Definitions
In this Act: (1)The term appropriate congressional committees means the Committee on Homeland Security of the House of Representatives and any committee of the House of Representatives or the Senate having legislative jurisdiction under the rules of the House of Representatives or Senate, respectively, over the matter concerned. (2)The term Intelligence Community has the meaning given that term in section 3(4) of the National Security Act of 1947 (50 U.S.C. 401a(4)). (3)The term national biosecurity and biodefense stakeholders means officials from the Federal, State, local, and tribal authorities and individuals and other persons from the private sector who are involved in efforts to prevent, protect against, respond to, and recover from a biological attack or other phenomena that may have serious health consequences for the United States, including wide-scale fatalities or infectious disease outbreaks.
<enum>I</enum><header>A National Biodefense Enterprise</header> <section id="HF91ED286AECF47E1BB88B9D750B0E6B3"><enum>101.</enum><header>Special Assistant for Biodefense</header> <subsection id="H7A96D8C0B2E64BE3BFA804357D57C26C"><enum>(a)</enum><header>In general</header><text>The President shall assign a member of the National Security Council to serve as Special Assistant to the President for Biodefense, who shall—</text> <paragraph id="HA2EF09FA02CC46AF9F28936BCB5E3EAE"><enum>(1)</enum><text>serve as the principal advisor to the President regarding coordination of Federal biodefense policy including prevention, protection, response, and recovery from biological attacks or other phenomena that may have serious health consequences for the United States, including wide-scale fatalities or infectious disease outbreaks;</text> </paragraph><paragraph id="H5C6C83E3325C494D9B7D9D42A107B68D"><enum>(2)</enum><text>identify gaps, duplication, and other inefficiencies in existing biodefense activities and the actions necessary to overcome these obstacles;</text> </paragraph><paragraph id="H04036E283B5B42DB8C16C6BED1B7A7A4"><enum>(3)</enum><text>lead the development of a coordinated National Biodefense Plan, in accordance with section 102;</text> </paragraph><paragraph id="H0AC80990099B404F83EDE099B1204E10"><enum>(4)</enum><text>lead the development of a coordinated National Biosurveillance Strategy, in accordance with section 103;</text> </paragraph><paragraph id="H18EE87792A6F4B0FA7DC4BB7659E002F"><enum>(5)</enum><text>lead the development of a coordinated national research and development strategy and implementation plan for microbial forensics, the latter to be updated not less than once every 4 years;</text> </paragraph><paragraph id="H2C84F8052ED34B749C5AB8B76932AABF"><enum>(6)</enum><text>oversee, in coordination with the Director of the Office of Management and Budget, the development of a comprehensive cross-cutting biodefense budget analysis to inform prioritization of resources and ensure that biodefense challenges are adequately addressed, in accordance with section 104; and</text> </paragraph><paragraph id="HB00AF43FDBB3473A9520A62CB99608FC"><enum>(7)</enum><text>conduct ongoing oversight and evaluation of implementation of Federal biodefense activities by relevant Government departments and agencies.</text> </paragraph></subsection><subsection id="H60BCDE0FBFA842CE9D25125E68E903E2"><enum>(b)</enum><header>Access by congress</header><text>The appointment of the Special Assistant to the President for Biodefense shall not be construed as affecting access by Congress or committees of either House of Congress to information, documents, and studies in the possession of, or conducted by or at the direction of, the Special Assistant.</text> </subsection></section><section id="HA7815DE481434B6A9D19465252AAA972"><enum>102.</enum><header>National Biodefense Plan</header><text display-inline="no-display-inline">The Special Assistant to the President for Biodefense shall submit to the President a National Biodefense Plan that—</text> <paragraph id="H03CE301616E44C4AAB9EE08FCCD6A743"><enum>(1)</enum><text>defines the scope and purpose of a national biodefense capability;</text> </paragraph><paragraph id="H9BA0EF3A700347AA991E7B5E92A0DF58"><enum>(2)</enum><text>identifies biological risks to the Nation to be addressed by the Plan, consistent with section 2102 of the Homeland Security Act of 2002, as amended by this Act;</text> </paragraph><paragraph id="HE7357406C76B4E1488160B02F2D50FC0"><enum>(3)</enum><text>delineates activities and tasks to be performed, including prevention, protection, response, and recovery activities, to address the risks identified under paragraph (2);</text> </paragraph><paragraph id="H372F0D89C1244814BB8BB089CA0DE243"><enum>(4)</enum><text>defines research and development needs for improving the capacity for threat awareness and prevention, protection, response, and recovery;</text> </paragraph><paragraph id="H3A000D3FAB344AB0A10EDC2126C4AC10"><enum>(5)</enum><text>identifies biodefense assets, interdependencies, capability gaps, and gaps in the integration of capabilities;</text> </paragraph><paragraph id="H549E7CDD186F46DDB6391B7F2C2953CD"><enum>(6)</enum><text>provides goals, activities, milestones, and performance measures;</text> </paragraph><paragraph id="H4B8FF87191D642C6BFF3B71B10DFA3B4"><enum>(7)</enum><text>identifies resource and investment needs;</text> </paragraph><paragraph id="H3DB7C83825114F09A659F7C35BA60ABA"><enum>(8)</enum><text>defines organizational roles, responsibilities , and coordination of Federal, State, local, and tribal authorities (as those terms are defined in the Homeland Security Act of 2002 (6 U.S.C. 101 et seq.)) with respect to the activities and tasks delineated in paragraph (3);</text> </paragraph><paragraph id="HCFAAB0EF51134E8A988046B3FA0F69E7"><enum>(9)</enum><text>integrates and supports the strategies outlined in Presidential Policy Directives 2 and 8 and Homeland Security Presidential Directives 5, 9, 10, 18, 21, and their successors, the National Biosurveillance Strategy published under section 103 of this Act, the National Medical Countermeasure Dispensing Strategy developed under section 319F–5 of the Public Health Service Act, as amended by this Act, and other strategy documents as appropriate;</text> </paragraph><paragraph id="H9FE3B71E1020425AB0A9A412DB053F4D"><enum>(10)</enum><text>is consistent with the National Response Framework as published by the Secretary of Homeland Security in January 2008, and any successors thereof;</text> </paragraph><paragraph id="H7C68A01B2618448089FA2D2BB9F4B8F0"><enum>(11)</enum><text>incorporates input from Federal, State, local, and tribal stakeholders;</text> </paragraph><paragraph id="H562EF567FBDF4848AD066237ECE70DDA"><enum>(12)</enum><text>provides planning guidance to biosecurity and biodefense stakeholders, including leveraging of existing guidance; and</text> </paragraph><paragraph id="H0FDF78400B6745BC836ABAE546967A75"><enum>(13)</enum><text>shall be submitted to the President and the Congress within 18 months after the date of the enactment of this Act, and updated as necessary.</text> </paragraph></section><section id="HBC47B6FC198C41FB9757A3863096F387"><enum>103.</enum><header>National Biosurveillance Strategy</header> <subsection id="H2FAA361321E8430A8193875BBBA2D415"><enum>(a)</enum><header>Strategy for biosurveillance</header><text>The Special Assistant to the President for Biodefense shall publish a National Biosurveillance Strategy that shall—</text> <paragraph id="HE41C1756959D42DCB15A8BBD7879F13D"><enum>(1)</enum><text>identify the purpose and scope of a nationally integrated biosurveillance capability;</text> </paragraph><paragraph id="HF7A34830295C4FE39F6F049F0893FB44"><enum>(2)</enum><text>establish goals, objectives, priorities, milestones, and performance measures to guide the development of such capability;</text> </paragraph><paragraph id="HB785414AD95D47E9A0D43FD86AA58960"><enum>(3)</enum><text>define and prioritize costs, benefits, and resource and investment needs, with particular attention to leveraging existing resources;</text> </paragraph><paragraph id="HAD67C06A169746AD996332E2D6C560E4"><enum>(4)</enum><text>delineate Federal, State, local, tribal, and private roles and responsibilities; and</text> </paragraph><paragraph id="H7441FE43321A476285979EC4761D643D"><enum>(5)</enum><text>describe how the Strategy is integrated with related national strategies.</text> </paragraph></subsection><subsection id="HDF136EFD8E97420C8127C6FF553A5D75"><enum>(b)</enum><header>Matters for consideration</header><text display-inline="yes-display-inline">In developing the strategy required under subsection (a), the Special Assistant shall take into consideration—</text> <paragraph id="H6A93F944AEF44FE084DB0F51087A1733"><enum>(1)</enum><text>the state of biosurveillance domestically and internationally;</text> </paragraph><paragraph id="H6CAE25CAA30D45719CEECC963195FCB9"><enum>(2)</enum><text>material threat assessments and determinations developed by the Secretary of Homeland Security in accordance with the Project BioShield Act of 2004 (Public Law 108–276) and the amendments made by that Act;</text> </paragraph><paragraph id="H6DBA624A4B5C43B788E8D3CDA8E1CB78"><enum>(3)</enum><text>risk assessments consistent with section 2102 of the Homeland Security Act of 2002, as amended by this Act;</text> </paragraph><paragraph id="H9F382B6B3E5441FFA2769CCF772190CA"><enum>(4)</enum><text>reports on global trends produced by the Office of the Director of National Intelligence regarding the biological threat;</text> </paragraph><paragraph id="H7A63CA6B07A141AC872E00F817BAB5D6"><enum>(5)</enum><text>Intelligence Community needs as articulated in relevant intelligence strategies;</text> </paragraph><paragraph id="HF94C8C56D45A4EC1B439A56D2A874B6B"><enum>(6)</enum><text>information available in biosurveillance systems and changes to information technology including systems used commercially to allow for the incorporation and integration of this information; and</text> </paragraph><paragraph id="HA24D25E14F974007B84312355EACCDA5"><enum>(7)</enum><text>costs associated with establishing and maintaining the necessary infrastructure to integrate biosurveillance systems.</text> </paragraph></subsection><subsection id="H8341DFB9587F4A188DD06A24407B3E82"><enum>(c)</enum><header>Implementation plan</header><text>In addition to the strategy required under subsection (a), the Special Assistant shall publish an implementation plan for such strategy that includes benchmarks for measuring the success of the Strategy. The implementation plan shall—</text> <paragraph id="HB7912DB86FE14E76A4C271A8A68A4C73"><enum>(1)</enum><text>include a plan for advancing situational awareness of biological threats, by rapid detection and dissemination of biosurveillance information in real time, and through other means;</text> </paragraph><paragraph id="H543F0D1C529348169CA76D9E921E3B32"><enum>(2)</enum><text>include a plan for fostering information sharing among national biosecurity and biodefense stakeholders—</text> <subparagraph id="HBDAB7F1219E74D578BFEDB0A71416E65"><enum>(A)</enum><text>to identify potential threats, reduce vulnerabilities, and improve collective response activities to, and investigations of, suspected biological attacks;</text> </subparagraph><subparagraph id="HDC2D8C2D74A3490490FB5A89C44DB313"><enum>(B)</enum><text>that addresses the type of information to be shared and how it will be shared; and</text> </subparagraph><subparagraph id="HFB67AC67BF3F4AA3A7C65A6EBCA03BF0"><enum>(C)</enum><text>that identifies critical sensitivities to be protected; and</text> </subparagraph></paragraph><paragraph id="HDB891C4E8C88413A843C4CD0B21424FB"><enum>(3)</enum><text>include a plan for enhancing the capability of the Federal Government to rapidly identify, characterize, localize, and track a biological event of national concern by integrating and analyzing data relating to human health, animal, plant, food, and environmental monitoring systems (both national and international).</text> </paragraph></subsection><subsection id="H837FD8C676F44BBCA9032583A4651FB7"><enum>(d)</enum><header>Deadline; submission; updates</header><text>The Special Assistant shall—</text> <paragraph id="H48DA9B27EAB84BEDA2C5283AB790B0BA"><enum>(1)</enum><text>publish the strategy, and submit it to the appropriate congressional committees, by not later than 1 year after the date of enactment of this Act; and</text> </paragraph><paragraph id="H786E7D779E7C40A4AC4A1B0EC4F46A36"><enum>(2)</enum><text>publish an implementation plan for such strategy not later than 2 years after the date of enactment of this Act, and update the implementation plan at least once every 4 years.</text> </paragraph></subsection></section><section id="HD8DE04701D324D5AA165EE0F00FA466D"><enum>104.</enum><header>Comprehensive cross-cutting biodefense budget analysis</header> <subsection id="H73426EE7727242BCA7779DB11C61FA5B"><enum>(a)</enum><header>In general</header><text>In order to enhance strategic planning, eliminate redundancies, identify capability gaps, and provide for greater transparency, the Special Assistant to the President for Biodefense, in coordination with the Director of the Office of Management and Budget, shall transmit to the appropriate congressional committees, concurrent with the submission of the President’s annual budget to the Congress, a comprehensive cross-cutting biodefense budget analysis that delineates and integrates the biodefense expenditure requests for the departments and agencies headed by the officials listed in subsection (c).</text> </subsection><subsection id="HE52E7D5DD0634D228AADFCC426780FF1"><enum>(b)</enum><header>Contents</header> <paragraph id="HDD03247B5C244B639B8CA3D3539AD4AE"><enum>(1)</enum><header>In general</header><text>The comprehensive cross-cutting biodefense budget analysis shall provide a detailed, separate analysis, by budget function, by department or agency, and by initiative area (as determined by the Administration), for the prior fiscal year, the current fiscal year, and the fiscal years for which the budget is submitted, identifying the amounts of gross and net appropriations or obligational authority and outlays that contribute to biodefense, with separate displays for mandatory and discretionary amounts, including—</text> <subparagraph id="HAA8C1E2B538B460E81ECDC90C6F1734D"><enum>(A)</enum><text>summaries of the total amount of such appropriations or obligational authority and outlays requested for biodefense;</text> </subparagraph><subparagraph id="H6FE43C5F9D55465291492F290B8EFFC1"><enum>(B)</enum><text>an estimate of the current service levels of biodefense spending; and</text> </subparagraph><subparagraph id="H9F434FD2B2F64C8AA5EBFB86C3EB9EA8"><enum>(C)</enum><text>an indication of how the Federal activities or accounts covered by the analysis support the activities delineated in the National Biodefense Plan under section 102(2).</text> </subparagraph></paragraph><paragraph id="H0318320FB41D4FDBB36C0065E1C2AEF7"><enum>(2)</enum><header>Account-level amounts</header><text>With respect to subparagraphs (A) through (C) of paragraph (1), amounts shall be provided by account for each program, project, and activity.</text> </paragraph></subsection><subsection id="HB5D05D9FED7141DEABA699B19B9F602B"><enum>(c)</enum><header>Coordination</header> <paragraph id="H700E4F2862EC49B2A5F76631EA8864C1"><enum>(1)</enum><header>Submission to special assistant</header><text display-inline="yes-display-inline">Each official listed in paragraph (2) shall, by not later than 30 days before submitting the annual appropriations request for the agency under section 1108 of title 31, United States Code, submit to the Special Assistant—</text> <subparagraph id="H4064EDA0B4924880985A4C156B597305"><enum>(A)</enum><text>the proposed appropriations request; and</text> </subparagraph><subparagraph id="H8FEA4FF872344C54B2773FC7D1BFC346"><enum>(B)</enum><text>a progress report on how the department or agency under the official’s authority agency has met the responsibilities of the official under the National Biodefense Plan under section 102.</text> </subparagraph></paragraph><paragraph id="H194482DC69B04ECCB1D24E3F42CC5425"><enum>(2)</enum><header>Covered official</header><text>The officials referred to in paragraph (1) are—</text> <subparagraph id="H46798AD3573C4C36A0C403FED7B01584"><enum>(A)</enum><text>the Secretary of Agriculture;</text> </subparagraph><subparagraph id="HAAABF60363D64B999F83B9B6E75B8A69"><enum>(B)</enum><text>the Secretary of Commerce;</text> </subparagraph><subparagraph id="HFAAE6389002546159CDBC67DC0623E00"><enum>(C)</enum><text>the Secretary of Defense;</text> </subparagraph><subparagraph id="HAA9FAC38ED594D59ABFA0FC128CD1432"><enum>(D)</enum><text>the Secretary of Energy;</text> </subparagraph><subparagraph id="H2A25FEFBB82846FD8404014FFAF20E2D"><enum>(E)</enum><text>the Secretary of Health and Human Services;</text> </subparagraph><subparagraph id="H52E4567F77B943C89E30759A2FA3DEB5"><enum>(F)</enum><text>the Secretary of Homeland Security;</text> </subparagraph><subparagraph id="HEBD6D2372EA24A64B676ADB4AF367560"><enum>(G)</enum><text>the Secretary of State;</text> </subparagraph><subparagraph id="HE6BD5F99F2074D76B3E5C2F26E963D31"><enum>(H)</enum><text>the Secretary of Veterans Affairs;</text> </subparagraph><subparagraph id="H3EDFF55EAAD24FC59AAFBC90DFCB4989"><enum>(I)</enum><text>the Attorney General;</text> </subparagraph><subparagraph id="H528659DF90134D939574029BE1E54A62"><enum>(J)</enum><text>the Administrator of the Environmental Protection Agency;</text> </subparagraph><subparagraph id="H2D2510FAF5CE491B940569052C056634"><enum>(K)</enum><text>the Director of the National Science Foundation;</text> </subparagraph><subparagraph id="H090D42AB52CF409F87F60CE1240A5B9C"><enum>(L)</enum><text>the Postmaster General of the United States; and</text> </subparagraph><subparagraph id="H3B11E3343D344E17B55B6B99BA261979"><enum>(M)</enum><text>heads of other Federal departments and agencies as considered appropriate by the Special Assistant.</text> </subparagraph></paragraph></subsection><subsection id="H26AB1E57C3064007AF9089B242BC4EE3"><enum>(d)</enum><header>Consultation with Congress</header><text>Periodically, but at least annually, the Special Assistant for Biodefense shall consult with the Committee on Homeland Security of the House of Representatives, the Committee on Homeland Security and Governmental Affairs of the Senate, the Budget Committees of the House of Representatives and the Senate, the Appropriations Committees of the House of Representatives and the Senate, and the Congressional Budget Office.