118. A Federal entity that
				incurs costs as a result of such access is eligible for payment from the Fund
				for the purposes specified in paragraph (3) of this section. The revenue
				associated with such access shall be at least 110 percent of the estimated
				Federal
				costs.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="HB076ECAECCF6467891922253AFC6BA31"><enum>(e)</enum><header>Spectrum
			 Relocation Fund</header><text>Section 118 of the National Telecommunications
			 and Information Administration Organization Act (47 U.S.C. 928) is
			 amended—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="HA04F9F7E2FD24DE280FE4311CD559A30"><enum>(1)</enum><text>in subsection (b),
			 by inserting before the period at the end the following: <quote>and any
			 payments made by non-Federal entities for access to Federal spectrum pursuant
			 to section 113(g)(7) (47 U.S.C. 113(g)(7))</quote>;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H613D800F570B49A5906C24EE4805670D"><enum>(2)</enum><text>by amending
			 subsection (c) to read as follows:</text>
							<quoted-block display-inline="no-display-inline" id="HA330121D62BF4DE09B5FB80ED1DB1A6D" style="OLC">
								<subsection id="H8B8BCEAC76FF4ABD814D3A6CA786C653"><enum>(c)</enum><header>Use of
				funds</header>
									<paragraph id="H240914871C18470A9328AD14232AFD44"><enum>(1)</enum><header>Funds from
				auctions</header><text>The amounts in the Fund from auctions of eligible
				frequencies are authorized to be used to pay relocation costs, as such costs
				are defined in section 113(g)(3), of an eligible Federal entity incurring such
				costs with respect to relocation from any eligible frequency.</text>
									</paragraph><paragraph id="H1543F995010F4F5EB7E7ABBDBF5322D5"><enum>(2)</enum><header>Funds from
				payments by non-Federal entities</header><text>The amounts in the Fund from
				payments by non-Federal entities for access to Federal spectrum are authorized
				to be used to pay the sharing costs, as such costs are defined in section
				113(g)(3), of an eligible Federal entity incurring such costs.</text>
									</paragraph><paragraph id="HA1ABD6164BA6463BBA7B1B6F72F8D479"><enum>(3)</enum><header>Transfer of
				funds</header>
										<subparagraph id="HF5E82233A4644B3A8387585BFBC83A2F"><enum>(A)</enum><header>In
				general</header><text>Subject to subparagraph (B), the Director of OMB may
				transfer at any time (including prior to any auction or contemplated auction,
				or sharing initiative) such sums as may be available in the Fund to an eligible
				Federal entity to pay eligible relocation or sharing costs related to
				pre-auction estimates or research, as such costs are described in section
				113(g)(3)(C).</text>
										</subparagraph><subparagraph id="HC5FF1A91ECD54F36B8993B650C5B28FF"><enum>(B)</enum><header>Notification</header><text>No
				funds may be transferred pursuant to subparagraph (A) unless the notification
				provided under subsection (d)(2)(B) of this section includes a certification
				from the Director of OMB that—</text>
											<clause id="H05350E4D03F042E88A4C3077160AF320"><enum>(i)</enum><text>funds transferred
				before an auction will likely allow for a timely relocation, thereby increasing
				net expected auction proceeds by an amount equal to or greater than the time
				value of the amount of funds transferred; and</text>
											</clause><clause id="HBD56CA3D70614DE8A0FC9183FC421CD0"><enum>(ii)</enum><text>the auction is
				intended to occur within 5 years of transfer of funds.</text>
											</clause></subparagraph><subparagraph id="H4929438BDBBD487F994CD6C5E5291AE6"><enum>(C)</enum><header>Applicability</header>
											<clause id="H8D8427C1FCCA4F50AB6DDE8A10F0D8A7"><enum>(i)</enum><header>Prior costs
				incurred</header><text>The Director of OMB may transfer up to $10,000,000 to
				eligible Federal entities for eligible relocation or sharing costs related to
				pre-auction estimates or research, as such costs are described in section
				113(g)(3)(C), for costs incurred prior to the date of the enactment of the
				<short-title>Public Safety Spectrum and Wireless
				Innovation Act</short-title>, but after June 28th, 2010.</text>
											</clause><clause id="H17319CFBCD1C45E3A3361D88E12CD26E"><enum>(ii)</enum><header>Supplement not
				supplant</header><text>Any amounts transferred by the Director of OMB pursuant
				to clause (i) shall be in addition to any amounts that the Director of OMB may
				transfer after the date of the enactment of the
				<short-title>Public Safety Spectrum and Wireless
				Innovation
				Act</short-title>.</text>
											</clause></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>

				payment of the relocation and sharing costs that are payable from the Fund
				shall revert to and be deposited in the General Fund of the Treasury not later
				than 8 years after the date of the deposit of such proceeds to the Fund, unless
				within 60 days in advance of the reversion of such funds, the Director of OMB,
				in consultation with the Assistant Secretary for Communications and
				Information, notifies the appropriate committees of Congress that such funds
				are needed to complete or to implement current or future relocations or sharing
				initiatives.</text>
										</subparagraph><subparagraph id="H2F08024D18184807B728D716ADD50E2C"><enum>(B)</enum><header>Definition</header><text>In
				this paragraph, the term <quote>appropriate committees of Congress</quote>
				means—</text>
											<clause id="HE34E5AE2D1E944B9982FA219AAE7949C"><enum>(i)</enum><text>the Committee on
				Appropriations of the Senate;</text>
											</clause><clause id="H291181E1485F47E7B315B4C1DA0B09C4"><enum>(ii)</enum><text>the Committee on
				Commerce, Science, and Transportation of the Senate;</text>
											</clause><clause id="H7B48276E2165470A8B31B21E137D3D25"><enum>(iii)</enum><text>the Committee on

								<subsection id="HED4AAE51B8774812A100D0456CC6A56F"><enum>(f)</enum><header>Additional
