		<section id="HD7A86BC75FC6452EA4D548FDB33E1CC3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Safe Roads Act of
			 2011</short-title></quote>.</text>
		</section><section id="H96287437B39C4BA292CBB2DA063FC423"><enum>2.</enum><header>National
			 clearinghouse for alcohol and controlled substance test results of commercial
			 motor vehicle operators</header>
			<subsection id="H425A38E1B541456E863104E404F4BDFA"><enum>(a)</enum><header>In
			 general</header><text>Chapter 313 of title 49, United States Code, is
			 amended—</text>
				<paragraph id="HF83C0DE03F8749789092351E05AB295A"><enum>(1)</enum><text>in section
			 31306(a), by inserting <quote>and section 31306a</quote> after <quote>this
			 section</quote>; and</text>
				</paragraph><paragraph id="HF6F05395AD1747149B79DEC6C5C3AE53"><enum>(2)</enum><text>by inserting after
			 section 31306 the following:</text>
					<quoted-block display-inline="no-display-inline" id="H76CC9B795E0C43A18219B0C79410131F" style="USC">
						<section id="HE625B131535E4F5698E8B943A034BD06"><enum>31306a.</enum><header>National
				clearinghouse for alcohol and controlled substance test results of commercial
				motor vehicle operators</header>
							<subsection id="HA2233BFBB38D4822B7C9A8D872BC3827"><enum>(a)</enum><header>Establishment</header>
								<paragraph id="H833D0BAFB1F941B1A4435C0C92DAD165"><enum>(1)</enum><header>In
				general</header><text>Not later than 2 years after the date of the enactment of
				the <short-title>Safe Roads Act of 2011</short-title>, the
				Secretary of Transportation (referred to in this section as the
				<quote>Secretary</quote>) shall establish a national clearinghouse for records
				relating to alcohol and controlled substances testing of commercial motor
				vehicle operators.</text>
								</paragraph><paragraph id="H9E7D7BA6CE474DAA95002974379102E7"><enum>(2)</enum><header>Purposes</header><text>The
				purposes of the clearinghouse shall be—</text>
									<subparagraph id="H78C6B5A5E31F4DFAB87EB35CA1B18C14"><enum>(A)</enum><text>to improve
				compliance with the Department of Transportation’s alcohol and controlled
				substance testing program applicable to commercial motor vehicle
				operators;</text>
									</subparagraph><subparagraph id="H7E859018713E4DA0A42B369395BAC940"><enum>(B)</enum><text>to facilitate
				access to information about an individual before that individual is employed as
				a commercial motor vehicle operator;</text>
									</subparagraph><subparagraph id="HD1CD8E38339C408EA8EB1C67C09CB09E"><enum>(C)</enum><text>to enhance the
				safety of our United States roadways by reducing accident fatalities involving
				commercial motor vehicles; and</text>
									</subparagraph><subparagraph id="HE03EF545C730480FA3538BDD10D5B2E6"><enum>(D)</enum><text>to reduce the
				demand for illegal drugs and the number of impaired commercial motor vehicle
				operators.</text>
									</subparagraph></paragraph><paragraph id="H4CB103CF17924A57AE588E59265F2512"><enum>(3)</enum><header>Contents</header><text>The
				clearinghouse shall function as a repository for records relating to the
				verified positive test results and test refusals of commercial motor vehicle
				operators and violations by such operators of prohibitions set forth in subpart
				B of part 382 of title 49, Code of Federal Regulations (or any subsequent
				corresponding regulations).</text>
								</paragraph><paragraph id="HEAED8C9790CF4A649A3800B684B68B25"><enum>(4)</enum><header>Electronic
				exchange of records</header><text>The Secretary shall ensure that records can
				be electronically submitted to, and requested from, the clearinghouse by
				authorized users.</text>
								</paragraph><paragraph id="H6326E0D103A44A9197EBBEBDE206245A"><enum>(5)</enum><header>Authorized
				operator</header><text>The Secretary may authorize a qualified and experienced
				private entity to operate and maintain the clearinghouse and to collect fees on
				behalf of the Secretary under subsection (e). Such entity shall establish,