</text> </subsection></section><enum>II</enum><header>Intelligence Matters</header> <section id="H82148675EE244797B386E2CE80194317"><enum>201.</enum><header>National Intelligence Strategy for Countering the Threat from Weapons of Mass Destruction</header> <subsection id="HBE113D012A214EC39342FBA6072F6A8E"><enum>(a)</enum><header>Strategy</header> <paragraph id="HA24FA310BB174DF188AC62FC9CADBAA8"><enum>(1)</enum><header>Development</header><text display-inline="yes-display-inline">The Director of National Intelligence, in consultation with the Secretary of Homeland Security and the heads of other appropriate Federal departments and agencies, shall develop and implement—</text> <subparagraph id="H35588A1F621641058FDF26C3495A6BA9"><enum>(A)</enum><text>a strategy designed to improve the capabilities of the United States to collect, analyze, and disseminate intelligence related to weapons of mass destruction; and</text> </subparagraph><subparagraph id="H0E941FA673714DA2A4AE35D37141DDC7"><enum>(B)</enum><text>a plan to implement such strategy.</text> </subparagraph></paragraph><paragraph id="H2BEF31BC2C564A1188768D5DD7D695E8"><enum>(2)</enum><header>Title</header><text display-inline="yes-display-inline">The strategy required under paragraph (1) shall be known as the <quote>National Intelligence Strategy for Countering the Threat from Weapons of Mass Destruction</quote>.</text> </paragraph></subsection><subsection id="HB7F45672DE0B4CB6B7009AC8AA1CA331"><enum>(b)</enum><header>Contents</header><text>The strategy required under subsection (a) shall—</text> <paragraph id="HA2B3A3F0BD134543BBC7E8095208D174"><enum>(1)</enum><text>identify and address core capabilities needed for successful intelligence collection on weapons of mass destruction;</text> </paragraph><paragraph commented="no" id="H9CFD7C6885274F4EB5BF23C094F9A592"><enum>(2)</enum><text>include methods for the recruitment, training, and retention of a workforce with expertise in the collection, analysis, and dissemination of intelligence related to all types of weapons of mass destruction and science and technology related to weapons of mass destruction, as well as expertise in science and technology relating to risks posed by weapons of mass destruction; and</text> </paragraph><paragraph id="H0D7AF8BB980C461AA50B17BE341BAF6E"><enum>(3)</enum><text>include methods for information sharing and collaboration, as appropriate, with non-Federal national biosecurity and biodefense stakeholders.</text> </paragraph></subsection><subsection id="HDCD6F3FD546B4425832B740FF8D02369"><enum>(c)</enum><header>Implementation plan</header><text>The plan for implementing the strategy required under subsection (a) shall include—</text> <paragraph id="H460F159EF9FF4B36A1905F185C5A567C"><enum>(1)</enum><text display-inline="yes-display-inline">actions necessary to increase the effectiveness and efficiency of the sharing of intelligence on weapons of mass destruction throughout the Intelligence Community and with other Federal partners, including a description of statutory, regulatory, policy, technical, security, or other barriers that impede such sharing, and, as appropriate, the development of uniform standards across the Intelligence Community for such sharing;</text> </paragraph><paragraph id="H745A40D6718046CA8B49FBC88FB34EAE"><enum>(2)</enum><text display-inline="yes-display-inline">methods to disseminate intelligence products to national biosecurity and biodefense stakeholders in classified and unclassified formats to increase the effectiveness and efficiency of the sharing of information;</text> </paragraph><paragraph id="H089124EC7E924DCA8B5E033600B0EAAD"><enum>(3)</enum><text>actions necessary to provide open-source intelligence relating to weapons of mass destruction to—</text> <subparagraph id="HA9AC2C55DD134FDABA2F45C6DA6DBBB6"><enum>(A)</enum><text>appropriate Federal departments and agencies;</text> </subparagraph><subparagraph id="HBCB96541F08E4418A0E03905790896B3"><enum>(B)</enum><text>State, local, and tribal authorities; and</text> </subparagraph><subparagraph id="HD9C9286B49C343A3B60D868793A83A32"><enum>(C)</enum><text>private entities;</text> </subparagraph></paragraph><paragraph id="H7B0716E39E5F4A01990ED30980801B98"><enum>(4)</enum><text>specific objectives to be accomplished, with corresponding schedule, for each year of the 5-year period that begins on the date on which the strategy is submitted to the appropriate congressional committees under subsection (e) and tasks to accomplish such objectives, including—</text> <subparagraph id="HBF4794770B534EF2A7517956744451DC"><enum>(A)</enum><text>a list prioritizing such objectives and such tasks; and</text> </subparagraph><subparagraph id="H7D42CFE694A64A19ADD27F3F1A6427B5"><enum>(B)</enum><text>a schedule for meeting such objectives and carrying out such tasks;</text> </subparagraph></paragraph><paragraph id="HFACAFDBD3DA04F29B211E6D2C917C94C"><enum>(5)</enum><text>assignments of roles and responsibilities to elements of the Intelligence Community to implement the strategy; and</text> </paragraph><paragraph id="H3E4C79A069624A2B9426EC21E31B9A10"><enum>(6)</enum><text>a schedule for assessment of the effectiveness and efficiency of the strategy, including metrics, and a description of the components of the assessment.</text> </paragraph></subsection><subsection id="H9A52ADF272FC47158FFF522023B3B296"><enum>(d)</enum><header>Coordination</header><text>The Director of National Intelligence shall coordinate with State, local, and tribal government authorities, the private sector, and nongovernmental organizations in the development of the National Intelligence Strategy for Countering the Threat from Weapons of Mass Destruction.</text> </subsection><subsection id="H31B4E666F420454A9A13B9839D88B21C"><enum>(e)</enum><header>Deadline for Submission</header><text display-inline="yes-display-inline">Not later than 6 months after the date of the enactment of this Act, the Director of National Intelligence shall submit to the appropriate congressional committees the strategy and plan required under subsection (a). The submission shall be in unclassified form but with a classified annex, as appropriate.</text> </subsection><subsection id="H704AAF4979234462B4BE30DA6993698C"><enum>(f)</enum><header>Updates</header><text>The Director of National Intelligence shall update the implementation plan at least once every 4 years.</text> </subsection></section><section display-inline="no-display-inline" id="H9598C1C1B73A4631A53BC5608F1E3290"><enum>202.</enum><header>National Intelligence Strategy for Countering Biological Threats</header> <subsection id="H5D423E6B90744711B094BB72D47D2E0C"><enum>(a)</enum><header>Strategy</header> <paragraph id="H02096C4E89EE494D9A19A2655A6474EB"><enum>(1)</enum><header>Development</header><text display-inline="yes-display-inline">The Director of National Intelligence, in consultation with the Secretary of Homeland Security, the Secretary of Health and Human Services, the Secretary of Agriculture, the Special Assistant to the President for Biodefense, and the heads of other appropriate Federal departments and agencies, shall develop and implement a strategy and a plan for implementing the strategy that is integrated into the National Intelligence Strategy for Countering the Threat from Weapons of Mass Destruction, as required under this title.</text> </paragraph><paragraph id="H966A47C6EF0D4FF6BD25A8D29325755C"><enum>(2)</enum><header>Title</header><text display-inline="yes-display-inline">The strategy required under paragraph (1) shall be known as the <quote>National Intelligence Strategy for Countering Biological Threats</quote>.</text> </paragraph></subsection><subsection id="H914A74B124B54DEC9CCFA45EA7E6701C"><enum>(b)</enum><header>Contents</header><text>The strategy required under subsection (a) shall—</text> <paragraph id="H177DAB153B5C4D19B1F8007E7E113D00"><enum>(1)</enum><text>identify and address target capabilities needed for successful intelligence collection on biological threats;</text> </paragraph><paragraph id="H812390D7181A402AA52C1E975AF2CAC1"><enum>(2)</enum><text>include a plan for establishing in the Intelligence Community a cadre of collectors and analysts in all relevant agencies in the Intelligence Community that are familiar with biological threats, biological science, and biotechnology, including—</text> <subparagraph id="H7C02454447404ED398A4C7A40ABBA573"><enum>(A)</enum><text display-inline="yes-display-inline">biological scientists;</text> </subparagraph><subparagraph id="HE1308980D044489B9BAE95C97414BCF8"><enum>(B)</enum><text>biotechnologists; and</text> </subparagraph><subparagraph id="H1C3D5C445B874D729E4082D24D0D4CD3"><enum>(C)</enum><text>experts with knowledge of the current state of technologies that could be used to develop a weapon of mass destruction;</text> </subparagraph></paragraph><paragraph commented="no" id="HADC22543714749FE9FD5C325648970B1"><enum>(3)</enum><text>include a plan for defining the functions, capabilities, and gaps in the Intelligence Community workforce with respect to assessing the biological threat;</text> </paragraph><paragraph id="H2AC981C374E147AD9E86B7B4BBDB933C"><enum>(4)</enum><text>include methods for collaboration—</text> <subparagraph id="H708A8E235B4E42E58C790FEF3D635C55"><enum>(A)</enum><text display-inline="yes-display-inline">with non-Intelligence Community technical experts within Federal departments and agencies; and</text> </subparagraph><subparagraph id="H198E9B9A25314CC3A115137D12E68A9D"><enum>(B)</enum><text display-inline="yes-display-inline">as appropriate, with individuals with expertise described in paragraph (2) who are not employed by the Federal Government, in particular with State and local biodefense stakeholders;</text> </subparagraph></paragraph><paragraph id="HC4E90E0A15104F7FBE128C71EFB7F8F3"><enum>(5)</enum><text>include a plan for defining, integrating, focusing, and enhancing existing capabilities in the Intelligence Community dedicated to current and strategic biological threats; and</text> </paragraph><paragraph id="H950AEAA1AF4D4FCE8E3A7076447C7BDD"><enum>(6)</enum><text>include a plan for ensuring the prioritization and sustained commitment of intelligence personnel and resources to address biological threats.</text> </paragraph></subsection><subsection id="H424FD518073042038D4BC922ABE2FDFB"><enum>(c)</enum><header>Implementation plan</header><text>The implementation plan for the strategy required under subsection (a) shall—</text> <paragraph id="H0DE8CD0E705E422FBF89931FE4DD5E0D"><enum>(1)</enum><text>include actions necessary to increase the effectiveness and efficiency of the sharing of intelligence throughout the Intelligence Community on biological weapons and organisms that could be used for biological terrorism, including a description of statutory, regulatory, policy, technical, security, or other barriers that prevent such sharing, and, as appropriate, the development of uniform standards across the Intelligence Community for such sharing;</text> </paragraph><paragraph id="HAA25CCAABC1442F08551F4FADEA2BA5B"><enum>(2)</enum><text>address strategic and tactical human intelligence, measurement and signature intelligence, technical intelligence, medical intelligence, and open-source intelligence activities necessary to implement the strategy;</text> </paragraph><paragraph id="HB25255A2E1D34A16BCD57A6E987C9180"><enum>(3)</enum><text>identify specific objectives to be accomplished during each year of the 5-year period that begins on the date on which the strategy is submitted to the appropriate congressional committees under subsection (d) and tasks to accomplish such objectives, including—</text> <subparagraph id="HD09BBBA2F8FF45608AD8BA9E86B52E6D"><enum>(A)</enum><text>a list prioritizing such objectives and such tasks; and</text> </subparagraph><subparagraph id="HC0FD414F9FB44198A43333BBF89D1A45"><enum>(B)</enum><text>a schedule for meeting such objectives and carrying out such tasks;</text> </subparagraph></paragraph><paragraph id="H7AA3344DC5D544AE83E21D1988970994"><enum>(4)</enum><text>assign roles and responsibilities to elements of the Intelligence Community to implement the strategy;</text> </paragraph><paragraph id="HF5773F9DCC9A4910A58B36554A19D54D"><enum>(5)</enum><text>a schedule for assessment of the effectiveness and efficiency of the strategy, including metrics; and</text> </paragraph><paragraph id="H856476D25B5E44FE9B5CCA5A562CCE36"><enum>(6)</enum><text>a schedule for evaluating on a regular basis the efforts of the Intelligence Community and progress on understanding and countering biological threats.</text> </paragraph></subsection><subsection display-inline="no-display-inline" id="HC7FF17A21ECF4082AC2DFA79AC3804BA"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Director of National Intelligence shall submit to the appropriate congressional committees the strategy and plan required under subsection (a). The report shall be in unclassified form but with a classified annex, as appropriate.</text> </subsection><subsection id="H6699257166A246088FE759B0A0C9ED65"><enum>(e)</enum><header>Updates</header><text>The Director of National Intelligence shall update the implementation plan at least once every 4 years.</text> </subsection></section><section id="H55CB8C4F0E734B58AAA2A2012F1BF896"><enum>203.</enum><header>State, local, and tribal defined</header><text display-inline="no-display-inline">In this title, the term <quote>State, local, and tribal</quote> has the same meaning that term has in the Homeland Security Act of 2002 (6 U.S.C. 101 et seq.).</text> </section><enum>III</enum><header>Homeland Security Matters</header> <section id="H418437AFD55C483F97ACEE7C93A9B4A6"><enum>301.</enum><header>Weapons of mass destruction prevention and preparedness</header> <subsection id="H89B1FD16614040DA96ED2B60A0E5DA97"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Homeland Security Act of 2002 (6 U.S.C. 101 et seq.) is amended by adding at the end the following new title:</text> <quoted-block changed="added" committee-id="HHM00" display-inline="no-display-inline" id="HE27A02DF6A444C0F9B7FE49D2D2D0CC5" reported-display-style="italic" style="OLC"> <title id="HB1548B1C19BE446DAE039FAA6AD159BC"><enum>XXI</enum><header>WEAPONS OF MASS DESTRUCTION PREVENTION AND PREPAREDNESS</header> <subtitle id="H407FC81B80E74F62884474CF23D54F26"><enum>A</enum><header>Prevention </header> <section id="H79DC1A7191314E5AA03A0B9B79E7BC80"><enum>2101.</enum><header>Weapons of mass destruction intelligence and information sharing</header> <subsection id="H8D4563D377EF4AFFA03BED374177E5DE"><enum>(a)</enum><header>In general</header><text>The Office of Intelligence and Analysis of the Department shall—</text> <paragraph id="H112EADBDBD2D426E8CB07CE2FFB90F90"><enum>(1)</enum><text>conduct intelligence and information sharing activities consistent with the National Intelligence Strategy for Countering the Threat from Weapons of Mass Destruction under section 201 of the <short-title>WMD Prevention and Preparedness Act of 2012</short-title> and the National Intelligence Strategy for Countering Biological Threats under section 202 of that Act;</text> </paragraph><paragraph id="HDD8EFA92EA3542C59A68F4ED92CE22CD"><enum>(2)</enum><text display-inline="yes-display-inline">support homeland security-focused intelligence analysis of terrorist actors, their claims, and their plans to conduct attacks involving chemical, biological, radiological, and nuclear materials against the Nation;</text> </paragraph><paragraph id="H975F7386BAD14076AD2936D8D7F62ACF"><enum>(3)</enum><text>support homeland security-focused intelligence analysis of global infectious disease, public health, food, agricultural, and veterinary issues;</text> </paragraph><paragraph id="H0624EBACB6A34D0FAD6D3AE741A8C2F2"><enum>(4)</enum><text>support homeland security-focused risk analysis and risk assessments of the homeland security hazards described in paragraphs (2) and (3), by providing relevant quantitative and nonquantitative threat information;</text> </paragraph><paragraph id="HF0CA9E7F42AD45688170CBD605310668"><enum>(5)</enum><text>leverage existing and emerging homeland security capabilities and structures, including fusion centers established pursuant to section 210A, to enhance prevention, protection, response, and recovery efforts with respect to a chemical, biological, radiological, or nuclear attack;</text> </paragraph><paragraph id="HED0EDAA7EB404E649A3AEBD3A50E9A53"><enum>(6)</enum><text>share information and provide tailored analytical support on these threats to State, local, and tribal authorities as well as other national biosecurity and biodefense stakeholders; and</text> </paragraph><paragraph id="H019F6D4461974C0EA429FBF9E365ADD9"><enum>(7)</enum><text>perform other responsibilities, as assigned by the Secretary.</text> </paragraph></subsection><subsection id="H2AFFB87C88F24ADFB4CB46CC6F1BC0B0"><enum>(b)</enum><header>Coordination</header><text display-inline="yes-display-inline">Where appropriate, the Office of Intelligence and Analysis shall coordinate with other relevant Department components, others in the Intelligence Community, including the National Counter Proliferation Center, and other Federal, State, local, and tribal authorities, including officials from high-threat areas, and enable such entities to provide recommendations on optimal information sharing mechanisms, including expeditious sharing of classified information, and on how they can provide information to the Department.</text> </subsection><subsection id="HCEE5008CB5874270800EE873BA53CA66"><enum>(c)</enum><header>Report</header> <paragraph id="H8F5A4F8E11D34D969ED9B33B30D3DCFF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this section and annually thereafter, the Secretary shall report to the appropriate congressional committees on—</text> <subparagraph id="HB089FB558C764B43AABAE51185127616"><enum>(A)</enum><text>the intelligence and information sharing activities under subsection (a) and of all relevant entities within the Department to counter the threat from weapons of mass destruction; and</text> </subparagraph><subparagraph id="H54770B4D301B42BE91858ABFFF5BDC1F"><enum>(B)</enum><text>the Department’s activities in accordance with relevant intelligence strategies, including the National Intelligence Strategy for Countering the Threat from Weapons of Mass Destruction and the National Intelligence Strategy for Countering Biological Threats.