				payments from the Fund</header><text>Notwithstanding subsections (c) through
				(e), after the date of the enactment of the <short-title>Public Safety Spectrum and Wireless Innovation
				Act</short-title>, and following the credit of any amounts specified in
				subsection (b), there are hereby appropriated from the Fund and available to
				the Director of the OMB up to 10 percent of the amounts deposited in the Fund
				from the auction of licenses for frequencies of spectrum vacated by Federal
				entities, or up to 10 percent of the amounts deposited in the Fund by
				non-Federal entities for sharing of Federal spectrum. The Director of OMB, in
				consultation with the Assistant Secretary for Communications and Information,
				may use such amounts to pay eligible Federal entities for the purpose of
				encouraging timely access to such spectrum, provided that—</text>
									<paragraph id="H72878B6A433E48E78F829A9A105F3B16"><enum>(1)</enum><text>any such payment
				by the Director of OMB is based on the market value of the spectrum, the
				timeliness with which the licensee cleared its use of such spectrum, and the
				need for such spectrum in order for the Federal entity to conduct its essential
				missions;</text>
									</paragraph><paragraph id="H5A3954A3503B497D80C6E9A6A93E3E74"><enum>(2)</enum><text>any such payment
				by the Director of OMB is used to carry out the purposes specified in
				subparagraphs (A) through (F) of paragraph (3) of subsection 113(g) to achieve
				enhanced capability for those systems affected by reallocation of Federal
				spectrum to commercial use, or by sharing of Federal frequencies with
				non-Federal entities;</text>
									</paragraph><paragraph id="H9236F7A27CDC4C70AD02E7179C6192CF"><enum>(3)</enum><text>the amount
				remaining in the Fund after any such payment by the Director is not less than
				10 percent of the winning bids in the relevant auction, or is not less than 10
				percent of the payments from non-Federal entities in the relevant sharing
				agreement; and</text>
									</paragraph><paragraph id="H6655C65DAA83490E96F2D38B2819EBAF"><enum>(4)</enum><text>any such payment
				by the Director shall not be made until 30 days after the Director has notified
				the Committees on Appropriations and Commerce, Science, and Transportation of
				the Senate, and the Committees on Appropriations and Energy and Commerce of the
				House of
				Representatives.</text>
									</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="H8E89A853B1DA44F3925EE171901D60E5"><enum>(f)</enum><header>Competitive
			 bidding; treatment of revenues</header><text>Subparagraph (D) of section
			 309(j)(8) of the Communications Act of 1934 (47 U.S.C. 309(j)(8)) is amended by
			 inserting <quote>excluding frequencies identified by the Federal Communications
			 Commission to be auctioned in conjunction with eligible frequencies described
			 in section 113(g)(2)</quote> before <quote>shall be deposited</quote>.</text>
					</subsection><subsection id="HE786C158371744B3BB75E59701FC4C0A"><enum>(g)</enum><header>Public
			 disclosure and nondisclosure</header><text>If the head of an executive agency
			 of the Federal Government determines that public disclosure of any information
			 contained in notifications and reports required by sections 113 or 118 of the
			 National Telecommunications and Information Administration Organization Act (47
			 U.S.C. 923 and 928) would reveal classified national security information or
			 other information for which there is a legal basis for nondisclosure and such
			 public disclosure would be detrimental to national security, homeland security,
			 public safety, or jeopardize law enforcement investigations, the head of the
			 executive agency shall notify the NTIA of that determination prior to release
			 of such information. In that event, such classified information shall be
			 included in a separate annex, as needed. These annexes shall be provided to the
			 appropriate subcommittee in accordance with appropriate national security
			 stipulations, but shall not be disclosed to the public or provided to any
			 unauthorized person through any other means.</text>
					</subsection></section><section id="HAC411CDAA0364566A361C6BC77E4D60B"><enum>515.</enum><header>Report on
			 spectrum sharing</header>
					<subsection id="HFAF9619B04764AF1909AA6CA5DD158EC"><enum>(a)</enum><header>Identification
			 of spectrum; report to Congress</header><text>Not later than 1 year after the
			 date of enactment of this Act, the NTIA shall conduct a study and submit a
			 report to the appropriate committees of Congress—</text>
						<paragraph id="HD83FF140B3774DABA76AE27670EA3E59"><enum>(1)</enum><text>that identifies
			 spectrum between 225 MHz and 3700 MHz operated or licensed by a Federal entity
			 that the NTIA, in consultation with the Commission, determines appropriate for
			 sharing with non-government entities or non-Federal government entities,
			 including, after taking into account any spectrum identified by the NTIA in its
			 October 2010 report entitled <quote>An Assessment of the Near-Term Viability of
			 Accommodating Wireless Broadband Systems in the 1675–1710 MHz, 1755–1780 MHz,
			 3500–3650 MHz, and 4200–4220 MHz, 4380–4400 MHz Bands</quote>, the additional
			 100 MHz most likely to be appropriate for wireless broadband operations;
			 and</text>
						</paragraph><paragraph id="H7F4693B33B974FC983C3DD22AF399DE3"><enum>(2)</enum><text>on how Federal
			 entities can utilize dynamic spectrum sharing technologies to allow
			 non-government entities or non-Federal government entities to share
			 underutilized spectrum without interference to the primary usage by the Federal
			 Government of that spectrum, including through use of cognitive radio and
			 sensing technologies and database and geolocation approaches.</text>
						</paragraph></subsection><subsection id="H2B574CF4917F46628BC178494DB747F3"><enum>(b)</enum><header>Considerations</header><text>In