				operate, maintain, and expand the clearinghouse and permit access to deliver
				information and records from the clearinghouse to individuals and employers
				only as authorized by the Secretary in accordance with this section.</text>
								</paragraph></subsection><subsection id="HF9B0AA5800714B018B03D67A5B731742"><enum>(b)</enum><header>Design of
				clearinghouse</header>
								<paragraph id="H3B851AF8718C4E87BD0146ADFE2BF6DE"><enum>(1)</enum><header>Use of federal
				motor carrier safety administration recommendations</header><text>In
				establishing the clearinghouse, the Secretary shall consider—</text>
									<subparagraph id="HDB4F7E8973D4408787A32E2676AED733"><enum>(A)</enum><text>the findings and
				recommendations contained in the Federal Motor Carrier Safety Administration’s
				March 2004 report to Congress required under section 226 of the Motor Carrier
				Safety Improvement Act of 1999 (Public Law 106–159); and</text>
									</subparagraph><subparagraph id="HED360885C9D34DAE80101AB863E8D679"><enum>(B)</enum><text>the findings and
				recommendations contained in the Government Accountability Office’s May 2008
				report to Congress entitled <quote>Motor Carrier Safety: Improvements to Drug
				Testing Programs Could Better Identify Illegal Drug Users and Keep Them off the
				Road</quote>.</text>
									</subparagraph></paragraph><paragraph id="H7CEC205EF41044819F7FCF542767259C"><enum>(2)</enum><header>Development of
				secure processes</header><text>In establishing the clearinghouse, the Secretary
				shall develop a secure process for—</text>
									<subparagraph id="H443D2D877FBE4A6C8621C2FDBE8E4B26"><enum>(A)</enum><text>administering and
				managing the clearinghouse in compliance with all applicable Federal security
				standards;</text>
									</subparagraph><subparagraph id="HF13737C5CF3340A3BB266603BB21B2D3"><enum>(B)</enum><text>registering and
				authenticating authorized users of the clearinghouse;</text>
									</subparagraph><subparagraph id="H46B95D1BF9C8446D8C4B39C341C5858F"><enum>(C)</enum><text>registering and
				authenticating individuals required to report to the clearinghouse under
				subsection (g);</text>
									</subparagraph><subparagraph id="H62CADB539CC141A28242485BF8E89EDD"><enum>(D)</enum><text>preventing the
				unauthorized access of information from the clearinghouse;</text>
									</subparagraph><subparagraph id="HEE19EBF7903D44F2BD28ACD575B6DEBA"><enum>(E)</enum><text>storing and
				transmitting data;</text>
									</subparagraph><subparagraph id="HA121A8C56EC842148E7FB76EEDB3A406"><enum>(F)</enum><text>individuals
				required to report to the clearinghouse under subsection (g) to timely and
				accurately submit electronic data to the clearinghouse;</text>
									</subparagraph><subparagraph id="HAEAC1A2C6F8042C187DF171558DF0F77"><enum>(G)</enum><text>generating timely
				and accurate reports from the clearinghouse in response to requests for
				information by authorized users; and</text>
									</subparagraph><subparagraph id="H2A3D9A5CAE034E8B9DE7999C3C7C4943"><enum>(H)</enum><text>updating an
				individual’s record upon completion of the return-to-duty process described in
				title 49, Code of Federal Regulations.</text>
									</subparagraph></paragraph><paragraph id="HFE91958C01AA48C89EC5395446DBA5F4"><enum>(3)</enum><header>Employer alert
				of positive test result</header><text>In establishing the clearinghouse, the
				Secretary shall consider developing a secure method for electronically
				notifying an employer of any additional positive test results or other
				noncompliance for an individual that are entered into the clearinghouse during
				the 7-day period immediately following an employer’s inquiry about such
				individual.</text>
								</paragraph><paragraph id="H7402988994004E47B40E7999B229721A"><enum>(4)</enum><header>Archive
				capability</header><text>In establishing the clearinghouse, the Secretary shall
				develop a process for archiving all clearinghouse records, including the
				depositing of personal records, records relating to each individual in the
