		<official-title>To amend the Oil Pollution Act of 1990 to facilitate the
		  ability of persons affected by oil spills to seek judicial
		  redress.</official-title>

		<section id="HC22B74E52116428081BB5999B9BE657B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Oil Spill Victims Redress
			 Act</short-title></quote>.</text>
		</section><section id="HC47F5A73E3FD4DA7A4E0EE672D7083E6"><enum>2.</enum><header>Claims
			 procedure</header><text display-inline="no-display-inline">Section 1013(a) of
			 the Oil Pollution Act of 1990 (33 U.S.C. 2713(a)) is amended by striking
			 <quote>all claims for removal costs or damages</quote> and inserting <quote>all
			 claims against each responsible party for removal costs or damages under this
			 Act</quote>.</text>
		</section><section id="HAF2F47F8E6C1428093E349D47C820852"><enum>3.</enum><header>State court
			 jurisdiction</header><text display-inline="no-display-inline">Section 1017(c)
			 of the Oil Pollution Act of 1990 (33 U.S.C. 2717(c)) is amended—</text>
			<paragraph id="H5064CEB742924B0485B9E24D239639A5"><enum>(1)</enum><text>by striking
			 <quote>A State trial</quote> and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD11F1D0CE23E48FEA5A224C28F642CAE" style="OLC">
					<paragraph id="HF5F1B662AD4943BD958122F2713EADEF"><enum>(1)</enum><header>In
				general</header><text>A State trial</text>
					</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HBD32EC48176344A18BA3B95197DFC4D0"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H0E0250AEE4AF46C48233975C499D4279" style="OLC">
					<paragraph id="H5E62E0CFAA494790A8723286B401BDD5"><enum>(2)</enum><header>Damages and
				relief</header><text>Notwithstanding any other provision of this Act, a State
				court may award damages or other relief to any person for claims under State
				law against any responsible party or other person.</text>
					</paragraph><paragraph id="H64BD7647C9DF407682B5C22081C9F04F"><enum>(3)</enum><header>Removability</header><text>A
				civil action brought in State court with respect to a discharge of oil into or
				on the navigable waters, adjoining shorelines, or the exclusive economic zone
				of the State is not within the original jurisdiction of the United States
				district courts, and is therefore not removable, unless—</text>
						<subparagraph id="HDD168AA123954DDB99FD45CF21029AD8"><enum>(A)</enum><text>a Federal claim is
				pleaded in addition to claims arising under State law; or</text>
						</subparagraph><subparagraph id="HA7F5D91FC6E143479F6DBC829B3EC107"><enum>(B)</enum><text>the action is
				otherwise removable based on diversity of citizenship pursuant to section 1332
				of title 28, United States
				Code.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H380DFE8B05F54B08BD6E2BA2E772BF20"><enum>4.</enum><header>Relationship to
			 other law</header><text display-inline="no-display-inline">Section 1018 of the
			 Oil Pollution Act of 1990 (33 U.S.C. 2718) is amended—</text>
			<paragraph id="HB869612B8EF74B2997E63C13C11F26A7"><enum>(1)</enum><text>in subsection (a),
			 by striking paragraph (1) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="HC09B9D959ABA48B8B8D1485864EC5B8E" style="OLC">
					<paragraph id="H098375B4C0124E64B20C37D64B06EBD9"><enum>(1)</enum><text>affect or preempt
				the authority of any State or political subdivision of a State from imposing,
				on any responsible party or other person, any additional liability or
				requirement with respect to—</text>
						<subparagraph id="H65D367174ACB43D1AED1E829C1686B2D"><enum>(A)</enum><text>the discharge of
				oil occurring within the State, or pollution by oil having effects within the
				State; or</text>
						</subparagraph><subparagraph id="H38B3FDC469FF45868391909440B0B3A8"><enum>(B)</enum><text>any removal
				activities in connection with such a discharge;
				or</text>
						</subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H5E4B539730DA4FAD9614A1D119216A02"><enum>(2)</enum><text>in subsection
			 (c)(1), by inserting <quote>on any responsible party or other person</quote>
			 after <quote>to impose</quote>.</text>
			</paragraph></section><section id="H03D2BC6932E84E6FB297D2E9CBD2123D"><enum>5.</enum><header>Applicability</header><text display-inline="no-display-inline">This Act and the amendments made by this Act
			 apply with respect to any claim that is pending on, or filed on or after, the
			 date of enactment of this Act.</text>