			 carrying out the study and report required under subsection (a), the NTIA
			 should consider—</text>
						<paragraph id="H4535230381544773958090DCA14FC280"><enum>(1)</enum><text>radio systems that
			 are utilized in fixed or predictable geographic locations;</text>
						</paragraph><paragraph id="H5D19F756922845E4881A310EBEA76CE9"><enum>(2)</enum><text>radio systems that
			 are only utilized intermittently at fixed or predictable times;</text>
						</paragraph><paragraph id="HE2057D3357AA444D846CCA1693699A99"><enum>(3)</enum><text>spectrum
			 allocations in which radio systems are currently not deployed; and</text>
						</paragraph><paragraph id="H6531D9C267D44DCB999E6A6CDF70E4A4"><enum>(4)</enum><text>spectrum that is
			 harmonized regionally or globally.</text>
						</paragraph></subsection><subsection id="H0D0A4D18C433459EB0DB73C65E402EBC"><enum>(c)</enum><header>Public
			 consultation and rule changes</header>
						<paragraph id="H69EA1E9894E245EA8337ABDBFC91ECEA"><enum>(1)</enum><header>In
			 general</header><text>Not later than 6 months after the report required under
			 subsection (a) is submitted, the NTIA shall conduct a public consultation and,
			 with the Interdepartment Radio Advisory Committee, develop rules for Federal
			 users to increase spectrum sharing by Federal entities.</text>
						</paragraph><paragraph id="HEAF2CE6E29B94BEDAEB8467C5CD86829"><enum>(2)</enum><header>Considerations</header><text>In
			 carrying out the rulemaking required under paragraph (1), the NTIA shall
			 consider—</text>
							<subparagraph id="H62730B93046B43F3B54590D17B956799"><enum>(A)</enum><text>the findings of
			 the report required under subsection (a); and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAEA785322648453097CFACCE09846F9C"><enum>(B)</enum><text>the
			 recommendations in the Final Report, dated November 8, 2010, issued by the
			 Interference and Dynamic Spectrum Access Subcommittee of the Commerce Spectrum
			 Management Advisory Committee.</text>
							</subparagraph></paragraph></subsection></section></subtitle><subtitle id="H5E3548E06BBE4F4A88FE71E9256570D9"><enum>C</enum><header>Efficiency and
			 management</header>
				<section id="HA5D1F88936614A328FCA5B916AD52FF5"><enum>521.</enum><header>Functional
			 responsibility of the NTIA to ensure efficient use of spectrum</header><text display-inline="no-display-inline">Section 103(b)(2) of the National
			 Telecommunications and Information Administration Organization Act (47 U.S.C.
			 902(b)(2)) is amended—</text>
					<paragraph id="HF3580235BE954BFC866A1FADD92016B1"><enum>(1)</enum><text>by redesignating
			 subparagraphs (B) through (T) as subparagraphs (C) through (U), respectively;
			 and</text>
					</paragraph><paragraph id="H44084C9A948048289759843D781BF191"><enum>(2)</enum><text>by inserting after
			 subparagraph (A) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H85D0F18ACC5749F184AA6806E45E9BF5" style="OLC">
							<subparagraph id="H96B91EEC66CA42D6ABA2BC3B42012C5F"><enum>(B)</enum><text>The responsibility
				to promote the best possible and most efficient use of electromagnetic spectrum
				resources across the Federal Government, subject to and consistent with the
				needs and missions of Federal
				agencies.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section id="HB7C423E48F9F49A99191CECD721F6517"><enum>522.</enum><header>Spectrum
			 efficiency analytic tools</header>
					<subsection id="H39D6C05C7B20427893F8698C3E7CC5B4"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 18
			 months after the date of enactment of this title, the NTIA, in consultation
			 with NIST and the Commission, as appropriate, shall develop analytic tools or
			 metrics for the NTIA and Federal entities to measure the spectrum efficiency of
			 Federal spectrum systems used by such entities.</text>
					</subsection><subsection id="HD08CB914760E48188FAE9DEB03215400"><enum>(b)</enum><header>Required
			 consideration</header><text>In developing the tools or metrics to measure
			 spectrum efficiency pursuant to subsection (a)(1), the NTIA shall consider the
			 conclusions reached in the report entitled <quote>Definitions of Efficiency in
			 Spectrum Use</quote>, authored by the Commerce Spectrum Management Advisory
			 Committee and dated October 1, 2008.</text>
					</subsection></section><section commented="no" display-inline="no-display-inline" id="H64605DA391CC4364A457D75519000C24"><enum>523.</enum><header>Study on
			 receiver performance and spectrum efficiency</header>
					<subsection commented="no" display-inline="no-display-inline" id="H93551306052348E58D61F0CE80712909"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Comptroller
			 General of the United States shall conduct a study to consider efforts to
			 ensure that each transmission system that employs radio spectrum is designed
			 and operated so that reasonable use of adjacent spectrum does not excessively
			 impair the functioning of such system.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="H2D54365CD32047B982420D9B0C66291C"><enum>(b)</enum><header>Required
			 considerations</header><text display-inline="yes-display-inline">At a minimum,
			 the study required under subsection (a) shall consider—</text>
						<paragraph id="HE96C956A1FB54FF39054E57322D50C63"><enum>(1)</enum><text>the value
			 of—</text>
							<subparagraph id="HBCA7367FB4F044BAAFF95E48B711A235"><enum>(A)</enum><text>improving receiver
			 performance as it relates to increasing spectral efficiency;</text>
							</subparagraph><subparagraph id="H8619BE974984412B81C002F794F8DB43"><enum>(B)</enum><text>improving
			 operation of services in adjacent frequencies; and</text>
							</subparagraph><subparagraph id="H1EE5F5CF00C2467DAD43AB10CE19D2C0"><enum>(C)</enum><text>narrowing the
			 guard bands between adjacent spectrum use.</text>
							</subparagraph></paragraph><paragraph id="H20EADB7576544437B74F844D2F5FA44A"><enum>(2)</enum><text>the role of