</text> </subparagraph></paragraph><paragraph id="H4987D45163194A36BC33F99D761837D3"><enum>(2)</enum><header>Assessment of implementation</header><text>The report shall include—</text> <subparagraph id="HCE25E72656524F1CB4B382C1C88FFF5C"><enum>(A)</enum><text>a description of methods established to assess progress of the Office of Intelligence and Analysis in implementing this section; and</text> </subparagraph><subparagraph id="H12ECA5181BB3415B8EF093B77ECED813"><enum>(B)</enum><text>such assessment.</text> </subparagraph></paragraph></subsection></section><section id="H997E6C2026114E8CA5FAE8C0A0833B97"><enum>2102.</enum><header>Risk assessments</header> <subsection id="HCB3F9CDB8B5F4800BC25E70685A792EF"><enum>(a)</enum><header>In general</header><text>The Secretary, acting through the Under Secretary for Science and Technology, shall, in coordination with relevant Department components and other appropriate Federal departments and agencies—</text> <paragraph id="H8A8EE0BFB01245B6A99B6C6ECDAFD8CB"><enum>(1)</enum><text>produce and update periodically a terrorism risk assessment of chemical, biological, radiological, and nuclear threats; and</text> </paragraph><paragraph id="HD2C228A3010B46D4A3AF501AEEFE814B"><enum>(2)</enum><text>produce and update periodically an integrated terrorism risk assessment that assesses all of those threats and compares them against one another according to their relative risk.</text> </paragraph></subsection><subsection id="HD260B28E4DE049FC9CBF1E03A76D25AE"><enum>(b)</enum><header>Methodology</header> <paragraph id="H9F0481D32E7149E0AAD43E35D5CCEF88"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall—</text> <subparagraph id="H4CF6895073994385817F34FCD3061604"><enum>(A)</enum><text>convene an interagency task force of relevant subject matter experts to assess the proposed methodology to be used for assessments required under subsection (a), and to provide recommendations to the Secretary as to the adequacy of such methodology;</text> </subparagraph><subparagraph id="H93283EFB1C774DE7B2768533782D1D60"><enum>(B)</enum><text>conduct sensitivity analysis on each assessment to identify and prioritize research activities to close knowledge gaps; and</text> </subparagraph><subparagraph id="H77CE851FB20843F0BF6A7F4B6993F5E1"><enum>(C)</enum><text>consider the evolving threat from an intelligent adversary.</text> </subparagraph></paragraph><paragraph id="H580C5D1FBA0944FC83CDE9B11F410157"><enum>(2)</enum><header>Inclusion in assessment</header><text>Each assessment under subsection (a) shall include a description of the methodology used for the assessment.</text> </paragraph></subsection><subsection id="HADA8A6078D074992AAC38DC1EC0C572B"><enum>(c)</enum><header>Usage</header><text>The assessments required under subsection (a) shall be used to inform and guide risk management decisions, including—</text> <paragraph id="H24860CAC157645A8AE8C9F8912019599"><enum>(1)</enum><text>the threat assessments and determinations by the Secretary regarding agents and toxins pursuant to section 319F–2 of the Public Health Service Act;</text> </paragraph><paragraph id="H8670148F5BC347559255A80AF78A211B"><enum>(2)</enum><text>allocation of resources for research and development for chemical, biological, radiological, and nuclear attack prevention, protection, response, and recovery;</text> </paragraph><paragraph id="H283B1D4CE211462AB7D58051C580E7B3"><enum>(3)</enum><text>prioritization of medical countermeasure research, development, acquisition, and distribution activities and other national strategic biodefense research;</text> </paragraph><paragraph id="HEEFA2394EB344BEE904331ADDCF99B98"><enum>(4)</enum><text>tailored risk assessments and risk mitigation studies, as appropriate, on topics such as radiological materials security or the economic risks of a biological attack; and</text> </paragraph><paragraph id="HD0F0C5CBBF50452EAE1D790C876599B7"><enum>(5)</enum><text>other homeland security activities as determined appropriate by the Secretary and the heads of other agencies.</text> </paragraph></subsection><subsection id="H80DE389188594A828C5A2E40B1369730"><enum>(d)</enum><header>Input and sharing</header><text>The Secretary shall, for each assessment required under subsection (a)—</text> <paragraph id="HA70F4926EEA444DD9B7EF039DA5E441B"><enum>(1)</enum><text>seek input from national biosecurity and biodefense stakeholders, and other Federal, State, local, and tribal officials involved in efforts to prevent, protect, respond to, and recover from chemical, biological, radiological, and nuclear threats;</text> </paragraph><paragraph id="HF5E87E007BC24951A5064C6320B6D0BA"><enum>(2)</enum><text>ensure that written procedures are in place to guide the interagency development of the assessments, including for input, review, and implementation purposes, among relevant Federal partners;</text> </paragraph><paragraph id="HB1F8FD2537374C2EA9A916B1242B1A41"><enum>(3)</enum><text>share the risk assessments with Federal, State, local and tribal officials with appropriate security clearances and a need for the information in the classified version; and</text> </paragraph><paragraph id="HE113F5D53E624CED98219CCC1429FC8F"><enum>(4)</enum><text>to the maximum extent practicable, make available an unclassified version for Federal, State, local, and tribal officials involved in prevention and preparedness for chemical, biological, radiological, and nuclear events.</text> </paragraph></subsection><subsection id="H1F972EC6CBA6407FB0D8114709F6D7F5"><enum>(e)</enum><header>Written procedures</header><text display-inline="yes-display-inline">The Secretary shall establish written procedures for appropriate usage of the assessments required under subsection (a), including—</text> <paragraph id="H23F20B09E3424B42A4EF9BB2F3086214"><enum>(1)</enum><text display-inline="yes-display-inline">a description of the types of departmental activities for which the assessments should be considered;</text> </paragraph><paragraph id="H49C5D7EF24E04E3DB9EA14FC1F0D5FA0"><enum>(2)</enum><text>the extent to which the findings of the assessments should play a role in such activities;</text> </paragraph><paragraph id="H1EA71226019F4F55BC1E18DCE8765F32"><enum>(3)</enum><text>the point in planning processes at which the assessments should be considered; and</text> </paragraph><paragraph id="H56126DA1A1EA4B03944A704F701A6577"><enum>(4)</enum><text>how users can access expertise within the Department to aid in interpretation of the results of the assessments.</text> </paragraph></subsection></section><section id="H3341A7E6A4AF4F5498962E5E8A3FA677"><enum>2103.</enum><header>National Export Enforcement Coordination</header> <subsection id="H9680363139384AD1B7B97C06D91F0E03"><enum>(a)</enum><header>Establishment</header><text>There shall be maintained in the Department the Export Enforcement Coordination Center, with capability for national export enforcement coordination that is managed by the Secretary and coordinates the export enforcement activities among the Department, the Department of Agriculture, the Department of Commerce, the Department of Defense, the Department of Energy, the Department of Justice, the Department of State, the Department of the Treasury, the Intelligence Community, and other Federal agencies as appropriate.</text> </subsection><subsection id="H179DB9EB8CC64CA8A6664D2C57F8E33C"><enum>(b)</enum><header>Responsibilities</header><text>The Center shall—</text> <paragraph id="H1F8EC81902274808B07BF991614E5931"><enum>(1)</enum><text>enhance Federal coordination for law enforcement counterproliferation investigations, including coordination and deconfliction with intelligence counterproliferation activities;</text> </paragraph><paragraph id="H9AF18B29F0F84DE8BE25D4186DF73F31"><enum>(2)</enum><text>address licensing inquiries, reviews, requests, checks, and verifications; and</text> </paragraph><paragraph id="H3B5989ED7F7F4FFC9F6971B992C5EB58"><enum>(3)</enum><text>conduct outreach and provide training to the export trade community.</text> </paragraph></subsection></section><section id="HE096850881F149C8AABC646812D2F7FF"><enum>2104.</enum><header>Communication of threat information</header> <subsection id="HF1A97AA9F51D4DCF8192FD26C2E986E1"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text> <paragraph id="H0DFD7574A4CE420F85B53EF1405313E3"><enum>(1)</enum><text>The Commission on the Prevention of Weapons of Mass Destruction Proliferation and Terrorism recommended that <quote>the Federal Government should practice greater openness of public information so that citizens better understand the threat and the risk this threat poses to them</quote>.</text> </paragraph><paragraph id="HF48A0D9CB88C4C8D9DE7F81FFA916097"><enum>(2)</enum><text>There are unique challenges for community preparedness for attacks from weapons of mass destruction.</text> </paragraph></subsection><subsection display-inline="no-display-inline" id="HD17BCC08958F4BDDB42003EFB5A399CA"><enum>(b)</enum><header>Communications plan</header> <paragraph id="HF2831A38AFEF4E118465274C7D00BC32"><enum>(1)</enum><header>In general</header><text>The Administrator of the Federal Emergency Management Agency shall develop a communications plan designed to provide information to the public related to preventing, preparing for, responding to, and recovering from chemical, biological, radiological, and nuclear attacks;</text> </paragraph><paragraph id="H8A37EECBE049419E90A77463896202D4"><enum>(2)</enum><header>Consultation</header><text>As appropriate, the Administrator of the Federal Emergency Management Agency shall consult with State, local, and tribal authorities and coordinate with other Federal departments and agencies in developing the communications plans under paragraph (1).</text> </paragraph><paragraph id="HA4B2EF0A56C542B28A8CD147E1FBE35A"><enum>(3)</enum><header>Pre-scripted messages and message templates</header> <subparagraph id="H26E6C5934DA94EB0B4278B7FD1AAD189"><enum>(A)</enum><header>In general</header><text>The Administrator of the Federal Emergency Management Agency shall develop and disseminate, through an alerts and warnings system, pre-scripted messages and message templates for State, local, and tribal authorities so that those authorities can quickly and rapidly disseminate critical information to the public in anticipation of, during, or in the immediate aftermath of a chemical, biological, radiological, and nuclear attack, and to be included in the Department of Homeland Security’s lessons learned information sharing system.</text> </subparagraph><subparagraph id="H871DAD9CD830479086CEAE92DA36181E"><enum>(B)</enum><header>Development and design</header><text>The pre-scripted messages or message templates shall—</text> <clause id="H3A21EEBCAEAC4DE485B43FD9139ED541"><enum>(i)</enum><text>be developed in consultation with State, local, and tribal authorities and in coordination with other appropriate Federal departments and agencies;</text> </clause><clause id="H5FF47FBF4F5D45D682239FBE7869DC78"><enum>(ii)</enum><text>be designed to provide accurate, essential, and appropriate information and instructions to the population directly affected by an incident, including information regarding an evacuation, sheltering in place, hospital surge operations, health, and safety;</text> </clause><clause id="HC1419EFFC0374875BFB2718462346122"><enum>(iii)</enum><text>be designed to provide accurate, essential, and appropriate information and instructions to children and other special needs populations within the population directly affected by an incident;</text> </clause><clause id="HEC7865F08D424250A8BC813796671192"><enum>(iv)</enum><text>be designed to provide accurate, essential, and appropriate information and instructions to emergency response providers and medical personnel responding to an incident; and</text> </clause><clause id="H2AB29347E2B14F05B26ABCEE3EC8E815"><enum>(v)</enum><text>include direction for the coordination of Federal, State, local, and tribal communications teams.</text> </clause></subparagraph><subparagraph id="HDDAA6D9A407548E8B2DBAF60E2338480"><enum>(C)</enum><header>Communications formats</header><text>The Administrator shall develop pre-scripted messages or message templates under this paragraph in multiple formats to ensure delivery—</text> <clause id="HAE283448248D443992753150051D47BC"><enum>(i)</enum><text>in cases where the usual communications infrastructure is unusable;</text> </clause><clause id="HACCB6DCE851944D0A639CFA58C95D428"><enum>(ii)</enum><text>to individuals with disabilities or other special needs and individuals with limited English proficiency; and</text> </clause><clause id="H81E616BBE10341688E04D5BDCE946232"><enum>(iii)</enum><text>to educational and childcare facilities, including daycare centers, grade schools, universities, hospitals, and elderly care facilities.</text> </clause></subparagraph><subparagraph id="H46B02F2D931F4248A76A62827A6C64B5"><enum>(D)</enum><header>Dissemination and technical assistance</header><text>The Administrator shall ensure that all pre-scripted messages and message templates developed under this paragraph are made available to State, local, and tribal authorities so that those authorities may incorporate them, as appropriate, into their emergency plans. The Administrator shall also make available relevant technical assistance to those authorities to support communications planning.</text> </subparagraph><subparagraph id="HB048DF6B5E3B4925A312D00037696D75"><enum>(E)</enum><header>Exercises</header><text>To ensure that the pre-scripted messages or message templates developed under this paragraph can be effectively utilized in a disaster or incident, the Administrator shall incorporate Federal, State, local, and tribal communications teams that deliver such pre-scripted messages or message templates into exercises, including those conducted under the National Exercise Program.</text> </subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H04CD272DBDDF4265B330F2383F1FEA1B"><enum>(4)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this subsection, the Administrator of the Federal Emergency Management Agency shall submit to the appropriate congressional committees the communications plans required to be developed under this subsection, including pre-scripted messages or message templates developed in conjunction with the plans and a description of the means that will be used to deliver these messages during such incidents.</text> </paragraph></subsection><subsection id="H59F3BE8B35AB4A5D9BCB8259A89735EA"><enum>(c)</enum><header>Terrorism threat awareness</header> <paragraph id="HABF3F75EFDF74F04A3AD5737DC1969BA"><enum>(1)</enum><header>Terrorism threat awareness</header><text>The Secretary, in coordination with the Attorney General and heads of appropriate Federal agencies, shall for purposes of preparedness and collective response to terrorism and for other purposes—</text> <subparagraph id="HC1E000694C4444CAB9A92A3CCFAEC5B9"><enum>(A)</enum><text>ensure that homeland security information concerning terrorist threats is provided to State, local, and tribal authorities and the public within the United States, as appropriate; and</text> </subparagraph><subparagraph id="H1EF9466D5EEA42B498EDB0363D316177"><enum>(B)</enum><text>establish a process to optimize opportunities for qualified heads of State, local, and tribal government entities to obtain appropriate security clearances so that they may receive classified threat information when appropriate.</text> </subparagraph></paragraph><paragraph id="HA4DB5F71695C4F9C81ECC327E4570ABE"><enum>(2)</enum><header>Threat bulletins</header> <subparagraph id="HC434FC62641843EE874A32CBDF7771B3"><enum>(A)</enum><header>In general</header><text>Consistent with the requirements of paragraph (1), the Secretary shall, on a timely basis, prepare unclassified threat bulletins on chemical, biological, radiological, and nuclear threats.</text> </subparagraph><subparagraph id="H0AE5C145830646E2B1E458B1DC17801B"><enum>(B)</enum><header>Requirements</header><text>Each assessment required under subparagraph (A) shall—</text> <clause id="H497E8D21BE8F407CA90C315464D1B1A7"><enum>(i)</enum><text>include guidance to the public for preventing and responding to acts of terrorism arising from such threats; and</text> </clause><clause id="H47E3E09D2ED34E9E8698C7901148A14B"><enum>(ii)</enum><text>be made available on the Internet Web site of the Department and other publicly accessible Internet Web sites, communication systems, and information networks.</text> </clause></subparagraph></paragraph><paragraph id="HDDCB6E87E92E455B8EC3090F34933922"><enum>(3)</enum><header>Guidance to State, local, and tribal authorities</header><text display-inline="yes-display-inline">The Secretary, using information provided by the terrorism risk assessments under section 2102 and material threat assessments and determinations under the Project BioShield Act of 2004 (Public Law 108–276) and the amendments made by that Act—</text> <subparagraph id="H0C0F52D8F66041ACACEC20B10F93E675"><enum>(A)</enum><text display-inline="yes-display-inline">shall provide to State, local, and tribal authorities written guidance on communicating terrorism-related threats and risks to the public within their jurisdictions; and</text> </subparagraph><subparagraph id="HF4490ABFAF2C455391C6927526BB08E5"><enum>(B)</enum><text>shall identify and articulate the governmental rationale for identifying particular communities as being at heightened risk of exploitation.</text> </subparagraph></paragraph><paragraph id="H84D80C2255E74A1C93039D2C7979A3D2"><enum>(4)</enum><header>Use of existing resources</header><text display-inline="yes-display-inline">The Secretary shall use Internet Web sites, communication systems, and information networks in operation on the date of an assessment under this subsection, and shall coordinate with other heads of Federal departments and agencies to provide information through existing channels to satisfy the requirements of paragraph (2)(B)(ii). The Secretary shall provide guidance on how State, local, tribal, and private entities can partner with public television stations to disseminate information provided by the Department and shall provide information on best practices on disseminating information to residents of local communities, including leveraging public television stations.</text> </paragraph></subsection></section><section id="H43CA86B728EC4D2BA4B2C9627190FE55"><enum>2105.