				database, and access requests for personal records, for the purposes of—</text>
									<subparagraph id="HEAD3481E55DD4652AC287F06D12928D4"><enum>(A)</enum><text>auditing and
				evaluating the timeliness, accuracy, and completeness of data in the
				clearinghouse; and</text>
									</subparagraph><subparagraph id="H0D4EB1587CEE4569A23541452C113C3F"><enum>(B)</enum><text>auditing to
				monitor compliance and enforce penalties for noncompliance.</text>
									</subparagraph></paragraph><paragraph id="H5C0F622F037F464999D10A877FC9EDAF"><enum>(5)</enum><header>Future
				needs</header>
									<subparagraph id="HD367799322D9463A9895A618DB8EE32C"><enum>(A)</enum><header>Interoperability
				with other data systems</header><text>In establishing the clearinghouse, the
				Secretary shall consider—</text>
										<clause id="H2287C1B9D6FC431CBBA6F69650312F10"><enum>(i)</enum><text>the existing data
				systems containing regulatory and safety data for commercial motor vehicle
				operators;</text>
										</clause><clause id="H5263338BFFB044EDAF5129533E1DCF35"><enum>(ii)</enum><text>the efficacy of
				using or combining clearinghouse data with 1 or more of such systems;
				and</text>
										</clause><clause id="HB8D38967B42F41A68BCE8CC6A8E4F3A3"><enum>(iii)</enum><text>the potential
				interoperability of the clearinghouse with such systems.</text>
										</clause></subparagraph><subparagraph id="H66F07B69F74843AB9F0DBC74D523A13C"><enum>(B)</enum><header>Specific
				considerations</header><text>In carrying out subparagraph (A), the Secretary
				shall determine—</text>
										<clause id="H9074F78FACD74ACA8804CDAA2EC4062A"><enum>(i)</enum><text>the
				clearinghouse’s capability for interoperability with—</text>
											<subclause id="H0DC45E6B5E274BC89443FA5550A7D24F"><enum>(I)</enum><text>the National
				Driver Register established under section 30302;</text>
											</subclause><subclause id="HB4FF05D1EE0347A0AE2AABE5B345E1ED"><enum>(II)</enum><text>the Commercial
				Driver’s License Information System established under section 31309; and</text>
											</subclause><subclause id="HC729ABA3433A441DA45625DFC4436676"><enum>(III)</enum><text>other data
				systems, as appropriate; and</text>
											</subclause></clause><clause id="HEBC68D5B25E64A7186B8E4CD739B2361"><enum>(ii)</enum><text>any changes to
				the administration of the current testing program, such as forms, that are
				necessary to collect data for the clearinghouse.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="H0F476DF752F646BDA409A0FC791B8C7E"><enum>(c)</enum><header>Standard
				forms</header><text>The Secretary shall develop standard forms to be
				used—</text>
								<paragraph id="H1AC9FC23414A49DDBAF2B6F36D80003F"><enum>(1)</enum><text>by employers and
				other authorized users of the clearinghouse to—</text>
									<subparagraph id="H2C6D889B8BB94569B8BF7AD8228F4694"><enum>(A)</enum><text>request records
				from the clearinghouse; and</text>
									</subparagraph><subparagraph id="HCD56AC5C56D7476999DE4575B81C4A2F"><enum>(B)</enum><text>obtain the consent
				of each individual who is the subject of a request from the clearinghouse;
				and</text>
									</subparagraph></paragraph><paragraph id="HDE4EB8AB6F4D4638B767465ADE71852D"><enum>(2)</enum><text>to notify
				individuals that positive alcohol and controlled substances test results,
				refusals to test, and violations of prohibitions set forth in subpart B of part
				382 of title 49, Code of Federal Regulations (or any subsequent corresponding
				regulations), will be reported to the clearinghouse.</text>
								</paragraph></subsection><subsection id="H499866AFCFF2408FB7E0CF668BF4A0C4"><enum>(d)</enum><header>Privacy</header><text>Information
				may not be released from the clearinghouse unless such release complies with
				all applicable Federal privacy laws and regulations, including the Health
				Insurance Portability and Accountability Act of 1996 (Public Law 104–191) and
				fair information practices under the Privacy Act of 1974 (5 U.S.C.