			 manufacturers, commercial licensees, and government users with respect to their
			 transmission systems and use of adjacent spectrum described in subsection
			 (a);</text>
						</paragraph><paragraph id="H2AD4B4A94561428B813E22D5048CBF85"><enum>(3)</enum><text>the feasibility of
			 industry self-compliance with respect to the design and operational
			 requirements of transmission systems and the reasonable use of adjacent
			 spectrum described in subsection (a); and</text>
						</paragraph><paragraph id="HD84751C27D344F49BC556A82160765B4"><enum>(4)</enum><text>the value of
			 Commission and NTIA action to establish, by rule, technical requirements or
			 standards for non-Federal or Federal use, respectively, with respect to the
			 reasonable use of adjacent spectrum described in subsection (a).</text>
						</paragraph></subsection><subsection id="H0E1845B191484C0D84CD3EC6C9860D39"><enum>(c)</enum><header>Definition</header><text>For
			 purposes of this section, the term <quote>transmission system</quote> means any
			 telecommunications, broadcast, satellite, commercial mobile service, or other
			 communications system that employs radio spectrum.</text>
					</subsection><subsection id="H1D60FA901E954E719345E973FE7F3AA8"><enum>(d)</enum><header>Report</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Comptroller
			 General of the United States shall submit a report to the appropriate
			 committees of Congress on the results of the study required under subsection
			 (a).</text>
					</subsection></section><section id="H94BA2C0BEB2745DEB8FF9A308DCF244C"><enum>524.</enum><header>Frequency
			 assignment</header>
					<subsection id="H2ED5531ABE69469D853B8DBE62077F98"><enum>(a)</enum><header>Examination</header><text display-inline="yes-display-inline">Not later than 6 months after the date of
			 enactment of this title, the NTIA, in consultation with the Interdepartment
			 Radio Advisory Committee, shall—</text>
						<paragraph id="H6D59057979E243D4AB8E5B1D4FB75951"><enum>(1)</enum><text display-inline="yes-display-inline">examine its frequency assignment processes,
			 including the 5-year frequency assignment review program, and</text>
						</paragraph><paragraph id="HF1351DA4BFBA45DE89503FF2239A5B00"><enum>(2)</enum><text display-inline="yes-display-inline">consider best practices to determine if the
			 current approach for collecting and validating data from Federal entities can
			 be streamlined or improved to help ensure that such entities are managing
			 current and future spectrum assignments efficiently.</text>
						</paragraph></subsection><subsection id="HD5269248B16D4467AC8C969D61353A65"><enum>(b)</enum><header>Required
			 considerations</header><text>In carrying out the requirements of subsection
			 (a), the NTIA shall consider—</text>
						<paragraph id="H5038E72F4B034BACB88721732A42CACA"><enum>(1)</enum><text>providing Federal
			 entities with specific guidance or requirements on how to justify to the NTIA
			 that requested spectrum frequency assignments would fulfill an established
			 mission need and that other means of communication are not appropriate or
			 available;</text>
						</paragraph><paragraph id="H3407408588654387B64D211040637D26"><enum>(2)</enum><text>requiring Federal
			 entities to submit documentation, as part of the spectrum frequency assignment
			 process;</text>
						</paragraph><paragraph id="HBD2B3E38E69B47D6916294CF0DD2DA99"><enum>(3)</enum><text>verifying that
			 such entity has completed an analysis to support the use and need of the
			 requested assignment; and</text>
						</paragraph><paragraph id="H3CBAB649D12D4C2CAB1503C0ACF97F18"><enum>(4)</enum><text>requiring managers
			 of spectrum resources at each Federal entity to validate, verify, or attest to
			 the accuracy of spectrum information submitted by their entity to the
			 NTIA.</text>
						</paragraph></subsection></section><section id="H150F259F276A44ADB006A8BA3744D295"><enum>525.</enum><header>Spectrum
			 opportunity cost transparency</header>
					<subsection id="H7888849D4391440D934D80A3710B0170"><enum>(a)</enum><header>Analysis of
			 economic opportunity cost</header>
						<paragraph id="H543281C767C042D79FDFAEF467428243"><enum>(1)</enum><header>Development of
			 framework</header>
							<subparagraph id="HA6F3CB6C163E4A62B677CC82D9BA2254"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 1 year
			 after the date of enactment of this title, the NTIA, in consultation with the
			 Commission and the Director of the Office of Management and Budget, shall
			 develop a framework for determining the annual economic opportunity cost of
			 each specific Federal spectrum band assigned or otherwise allocated for use by
			 Federal entities.</text>
							</subparagraph><subparagraph id="HA1F05E0CDC794FADADF75BB2CBF56263"><enum>(B)</enum><header>Considerations</header><text>In
			 developing the framework required under subparagraph (A), the NTIA shall take
			 into account the spectrum pricing methodologies adopted by other countries
			 which utilize administered incentive pricing of spectrum for government
			 users.</text>
							</subparagraph></paragraph><paragraph id="H2D867E4004484480BB1938C00F6CECF3"><enum>(2)</enum><header>Scope</header><text display-inline="yes-display-inline">The framework developed under paragraph (1)
			 shall cover all federally allocated spectrum bands between 150 MHz and 6000
			 MHz, inclusive.</text>
						</paragraph><paragraph id="HBD15DDD484084352BD789620D7DA8F8E"><enum>(3)</enum><header>Goals</header><text display-inline="yes-display-inline">The goal of the framework developed under
			 paragraph (1) is—</text>
							<subparagraph id="H78295A0EE41E4C45BBE149C34C3F92DF"><enum>(A)</enum><text display-inline="yes-display-inline">to provide Federal entities with a
			 sustained long-term signal of spectrum value to inform the spectrum management
			 decisions of such entities; and</text>
