		<official-title>To amend title 41, United States Code, to increase the
		  American-made content requirement for the Buy American Act, and for other
		  purposes.</official-title>

		<section id="H914B1E277C054E74B746197A4332873B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>The Buy American Enhancement Act of
			 2011</short-title></quote>.</text>
		</section><section id="H3B55030BF77A402DB6CE90CD5E4785E7"><enum>2.</enum><header>Domestic content
			 requirement for the Buy American Act</header>
			<subsection id="HC2F7B27B63844E1E933EE5484D230708"><enum>(a)</enum><header>Substantially
			 all defined</header><text display-inline="yes-display-inline">Section 8301 of
			 title 41, United States Code, is amended—</text>
				<paragraph id="HF3FC4A54445F46DCA73AEB402F6FF2ED"><enum>(1)</enum><text>by redesignating
			 paragraph (2) as paragraph (3); and</text>
				</paragraph><paragraph id="H666B7195F8444F24BB0970D61702B11F"><enum>(2)</enum><text>by inserting after
			 paragraph (1) the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H8D5697ABFF7C409C8A3CC0BBDA1769DD" style="USC">
						<paragraph id="HB34242320ED84285A4E2D184BE63C9C4"><enum>(2)</enum><header>Substantially
				all</header><text display-inline="yes-display-inline">Articles, materials, or
				supplies shall be treated as made substantially all from articles, materials,
				or supplies mined, produced, or manufactured in the United States if the cost
				of the domestic components of such articles, materials, or supplies exceeds 75
				percent of the total cost of all components of such articles, materials, or
				supplies.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" id="H69A4865267ED4B6E9DCC74A560BE8D15"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall take effect not
			 later than 180 days after the date of the enactment of this Act.</text>
			</subsection></section><section id="HFE5C783DCED84DF59DD200C28E3896E1"><enum>3.</enum><header>Requirement for
			 indirect contracts to comply with the Buy American Act</header>
			<subsection id="H5AF01F9F15974B609A313AB15D918AFD"><enum>(a)</enum><header>Contract
			 requirement</header><text display-inline="yes-display-inline">The head of each
			 Federal agency shall ensure that each contract described in subsection (b)
			 awarded by such Federal agency includes a provision requiring any articles,
			 materials, and supplies provided under the contract to comply with chapter 83
			 of title 41, United States Code (popularly referred to as the <quote>Buy
			 American Act</quote>), subject to the exceptions to that chapter provided in
			 the Trade Agreements Act of 1979 (19 U.S.C. 2501 et seq.) or otherwise provided
			 by law.</text>
			</subsection><subsection id="H2DE4729B7BD446B381EA555F255BD97B"><enum>(b)</enum><header>Contracts
			 described</header><text>The contracts described in this subsection include each
			 of the following:</text>
				<paragraph commented="no" id="H7CB17E6F58B044028B9F143B25F3CF21"><enum>(1)</enum><text>Housing leases,
			 including military housing provided by a private entity.</text>
				</paragraph><paragraph id="H67A5E7C48E4547189645F54AAB08C80B"><enum>(2)</enum><text display-inline="yes-display-inline">Power purchase agreements.</text>
				</paragraph><paragraph id="HC8771BECE0024BA584AEE69645EB315E"><enum>(3)</enum><text display-inline="yes-display-inline">Enhanced-use leases.</text>
				</paragraph><paragraph id="HD06FC79156994C17AB7EA9D6EDDC2CF1"><enum>(4)</enum><text>Energy savings
			 performance contracts.</text>
				</paragraph><paragraph id="HBE02617237994E998C8715AEA86EDD2A"><enum>(5)</enum><text>Utility energy
			 service contracts.</text>
				</paragraph></subsection></section><section id="HE44E362B39EF4DE6980FFC0E99AE1914"><enum>4.</enum><header>Buy American
			 waiver reporting requirement</header>
			<subsection id="H23D1D4276949481D902CB6701FB135D7"><enum>(a)</enum><header>Waiver
			 defined</header><text display-inline="yes-display-inline">Section 8301 of title
			 41, United States Code, as amended by section 2, is further amended by adding
			 at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H9A2BC5C78E0D41BB8C3AA4A197A0DF76" style="USC">