				552a).</text>
							</subsection><subsection id="H4A9E70AD3D654C1BA877E7BFFEBBA539"><enum>(e)</enum><header>Fees</header>
								<paragraph id="H7A209B2BF49E46D8840B119523080FD6"><enum>(1)</enum><header>Authority to
				collect fees</header><text>Except as provided under paragraph (3), the
				Secretary may collect reasonable, customary, and nominal fees from employers
				and other authorized users of the clearinghouse for requests for information
				from the clearinghouse.</text>
								</paragraph><paragraph id="H050A190FBDC54DCCA467FAE0B71A532B"><enum>(2)</enum><header>Use of
				fees</header><text>Fees collected under this subsection shall be used for the
				operation and maintenance of the clearinghouse.</text>
								</paragraph><paragraph id="HFF87D4B255404868933744855FA124AF"><enum>(3)</enum><header>Limitation</header><text>The
				Secretary may not collect a fee from any individual requesting information from
				the clearinghouse that pertains to the record of the individual.</text>
								</paragraph></subsection><subsection id="H1C0B662399CB4A16AB6B6A63C548685F"><enum>(f)</enum><header>Employer
				requirements</header>
								<paragraph commented="no" id="H9F0AF39B78484F398CD8C9ADAF3E67AB"><enum>(1)</enum><header>Determination
				concerning use of clearinghouse</header><text>The Secretary shall determine
				which commercial motor carrier employers are authorized to use the
				clearinghouse to meet the alcohol and controlled substances testing
				requirements under title 49, Code of Federal Regulations.</text>
								</paragraph><paragraph id="HDD467C287D284E0A8DB631EA173A84EE"><enum>(2)</enum><header>Applicability of
				existing requirements</header><text>Each commercial motor carrier employer and
				service agent shall comply with the alcohol and controlled substances testing
				requirements under title 49, Code of Federal Regulations.</text>
								</paragraph><paragraph id="H9D035541C5CE4B1E9ED566018FE4D90C"><enum>(3)</enum><header>Employment
				prohibitions</header><text>A commercial motor carrier employer shall not hire
				an individual to operate a commercial motor vehicle unless the employer has
				determined that the individual, during the preceding 3-year period—</text>
									<subparagraph id="HB7FF4796AC6E43C2AF40FE715078EF0F"><enum>(A)</enum><text>has been tested
				for the use of alcohol and controlled substances, as required under title 49,
				Code of Federal Regulations;</text>
									</subparagraph><subparagraph id="H05A1DF5799EE4BED98895442C6E0B4A7"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H6637273521434B10A701A828D97F2825"><enum>(i)</enum><text>has not tested positive
				for the use of alcohol or controlled substances in violation of such
				regulations; or</text>
										</clause><clause id="H693D1B413F8148009C70FE1083DAA179" indent="up1"><enum>(ii)</enum><text>has tested positive for the use of
				alcohol or controlled substances and has completed the required return-to-duty
				process described in title 49, Code of Federal Regulations;</text>
										</clause></subparagraph><subparagraph id="HFF37092DA28445E688DDFD7570C73543"><enum>(C)</enum><text>has not refused to
				take the alcohol or controlled substance tests required under title 49, Code of
				Federal Regulations; and</text>
									</subparagraph><subparagraph id="HFBDB939151FA4726BEC5CAF0BA9A6669"><enum>(D)</enum><text>has not violated
				any other provision of subpart B of part 382 of title 49, Code of Federal
				Regulations (or any subsequent corresponding regulations).</text>
									</subparagraph></paragraph></subsection><subsection id="HC43545BAD7DF42B3920729F1DB55B719"><enum>(g)</enum><header>Reporting of
				records</header>
								<paragraph id="HED291077E044433B980B8075070D12F9"><enum>(1)</enum><header>In
				general</header><text>Medical review officers, employers, service agents, and
				other appropriate persons, as determined by the Secretary, shall promptly
				submit to the Secretary records in their possession of any individual
				who—</text>
									<subparagraph id="H944BDF388D52433AB86D5CEBED4D5118"><enum>(A)</enum><text>has refused to
				take an alcohol or controlled substance test required under title 49, Code of
				Federal Regulations;</text>
									</subparagraph><subparagraph id="HBEBF341AC7E74FEEA8AC283B97101289"><enum>(B)</enum><text>has tested
				positive for alcohol or a controlled substance in violation of such
				regulations; or</text>
									</subparagraph><subparagraph id="H5484D1AE13DE454B8D3BFFA72F5FD6CB"><enum>(C)</enum><text>has violated any
				other provision of subpart B of part 382 of title 49, Code of Federal
				Regulations (or any subsequent corresponding regulations).</text>