							</subparagraph><subparagraph id="H9E2F0F04E7054493BFC34DC056FE1710"><enum>(B)</enum><text display-inline="yes-display-inline">to provide the public with increased
			 transparency about how Federal entities use a scare physical resource.</text>
							</subparagraph></paragraph><paragraph id="HE9C3C57DAB734C6195A4120FD3A9323D"><enum>(4)</enum><header>Requirements</header><text>The
			 framework developed under paragraph (1) shall—</text>
							<subparagraph id="HC7FF2F60298A42A9B31EB29489251806"><enum>(A)</enum><text>define the term
			 <quote>opportunity cost</quote> as the value of the spectrum, in dollar terms,
			 as if such spectrum were to be reallocated to the highest commercial
			 alternative use that currently does not have access to that spectrum;</text>
							</subparagraph><subparagraph id="H183DFC0E0D9141B5B552C25033A45497"><enum>(B)</enum><text>be updated, on an
			 annual basis, to take into account observed market valuations from spectrum
			 auctions, secondary spectrum trading, and other market indicators of spectrum
			 value;</text>
							</subparagraph><subparagraph id="H4FEC1EA24BD945B686E813CD7DBC2787"><enum>(C)</enum><text>determine the
			 opportunity costs borne by each Federal entity for each spectrum band that is
			 entirely under the control of a single agency; and</text>
							</subparagraph><subparagraph id="H6FC5ECD55D2240F89BEC2AE2960C4F51"><enum>(D)</enum><text>determine the
			 opportunity costs for spectrum assigned or otherwise allocated to Federal
			 entities for both primary use and secondary use.</text>
							</subparagraph></paragraph></subsection><subsection id="HCA83624F5F3240A9A48D311732B48F87"><enum>(b)</enum><header>Report on
			 opportunity costs</header><text>Each Federal entity that has been assigned or
			 otherwise allocated use of a Federal spectrum band shall report, as an
			 off-budget item, the opportunity cost borne by the entity for each spectrum
			 band the entity uses—</text>
						<paragraph id="HDCBE671C800641EFAA4CE771BF78155D"><enum>(1)</enum><text>in the budget of
			 the entity to be included in the budget of the United States Government
			 submitted by the President under section 1105 of title 31, United States Code;
			 and</text>
						</paragraph><paragraph id="HB79435E07D4C4340B848F06BA0320AE1"><enum>(2)</enum><text>in the annual
			 financial statement of the entity required to be filed under section 3515 of
			 title 31, United States Code.</text>
						</paragraph></subsection><subsection id="H206DA46F463E4989A7C631820605FF2A"><enum>(c)</enum><header>Spectrum value
			 analysis</header><text>Not later than 5 years after the date of the enactment
			 of this title, and every 5 years thereafter, each Federal entity that has been
			 assigned or otherwise allocated use of a Federal spectrum band, or otherwise
			 utilizes such spectrum, shall engage in an analysis comparing the opportunity
			 cost of that spectrum, as such cost is determined by the framework developed by
			 the NTIA under subsection (a), to the projected costs of the entity relocating
			 to other government spectrum holdings, co-locating with other government
			 agencies, leasing other non-Federal spectrum, or contracting out for its
			 spectrum activities.</text>
					</subsection><subsection id="H4C71D52EB20843A7BBFC53552B0C2DBC"><enum>(d)</enum><header>Spectrum
			 technology study</header>
						<paragraph id="HDA57D0230BF14705899B5DEA0D3544F0"><enum>(1)</enum><header>In
			 general</header><text>Not later than 18 months after the date of the enactment
			 of this title, and every 5 years thereafter, the Comptroller General of the
			 United States, in consultation with NTIA, shall examine the technologies and
			 equipment used by Federal entities operating on Federal spectrum allocations
			 and determine if such technologies and equipment are the most spectrum
			 efficient available.</text>
						</paragraph><paragraph id="H14C4B23439AA44E88FFB674DC5DA4ED3"><enum>(2)</enum><header>Certain
			 determinations made</header><text>If the results of any study required under
			 paragraph (1) determines that the technologies and equipment of Federal
			 entities operating on Federal spectrum allocations are not the most spectrum
			 efficient available, the Comptroller General shall determine—</text>
							<subparagraph id="H0C655638813B428080691B5B826B47D0"><enum>(A)</enum><text>what the costs
			 would be to upgrade such systems to more up-to-date and readily available
			 systems;</text>
							</subparagraph><subparagraph id="H7CED574FB47D461CB0FF5782D57A32F6"><enum>(B)</enum><text>what benefits
			 would be gained from upgrading, particularly any cost savings or increases in
			 spectrum utilization efficiency; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE24766129B894A3FBEB9D80331B78896"><enum>(C)</enum><text>if there are any
			 possible problems with upgrading to more up-to-date systems.</text>
							</subparagraph></paragraph></subsection></section><section id="H4B1630924BF044BDA7C734048BD720CE"><enum>526.</enum><header>System
			 certification</header><text display-inline="no-display-inline">Not later than 6
			 months after the date of enactment of this title, the Director of the Office of
			 Management and Budget shall update and revise section 33.4 of OMB Circular A–11
			 to reflect the recommendations regarding such Circular made in the Commerce
			 Spectrum Management Advisory Committee Incentive Subcommittee report, adopted
			 January 11, 2011.</text>
				</section><section commented="no" display-inline="no-display-inline" id="HFC52F787259C413E9DE1A11F523C292F"><enum>527.</enum><header>Report to
			 Congress on improving spectrum management</header><text display-inline="no-display-inline">Not later than 3 months after the date of
			 enactment of this title, the NTIA shall submit to the appropriate committees of
			 Congress a report on the status of the NTIA's plan to implement the
			 recommendations contained in the <quote>President’s Memorandum on Improving
			 Spectrum Management for the 21st Century</quote>, 49 Weekly Comp. Pres. Doc.
