		<official-title>To amend chapters 83 and 84 of title 5, United States
		  Code, to set the age at which Members of Congress are eligible for an annuity
		  to the same age as the retirement age under the Social Security

		<section id="H8D640D4D56B14C93A1D735808814330C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Congressional Retirement Age Act of
			 2011</short-title></quote>.</text>
		</section><section id="H2F075021AC1D414D812AA04886ED65B6"><enum>2.</enum><header>Retirement
			 age</header>
			<subsection id="H45F12DC185E14CAF8388FC67F2182482"><enum>(a)</enum><header>CSRS</header><text>Subchapter
			 III of chapter 83 of title 5, United States Code, is amended—</text>
				<paragraph id="HAF339ABA5C9E4A8A969FDBADA834063A"><enum>(1)</enum><text>in section 8336,
			 by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H3D0E44C10EAC4949B6F9E5AE4AFE82E7" style="OLC">
						<subsection id="H168E70AF4B1C4D709400FBDAC026EEF3"><enum>(q)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H5446C5AA262F4657AB69FF4B150587D4"><enum>(1)</enum><text>An individual serving as
				a Member on or after the date of enactment of this subsection—</text>
								<subparagraph id="H9778412A5F214C8289A554F33AA8BBB7" indent="up1"><enum>(A)</enum><text>shall not be eligible for an annuity
				under any other provision of this section; and</text>
								</subparagraph><subparagraph id="H893A447A0BB64C529B0DB3390D8104C9" indent="up1"><enum>(B)</enum><text>shall be eligible for an annuity if
				the individual is separated from the service after attaining retirement age (as
				defined in section 216(l)(1) of the Social Security Act (42 U.S.C. 416(l)(1))
				and completing 5 years of service.</text>
								</subparagraph></paragraph><paragraph id="H48EBA19FC8834180B31D05F0E52C0296" indent="up1"><enum>(2)</enum><text>This subsection applies to an
				individual serving as a Member on or after the date of enactment of this
				subsection without regard to whether—</text>
								<subparagraph id="HEEF30B56FA5F44B8A5ED0026B7C65E17"><enum>(A)</enum><text>the individual is separated from the
				service while serving as an employee or a Member; or</text>
								</subparagraph><subparagraph id="H5EEB66B03455403CB4E036786A774FAF"><enum>(B)</enum><text>any service by the individual is
				subject to section 8334(k)</text>
								</subparagraph></paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H77EAC6B34DCD48F09C9535CB00B5C065"><enum>(2)</enum><text>in section 8338,
			 by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HE6ACAA8B5F1A4C758FDD930D9063F019" style="OLC">
						<subsection id="HB3511DF5D6C846E7B1A61484107AF0F4"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H294A3F7A01C04444949EC48A1781D0AB"><enum>(1)</enum><text>An individual serving as
				a Member on or after the date of enactment of this subsection—</text>
								<subparagraph id="H43412DE94A664073A7F446EF67CE7326" indent="up1"><enum>(A)</enum><text>shall not be eligible for an annuity
				under any other provision of this section; and</text>
								</subparagraph><subparagraph id="HF2B01460E23F4F78A0B35AA3B7334F05" indent="up1"><enum>(B)</enum><text>if the individual is separated from
				the service, or transferred to a position in which the individual does not
				continue subject to this subchapter, after completing 5 years of service, is
				eligible for an annuity beginning at retirement age (as defined in section
				216(l)(1) of the Social Security Act (42 U.S.C. 416(l)(1)).</text>
								</subparagraph></paragraph><paragraph id="H273CE5DCB8CC47A1AF8086E08AE87C7B" indent="up1"><enum>(2)</enum><text>This subsection applies to an
				individual serving as a Member on or after the date of enactment of this
				subsection without regard to whether—</text>
								<subparagraph id="HAF96B45C3C844820AC644EF73A571A75"><enum>(A)</enum><text>the individual serves as an employee
				before, on, or after the date of enactment of this subsection; or</text>