									</subparagraph></paragraph><paragraph id="H3FEC4FAC5B35429E80D15A84F2606115"><enum>(2)</enum><header>Inclusion of
				records in clearinghouse</header><text>The Secretary shall include in the
				clearinghouse all records of positive test results and test refusals received
				pursuant to paragraph (1).</text>
								</paragraph><paragraph id="HB34AB3A2670E4320B6A82B7FED81F137"><enum>(3)</enum><header>Modifications
				and deletions</header><text>If the Secretary determines that a record contained
				in the clearinghouse is not accurate, the Secretary shall modify or delete the
				record, as appropriate.</text>
								</paragraph><paragraph id="HD6E31AE607C64A6CA2F474E34C8D9DB0"><enum>(4)</enum><header>Notification</header><text>The
				Secretary shall expeditiously notify, unless such notification would be
				duplicative, an individual when—</text>
									<subparagraph id="H759D0A46862E4F15A3F3321345999BE9"><enum>(A)</enum><text>a record relating
				to the individual has been received by the clearinghouse;</text>
									</subparagraph><subparagraph id="H014566F425F540E4B25CC0B535A0730D"><enum>(B)</enum><text>any record in the
				clearinghouse relating to the individual is modified or deleted, and include in
				such notification the reason for such modification or deletion; or</text>
									</subparagraph><subparagraph id="H630787B5C73F4E6CA80E8AD8A3B1D63E"><enum>(C)</enum><text>any record in the
				clearinghouse relating to the individual is released to an employer and shall
				include in such notification the reason for such a release.</text>
									</subparagraph></paragraph><paragraph id="HF6EB046C4CC84C4CA33F74310EA701D7"><enum>(5)</enum><header>Data quality and
				security standards for reporting and releasing</header><text>The Secretary may
				establish additional requirements, as appropriate, to ensure that—</text>
									<subparagraph id="H65850C94FB414E0F8F79AFC1FAA145A9"><enum>(A)</enum><text>the submission of
				records to the clearinghouse is timely and accurate;</text>
									</subparagraph><subparagraph id="H5290AB97297D44869F1922BFEAECB31A"><enum>(B)</enum><text>the release of
				data from the clearinghouse is timely, accurate, and released to the
				appropriate individual, employer, or State licensing official; and</text>
									</subparagraph><subparagraph id="H7867A3D091E84726AD37F85040F28819"><enum>(C)</enum><text>the individuals
				with records in the clearinghouse have a cause of action for the inappropriate
				use of information included in the clearinghouse.</text>
									</subparagraph></paragraph><paragraph id="HC7299BAF57794E3DAC68E43A8C88173D"><enum>(6)</enum><header>Retention of
				records</header><text>The Secretary shall—</text>
									<subparagraph id="HEF26F62700AD40AE91B8E50F3D4B1F88"><enum>(A)</enum><text>retain all the
				records submitted to the clearinghouse during the 5-year period beginning on
				the date on which such records are submitted;</text>
									</subparagraph><subparagraph id="H72B6B337BF024DD3B6CEA0394A454552"><enum>(B)</enum><text>remove such
				records from the clearinghouse at the end of such 5-year period, unless the
				individual has not met required return-to-duty and follow-up requirements under
				title 49, Code of Federal Regulations; and</text>
									</subparagraph><subparagraph id="HC7AADEC6C96843EA88CE999FEA3452A3"><enum>(C)</enum><text>retain records
				beyond the end of such 5-year period in a separate location for archiving and
				auditing purposes.</text>
									</subparagraph></paragraph></subsection><subsection id="HC842356E66F24E359681091AC3286ABF"><enum>(h)</enum><header>Access to
				clearinghouse by employers</header>
								<paragraph id="H2848F09235974A8C8FEE8D2A08F0CD63"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall establish a process to require
				employers to request and review any records in the clearinghouse pertaining to
				an individual before employing the individual and each year thereafter as long
				as the individual is under the employ of the employers.</text>
								</paragraph><paragraph id="HAABB078DF5C8443DA903DFBB0C0746ED"><enum>(2)</enum><header>Consent
				requirement</header><text>An employer may not be granted access to any records
				in the clearinghouse pertaining to an individual until after the
				employer—</text>
									<subparagraph id="HDE55562011154C85AB6C26844068F759"><enum>(A)</enum><text>obtains the prior
				written or electronic consent of the individual for access to such records;
				and</text>
									</subparagraph><subparagraph id="HEDC70DC69CF94587984FBFEF9B56B4F2"><enum>(B)</enum><text>submits proof of
				such consent to the Secretary.</text>
									</subparagraph></paragraph><paragraph id="H9610CD4C50AB41FFAD4EA0A1AA71F145"><enum>(3)</enum><header>Access to