			 2875, Nov. 29, 2004.</text>
				</section><section id="H977434336406430A84223B702088AB6E"><enum>528.</enum><header>Wireless
			 facilities deployment</header>
					<subsection id="H5547929447464F9391A36064990D06F6"><enum>(a)</enum><header>Facility
			 modifications</header>
						<paragraph id="HEB97AC27BADD423EBFF1693BA51A0ECD"><enum>(1)</enum><header>In
			 general</header><text>Notwithstanding section 704 of the Telecommunications Act
			 of 1996 or any other provision of law, a State or local government may not
			 deny, and shall approve, any eligible facilities request for a modification of
			 an existing wireless tower that does not substantially change the physical
			 dimensions of such tower.</text>
						</paragraph><paragraph id="H0B2CF2463F474EF3A68FC5F56CDA2E27"><enum>(2)</enum><header>Eligible
			 facilities request</header><text>For purposes this subsection, the term
			 <quote>eligible facilities request</quote> means any request for modification
			 of an existing wireless tower that involves—</text>
							<subparagraph id="H5BE698DA921F4C76B01D2DDB5E5F18AB"><enum>(A)</enum><text>collocation of new
			 transmission equipment;</text>
							</subparagraph><subparagraph id="H0F0B76C12BAD4BF498B643D07D56C5B2"><enum>(B)</enum><text>removal of
			 transmission equipment; and</text>
							</subparagraph><subparagraph id="H3B828F3406884530A109CFC4295F4AC8"><enum>(C)</enum><text>replacement of
			 transmission equipment.</text>
							</subparagraph></paragraph></subsection><subsection id="H18103B0C46EF4949922C7854C7040D00"><enum>(b)</enum><header>Federal
			 easements and rights-of-Way</header>
						<paragraph id="H29B2C12EEADF470CB91786C30D5E2386"><enum>(1)</enum><header>Grant</header><text>If
			 an executive agency, a State, a political subdivision or agency of a State, or
			 a person, firm, or organization applies for the grant of an easement or
			 rights-of-way to, in, over, or on a building owned by the Federal Government
			 for the right to install, construct, and maintain wireless service antenna
			 structures and equipment, and backhaul transmission, the executive agency
			 having control of the building may grant to the applicant, on behalf of the
			 Federal Government, an easement or rights-of-way to perform such installation,
			 construction, and maintenance.</text>
						</paragraph><paragraph id="HDB4F33C3D8F54C4082525118D308ED09"><enum>(2)</enum><header>Application</header><text>The
			 Administrator of the General Services Administration shall develop a common
			 form for rights-of-way applications required under paragraph (1) for all
			 executive agencies that shall be used by applicants with respect to the
			 buildings or property of each such agency.</text>
						</paragraph><paragraph id="H6B0E96568FB2463683E98EE5746D0EA5"><enum>(3)</enum><header>Fee</header>
							<subparagraph id="H133876AFF3C54939AB7C9FC89A6F6C19"><enum>(A)</enum><header>In
			 general</header><text>Notwithstanding any other provision of law, in making a
			 grant of an easement or rights-of-way pursuant to paragraph (1), the
			 Administrator of the General Services Administration shall establish a fee for
			 the award of such grant that is based on direct cost recovery.</text>
							</subparagraph><subparagraph id="H66D67D19D9B3416C99276E69EF0265AB"><enum>(B)</enum><header>Exceptions</header><text>The
			 Administrator of the General Services Administration may establish exceptions
			 to the fee amount required under subparagraph (A)—</text>
								<clause id="H2C7D2E0D921A48B68DBFC4450EE346BE"><enum>(i)</enum><text>in
			 consideration of the public benefit provided by a grant of an easement or
			 rights-of-way; and</text>
								</clause><clause id="H27D5EF1819204F68AF5546C4DF787FEC"><enum>(ii)</enum><text>in
			 the interest of expanding wireless and broadband coverage.</text>
								</clause></subparagraph></paragraph><paragraph id="HF6BD4E230E0542308AC44A9C277A4772"><enum>(4)</enum><header>Use of fees
			 collected</header><text>Any fee amounts collected by an executive agency
			 pursuant to paragraph (2) shall be made available, without further
			 appropriation, to such agency for purposes of the agency’s telecommunications
			 and information technology needs and any excess funds shall then be deposited
			 into the Federal Building Fund.</text>
						</paragraph></subsection><subsection id="H980FEDC1FDA14AFAAEFAE12C18D50CB6"><enum>(c)</enum><header>Master contracts
			 for wireless tower sitings</header>
						<paragraph id="HB7E16690543C4ED1926566FCFDFBCB2C"><enum>(1)</enum><header>In
			 general</header><text>Notwithstanding section 704 of the Telecommunications Act
			 of 1996 or any other provision of law, and not later than 60 days after the
			 date of enactment of this Act, the Administrator of the General Services
			 Administration shall—</text>
							<subparagraph id="HE7767A776412455598A36BE9975B518F"><enum>(A)</enum><text>develop 1 or more
			 master contracts that shall govern the placement of wireless service antenna
			 structures on buildings and property owned by the Federal Government;
			 and</text>