</enum><header>Individual and community preparedness for chemical, biological, radiological, and nuclear attacks</header> <subsection id="HF0278A3655DE41EBB829E535108C47D2"><enum>(a)</enum><header>In general</header><text>The Secretary, acting through the Administrator for the Federal Emergency Management Agency, shall assist State, local, and tribal authorities in improving and promoting individual and community preparedness and collective response to terrorist attacks involving chemical, biological, radiological, and nuclear materials against the United States by—</text> <paragraph id="H2C950C5EF8784DBBBBD784B80B1A68FA"><enum>(1)</enum><text>developing guidance and checklists of recommended actions for individual and community prevention and preparedness efforts and disseminating such guidance and checklists to communities and individuals;</text> </paragraph><paragraph id="H12DB62D24921489FA91AAE357407A8DC"><enum>(2)</enum><text>updating new and existing guidance and checklists as appropriate;</text> </paragraph><paragraph id="HF680956469ED4865A55096BBA8B51A6F"><enum>(3)</enum><text>disseminating to communities and individuals the guidance developed under section 2131, as appropriate;</text> </paragraph><paragraph id="H225D7F6DA32F4E2B9DB452DFAD441191"><enum>(4)</enum><text>providing information and training materials in support of individual and community preparedness efforts;</text> </paragraph><paragraph id="H9EFBECFD44314E41BC11AF24F4C73EB0"><enum>(5)</enum><text>conducting individual and community preparedness outreach efforts; and</text> </paragraph><paragraph id="HA5D2DDA86CF64CDA8D86BF567E443235"><enum>(6)</enum><text>such other actions as the Secretary determines appropriate.</text> </paragraph></subsection><subsection id="H2CB710C8C0E642428387C29503D74170"><enum>(b)</enum><header>Coordination</header><text display-inline="yes-display-inline">The Secretary shall coordinate with Federal departments and agencies and with private sector and nongovernmental organizations to promote individual and community preparedness and collective response to terrorist attacks involving chemical, biological, radiological, and nuclear materials against the United States.</text> </subsection><subsection id="H91FA7C9DF05541408A88F5CDBEEFFD22"><enum>(c)</enum><header>Best practices</header><text>In compiling guidance for individual and community preparedness in order to carry out subsection (a)(4), the Secretary shall give due regard to best practices based on the experience of other agencies and countries and the expertise of academic institutions and nongovernmental organizations.</text> </subsection></section></subtitle><subtitle id="H8365C4E2DEBC4BE6932182B8C1F3E288"><enum>B</enum><header>Protection</header> <section id="HDD3F6BAA1667494091400F0543ACD374"><enum>2121.</enum><header>Detection of biological attacks</header> <subsection id="HB5F890592D55463C9FFC4F491E0AC9BD"><enum>(a)</enum><header>Program</header><text>The Secretary shall carry out a program to detect a biological attack or event that poses a high risk to homeland security. Through such program, the Secretary shall—</text> <paragraph id="H2404A0A76F6F4F3998A19CCFFB908C58"><enum>(1)</enum><text>deploy detection capabilities to areas, based on high risks identified by Department assessments, to indicate the presence of biological agents;</text> </paragraph><paragraph id="H4F561D598B96444A94B160B0DDFD31BE"><enum>(2)</enum><text>consider multiple deployment strategies including surge capability;</text> </paragraph><paragraph id="HB9226C6DF6D64BFC944E23AA925E0BB9"><enum>(3)</enum><text>provide information to participating laboratories and programs for their use in monitoring public health, and biological material or other data from those detectors to participating laboratories and programs for testing and evaluation;</text> </paragraph><paragraph id="H7214B61331764EE0B2716D9677513D9A"><enum>(4)</enum><text>regularly communicate with, and provide information about the presence of biological agents to, appropriate Federal, State, and local agencies responsible for public health, law enforcement, and emergency services, in a manner that ensures transparency with the governments served by such personnel;</text> </paragraph><paragraph id="H65E215770C214F0D98435EE096B861E7"><enum>(5)</enum><text display-inline="yes-display-inline">provide advanced planning tools, concepts of operations (including alarm resolution protocols and response guidance), standard operating procedures, and training exercises (including in collaboration with relevant national level exercises) for collective response to and recovery from biological attacks; and</text> </paragraph><paragraph id="H2F2792CB2B0B462AA19DF5F3CE1BF7FB"><enum>(6)</enum><text>provide technical assistance to jurisdictions hosting the program to improve their ability to respond to a detected pathogen.</text> </paragraph></subsection><subsection id="H118E3D338D694979A23EE3CC2BF136F3"><enum>(b)</enum><header>Program requirements</header><text>Under the program required under subsection (a), the Secretary shall—</text> <paragraph id="H2969D348237E499195E5CB735B7E751D"><enum>(1)</enum><text>enter into memoranda of agreement or interagency agreements under the Economy Act of 1933 (31 U.S.C. 1535 et seq.) with the Director of the Centers of Disease Control and Prevention and the Administrator of the Environmental Protection Agency, and the heads of other Federal departments and agencies, setting forth roles and responsibilities, including with respect to validating performance and developing testing protocols for participating laboratories and coordination with appropriate State, local, and tribal agencies;</text> </paragraph><paragraph id="H14CC8707B9B64D928793BFCB54E413AA"><enum>(2)</enum><text>establish criteria for determining whether plans for biological detector capabilities and coverage sufficiently protect the United States population, and make such determinations on an annual basis;</text> </paragraph><paragraph id="H1B7AA87D433347C387F4149AE082397B"><enum>(3)</enum><text display-inline="yes-display-inline">acting through the Under Secretary for Science and Technology, and in consultation with the Director of the Centers for Disease Control and Prevention, implement a process for establishing assay performance standards and evaluation for equivalency for biological threat assays, that—</text> <subparagraph id="H034A16AAFCC9447FAD920CE719F62300"><enum>(A)</enum><text>evaluates biological threat detection assays, their protocols for use, and their associated response algorithms for confirmation of biological threat agents, taking performance measures and concepts of operation into consideration;</text> </subparagraph><subparagraph id="HE2B8311FE1F64741AEB5FFC66CC4ED58"><enum>(B)</enum><text>develops interagency peer-reviewed assay performance and equivalency standards based on the findings of the evaluation under subparagraph (A);</text> </subparagraph><subparagraph id="H96FC58DEBD234E058AB00C2EC1E72845"><enum>(C)</enum><text>requires implementation of the standards developed under subparagraph (B) for all Department biological detection programs;</text> </subparagraph><subparagraph id="HCDCAB48F508C47B0B9EB9BA1D1479BCF"><enum>(D)</enum><text>promotes use of such standards among all other Federal biological detection programs and makes them available to the private sector and other end-users as appropriate; and</text> </subparagraph><subparagraph id="HC79BD09AF1B14D96B03AB82A77FD78CB"><enum>(E)</enum><text>is updated as necessary;</text> </subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HD57723CDE4B943838462CB50366D1EB7"><enum>(4)</enum><text>prior to obligating funds to acquire biodetection systems for purposes of operational testing and evaluation, require—</text> <subparagraph id="HC2AA218BF5AF4B6B89401D7BAEC8ABA9"><enum>(A)</enum><text>a determination of the sensitivity and specificity of the currently deployed biodetection system;</text> </subparagraph><subparagraph id="HF577387617AE48A0A797A26DB1FB1A4D"><enum>(B)</enum><text>an assessment of the sensitivity and specificity of the next generation biodetection system or systems under consideration for acquisition and whether it meets established operational requirements;</text> </subparagraph><subparagraph id="H2460A49EEC7C4A4F9C136CD6F328303D"><enum>(C)</enum><text>provision of all raw data to the Science and Technology Directorate to enable the Under Secretary to—</text> <clause id="H8A3D787459D84B08B10C56E34571673B"><enum>(i)</enum><text>conduct a trade-off study comparing the results of subparagraphs (A) and (B); and</text> </clause><clause id="H2E27F174452B4786AEDE5477FCB7C808"><enum>(ii)</enum><text>perform a technical readiness assessment in accordance with section 308(b); and</text> </clause></subparagraph><subparagraph id="HD41C804261924B11A2FF881CD58B944B"><enum>(D)</enum><text>that the findings under subparagraph (C) inform the cost-benefit analysis under paragraph (5)(A) and any Departmental acquisition review board decision regarding the biodetection system or systems under consideration; and</text> </subparagraph></paragraph><paragraph id="H58C25381ACD34CF6B1AA3BCD93E8A085"><enum>(5)</enum><text>prior to acquiring and deploying biodetection technology, require—</text> <subparagraph id="H06B1C55B751A4B0EBEA43668DA7EF72F"><enum>(A)</enum><text>a cost-benefit analysis, including an analysis of alternatives, that shall be informed by the terrorism risk assessments under section 2102;</text> </subparagraph><subparagraph id="H1C9221B6D66A45C580B7108627C4E833"><enum>(B)</enum><text>operational testing and evaluation;</text> </subparagraph><subparagraph id="H44AB7740B9554E87AD91DF2B2920DA46"><enum>(C)</enum><text>operational assessment by the end users of the technology; and</text> </subparagraph><subparagraph id="H50C1C69B21B44D008EEE7BC02FB02FA9"><enum>(D)</enum><text>the Department, other relevant executive agencies, and local jurisdictions intended to host the systems to agree on concepts of operations for resolving alarms.</text> </subparagraph></paragraph></subsection><subsection id="H893E3AB0DDC74EB494237869076219D7"><enum>(c)</enum><header>Contract authority</header><text>The Secretary may enter into contracts with participating laboratories and programs for—</text> <paragraph id="H10A6A52B90DC40E082CD70DF9977EAD1"><enum>(1)</enum><text>the provision of laboratory services or other biosurveillance activities as appropriate for purposes of this section on a fee-for-service basis or on a prepayment or other similar basis; and</text> </paragraph><paragraph id="H6D2F51A999EA4476926587D0C38C3F0D"><enum>(2)</enum><text>administrative and other costs related to hosting program personnel and equipment in these laboratories or programs.</text> </paragraph></subsection><subsection id="H5C6F9BFE50EE434C85C2AE66405A14BE"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H46EF715F3A114AC0935BCB4AF864E344"><enum>(1)</enum><text>The term <term>participating laboratory</term> means a laboratory that has been accepted as a member of the Laboratory Response Network for Biological Terrorism that—</text> <subparagraph id="H3F00051BA0624DF0A36C6E0DF4AFBA63"><enum>(A)</enum><text>is fully equipped to detect and respond quickly to acts of biological terrorism;</text> </subparagraph><subparagraph commented="no" id="H1D9D9B26B3374C20B1D69C82673793D3"><enum>(B)</enum><text display-inline="yes-display-inline">provides biocontainment and microbiological analysis in support of the Department and relevant law enforcement agencies with responsibilities for investigating biological incidents; and</text> </subparagraph><subparagraph id="H0C8E01C6DEAF47F7B328488E49A3D644"><enum>(C)</enum><text>supports assay evaluation, research and development.</text> </subparagraph></paragraph><paragraph id="H5E8C0F00186B4F06BD4CC43224449C7C"><enum>(2)</enum><text>The term <term>assay</term> means any scientific test that is designed to detect the presence of a biological threat agent that is of a type selected under criteria established by the Secretary.</text> </paragraph></subsection></section><section id="H6B9C4C1EE6DC4AE181CF61883A681E20"><enum>2122.</enum><header>Rapid biological threat detection and identification at ports of entry</header> <subsection id="H9AD084FA3F5749BEA7DB725E29EA5F7A"><enum>(a)</enum><header>In general</header><text>The Secretary of Homeland Security shall require the Under Secretary for Science and Technology, in consultation with the heads of other relevant operational components of the Department of Homeland Security, to assess whether the development of technological screening capabilities for biological agents, pandemic influenza, and other infectious diseases should be undertaken by the Directorate of Science and Technology to support entry and exit screening at ports of entry and for other homeland security purposes.</text> </subsection><subsection id="HA3AE32CADCF2479A9D660E52F5443552"><enum>(b)</enum><header>Development of methods</header><text>If the Under Secretary determines that the development of such screening capabilities should be undertaken, the Secretary shall, to the extent possible, initiate development of safe and effective methods to—</text> <paragraph id="H9F1EDA9005FE4E3F9E1755FB41D6CBB0"><enum>(1)</enum><text>rapidly screen incoming persons at ports of entry for biological agents, pandemic influenza, and other infectious diseases; and</text> </paragraph><paragraph id="H2E506E5922A34D22A2DAEBD9DE95821B"><enum>(2)</enum><text>obtain results of such screening near the point of entry.</text> </paragraph></subsection></section><section id="H2FE0A31607334392B1537A518E00309A"><enum>2123.</enum><header>Evaluating detection technology</header><text display-inline="no-display-inline">To inform the purchase of detection technology, the Secretary, in coordination with the Director of the National Institute of Standards and Technology, may carry out a program to—</text> <paragraph id="HFFAC9D2A5B1C4B5BB88B0F8703D9A079"><enum>(1)</enum><text>establish near-term minimum performance metrics to support public safety actionable activities, based to the greatest extent practicable on voluntary consensus standards, to evaluate the effectiveness of detection technology for high-priority biological agents and toxins and high-priority chemical agents;</text> </paragraph><paragraph id="H2159BA8664A14599B0968122F946277F"><enum>(2)</enum><text>establish a process for voluntary testing and evaluation of technology by an accredited laboratory to demonstrate conformance to such consensus standards, or performance metrics if standards do not exist, for the effective detection of high-priority biological agents and toxins and high-priority chemical agents, including incentivization for the program through potential cost sharing with technology manufacturers and for SAFETY Act certification or placement on the authorized equipment list, or both; and</text> </paragraph><paragraph id="H029FCCC547824B9FB2D10B698A04ABEF"><enum>(3)</enum><text>with permission from the detection technology manufacturer, make available to Federal departments and agencies, State, territorial, local, and tribal entities, and the private sector the results of detection system testing and evaluation under paragraph (2).</text> </paragraph></section><section id="HE3208216622B4B439B08EB816715C42A"><enum>2124.</enum><header>Domestic implementation of the Global Nuclear Detection Architecture</header> <subsection id="HCFF7DC051C6045BEBF501185EA17B0C1"><enum>(a)</enum><header>Securing the cities</header><text display-inline="yes-display-inline">The Director of the Domestic Nuclear Detection Office shall establish and maintain a multilayered system of detection technologies, programs, and guidelines designed to enhance the Nation’s ability to detect and prevent a radiological or nuclear attack in high-risk United States cities, as determined by the Secretary.</text> </subsection><subsection id="H079FF3559C924FBE80AB755731DF8C71"><enum>(b)</enum><header>Surge capabilities</header><text>The Director shall develop a surge capability for radiological and nuclear detection systems that can be deployed within the United States rapidly in response to actionable intelligence or warnings, and includes procurement of appropriate technology, training, and exercises.</text> </subsection><subsection id="HDB2E695A9A13446799D3A826A77B2CB2"><enum>(c)</enum><header>Integration</header><text>The programs under subsections (a) and (b) shall be integrated into the Global Nuclear Detection Architecture and shall inform architecture studies, technology gaps, and research activities of the Domestic Nuclear Detection Office.</text> </subsection></section></subtitle><subtitle id="H5FD03534B5C0406797E0404722188E14"><enum>C</enum><header>Response</header> <section id="H661FD07607754D7BBC2498C44CEB9291"><enum>2131.</enum><header>First responder guidance concerning chemical, biological, radiological, and nuclear attacks</header> <subsection id="HB627878C59F940A789D62A2662282C94"><enum>(a)</enum><header>Establishment of voluntary guidance</header><text>Not later than 1 year after the date of the enactment of this section, the Secretary, in coordination with the Secretary of Health and Human Services, the Secretary of Agriculture, the Administrator of the Environmental Protection Agency, the Attorney General, and the heads of other Federal departments and agencies, as appropriate, shall—</text> <paragraph id="H8BD21224B63D41878CEE3C6B131027F0"><enum>(1)</enum><text display-inline="yes-display-inline">develop for police, fire, emergency medical services, emergency management, and medical and public health personnel, voluntary guidance for responding to a release of chemical, biological, radiological, and nuclear material;</text> </paragraph><paragraph id="H310FF7C5345A40769F324362C40F8735"><enum>(2)</enum><text>make such guidance available to State, local, and tribal authorities, including primary and secondary schools and other educational institutions, nongovernmental organizations, the private sector, and the public; and</text> </paragraph><paragraph id="H5402318D567C44888EEC9AE70704824F"><enum>(3)</enum><text>in developing the guidance under paragraph (1)—</text> <subparagraph id="HFF10231DA40343DDBD7B5AAA4C0C3B6B"><enum>(A)</enum><text>review the experiences of other countries and the expertise of academic institutions and nongovernmental organizations; and</text> </subparagraph><subparagraph id="HA40DBEB577CB47CBA97D3FD51AB7D6D0"><enum>(B)</enum><text>consider the unique needs of children and other vulnerable populations.