				records</header><text>Upon receiving from an employer a request, in compliance
				with paragraph (2), for records in the clearinghouse pertaining to an
				individual, the Secretary shall provide access to the records to the employer
				as expeditiously as practicable.</text>
								</paragraph><paragraph id="H51766BF92C2E4763A48FC50F5CA3B383"><enum>(4)</enum><header>Retention of
				record requests</header><text>The Secretary shall require employers to retain,
				for a 3-year period—</text>
									<subparagraph id="H245251F097C84407A122202BDB6E8C9A"><enum>(A)</enum><text>a record of each
				request made by the employer for records from the clearinghouse; and</text>
									</subparagraph><subparagraph id="H43912FC1F4084F748922EF4EC2405606"><enum>(B)</enum><text>any information
				received pursuant to such request.</text>
									</subparagraph></paragraph><paragraph id="HDA4AD4F44CCE4616975A20F66C6AD2A2"><enum>(5)</enum><header>Use of
				records</header>
									<subparagraph id="H56EDCC341A4845169CA56BC1513595FF"><enum>(A)</enum><header>In
				general</header><text>An employer may use a record of an individual received
				from the clearinghouse only to assess and evaluate the qualifications of the
				individual to operate a commercial motor vehicle for such employer.</text>
									</subparagraph><subparagraph id="H0CE1ABBBA8924B72BA67635B31E7EB3D"><enum>(B)</enum><header>Protection or
				privacy of individuals</header><text>An employer that receives a record from
				the clearinghouse pertaining to an individual shall—</text>
										<clause id="HD20E3E08D44F47458678E8D9382247B3"><enum>(i)</enum><text>protect the
				privacy of the individual and the confidentiality of the record; and</text>
										</clause><clause id="H2E5474D9377F4B74A09BCEA214720994"><enum>(ii)</enum><text>ensure that
				information contained in the record is not divulged to any person or entity who
				is not directly involved in assessing and evaluating the qualifications of the
				individual to operate a commercial motor vehicle for the employer receiving the
				record.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="HA71085EFF3D4414D994CEFC472707389"><enum>(i)</enum><header>Access to
				clearinghouse by individuals</header>
								<paragraph id="HC7B2B9183A3D4098AA1EA9764A0079FD"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall establish a process by which any
				individual may request and receive information from the clearinghouse—</text>
									<subparagraph id="H0CEECEFDC0BF4FB0BC32922504ED9954"><enum>(A)</enum><text>to determine
				whether the clearinghouse contains a record pertaining to the
				individual;</text>
									</subparagraph><subparagraph id="H0E4F198323584A27A9325D986A946A98"><enum>(B)</enum><text>to verify the
				accuracy of such record;</text>
									</subparagraph><subparagraph id="H8CA107446A7B4F0EA6A248FEFDFCB786"><enum>(C)</enum><text>to update an
				individual’s record, including completing the return-to-duty process described
				in title 49, Code of Federal Regulations; and</text>
									</subparagraph><subparagraph id="H0EA21D0A9A8E4444B146D55C509C70E7"><enum>(D)</enum><text>to determine
				whether the clearinghouse has received requests for information regarding the
				individual.</text>
									</subparagraph></paragraph><paragraph id="H8B1CE4511719490CA2EB249DFBD2109A"><enum>(2)</enum><header>Dispute
				procedure</header><text>The Secretary shall establish a procedure, including an
				appeal process, for any individual to dispute and remedy administrative errors
				contained in a record in the clearinghouse that pertains to such
				individual.</text>
								</paragraph></subsection><subsection id="H6BD3D92048654E9684819734E8FB23D4"><enum>(j)</enum><header>Access to
				clearinghouse by State licensing authorities</header>
								<paragraph id="H491D920C9965451ABC7D30CBC34B7356"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall establish a process by which the
				chief commercial driver’s licensing official of a State may request and receive
				records from the clearinghouse that pertain to an individual applying for a
				commercial driver’s license from such State.</text>
								</paragraph><paragraph id="H9296017D5E8448B1860C1DB0B958B18A"><enum>(2)</enum><header>Implied
				consent</header><text>The chief commercial driver’s licensing official of a
				State may be granted access to any records in the clearinghouse pertaining to
				an individual without obtaining the prior written or electronic consent of the
				individual and submitting proof of such consent. Any individual who holds a
				commercial driver’s license shall be deemed to have consented to such access.