							</subparagraph><subparagraph id="HD3621E1056184E53A3678EADD00C5744"><enum>(B)</enum><text>in developing the
			 master contract, with respect to the siting of wireless service antenna
			 structures, standardize the treatment of the placement of wireless service
			 antenna structures on rooftop or building facades, the placement of equipment
			 on rooftops or inside buildings, and technology, and any other key issues that
			 the Administrator determines appropriate.</text>
							</subparagraph></paragraph><paragraph id="HB5466DF0F44E4FEC808ABCC61525F744"><enum>(2)</enum><header>Applicability</header><text>The
			 master contract developed by the Administrator of the General Services
			 Administration under paragraph (1) shall apply to all publicly accessible
			 property owned by the Federal Government, unless the Administrator decides that
			 issues with respect to the siting of a wireless service antenna structure on a
			 specific building or property warrant nonstandard treatment of a specific
			 property.</text>
						</paragraph><paragraph id="H5B79F8AECFD04F998A046BAF503E7A34"><enum>(3)</enum><header>Application</header><text>The
			 Administrator of the General Services Administration shall develop a common
			 form or set of forms for wireless service antenna structure siting applications
			 required under this section for all executive agencies that shall be used by
			 applicants with respect to the buildings of each such agency.</text>
						</paragraph></subsection></section></subtitle></title><title id="HA810B9D448314528BE38692953E4E767"><enum>VI</enum><header>Studies on Next
			 Generation 9–1–1 Services</header>
			<section id="H93F5F41B75564A35985C1BDC01B944FF"><enum>601.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this title, the following
			 definitions shall apply:</text>
				<paragraph id="H6C0F45A1380B447A9792B53758C00B30"><enum>(1)</enum><header>9–1–1
			 services</header><text>The term <term>9–1–1 services</term> includes both
			 E9–1–1 services and Next Generation 9–1–1 services.</text>
				</paragraph><paragraph id="H97E1076552544803A520EFD558492317"><enum>(2)</enum><header>E9<enum-in-header>–1–1</enum-in-header>
			 services</header><text>The term <term>E9–1–1 services</term> means both phase I
			 and phase II enhanced 9–1–1 services, as described in section 20.18 of the
			 Commission's regulations (47 C.F.R. 20.18), as in effect on the date of
			 enactment of this title, or as subsequently revised by the Commission.</text>
				</paragraph><paragraph id="HDEE13F2B70104D9781BF9212AEB540B8"><enum>(3)</enum><header>Next Generation
			 9–1–1 services</header><text>The term <term>Next Generation 9–1–1
			 services</term> means an IP-based system comprised of hardware, software, data,
			 and operational policies and procedures that—</text>
					<subparagraph id="H60BF0F620DF14F9A8A20D2ED97708DFB"><enum>(A)</enum><text>provides
			 standardized interfaces from emergency call and message services to support
			 emergency communications;</text>
					</subparagraph><subparagraph id="H707B61C6AE7F41E698B29F40BE9142DA"><enum>(B)</enum><text>processes all
			 types of emergency calls, including voice, data, and multimedia
			 information;</text>
					</subparagraph><subparagraph id="HF52EA0C96B794B90819E30DEB40BF76F"><enum>(C)</enum><text>acquires and
			 integrates additional emergency call data useful to call routing and
			 handling;</text>
					</subparagraph><subparagraph id="H856E427888764103BD4EB39270142804"><enum>(D)</enum><text>delivers the
			 emergency calls, messages, and data to the appropriate public safety answering
			 point and other appropriate emergency entities;</text>
					</subparagraph><subparagraph id="H24A54721B2414B1DBA1D8BDCBDB4164B"><enum>(E)</enum><text>supports data or
			 video communications needs for coordinated incident response and management;
			 or</text>
					</subparagraph><subparagraph id="HBF99A0C04CC449BE9511BC0D9767F7AE"><enum>(F)</enum><text>provides broadband
			 service to public safety answering points or other first responder
			 entities.</text>
					</subparagraph></paragraph><paragraph id="H4566C776681949FF9B87293222B2F1DF"><enum>(4)</enum><header>Public safety
			 answering point</header><text>The term <term>public safety answering
			 point</term> has the meaning given the term in section 222 of the
			 Communications Act of 1934 (47 U.S.C. 222).</text>
				</paragraph></section><section id="H16626EE82F5749C5BE7FA7F920E32E44"><enum>602.</enum><header>NHTSA report on
			 costs for requirements and specifications of Next Generation 9–1–1
			 services</header>
				<subsection id="H8DD2838309514DFD8D655775480CBDDB"><enum>(a)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 title, the Administrator of the National Highway Traffic Safety Administration,
			 in consultation with the Commission and the Secretary of Homeland Security,
			 shall prepare and submit a report to Congress that analyzes and determines
			 detailed costs for specific Next Generation 9–1–1 service requirements and
			 specifications.</text>
				</subsection><subsection id="H22D1F5184AA14D09B7B27A164D38E50B"><enum>(b)</enum><header>Purpose of