</text> </subparagraph></paragraph></subsection><subsection id="H0FBACC314F7244BE93B82933D90B84B8"><enum>(b)</enum><header>Contents</header><text>The guidance developed under subsection (a)(1) shall be voluntary, risk-based guidance that shall include—</text> <paragraph id="H544B3CACC9B54F1F80B2234382EEE86F"><enum>(1)</enum><text>protective action guidance for ensuring the security, health, and safety of emergency response providers and their families and household contacts;</text> </paragraph><paragraph id="H8A7B252C8BE748B48D14DF15EE163526"><enum>(2)</enum><text>specific information regarding the effects of the chemical, biological, radiological, or nuclear material on those exposed to the agent; and</text> </paragraph><paragraph id="HFB731FBFEBBC4AF4AFB0ECA45A055AAF"><enum>(3)</enum><text display-inline="yes-display-inline">best practices for emergency response providers to effectively diagnose, handle, and otherwise manage individuals affected by an incident involving chemical, biological, radiological, or nuclear material.</text> </paragraph></subsection><subsection id="H0F4AA3034507413F93CF74B412DB25CF"><enum>(c)</enum><header>Review and revision of guidance</header><text>The Secretary shall—</text> <paragraph id="H911E2409B07C467BB29F8E2F32165EB6"><enum>(1)</enum><text>review the guidance developed under subsection (a)(1) at least once every 2 years;</text> </paragraph><paragraph id="HCC41FC20D793492795B94352D467C29E"><enum>(2)</enum><text>make revisions to the guidance as appropriate; and</text> </paragraph><paragraph id="H32A0FE3AB47F44B48EDF73DBE16B3318"><enum>(3)</enum><text>make any revised guidance available to State, local, and tribal authorities, nongovernmental organizations, the private sector, and the public.</text> </paragraph></subsection><subsection id="HCEA257FDD9B643F9AA663EA4CD48DCFD"><enum>(d)</enum><header>Procedures for developing and revising guidance</header><text>In carrying out the requirements of this section, the Secretary shall establish procedures to—</text> <paragraph id="HFEF44912BBAF4620B30D65B67D100C49"><enum>(1)</enum><text>enable members of the first responder and first provider community to submit recommendations of areas in which guidance is needed and could be developed under subsection (a)(1);</text> </paragraph><paragraph id="HA1A61AE196B5416AB0B4EBFA814F4E04"><enum>(2)</enum><text>determine which entities should be consulted in developing or revising the guidance;</text> </paragraph><paragraph id="H7A987341D12740809661D1F542F4843D"><enum>(3)</enum><text>prioritize, on a regular basis, guidance that should be developed or revised; and</text> </paragraph><paragraph id="HDD24E7CFFFF04C3A8E6F91A420518E0E"><enum>(4)</enum><text>develop and disseminate the guidance in accordance with the prioritization under paragraph (3).</text> </paragraph></subsection></section><section id="H3B8BC30D0B3F485D8AD364EA72E75F0A"><enum>2132.</enum><header>Integrated plume modeling for collective response</header> <subsection id="H8045914FBC694CC994E638929D8CF760"><enum>(a)</enum><header>Development</header> <paragraph id="H40AE211F2F3248638E835D1262B57F48"><enum>(1)</enum><header>In general</header><text>The Secretary shall acquire, use, and disseminate the best available integrated plume models to enable rapid response activities following a chemical, biological, nuclear, or radiological attack or event.</text> </paragraph><paragraph id="H2E87440ABA584ED9822A99BA9380FF8E"><enum>(2)</enum><header>Scope</header><text>The Secretary shall—</text> <subparagraph id="H3AB36A88DE2F4DBEB9EB80E4A8AC55DD"><enum>(A)</enum><text>identify Federal, State, and local needs regarding plume models and ensure the rapid development and distribution of integrated plume models that meet those needs to appropriate officials of the Federal Government and State, local, and tribal authorities to enable immediate response to a chemical, biological, radiological, or nuclear attack or event;</text> </subparagraph><subparagraph id="H8E9B522C33D149DAB8BD35C13440F71A"><enum>(B)</enum><text>establish mechanisms for dissemination by appropriate emergency response officials of the integrated plume models described in paragraph (1) to nongovernmental organizations and the public to enable appropriate collective response activities;</text> </subparagraph><subparagraph id="HD5768FED34CF446FB3E9B9F4B3169952"><enum>(C)</enum><text>ensure that guidance and training in how to appropriately use such models are provided; and</text> </subparagraph><subparagraph id="H1F6090ED93224FB180FC1C17550B84F6"><enum>(D)</enum><text>ensure that lessons learned from assessing the development and dissemination of integrated plume models during exercises administered by the Department are put into the lessons learned information sharing system maintained by the Department.</text> </subparagraph></paragraph></subsection><subsection id="HBF55DBCF731B4AED813B14249446B4CF"><enum>(b)</enum><header>Definitions</header><text>For purposes of this section:</text> <paragraph id="H8E01AF74264444C79A26F8C536FDCA38"><enum>(1)</enum><text>The term <quote>plume model</quote> means the assessment of the location and prediction of the spread of agents following a chemical, biological, radiological, or nuclear attack or event.</text> </paragraph><paragraph id="H1BE32C392402490B8108EC88BFC8E756"><enum>(2)</enum><text>The term <quote>integrated plume model</quote> means a plume model that integrates protective action guidance and other information as the Secretary determines appropriate.</text> </paragraph></subsection></section><section commented="no" id="H2CBDCD987F2C4A9B9B2E04853CF6D79C"><enum>2133.</enum><header>Establishment of the system assessment and validation for emergency responders (SAVER) program</header><text display-inline="no-display-inline">The Secretary shall carry out a program for system assessment and validation of emergency response equipment at the Department, to be known as the <quote>SAVER Program</quote>. The Secretary shall ensure that such program—</text> <paragraph commented="no" id="HCDF56D6E0131411BA41693C18705D859"><enum>(1)</enum><text>conducts objective, impartial, practitioner-relevant, and operationally oriented assessments and validations of commercial emergency responder equipment and systems, including hand-held detectors for chemical, biological, radiological, and nuclear agents;</text> </paragraph><paragraph id="H37A56A039FD2416F8AE7000D85045E45"><enum>(2)</enum><text>prioritizes such evaluation based on the technical results obtained from the program established under section 2123, if available;</text> </paragraph><paragraph commented="no" id="H6D6478BC41A14EEC9EAC1CB69084C365"><enum>(3)</enum><text>is supported by a network of scientists who, in coordination with subject matter experts, perform the assessment and validation activities using strict scientific and testing protocols;</text> </paragraph><paragraph commented="no" id="H0B79E804E86245CF87E4D086A0F7EFD2"><enum>(4)</enum><text>provides results along with other relevant equipment information to the emergency response provider community in an operationally useful form;</text> </paragraph><paragraph commented="no" id="H78C306ADFED143DE9C97F79795793AF7"><enum>(5)</enum><text>provides information on equipment that falls within the categories listed in the Department’s authorized equipment list;</text> </paragraph><paragraph commented="no" id="H3098727A72F44728B6FABA7DC597D949"><enum>(6)</enum><text>provides information that enables decision-makers and responders to better select, procure, use, and maintain emergency responder equipment; and</text> </paragraph><paragraph commented="no" id="H6872F946D61F488EAA04A306F3C9231B"><enum>(7)</enum><text>shares such information nationally with the emergency response provider community.</text> </paragraph></section><section display-inline="no-display-inline" id="H949651050BBC4283A5A7310C8C144E25" section-type="subsequent-section"><enum>2134.</enum><header>Payment for laboratory response services</header><text display-inline="no-display-inline">In carrying out their functions, responsibilities, authorities, and duties to counter biological terrorism, the Secretary, the Attorney General, and the heads of other participating Federal agencies are authorized, subject to the availability of appropriations, to enter into contracts with laboratories that comprise the Laboratory Response Network for Biological Terrorism and other federally networked laboratories that agree to participate in such a contract, for the provision of laboratory testing services on a fee-for-service basis or on a prepayment or other similar basis. Prior to entering into such a contract with any laboratory in the Laboratory Response Network for Biological Terrorism, the Secretary, the Attorney General, or the head of any other participating Federal agency shall inform the Centers for Disease Control and Prevention.</text> </section><section id="H9608B7D8A0A7476E92C192630764C139"><enum>2135.</enum><header>Bioforensics capabilities</header> <subsection id="H8A31874151AD45D29BE4758B49CDE30B"><enum>(a)</enum><header>Bioforensics analysis center</header><text>There is authorized in the Department a bioforensics analysis center to provide support for law enforcement and intelligence-related investigations and actions to—</text> <paragraph id="H4D822DDB1AAB466BA2B1E07F6C021CCF"><enum>(1)</enum><text>provide definitive bioforensics analysis in support of the executive agencies with primary responsibilities for preventing, deterring, responding to, attributing, and recovering from biological attacks; and</text> </paragraph><paragraph id="H4DCF29C6639040779142AD4B8BE0FBCF"><enum>(2)</enum><text>undertake other related bioforensics activities.</text> </paragraph></subsection><subsection id="H14B2F33FB2BE4B5E86DBAE278924C9C7"><enum>(b)</enum><header>Payment for services</header><text>The center shall charge and retain fees to reimburse the cost of any service provided to an executive agency that requested such service.</text> </subsection><subsection id="HD91DAD57C5C644A8B7F81FE3124A87E0"><enum>(c)</enum><header>Detailee program</header><text>Subject to the availability of appropriations, the Secretary may implement a program under which executive agencies as considered appropriate by the Secretary provide personnel, on a reimbursable basis, to the center for the purpose of—</text> <paragraph id="HC1EDEE88F6104EEF9590DBD4CD330593"><enum>(1)</enum><text>providing training and other educational benefits for such stakeholders to help them to better understand the policies, procedures, and laws governing national bioforensics activities; and</text> </paragraph><paragraph id="H05D8FCC563B946BF9A5C42AC8C5E8EAE"><enum>(2)</enum><text>bolstering the capabilities and information sharing activities of the bioforensics analysis center authorized under subsection (a) with national biosecurity and biodefense stakeholders.</text> </paragraph></subsection></section><section display-inline="no-display-inline" id="H7E25971685024E47BA4F7D62A1AF6E4A" section-type="subsequent-section"><enum>2136.</enum><header>Metropolitan Medical Response System Program</header> <subsection id="H7C99FE028B784554916AD0788CC11B78"><enum>(a)</enum><header>In General</header><text>The Secretary shall conduct a Metropolitan Medical Response System Program, that shall assist State and local governments in preparing for and responding to public health and mass casualty incidents resulting from acts of terrorism, natural disasters, and other man-made disasters.</text> </subsection><subsection id="H1B1DA8F4D57A4B50BF1D632453A9F838"><enum>(b)</enum><header>Financial Assistance</header> <paragraph id="HF67F38D2F53940DEB5E5057E04F46D69"><enum>(1)</enum><header>Authorization of grants</header> <subparagraph id="H2C75E05A91AF4CAEBD8144E745BB2640"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, through the Administrator of the Federal Emergency Management Agency, may make grants under this section to State and local governments to assist in preparing for and responding to mass casualty incidents resulting from acts of terrorism, natural disasters, and other man-made disasters.</text> </subparagraph><subparagraph id="H13A31A0B96B146EF98A3DA1E7F2F1107"><enum>(B)</enum><header>Consultation</header><text>In developing guidance for grants authorized under this section, the Administrator shall consult with the Chief Medical Officer.</text> </subparagraph></paragraph><paragraph id="H36BFE63EC3644EAE88A276B4BDB8E197"><enum>(2)</enum><header>Use of funds</header><text display-inline="yes-display-inline">A grant made under this section may be used to support the integration of emergency management, health, and medical systems into a coordinated response to mass casualty incidents caused by any hazard, including—</text> <subparagraph id="H57091C051C484D38B5A9EA9DF55CDD57"><enum>(A)</enum><text>to strengthen medical surge capacity;</text> </subparagraph><subparagraph id="H310EFB1492934402A35E288AA9FB8E2A"><enum>(B)</enum><text display-inline="yes-display-inline">to strengthen mass prophylaxis capabilities including development and maintenance of an initial pharmaceutical stockpile sufficient to protect first responders, their families, and immediate victims from a chemical or biological event, including the procurement of home medical kits that are approved pursuant to the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 301 et seq.) or the Public Health Service Act (42 U.S.C. 201 et seq.), as applicable;</text> </subparagraph><subparagraph id="HC01BE79D150745DFA58271B3A737192C"><enum>(C)</enum><text>to strengthen chemical, biological, radiological, nuclear, and explosive detection, response, and decontamination capabilities;</text> </subparagraph><subparagraph id="H4FD428E43D1D42A7B524C05D9DF9DAA9"><enum>(D)</enum><text>to develop and maintain mass triage and pre-hospital treatment plans and capabilities;</text> </subparagraph><subparagraph id="H27B52FF822D74A05B61647C1338BB049"><enum>(E)</enum><text>for planning;</text> </subparagraph><subparagraph id="HAA3E4391A5EB4982A62E9FC77B2FD072"><enum>(F)</enum><text>to support efforts to strengthen information sharing and collaboration capabilities of regional, State, and urban areas in support of public health and medical preparedness;</text> </subparagraph><subparagraph id="HFFEC6E6BB6C14D0390D38CB5CAE43086"><enum>(G)</enum><text>for medical supplies management and distribution;</text> </subparagraph><subparagraph id="H1D48609647954B44AACEB1E0BB38BA80"><enum>(H)</enum><text>for training and exercises;</text> </subparagraph><subparagraph id="H739EDA6341BD4985A5595AFAB27B0966"><enum>(I)</enum><text display-inline="yes-display-inline">for integration and coordination of the activities and capabilities of public health personnel and medical care providers with those of other emergency response providers as well as other Federal agencies, the private sector, and nonprofit organizations, for the forward movement of patients; and</text> </subparagraph><subparagraph id="HC6D79626500841AEBED35D33C077BD12"><enum>(J)</enum><text>for such other activities as the Administrator provides.</text> </subparagraph></paragraph><paragraph id="H162F5C9411D1464B8770DD08194CF14F"><enum>(3)</enum><header>Eligibility</header> <subparagraph id="HC0E3FE8ED9D84127B8075ECD654C8C79"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (C), any jurisdiction that received funds through the Metropolitan Medical Response System Program in fiscal year 2009 shall be eligible to receive a grant under this section.</text> </subparagraph><subparagraph id="HA61E0526921342169981013AA9D0F52B"><enum>(B)</enum><header>Additional jurisdictions</header> <clause id="HF24F97FC92204AF5B0A22FDF0B33A064"><enum>(i)</enum><header>Unrepresented states</header> <subclause id="H2AEE2D3065E3438E972AA6CDB51CD981"><enum>(I)</enum><header>In general</header><text>Except as provided in subparagraph (C), the Administrator may make grants under this section to the metropolitan statistical area with the largest population in any State in which no jurisdiction received funds through the Metropolitan Medical Response Program in fiscal year 2009, or in which funding was received only through another State.</text> </subclause><subclause id="HA77ADB41EA8A4F6882A9E126B3AC2980"><enum>(II)</enum><header>Limitation</header><text>For each of fiscal years 2012 through 2014, no jurisdiction that would otherwise be eligible to receive grants under subclause (I) shall receive a grant under this section if it would result in any jurisdiction under subparagraph (A) receiving less funding than such jurisdiction received in fiscal year 2009.</text> </subclause></clause><clause id="H66DA415776D74E2FAE775BDD35542AE1"><enum>(ii)</enum><header>Other jurisdictions</header> <subclause id="H883937F5710945B1A49E4ABC6F791C22"><enum>(I)</enum><header>In general</header><text>Subject to subparagraph (C), the Administrator may determine that additional jurisdictions are eligible to receive grants under this section.</text> </subclause><subclause id="HCEE1B638004A4C9DAB822FD463F7EF17"><enum>(II)</enum><header>Limitation</header><text>For each of fiscal years 2012 through 2014, the eligibility of any additional jurisdiction to receive grants under this section is subject to the availability of appropriations beyond that necessary to—</text> <item id="HD6A2180B8C504E6BB20767EF7F83B62B"><enum>(aa)</enum><text>ensure that each jurisdiction eligible to receive a grant under subparagraph (A) does not receive less funding than such jurisdiction received in fiscal year 2009; and</text> </item><item id="H6015008009FD40E5995083C94E5FA8C8"><enum>(bb)</enum><text>provide grants to jurisdictions eligible under clause (i).</text> </item></subclause></clause></subparagraph><subparagraph id="HD4C61CC295A94FD1B8A73E72CB7C02EA"><enum>(C)</enum><header>Performance requirement after fiscal year 2012</header><text>A jurisdiction shall not be eligible for a grant under this subsection from funds available after fiscal year 2012 unless the Secretary determines that the jurisdiction maintains a sufficient measured degree of capability in accordance with the performance measures issued under subsection (c).</text> </subparagraph></paragraph><paragraph id="H4AD17911EA72417D82EA8E29F6709D78"><enum>(4)</enum><header>Distribution of funds</header> <subparagraph id="HA3030931A2F54FDC96FDB4139151C0AA"><enum>(A)</enum><header>In general</header><text>The Administrator shall distribute grant funds under this section to the State in which the jurisdiction receiving a grant under this section is located.</text> </subparagraph><subparagraph id="H0DA687159FA2439E93FE66E93FA9BFA2"><enum>(B)</enum><header>Pass through</header><text>Subject to subparagraph (C), not later than 45 days after the date on which a State receives grant funds under subparagraph (A), the State shall provide the jurisdiction receiving the grant 100 percent of the grant funds, and not later than 45 days after the State releases the funds, all fiscal agents shall make the grant funds available for expenditure.