					<paragraph id="HEBAD2972ECF443868D86042DEEFD6385"><enum>(4)</enum><header>Waiver</header><text display-inline="yes-display-inline">The term <term>waiver</term> means, with
				respect to the acquisition of an article, material, or supply for public use,
				the inapplicability of this chapter to the acquisition by reason of any of the
				following:</text>
						<subparagraph commented="no" id="HEF9CD4ACD6D84C508551FD829C530B6B"><enum>(A)</enum><text>A determination by
				the head of the Federal agency concerned that the acquisition is inconsistent
				with the public interest.</text>
						</subparagraph><subparagraph commented="no" id="H12EF247E10C24B6F960F8F7E2F1EB5CD"><enum>(B)</enum><text>A determination by
				the head of the Federal agency concerned that the cost of the acquisition is
				unreasonable.</text>
						</subparagraph><subparagraph id="H47831AA16F9B41C8854EC2D8EDF9C924"><enum>(C)</enum><text>Use outside of the
				United States.</text>
						</subparagraph><subparagraph commented="no" id="HDC5DC17B49114A8E8A0E6C315D0037D5"><enum>(D)</enum><text>A determination by
				the head of the Federal agency concerned that the article, material, or supply
				is not mined, produced, or manufactured in the United States in sufficient and
				reasonably available commercial quantities of a satisfactory quality.</text>
						</subparagraph><subparagraph id="H60CE2A4D6F7B4ECD929E9C70006780A2"><enum>(E)</enum><text>Procured under a
				contract with an award value that is not more than the micro-purchase threshold
				under section 1902 of this title.</text>
						</subparagraph><subparagraph id="H9C0E2DA952EE4AF58B7E357C3C62E348"><enum>(F)</enum><text>An exception under
				the Trade Agreements Act of 1979 (19 U.S.C. 2501 et seq.).</text>
						</subparagraph><subparagraph id="H5420C335BFFB4AF5BC9AE79CDDE30CC1"><enum>(G)</enum><text>Any other
				exception otherwise provided by
				law.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3A10816C20A34BB09D0CEE5090E24DF9"><enum>(b)</enum><header>Waiver reporting
			 requirement</header><text>Section 8302 of title 41, United States Code, is
			 amended by adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H1E991F8857C54700A8E61490735F4A20" style="USC">
					<subsection id="HD293507E1F5C4DD68B5B0DA38888F003"><enum>(c)</enum><header>Waiver reporting
				requirement</header><text display-inline="yes-display-inline">The head of each
				Federal agency shall establish a location on the website of such agency for the
				publication of waivers accessible by the public and shall publish a list at
				such location of each waiver granted under this chapter not later than 30 days
				after such waiver is granted.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H6C644651970F482FB9C64738C54E9510"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall take effect not later than 180 days after the date of the
			 enactment of this Act.</text>
			</subsection></section><section id="H5DA68AFA5A004BEBBE3D050ED939EEC5"><enum>5.</enum><header>Implementation
			 through the Federal Acquisition Regulation</header><text display-inline="no-display-inline">Not later than 180 days after the date of
			 the enactment of this Act, the Federal Acquisition Regulation shall be revised
			 as necessary to implement the provisions of this Act.</text>
		</section><section id="HF5318A5EA8B14B50AE25CCA254B8E336"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" id="H39A9FBD88EED446795A13876D2E7694D"><enum>(1)</enum><header>Energy savings
			 performance contract</header><text display-inline="yes-display-inline">The term
			 <term>energy savings performance contract</term> has the meaning given that
			 term under section 436.31 of title 10, Code of Federal Regulations.</text>
			</paragraph><paragraph commented="no" id="H499F2F38245C49C0A815AA02E8BCE486"><enum>(2)</enum><header>Federal
			 agency</header><text display-inline="yes-display-inline">The term <term>Federal
			 agency</term> means any executive agency (as defined in section 133 of title
			 41, United States Code) or any establishment in the legislative or judicial
			 branch of the Federal Government.</text>