			 report</header><text>The purpose of the report required under subsection (a) is
			 to serve as a resource for Congress as it considers creating a coordinated,
			 long-term funding mechanism for the deployment and operation, accessibility,
			 application development, equipment procurement, and training of personnel for
			 Next Generation 9–1–1 services.</text>
				</subsection><subsection id="HD65AF8E47BF34DB1B7FC9444551C4201"><enum>(c)</enum><header>Required
			 inclusions</header><text>The report required under subsection (a) shall include
			 the following:</text>
					<paragraph id="H6533FE65356F409AA338482626CEFF05"><enum>(1)</enum><text>How costs would be
			 broken out geographically and/or allocated among public safety answering
			 points, broadband service providers, and third-party providers of Next
			 Generation 9–1–1 services.</text>
					</paragraph><paragraph id="H3E4B564268C14DCF82BA9DB06AAB7A16"><enum>(2)</enum><text>An assessment of
			 the current state of Next Generation 9–1–1 service readiness among public
			 safety answering points.</text>
					</paragraph><paragraph id="HE20B374C54694E2FB923B3BE1AB6DF9C"><enum>(3)</enum><text>How differences in
			 public safety answering points’ access to broadband across the country may
			 affect costs.</text>
					</paragraph><paragraph id="H942811EECCC44A5D93A8B64DE35EFAB6"><enum>(4)</enum><text>A
			 technical analysis and cost study of different delivery platforms such as
			 wireline, wireless, and satellite.</text>
					</paragraph><paragraph id="HC2325378955442FFAF83237929F8357B"><enum>(5)</enum><text>An assessment of
			 the architectural characteristics, feasibility, and limitations of Next
			 Generation 9–1–1 service delivery.</text>
					</paragraph><paragraph id="HA166BA08B9FA4A3FBEBDA54F8FED104D"><enum>(6)</enum><text>An analysis of the

					</paragraph><paragraph id="H0AB9A0639FD7428591F77110B71A64DA"><enum>(7)</enum><text>Standards and
			 protocols for Next Generation 9–1–1 service and for incorporating Voice over
			 Internet Protocol and <quote>Real-Time Text</quote> standards.</text>
					</paragraph></subsection></section><section id="H7C93BCA1DB264DF5BC4427F6734B01AF"><enum>603.</enum><header>FCC
			 recommendations for legal and statutory framework for Next Generation 9–1–1
			 services</header><text display-inline="no-display-inline">Not later than 1 year
			 after the date of enactment of this title, the Commission, in coordination with
			 the Secretary of Homeland Security and the Administrator of the National
			 Highway Traffic Safety Administration, shall prepare and submit a report to
			 Congress that contains recommendations for the legal and statutory framework
			 for Next Generation 9–1–1 services, consistent with recommendations in the
			 National Broadband Plan developed by the Commission pursuant to Public Law
			 111–5, including the following:</text>
				<paragraph id="H1AC412AA2FD548C5B5A9B117FF4E134B"><enum>(1)</enum><text>A
			 legal and regulatory framework for the development of Next Generation 9–1–1
			 services and the transition from legacy 9–1–1 to Next Generation 9–1–1
			 networks.</text>
				</paragraph><paragraph id="H751C373D993D4FBEB20FC702574D27AC"><enum>(2)</enum><text>Legal mechanisms
			 to ensure efficient and accurate transmission of 9–1–1 caller information to
			 emergency response agencies.</text>
				</paragraph><paragraph id="HC09F0E852D754D379BDDF0B677634D1F"><enum>(3)</enum><text>Recommendations
			 for removing jurisdictional barriers and inconsistent legacy regulations
			 including—</text>
					<subparagraph id="H1B3E994DACBE48EFBA466042C231570C"><enum>(A)</enum><text>proposals that
			 would require States to remove regulatory roadblocks to Next Generation 9–1–1
			 services development, while recognizing existing State authority over 9–1–1
			 services;</text>
					</subparagraph><subparagraph id="H3F5C2C7355BE46EA926AEDBC77D6F15F"><enum>(B)</enum><text>eliminating
			 outdated 9–1–1 regulations at the Federal level; and</text>
					</subparagraph><subparagraph id="HF27984EED139417894E5E4BE6AE342CB"><enum>(C)</enum><text>preempting
			 inconsistent State regulations.</text>
					</subparagraph></paragraph></section></title><title id="HCDB73AE2B6C84C86863A53D6DED1727D"><enum>VII</enum><header>Miscellaneous</header>
			<section id="H6129A99B72C542ABAAC8EEE958426676"><enum>701.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or an amendment
			 made by this Act, or the application of the provision to any person or
			 circumstance, is held to be unconstitutional, the remainder of this Act and the
			 amendments made by this Act, and the application of the provisions of this Act
			 and the amendments made by this Act to any other person or circumstance, shall
			 not be affected thereby.</text>
			</section><section id="H96FECE9B04E84E23B607FF63003BA544"><enum>702.</enum><header>Rule of
			 construction</header><text display-inline="no-display-inline">Nothing in this
			 Act shall be construed as adding or subtracting from the authority the
			 Commission may or may not have to regulate broadband Internet access
			 service.</text>