				Consent is implied by obtaining a commercial driver’s license from the State
				and by driving a commercial motor vehicle.</text>
								</paragraph><paragraph id="H4034CF0FF22B4F46AD685D6E6ACD1B86"><enum>(3)</enum><header>Protection of
				privacy of individuals</header><text>If the chief commercial driver’s licensing
				official of a State receives a record from the clearinghouse pertaining to an
				individual, the official shall—</text>
									<subparagraph id="H2E5EF9CD269B479DB8D63BA956E1246D"><enum>(A)</enum><text>protect the
				privacy of the individual and the confidentiality of record; and</text>
									</subparagraph><subparagraph id="H33BD97DD46AD481FA73BACF7BC486FF9"><enum>(B)</enum><text>ensure that
				information contained in the record is not divulged to any person within or
				outside the State government who is not directly involved in assessing and
				evaluating the qualifications of the individual to operate a commercial motor
				vehicle.</text>
									</subparagraph></paragraph></subsection><subsection id="H2566939AC8C7444CA0D5C98646CCFA82"><enum>(k)</enum><header>Penalties</header><text>An
				employer, employee, medical review officer, or service agent who violates any
				provision of this section or section 3 of the <short-title>Safe Roads Act of 2011</short-title> shall be subject to
				the civil and criminal penalties described in section 521(b) of title 49,
				United States Code, and other applicable civil and criminal penalties, as
				determined by the Secretary.</text>
							</subsection><subsection id="H1B0F755E41584C3AADB04DC710744A14"><enum>(l)</enum><header>Compatibility of
				State and local laws</header>
								<paragraph id="H25B4266F9F4A427397A990CACFDBEAC6"><enum>(1)</enum><header>Preemption</header><text>Except
				as provided under paragraph (3), any law, regulation, order, or other
				requirement of a State, political subdivision of a State, or Indian tribe
				related to commercial driver’s license holders subject to alcohol or controlled
				substance testing under title 49, Code of Federal Regulations, which is
				inconsistent with the requirements under this section or any regulation issued
				pursuant to the authority of this section is preempted.</text>
								</paragraph><paragraph id="H047D08708B2E4AA09B8CB93D37412195"><enum>(2)</enum><header>Applicability</header><text>The
				preemption under paragraph (1) shall apply to—</text>
									<subparagraph id="H30FDFD4BB22B4F778592C7C015B68C49"><enum>(A)</enum><text>the reporting of
				valid positive results from alcohol screening tests and drug tests;</text>
									</subparagraph><subparagraph id="HE9031D3ADAAD4FC19A20762E91DCB74F"><enum>(B)</enum><text>the refusal to
				provide a specimen for an alcohol screening test or drug test; and</text>
									</subparagraph><subparagraph id="H52208B17CCAC4A1AB1D9831E6437DF0B"><enum>(C)</enum><text>other violations
				of subpart B of part 382 of title 49, Code of Federal Regulations (or any
				subsequent corresponding regulations).</text>
									</subparagraph></paragraph><paragraph id="HF6E8EFB5C1EE456EA929E888C37AAF43"><enum>(3)</enum><header>Exception</header><text>A
				law, regulation, order, or other requirement of a State, political subdivision
				of a State, or Indian tribe shall not be preempted under this subsection to the
				extent it relates to actions taken with respect to a commercial motor vehicle
				operator’s commercial driver’s license or driving record as a result of such
				driver’s—</text>
									<subparagraph id="HD6A5ED6173B04612AF8A6BBA628E00AB"><enum>(A)</enum><text>verified positive
				alcohol or drug test result;</text>
									</subparagraph><subparagraph id="H380EEF6F91A142CCA5CBDE3860E1BF91"><enum>(B)</enum><text>refusal to provide
				a specimen for the test; or</text>
									</subparagraph><subparagraph id="HC94A527510334615962371F7EBF8CF99"><enum>(C)</enum><text>other violations
				of subpart B of part 382 of title 49, Code of Federal Regulations (or any
				subsequent corresponding regulations).</text>
									</subparagraph></paragraph></subsection><subsection id="HF572F300941B408492FA7BC56A1F5E90"><enum>(m)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="H23B3D3F5E23F4C3894C4D0B038A5950B"><enum>(1)</enum><header>Authorized
				users</header><text>The term <term>authorized users</term> means employers,
				State licensing authorities, and other individuals granted access to the
				clearinghouse.</text>
								</paragraph><paragraph id="H1EDFD0C070D64E2CB45CDA5A34D7FE54"><enum>(2)</enum><header>Chief commercial
				driver’s licensing official</header><text>The term <term>chief commercial
				driver’s licensing official</term> means the official in a State who is
				authorized to—</text>
									<subparagraph id="H783D116DBBFC4120974838C93F37AF9B"><enum>(A)</enum><text>maintain a record