</text> </subparagraph><subparagraph id="H49F45101CE7940868BEDFCBCB841D90B"><enum>(C)</enum><header>Exception</header><text>The Administrator may permit a State to provide to a jurisdiction receiving a grant under this section 97 percent of the grant funds awarded if doing so would not result in any jurisdiction eligible for a grant under paragraph (3)(A) receiving less funding than such jurisdiction received in fiscal year 2009.</text> </subparagraph></paragraph><paragraph id="H92CC46517FD5446884EDBE1CAE1C8610"><enum>(5)</enum><header>Regional coordination</header><text>The Administrator shall ensure that each jurisdiction that receives a grant under this section, as a condition of receiving such grant, is actively coordinating its preparedness efforts with surrounding jurisdictions, with the official with primary responsibility for homeland security (other than the Governor) of the government of the State in which the jurisdiction is located, and with emergency response providers from all relevant disciplines, as determined by the Administrator, to effectively enhance regional preparedness.</text> </paragraph></subsection><subsection id="H66591C58E67146779720331E799D39F3"><enum>(c)</enum><header>Performance measures</header><text>The Administrator of the Federal Emergency Management Agency, in coordination with the Chief Medical Officer, and the National Metropolitan Medical Response System Working Group, shall issue performance measures within 1 year after the date of enactment of this section that enable objective evaluation of the performance and effective use of funds provided under this section in any jurisdiction.</text> </subsection><subsection display-inline="no-display-inline" id="H27F4FB0C31464758AA49B574B4AC4BF0"><enum>(d)</enum><header>Metropolitan Medical Response System Working Group defined</header><text display-inline="yes-display-inline">In this section, the term <quote>National Metropolitan Medical Response System Working Group</quote> means—</text> <paragraph id="H1FC1F3DC7EF247D191F6D354BC7F42D8"><enum>(1)</enum><text>10 Metropolitan Medical Response System Program grant managers, who shall—</text> <subparagraph id="HA1A8DBAAA12B4BFC919C24276C1D7779"><enum>(A)</enum><text>include 1 such grant manager from each region of the Agency;</text> </subparagraph><subparagraph id="HC33F0E1A8DAA455A9F1B8C43DB8E7379"><enum>(B)</enum><text>comprise a population-based cross section of jurisdictions that are receiving grant funds under the Metropolitan Medical Response System Program; and</text> </subparagraph><subparagraph id="H12203FAD82C542D7A56E1DBFF24B1683"><enum>(C)</enum><text>include—</text> <clause id="HC7B535EE945242B6A0734A3B4EBE7E8C"><enum>(i)</enum><text>3 selected by the Administrator of the Federal Emergency Management Agency; and</text> </clause><clause id="H6C1BA1171C72453A9C12CC0DC246DD9E"><enum>(ii)</enum><text display-inline="yes-display-inline">3 selected by the Chief Medical Officer; and</text> </clause></subparagraph></paragraph><paragraph id="H8C1CC0D671E94355924981A09A702C83"><enum>(2)</enum><text display-inline="yes-display-inline">3 State officials who are responsible for administration of State programs that are carried out with grants under this section, who shall be selected by the Administrator.</text> </paragraph></subsection><subsection id="HC37197FCEEB04956AAE26C89001C3C37"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $42,000,000 to carry out the program for each of fiscal years 2012 through 2016.</text> </subsection></section></subtitle><subtitle id="H83F1D5F71182441294B6AF4C04F9B463"><enum>D</enum><header>Recovery</header> <section id="H8B41DAE8407E47C4A9360598468BBD6F"><enum>2141.</enum><header>Identifying and addressing gaps in recovery capabilities</header> <subsection id="H3A2A15673E7A4781BD3F55FD0E1DB2E7"><enum>(a)</enum><header>Risk assessment</header> <paragraph id="H69BF3B6204E14F8C914CC2DC1DBED5AB"><enum>(1)</enum><header>Tailored risk assessment</header><text>The Secretary, acting through the Under Secretary for Science and Technology and in coordination with the Administrator of the Environmental Protection Agency, shall conduct tailored risk assessments to inform prioritization of national recovery activities for chemical, biological, radiological, and nuclear incidents, to be updated as necessary.</text> </paragraph><paragraph id="H41C45093918B4B9690D87C87DB6B8049"><enum>(2)</enum><header>Considerations</header><text>In conducting the risk assessments under paragraph (1), the Secretary shall—</text> <subparagraph id="H8B23C01CFD7342809644401FD3695CE4"><enum>(A)</enum><text>consult with the Secretary of Health and Human Services, the Secretary of Agriculture, the Secretary of the Interior, the Chairman of the Nuclear Regulatory Commission, and the heads of other relevant Federal departments and agencies;</text> </subparagraph><subparagraph id="HB4E01CE699354AEDBAA67A5E5F9BE5BE"><enum>(B)</enum><text>consider recovery of both indoor areas and outdoor environments; and</text> </subparagraph><subparagraph id="H9734873940344BD8AD1582BF1E0397FB"><enum>(C)</enum><text>consider relevant studies previously prepared by other Federal agencies, or other appropriate stakeholders.</text> </subparagraph></paragraph><paragraph id="H2350CAFE0CDD45829AF887C380828AB5"><enum>(3)</enum><header>Collaboration</header><text>Upon completion of the risk assessments required by this section, the Secretary shall provide the findings to the Administrator of the Environmental Protection Agency and heads of other relevant Federal agencies in order to inform ongoing and future work, including research and guidance development, undertaken by those agencies in recovery and remediation from chemical, biological, radiological, or nuclear incidents.</text> </paragraph></subsection><subsection id="HCF4E96253D834A319DA67746D48821B8"><enum>(b)</enum><header>Research</header><text>The results of the risk assessment under this section shall inform appropriate Federal research to address the high-risk capability gaps uncovered by each assessment.</text> </subsection><subsection id="HD0BCCC90A44949B1BA8138162CB7BCFC"><enum>(c)</enum><header>Submission to Congress</header><text>The results of each risk assessment shall be submitted to the appropriate congressional committees within 30 days after completion of the assessment.</text> </subsection></section><section display-inline="no-display-inline" id="HC8DDDE1C93C34D1290FC370FEA5AEAB4" section-type="subsequent-section"><enum>2142.</enum><header>Recovery from a chemical, biological, radiological, and nuclear attack or incident</header> <subsection id="H92EFC806B29B439EA5332CDBCEB7AE71"><enum>(a)</enum><header>Establishment of guidance</header><text>The Secretary shall develop and issue guidance for clean-up and restoration of indoor and outdoor areas, including subways and other mass transportation facilities, that have been exposed to chemical, biological, radiological, or nuclear materials. The Secretary shall develop and issue the guidance, within 24 months after the date of enactment of this section, in consultation with—</text> <paragraph id="HDF3895D16E904BFCB9580ECD86EF7712"><enum>(1)</enum><text>the Secretary of Agriculture;</text> </paragraph><paragraph id="H5DD8590CAA8D489D8A21A013928EB396"><enum>(2)</enum><text>the Secretary of Commerce;</text> </paragraph><paragraph id="H9BD12111163848AB84CCB9FE898C7319"><enum>(3)</enum><text>the Secretary of Education;</text> </paragraph><paragraph id="H544A321193184EC6BCE6D4012A31A8AE"><enum>(4)</enum><text>the Secretary of the Interior;</text> </paragraph><paragraph id="H5F4CF67A509743B4906969E86EC5DA87"><enum>(5)</enum><text>the Attorney General;</text> </paragraph><paragraph id="H28CB50659F1046E7B483D6A9E671E221"><enum>(6)</enum><text>the Secretary of Labor;</text> </paragraph><paragraph id="H90513DE7750B46D08A7AC462E6A3FB79"><enum>(7)</enum><text>the Secretary of Transportation;</text> </paragraph><paragraph id="H7A05714113F14D2FA5391FC0E97C5304"><enum>(8)</enum><text>the Secretary of Housing and Urban Development;</text> </paragraph><paragraph id="H68F911FABEDE42A186DE8CE6360C4CA0"><enum>(9)</enum><text>the Secretary of Health and Human Services;</text> </paragraph><paragraph id="HD1AD4F13EDB04E5DBA76945007E06983"><enum>(10)</enum><text>the Secretary of Veterans Affairs;</text> </paragraph><paragraph id="HCFEA660D5D484D47AD142547D4EBA271"><enum>(11)</enum><text>the Secretary of the Treasury;</text> </paragraph><paragraph id="HE2A2C36900D8454C91E3F03BD0D301AB"><enum>(12)</enum><text>the Administrator of the Environmental Protection Agency; and</text> </paragraph><paragraph id="H8BC12BFAE34A490E9FD9B6DAE648E073"><enum>(13)</enum><text>the Administrator of the Small Business Administration.</text> </paragraph></subsection><subsection id="H684596E59A4C448F91A9C1B7917C30CC"><enum>(b)</enum><header>Contents</header><text>The guidance developed under subsection (a) shall clarify Federal roles and responsibilities for assisting State, local, and tribal authorities and include risk-based recommendations for—</text> <paragraph id="HFBDB47C313BE4E808E037F728F187C46"><enum>(1)</enum><text>standards for effective decontamination of affected sites;</text> </paragraph><paragraph id="H572441DB478544F4AC9DC658A4664516"><enum>(2)</enum><text>standards for safe post-event occupancy of affected sites, including for vulnerable populations such as children and individuals with health concerns;</text> </paragraph><paragraph id="H6B39CE79FC27444EAD092D0159C6DC06"><enum>(3)</enum><text>requirements to ensure that the decontamination procedures for responding organizations do not conflict;</text> </paragraph><paragraph id="H88440F0C7A39429E89A55B8CE9389927"><enum>(4)</enum><text>requirements that each responding organization uses a uniform system for tracking costs and performance of clean-up contractors;</text> </paragraph><paragraph id="H4B5E4D4D01C8455DA245E9864EDA0873"><enum>(5)</enum><text>maintenance of negative air pressure in buildings;</text> </paragraph><paragraph id="H31935CD9112444AABFBB6252BC26AE12"><enum>(6)</enum><text display-inline="yes-display-inline">standards for proper selection and use of personal protective equipment;</text> </paragraph><paragraph id="H5D7C8FE31CFC44F2B0E2C3C46FA45B1B"><enum>(7)</enum><text>air sampling procedures;</text> </paragraph><paragraph id="HA919FCB506E24997A02C0501309FE062"><enum>(8)</enum><text>development of occupational health and safety plans that are appropriate for the specific risk to responder health; and</text> </paragraph><paragraph id="H0F576678A51441ACAEFA317A354F0000"><enum>(9)</enum><text>waste disposal.</text> </paragraph></subsection><subsection id="H40E8B316265146F8A90174DB422F5CE5"><enum>(c)</enum><header>Review and revision of guidance</header><text>The Secretary shall—</text> <paragraph id="H16D2204C59C14FA6BD0DAA5747651114"><enum>(1)</enum><text>not less frequently than once every 2 years, review the guidance developed under subsection (a);</text> </paragraph><paragraph id="HA24F897A9BB245628A79053CABECA143"><enum>(2)</enum><text>make revisions to the guidance as appropriate; and</text> </paragraph><paragraph id="HAB4D621079BF49A78B08091143159471"><enum>(3)</enum><text>make the revised guidance available to the Federal Government, State, local, and tribal authorities, nongovernmental organizations, the private sector, and the public.</text> </paragraph></subsection><subsection id="H3EA115EBD8C949D7A3FB8FD2B4FF88BD"><enum>(d)</enum><header>Procedures for developing and revising guidance</header><text>In carrying out the requirements of this section, the Secretary shall establish procedures to—</text> <paragraph id="HA8659F1EDDAD4549AD441870E914F389"><enum>(1)</enum><text>prioritize issuance of guidance based on the results of the risk assessment under section 2131;</text> </paragraph><paragraph id="H30F012AD7D4845A385A0079199E0F8E5"><enum>(2)</enum><text>inventory existing relevant guidance;</text> </paragraph><paragraph id="H5B8C304440B94D09B0788402B6DEB41E"><enum>(3)</enum><text>enable the public to submit recommendations of areas in which guidance is needed;</text> </paragraph><paragraph id="HD8344403DC924EF5B9DF3C6EE168FD48"><enum>(4)</enum><text>determine which entities should be consulted in developing or revising the guidance;</text> </paragraph><paragraph id="H35EE3356E110441D86AD405B038D0886"><enum>(5)</enum><text>prioritize, on a regular basis, guidance that should be developed or revised; and</text> </paragraph><paragraph id="H30337BDB6F904530BA7233C98A284791"><enum>(6)</enum><text>develop and disseminate the guidance in accordance with the prioritization under paragraph (5).</text> </paragraph></subsection><subsection id="H378036556FC14FABA6C6647A5B28A629"><enum>(e)</enum><header>Consultations</header><text>The Secretary shall develop and revise the guidance developed under subsection (a), and the procedures required under subsection (d), in consultation with—</text> <paragraph id="H80663B5D7E9B4361B1FD2BDE0859EA87"><enum>(1)</enum><text>the heads of other Federal departments and agencies that are not required to be consulted under subsection (a), as the Secretary considers appropriate;</text> </paragraph><paragraph id="H7F7378983678434E9A03EB4D5D0A5393"><enum>(2)</enum><text>State, local, and tribal authorities; and</text> </paragraph><paragraph id="HA9F54AD35E414406B5D571D5F568713B"><enum>(3)</enum><text>nongovernmental organizations and private industry.</text> </paragraph></subsection><subsection id="H54323C5E15B5482BBB7102BBAC72E02D"><enum>(f)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this section, and annually thereafter, the Secretary shall provide appropriate congressional committees with—</text> <paragraph id="H71720C1E9CC743A9BEE526974FB7611A"><enum>(1)</enum><text>a description of the procedures established under subsection (d);</text> </paragraph><paragraph id="HB8E2AC33F4A14DB9A3AE38B3CFA46C6D"><enum>(2)</enum><text>any guidance in effect on the date of the report;</text> </paragraph><paragraph id="H52E5A2CD83C644478820929343A72688"><enum>(3)</enum><text>a list of entities to which the guidance described in paragraph (2) was disseminated;</text> </paragraph><paragraph id="H8A91773366AE45E2B82AC80328099141"><enum>(4)</enum><text>a plan for reviewing the guidance described in paragraph (2), in accordance with subsection (e);</text> </paragraph><paragraph id="H5B9DF24268DB43BB8173D8A45BA9B4EF"><enum>(5)</enum><text>the prioritized list of the guidance required under subsection (d)(4), and the methodology used by the Secretary for such prioritization; and</text> </paragraph><paragraph id="H9C399D7B1A374E81AEF138BC2B8B227A"><enum>(6)</enum><text>a plan for developing, revising, and disseminating the guidance.</text> </paragraph></subsection></section><section id="H189863E4D35B4A6EA5C3A04B4A051364"><enum>2143.</enum><header>Exercises</header> <subsection id="HECBD5D49056F4C60BB4F619C9BEE9BD6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">To facilitate recovery from a chemical, biological, radiological, or nuclear attack or other incident involving chemical, biological, radiological, or nuclear materials and to foster collective response to terrorism, the Secretary shall develop exercises in consultation with State, local, and tribal authorities and other appropriate Federal agencies, and, as appropriate, in collaboration with national level exercises, including exercises that address, to the best knowledge available at the time, analysis, indoor environmental cleanup methods, and decontamination standards, including those published in the guidance issued under section 2142.</text> </subsection><subsection id="HF377B54A1C4F40FE8FF30B3E50061507"><enum>(b)</enum><header>Lessons learned for national level exercises</header><text display-inline="yes-display-inline">The Secretary shall provide electronically, to the maximum extent practicable, lessons learned reports to each designated representative of State, local, and tribal jurisdictions and private sector entities that participate in National Level Exercises of the Department. Each lessons learned report shall be tailored to convey information on that exercise that could be leveraged to enhance preparedness and response.</text> </subsection></section></subtitle>. (b)

Metropolitan Medical Response Program review
(1)
In general
The Administrator of the Federal Emergency Management Agency, the Chief Medical Officer of the Department of Homeland Security, and the National Metropolitan Medical Response System Working Group shall conduct a review of the Metropolitan Medical Response System Program authorized under section 2136 of the Homeland Security Act of 2002, as added by this section, including an examination of— (A)the extent to which the program goals and objectives are being met; (B)the performance metrics that can best help assess whether the Metropolitan Medical Response System Program is succeeding; (C)how the Metropolitan Medical Response System Program can be improved; (D)how the Metropolitan Medical Response System Program complements and enhances other preparedness programs supported by the Department of Homeland Security and the Department of Health and Human Services; (E)the degree to which the strategic goals, objectives, and capabilities of the Metropolitan Medical Response System Program are incorporated in State and local homeland security plans; (F)how eligibility for financial assistance, and the allocation of financial assistance, under the Metropolitan Medical Response System Program should be determined, including how allocation of assistance could be based on risk; (G)implications for the Metropolitan Medical Response System Program if it were managed as a contractual agreement; and (H)the resource requirements of the Metropolitan Medical Response System Program. (2)
Report
Not later than 1 year after the date of enactment of this Act, the Administrator and the Chief Medical Officer shall submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report on the results of the review under this section. (3)
Consultation
The Administrator of the Federal Emergency Management Agency shall consult with the Secretary of Health and Human Services in the implementation of paragraph (1)(E). (4)
Definition
In this subsection the term National Metropolitan Medical Response System Working Group has the meaning that term has in section 2136 of the Homeland Security Act of 2002, as added by this section.

