		<official-title>To amend title 38, United States Code, to direct the
		  Secretary of Veterans Affairs to conduct cost-benefit analyses of certain
		  contracts.</official-title>

		<section id="HDF529F92D6E54703A0D10BC39ADF4B64" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Accountability in Contract Execution
			 Act</short-title></quote>.</text>
		</section><section id="H033AAE82E009439686E3C83EE6DF8CE3" section-type="subsequent-section"><enum>2.</enum><header>Cost-benefit analyses
			 of certain contracts</header>
			<subsection id="H79E177AB892648B99E7AFEA034248BCB"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter I of
			 chapter 5 of title 38, United States Code, is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H1463C8BF7DC84D89A50127DD22F8AD19" style="USC">
					<section id="H4622EF9925514B5D9FA64735863DF192"><enum>517.</enum><header>Cost-benefit
				analyses of certain contracts</header>
						<subsection id="HE0966D616F5E4541AE5393B3147E99B6"><enum>(a)</enum><header>In
				general</header><paragraph commented="no" display-inline="yes-display-inline" id="H056312344CB64C1EA0FD900441D964BC"><enum>(1)</enum><text>The Secretary
				shall—</text>
								<subparagraph id="HE6EC357B317F42F093DDE5FBC5EE23E7" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">conduct a cost-benefit analysis of each
				contract described in paragraph (2); and</text>
								</subparagraph><subparagraph id="H1403B28F97694FD999C6F4623110F68F" indent="up1"><enum>(B)</enum><text>notify the Committees on Veterans’
				Affairs of the House of Representatives and the Senate of each such contract
				and the office of the Department where the cost-benefit analysis for such
				contract is located.</text>
								</subparagraph></paragraph><paragraph id="HC6591E2D834147388528B3DC8B8C14AD" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">A
				contract described in this paragraph is a contract awarded by the Secretary
				that is valued at more than $100,000,000, including—</text>
								<subparagraph id="H395CF5069FBB473A953EE527976011C9"><enum>(A)</enum><text>a sole-source contract;</text>
								</subparagraph><subparagraph id="HA0BF1731810446C49D35998476894B25"><enum>(B)</enum><text display-inline="yes-display-inline">an
				undefinitized contract;</text>
								</subparagraph><subparagraph id="H9545651EE936429D8605071CA22B2B76"><enum>(C)</enum><text display-inline="yes-display-inline">a
				split contract; or</text>
								</subparagraph><subparagraph id="H421473092AB04A44B3CFD89E63368767"><enum>(D)</enum><text>an indefinite delivery-indefinite
				quantity contract.</text>
								</subparagraph></paragraph></subsection><subsection id="H19F734AB58274EE397AAC934044718C5"><enum>(b)</enum><header>Elements</header><text>Each
				cost-benefit analysis conducted under subsection (a)(1)(A) shall
				include—</text>
							<paragraph id="HA9DDD7EEC19D473F84BC2D5F70CEE4BC"><enum>(1)</enum><text>a cost analysis
				detailing—</text>
								<subparagraph id="H114609C3D158499785FF6F81D131C6E8"><enum>(A)</enum><text display-inline="yes-display-inline">the economic feasibility of the contract,
				including the costs and benefits;</text>
								</subparagraph><subparagraph id="HBA962D90A9114922B7922B7532F7A7ED"><enum>(B)</enum><text>the technical
				feasibility of the awarded contract, including its effectiveness and adequacy
				at achieving the stated goal of the contract;</text>
								</subparagraph><subparagraph id="H41E9AD9D40644CA1BABC1A2670729712"><enum>(C)</enum><text>the cost
				effectiveness of the contract, including why selecting the particular
				contractor provides the best value for the dollar amount of the contract;
				and</text>
								</subparagraph><subparagraph id="H106277361495468ABF836C0B74A79FED"><enum>(D)</enum><text>the manner in
				which the Secretary adhered to best industry practices in writing, bidding, and
				awarding the contract, including a description of—</text>
									<clause id="HBE7C0267F2544E7F8015ABDB7CE233F3"><enum>(i)</enum><text>any industry
				expertise used; and</text>
									</clause><clause id="HF0C6EED230C84C6DBACA7978093CF00A"><enum>(ii)</enum><text>the primary
				stakeholders related to the contract and the manner in which the Secretary
				identified such stakeholders; and</text>
									</clause></subparagraph></paragraph><paragraph id="HA3280A95645C45DDAB855B84BE2D68C7"><enum>(2)</enum><text>written
				certification that, during the contracting process, the Secretary considered
				all alternatives in a fair, competitive, and ethical contracting
				environment.</text>
							</paragraph></subsection><subsection id="H40CDC082EB374E899B0EFF9A05EAF27A"><enum>(c)</enum><header>Submission to
				Congress</header><text display-inline="yes-display-inline">Upon request by the
				Committee on Veterans’ Affairs of the House of Representatives or the Committee
				on Veterans’ Affairs of the Senate, the Secretary shall submit to such
				committee a cost-benefit analysis conducted under subsection (a)(1)(A) by not
				later than the date that is 10 days after the date of the
				request.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H31EE8085CD17490FB021AC57DA3A9F00"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections at the beginning of such chapter is amended by adding after the item
			 relating to section 516 the following new item:</text>

					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H6DA3E363F3064B2BBF545152FA65F44C"><enum>(c)</enum><header>Effective
			 date</header><text>Section 517 of title 38, United States Code, as added by
			 subsection (a), shall apply with respect to contracts entered into by the
			 Secretary of Veterans Affairs on or after the date of the enactment of this
			 Act.</text>