								</subparagraph><subparagraph id="HAE4B91DB31D948DE95B35A107264EBE7"><enum>(B)</enum><text>any service by the individual is
				subject to section
				8334(k).</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H83D9C8B7CCFA49F4B6E4FFC1C1732C45"><enum>(b)</enum><header>FERS</header><text>Chapter
			 84 of title 5, United States Code, is amended—</text>
				<paragraph id="H729B9631CDFD41DD9D6526ED28E3776C"><enum>(1)</enum><text>in section 8412,
			 by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H96E0E4D214CB463991BEA518EDBC5301" style="OLC">
						<subsection id="HCD67DADFCE8D4A7090B6C15F5382F6D5"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HF5B06F710D5F477F9E9AAF29334F8E18"><enum>(1)</enum><text>An individual serving as
				a Member on or after the date of enactment of this subsection—</text>
								<subparagraph id="HFF3847D838CD4EBBBB313B6311F867D4" indent="up1"><enum>(A)</enum><text>shall not be eligible for an annuity
				under any other provision of this section; and</text>
								</subparagraph><subparagraph id="HC35354791BC0439087162D7EAA33C46F" indent="up1"><enum>(B)</enum><text>shall be eligible for an annuity if
				the individual is separated from the service after attaining retirement age (as
				defined in section 216(l)(1) of the Social Security Act (42 U.S.C. 416(l)(1))
				and completing 5 years of service.</text>
								</subparagraph></paragraph><paragraph id="HC6F2B23142D4472B87D59D1609BA63B9" indent="up1"><enum>(2)</enum><text>This subsection applies to an
				individual serving as a Member on or after the date of enactment of this
				subsection without regard to whether the individual is separated from the
				service while serving as an employee or a
				Member.</text>
							</paragraph></subsection><after-quoted-block>;
				</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H25D732551F4846A88CA20DF4D3041194"><enum>(2)</enum><text>in section 8413,
			 by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H14E8E676E85B4C438CFA2D8E6EC7C631" style="OLC">
						<subsection id="HF237F5AF47E14212B110A62F268F9F1D"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H853F6230AEF742E0B00BBC3AF484D48D"><enum>(1)</enum><text>An individual serving as
				a Member on or after the date of enactment of this subsection—</text>
								<subparagraph id="H1CDFE364D8F3449D996819A3D63FE9B2" indent="up1"><enum>(A)</enum><text>shall not be eligible for an annuity
				under any other provision of this section; and</text>
								</subparagraph><subparagraph id="H7DC62BDBCC50482AB864C5E0B1E8FB0C" indent="up1"><enum>(B)</enum><text>if the individual is separated from
				the service, or transferred to a position in which the individual does not
				continue subject to this chapter, after completing 5 years of service, is
				eligible for an annuity beginning at retirement age (as defined in section
				216(l)(1) of the Social Security Act (42 U.S.C. 416(l)(1)).</text>
								</subparagraph></paragraph><paragraph id="HE6C4AABB236842BDB51125FB41ED8C8A" indent="up1"><enum>(2)</enum><text>This subsection applies to an
				individual serving as a Member on or after the date of enactment of this
				subsection without regard to whether the individual serves as an employee
				before, on, or after the date of enactment of this
				subsection.</text>
							</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HF44FD37A0EFB45DFA06AE378095E6705"><enum>(3)</enum><text>in section 8414,
			 by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HEF479D47A5564E87B28103E8F124CA25" style="OLC">
						<subsection id="H4C772098A49A470F9BCFE21961A0E675"><enum>(e)</enum><text>Notwithstanding
				any other provision of this section, an individual serving as a Member on or
				after the date of enactment of this subsection who otherwise meets the
				requirements for an annuity under another provision of this section shall not
				be entitled to an annuity until after attaining retirement age (as defined in
				section 216(l)(1) of the Social Security Act (42 U.S.C.
				416(l)(1)).</text>