Enhancing laboratory biosecurity
(a)
Federal Experts Security Advisory Panel
(1)
Panel
(A)
Establishment
The President shall establish a permanent advisory panel to be known as the Federal Experts Security Advisory Panel to make technical and substantive recommendations on biological agent and toxin security. (B)
Membership
The members of the Panel— (i)shall consist of the voting members appointed under subparagraph (D) and the nonvoting members appointed under subparagraph (E); and (ii)except as provided in subparagraph (E), shall each be an official or employee of the Federal Government. (C)
Co-Chairs
The voting members of the Panel appointed under clauses (i), (v), and (vi) of subparagraph (D) shall serve jointly as the Co-Chairs of the Panel. (D)
Voting members
The voting members of the Panel shall consist of 1 voting representative of each of the following Government entities, appointed (except with respect to the National Security Council) by the head of the respective entity: (i)The Department of Agriculture. (ii)The Department of Commerce. (iii)The Department of Defense. (iv)The Department of Energy. (v)The Department of Health and Human Services. (vi)The Department of Homeland Security. (vii)The Department of Justice. (viii)The Department of Labor. (ix)The Department of State. (x)The Department of Transportation. (xi)The Department of Veterans Affairs. (xii)The Environmental Protection Agency. (xiii)The National Security Council, which shall be represented by the Special Assistant to the President for Biodefense. (xiv)The Office of the Director of National Intelligence. (xv)Any other department or agency designated by the Co-Chairs. (E)
Nonvoting members
The nonvoting members of the Panel shall consist of— (i)such additional representatives of the Government entities listed in subparagraph (D) as may be appointed by the heads of the respective entities; and (ii)a representative of the public health laboratory community or biological laboratory community (or both). (F)
Administrative support
The Secretary of Health and Human Services shall provide to the Panel such facilities, staff, and support services as may be necessary for the Panel to carry out its responsibilities under paragraph (2). (2)
Responsibilities
Not later than 6 months after the date of the enactment of this section, the Panel shall, with respect to biological agent and toxin security, deliver to the Secretaries of Agriculture, Health and Human Services, and Homeland Security plurality recommendations, including any statements of dissent, concerning— (A)the designation as highest risk of that subset of biological agents and toxins listed pursuant to section 351A(a)(1) of the Public Health Service Act (42 U.S.C. 262a(a)(1)) that presents the greatest risk of deliberate misuse with significant potential for mass casualties or devastating effects to the economy, informed by— (i)any biological or bioterrorism risk assessments conducted by the Department of Homeland Security and relevant assessments by other agencies; and (ii)determinations made by the Secretary of Homeland Security pursuant to section 319F–2(c)(2)(A) of such Act (42 U.S.C. 247d–6b(c)(2)(A)); (B)the development of a set of minimum risk-based prescriptive laboratory security performance standards based on the risk at the lowest level, allowing for enhancements as risk increases; (C)the establishment of appropriate standards and practices to improve vetting and monitoring of, and ensure reliability of, personnel with access to highest risk biological agents and toxins at facilities registered under section 351A(d) of the Public Health Service Act (42 U.S.C. 262a(d)); (D)the establishment of appropriate practices for physical security and cyber security for facilities that possess highest risk biological agents or toxins; (E)standards for training of laboratory personnel in security measures; (F)other emerging policy issues relevant to the security of biological agents and toxins; (G)adequacy of information sharing protocols with biodefense and biosecurity stakeholders; and (H)any other security standards determined necessary. (b)
Revision of rules and regulations
(1)
Proposed rules
The Secretaries of Health and Human Services and Agriculture, in coordination with the Secretary of Homeland Security, no later than 1 year after the date of receipt of recommendations under subsection (a)(2), shall, as appropriate, propose rules under section 351A of the Public Health Service Act (42 U.S.C. 262a) establishing security standards and procedures that are specific to highest risk biological agents and toxins. (2)
Final rules
The Secretaries of Health and Human Services and Agriculture, in coordination with the Secretary of Homeland Security, no later than 24 months after the date of the enactment of this section, shall promulgate final rules described in paragraph (1). (c)
Coordination of Federal oversight
To ensure that the Federal Government provides for comprehensive and effective oversight of biological agents and toxins security, the heads of the Government entities listed in subsection (a)(1)(D) shall for facilities in which the entity supports biological agent or toxin laboratory activities and by no later than 6 months after the submission of recommendations under subsection (a)(2), develop and implement a plan for the coordination of biological agents and toxins security oversight that— (1)articulates a mechanism for coordinated inspections of and harmonized administrative practices for facilities registered under section 351A(d) of the Public Health Service Act (42 U.S.C. 262a(d)), pursuant to subsection (d) of this section; and (2)ensures consistent and timely identification and resolution of biological agents and toxins security and compliance issues. (d)
Common inspection procedures
The heads of the entities listed in subsection (a)(1)(D) shall coordinate or consolidate laboratory inspections and ensure that such inspections are conducted using a common set of inspection procedures across such entities in order to minimize the administrative burden on such laboratory. (e)
Inspection reports
Any inspection report resulting from an inspection described in paragraph (1) shall be available to— (1)each Federal agency that supports biological agent or toxin laboratory activities at the laboratory that is the subject of the inspection report; and (2)the laboratories that are the object of inspection. (f)
Laboratory biosecurity information sharing
(1)
Federal sharing
The Secretaries of Health and Human Services and Agriculture shall— (A)develop a process for sharing of information pertaining to biological agents and toxins with agencies that support biological agent or toxin laboratory activities, that identifies the purpose for sharing, and a mechanism for securing, such information; (B)share relevant information pertaining to biological agents and toxins, including identification of laboratories possessing highest risk biological agents and toxins, and compliance issues with the Secretary of Homeland Security; and (C)share relevant information pertaining to biological agents and toxins, including identification of laboratories possessing highest risk biological agents and toxins, with appropriate State, local, and tribal government authorities, including law enforcement authorities and emergency response providers. (2)
Classified and sensitive information
The Secretaries of Agriculture and Health and Human Services shall ensure that any information disseminated under this section is handled consistently with— (A)the authority of the Director of National Intelligence to protect intelligence sources and methods under the National Security Act of 1947 (50 U.S.C. 401 et seq.) and related procedures or similar authorities of the Attorney General concerning sensitive law enforcement information; (B)section 552a of title 5, United States Code (commonly referred to as the Privacy Act of 1974); and (C)other relevant laws. (g)
Definitions
In this section: (1)The terms biological agent and toxin refer to a biological agent or toxin, respectively, listed pursuant to section 351A(a)(1) of the Public Health Service Act (42 U.S.C. 262(a)(1)). (2)The term highest risk means, with respect to a biological agent or toxin, designated as highest risk as described in subsection (a)(2)(A). (3)The term Panel means the Federal Experts Security Advisory Panel under subsection (a). (4)The term State, local, and tribal has the same meaning that term has in the Homeland Security Act of 2002 (6 U.S.C. 101 et seq.).

Definitions
Section 2 of the Homeland Security Act of 2002 (6 U.S.C. 101) is amended by adding at the end the following new paragraphs: (19)The term Intelligence Community has the meaning given that term in section 3(4) of the National Security Act of 1947 (50 U.S.C. 401a(4)). (20)The term national biosecurity and biodefense stakeholders means officials from the Federal, State, local, and tribal authorities and individuals from the private sector who are involved in efforts to prevent, protect against, respond to, and recover from a biological attack or other biological incidents that may have serious health or economic consequences for the United States, including wide-scale fatalities or infectious disease outbreaks. .

Dual-use terrorist risks from synthetic biology
(a)
Sense of Congress
It is the sense of Congress that the field of synthetic biology has the potential to facilitate enormous gains in fundamental discovery, public health, and biotechnological applications, but that it also presents inherent dual-use homeland security risks that must be managed. (b)
Assessment of risk
Not less frequently than once every two years, the Secretary of Homeland Security, acting through the Under Secretary for Science and Technology, shall undertake a risk assessment of the dual-use and other risks associated with synthetic biology. (c)
Establishment of guidance
Not later than six months after the date of the enactment of this Act, the Secretary shall develop and provide to the heads of all departments and agencies that fund life sciences research, guidance on compliance with United States laws, arms control agreements to which the United States is a party or signatory, and individual department and agency policy, including consideration of— (1)best practices for establishing a department or agency process that achieves compliance for department or agency research, development, or acquisition projects in the life sciences; (2)the types of projects that should be assessed; (3)at what stage or stages such projects should be assessed; and (4)means for preventing the release of homeland or national security information. (d)
Research and development
Based upon the findings of the risk assessment undertaken in accordance with subsection (b), the Under Secretary may conduct research into the risks and ways to mitigate such risks of synthetic biology, including— (1)determining the current capability of synthetic nucleic acid providers to effectively differentiate a legitimate customer from a potential terrorist or other malicious actor; (2)determining the current capability of synthetic nucleic acid providers to effectively screen orders for sequences of homeland security concern; and (3)making recommendations regarding screening software, protocols, and other remaining capability gaps uncovered by such risk assessment.

Dissemination of information analyzed by the Department to State, local, tribal, and private entities with responsibilities relating to homeland security
Section 201(d)(8) of the Homeland Security Act of 2002 (6 U.S.C. 121(d)(8)) is amended by striking and to agencies of State and all that follows and inserting to State, local, tribal, and private entities with such responsibilities, and, as appropriate, to the public, in order to assist in preventing, deterring, or responding to acts of terrorism against the United States..