				about commercial driver’s licenses issued by the State; and</text>
									</subparagraph><subparagraph id="H431029D2E855464695B569E28EDEF3F0"><enum>(B)</enum><text>take action on
				commercial driver’s licenses issued by the State.</text>
									</subparagraph></paragraph><paragraph id="H8C3F5686047247ACAC7E12C546A1DCA1"><enum>(3)</enum><header>Clearinghouse</header><text>The
				term <term>clearinghouse</term> means the clearinghouse established under
				subsection (a).</text>
								</paragraph><paragraph id="H149723AF4441493F93C7166BFE7BBA03"><enum>(4)</enum><header>Commercial motor
				vehicle operator</header><text>The term <term>commercial motor vehicle
				operator</term> means an individual who is—</text>
									<subparagraph id="H99D5C68B63D540CB886BDDBD1A574B9D"><enum>(A)</enum><text>in possession of a
				valid commercial driver’s license issued in accordance with section 31308;
				and</text>
									</subparagraph><subparagraph id="H9F0C23113501430583FCDD91139A507C"><enum>(B)</enum><text>subject to
				controlled substances and alcohol testing under title 49, Code of Federal
				Regulations.</text>
									</subparagraph></paragraph><paragraph id="H1C56E2ABE8B74DF8A8E922BE14552739"><enum>(5)</enum><header>Employer</header><text>The
				term <term>employer</term> means a person or entity employing, or seeking to
				employ, 1 or more employees (including an individual who is self-employed) to
				be commercial motor vehicle operators.</text>
								</paragraph><paragraph id="HDA34271B644C44D39C369400C82E9677"><enum>(6)</enum><header>Medical review
				officer</header><text>The term <term>medical review officer</term> means a
				licensed physician who is responsible for—</text>
									<subparagraph id="H66DBB242C22D4BD6AF766F45642AB38E"><enum>(A)</enum><text>receiving and
				reviewing laboratory results generated under the testing program;</text>
									</subparagraph><subparagraph id="H49C800F666504B28B901A540F14980C2"><enum>(B)</enum><text>evaluating medical
				explanations for alcohol and controlled substances tests required under title
				49, Code of Federal Regulations; and</text>
									</subparagraph><subparagraph id="H50703E1D8C4448428B408B2E9EEC2C59"><enum>(C)</enum><text>deciding the
				outcome of controlled substance tests.</text>
									</subparagraph></paragraph><paragraph id="H90313538525E4CF0BBBE0BC8B7C7CEE2"><enum>(7)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> means the Secretary of Transportation.</text>
								</paragraph><paragraph id="H06D36FCBAAF541A69C345BBB2FAD4053"><enum>(8)</enum><header>Service
				agent</header><text>The term <term>service agent</term> means a person or
				entity, other than an employee of the employer, who provides services to
				employers or employees under the testing program.</text>
								</paragraph><paragraph id="H2288E0776AC0445BA8020EA687448CE8"><enum>(9)</enum><header>Testing
				program</header><text>The term <term>testing program</term> means the alcohol
				and controlled substances testing program required under title 49, Code of
				Federal
				Regulations.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H56C00986971E4DB487B5EE4CC46B7F16"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The analysis for chapter 313 of title 49, United States
			 Code, is amended by inserting after the item relating to section 31306 the
			 following:</text>

					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H07E308F58E744CCD987CCFC46C9BF13F"><enum>3.</enum><header>Enhanced
			 oversight of collection sites</header><text display-inline="no-display-inline">The Secretary of Transportation
			 shall—</text>
			<paragraph id="H93F10E14A35F411BBAE8BCF0CF9C431F"><enum>(1)</enum><text>require each site
			 at which urine is collected for controlled substances tests under title 49,
			 Code of Federal Regulations, to register with the Department of
			 Transportation;</text>
			</paragraph><paragraph id="HF3E0A528D8D9482CAC90F79ED38E0AB6"><enum>(2)</enum><text>publish an annual
			 list of registered collection sites in the Federal Register and make such list
			 available to the public;</text>
			</paragraph><paragraph id="H4232835403EC443E98F84D6C31A52724"><enum>(3)</enum><text>ensure that no
			 collection site is included on the list described in paragraph (2) unless the
			 site submits an annual certification to the Secretary that the site meets each
			 of the applicable requirements under title 49, Code of Federal Regulations;
			 and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2F5023A421644D43955D04D202846A55"><enum>(4)</enum><text>develop an
			 instrument for the certification under paragraph (3) that requires a positive
			 response to each applicable requirement, including an explanation of the
			 penalties imposed for making false statements.</text>