<enum>IV</enum><header>Public Health Matters</header> <section id="HB779CFFAB16745649496C4A66372CBE2"><enum>401.</enum><header>Sense of Congress regarding Federal coordination on medical countermeasures</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> <paragraph id="HADE0C35AEE864F3CAB27A993F416912A"><enum>(1)</enum><text>10 years after the terrorist attacks of September 11, 2001, and 7 years after enactment of the Project BioShield Act of 2004 (Public Law 108–276), coordination among Federal agencies involved in activities relating to researching, developing, and acquiring medical countermeasures still needs improvement; and</text> </paragraph><paragraph id="H170CE726788C4E64BCFF5920F06ECD1F"><enum>(2)</enum><text>aggressive action should be taken by the Department of Health and Human Services (in particular, the heads of the National Institutes of Health, the Biomedical Advanced Research and Development Authority, the Centers for Disease Control and Prevention, and the Food and Drug Administration), the Department of Homeland Security, and the Department of Defense to foster greater coordination with respect to such activities, including adoption of an interagency agreement that sets forth the relative areas of responsibility with respect to establishing medical countermeasure requirements and researching, developing, and acquiring medical countermeasures to meet those requirements.</text> </paragraph></section><section id="H51AF38303FDA42D493A90706FDBE1556"><enum>402.</enum><header>National Medical Countermeasure Dispensing Strategy</header><text display-inline="no-display-inline">Title III of the Public Health Service Act is amended by inserting after section 319F–4 (42 U.S.C. 247d–6e) the following:</text> <quoted-block changed="added" committee-id="HHM00" id="H1183FA08EA484EE49ECE9234DB0CC6F6" reported-display-style="italic" style="OLC"> <section id="HC6EBF838ABC1444CB523B1350CBFD48E"><enum>319F–5.</enum><header>National Medical Countermeasure Dispensing Strategy</header> <subsection id="H96A16AE363C04601B8EDD91A83405C04"><enum>(a)</enum><header>Definitions</header><text>In this section—</text> <paragraph id="H87E73BEBE6CC4D0D82FD763A8CC0040E"><enum>(1)</enum><text>the term <quote>dispense</quote> means to provide medical countermeasures to an affected population in response to a threat or incident; and</text> </paragraph><paragraph id="H5D2FC78F5C184B59A85EFD84507B189B"><enum>(2)</enum><text>the term <quote>medical countermeasure</quote> means a qualified countermeasure (as defined in section 319F–1(a)(2)).</text> </paragraph></subsection><subsection id="HFB076B72A6C44897A51FED2CE57FBFF6"><enum>(b)</enum><header>Strategy</header> <paragraph id="HD44F8C787AC64F16BB2A7E94B48B49AE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, in coordination with the Secretary of Homeland Security, the Secretary of Agriculture, and other appropriate Federal agencies, shall develop, implement, and, as appropriate, periodically update a National Medical Countermeasure Dispensing Strategy to enhance preparedness and collective response to a terrorist attack on humans or animals with any chemical, biological, radiological, or nuclear material, that delineates Federal, State, and local responsibilities.</text> </paragraph><paragraph id="HF3D6F97E81A84F339E01CBC241AE9BA9"><enum>(2)</enum><header>Considerations</header><text>The strategy shall be sufficiently flexible to meet the unique needs of different communities, including first responders, and shall consider—</text> <subparagraph id="HB1A85C328B184EE6B59F51A7DB367FD8"><enum>(A)</enum><text display-inline="yes-display-inline">a variety of options for dispensing medical countermeasures, including to individuals, schools, universities, hospitals, and elderly care facilities;</text> </subparagraph><subparagraph id="H1BD1F4F044E34418831DA750002EB731"><enum>(B)</enum><text>post-incident requirements for emergency use authorizations before countermeasures can be distributed legally;</text> </subparagraph><subparagraph id="H0E0DA00A36C949D5BF18BEC59182C52A"><enum>(C)</enum><text>the inclusion of locally held caches of countermeasures in event-specific authorizations covering federally held countermeasures of the same type; and</text> </subparagraph><subparagraph id="HB503DAEBDA1C4CA9B248DA3CC3F7F50B"><enum>(D)</enum><text>distribution to the public of home medical kits for personal stockpiling purposes, within 30 days after a domestic or international bioterrorist attack resulting in human infection.</text> </subparagraph></paragraph></subsection><subsection id="H723CE8B4520247948B1743AF3269F5B0"><enum>(c)</enum><header>Coordination</header><text>The Secretary shall coordinate with the Administrator of the Federal Emergency Management Agency, State, local, and tribal authorities, representatives from the private sector, and nongovernmental organizations on the National Medical Countermeasures Dispensing Strategy.</text> </subsection><subsection id="H2FCE2F0A96464403B2BA3BF0A9A9FDEF"><enum>(d)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this section, the Secretary shall submit the National Medical Countermeasures Dispensing Strategy to the appropriate congressional committees.</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </section><section commented="no" id="HA0E4EFF5ADB64E7D91B32C91DD7BECCD"><enum>403.</enum><header>National pre-event vaccination and antimicrobial dispensing policy review</header> <subsection commented="no" id="H86F312710093481A97AAC56972E1BF79"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services, in coordination with the Secretary of Homeland Security and the Secretary of Agriculture, shall review the adequacy of domestic vaccination and antimicrobial dispensing policy, guidance, and information provided to the public in light of any known terrorist risk of a biological attack or other phenomena that may have serious health consequences for the United States, including wide-scale fatalities or infectious disease outbreaks including outbreaks associated with the avian flu. In carrying out the review under this section, the Secretary shall consider—</text> <paragraph commented="no" id="HAC9775906F8C4C43AD5A4AE329240A3F"><enum>(1)</enum><text>terrorism risk assessments under section 2102 of the Homeland Security Act of 2002, as amended by this Act, and material threat assessments and determinations under the Project Bioshield Act of 2004 (Public Law 108–276) and the amendments made by that Act;</text> </paragraph><paragraph commented="no" id="HAF5478850BEE4CA19C6A5AD41DF50362"><enum>(2)</enum><text>reports on global trends and intelligence produced by the Office of the Director of National Intelligence and the Intelligence Community regarding biological threats;</text> </paragraph><paragraph commented="no" id="HD4D69CE745884226B227221ABEE70AB3"><enum>(3)</enum><text display-inline="yes-display-inline">the availability of federally provided vaccines and antimicrobials to dispense to first responders and the public, on a voluntary basis, in anticipation of a biological attack;</text> </paragraph><paragraph commented="no" id="H415496ABF8F94FE4BEA715FD5D63E814"><enum>(4)</enum><text display-inline="yes-display-inline">applicability of Federal shelf-life extension programs to locally held stockpiles of medical countermeasures, to the extent that information on local stockpiles is available;</text> </paragraph><paragraph commented="no" id="H0D96CF9AA22546F5BEDB04D58770F16A"><enum>(5)</enum><text>making expiring products available to appropriate international organizations or foreign partners once the requests of domestic stakeholders have been fulfilled;</text> </paragraph><paragraph id="HCA08970A30994AA186A5AB6F0C5439A2"><enum>(6)</enum><text>the implications of pre-event vaccination and antimicrobial dispensing to livestock; and</text> </paragraph><paragraph id="HCC171CE234884404847D6637E3A95C2A"><enum>(7)</enum><text>mechanisms to increase coordination between the Strategic National Stockpile established under section 319F–2 of the Public Health Service Act (42 U.S.C. 247D–6b) and the National Veterinary Stockpile that would enhance vaccination and dispensing capabilities.</text> </paragraph></subsection><subsection commented="no" id="HB92EE2F7017548AD96C9C94FC14D0856"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of Health and Human Services shall report to the appropriate congressional committees on the review required by subsection (a), together with any recommendations relating to the availability of domestic vaccine and antimicrobials for disbursing to the public and voluntary immunization by first responders.</text> </subsection></section><section commented="no" id="H922147D139E04C59A416B22EC6EB8106"><enum>404.</enum><header>Management of short shelf life vaccine and antimicrobial stockpiles</header><text display-inline="no-display-inline">The Secretary of Health and Human Services shall make available surplus vaccines and antimicrobials, and vaccines and antimicrobials with short shelf lives, from the strategic national stockpile under section 319F–2(a) of the Public Health Service Act (42 U.S.C. 247d–6b(a)) to State, local, and tribal first responders, including health care responders, for administration to such responders who voluntarily consent to such administration, and shall—</text> <paragraph id="H4C5E43A04B894501A95B21C6CA8FBD6A"><enum>(1)</enum><text>establish any necessary logistical and tracking systems to facilitate making such vaccines and antimicrobials so available; and</text> </paragraph><paragraph id="H5C8819C4B81447B98BE8BE2DFA68D25A"><enum>(2)</enum><text>distribute disclosures regarding associated risks to end users.</text> </paragraph></section><section commented="no" display-inline="no-display-inline" id="HB844D54FA5FD4BE98A19F813DB8D0AE8" section-type="subsequent-section"><enum>405.</enum><header>Material threat determinations reviews</header><text display-inline="no-display-inline">Section 319F–2(c)(2)(A) of the Public Health Service Act (42 U.S.C. Sec 247d-6b(c)(2)(A)) is amended—</text> <paragraph commented="no" id="H698E1C5E321C4EAAA48CBF5657E8E5FC"><enum>(1)</enum><text>in clause (i), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph id="HD3CA6476F27F43CDB0C8EE87ABB0AA29"><enum>(2)</enum><text>by redesignating clause (ii) as clause (iii);</text> </paragraph><paragraph commented="no" id="H851DFC25AD9743C180FC619D58A22EB6"><enum>(3)</enum><text>by inserting after clause (i) the following:</text> <quoted-block changed="added" committee-id="HHM00" display-inline="no-display-inline" id="H33260DF6026D4F1CA76193CF9ABE38B1" reported-display-style="italic" style="OLC"> <clause commented="no" id="H5C2A5B3E66B74768960E203F67CB7E39"><enum>(ii)</enum><text display-inline="yes-display-inline">establish criteria for the issuance of a material threat determination;</text> </clause><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph><paragraph commented="no" id="HAEB038FC3A7048A3AFDA2F56A66C9937"><enum>(4)</enum><text>in clause (iii), as so redesignated, by striking the period at the end and inserting <quote>; and</quote>; and</text> </paragraph><paragraph commented="no" id="H4F9C9299565343DD9AA5F1E8F9ADEED3"><enum>(5)</enum><text>by adding at the end the following:</text> <quoted-block changed="added" committee-id="HHM00" id="H8ADC2AB250BA48A6BA9DBC9BD64D9C81" reported-display-style="italic" style="OLC"> <clause commented="no" id="H8D998DB1E9A641A19795A61B87DCEDB6"><enum>(iv)</enum><text>review and reassess determinations under clause (iii) to determine whether agents continue to present a material threat against the United States population sufficient to affect national security and homeland security.</text> </clause><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section><section commented="no" id="HD1ABABE03B65426CBE0EE048D0FB720F"><enum>406.</enum><header>Background checks</header><text display-inline="no-display-inline">Section 351A(e)(3)(A) of the Public Health Service Act (42 U.S.C. 262a(e)(3)(A)) is amended by adding at the end the following: <quote>In identifying whether an individual is within a category specified in subparagraph (B)(ii)(II), the Attorney General shall consult with the Secretary of Homeland Security, the Secretary of Defense, and the Secretary of State to determine whether these officials possess any information relevant to the identification of such an individual by the Attorney General.</quote>.</text> </section><section id="H4D08CC1445394DBF998D33C7D9D184B5"><enum>407.</enum><header>State, local, and tribal defined</header><text display-inline="no-display-inline">In this title, the term <quote>State, local, and tribal</quote> has the same meaning that term has in the Homeland Security Act of 2002 (6 U.S.C. 101 et seq.).</text> </section><enum>V</enum><header>Foreign Relations Matters</header> <section id="H5C49BF505ACA45B08D83AF1685BE33E5"><enum>501.</enum><header>International engagement to enhance biodefense and laboratory biosecurity</header><text display-inline="no-display-inline">The Secretary of State, in consultation with the Special Assistant to the President for Biodefense, and the heads of appropriate Federal agencies, shall, as appropriate—</text> <paragraph id="H3FBB8B680A0D4E0396D37709390BD4BE"><enum>(1)</enum><text>support efforts of other countries to establish and build capacity to effectively implement legislation criminalizing the development or use of biological weapons or acts of bioterrorism;</text> </paragraph><paragraph id="H2B46055F802E4E23AE524B8B36577BA3"><enum>(2)</enum><text>engage other countries and international nongovernmental entities to develop and establish common standards, guidance, and best practices for actions relevant to preventing acts of bioterrorism and the illicit use of life sciences;</text> </paragraph><paragraph id="H8E706022FB3E437EB33DBB0F90D90EBC"><enum>(3)</enum><text display-inline="yes-display-inline">support the efforts of other countries to enhance biosecurity and safety practices at laboratories and other facilities with materials that could be used in biological weapons or in an act of bioterrorism;</text> </paragraph><paragraph id="H81C334EB84014BEAAA525590521289DE"><enum>(4)</enum><text>promote the development and adoption of international guidance for the safety and security of high-risk pathogens and toxins; and</text> </paragraph><paragraph id="H010CEFFC94544472882A1D779034F2DF"><enum>(5)</enum><text display-inline="yes-display-inline">promote information sharing relating to threats and best practices between the intelligence community, Federal law enforcement, and international law enforcement and security officials.</text> </paragraph></section><section id="HE0760E255680448D95844D4E099752CB"><enum>502.</enum><header>International collaboration and information sharing relating to biosecurity</header><text display-inline="no-display-inline">The Secretary of State, in consultation with the Secretary of Homeland Security, the Secretary of Agriculture, the Secretary of Health and Human Services, and the heads of other appropriate Federal agencies, shall, as appropriate—</text> <paragraph id="HAC111FF5FB7C422389C9BDA521D42F49"><enum>(1)</enum><text>support efforts in other countries and regions to develop mechanisms and capabilities for reporting to United Nations organizations validated data on biological attacks or other phenomena that may have serious health consequences for the United States, including wide-scale fatalities or infectious disease outbreaks;</text> </paragraph><paragraph id="H5A9997E8C1C849068E3EC676FAB075FF"><enum>(2)</enum><text display-inline="yes-display-inline">engage other Federal and nongovernmental entities and other countries to advance awareness and understanding of the risk posed by information derived from the life sciences that has the potential for misuse to cause harm, and advance recommendations on how best to address such risk;</text> </paragraph><paragraph id="H96DE0A17D4214765A3FC43B376DFC697"><enum>(3)</enum><text>engage such entities and countries to promote greater awareness and understanding of the global availability of and access to life science technologies and materials; and</text> </paragraph><paragraph id="H6AB8BCC3D36644F0AECAD5390A01AF21"><enum>(4)</enum><text>promote the development and use of mechanisms for reporting, preserving, and sharing data on Federal programs and investments in international scientific, agricultural, medical, and public health collaborations in support of efforts to enhance global biosecurity.</text> </paragraph></section><section id="HDF5E325B1DE44A0C9FDE565923F10B54"><enum>503.</enum><header>Interagency task force on best practices for global biopreparedness</header> <subsection id="H3F1D806F89AA4979988C706B3E295C4E"><enum>(a)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that preparedness for a chemical, biological, radiological, or nuclear incident must be undertaken not only domestically but also internationally. Specifically, there is a need for a global preparedness architecture for such an event. Congress supports efforts to provide an international forum for discussion of key health security policies with international dimensions, and the establishment of a formal United States interagency task force to develop best practices and recommendations for implementation of a global preparedness architecture could enhance global preparedness.</text> </subsection><subsection id="H26669C8BAD084575BC187208E84B3A17"><enum>(b)</enum><header>Establishment of task force</header><text display-inline="yes-display-inline">The Secretary of State shall convene and lead an interagency task force to examine—</text> <paragraph id="HF5D9790C201D4634818E5D51AAE29FE0"><enum>(1)</enum><text>the state of global biopreparedness for a major biological event;</text> </paragraph><paragraph id="HFB4514E96CDD47CD8F49A47949E87364"><enum>(2)</enum><text>necessary components of a global biopreparedness architecture that would advance international health security, including considerations of—</text> <subparagraph id="HD90DA10C965D47509EC62940DCB48124"><enum>(A)</enum><text>risk assessments;</text> </subparagraph><subparagraph id="HEE5C2AD2F11A412DB8504FCD438E2B0B"><enum>(B)</enum><text>prevention;</text> </subparagraph><subparagraph id="HBC95D5AAC10746B9BF4CF34225340069"><enum>(C)</enum><text>protection;</text> </subparagraph><subparagraph id="H17021CC010DC4AC98D3CE402360E3F10"><enum>(D)</enum><text>regional stockpiling of medical countermeasures, including considerations of—</text> <clause id="H0F774BF62C654AD4A7CB35893E3711F5"><enum>(i)</enum><text>security of the stockpile;</text> </clause><clause id="H35327744481748F685533CBEE7BB86F6"><enum>(ii)</enum><text>preservation of the stockpile through effective detection and diagnosis, shelf life extension programs, and other means;</text> </clause><clause id="H45B435F8AE264912AE86D0CEC05205C8"><enum>(iii)</enum><text>delivery planning; and</text> </clause><clause id="H54C51577BE794B2BB9442A61106C91BA"><enum>(iv)</enum><text>legal considerations for implementing such an architecture;</text> </clause></subparagraph><subparagraph id="HE27996340D754E34951D8166487B71C7"><enum>(E)</enum><text>response and attribution;</text> </subparagraph><subparagraph id="HBBE3D7A5E9D649BA91303B6D0885FCFF"><enum>(F)</enum><text display-inline="yes-display-inline">other elements that should be a component of such an architecture; and</text> </subparagraph><subparagraph id="H9EE2C8FD7F93488DB8243CB774CFF92A"><enum>(G)</enum><text>obstacles to implementing such an architecture;</text> </subparagraph></paragraph><paragraph id="HECD51AB7771F40FAB227D0044C9D2960"><enum>(3)</enum><text display-inline="yes-display-inline">best practices for preparedness based on lessons learned from domestic efforts to address the above issues, and that may be applicable internationally;</text> </paragraph><paragraph id="H4657A6ED9E53402B865C817B215E7A70"><enum>(4)</enum><text>activities undertaken through the National Intelligence Strategy for Countering Biological Threats developed under section 202 and the International Health Regulations 2005, as well as other activities deemed relevant by the task force; and</text> </paragraph><paragraph id="H5BE0EF81ABFA4C96ABBA546BCB8B6E13"><enum>(5)</enum><text>the utility of working through existing international forums as a mechanism for distributing this information to the international community.</text> </paragraph></subsection><subsection id="HF3FAF7BD71214435A12AA0625A7248D2"><enum>(c)</enum><header>Membership</header><text display-inline="yes-display-inline">Members of the task force shall include representatives from—</text> <paragraph id="H81F7C04A620C4E18AB13BCD1A5EA0ED9"><enum>(1)</enum><text>the Department of Homeland Security;</text> </paragraph><paragraph id="H93FC415012F94CC899D76E42B497D27B"><enum>(2)</enum><text>the Department of Health and Human Services, including the Centers for Disease Control and Prevention;</text> </paragraph><paragraph id="H5DCC417108A44390AFDA025D6D155CC9"><enum>(3)</enum><text>the Department of Agriculture;</text> </paragraph><paragraph id="H87E67BDBA74C4529AF88CAFCA8BA8977"><enum>(4)</enum><text>the Department of Defense;</text> </paragraph><paragraph id="H027B4CDAB5924BFDBAD15145F66C50CC"><enum>(5)</enum><text>the Department of Justice;</text> </paragraph><paragraph id="HC2B91ACF77D1419B85DC9DFF0C2A329D"><enum>(6)</enum><text>the Department of State;</text> </paragraph><paragraph id="H1573A4BF5F274E77BE24255075966C80"><enum>(7)</enum><text>the Director of National Intelligence;</text> </paragraph><paragraph id="HBB058732BD754D779464F9D6D07B5C92"><enum>(8)</enum><text>other Federal departments and agencies, as determined appropriate by the Secretary; and</text> </paragraph><paragraph id="H3A20554C4240470A8C33D7D1307FF3CD"><enum>(9)</enum><text display-inline="yes-display-inline">national biosecurity and biodefense stakeholder community, including from the pharmaceutical and biotechnology industries, and the diagnostic laboratory community, as determined by the Secretary.</text> </paragraph></subsection><subsection id="H9B397203F0164CCA925789EEA98F37F1"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary shall submit to the appropriate congressional committees a report on the findings of the task force established under this section.</text> </subsection></section><section id="H6A367AD995BB458CA665AD154C3BB346"><enum>504.</enum><header>Biological and Toxin Weapons Convention</header><text display-inline="no-display-inline">The Secretary of State shall—</text> <paragraph id="H483D1566412A4FB895A3E2E80BCA48CB"><enum>(1)</enum><text display-inline="yes-display-inline">promote confidence in effective implementation of and compliance with the Convention on the Prohibition of the Development, Production and Stockpiling of Bacteriological (Biological) and Toxin Weapons and on their Destruction (commonly referred to as the <quote>Biological and Toxin Weapons Convention</quote>) by the States party to the Convention by promoting transparency with respect to legitimate activities and pursuing compliance diplomatically to address concerns;</text> </paragraph><paragraph id="H3C9D85F25F764EDAB583971A00BA99E9"><enum>(2)</enum><text>promote universal membership in the Convention;</text> </paragraph><paragraph id="H0D2FE9D212F94525816727E55DBDB519"><enum>(3)</enum><text display-inline="yes-display-inline">develop an action plan for increasing international adherence to the Convention;
